We write this because it’s a fact.

Meredith Nilan is a blonde. That is a fact.

One of the themes “The Good Ol’ Boys” have been preaching in the Nilan-Moore case is “stick to the facts” — as if they can’t read the designation under our byline: PLANET VALENTI News and Commentary.

Fact versus Opinion: Validity and Truth

In our professorial turns, we spend time on argumentation: The great art of rhetoric and debate. Arguments are won and lost on a person’s ability to uncover facts, understand them, and — using logic and reasoning — arrive at valid and truthful conclusions. Validity and truth are not necessarily one in logic.

We define a fact this way: Information that does not change, even as the source changes. No matter who you ask, if you want to know who won the Stanley Cup in 2011, the answer is the Boston Bruins. Even a Rangers fan has to tell you this. No matter who you ask, the answer will be Boston.

We define opinion this way: Information that can change, and usually does change, as the source changes. Ask why the Bruins won the Cup, and — depending on who you ask — you’ll get a range of different answers: Tim Thomas, tough defense, great coaching, luck, they were due, sunspots, subterranean waters, and Can Neeley.

Complying with the wishes of our GOB buddies for FACTS, therefore, THE PLANET shares only a few of the facts from the Meredith-Nilan-Peter Moore case. At least, we think these are facts, based on the best evidence made available, one our own scrutiny of the scene of the incident, public admissions in the case, information from the police, and information from other officials in the case. We will correct any that can be demonstrated as non-factual.

* FACT: Meredith Nilan was driving her daddy’s car at approximately 8:15 p.m. on the evening of Dec. 8, 2011.

* FACT: She had been at a Berkshire Young Professionals party at Allium‘s restaurant in Great Barrington, before that.

* FACT: Alcohol was consumed at the BYP party.

* FACT: According to participants at these BYP “networking” socials, alcohol plays a major part in the BYP gatherings.

* FACT: Meredith Nilan drove her car into pedestrian Peter Moore.

* FACT: Meredith Nilan’s vehicle  jumped lanes, swerved, and collided with the unfortunate man.

* FACT: Meredith Nilan did not stop and assist Moore.

* FACT: She left Moore on the side of the road, unconscious, on a freezing night, with only his dog to provide whatever comfort and warmth could be obtained.

* FACT: The dog rested against his master’s broken body, doing his best to protect the gravely injured man. The dog would not leave Peter Moore’s side, and its fur froze into a pool of his master’s blood.

* FACT: Meredith Nilan did not stop at the scene and call police.

* FACT: Meredith Nilan did not contact police until the next day.

* FACT: Public word of this accident did not leak out until well after a month later.

* FACT: THE PLANET first received word on Dec. 20.

* FACT: Meredith Nilan and her father returned to the vicinity of the accident scene.

* FACT: Meredith Nilan’s father refused to let Pittsfield Police search the vehicle that night without a court order.

* FACT: Pittsfield Police could not get a warrant from a Pittsfield judge.

* FACT: Pittsfield Police received the search warrant from Southern Berkshire District Court.

* FACT: Pittsfield Police filed  criminal misdemeanor charges against Meredith Nilan.

* FACT: On Jan. 12,  a hearing was held in Central Berkshire District Court.

* FACT: The hearing was not publicized in advance.

* FACT: The clerk magistrate of Central Berkshire Court, Christopher Speranzo, did not preside over the hearing.

* FACT: The clerk magistrate of Central Berkshire Court, Christopher Speranzo, has not made a public statement on the case.

* FACT: According to court personnel, the clerk magistrate of Central Berkshire District Court, Christopher Speranzo, has been largely, if not completely absent, from his job since this case became public.

* FACT: Clerk magistrate Christopher Speranzo makes $110,000 plus benefits annually.

* FACT: A Pittsfield detective has told THE PLANET that Christopher Speranzo “hasn’t been seen” in the courthouse for days.

* FACT: Christopher Speranzo refused to openly campaign for his seat at 3rd Berkshire District Representative in the 2009 election.

* FACT: Christopher Speranzo knew that after he won that race he would be a candidate for Central Berkshire District Court clerk magistrate.

* FACT: Christopher Speranzo knew he would be confirmed in a vote by the governor’s council strictly along political lines.

* FACT: The GOB would then, as they do now, have “their boy” in this key court position.

* First assistant clerk magistrate of Westfield District Court, Nathan Byrnes, presided over the hearing.

* FACT: Neither the press nor the public knows who chose Byrnes to hear the case.

* FACT: Neither the press nor the public knows why Byrnes, among many other magistrates, was chosen for the job.

* FACT: In a show-cause hearing to determine if criminal charges should proceed to trial, the presiding magistrate can open the proceedings to the public or not.

* FACT: Magistrate Byrnes decided to close the hearing to the public.

* FACT: Magistrate Byrnes decided to close the hearing to the press.

* FACT: Magistrate Byrnes decided to close the hearing to the victim, Peter Moore.

* FACT: Magistrate Byrnes decided to close the hearing to the victim’s attorney.

* FACT: Magistrate Byrnes decided to open the hearing to Meredith Nilan.

* FACT: Magistrate Byrnes decided to open the hearing to Clifford Nilan.

* FACT: Magistrate Byrnes decided to open the hearing to Meredith Nilan’s attorney.

* FACT: The date of the hearing was not made public.

* FACT: THE PLANET found out that the hearing had been held the day after.

* FACT: THE PLANET could only report on Jan. 13 that the hearing had been held as unconfirmed information, even though the information, as it turned out, was accurate.

* FACT: No transcripts or the hearing have been released.

* FACT: No account of the hearing has been made public except the one given by Meredith Nilan’s attorney, who said that a full, complete, evidentiary hearing had been held and that the magistrate found no cause to go any further with the case.

* FACT: The Berkshire Eagle, aka the Boring Broadsheet, reported what Meredith Nilan’s attorney had to say about the case, essentially reporting that on the basis of the evidence presented to Magistrate Byrnes, Meredith Nilan was innocent.

* FACT: The BB printed a huge, page one story on its idol, James Taylor, today.

* FACT: The BB has not printed one letter to the editor on the Nilan-Moore case.

* FACT: There’s no reason to believe that Magistrate Byrnes looked at photographs of the damaged Nilan vehicle.

* FACT: Meredith Nilan’s father is as Politically Connected as a person can be in Berkshire County.

* FACT: Nathan Byrnes found no evidentiary basis for the case to proceed.

* FACT: Peter Moore suffered a broken neck, a broken leg, brain damage, severe bruises, cuts all over his body, shock, mental trauma, and emotional trauma.

* FACT: Peter Moore faces a lengthy rehab process.

* FACT: Peter Moore will never regain his previous quality of life.

* FACT: Photographs of the car show extensive damage, consistent only with speeding.

* FACT: The head-shaped hole in the windshield of the vehicle driven by Meredith Nilan on the night in question all-but proves that only a human head — not a dog and not a deer — could have caused it.

* FACT: The head-shaped hole in the windshield of the vehicle driven by Meredith Nilan on the night in question is near the driver’s position.

* FACT: Only a person completely inattentive, unconscious, asleep, impaired by alcohol or some other substance, or in shock could not know she had hit a human being.

* FACT: Nathan Byrnes ruled not enough evidence to let the case be tried in court.

* FACT: Meredith Nilan’s father is Politically Connected.

* FACT: Nathan Bynes ruled not enough evidence to let the case proceed to trial.

* FACT: Meredith Nilan’s father is Politically Connected.

* FACT: Nathan Byrnes ruled in a secret hearing with the victim and his attorney NOT PRESENT that there was not enough evidence to proceed.

* FACT: Meredith Nilan’s father is Politically Connected.

* FACT: Meredith Nilan’s father demonstrated he would not hesitate to use his position of power in the case of Angelo Stracuzzi.

* FACT: Meredith Nilan has not made any public statement on the case.

* FACT: Meredith Nilan has not made a public or private apology to Peter Moore.

* FACT: Meredith Nilan has not made a public or private expression of concern for Peter Moore injuries.

* FACT: Meredith Nilan’s father is Politically Connected.

* FACT: Meredith Nilan’s father supervised the “probation” of  convicted criminal Angelo Stracuzzi.

* FACT: Meredith Nilan’s father, while serving on the board and in a fiduciary executive position at the county’s largest financial institution, said nothing for five years on charges of child molestation filed by police in Biddeford, Maine, against convicted criminal Angelo Stracuzzi.

* FACT: Meredith Nilan’s father, while serving on the board and in a fiduciary executive position at the county’s largest financial institution, said nothing when convicted criminal Angelo Stracuzzi pled guilty to two counts against two Maine boys, one age 13 and one age 15.

There was a blonde who found herself sitting next to a Lawyer on an airplane. The lawyer just kept bugging the blonde wanting her to play a game of intelligence. Finally, the lawyer offered her 10 to 1 odds, and said every time the blonde could not answer one of his questions, she owed him $5, but every time he could not answer hers, he’d give her $50.00. The lawyer figured he could not lose, and the blonde reluctantly accepted.

The lawyer first asked, “What is the distance between the Earth and the nearest star?”

There is only one person that knows exactly what happened that night, and unless the truth is (or has been) told, none of us ever will know differently. I understand that there are people that are upset about the situation, but this is a criminal proceeding left up to due process, for both the victim and the accused. I think THE PLANET’S relevant points are made about process, but considering that any accused or any victim, regardless of stature in the community, could be treated this way by both the system and the public is difficult for me to comprehend.

I am unimpressed by the ranting and raving about GOB’s or ‘daddy’s’ influence because these are not FACTS. There is no metric to define them. Awful situation, but so was the apathy when the director of a local not-for-profit sturck and killed a man not so long ago.

Excuse me, Shakes His Head, but that “director of a local not-for-profit” was charged and went to court. She didn’t have daddy paving the way for a free pass on responsibility. Kris Hazzard was charged, taken to court, no magistrate, no “sorry, I just can’t see any facts to take this any further” wink, wink “trial.” I’d hardly call that apathy. She went through, and continues to go through, the system as it was designed to take place… not as the Nilans have bastardized it. And those are facts.

@shakes he head,That seems weird since two people were at the scene.Yes,there are some facts that only she knows and that will keep her from being charged with DWI. But how could anybody not think there is not enough evidence to go to court for leaving the scene.

There are subjective statements in the 77 “facts” listed above. I am not stating that there is a wrong or a right here, just that the community was at peace when another allegedly ‘connected’ person was in somewhat similar tragic circumstances. The community needs to be patient while the same due process that each and every one of us, no matter how guilty or innocent, is entitled plays out. We the people should moderate our emotions with patience.

Here we go with all the sympathy for Meredith.

This fine upstanding young woman nearly killed someone. She was callous enough to not stick around the scene of the accident, even though she claims she thought she hit a dog or a deer. Here actions and inactions left Mr Moore on the side of the road, perhaps to die.

Cannot tell the difference between a dog and a deer and a human.

DV, can you please ask your buddy Gov. Deval Patrick what the mechanism is by which Berkshire County taxpayers can remove from his lifetime appointment the do-nothing new clerk-magistrate Chris Speranzo whom Patrick for god-knows-what reason saddled all of us with.

Rick This is what Ive been saying all along. Now Ray Ovac wants to oust Speranzo just because he does not like him. Did anyone check to see if he is sick or maybe there is a good reason he is out of work? Maybe he’s been at work all this time and somebody is spreading lies about him. Not so. I don’t even know the guy. But here you have a guy who was a no-show at the start being handed a six-figure lifetime appointment. One would expect that for six-figures annually the state/county would get something for its money.
If this were GE with Jack Welch in charge and Speranzo had exhibited this low level of productivity weeks after being given a promotion to the position, what do you think Jack Welch would do?

Who the hell is in charge over that court anyway??? Not Speranzo, he not been seen, Not Judge Rutberg he is to busy letting criminals go. Maybe he should run for Governor of Mississippi. Not one of the Asst. clerks she being investigated for leaking info to the Eagle. Not Judge Koenig, Speranzo threw her out of her office so he could have an office that the public don’t walk by. And the beat goes on over there.

All DV facts add up to this case stinks and needs to be investigated and the public needs answers.

The facts here, and as Dan says, anything not a fact, please let a person with better knowledge to come forward, like Mr. Nilan, but all the facts show clearly theres a good reason to believe Nilan used his position to win favortism for his daughter in a court proceeding. Hes an officer of the court. Isn’t he sworn to uphold the law? This case stinks and until an investigation looks at it I will not trust anything in Pittsfield right now even Dan Bianchi. Mr. New Mayor: Say something for us, the peeps. Or now that you are elected do we matter to you anymore?

In all fairness, it isn’t appropriate for the Mayor to comment on an “on-going investigation” case. He can’t comment on it! Of course, we still don’t know IF it’s an “ongoing investigation” or if the appeal was refused, thus ending any criminal investigations, trials, etc.

I must say, Dan, that your comments today are not one of my favorite to say the least. I get, and agree with, your major point — you ruined it, and sleazed it down using the “blonde jokes” (and no – I’m not blonde).

On a completely different subject, the Eagle printed a fluff article today about WMECO and Ward 4 City Councilor working together to allow abutting homeowners to keep structures on WMECO property that were built there without WMECO’s permission. The Eagle listed structures such as fences, sheds, and even in-ground pools. The whole tone of the article was warm and fuzzy.

I want to know how these structures were built in the first place. Listed below are the issues:
1) Fences, sheds and in-ground pools require a building permit.
2) The city would not issue a permit for a homeowner to build on utility owned land.
3) Can we assume that these structures are not permitted and therefore illegal?
4) Does WMECO and a City Councilor have the authority to bypass the permitting process?
5) How often does WMECO inspect and maintain their properties?
What is wrong with this city? It seems that these rules are for suckers.

Maybe Councilor Connell would like to explain why Ward 4 residents do not require building permits.

Excellent points! And when some kid drowns in one of the in-ground pools, they’ll sue WMECO for not having proper fences, supervision, etc. Not that I’m any fan of WMECO, just saying…

This is all very cute about the difference between facts and opinions but the placement and wording of facts can be as influential and biased as anything, which was obviously done in this post. I’m not excusing this girl’s actions for one second, but let’s call it like it is. You have no proof she was under the influence but you have no problem stating “facts” which suggest as such. So that’s pure speculation. You have no proof the Mr. Nilan used his sinister political influence in any way. Again, pure speculation. Additionally, you probably should have included on this list of facts that it makes perfect sense for a clerk magistrate from a district outside of Berkshire County to preside over the hearing for the obvious purpose of trying to avoid accusations of impropriety.

Also, not to take anything away from the victim, but can it be proven in any way that his quality of life will never be the same? Has that been stated by a medical professional or physical therapist? Because all that’s been reported over and over again is a list of injuries that clearly wasn’t quoted from any hospital, as a “calf bone” does not exist in any anatomy book I’ve ever read.

You must be twelve or your quality of life must be a couch potato. Don’t check with a medical professional or therapist check with the people who have had head, neck, spine injuries and broken bones when they are in their 50’s and older. Can I jog, ski or even get out of bed without pain? I can watch TV with the best of them.

Soooooo, the BB interviews Capeless & makes him look even worse than his saying nada. Obviously, Capeless has come off of the BB’s protected list of GOB’s!!! Something happened! That was a horrible interview for Capeless! But they had him right there, asking questions of him because he’s taken a lot of heat from the public lately, and they don’t even ask him about the Nilan case at all?? Hellloooooooo!!!! Not even “has there been a ruling on the appeal yet?” Nothing!!! So obviously, others still remain on the BB’s protected list!!!!! The most interesting question was “is the DA’s office equiped to handle this case” and Capeless asked why anyone would even think that? Wellllllll, this interview didn’t leave me with a “warm & fuzzy” for our DA’s office!!!

Does anyone on here know why it is that the citizens of Pittsfield can’t know the outcome of the judge’s ruling on the appeal? “They” can really shut that hearing down THAT much?

Perhaps Capeless tried to give an interview that would relieve some of the pressure he’s gotten over the Hall case, knowing that there’s much more to come over the Nilan case… But certainly just speculation as THE BB NEVER ASKED!!! Or at least didn’t print that they asked… I think it’s getting to be time to start making calls to the television media, the Atty General’s office and the Feds, insisting upon a full investigation of the Nilan case (and no, not because she’s blonde…. And no blonde jokes included in the request).

who does no show answer to???? who is speranzos superiors??? you want to find out how crooked deval is then find out the chain of command. these for life positions answer to no one, they just suck the tax money up….. thats mass. politics in action…. after all it was proven that that position is not needed… because its a life position it should be on a referendum ballot for we the people to vote on…. after all if we let politicians make for life jobs, you know its crooked…..

Would not an honorable man be concerned about public opinion? Or are we so far down the road that public officials, once elected or appointed, just don’t give a stool about the people that put them where they are?

I think everyone who does business with Berkshire Bank should boycott them because of Ms. Nilan employment there and let the brass know how you feel about her drunken night and all the havoc she caused one man and his dog. Capeless is truly a coward and should be booted from his office for more than his mishandling of the Adam Lee Hall case, he and his cronnies have botched a many, unfortunately anyone who is conected is treated the same as Meredith and they are above the law, Pittsfield is truly a crack infested rat hole of a city with jokers in the court house and PPD. Have you ever spent some time in the court house watching what goes on, the biggest waste of taxpayers money you’ll ever see more people standing around doing nadda and acomplishing nadda.

dusty, politicians write the laws that protect them, in washington its ok for the people on the finance committees to engage in insider trading with wall street,(the law they wrote says its ok) with facts like that , and their pay and perks, do you ever wonder why “for life jobs” are ever dreamed up…. who sat around years ago and said gee whiz lets make it a life position, give the position perks and privileges above all and see if some one applies for the job?….. and when they do ,we will pick the person who better served the sitting governor and not the most qualified….. just the fact that this job even exists is beyond me.this is why all politics, local, state, and washington is broken. they have eliminated we the people.

We need to enact a couple of very simple laws and apply them to all politicians.

1. You cannot run for re-election if your budgets are not balanced.

2. Two terms maximum for any political position.

3. Make political campaign funding capped with limits on spending.

ive seen many cars and trucks, both parked and moving on both sides of the road. For example, on trash day the garbage truck is often on the wrong side of the road, so if they hit someone or something would that be considered jumping lanes? how about FedEx and UPS or the Mailmen?

Dear concerned you have zero knowledge is your accusation of what goes on in the court house. These are just your opinions and your trying to buffalo people into thinking there is scandalism going on inside the court house. Keep to yourself until you have some hard evidence.

Moores accident is a tragic thing, at same time think of your own child would you not do everything in your power to protect them?
