(FORTRESS OF SOLITUDE, TUESDAY, MARCH 27, 2012) — We’re not sorry we haven’t fallen for the Trayvon Martin overreaction. The teenager lost his life, prematurely, and for that we are sorry. We will not, however, join the mindless herd in wanting to turn this unfortunate boy into a political cause. As racial flash points, this case is serving up seconds, but the knee-jerk variety of the false concern saddens us more than any other aspect of this story.

The Other Side of the Story

Lost in all the knee-jerk tumult over the Martin’s shooting is the story of the shooter, George Zimmerman. You probably haven’t heard Zimmerman’s side of the story, how, according to a statement given to police, Martin knocked Zimmerman down, repeatedly smashed his head into the ground, and tried to take his gun.

That account of the vicious assault allegedly perpetrated doesn’t fit with the Trayton Martin, Saint and Martyr scenario, and so those who wish everything to be neatly black and white dismiss it. We have found this to be a characteristic of those who cannot handle the refutation part of debate: Dismiss everything that doesn’t conform to your pre-existing world view.

You also probably did not hear of the eyewitness testimony of Austin Brown, 13, who told police he saw Zimmerman on the grass moaning and crying for help only a few seconds before Brown heard the gunshot that killed Martin. And did you know why Martin was staying in Sanford, Fla., at the house of his father’s girlfriend? He was there because he had been kicked out of Krop High School in Miami, Fla. School officials tossed him after they found what they said was a bag of pot.

When you take a closer look, the Martin boy isn’t the innocent victim he first appears to be.

Now we got The Rev. Al Sharpton milking the case to revive his flagging public profile and Travon’s grieving mother filing for trademark protection on the sayings “I am Trayvon” and “Justice for Trayvon.” DVDs, CD, books, T-shirts, and other merchandise are said to be in the works. That’s enough for us to make us proud of the fact that neither we nor anyone we knew took part in the ridiculous “Hoodie” protest at Park Square, Pittsfield recently.

NILAN-MOORE SOURCES ADD TO INTRIGUE

With the Nilan-Moore Case now in the recesses of judicial bantering and not set for an official court appearance until early May, we are hearing the same sensational tidbits that you are, the ones that seem determined to add a soap opera aspect to a case that doesn’t need it.

So we will leave the amorific mutterings to the gossipers and present, rather, these items:

* DNA MATCH — According to sources familiar with the investigation, the Massachusetts state police conducted the forensic investigation of the 2001 Suburu Forester SUV before the car was repaired. Police found fibers and other evidence on the vehicle that matched Peter Moore’s DNA, according to the source.

* ALL NEW, LIKE NOTHING EVER HAPPENED — Shortly after the accident (just how soon we don’t know, but in a mighty hurry), the Nilans had the vehicle repaired, sources say. All front end damage was fixed, and the tell-tale windshield, with its head-sized hole, was replaced, according to sources. In fact, it appears that Meredith Nilan is using the repaired vehicle to this day. One would think that the vehicle in question would have been impounded by authorities and preserved in its original, damaged condition, for possible forensic evidence and for use in future court proceedings, but apparently that is not the case. It appears that the Nilans retained or were given control of the vehicle, and it looks like they didn’t waste much time in getting the signature signs of body trauma removed. Now don’t that beat all?

* IS NO SHOW STONEWALLING COPS? — Why is the office of Clerk Magistrate Christopher Speranzo stonewalling the police department on even its most routine requests? We hear from police sources that is what No Show is doing. If this is true, at what point, if any, we wonder, does his action become obstruction of justice? The question still looms: How difficult should it be for the police to get a copy of the audio tape of the Nathan Byrnes show-cause hearing? And what of the missing papers, cited by Nilan attorney Tim Shugrue in his initial motion to have the case dismissed? What was missing? What was the chain of evidence? Exactly what kind of security for evidence does the Pittsfield court maintain?

* MYSTERIOUS PHONE CALL — And did Meredith Nilan place a phone call to Berkshire Medical Center on Friday, Dec. 9, 2011, inquiring into the status of Peter Moore’s health? Our sources, familiar with that part of the phone logs, are claiming that such a call occurred. Sources say Nilan made the call sometime prior to her 11 a.m. meeting with police on Dec. 9. If this is true, it would seem to indicate (a) that she knew she hit a human being and (b) she knew she hit Peter Moore.

NUCIFORO RIPS NEAL FOR PAYMENTS TO SON

Andrea Nuciforo, congressional candidate, is calling out his opponent, longtime incumbent Richie Neal, for past payments of nearly $30,000 to Neal’s son during campaigns in which Neal went unopposed.

In a statement released yesterday, Nuciforo is claiming that Neal paid his son, Brendan, $28,500 from his campaign treasury during the 2008 primary and general elections. Neal ran unopposed in that race.

Nuciforo said, “While I have no reason to doubt Brendan’s skills as a proxy to his father, Neal’s donors deserve to know what contribution ‘an invaluable surrogate’ provided during two election cycles in which his father ran completely unopposed. I think he owes his voters and donors an explanation.”

Nuciforo concluded, “I couldn’t agree more with the report [released by the Citizens for Responsibility and Ethics]: This is the kind of campaign finance behavior that causes voters to lose faith in their elected officials. Look, the $28,500 Richie Neal gave his son pales when compared with the $5,474,147 Wall Street big banks, insurers, and PACs have given his father over the last 24 years.”

Nuciforo raised over 6 figures from big banks and insurance companies when he was a state Senator. Now Nuciforo is criticizing his opponent Richard Neal for raising millions in special interest dollars from financial institutions. How would Nuciforo be any different from Neal? I mean, Neal and Nuciforo are both Democrats, both have public records of being in bed with financial special interests, and both would vote for the same party leadership and support the same political agenda. Nuciforo is a hypocrite!

Clearly there was a scuffle. But who provoked it? 911 told Zimmerman NOT to follow Martin and he did so anyway. Maybe Martin did try to go for the gun — but why was the gun out in the first place? Why did Zimmerman even HAVE a gun when neigthborhood eatch folks are not suppsed to be armed? Why did he leave his car after being told NOT to follow Martin? Did he approach Martin in a threatening manner (thereby making HIM “fear for his life” and fight back?) Who pushed first? We will never know.

As for whether or not Martin was suspended from school, that makes NO DIFFERENCE to me because Zimmerman didn’t even know who the kid was. I see this as just an attempt to smear his reputation in order to say, “See? It wasn’t so bad, the kid was a delinquent.”

It is true that this has become a flashpoint, but it is also true that young black males (as well as other minortities) get negatively profiled all the time, making this issue much more than the death of Treyvon Martin (as tragic as that is.)

Zimmerman is a minority himself. In Fla pretty much anyone can have a gun it’s not like Mass. We will never know what happened because it’s been too polluted by the media every source is saying different hopefully it goes to a grand jury then everyone can get on with their lives after. Also we see a 17 year old for a child I think a lot of people are naive to the reality of how violent some of these kids can be.

The media took a one sided look at the Trayvon Martin story and you are correct in pointing out, there is the other side to be heard. However, the 911 calls make it clear that Zimmerman was following Martin. Sounds of breathing and footsteps indicate he was probably chasing him. He could have stayed in his car and kept his distance. The altercation was instigated by Zimmerman and he got his ass kicked (arguably a deserved ass kicking). The kid did not deserve to die. One could argue, had the kid gotten the gun away from Zimmerman, he would have been justified in shooting. Would there have been an arrest had that been the case? I don’t think there is any doubt.

For those who instantly read Valenti’s take on matters and use his opinion as their own, consider this about the Trayvon shooting:

1) Why he was in Florida to begin with (and the fact that he GASP! smoked marijuana) has literally nothing to do with anything. Absolutely nothing.

2) The law in Florda (stand your ground law) is not applicable in this situation (according to the creator of the law). You can’t follow a person, intimidate them and then, when things don’t go your way, shoot that person.

3) Only one person was armed that day and it was Zimmerman. Only one person had the intention of confronting somebody and it was Zimmerman. Only one person was told by the 911 dispatcher to not follow the boy and it was Zimmerman.

4) Zimmerman had literally no authority to follow, confront and shoot this boy. He wasn’t law enforcement and, according to the letter of the law, had no legal authority to kill him.

5) If Dan had actually spent any time looking at the vast majority of news coverage he would see that almost everybody is condemning not simply Zimmerman but the hasty and questionable investigation and findings of the police. To make no arrests, to not bring anybody in for questioning and to let Zimmerman keep the gun are not signs of a competent and thorough investigation.

Dan, local celebrity that he is, is heavily emotionally invested in the peculiarities and circumstances of local hit and runs in Pittsfield. So I wonder why, when he rails against the GOBs of Pittsfield, an area he intimately knows, is he so ready to accept the “facts” of those same GOBs of a town he has no previous knowledge of?

It’s the same skepticism of law enforcement and power dynamics which fuel so much of Dan’s outrage that is fueling the outrage over the Zimmerman/Trayvon shooting. It’s curious that Dan has come down so clearly and quickly on the side of Zimmerman and those in power.

The character of the young man is relevant to determining what kind of response he would make in that situation. Someone who gets suspended for bringing drugs and presumably stolen jewellery to school is not a “nice quiet young man”, and could plausibly start a street brawl.

As a neighborhood watch captain, Zimmerman was sanctioned by his community to take action. It would have been smarter to wait for backup, but following someone is not a crime, nor is defending yourself by any means possible when physically attacked.

I’ll agree that the police response was questionable, but it was probably colored by the guy’s involvement in “neighborhood watch”, which is a government intrusion into private life that few people criticize.

You’re leaving out the fact that Martin was trespassing and as citizens we do have the right to defend our communities from criminals. Yes it was stupid for zimmerman to not obey the 911 operator but he’s sick of crime in his gated community and didn’t want the guy to get away.

Louis Allegrone, of the Allegrone Construction Family(who built the new Kelly’s in Dalton, where BYP also recently had an event…see the connection?) is the boyfriend of Meredith Nilan.
He is also the person who she called immediately after hitting Peter Moore, before calling her father, and before calling police. According to statements, he told her to drive home immediately, hide the car in the garage while he and another person(either Meredith or Cliff) drove over to the scene in a dark SUV before the police arrived or potentially were called. What they were doing we don’t know, most likely tampering with, or destroying evidence.

I’ve lived in Florida, the outer reaches of Naples to be exact. During that time there were several times when I found strange men wandering through my property (3 acres bordering a canal with no visible neighbors). Under Florida Stand-Your-Ground law it would have been completely within my rights to shoot them. Fortunately, despite my fear, reason prevailed I made a phone call and I found out they were immigrants picking palmetto berries.

I relay this because at that time there was a very frightened young woman, alone in the woods with a small mob of men coming from the back of my property down both sides of the house. Basically surrounding me. I hid in a spare bedroom, on the floor peeking out the window while I made my phone call. I was not an armed man, in a car on the phone with the authorities telling them those **** do this all the time. I, and those like me, are who that law was made for.

This is not a black and white issue. This is a matter of right and wrong. It’s not that some asshole picked up a gun and went hunting in a gated community. The issue is what happened after that gun shot. Zimmerman claims he was attacked (after following and scaring the hell out of this kid). We are taught as children to fight, fight, fight if we are in a position of being abducted, threatened, hurt. If that is what this child did, after being followed through the community, than wouldn’t he have been utilizing his right to Stand-Your-Ground using the only thing he had, his young 17 year-old scrawny body.

The outrage comes not only that his man shot this boy, but that at first blush, the police did nothing about it. They did not detain the shooter. They did not strip him of his rights nor his gun. They did not pursue any actions until higher authorities were contacted. Then, and only then did they look further into the events of that night.

This is not a black and white issue.

You are so far off the mark I find your analogy laughable. Zimmerman wasn’t beaten (to death or otherwise). Did you actually see the booking photo? He supposedily had a broken nose, but no swelling, no raccoon eyes, no visible damage. Redness is immediate, as is swelling while bruising can take up to two hours (probably the amount of time between being ‘beaten’ and booked). He looked absolutely fine. Now, as we all know, looks can be deceiving. All the way around. Just because you have baggy pants and a hoodie does not mean you are gangsta’ It does however mean you are like many young men in today’s society. Look around – black, white, brown, yellow, red. This seems to be the standard uniform.

The palmetto pickers, as you call them, were polite when approached and would leave your property when asked. Hell, they had to be – they were stealing a pricey bunch of berries. I had the right to protect myself as I saw fit. It’s hard to justify shooting a polite berry picker.

For you to surmise that young Martin beat this gun toting man nearly “to death” is interesting. Just as Zimmerman jumped to conclusions, so are you.

FYI – my father, a wonderful man, was handicapped due to polio as a boy. He learned at a young age to defend himself with words very effectively. That man could cut to the bone with nothing more than his wit.

Fair enough, but it really comes down to what evidence there is and how believable Zimmerman is…and it still might be impossible to verify exactly what happened. Zimmerman could have even shot him in cold blood and then broken his own nose for cover, but there are also scenarios where the shooting was justified.

Dee, I agree with you 100%…the race aspect has spun out of control, but the police response, the phone records, and the booking photos have proven that Zimmerman is being protected by a GOB network. The Stand Your Ground law will serve to keep me, and I’m sure many others out of that particular community, and any town that adopts that wild west law. (Not that I’ve ever wanted to visit Florida to begin with, haha)……cue the “southern man don’t need you around anyhow” mantra!

For the first 4 or 5 days, it was being reported that he was white. Then it finally came out in only a small subset of the media that he is half Hispanic. I’m SURE that Obama and his people didn’t know that, especially with a last name of Zimmerman. It likely never occurred to them that he’s Hispanic. Ut oh – there goes some of that Hispanic vote!

Zimmerman did not follow Trayvon, he lost sight of him, went back to his car and then was assaulted by Trayvon. To the point that Trayvon tried to take Zimmerman’s gun.

Trayvon’s mother said “they killed my son” who is “they”? It was a single man defending himself against a thug, not some smiling little boy in a football uniform. I suspect the “they” isn’t the news media as they jumped to the defense of Trayvon and are now having to back peddle as the facts come out.

Now the New Black Panthers are offering a reward for Zimmerman, they are now claiming they are an Army?
Maybe Obama will send them to GITMO.

Now onto Nilan. Yes she knew she hit him, my sources say she did it on purpose as they were allegedly lovers and he had just broken up with her (allegedly). She confided as much to her morning running partner, are the police searching for this witness of a crime after the fact?. My question is are the police investigating this as attempted murder?

The media loves a good old fashioned racial prejudice story. It is sad to see their white guilt stirring up racial outrage. I wish more outlets were reporting all the facts in an objective manner. The media will fare as well with the Trayvon case as they did with Crystal Magnum, Tawana Brawley and the Jena 6.

Concerned, Steve Wade, and Molly you are all correct in your support of my step son Peter who wouldn’t have had time to have an affair with anybody let alone a 24 year old. Of course Ms. Nilan should know who he was, HE LIVES IN HER NEIGHBORHOOD AND JOGGED BY HER HOUSE ALMOST DAILEY! Peter’s step daughter was only a few grades behind her in school. Ms. Nilan has been in Robin’s office, is somebody going to dream up a rumor about that too! Pittsfield is a small community and people do know one another without having affairs. Peter is a victim of a crime and should be given the rights that under Mass. Law Crime Victims are entitled too. So far no one from the District Attorney’s Office has contacted him regarding those Rights and Resources which should be available to him. THIS HAS GONE ON LONG ENOUGH! The next court date, May 2, will be almost 5 months since Ms. Nilan mowed him down and she has yet to utter one word of regret for the injuries she has caused him and his wife and children.

Well said. Peter, in my mind, has never been treated like the victim in this — it’s been all about “the Nilan’s” and how they continue to try to out-maneuver the courts. It is intolerable that no one has contacted him about his victim rights and what resources are available to him.

She won’t utter a single thing of regret as that would be an admission of guilt and she won’t do that. Don’t forget, you’re talking about a person who was able to leave him in the road to die – the only thing that she regrets is getting caught at that.

I’m glad that D.V. isn’t publishing outright rumors in the Nilan case on his site. If there are some facts to support them, then fine. And if not, people like to dream up all kinds of things. He has continued to show the respectability of this site by giving facts.

re: Trayvon Martin. This is a tragic case — it just is. He was so young and any wrongful death of a young teenager is a tragedy. However, it is very clear to me that Obama has intentionally made this into a “race issue” – he’s trying to fire up the black community (community organizer that he is) to get out to the polls as this time, they just weren’t going to do that!

He has a history of dividing this country and bringing up the race issue — recall the Harvard guy and the Cambridge Police? And the beer summit? He has done this numerous times and it’s intolerable! He’s done it to the point where white people are saying, “hey – wait a minute!” and then either getting knocked down for that or feel guilty because of it. I believe this country HAS come a very long way and he has succeeded in tearing a lot of that down. And the media! OMG! It has been the top story every single night for about 2 weeks now! I can’t keep listening to the same sound bites, the same info – it’s awful! And I find them to be so biased, too! The media has a responsibility to report on ALL the facts and they haven’t lived up to their responsibility. Hence, another indication that this is all orchestrated by “The Community Organizer”… And today, Congress is now involved as well – the Democrats — oh surprise, surprise! And just how are we suppose to get a non-biased jury after all the biased press, the President’s remarks and now Congress?

Also, as our leader, he should be at the microphone urging things NOT to happen and instead, he’s done just the opposite. What about the black panthers trying to organize 10,000 black men to hunt down Zimmerman and kill him? Where is Obama’s microphone on that? What about trying to unite our country and calming down the black community and asking them to trust in our criminal justice system? I find it outrageous! And the fact that the mother has taken out trademarks on those things is equally outrageous, and speaks volumes! Everyone was so outraged, but because we weren’t hearing any of the details about Zimmerman and once the officials released some of that, now they’re trying to ruin Treyvon in death, too? What?

Why aren’t Al Sharpton and Jesse Jackson and Obama out there constantly trying to do something about all of the blacks shooting blacks – there were 42 blacks shot in Chicago in one weekend – by other blacks. That is ALSO a tragedy! As are all of the links that were posted here about blacks killing whites and other whites killing blacks that we haven’t heard of. It is ALL a tragedy and this President is just urging this on based on race for his own gain. Very sad, indeed.

I don’t know. Perhaps I am stoking the proverbial fire, but the more “facts” about the Nilan incident that I read, the more my eyes burn.This “vile” rumor continues to pop up in a variety of places, from a variety of people, and raise more red flags than a communist party parade. The sensationalistic nature of this story is very hard to ignore, and the more questions we ask, the harder it’s going to be to hide the truth. Perhaps the reason that the Moore’s are not pushing all this so hard is because there is some truth to this, and they don’t want to deal with public embarrassment? Not saying this let’s Nilan’s off the hook by any means, but should these allegations have truth, then what she did, and what her father and company have done are far more serious transgressions than just sweeping an an accidental drunk driving hit and run under the rug. Does the Cliff really know what happened or is Meredith and Allegrone playing him for a dummy too? Does he think that he can put in The Fix on this and get away with it because he doesn’t know how serious this really could be? There is possibly something explosive behind this, something far more nefarious than a simple DUI hit and run.

Telephone records, if made public in this case would surely expose the truth. Perhaps she called the hospital before her meeting with police to see if he was going to die, and when she heard he was going to live, she and Allegrone prepared a story for the police that cast doubt on the whole nature of what happened? And if both her and the BF were interviewed, were they interviewed separately as a means of flushing out inconsistencies between their two stories?

And did she call Allegrone to the scene before anyone else, asking him to come and finish the job that she didn’t do when she pulled Peter from her windshield and realized he was still alive? And when they got back to the scene and peter was gone, did they then concoct this story about a deer or dog and tell that to daddy, and pull the wool over his eyes too?

This all reeks of something far more sinister than what we all know right now. We need to ask all these questions, as unpleasant as they are. Pressure is going to be what flushes out the truth.

Perhaps you need to get a life — you are literally dreaming up all kinds of things and scenarios. I can very easily come up with a few totally different scenarios that involves other people that have not been previously mentioned as being involved in this case, but really ‘could be’. And if it weren’t for the fact that I would be maliciously spreading rumors that had no basis in fact by giving you an example, I’d give you a great example — and at the end, you’d be saying, “hmmmmm – that really could be! And I bet it is!”

Get over it! Peter Moore and his family are VICTIMS! Stop making this horrific experience of theirs worse! She hit him because she was likely drunk, or texting, or putting on makeup, or all and at the same time.

What is wrong with people? This case isn’t currently bad enough with her hitting a man and leaving him to die and Cliff Nilan trying to cover it up? You need to, in your your imagination, make it somehow more sinister? As I said, get a life!

So what that I have an imagination? Are you jealous that you may lack that creativity? Last time I checked it’s a free country to speak my mind. And didn’t I preface my post by saying that I was essentially speculating? Most of my sentences end with questions marks, and are simply that, questions. You continue to imply that the buck stops with you on this matter, and make statements that are positioned as facts. What makes you the authority?

You spend a lot of time on here replying to people blasting them about how stupid they are for having their own opinions. I don’t go around replying to your posts that I find to be provocative telling you to get a life. Your self aggrandizing is annoying.

Imagination can be a wonderful thing – but not when you’re using it to smear people who are already victims, with absolutely NO, NONE, ZERO basis in any fact at all.

I am merely giving my opinion of your doing that – that you are being very irresponsible to say the least. That is my opinion – I don’t expect you to like it. And yes, this IS, thankfully, a free country and we all can speak our minds – hence I did in reply to your being outrageous, irresponsible, and with an over active imagination that could be put to good use in other areas. And oh by the way – I think you need to look in the mirror on the “self aggrandizing” – why else would you be posting things like this?

If you need some real problems to be concerned about to take up your time and which need some creativity to solve, I can send a few…

I am too aware of the hard hitting but respectable way Mr. Valenti has handled his coverage of the Nilan case. I’m sure he hears all the rumors but he has only gone with fact and supposition based on fact. His has been the one reliable source for information in the case all along.

Trayvon isn’t this angel the media (with there 12 year old pictures) want us to believe he is. He assulted a school bus driver before than bragged about it on his Twitter page that he sold marijuana off of and went by the name NO_LIMIT_NIGGA. I must say that yes the media is crazy in their non stop attention of the Trayvon case but also that I am appaled at the callousness and plain disgusting implications of some of you people, whom I normally resepect, even if we disagree, on some of your twisting of the facts of this case. Which are plain and simple. A young 17 yr old African American boy was walking, armed only with skittles and ice tea, and was shot dead, point blank range by someone 10 yrs older and 100 pounds heavier and was actively pursuing this young man after having been told multiple times to stop following/chasing him.
Those are the facts PERIOD….baggy pants, hoodies are no different to this generation than ripped jeans, earings and leather jackets were to the older generation. Traces of Pot makes this guy Charles Manson, c’mon. You guys have gone way OFF the road with your assesment of this kid and this case. In my opinion , you should all be ashamed at your blindness and lack of senstivity and basic human compassion.

Sad thing it happens every day.There are people shot and killed every day.It is the duty of the DA and police to do there jobs.In Ttrayvon’s case the police wanted to press charges,but were overuled.Thankfully common sense prevailed.Let the the courts deceide the truth.
