CITY’s WATER WOES KEEP DRIP, DRIP, DRIPPING … EPA THREATENS ACTION … WILL COUNCIL’S ‘FANTASTIC FOUR’ STICK TO THEIR GUNS? THE HEAT IS ON

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION, APRIL 13-18, 2018) — The recent vote of the Pittsfield City Council to defeat the Tyer Administration’s proposal to borrow nearly $80 million to pay for unfunded mandates ordered by the federal government’s Environmental Protection Agency (EPA) to the city’s waste water treatment facility off Holmes Road didn’t stop the water torture for the city’s bedraggled taxpayers. It only postponed it.

This week, the EPA sent another scare to Mayor Linda Tyer and council president Peter Marchetti. It came in the form of a long letter that can be boiled down to two points:

(a) We (the EPA) are aware of what your council did.

(b) If by the end of June you haven’t agreed to the upgrades we are demanding, you will be severely punished.

THE PLANET calls this “Your tax dollars hard at work.”

It’s ironic that the EPA should be demanding anything of anybody right now, given the charges of corruption that have been brought public by former Trump campaign aide and later EPA political appointee Kevin Chmielewski. He blew the whistle to House and Senate investigators on the EPA administration, particularly alleged wrongdoings by current administrator Scott Pruitt.

Chmielewski charges:

— Pruitt blew past an allotted $5,000 budget to redecorate his office by leasing works of art from the Smithsonian and building a $43,000 sound proof booth.

— Pruitt used EPA Director of Scheduling and Advance Millan Hupp as his personal real estate representative and spending considerable time and agency resources to find a home.

— Pruitt “100 percent” approved pay raises for favored staff even after the White House blocked the salary increases.

— Pruitt’s energy lobbyist landlord complained over speaker phone that he never paid him rent for the condo, and that Pruitt’s daughter was scraping the hardwood floors with her luggage.

— Pruitt attempted to sign a $100,000 per month lease for use of a private jet.

— Pruitt directed staff to find reasons for him to travel home to Oklahoma on taxpayers’ dime during long weekends.

— His chief-of-staff was told not to attend travel planning meetings after objecting to stays at expensive hotels and costly flights.

— Scheduling international trips based on places he’d like to visit as opposed to where work required him to go.

— Pruitt paid $30,000 for private security detail.

In short, the EPA has no moral right to be demanding anything of anybody at this time. Organizations and systems rot from the top down, as a generation of Pittsfield politics has proven. With EPA leadership allegedly so bankrupt, the proper response for the city of Pittsfield will be to call the EPA’s bluff. Should the agency attempt to go forward with fines, the city can appeal this through the roof, and win.

Attached please find a letter that I and President Marchetti received yesterday afternoon from the Environmental Protection Agency regarding the city’s permit and administrative order for the upgrades at the wastewater treatment plant. I consider this an urgent matter and intend to submit an authorization for funding at the Tuesday, April 24 meeting. After you’ve had a chance to review the attached letter please feel free to contact either myself, Attorney Dohoney, or Commissioner Turocy with any questions you may have. In addition, President Marchetti was present at the session with Ms. Dunn, the EPA Region One Administrator, and her team.

Due to a long standing commitment I will not be in attendance at the April 24 meeting. However, the city’s administrative team, all of whom have been actively engaged in this process, will be present at your meeting to answer any questions you may have. Please do not construe my absence from your meeting to mean that I am not fully 100% committed to ensuring our compliance with the EPA permit and administrative order.

The takeaways from the mayor’s letter are these:

  • She is determined to seek the funding again.
  • She will do so not in person but through department heads.
  • The request will take place at the council meeting on April 24.
  • All she needs to do is swing one vote from among Chris Connell, Melissa Mazzeo, Kevin Morandi, and Donna Todd Rivers.
  • Even as we speak, the full court press is on to win that vote.
  • City hall sources say that the mayor is confident that the seven councilors who voted to approve the funding will stick to their votes. “Those votes are in the bag,” says one source.
  • Sources say Rivers and to a lesser extent Morandi will be the target of “political pressure” to switch.
  • One switch to the “yes” side will give the mayor the 8-3 supermajority she needs to get the funding approved.
  • Our sources are predicting that the mayor will “get” that eighth vote.

THE PLANET has in previous recent columns discussed in great detail why a yes vote is the wrong vote here. We won’t rehash the arguments again. Interested readers can search the archives (located on THE PLANET home page).

Pittsfield politics is a textbook case study of financial mismanagement! Every fiscal year, they raise municipal taxes by 5% and debts by tens of millions of dollars. It is fiscally unsustainable! The lovely Linda Tyer does not live in reality! The average Pittsfield taxpayer is financially constrained by their local tax bill. Pittsfield is one of the most economically unequal communities in the state and nation! There are no living wage jobs for the average worker in Pittsfield! GE left town, Sabic left town, among other past living wage employers. The only living wage jobs are public and non-profit employment positions. The rub is that you have to politically-connected to obtain and retain a plum or cushy job in Pittsfield. The Good Old Boys run the show! Over the past several decades in Pittsfield, thousands of people have moved out of the area. Moreover, almost all the good jobs vanished, too. The majority of residents who have been left behind in Pittsfield are part of the underclass. To illustrate, all K – 6 Pittsfield public school students are eligible for free school lunches. The Berkshire Eagle only reports propaganda about Pittsfield politics. The local daily rag supports higher local taxes, and the unfunded mandates by the EPA for Pittsfield’s waste-water upgrade. Meanwhile, the Housatonic River is still polluted with cancer-causing toxic/industrial waste chemicals called PCBs! The hypocrisy by the EPA is huge! The April 24th vote for the waste-water upgrade comes before municipal budget deliberations. It is only a matter of time before Pittsfield politics becomes fiscally insolvent and then bankrupt!

You say that she will get the eighth vote, that would be political suicide,and in my opinion, the wrong thing to do. As in previous threads here, it was stated by many that citizens couldn’t afford five dollars, let alone four times a rate increase-a quarter for some and three for most. But the most troubling thing was the Vote, not a mention of what the rate increase and impact it would have-devastating to many.

The Mayor won’t be able to persuade Morandi, no way, or Connell, Or Mazzeo. Rivers is the question mark. Bottom line If any of them is to change, be ready for a Voter on-slaught.

And the Mayor won’t be there, she should resign.

Agree, they’ve got to get to Rivers. Morandi caved on the high school but I don’t think they’ll get him again. Maz is her own person, Connell’s got guts.

Linda Tyer was not qualified to be a Mayor in the first place.
Neither any business experience, nor corporate experience.
She was a secretary in School Dep and City Clerk–good paper work skills+ obedience to Boston Dems+ sense of self-importance–nothing else.

If any of the Ward Councilors do change their vote,they should go to their constituents and explain what the rate increase will be, still unknown. They should also tell them that the drinking water is fine and sewer plant has no violations. They would get laughed out of the room.

I say,let the Builder of the Plant who’s has been speaking about the situation for years,guide us. He seems assured very little needs to be done, if anything.

Excellent idea, let a private citizen who knows more than any of the people the absentee Mayor will send to this Important ‘Meeting’ be our representative, unofficially of course. The E P A letter doesn’t mean anything,the interest payment on 70 million would be quadriple a fine, if any? Don’t get stupid taxpayers.
If it can be proven the drinking water has issues for a reason to build a new plant,yes, but this is not the case.

Water project comes in October 2018 to City Council–asking about the same amount for upgrade.
Now they asking $74 Mills for ONLY Sewer upgrade.
So, I propose City’s Referendum to remove/replace all City Councilors and Mayor! We need to get a web site to collect 3500 signatures to run City’s Referendum.

No I don’t and I was shocked to learn that up to 35 pot stores will be allowed in the city. That is ridiculous. Hardly any retail shopping in the area, but pot will be everywhere. This is apparently the priority of this area. This city just gets more disgusting by the day.

You are right, Dan. Call the bluff on the EPA. Paying the fine is still much less than the millions for the sewer. And it DOEN’T HAVE ANYTHIG TO DO WITH OUR DRINKING WATER.

If you are taking bets, my money goes on RIVERS. There is no doubt in my mind, she will bend. And then she can say goodbye next election.

I believe both the water and wastewater improvements are necessary. This is how capital maintenance works. The punishment will not be a fine, but a federal court order to comply with the administrative rule.

However there are 2 significant questions:

1. What will future rates be? Shouldn’t be tough to project what the expenditures will add. Bond rates are only going go go up. Putting this off and burying your head in the sand has only driven the cost up, along with the burden to the system users. I agree though, the council should not approve any increases without knowing a ballpark estimate of what rates will be.

2. Why were the enterprise funds so poorly mismanaged to not build up funds for future improvements and catastrophic repairs? The community I work for collects about $25 Million in water/wastewater fees and has cash reserve accounts in those enterprise funds of about $40 Million. That said, rates still increase about 2% a year.

SHH, apart from the EPA mandate to reduce nitrogen in the waste water, are you aware of any other EPA requirements that are forcing the city to upgrade? I’m not sure so am hoping you or anyone else here have some info on that.

Good questions, Shakes. Still no info on future rates. And, having lived in the Pitt for over 30 years – I can’t EVER remember the city having a surplus! Tax & spend Dems have ruled unchallenged. Howie commented how the retiring Gov. Paul LePage of Maine has amassed a billion dollar surplus – he’s a fiscal conservative Republican. He should be the most popular Gov. in the nation – not RINO Charlie Baker.

The utility funds should be enterprises meaning that fees collected go into them and costs for specific utilities go out of them. Surpluses should not transfer to general fund and deficit payments should not come from general fund.

LePage may have made some great decisions in running Maine’s executive branch. I’m not sure that atones for his racist, sexist, bigoted politics, but I’m not in Maine so I can’t really do more than be disgusted by them from afar.

Answer: The excess funds from the enterprise funds were used for the “free cash” account that was recurringly used to offset the tax rate increase per fiscal year operation municipal budget.

Since local government has no interest in fixing local roads especially fixing them right, it may be up to the public to start their own road repairs as many have been forced to do in areas where government is more interested in how many genders we have than in doing anything practical to help the public.

My source was Glenn Becks web site. This is 2 guys trying to fix neglected infrastructure in a firmly Republican state. It is not a movement, not many people; it’s 2 guys. I give them credit and props. Whether it’s firmly Republican Indiana or profoundly Democrat Massachusetts priorities are indeed out of whack. The roads need to be fixed. The water needs to be clean. Garbage needs to be picked up…and obviously both Democrats and Republicans, progressives and regressives can mismanage and misuse public funds.

The regulations of the EPA have been eased considerably and some done away with since Trump got elected. It certainly wouldn’t hurt to challenge them with as good lawyer.

Nothing ventured, nothing gained.

But I believe much of this force is coming from the mayor and not the EPA.

Has Mrs Behnke addressed the issue of who handles the counting of any cash in any building for any accounts and for any reason…..there are rumours about people who count cash on their own and do principles account for that cash.I would like to hear One of our 56 Superintendants address cash money in schools.There must be an accounting.Missing profit is no joke….staff stores are trouble when someone buys water for 10 cents and sells it for 75 cent or 1 buck.Lets get on top of this problem.

In 2014 the last administration said it would have sent a message to Assad by bombing Syria if they crossed an imaginary line. Syria did. Instead of the bombing they said they came up with a better plan. The plan was to trust Russia in ridding Syria of the chemical weapons so the U.S. wouldn’t have to get involved. Doesn’t look like that worked out too good. This was an appropriate response. The targets were not picked to kill people they were picked to destroy some of the chemical weapon system and minimize collateral damage.
Also in this strike even though Russia said it would defend against incoming missiles, it looks like they didn’t even employ their air defense system and left the U.S. alone.

#1 Assad was the last person in the World willing to launch Chemical attack–looks like provocation of his enemies–might be Turkey or third party connected to our boys.

Tyer,Mcandless….Taconic 125 million,Water Project 80 to 120 million,Pittsfield High 150 million why is it that our highest paid employee Mccandless is not required to speak to projects that affect how his budget is impacted. McCandless desires many things like all department do but he gets a pass about the overall budget.Highway understands,police and fire Chiefs must deal but not Mccandless.We have seen police cover on ot shift after shift because of shortage of employees,fire departments close stations but not schools……if PHS is redone it will soon cost another 150 million so insane is in the near future over a quarter of 1 billion to house 1600 high school students….Right now the Crosby building in enviromentally unsound and unhealthy.Bad planning got us here and the schools who educate seem not to be able to critically think.How many Superintendant s does it take to manage their home checkbook.They tell you its not their miussion to balance numbers by using arithmetic but Dont they feel this is crazy and irresponsible to just keep telling SS people they need more.Its a department run on financial disinterest on where the money comes from.I see the banter of ex Superintendant and current Superintendant and want to scream at their incompetence. Any fool can spend money on repackaged ideas that school committee members have no clue except we are adding a NEW program.

Eberwien at one point was very close to incorporating 8th graders into the high school because of vacant rooms….Pittsfield has 1/2 a million sf of brick and mortar for 1600 kids.Many of whom can work remotely out of the building. Mccandless and curtis must know this…..our school department is slow and lazy….not teachers but there is no energy with these people.Walk the buildings .Superintendants need teacher energy.
