MAZZEO: SEWER RATE HIKES TO TOP 400% AFTER COUNCIL’s ‘FLAWED VOTE’ ON UPGRADE

(FORTRESS OF SOLIUTUDE THE WEEKEND EDITION APRIL 27-29, 2018) — THE PLANET called the flip-flop of Donna Todd Rivers long before Tuesday night, when she “got religion” and voted to approved borrowing for a $74 million upgrade to the Pittsfield sewer facility. When she first ran for office, we identified her penchant for backflips, the kind indicative of an insecure personality who needs everyone’s approval. THE PLANET won’t delve further into the psychology displayed by DTR’s vote, other than to say we called that one, too.

Bottom line: Rivers flipped because she couldn’t withstand the pressure from six of her colleagues — Moon, Caccamo, Simonelli, Persip, Krol, and Marchetti, particularly the latter two. Moon and Persip be rookies, and they have quickly learned that their submissive role in winning their masters’ approval on such high-ticket items. At this point, they are council back benchers. Caccamo and Simonelli sit back-bench as veterans who love to collect their $8,000 stipend but not bother themselves with the policy details that once served as prerequisites to office. That leaves Krol and Marchetti, two of a certain kind who define “bravery” as the first inserting a helpless victim’s cocoanut in a vice and the second turning the screw handle. They don’t like fair fights.

On the sewer vote, citizens should retain a long memory that Kevin Morandi, Chris Connell, and Melissa Mazzeo acted in the best interests of their constituents. THE PLANET notes that citizens, not offices, constitute the city. People, not policy, must come first, and the righteous trio voted in a way that understood this critical distinction. They did their homework and knew the EPA’s demand mounted to the onerous burden of an unfunded mandate. The EPA demands could have been successfully turned back in court on the basis that the federal government has no authority to order a city as beleaguered financially as Pittsfield to “invest” $74-80 million in a sewer system that’s already in compliance.

In an exclusive to THE PLANET, Mazzeo blasted the end run performed by the Tyer Administration to fix the sewer vote.

Mazzeo said she, Connell, and Morandi asked the mayor for “a face-to-face meeting with EPA officials to discuss the issues regarding the 2008 draft permit.” That permit referred to the city’s initial appeal to the EPA over the new regulations, an effort Pittsfield lost, Mazzeo said, “because of horribly inept paperwork.” Mazzeo viewed such losing on a technicality as “a $74 million mistake that had to be re-addressed.” Mazzeo, Connell, and Morandi then asked the mayor to reach out to federal officials for help. The mayor sent a letter to Congressman Richie Neal, Sen. Elizabeth Warren, and Sen. Ed Markey but, Mazzeo said, Tyer ignored Mazzeo’s request to see the letter before it went out.” To date, the text of the letter remains secret, begging the question: Did the letter reflect the concerns of Mazzeo, Connel, and Morandi (acting on behalf of citizens, who cannot absorb more water and sewer costs), or was it worded to get the Washington bunch behind the effort to ramrod the update through without proper diligence?

Mazzeo said that after the council’s initial 4-7 vote to deny the borrowing needed to fund the project, a week went by without hearing anything from the mayor. She then requested meeting with Tyer “to discuss what to do next. The mayor and her entourage said they were waiting on a meeting with Alex Dunn from the state Department of Environmental Protection,” Mazzeo said. “I told the mayor I would want to attend that meeting, and Chris did, too. The mayor made no comment to my request. On April 3, out of the blue, the mayor called me to tell me she was on her way to meet with Dunn and others. I again said I wanted to attend, but the mayor put me off, saying that she would ask my questions for me. I viewed that presumption as a slap in the face not to me but to the citizens and businesses of Pittsfield, since I, like she, hold a citywide office. I had every right to attend what turned out to be a closed meeting.”

Mazzeo called the meeting the mayor had with MADEP “a joke.”

“I wanted to attend but wasn’t allowed. Only the people who supported the sewer upgrade were there.”

In short, Mazzeo said, the mayor made sure to tilt the playing field. If true, that would place the council’s approval Tuesday night as a vote under duress, since it occurred with incomplete, even false, information. THE PLANET has learned that attendance at the key meeting was limited to Mayor Tyer, Peter Marchetti, DPW chief Turocy, and city consultant Al Wells — all staunch advocates of the wanton spending. No critics of the plan were there to voice the reasonable concerns over a project with more holes than Blackburn Lancashire.

“The rest is history,” Mazzeo said. “After the meeting, the mayor ran to The [Berkshire] Eagle and made her statements, all before we even got our letter [from the EPA]. I sent an e-mail to the mayor telling her I was not happy that she would not be at the council meeting on Tuesday. She wrote back that [finance director] Kerwood [city attorney] Dahoney were capable of handling all the questions. So that’s it in a nutshell: A flawed vote that will raise sewer rates more than 400% in the next five years, and we don’t even know what the EPA permit will require the city to do. The more responsible action would have been to wait until we had direct knowledge of those requirements before moving ahead with this, but at least the consultants will still be making money.”

The Mayor needs to be recalled

SECTION 9-4
RECALL.
(a)
Application – Any holder of an elected office in the city, with more than six months remaining in the term of office for which the officer was elected, may be recalled therefrom by the voters of the city in the manner provided in this section. No recall petition shall be filed against an officer within six months after taking office.
(b)
Recall Petition – A recall petition may be initiated by the filing of an affidavit containing the name of the officer sought to be recalled and a statement of the grounds for recall, provided that the affidavit is signed by at least 500 voters for the office of mayor or councilor-at-large and at least 300 voters for any other elected officials; provided, however, that the signatures for a recall petition for the office of ward city councilor shall be from certified voters in the ward for which the councilor was elected. The city clerk shall thereupon deliver to those voters making the affidavit copies of petition blanks demanding such recall, copies of which printed forms the city clerk shall keep available. The blanks shall be issued by the city clerk, with signature and official seal attached thereto. The blanks shall be dated, shall be addressed to the city council and shall contain the names of all the persons to whom the blanks are issued, the number of blanks so issued, the name of the person whose recall is sought, the office from which removal is sought and the grounds of recall as stated in the affidavit. A copy of the petition shall be entered in a record book to be kept in the office of the city clerk. Said recall petition shall be returned and filed with the city clerk within 28 days after the filing of the affidavit, and shall have been signed by at least 20% of the voters of the city for any officer elected at large and signed by at least 20% of the voters of the ward for an officer elected by ward. The city clerk shall submit the petition to the registrars of voters and the registrars shall, within five days, certify thereon the number of signatures which are names of voters.

Recall Election – If the petition shall be found and certified by the city clerk to be sufficient, the city clerk shall submit the same with such certificate to the city council within five days, and the city council shall give written notice of the receipt of the certificate to the officer sought to be recalled and shall, if the officer does not resign within five days thereafter, order an election to be held on a date fixed by the city council not less than 64 days and not more than 90 days after the date of the city clerk’s certificate that a sufficient petition has been filed; provided, however, that if any other city election is to occur within 120 days after the date of the certificate, the city council shall postpone the holding of the recall election to the date of such other election. If a vacancy occurs in said office after a recall election has been ordered, the election shall not proceed as provided in this section.

Pittsfield and the Housatonic River should be a Superfund site! Industrial chemicals called PCBs that cause cancer are everywhere. The EPA allowed most of GE’s toxic waste to be capped, but caps do not last forever! In fact, caps need to be monitored for pollution on a daily basis.

The argument that the sewage plant is emitting chemicals into the already polluted Housatonic River is both unfair and myopic. The EPA is totally hypocritical to allow caps, while they are complaining about waste-water plant pollutants.

The large increases for the rate-payers into the city’s enterprise fund comes prior to the city’s fy2019 budget, which always increases by 5% per year. Pittsfield politics is financially unsustainable.

The bottom line is that Pittsfield and the Housatonic River is still polluted and its municipal finances are a hardship on the average local taxpayer!

I agree Wilson especially when all the school personnel, who voted in Mayor Tyer, will flood to the polls and monopolize the elections. School employees love Mayor Tyer because the delivers the goods in the form of higher salaries. The push for more money for the schools is what is destroying this city. Nothing else matters in the choice of leaders for Pittsfield as long as they deliver that basic necessity. This is why we end up with such TERRIBLE leaders.

Melissa Mazzeo is right on this issue, but has been wrong on so many others like fighting against a Super Walmart and shutting down free speech at council meetings. Melissa Mazzeo is also a school loyalist who will give school employees all the money they want.

Yes you are correct, Art, the fix was in. Mayor Linda Tyer wasn’t even at the meeting due to a pre-planned vacation, and her Director of Administrative Services, Roberta McCulloch-Dews was there and read a letter from the Mayor. The mayor should have been there for such a large project. She could have at least used Skype or teleconference for the short time she had to be present.

What bank or banks holds the countless millions of city debt? How much is it and what is the interest taxpayers pay each year?

Is there any city owned assets that can be sold? Trees for lumber, buildings, land, unused vehicles?

Has that guy that owns that large building with the firewood collection on outer West Housatonic ever paid his back taxes from 20 years ago?

why is the common lit up all night?

And the city employees, especially school dept need to pay more for their insurance.

How much is the water bottling plant paying for access to our city drinking water??? How much of our water is being trucked out in a week….month…year? Was the company given any incentives such as tax breaks? Is the bottling plant causing a strain on our systems?

Its as if mayor tyer is on a mission to destroy this city by gentrification. If you cant afford to live here your being removed through property tax burdens.
I see once again all children of special needs are being house in the worse public school buildind.The Crosby school is a enviromental disaster where Publics Schools hide the children who need the best enviroment. Crosby is absolutely unfit for children and a health hazzard.Its the Silver lake of schools and the Superintendant knows it.Great staff very sick building and the teachers union fields many complaints about air quality there over the years.The former shop area smelled of mold year round and thats where special ed children were assigned.

There was an article in the April 14 Berkshire Eagle, section B, top article, that says there is a retired police officer who still gets health benefits from the city. Really? How many other retired Pittsfield employees are the taxpayers paying health benefits for?

First of all it is not a fair challenge since you post under six different names.

Secondly, it would not be fair to all the other readers who’s only reason to get up in the morning is to read my cranial challenging posts.

Still, keep an eye on Trump and Bolton breaking the multi national treaty with Iran and causing untold havoc in the mid east. Israel and Saudi Arabia want us to take out Iran for them so they do not have to waste resources. The sickest school building is the Special education programs home base.SPED has been well srrved by staff but every administration has found that the more dilapidated structure are best suited for the kids who need the most help.Water has been dripping into dark places for years and years…..Mold anyone,anyone.Its 100 degrees in one room and 32 degress in another ….If administrators say they dont know they are lying

As I suspected and pointed out here a few weeks ago, Tyer only let those in support of wasting 74 mil go to that meeting with the EPA. As Dan has often said, the fix was in.
I thought we couldn’t get a mayor worse then Ruberto but Bianchi proved me wrong. I then thought we couldn’t get a mayor worse than Bianchi and Tyer proved me wrong. But I think I’m right this time in saying we could not possibly get a mayor worse than Tyer. She is the worst mayor in the history of Pittsfield and is as dishonest as they come.

i have been watching the same disaster unfold for years. It is almost like the mummies curse. One of our ancestors must have done something really horrible for us to deserve this much inept and uncaring leadership.

The Red Sox finally broke their curse but for us it may take a while. Not looking good right now.

Jimmy Ruberto is the King of the Good Old Boys of Pittsfield politics. The G.O.B. ran Pittsfield into the proverbial ditch. The G.O.B. is a group of interrelated, multigenerational, inbred local families that act like the mafia. Anyone who speaks out against the G.O.B. loses their job in a New York minute. The G.O.B. spreads vicious rumors against you, too. The G.O.B. relies on suppression of citizen participation, low voter turnout, and a top-down one political party system that guarantees their tight grip on power.
If King Jimmy Ruberto really still runs the show in Pittsfield politics via the lovely Linda Tyer, then Pittsfield will go deeper into its never-ending downward spiral or population and job loss, with 5% yearly tax hikes and tens of millions of dollars in additional municipal debts.
Pittsfield politics had enough with the “Doyle debacle”, the “Hathaway hack”, the “Ruberto regime”, and the “Bianchi bust”!

President Trump seems to be giving the North Korean leader what he has been looking for all along which is acknowledgment. Throwing money at him didn’t work or appeasing him as Obama did both. All along he wanted to be seen as a player on the world stage. Maybe now we will continue to see him become a responsible world leader although he has a LONG way to go. Also what he did to the young American boy is unforgivable. North and South Korea in an historic summit is also very impressive. Thank you President Trump!!!

Why didn’t the City Council object to the V I P invite at the EPA meeting with Ms. Dunn. Why does the Planet and Gaetani have to do the dirty work on that one? I was at Big Y andGaetani told me in the store he has written a letter to have her come to a City Wide question and answer forum. Again, why didn’t the EPA ask that all C C be at that meeting. Something wrong there?

Gentrification is the removal of people who cant afford to live in a area because the cost is getting to high and they need to move and relocate.Pittsfield is poverty and the Mayor and city council except a very few in collusion with Schoo committee have made it by design to expensive.
Its cheaper to own a home in Pittsfield than pay rent as a 3 bedroom apartment is 1600 bucks.Home sell cheap here but if your in poverty you dont have 30k to buy from the bankers.The taxes on chep homes here is off the charts…..Yup ,they are forcing the poor to leave Pittsfield.

I am not alone in my criticisms of Donald Trump! He is a hateful politician! He is an embarrassment to our country and the World. As for the economy, the stock market is volatile and the federal budget will have record deficits of over one trillion dollars! Many Republican Congressmen are retiring this year of 2018. House Speaker Paul Ryan knows the U.S. House of Representatives is going to flip to the Democrats with the midterm elections this year of 2018. DACA was never LAW…they wanted to give 800,000 DACA people a path way to citizenship. President Trump offered 1.8 million daca people a pathway in exchange for border wall….Schumer and Pelosi turned it down. We need the wall or we will end up in this situation again. The best experience I had at the CT was when they played The Shining on the big screen. I had high hopes for that place but whoever the booker is has failed. There are so many good bands/comedians on the theater circuit but none ever show up here. Why?

Thats a good question Joe. There are always a ton of acts touring, big name, medium and small. Wouldn’t it be better just to have shows, regular shows? Can they not operate profitably? It has to be a fairly simple calculation; cost of act, number of seats, mmprice per seat and add a % for concessions.

Seen a map of the states showing the states with the highest and lowest paid teachers. Looks like Pittsfield teachers are like 3rd highest in the whole country. Imagine that on top of heath insurance and time off etc

Pittsfield is not even the third highest paid in Berkshire County. It is $6000.00 below the state average. Mass. is the 5th highest in the country for teachers pay. I’m looking at masslive.com. Where is this map dusty that puts Pittsfield third nationally?

There is only one person in this City who could turn this City around and that person is Gaetani. This guy is a War Hero and could debate anyone, on any topic, leaving them smoldering in the ashes.

Gaetani is a highly educated fearless genius, who has worked with the highest level Individuals In this Country. President Johnson, Generals Westmorland, Abrahams and Colin Powell and former Governor Michael Dukakis and Sec of State John Kerry, and Most importantly Dr. Milo’s Krofta and Dr. Lawrence K. Wong.

He has worked extensively with the Federal E P A and the state and local regulatory Agencies and he knows how to talk to these kinds of people.

Gaetani just didn’t come on the scene suddenly. He has been out there predicting that the Vity would find themselves in the mess they are in now because of the incompetence of the mayor and city council.

Gaetani is by far the most knowledgeable person in water and waste water projects. The mayor,council, take his advise. And the main question everyone should ask? Is why?

Whether you like Gaetani or not, the man is highly educated and everything he does is for the taxpayer. he saved our city over one hundred million in the eighties and was prepared to save another 40-50 million on this project.

I need to know why this man wasn’t listened to.

Gaetani has stated over and over again that Turdocy and the three consulting engineering firms must be fired, any the city deal with benders directly.

Gaetani should know, that’s what he did in the eighties. An example of absurdity at the last Council Meeting was Persip asking a City Worker what technology should buy.

This would be comparable to Albert Einstein sitting in an Audience an a student asking a question of a janitor about relativity. This is the type of stupidity that occurs in this City. Does everyone see the picture now??????

I asked the G-Man about the petition he will be asking to bring Ms.Dunn here for a public question and answer. I don’t know if she was even aware there would be only a couple of City Councilors at the meeting,who happened to be for the project of this magnitude is definitively not oversight,just under handed in my opinion.

I believe the man when he says that the project is flawed and way over priced because it would be totally revamped-not needed says G -Man, he is correct.

I told him residents are in the dark about the details, especially cost of the not needed project. Twenty four dollars to begin with,is a lot to some. I can remember when the last increase came, about five dollars,Councilor Mazzeo said that it wasn’t to bad,wonder what she thinks about this. is she going to wait until after it passes, and do a Mea culpa? Or is she going to help Gaetani get Dunn here so that Citizens can express their opinions.

Gaetani has laid out the framework. Everything is in compliance, yes,a new stage has to be constructed and maitenance on holding tanks, I Believe? But until I know details of what the EPA is asking, how can anyone in good conscience, with this price tag agree with these new rates.

The last resort was, if flip flop hadn’t changed her vote it would have forced Dunn to address it publicly.

Its Lying Linda Tyer who never tells the truth to taxpayers.Where is the money coming from.People need to be cut in the school.35% of teacher dont pay taxes to Pittsfield. To quote Mccandless he said of the 240 kids who enter taconic about 20 % wont graduate from that building.The school for 120 million will generally be over staffed and not filled to capacity as a rule.Yon,Trici Bouvier, Massimiano, Eberwien take credit this ugly building and plan of use that is going to cost big as they will make huge changes almost immediately

Mizz Behnke gave herseld and all administrators a raise.She got 4 k….Why is she called a Superintendant when the old name was business office purchaser.

I do agree with you on this issue School Committee. ALL of the paraprofessionals were hired back and even more taken on the school payroll. The schools complain about money, but the paraprofessionals are there to make the job easier on the teachers. The paraprofessionals are a luxury when the schools can’t stay within budget. When the money isn’t going to the kids, but to high over the top salaries for teachers and administrators. Kids need school supplies so badly that they need to beg the public for money.

The general public would be completely understanding of hiring paraprofessionals to assist teachers if the schools knew how to budget their money. The don’t even try. They don’t know what budgeting means and how to live within a budget. If they get more money in the budget, which they generally do every year, they raise even higher the already high salaries of teachers and administrators.

The roads in Pittsfield are still terrible. Nearly May in a few days and I see very little improvement in all of the holes on so many roads. The road crew was out the other day on a street near my house fixing a few holes and unbelievably people were going by honking at them, swearing at them, and calling them names. They are obviously confused as to who to blame for the deplorable condition of the roads in this city. They should be marching in front of Pittsfield City Hall with signs and chanting “Fix the Roads”. It’s not the fault of the road crews that the roads are not being fixed. It’s the people in charge of this city who are to blame.

I would not be shocked that the funds are going elsewhere and this should be looked into. The situation with the roads is at a crisis point. Even when and if all of these holes are filled, they will all open up next winter bigger and deeper than ever. It will take months to get all of these roads back to even a little bit normal for this summer. Each year has been getting worse with this year being off the charts for being dangerous. The local politicians need to have a plan and soon. This is a poor community and people can’t afford all of these vehicle repairs due to roads that in many instances are so bad that they should be closed until they are repaired.

I know a couple of people up in the Ann drive, Alfred drive area. Those people pay HUGE taxes and their roads are 3rd rate……gotta blame the ward councilor for not hammering the mayors on this. They have been bad for years. Piss poor management in this city.

I also think road funds have been used elsewhere or absconded going back a couple of mayors.

Either our road construction specs are inadequate for our climate…or the contractors get away with not constructing them to spec. I very seldom travel South St., but accessed it over a bombed out like Crofut St. the other day to head south. There were several areas between Crofut and the bridge over the railroad tracks were the top layer of pavement is gone. Wasn’t the road completely resurfaced about 3 years ago?
