HANDICAPPING, AND WE MEAN HANDICAPPING, THE “RACE” for DISTRICT ATTORNEY

PLANET VALENTI NEWS AND COMMENTARY

(FORTRESS OF SOLITUDE, WEDNESDAY JULY 18, 2018) — Making sense of the stillborn race for District Attorney is rather like explaining Russia: No matter what you say about it is true. Even if it’s false, it will somehow be true. THE PLANET calls the race “stillborn” because it involves one party only: Democrats. That should come as no surprise in a county and Commonwealth that runs on a single-party system. … you know, like the Soviet Union circa Cold War.  In Massachusetts, you’re a Democrat or you’re nobody. And give me no Charlie Baker, that de facto Dem. He typically would be the exception that proves the rule, but he’s a stooge of a rule that allows no exceptions, even for — ahem — alleged “Republicans.”

The three contestants line up this way. There’s the heavy favorite, current DA by coronation Paul Caccaviello; yet-again Andrea Harrington; and Judith Knight.

Caccaviello’s claim on the job will be his years in the county DA’s office, that long line of royalty that goes unbroken before Tony Ruberto, then Gerry Downing, David Capeless, and now, after Capeless mysteriously bailed out of his term 10 months early, his hand-picked successor, Caccaviello. Cacc made the most noise in the dead-to-date campaign with Wifegate, a tawdry affair in which his wife and Capeless’s got into a spitting match with the owner of Otto’s Grease Joint at East and Wendell Avenue Extension after the latter posted nasty things about “her man” on his Fakebook page. Just for laughs, Alan Harris, owner of Berkshire Money Management and his sponsoree, John Krol of The John Krol Show, joined the fun.

Can you tell we’re in Pittsfield, yet?

Wifegate, a moniker put on the profumo affair by our good friend Mike Ward, is likely the closest thing that this campaign will see to a debate of “the issues.” And wait until the September primary. Turnout will be so low that it will be looking up at the earthworms in Pittsfield Cemetery.

Yet Again Harrington shows up for office as frequently as Donna Todd Rivers flips her flop and sells out to the highest bidder. Harrington’s previous run came against Sen. Adam Chrome Dome, D-Nowhere. Her platform consisted of the hope that another senator named Andrea would be took much for voters to resist. She had no chance, alack, since she found herself up against The Machine, the same one she faces in this race. The Machine has shown a few cracks, a symptom of which had to be Capeless’s premature exit, leading sleuths to wonder in unison, “Hmmmm.” Add to that the general discontent with incumbents, and anything’s possible.

THE PLANET will not make any endorsements in this race, but we will tell you to stay well away from any candidate who talks about her “holistic” view of the law. That’s Harrington’s great vision for the top criminal justice official in Berkshire County. Holistic. That’s code for: We will be weak on crime. These poor people need our understanding, a boost up, methadone, and public handouts. They’re not criminals. They’re victims of white, male, middle-class imperialism.

In an earlier interview with our friend and colleague Terry Cowgill of The Edge, Yet Again claimed she had “a 7,000-foot view of the criminal justice system.” She forgot to mention that she has no experience whatsoever as a prosecutor, leading THE PLANET to think that “7,000-foot view” came after being thrown out of a Cessna without a parachute. With every second, the ground comes closer, and along the way between now and the September primary, Yet Again will be heard shouting, “So far, so good.” We can’t say if she’ll finish second or third (our money is on Place), but we do know what her final campaign utterance will be: “Splat!!”

This brings us to attorney Judith Knight. This woman at least brings experience to the table in the form of her service as assistant district attorney of Middlesex County. That’s Boston way, so she knows her way around the big city. Knight’s chief problem will be visibility. She’s only known through her lawn signs, and not only do lawn signs not vote, they do not create news. Incidentally, “lawn signs do not vote” must pass as political wisdom. This is, in case you forgot, “The Berkshires.” God help us. We must also observe that Knight and Yet Again split the anti-incumbent vote. Game. Set. Match.

With all that, THE PLANET can map out the winning strategy for each candidate:

Caccaviello: Avoid debates, keep a low profile, put a gag in the wives’ mouths, and above all, “energize the base,” which is to say, don’t do anything to make The Machine mad. Heavy favorite.

Harrington: Make a lot of noise. Challenge Cacc at every turn. Call him out. Put all you’ve got in Pittsfield. Forget the rest of the county. The county seat alone will decide this race. Take Pittsfield and you become the next DA. She’s got a decent start on outer West Street and Valentine Road with a cancerous multiplication of lawn signs. Now she must follow that up by somehow getting Caccaviello in sight from hiding. Long shot.

Same with Knight. Get visible. Somehow gets voters interested. Match your experience with Cacc’s. Make some news. Longer shot.

There might be one other tactic that would greatly improve the odds for either woman: It goes by the code name “Operation Bernie Baron.” Ah, but we guess not one of them would dare dare dare touch that third rail. It would only be the biggest local story of the past and current century.

Caccaviello came after Baran went up the river for life, but Ford is still a judge and Ford was the prosecutor.

Caccviello’s challengers will split the women vote as well as the liberal looney tune vote.

Harrington is a joke as is Knight and they both want to play nice with the ganagbangers and oher dirt bags because drug dealers are only “non violent drug offenders” who are supporting their habit.

Can someone please enlighten me by providing a link or some detail, about this wifegatenthing?

The last I read about it, the District Attorney position pays over $170,000 per year. Like other criminal justice positions, it pay$ to be politically-connected. The best part of the deal is the future pension. If it weren’t for criminals, the well taken care of bureaucrats would be out of their high paying jobs!
I also wonder who will benefit the most by low voter turnout on September 4th?
There is also a Democratic Primary between moderate Congressman Richie Neal and liberal challenger Tahira Amadul-Wadud.

I remember a very long time ago when a teenager from Great Barrington was being railroaded into jail for selling pot in a school zone. An over zealous district attorney for whatever reason wanted this kid in jail. And I seem to remember Judy Knight defending the kid saying how ridiculous it was to put a high school kid in jail for the 2 year mandatory sentence for selling pot.

So for this act of humanity she certainly gets my serious consideration while anyone who is part of the Pittsfield machine does not. There is too much concentrated power in Pittsfield and while my one little vote may not change that, I have to do it for my conscious. .

You’re leaving out of that story the fact that the kid refused to cooperate on the brilliant advise of Knight (as did her other client who was busted again weeks later). The thing was a decade ago, thousands of young adults go thru the DAs office annually with no sweat. But she regurgitates this one. Oh and you might mention her “prosecution” experience was as a junior ada 25 years ago.

Its bothersome for the few of us who do go the polls to see the candidate quit 10 months early. Mr. Capeless was elected for 4 years. It’s probable that Mr. Caccaviello will be elected and then re-elected. In 8 years he’ll be 65. Can we assume that in 7 years and 2 months he’ll be stepping aside for his minion?

I guess I would ask, who would you want representing you if your daughter was shot and killed and witnesses refused to cooperate? Harrington, who has never prosecuted a single case and the very few she did defend were DUIs etc (by the way, ask how those went. She cried to the judge and asked to be removed from one of those cases because she was in her own words “incompetent” due to her being too involved in the campaign for Senate.) Or Knight, who has never exhibited an ounce of interest in crime prevention, addiction treatment, children services in fact any social causes at all or anything other than handling a few cases and failing in a run for DA on the “soft on crime” platform. You can rage against the machine all you want, but at the end of the day if there are more drug dealers, more shootings, more crime in Pittsfield you have no one to blame but yourself if you don’t show up Sept. 4 and vote for Caccaviello.

The gateway drug theory has been disproved a thousand times over. The number one gateway drug is alcohol, which has caused more problems in this city than pot will in a hundred years. The only reason doctors lobby against marijuana (smoking notwithstanding) is that its users have much less need to go to them because their low stress levels mean less ailments. It’s a money loser for the AMA and big pharma.

Progressive politics supporters are proof that critical thinking skills are no longer taught in the American education system. If we had critical thinking skills in modern classrooms we wouldn’t have people wanting to abolish ICE because they think it’s a terrorist organization. They would be able to think logically and realize we need to protect our borders and in these dangerous times we can’t have open borders. They would realize that not all children who come to the border are with people who are really their parents and we need to do DNA tests to confirm if there is a relationship to prevent further harm to the children.

Critical thinkers would realize that socialism doesn’t work and only leads to disaster. The list goes on and on……….

You mean like when Obama told Russia he’d have more flexibility after the election? Or his order to stop the US cyber chief from taking any action against the 2016 election interference. Or “We think there’s an excellent opportunity to put US-Russian relations on a much stronger footing,” Obama said.
Or how about Clinton: Clinton and Putin shake hands July 22, 2000 before the start of a meeting during the Group of Eight (G8) economic summit in Nago, Japan. Clinton shares a light moment with Putin before a Group of Eight meeting in Nago, Okinawa, Japan
Or Bush? Bush shakes hands with Putin in the garden of the Brdo Castle near Ljubljana, Slovenia on June 16, 2001 for a summit meeting.”He’s a man deeply committed to his country and the best interests of his country, and I appreciate very much the frank dialogue and that’s the beginning of a very constructive relationship,” Bush said of Putin.

Let’s not forget the new DA already has at least 2 high-profile murder cases, locally, to prosecute. The death of a 22-year-old girl who was shot in the head as a bystander to an act of violence between adults. And what appears to be a more calculated murder of a man in a park on the Fourth of July.

Here’s an interesting story about the former DA. As the family of the slain girl was preparing her body for her private funeral, they were kicked out of the room in the funeral parlor to allow prisoner Christopher Davis to have a private goodbye with his alleged girlfriend. At the time Davis was being held at the BCHC, without the right to bail, pending a dangerousness hearing. Neither the parents nor any of the family of the murdered child was asked for permission for this to happen, or even made aware until the Sheriff showed up at the funeral home with the prisoner and told the family members to leave while he said his goodbye. This egregious violation was sanctioned by the DA and the sheriffs office, with zero respect for the family in an excruciating time of grief.

Here’s the kicker – Davis was granted this special permission by way of an agreement with the DAs office. He agreed to testify at grand jury in the murder case of James Dominguez, who was shot in the head and murdered outside a local bar the year before. Some readers here may remember the grand announcement made in the murder case of JD. Suspect charged! Hooray!

A few weeks later you may also recall an article regarding the prosecution of Christopher Davis for lying to a grand jury in a capital murder case. What the police and DA didn’t tell the public was that Davis lied to the grand jury, he received an unpermitted and unwelcome special private visit with the murder victim to be the first person to say goodbye to her. Yanna’s funeral was a private service with family only, who wanted to express their grief prior to opening up the parlor to the public. Instead, they spent their last days with her, knowing that their privacy and respect and decent humanity had been violated by the sheriffs office, the district attorney, and the funeral parlor as well for allowing this to happen.

And the murder of James Dominguez? You never heard anything more about that, right? That’s because they had to release the suspect they had charged with his murder based on the false testimony of Davis. But you didn’t see that in the newspaper.

Just another dead person for that new DA to tend with…

John, I think you’d be hard-pressed to find anyone who actually believed that. It would be pretty hard to believe that Davis struck a deal with the Sheriff, agreeing to testify in a murder case that resulted in the DA charging someone with first degree murder, without the DA actually knowing before hand.

Paul

Good post Auto Phil. Something that drives me nuts with the DA’s office is the constant dismissal of weapons and ammunition charges. All we ever here these days is we need more gun laws and this office never enforce the ones we have. What ever happened to the mandatory jail time that we use to post signs when entering the state. Law abiding citizens have to jump through hoops and spend a lot of money to legally possess firearms. Why? Nothing happens to those who do not follow the laws.
Hell, they even drop the stolen gun charges. Do they even ask the victim of the theft how they feel? I think not. I am willing to bet that if a decent law abiding citizen got stopped and their permit was 1 day expired they would get hung out to dry.
