(FORTRESS OF SOLITUDE, MONDAY, AUG. 11, 2018) — It’s been clear since the race began that the contest for the Democratic nomination for Berkshire County District Attorney would not be about issues. For those just tuning in, this election will be decided in September, since there is no Republican challenger … or challenger from any other party, to be technical. The race features the interim incumbent, Paul Caccaviello, appointed by the governor following the premature resignation of D.A. David Capeless; Andrea Harrington, attorney; and Judith Knight, attorney.

Cacc has the backing of what we loosely term The Machine, which needs no definition. Interestingly, though, Harrington has garnered high-profile support from other politicos and players that in the past had been linked to The Machine, personages such as Linda Tyer, John Krol, Barry Clairmont, Peter Marchetti, and others. An interesting weather vane is councilor-at-large Peter White, a good one for taking readings of wind direction and pointing that way. Who, if anyone, has he publicly backed? This subplot indicated a split in The Machine, a division that could have implications for the city elections in 2019.

Typically, the D.A.’s race garners as much attention as the school committee farce (six candidates, six seats in the free and open elections). This one is different. Some think it’s not about the D.A.’s seat at all but the old Machine trying to hold power versus a new Machine trying to get off the ground and unseat the Old Guard. THE PLANET does not subscribe to this theory, but we have an open mind.

Does the New Guard think a Harrington win would pave the way for a municipal sweep in 2019? One must consider Cacciavello to prohibitive favorite at this point, for a number of reasons. It’s his election to lose. Thus far, he’s run a smart campaign — laying low, avoiding controversy, and largely “staying above” the fray. He has the hands-down edge on experience in one of the offices where experiences matters. With turnout expected to be low and with Knight splitting the “anti-” vote, it will take the miraculous for Harrington to win.

Local elections, with their dismal turnouts, never get decided on issues. This is especially true for September primaries. What portion of the electorate finally gets to the poll won’t pay attention until after Labor Day, when summer is up and green, golds, and reds of autumn hint at their hostile takeover. The only ones truly paying heed before then, including the ever-elusive “now,” are the “bases.” Each candidate has a base, and the first duty has to be “energize the base,” as the dismal political cliche puts it. Caccaviello has done the better job of that, although Harrington has picked up steam of late, particularly with her “Did she or didn’t she” attend or “crash” Sheriff Tom Bowler annual picnic. As THE PLANET said, this race isn’t about issues.

The other matter that has thrust Harrington into the whispered headlines and street buzz concerns Knight and State Rep. Tricia Farley-Bouvier. The rumor mill has it that TFB approached Knight with a job offer if Knight would withdraw and back Harrington. THE PLANET, reluctantly but not surprisingly, has been drawn into this palace intrigue. We had published an earlier column outlining the odds against and the winning strategies for each candidate. We said for Harrington to have a shot, she should do exactly what TFB is supposed to have done: Approach Knight with an offer. This became the dick-flimsy basis for the weird tale that we were the cause of the alleged TFB overture, to which we reply “Bullspit.” No evidence has come forward of any such offer, and we predict it never will. Those who make the allegation have the burden of proof. Their silence in the court of hard evidence and facts speaks shall have to speak for itself.

With that, let THE PLANET now turn this over to the various “interested parties.” First, we hear from Harrington on “Picnicgate:”

ANDREA HARRINGTON: “I am not sure that it’s possible to “crash” public events. It’s expected and normal that candidates attend events hosted by elected officials. I would not think anything of an opponent attending public events hosted by elected officials that are supporting my campaign. I very much value the hard and difficult work of the Sheriff and his staff and I hope that my attendance at Sheriff Bowler’s picnic communicated that. I have attended the Sheriff’s events in the past and my presence at those has always been in a spirit of support. Of course the Sheriff was, as always, gracious and welcoming. That being said, Congressman Neal’s staff requested that I meet with the Congressman at the event. Which I did.

“As to your other question [‘Did you say that people under 25 don’t have fully formed brains and therefore can’t be fully responsible for their actions?’] — The suggestion that people are not responsible for their actions due to their age is absurd. I would never say or infer anything so ridiculous. I have a 7 and 12 year old. I teach them that they are responsible for their actions. Everyone is responsible for their actions all of the time. To clarify why I was discussing scientific research around brain development: We have a serious drug problem here in Berkshire County and we have the resulting crime. We also have high recidivism rates. People from across the political spectrum have recognized that we need a new approach to these problems if we want to achieve better, cost effective results for our community. The recently passed criminal justice reform bill is the first piece of criminal justice legislation that actually looked at data and evidence in creating criminal justice policy. What I was referring to in my comments about the science around brain development- is that the human brain is still developing during the late teens and early twenties, which is something that should be taken into consideration when addressing criminal behavior because the science shows that developing brains can benefit from rehabilitation. Young people that are making poor decisions and committing non-violent crimes, may be good candidates for interventions like substance abuse treatment, job training, mental health treatment, etc. Because their brains are developing, they can be put on a better path which is preferable to the cycle of arrest, incarceration, and re-arrest. Conversely- the community always needs to be protected from violent offenders and I am committed to standing up for victims of crime irrespective of the age of the perpetrator.”

I see your interest is more global – addressing the corruption in Pittsfield – a sentiment with which I completely agree.

“The biggest issue in the race is the awfulness of David Capeless, and the awfulness of allowing such a man to anoint his successor.

“I believe that one glaring example of Capeless’s corruption and moral vacancy deserves more attention. Thanks to a compliant Berkshire Eagle, this story has gone almost entirely under the radar. I started looking into it as I reviewed the case of Mitchell Lawrence, the high school kid who was sent off to jail for 2 years by David Capeless for selling one joint. When Lawrence’s sentencing appeal was rejected, Capeless crowed about how justice had been done, the kid deserved what he was getting, and on and on.

“That mindset did not seem to apply to a man named Roberto V. Mazzeo. Mazzeo, a 36-year-old former corrections officer, was arrested in late 2014 with 63 lbs. of pot, some quantity of psychedelic mushrooms, over a dozen weapons including a stolen handgun and assault rifle, a bulletproof vest, a lot of cash, and scales and dealing paraphernalia. “For about three years, the case appears to have been kept idle and quiet. Then, last October 2017, it was announced that Mazzeo had pled guilty to a handful of reduced drug charges — the weapons charges were all thrown out at the ‘request of the Commonwealth’. His sentence, at the recommendation of the Berkshire DA’s office, was ONE YEAR OF PROBATION. See link below.

Mazzeo is the cousin of John Mazzeo, a Pittsfield PD investigator who is the treasurer of the police union that just endorsed Caccaviello.

FINALLY, ONE INSIDER’S REPORT ON ‘PICNICGATE’ “Now, OFF THE RECORD, from what I understand whatever happened at the sheriff’s picnic was due to the rude behavior of Robin McGraw. To begin, Robin McGraw is an aging trust fund baby whose fragile ego was recently wounded deeply when his planned big dollar fundraiser for Paul Caccaviello in Great Barrington turned out to be a total flop. In fact, the event was such a disaster that Sheriff Bowler was seen giving McGraw a tongue-lashing outside Crissey Farm, where the sparsely-attended event took place. McGraw was wounded. Such a sad thing for this flamboyant drama queen who prefers to enjoy the adoration of cocktail party types with his over-acting as the master of ceremonies at the Berkshire Museum Gala and other such events. He overpromised and underdelivered. Perhaps to prove to his GOB friends he was still valuable in this race, McGraw took to the opportunity to take his frustration out on Andrea Harrington. As all the aging, sexist old school men began to whisper outrage that this woman (Harrington) dare set foot at their annual male ego massaging sausage fest, McGraw couldn’t help but lash out at Harrington. To her credit, Harrington kept her cool and batted away the ridiculous attack.”

What is your prediction for the number or percentage of voter turnout for the Berkshire County District Attorney race on September 4th, 2018? It is usually around 20% of voters.
I wonder how much it will really matter which one of the three Democratic candidates win the primary election. I don’t think it will make any real difference!
Pittsfield has lost over 80% of its living wage jobs over the past 50 years. It is one of the most economically unequal communities in the state and nation. A majority of residents live in or near poverty. Pittsfield is a fertile area for criminals to prey on the weak, vulnerable, and powerless. The Good Old Boys ran Pittsfield into the proverbial ditch! Pittsfield is in a never-ending downward spiral!

I’ve lived a very long time and this is the strangest election I’ve ever witnessed. As the Trumpster would say, ‘there’s good and bad on both sides’. Having no dog in the fight both sides tell us how important it is that we vote while both hope we stay home.

Cacc is not the machine candidate – Harrington is, which is why all the machine is backing her. Bowler is not part of the machine. Massamianno was and he challenged him and Massamianno scrammed. He worked with cacc for years. And John Mazzeo is not the cousin of, or the nephew of, the guy caught with the weed, or Melissa Mazzeo. And the kid that did 2 years was given the minimum sentence when he was found guility of dealing drugs in a school zone. And Harrington is out to lunch on violent crime -no one is going to jail for being a drug user, they are going to jail for being drug dealers, and drug dealing leads to violent crime all the time. For her to suggest rehab for drug dealers under 25 is a joke. And these drug dealers are not paying taxes while my husband and I work our asses off to get by. And let us hope Harrington and Knight split the women vote so we can keep a competent DA in office.

I also received a flyer in the mail from the Harrington campaign and it was all about women’s issues….domestic abuse, rape, etc. I agree that Harrington is being backed by the machine more than Cacc. True, they are all progressives, but Harrington seems to be more far left. Violent crime is of concern to this community and I also agree that Harrington would not be tough enough on that issue.

Dan you say that Cavv is running a smart campaign, laying low, avoiding controversy, staying above the fray. Maybe but maybe not because there seems to be folk firing heavy artillery at Harrington even on this site. And it has a dirty campaign odor to it. Also, the female attack on the restaurant owner who expressed an opinion was not exactly “above the fray”. It was a kind of below the belt hit job that suggested a “do not cross me” attitude.

The DA position is a powerful one and can easily be weaponized. Choose your candidate wisely.

You really are a twister one, Cicero. The incident happened in 2010; it’s been long forgotten since the day the University won an MTD in federal court. To think UMass Amherst kept me around until 2014, when up to that date – they conferred three (3) degrees upon me. How many have college degrees have you earned? Not five, no doubt.

Ms. Harrington can’t manage a campaign staff of four or five w/o running afoul of OCPF rules & statutes. How would any reasonable mind conclude she’s skillful enough to run a 6 million dollar annual budget and a 50 member staff? She owes the I. R. S. to the tune of $20,000 and the Town of Richmond back taxes.

This is the same Berkshire district attorney candidate who thinks texting defendants in advance of court dates, to ensure their appearance in court, as an office reform measure. All the while ignoring her Rules of Professional Conduct, which precludes her from contacting defendants, or anyone else, represented by counsel.

And you gotta love the fact she’s now a self-acclaimed opioid expert, and she’s never tried a case in a superior court, and the list goes on and on.

No doubt, my favorite is dispatching TFB to offer Judy Knight a job if she withdraws from the DA’s contest. Gotta love Ms. Harrington’s gumption, though.

And now I learn John Krol went storming into Jerry Doyle’s house one night demanding her remove his Caccaviello lawn sign. My understanding is Jerry did but put them back up days later. Henchman Krol to the rescue!!!

And how convenient a Harrington cartoon character now claims that former DA Capeless resigned under pressure from the Mass. Attorney General’s Office. A couple weeks before the September 4th primary. Imagine that, huh!!!

Ms. Harrington is incompetent. If any of you bother to attend one or more of the scheduled debated you’d discover for yourselves just how stupid she sounds pinned up against two well-versed former ADAs. Who I might add ARE qualified to be a district attorney. But only one is a district attorney – and will be the next four years; he his Paul J. Caccaviello.

Ms. Harirngon is clearly outta her league this time! She allowed a couple of political hacks to push her into this contest, knowing full well she’d be humiliated by a couple of seasoned lawyers. She was used as a pawn in a political power-play. Stupidity knows no boundaries!!

You’re a funny guy, Cicero (or are a guy?). Do keep up the smear campaign; no doubt it’s the best you can do to offset Harrington’s chances of winning a post she grossly unqualified to hold.

Instead of insulting me, you should be promoting your candidate. But I guess when all else fails, beat up on the closest thing to a winner!

And for the record: I do not represent the Caccaviello campaign. I’m merely expressing many of Ms. Harrington shortcomings as to why she should never see the inside of the Berkshire District Attorney’s Office.

And unlike your Ms. Harrington, I admit I am not qualified to work in the DA’s office.

Check out the websites of the three candidates. Caccaviello is the only one that has a contact tab. This tells me that he wants to hear from you. Harrington and that other candidate don’t want to hear from you unless you provide your contact information. No questions please.

Also a check of OCPF campaign information show Knight and Harrington to be flush with GOB cash and Caccaviello has a more modest amount on hand. I guess when you’re the best choice you don’t have to have a lot of money to try and bullshit people into voting for you.

I can tell you personally, there are at least 5 Ifive) confirmations that TFB tried, unsuccessfully, to push JK outta of the DA’s contest – at the behest of the Harrington Campaign. How do they know? Well, Judith Knight told them; that’s how they know!

So, please don’t insult our intelligence with this stuff about calling TFB for a predetermined denial.

The only tragedy here is that Judy Knight is too scared to come forward. But that tends to happen when a powerful public figure approaches you with a do or die ultimatum!!

When you align yourself with deadly toxicants like John Krol and Barry Clairmont – you tend to inhale more than what’s normally acceptable.

Hopefully, someone mounts a serious challenge to TFB in two years. It’s time Beacon Hill politics is pushed outta Berkshire County.

Patrick Muraca was found guilty of wire fraud and lying to federal investigators, and he is facing up to 20 years in federal prison and a $250,000 fine.

Part of me still admires Patrick Muraca for speaking out about how the Ruberto regime and his G.O.B.’s failed city residents and businesses.

But like Jimmy Ruberto, Patrick Muraca turned out to be yet another fraudster!

By my calculations, Ms. Harrington has accumulated in excess of 47% of her contributions from outside Berkshire County. This in addition to the rogue machine funding her Harrington shipwreck!!

I thought this was the Berkshire District Attorney’s contest?

Ms. Harrington has accepted donations from as away as Florida to New Jersey to New York City to Cambridge, Mass. to Timbuck to.

Although when she loses on September 4th, Ms. Harrington could very well liquate her campaign account and use those funds to pay off a tax obligation to I. R. S. @ $20,000 and Town of Richmond.

FYI: She did begin this second campaign in debt to the tune of $8,000. Go figure!!

Nuciforo contributed to two campaigns! Luciforo gave “Caccaviello, Paul J.” $200, and “Harrington, Andrea” $250. Andrea must have gave Andrea $50 more than Paul because they have the same first name! Be sure to focus on Judy Knight’s quote. It leaves the Eagle’s readership with the inference that TFB did act in concert with Harrington to not only oust Ms. Knight, exchange her sudden departure with a job later on. In order for Ms. Knight to draw the “job” impression, TFB must have made overtures of the kind to her, on behalf of the Harrington campaign. Andera Harrington is as culpable as TFB.

Don’t be fooled by the author’s bias slant; Ms. Knight is the tell-all!

The definition of election fraud:
