HERE’S HOW ‘CACC CAN WIN’

In our previous column on the D.A.’s race, we outlined “why” Paul Caccaviello could win the November general election as a write-in candidate. Here, we give you the “how.” Bottom line is that this is a doable enterprise for PC.

A new tactic has emerged from Andrea Harrington’s supporters. First, Team H played the “insult” card that says Cacc disrespected the democratic process by seeking a “sore loser” write-in. That flopped on the face of it when THE PLANET pointed out that he’s actually doing the opposite. Next came the “He can’t win” mantra, refusing to believe it themselves. Now, we are getting the “playing favorites” angle, accusing us of secretly backing Caccaviello.

Let’s be clear. THE PLANET backs no one and everyone. We have never refused a candidate of any stripe when they asked us for advice, opinion, or our views. If they want the family recipe for crumb cake, we share it. We have, in fact, talked issues and strategies with both Harrington and Cacc — but we aren’t “backing” anyone. When we write of “why” and “how” he can win, THE PLANET simply points out the strategic and tactical elements that constitute the probable paths to victory for Cacc.

Why do it for him and not her? Easy. She already won straight-up, name-on-the-ballot.

THE PLANET isn’t saying Cacc WILL win. We are saying he CAN win. We respect both candidates, wish them both well, and will continue to communicate with both campaigns.

Let us now carry the owls to Athens. Here’s how you win a sticker campaign:

  • Play the Edge — Winning sticker campaigns are characterized by unusual circumstances. In this case, it’s Cacc’s win in Pittsfield. The county seat will decide the race in November.
  • Take Off the Gloves — Cacc must become a — yuk — “politician.” No more Mr. Nice Guy. He’s in a duel.
  • Tout Experience — He wins by hammering home his advantage in experience. He makes the campaign about competence, since both more or less agree on the issues.
  • GOP Go — Caccaviello campaigned as a Democrat and is well known in party circles, so he has votes there. But the 7,600 county Republicans hold the key to this election. They did not vote in September. His perceived “tougher on crime” versus her perceived “soft, ‘understand them'” approach should play well with GOP voters.
  • Know and Follow Electoral Law — Cacc’s campaign needs to read and re-read what Massachusetts law says about sticker campaigns. If they’ve read them already, read them again.
  • What’s in a Name? — The ballot will have a space for every office, in this case the D.A., where a person can physically write-in a person’s name that is not on the ballot. Caccaviello’s name will not appear on the ballot. People will need to write it in. Commonwealth law also allows a candidate to pre-print stickers with his name and address on it. The regulations are precise. Stickers must be 2-1/4″x1/4″ printed in black ink with the candidate’s name and then, in smaller type size, his address. Follow the instructions. Cacc must print up a large number of stickers and see that they are well distributed.
  • Knight Rider — Have Judith Knight appear with Cacc in a press conference, in which Knight will endorse the acting D.A. and urge her supporters to do the same. In the primary, Knight won more than 5,000 votes to roughly Cacc’s 7,600 and Harrington’s 8,300. Do we have to draw a map?
  • Don’t ignore North and South — In the north, go to Williamstown, North Adams, and Adams. Also, stump in Great Barrington and Stockbridge. The goal is to neutralize the votes Harrington piled up there. Have Knight perform as a stump surrogate in these areas.
  • Eagle Eyes — Have trusted aides at each voting station. Monitor the polls scrupulously. Every vote counts. Allow no disqualified votes without a challenge. Be sure that every piece of paper is examined. With write-ins, there will be sloppiness. In Massachusetts, as long as a ballot reveals the intent of the voter, it counts as a vote. Butchered spellings of “caccaviello” count as a vote if they reveal voter intent.

That’s the “how.” Now it’s up to Caccaviello. Victory can be his, if he plays it right.

You guys, other than Art, are way off. First of all it was Chuck Connors in the Rifleman. Jerry Van Dyke was Dicks brother who played banjo,he was co-host with Roy Clark I believe on the show He Haw.

Dick Van Dyke was a highly functioning alcoholic when he was tripping over that ottoman and many years into his career. He finally went into recovery and is alive at 92, so there is still hope for Brett.

I disagree. There is a big difference between an alcoholic judge and an alcoholic actor. Drunk actors have been faking it forever. Just look at Dean Martin and Errol Flynn. Judges, on the other hand have a very intellectual job in which they need to be sharp at all times. Kavanaugh’s memory is unbelievable for cases. Also, Kavanaugh’s wife with 2 young children doesn’t seem like the kind of woman who would stay with an alcoholic husband.

The Berkshire Eagle cant be against Kavanaugh and not do a comprehensive story on abuse at Williams college to explain what went on to its readers.This kind of journalism is gone as everything now is PR from Trump to Harrington with both pointing fingers at things gone wrong.The story locally is that Harrington if elected will pursue charges at Williams…..The Eagle needs to do this so it’s readers know what went on at Williams college

They cannot pursue charges when the victims and the school refuse to report. These cases are reported to the police without names. This is the school’s policy to protect victim privacy. Do you really think the DA’s office would not pursue reported rapes anywhere or the paper would refuse such a story? The idea that Harrington, one of the least skilled lawyers in the entire county, could do something is laughable.

Women should be outraged. Harrington snaps a photo and claims Markey has supported her when he has not. Healey claims Harrington is experienced when she isn’t. This is garbage. If we do not have truth over spin in the DA’s office what do we have? Why do they have to lie? How is this a win for women? Are we supposed to not care about the truth and just be happy there is a woman on the ticket? While the DA’s office fights against violence toward women, these women are pandering politicians. Bad for women. Bad for Berkshire County. Bad.

President Trump should have Mike Lee waiting on standby just in case anything happens with the Kavanugh confirmation due to dirty tactics on the left. Mike Lee could be quickly confirmed before the midterms. I am still rooting for Kavanaugh though and I think he will make it.

Abortion in this country is out of control. It’s not in trouble though no matter what the far left says. Unfortunately abortion will not be stopped even with a conservative on the Supreme Court as a swing vote. More Americans have to value the earliest beginnings of life before that happens.

Biden’s floor speech was on June 25, 1992, more than three months later in the election cycle than it is now.

There was no Supreme Court vacancy to fill.

There was no nominee to consider.

The Senate never took a vote to adopt a rule to delay consideration of a nominee until after the election.

The judge has repeatedly stated that he always got Raisinettes at the movie theater, from the time be was seven and into and past his college/law school days.

But now former classmates and friends have stated that Kavanaugh would often get Junior Mints.

So, you go to a job interview, let’s say rocket scientist, and the hiring people ask you some questions like,do you drink? Do you have any problem with drinking,have you ever been accused of assault, and of course the big one, do you know we have a company policy here that you have to be respectful to co workers and your superiors. And your response is, yeh I drink, don’t you? No never had a problem,you? Never did anything sexually like assault, ok….now your crying, is it something we said? Well,I’ve got this calendar that I wrote on myself. Ok, so you’ve never been belligerent in any way because of alchohol…NO, never been arrested or questioned related to any drinking? I’ve work hard, busted my butt,played sports, yeah I had some beer, beers, I like beer, yeah beer, like it, you, do you drink? . No, I don’t have a problem…neither do I………….

Just a question or two about the questions about the Willaims College controversy: 1) if there have been so many rapes on campus and the college is trying to hide them why haven’t the parents filed lawsuits against the college and 2) don’t some of the alleged victims come from families that have the wherewithal to hire lawyers and sue the college for millions?
It just doesn’t seem to make sense to me. Not an opinion just 2 questions.

I guess no one is reading anyone else’s posts. As stated, the cases are reported to the police without names because the victims don’t want the police involved. The DA can’t prosecute if there is no defendant or victim. That’s the victim’s choice and the school’s procedure.

Harrington & Supporters are saying there is a problem at Williams that Capeless did not address. Question: How can a DA’s office address an issue if it is not reported, no complaints are filed despite actions that violate the criminal code, and Williams resolves the issue by payoffs and deals cut?

I don’t what the state police are assigned to, but they are under the direction of the prosecutor, if the DA office catches wind of a crime, then it has the power on its own to investigate. The office does not need permission, or even cooperation from local law enforcement (or Williams College for that matter).

Wow are you offensive. If a rape claim was snuffed out at the criminal level and no probable cause was found, the victim and parents would be virtually powerless to do anything about it. Unless she decided to fight it by going public and having her face and name plastered in the media, her personal history put under a microscope, and her rape story shared with the rest of the planet.
She’d be known as a rape victim first and foremost for the rest of her life.

Fighting a DA legally would be a complete waste of time. They have unlimited power and absolute immunity that protects them no matter what they do.

But hey, no big deal, right? She’s probably some spoiled rich girl anyway. Probably deserved it.

Why do you assume the WPD never investigated any of these claims? You have no basis to assume that. That is the info that Caccaviello has been called upon to provide – how many cases were investigated and their disposition.

But you are correct about the MSP not investigating any cases. They never investigate rape cases at Williams as a matter of policy.

That fact right there should tell you all you need to know.

Your absolutely right I have no basis to judge that they did not investigate these claims or that they were notified but they do have the power to arrest or charge someone without consulting with the DA’s office. I guess I would pose the same question to you, how can you make the assumption that they were investigated and the cases forwarded to the DA for review or that there were victims wishing to have their cases go forward. Both claims are simply assumptions

Dan – I think that question is too narrow, there are a number of issues at play. I haven’t heard anything about Harrington “looking into the alleged rape culture at Williams.” I have heard her promise to re-examine every unindicted rape allegation – not just at Williams – going back 15 years, which is the statute of limitations for the crime.

Williams is under the microscope because of the number of allegations on campus. A rape culture appears to be thriving. But if the occasional case made it into criminal court, things would likely change. That is the bigger point here. The apparent policy of no rape prosecutions at Williams does more than deny justice for victims; it provides no impediment to the numbers going down in the future.

The numbers deserve an explanation and the silence is deafening, especially given the bombast on this board about the truth bomb headed our way. It’s always just around the corner, but never quite here. Why is that?

And yes, this issue is enough for me to support Harrington. But it’s not jut supporting her – it’s about making sure that people who behave like team Capeless are bounced from power.

Dan – Again, that is not what she said. She said she was going to REVIEW every un-indicted rape case brought in the last 15 years. One would hope (and expect) that the majority would be turn out to above board and up to snuff. But what about cases that potentially don’t meet that standard? Or if a bunch of them are concentrated in one area? Are they not worth uncovering and delivering justice on behalf of victims? Those are the cases she might “go after”.

In the meantime, zero, zilch, nada from Cacaviello (and apparently the WPD Chief?) on why no prosecutions during the Capeless era. Which led to steadily climbing Clery numbers throughout his tenure. Previous DA’s were not afraid to prosecute Williams students when required, which kept numbers much lower. Law enforcement matters.

Would you at least like to see some data, such as how many cases were investigated and how they were disposed?

I disagree that Brett Kavanaugh is a high functioning alcoholic. Actors like Errol Flynn, Dean Martin and other alcoholic actors can fake it because let’s face it acting isn’t brain surgery, but a judge needs to be extremely intellectual with a good memory for facts. Brett Kavanaugh showed his extremely good memory for cases and law. Also, with two young children, Kavanaugh’s wife doesn’t seem like the type of woman who would stay with an alcoholic husband and father.

All of the above mentioned alcoholic actors had serious relationship issues. Dick Van Dyke wasn’t married from 1984 to 2012 presumably during which time he was a hard core alcoholic.

We are beyond maybe proof of an alledged sexual assault, unless you know something we don’t. However, we now have the facts of him in a couple of lies with now more than one coroborating witnesses. We are talking about a high school incident decades ago, not how bad a drinker he has become. Now his judgement character, as well as his Temperment come into play, let alone he lied more than once under oath. The under oath part bothers many,he’s a Judge for krist sakes.

And the Williams College rape non-sense is fake news. There is a huge difference between a reported sexual assualt, and an actual sexual crime, that is investigated by the police.

The problem for Cicerkrol is, his legal advisor is Andrea Harrington, who doesn’t know anything about anything, least of all a rape case. There are in fact, cases reported only to Wiliams and cases reported to the police, as well as those reported to neither. Keep these no-nothings away from our DA’s office!!!

Quotes from David Capeless in an iBerkshires interview a few years ago about campus rape at Williams. Why don’t you read them closely:

CAPELESS: “Right from the beginning, if a girl complains, college security notifies the police, the police notifies my office. And the school will pursue it…. Unfortunately, there’s been a misunderstanding of what colleges are doing. It’s too easy to think that they have every reason to suppress the idea that there are assaults on their campus. But they’re not suppressing the information. Frankly, in the past, there were students who were discouraged from reporting [to civil authorities], but not now.”

Regarding the though process behind Capeless’s approach to sexual assault and rape cases, his answer to this question was quite enlightening…and revolting:

QUESTION: If someone chooses not to pursue a criminal prosecution, the worst thing the college can do is expel them. Does not society demand more of a punishment for the crime of rape?

CAPELESS: That all depends on the facts. In some instances, I would agree with that. If by what they have done, are they inclined to do it again? Or was it an aberrant moment that’s highly regretted?

I can assure you that no sexual assault victim ever was given comfort by learning “it was an aberrant moment that’s highly regretted. Very similar to the awful “just few minutes of action” comment about the Stanford rapes.

This issue came up because Caccaviello went after Williams at a debate. That’s what led to the Clery Act data coming out and all the rest.

Harrington did not make up these numbers, and it is not just Harrington who wants an explanation as to why Capeless never prosecuted Wiliams rape cases.

Any decent human being would want to know if something rotten was going on here. If all was above board, then share the stats and explain why it is reasonable that there was not one criminally prosecutable case out of the lot.

I’ll tell you what Capeless never did is go after people with personal politics like Harrington did, threatening Melissa Mazzeo with a promise to ruin her career. Is this what the DA’s office would be like under her? Why don’t the people who read beyond the planet need to know this information? Why doesn’t Mazzeo call the Eagle? It’s shocking.

The FBI investigation is being run by scump. This is why there was no interview of Ford or any of the key witnesses. Unbelievably Kavascumps peers who actually contacted the FBI and asked to be heard were not. This confirmation process is undeniably a total sham. Because this sham is not criminal in nature means scump is deciding who is interviewed and who is not. The process is nothing more than a slight delay for KavaScump’s confirmation. This is a partisan circus that has shown the American public how desperately we need a blue wave in November and because of this sham we will definitely get one. Look at Mitch McConnell. He is foaming at the mouth and pulling out all the stops to put the most tainted nominee of all time on the SC. THe FBI if given the green light to unturn every stone would burry KavaScumps. Dr. ford not interviewed, Mrs. Ramiriz’s 20 named witnesses not even contacted. Dr.Fords witnesses not contacted and KavaScumps peers who would shed light as to him being a raging drunk not contacted. I think you see the picture. Someone from the FBI will come forward sooner or later to tell us that the investigation was constrained and those constraining it were key republicans and the disgrace we call the president. I believe more so now that the key votes to sink KavaScump will deliver. Any of these undecided senators will realize that if they approve this miscreant their political days are over. The Republican dinosaurs who are pushing for this nominee are now marked for removal. This is about ethical behavior and the decent Americans demand ethical behavior and there has been nothing ethical about this circus act.
