CACC SLAMS HARRINGTON FOR ‘MISLEADING’ VOTERS ON WRITE-IN … HARRINGTON INSIDERS KNOCK D.A.’s ‘DESPERATE’ PRESS RELEASE

(FORTRESS OF SOLITUDE, TUESDAY-WEDNESDAY OCT. 30-31, 2018) — Incumbent District Attorney Paul Caccaviello, mounting a write-in campaign against Andrea Harrington, accused Harrington of conducting a misinformation campaign designed to confuse voters on Election Day, Nov. 6. Harrington beat Caccaviello in the September primary to win the official nod of the Democratic Party. The narrowness of the win, less than 1%, prompted the incumbent to take the unusual route to office.
Caccaviello says the Harrington Committee has been telling voters that the ballot will not contain a provision for write-in candidates. The ballot does, in fact, allow voters the opportunity to physically write in the name of their preference for office. Insiders familiar with the workings of the Harrington campaign deny the charge, calling it a “desperate” attempt to canvass in the campaign’s final week.

Caccaviello Calls on Harrington Campaign to Stop the Spread of False and Misleading Information
Berkshire County: District Attorney Paul Caccaviello publicly called on Andrea Harrington and her supporters to stop misleading the public about the Write-In process.
According to the Secretary of State’s Elections Division, “all ballots must have an area designated as a write-in space. This space allows a voter to physically write in the name of a person other than those names already printed on the ballot and thereby obtain a vote. A voter need not use the sticker to have such vote counted for the sticker candidate. He or she can physically write in the name of that candidate.”

Caccaviello wrote, “My campaign supporters and I work tirelessly to reach out to voters and provide them with information about my write-in campaign. While I don’t expect my opponent or her supporters to provide information about my campaign to potential voters, I do expect them to answer voters honestly when asked if there is and/or about the write-In process.”
“For the past two weeks while canvassing throughout the county several residents reported they have been told by the Harrington Campaign that there is no “Write-In” process and that since their candidate is the only name on the ballot, she is the only candidate that voters can vote for.”
Caccaviello went on to elaborate on one such encounter from a voter in Great Barrington who called Caccaviello personally. According to this gentleman, he was told that there is no write-in process allowed and that Andrea Harrington is the only candidate on the ballot.
“The resident was so disturbed by the contact he had with the Harrington supporter that he called me directly (to discuss),” Caccaviello stated.
“My volunteers reported similar incidents while canvassing in Pittsfield this weekend, and also earlier this week while making phone calls to voters in Great Barrington,” Caccaviello added.
“The false information about the Write-In process being spread by the Harrington Committee is not only misleading but unfair to voters. I am publicly asking Andrea Harrington and her campaign to stop misleading voters. The Write-In Campaign that I have launched is part of the democratic process, and we should be doing what we can to truthfully educate voters about their options on election day,” Caccaviello stated.
“With only one week left in this campaign, I hope that my opponent will try to honestly educate the voter about relevant issues facing our community and that her campaign will use their time to talk about their candidate and her plans for the District Attorney’s office.”

As of press time, Harrington did not respond to THE PLANET‘s request for comment. She has stopped answering our requests for comment. We did, however, triangulate responses from several insiders, from whom we put together this response, one that accurately reflects the campaign’s stance:
“The Harrington Campaign is not talking about any write-in campaign in either phone calls or while canvassing. Why would we draw attention to a misguided campaign. Our volunteers have been provided scripts and no where on the script do we talk about a write-in campaign. We have informed voters that Andrea Harrington’s name is the only name on the ballot for District Attorney, which is factual. We are asking that voters to fill in the oval for Andrea Harrington.
“This appears to be a desperate attempt by the write-in candidate to draw attention to his campaign. His supporters are stopping at nothing to spread misinformation about our campaign and try to make my supporters look bad, when we have done nothing but run a positive campaign focused on the issues in this race.”

As the Cacc release says, write-in spaces appear on each ballot. Write-ins will count as long as the voter’s intent can be determined.

When Harrington was gathering signatures for her run, a Paid petition signature obtainer approached me at Stop & Shop. The individual said to me that she was running because the DA wasn’t running for the office and it was open. I said that wasn’t true and asked where he got that info from. He said, “That’s what we were told to say by Ms. Harrington at our meeting.”
So, misinformation from Harrington and her scurvy crew is not something we should be surprised at.
And yes, Harrington did call Mazzeo and threaten her, and yes she did call Bowler and threaten him. Both were at Cacc’s fund raiser last night.

Truthsayer, it was Knights campaign that hired someone to gather signatures, not Harrington.
Harrington met with Bowler, not called, and no threat was made according to Andrea. Same as with the call to Mazzeo, no threat was made per Andrea. It’s a she said, she said thing. You weren’t there, so you don’t know, as I don’t know. The only ones who really know were the individuals involved.

Harringtons behavior made me pay attention and everyone I asked said Paul Cacciviello is worthy and is qualified. Also said he was a gentleman.
If Cacc’s team spent more of its remaining time educating voters on how to write in his name on a ballot, instead of constantly whining about Harrington’s campaign, they might just pull this out next week.

This is a given: contrary to popular belief, Missy Mazzeo never attended any of our meetings early on. She knew about the effort but never participated in its incubation stages.
The write-in effort began on September 5th, with your truly reaching out to crucial allies; this included Knight campaign manager, Mary Talbot. From there I reached out to others I thought could bring along important voting blocks, and Cacc family members.
After our initial crew pitched a PPT show to Cacc, he waffled somewhat . . . then . . .
. . . Bianchi and Bowler powered their way into the picture. A consultant from Springfield was recruited to scrutinize our effort. Once he gave Cacc a thumbs up . . . well, the rest is history.
From where I’m seated, certain Bianchi people worked with pointed precision to push me out. I’m guessing once Christmas help, always Christmas help. Or the other train of thought is I really didn’t want Bianchi too close to the process since he lost every Ward and Precinct in 2015. He and his other half still are kinda toxic around Pittsfield.
A few of Cacc’s former and current ADAs, highly critical of Harrington supporters posting under pseudonyms, ironically employed a like method of communication. Hypocritical, at best!

Mexican authorities arrested two Hondurans who allegedly shot at federal police officers escorting the migrant caravan across the southern state of Chiapas. The attack follows shortly after government warnings about Molotov cocktail attacks around a second caravan near the border with Guatemala.
The attack took place near Ignacio Zaragoza, Chiapas, when members of Mexico’s Federal Police were escorting the migrant caravan as part of “Operativo Caminante” or “Operation Walker” across the southern border state. According to Mexico’s Interior Secretariat, two men identified only as 22-year-old “Jerson” and 17-year-old “Carlos” spotted the group of police officers guarding the caravan and began firing at them.
The attackers’ pistol jammed, allowing police officers to arrest them without any injuries. Federal authorities seized a .380 caliber Glock with nine rounds still in the magazine.
The attack came soon after Mexican authorities issued a warning about migrants in Guatemala who were preparing Molotov cocktails and acquiring firearms to use against police officers in their attempts to break through the border to Mexico. Over the weekend, several clashes occurred where migrants threw rocks and used various makeshift weapons against border security forces.

The DA’s position should not be an elected position. In any elected position it is very possible that the winner of a contested position could be an individual such as Harrington who has neither the background or the experience that the position requires. When we look at the 2015 mayoral election we had an idiot and a genius with a solid successful corporate background and the idiot won in a landslide. This can only occur in the public sector where by the position is determined by how popular the candidates are. In the private sector this never occurs. We need to switch to a city manager type of government. If Tyer were a candidate for the city manager and was opposed by Gaetanis she wouldn’t have a prayer in the world of being offered the job. For all of the decades that have past, no one in the Berkshire County District Attorney’s Office has been held accountable!
Meanwhile, alleged child molester and sexual deviant Carmen Massimiano never faced legal charges, despite all of the allegations, news reports, and rumors over the decades.
That means that the Berkshire County District Attorney’s Office plays politics instead of enforcing the law. If you are innocent like Baran, you get framed and sent to prison. If you are someone like Carmen Massimiano, you get to serve as Berkshire County Sheriff for three decades and collect a 6-figure state pension.
What’s worse, North Adams is #1 once again in the commonwealth for violent crime, while Pittsfield is #5 in 2017, according to the FBI.
I endorse Andrea Harrington for Berkshire County District Attorney! She will bring progressive change to a political office that framed an innocent man named the late Bernard Baran.

As an avowed Harrington supporter, herein and in the Eagle, it should concern all of us that you are making a lot of assumptions and accusations. Ms. Harrington claims to be a reformer seeking change. The supporters of this “reform” shouldn’t be out making accusations and unproven allegations against anyone, especially the former sheriff.
Idealism is a beautiful thing. But if you check the definition of idealism, it’s holding high concepts and ideas that are unrealistic and only exist in the mind. The fact is, there’s all the idealistic promises of Progressives that ultimately fail when their ism hits the wall of realism (reality).
This race shouldn’t be a race. The DA’s office shouldn’t be an elected one. It should fall to an application process based upon experience, evaluated by the Governor’s Council like a judgeship, and awarded to the most qualified individual.
Because this is now a race, if we apply the hiring standard used in most scenarios, the most experienced and well-equipped person deserves the job. It should be an equal opportunity position based upon merit and experience. Knight and Caccaviello were the only two running that can handle the job. Harrington can have all the energy she needs, but like physics, if energy is misapplied, disasters can occur.
The reality today is that there are two choices. Paul Caccaviello who has the experience and knowledge to run the DA office, or Andrea Harrington who does not. It’s up to all the voters now, not just the party elites.
Want to talk about change? It’s time Berkshire County and Massachusetts becomes a true multiple party system, not just a bunch of political hacks who get elected because (D) is after their name.

The Baran case was not a frame up Jon, it was thrown out because of the ways the evidence was collected. The interviews with the children were not conducted correctly and with that evidence thrown out there was really no case against Mr. Baran. Frame up? No. Incompetence? Yes.

They used against Baran the fact that a child tested positive for an STD, although Baran himself tested negative…and the boyfriend of the child’s mother tested positive! That’s called a frame-up.

The Baran case is sad and tragic. But Jonathan I don’t see why that should reflect badly on Paul Caccaviello. He was not a decision maker back in those times. My guess is that Distrct Attorney PC would have filed for the release of Baran once the facts were revealed. Just a guess based on the eye test. Conversely how would one know what AH would do in the same set of circumstances?
The facts of the original case were egregious. The 4-year threat to retry Baran was beyond egregious – it was sick. If Caccaviello had an ounce of moral courage he would have stood up to Capeless the tyrant. What’s the value of a human life? For Capeless and Caccaviello, less than the cost of admitting you were wrong, apparently.

While the cases are similar in many respects Capless as much as I don’t care for him was left a case that had been adjudicated and had to allow the process to take its course it sucks at times but that is our legal process. The evidence was ditched possibly by Ford not Capless and no way I see PC that mess.

I agree with all you say about the Baran case, except for the part giving Capeless a pass for his role.
While Capeless was not part of the corrupt prosecution that sent Baran away for life, he was the sitting DA when the awful details of the Baran trial came to light. He was the sitting DA when a judge ordered a new trial for Baran in 2006. How did Capeless respond? By appealing the order for a new trial, insisting that though flawed the original trial was indeed fair, and keeping Baran in legal limbo for another 4 years.
That’s because Capeless is a sociopath. Anyone with even an ounce of humanity would have dropped the charges, apologized profusely to Baran for what he had endured and wished him Godspeed.
Bernard Baran was a human being. He was a demure, soft-spoken gay man, and I don’t even want to think about what he went through in prison. Meanwhile, Daniel Ford is a judge and David Capeless is drawing a pension of about $150k/year for life for his “service” to the state.

I was a Berkshire County prosecutor for ten years, heading sexual assault investigations for half that time. I am trained as a campus sexual assault investigator. I am appalled by Attorney Pucci’s suggestion that Berkshire DA Paul Caccaviello use the grand jury to force colleges to disclose names of student sexual assault victims against their will and then send investigators after them.
It’s doomed to fail. The federal laws governing campus investigations and reporting require that victims be guaranteed anonymous reports and that records shall not even identify victims who do not want to be identified. There are Massachusetts laws which protect victim confidentiality as well.
It would be harmful. This scheme would frighten the students whose reports were anonymous, and the ripple effect would set back already-reluctant reporting on campuses of what are often very complicated events. Victims, men and women, understand that there are painful costs associated with prosecution, particularly when one is a student with a packed schedule, who lives far from Berkshire County for nearly half the year. It is insensitive to victims, as is Andrea Harrington’s announced determination to review and if appropriate, re-open all non-prosecuted sexual assault cases fifteen years back. Each course would traumatize people who have made their peace with a decision that they cannot or will not testify.
I understand that Ms. Harrington’s election and re-opening of cases might give Mr. Pucci’s client an opportunity to pursue a prosecution, and that he wishes to zealously advocate for her. I encourage others to think of the many victims who will be harmed by this victim-hunt. There is more than enough work for the DA’s office with the crimes that are openly reported without harassing people who have said no thank you. i hope that Berkshire voters will write in Paul Caccaviello’s name for District Attorney.

Chuck – Just to be clear, I am not a lawyer, I have nothing to do with the Harrington campaign, and I don’t know Pucci any better than you do. My interest in this issue came about because of a comment Caccaviello made during the Williamstown debate. It piqued my interest because I remembered reading a Washington Post article a few years back that revealed some shocking info about sexual assaults at Williams. It had the 5th highest per capita rate of reported rapes and, amazingly, had the 16th highest number in absolute terms out of about 1,000 colleges. A tiny school like Williams. 16th highest number of reported rapes. Shocking.
While I am not a lawyer, I’m pretty good at research and putting two and two together. I started looking at Williams’ Clery Reports, then looked into info relating to prosecutions, or should I say the complete lack of prosecutions.
And so I continued to dig deeper. And everything I have found points to something terrible going on here.
One of the most disturbing aspects of this is seeing women like Lee Flournoy continue to try to spin this situation and conclude “nothing to see here.” I don’t feel like responding to it in detail now, but the Flournoy comment just posted by Truthsayer is nothing short of disgusting.

I know that Harrington et al are lying about not misinforming voters. I’ve been called and I’ve heard their spiel.
They say that Andrea Harrington is the ONLY candidate ON THE BALLOT, factually true but it implies there are no other options like a write in. They say she is the democratically elected candidate endorsed by the Democratic Party and bring up Warren and Healy.
When I asked about a write in candidate I was told the following.
“There is write in candidate on the ballot, Andrea Harrington is the ONLY (they stress this) candidate ON THE BALLOT, she was democratically elected and is endorsed by the Democratic Party. We ask that you fill in the oval and vote Andrea Harrington, the only candidate ON THE BALLOT for district attorney.
Now pretty much everything they say is correct but it’s misleading and I think crafted purposefully so. It’s almost like a bunch of lawyers got together and wrote a script that is legal but obfuscates the truth just enough to tilt things their way.

“There is no write in candidate ON THE BALLOT.” True there is no candidate exclusively as a write in. No name written in, there’s a space but you have to put the candidate’s name in yourself

They are implying, by parsing the words, that there’s only one candidate, Andrea is that candidate, and they diminish the write in slot by saying there is no write in candidate ON THE BALLOT.
They don’t say you can’t write one in the just say the candidate doesn’t exist which obfuscates the truth.
Another call I received, when I pressed if I could write in a name, it was the same AH is the only candidate ON THE BALLOT.
Again I asked if I could write someone in and they said “you can write someone in but it might invalidate your vote”
I guess if done poorly it could (so not lying) but implied that you really sorta can’t write in.
They also imply that it might invalidate your entire ballot which, considering some of the other issues on the ballot, it makes the write in seem very risky.

The reporter also said that the victim’s name had been leaked to him by the DA’s Office. That is actually crime. Massachusetts General Law Chapter 71, Section 97D. Looks like it’s punishable by up to year in jail and a $1,000 fine.
