CITY’s CONTROVERSIAL CHOICE OF LEGAL SERVICES THE GRINDING OF A POLITICAL AX, LEE SUPPORTERS CHARGE

Second of Two Parts
(FORTRESS OF SOLITUDE, THURSDAY AUG. 4, 2016) — With the simmering controversy in the appointment of legal services not making one column inch of taking up one second of time in the Mainstream Media, it has again fallen on THE PLANET to expose the latest example of the political rift that has held Pittsfield hostage to a petty political feud between two warring “machines.”
As machine politics goes, this isn’t Colossus vs. Guardian. It’s more like The Little Train that Couldn’t vs. a jammed cap gun. Rock ‘Em Sock ‘Em Robots has more working parts. Nonetheless, one could successfully argue that it has been for that reason all the more debilitating for the citizens of this once great city. While the Hatfields (Del Gallo Machine) battle the McCoys (Wotjkowski Machine) going on more than 30 years now, another precious day goes by where Pittsfield loses its chance of addressing its problems — and one more day before the systemic issues eroding the foundations reach a point beyond repair.
In awarding legal services, Pittsfield had two choices: Donovan & O’Connor (D&O) vs. Courtney, Lee, & Hamel (CL&H). On the surface, both seem equally qualified for the job. In the end, Pittsfield went with D&O, a choice one would have predicted had it been made solely for political considerations. Was that the criteria? Darren Lee, former assistant city solicitor and a principal in CL& H thinks so.
THE PLANET contacted Lee, and he was forthcoming about his concerns:
“There are many layers to this issue, some more complex for me than Tom (Hamel). However, in my view at the heart of this RFP is the public bidding laws, which the Massachusetts are meant to obtain the lowest cost that fair competition can achieve to protect and preserve taxpayers dollars, protect the integrity of the bidding process, prevent favoritism and maintain a level playing field for all bidders,” Lee said. “In this case it appears the justification to award the contract to D&O at a significantly higher price was experience. [ED NOTE: Cited by Colleen Hunter-Mullet, purchasing agent, in a letter to Lee dated July 7].
“I beg to differ,” Lee continued. “Tom and I have 40+ years practicing law in the municipal arena, and anyone that knows Tom knows he is an excellent attorney. My reputation for excellence speaks for itself. Never mind, I did the job for 4 years at a very proficient level and made the City $2,200,000.00 in the meantime [via Lee’s push for the tax title auction]. To me, the RFP was an attempt to sanitize a choice that was predetermined. As a taxpayer, I view the savings in the bids as significant and any opportunity for the City to save money ought to be embraced.
“On a personal note,” Lee said, “I‘m not surprised as a [Dan] Bianchi supporter that I will need to suffer at the hands of Linda and the Tyer supporters until the next election, but it is unfortunate that each election cycle brings more divisiveness in this small town, keeping us from our true strength of unity. In fact, I’m sure this e-mail will cost me something down the line, whether it be a financial loss or loss of a resource at the hands of the City! I know sour grapes when I see them, and I’ve experienced many in my years, but this is a simple case of nepotism. If I stipulate an equal ability to represent the City, although we are better, why hasn’t the lowest accepted and why did the committee negotiate a lower fee for D & O behind closed doors? I don’t have time to [feud] with Linda and her crew, but this decision is highly questionable.”
Sources Say Bid Protest Under Consideration
THE PLANET‘s investigation reveals that Lee’s company is considering a bid protest, according to one source, although Lee wouldn’t comment. One city hall insider agreed with Lee, saying the mayor “has a political ax to grind with Darren. To me, this was done to sanitize the selection of [former mayor] Jim Ruberto‘s long-time friend [Rich Dohoney of D&O].” Another city hall source said, “To me, the story is it’s a shame that the city of Pittsfield taxpayers continue to lose out on saving money for political cherries being handed out.”

Linda is not fooling anyone any more. I don’t think she is even trying or cares that the people are wise to her affiliation. She is not leading the pack but she is running with the wolves. Or foxes as the case may be.
Don’t give the wolves and foxes a bad rep, jackal weasel or skunk are more fitting.
Pittsfield as a whole has no interest in saving money.As a group of decision makers who can easily absorb 200 dollar a year tax increases.Not one of them deal with SS and just do not relate well with regular folks.
Its time to model a group of SS candidates after the WHEN group model that got these snobs elected.
It’s also time to make our local newspaper accountable by reporting the stories that expose the corruption in this area. Just as on the national level where the media coddles the Democrats in office, the same thing happens here in Pittsfield.
The Berkshire Eagle has reached a new low if that is even possible. In an editorial several days ago, they are now calling anyone who disagrees with a female progressive politician to be a misogynist. The editorial was lecturing to everyone who is speaking against our female AG here in Massachusetts who pushed for the nonsense bathroom law and is now going after guns.
We can only imagine if Hillary becomes president it will be four years of “You are criticizing her decisions because you hate all women”, just as we have had to endure 8 years of claims that anyone who disagreed with Obama did so only because of his race.
Sorry Pat but that leopard is not going to change its spots. The Eagle comes across as more embedded than it ever was. They might as well have an office at city hall.

I do not think it is fair to judge anyone for when they worked for the city of Pittsfield and under that umbrella of politics. He probably feels like a great smelly mess has been lifted from his shoulders and now he can be himself.

Lost in the conversation is the election. It is obvious the Mr. Lee has lost sight of the fact that the Tyer administration won the election by 2500 votes and that my friend is a mandate from the citizens that they are tired of Bianchi/Mazzeo appointments of unqualfied polticlal hacks like Mr. Lee.

I have to agree that mr. Lee’s reputation does speak for itself. He worked under Kathy Degnan, the woman who wore her father’s suit to work. He answered directly to her. She was the worse solicitor the city ever had.
For that reason alone, I’d never hire him or his firm.

The solution to the DelGallo vs. the Wojitkowski feud: throw both sides out. But remember, many of the current employees owe their hiring to one or the other. So does that mean we basically throw out 100% of the entire City workforce as well?
I remember when I bought my first house and needed the sewer and water lines renewed. I remember a now retired foreman in the Dept. “recommending” a contractor for the job. he told me the job would proceed trouble free.
I had a machine at the time, so I did my own digging and repair. The scrutiny was worse than a colonoscopy. I figured that was the price to save a few thousand dollars.
The towns cities and state have it out to ream the taxpayers.
Lets clean out all the democRATS and RINOs in December.

“Democratic Berkshire Senate hopefuls to spar August 11th in Pittsfield”

PITTSFIELD — Three Democratic candidates for Massachusetts Senate in the Berkshire, Hampden, Franklin and Hampshire District have agreed to an Aug. 11 debate.
Attorney Andrea Harrington of Richmond, nonprofit director Adam Hinds of Pittsfield, and lawyer Rinaldo Del Gallo III of Pittsfield will face off at Berkshire Community College starting at 7 p.m. next Thursday night.
The moderator will be Frederic D. Rutberg, a former Pittsfield District Court judge and principal in the group that recently purchased New England Newspapers, Inc., parent company of the Berkshire Eagle.
The primary is Sept. 8, and the winner will face Christine Canning of Lanesborough, a Republican, in the Nov. 8 general election.
Benjamin Downing, a Pittsfield Democrat who has held the Senate seat for ten years, announced in January he will not run for reelection. The sprawling district comprises 52 towns.
Earlier the same evening, 3rd Berkshire District state representative candidates Michael Eric Bloomberg and incumbent Tricia Farley-Bouvier will debate. That event starts at 6 p.m. and will be moderated by James Mahon, a professor of political science at Williams College.
The two-for-one event is sponsored by Berkshire Brigades, a Democratic Party organization, and cosponsored by the Pittsfield Democratic City Committee.

What is Hillary’s job plan? Not hearing one. Both of these candidates need to be pinned down to specifics. It’s time. The media keep them bickering, but in the meantime we need the meat and potatoes of what both of the presidential candidates intend to do. The country is not doing well financially. The media is keeping the facts hidden of the bad shape this country is in financially. We are one step away from financial calamity.
All we are getting from both presidential candidates are broad generalizations of what they will do. We need specifics so we can hold them to their promises after they are elected. Is this why they will not give specifics because they are afraid of being held accountable for their campaign promises?
Hillary and Obama have the same plan, the Tyer plan tax the working give to the non working-poor and wealthy.
I do not know Clintons job plan except to say she will change very little in what has generally been a very long successful road out of the collapse of 2008.
Clinton has a long history to judge her by and by all objective accounts of has acted in a very rational and professional manner and has tremendous experience.
Trump has zero experience and acts unstable with no plan except to be the anti Hillary candidate.He has created for himself a climate where she is the anti Trump candidate.She wins in a landslide if he cant articulate job creation .
