(FORTRESS OF SOLITUDE, WEDNESDAY SEPT. 7, 2016) — Ah, so much happening on THE PLANET and so too few days to share — but we press on, as always, a skiff against the tides.

With respect to the controversial proposed appointment of Fred Conyers Jr. to the Pittsfield Fire Department, you can forget the “proposed.” It’s a done deal. THE PLANET, ever mindful of Strunk & White‘s injunction against double negatives, tell you the appointment cannot not happen.

Conyers (along with four other applicants for Pittsfield Fire Department posts) comes before the city council Sept. 13 for “confirmation,” but even if the council rejects the application, Mayor Linda Tyer said at a closed press conference yesterday that she would still appoint Conyers. Tyer called the council’s confirmation “a formality” and not required by law. With respect to Conyers, Tyer had just neutered the council. Politically, it was well-played. Strategically, we can’t imagine the members would be happy with their inessential status.

Reached last night, council president Peter Marchetti said, “I agree she has the right to reappoint. The charter gives council approval of certain department heads and members of multi member committees. I don’t know about the [wisdom of the] appointment and would prefer not to comment until it and all the documentation has been submitted. I believe that the process should change and if no approval is required it should not be submitted as an approval. It should be submitted as for your information [only].”

Ward 1 councilor Lisa Tully told THE PLANET, “If our vote doesn’t matter, I don’t understand why it would be on the agenda for us to vote. I respect Mayor Tyer and Chief Czewrinski and trust that they are making the correct decision. From what I read, Mr. Conyers is qualified and  passed the State and Pittsfield requirements.”

[ED. NOTE: THE PLANET contacted all 11 councilors, late last night. We include  the remarks of Ward 6 councilor John Krol and Pete White, at-large, below. They came after we posted the column.]

Conyers, acting fire chief Bob Czerwinski, the mayor, and city director of administrative services Roberta McCulloch-Dews, were present at the “closed” press availability, attended by THE PLANET, the Berkshire Eagle, Northeast Public Radio, New England Public Radio, and iBerkshires.  After her opening statement, Tyer introduced Conyers, who talked off the cuff of his experience “going down the wrong path,” his nearly four years in state prison on drug and weapon charges, and his efforts in the five years out of prison to rebuild his life: “I wanted to show people who I am” and demonstrate trustworthiness, Conyers said.  He said he wanted to get some respectable years behind him in the community before applying for the fire fighter’s position, a job he’s wanted since he was 11, when he lost three friends to a house fire on Edward Avenue in the early 1990s. His rehab stint included jobs in the private sector (Home Depot, Unistress), providing for his family, and coaching youth sports (currently, Pop Warner football).

‘Push Back’ from the Ranks

THE PLANET asked Czerwinski if the ranks will accept Conyers as a trusted member of the PFD, one of “the brothers.” The acting chief acknowledged “push back” from the men but said he “had no concern about ‘the team’” in their ultimate functioning on calls or about their ultimate trust of Conyers. “Over time, the guys will accept [Conyers],” Czerwinski said. Conyers said he understood the concerns of the members, “but I’m a little disappointed in it.”

There is “push back” indeed — lots. Tyer said she and each city councilor had only the night before (Sept. 5) received a letter from Firefighters Local 2647 president Robert Leary outlining the members’ “concerns” with hiring Conyers.

THE PLANET, on behalf of the media, asked Tyer for a copy of the letter. First, she resisted, saying we should get a copy from Leary. We responded that since she was a recipient, she now “owned” the intellectual rights to the letter and could freely release it. Tyer said she still wanted it to come from Leary. THE PLANET pressed. We asked “If Leary refuses, would you then give us a copy?” The mayor said yes. “Then why not give us the letter now?” She relented, and after the conference ended, MuCulloch-Dews handed out copies. We include this little aside to indicate, non sequitur that it may be, that nothing comes to the press in this town unless you push hay-laden barrows, pull stubborn teeth, and persist. As Ringo once crooned, “It Don’t Come Easy.”

Leary said he “regrets that this letter has become necessary. Internal discussion of the past two months have lead [sic] the majority membership to believe this hiring puts its members and the City at risk. Although Civil Service is designed to be free from political influence, in this specific nomination … political influence has been introduced with a personal reference by Sheriff [Tom] Bowler.”

Chief Confirms Sheriff Hired His Daughter but, with Mayor, Denies ‘Quid Pro Quo

At the press conference, THE PLANET confirmed with Czerwinski that Bowler had hired the acting chief’s daughter in September 2014. He said that was well before Conyers’ application and the two could not therefore be connected. Of course, the obvious follow up is that the two-year passage of time would not necessarily prevent a quid pro quo between the sheriff and the acting chief, to be cashed in at a later date. Tyer denied any such arrangement, adding that she was proud to have the sheriff’s support of Conyers. Nonetheless, it remains a puzzle why Bowler, who has no professional duties with respect to the PFD, would go out of his way with this recommendation. It is also problematic that Leary, speaking for the membership, believes otherwise.

Leary said that Conyers “was bypassed for the previous two [PFD] appointments with no public outcry that we are aware of. The candidate’s past makes him ineligible for a position in the Sheriff’s Department or the Pittsfield Police Department. We believe his past is grounds for by-pass again, as past hiring practices have had candidates by-passed for much lesser histories.

Tyer said neither race nor criminal record has any bearing on civil service scores in the manner of veteran’s preference, for example. The mayor said Conyers placed at the top of the current list of eligible candidates without any extra help. She said he has passed the required psychological, medical, and physical-fitness testing. “No one was bypassed in favor of Fred Conyers,” Tyer said, with emphasis.

Mayor: Conyers ‘Has an Interesting and Compelling Life Story’

Since Tyer said she will appoint Conyers even should the council vote against, making him a certain hire. He can pop the bubbly. Czerwinski said Conyers and the four other rookies would begin training (“fire fighters’ boot camp”) on Sept. 19. Training would last five weeks. A one-year probationary period would follow.

Tyer said Conyers “has an interesting and compelling life story” and spoke of the need for “redemption” and “second chances.” So do the members of the fire fighters union, according to Leary: “We support anyone who has changed their lives for the good, but we believe this fire department is an inappropriate avenue … to promote the rehabilitation of this one candidate.”

Leary said the members feel Conyers’ “reputation and history will affect how he is perceived and how the 2647 membership is received. Our membership has concerns because we have been told by friends, family, and other public service workers that his public perspective [sic] is negatively influenced by his and his family’s history and association to [sic] drugs and violence.”

PLANET Says Roll the Dice on Conyers’ Sincerity

Fair enough, but how can someone who wants a second chance prove he is worthy of the undeniable risk without actually getting the chance? Fred Conyers Jr. has been vetted and, according to Tyer and Czerwinski, passed with ease. However, all the vetting, testing, interviews, and “looking him in the eye” prove nothing. There can be no certainly about Conyers, but the same can be said of any rookie. Most new hires work out and some do not. It’s always been and will always be the case, in the PFD, the PPD, football teams, supermarkets, offices, and every place of work that must successfully function as a unit.

A fire fighter told THE PLANET that all rookies can expect a rough ride when they first join. It’s not hazing, he said, but it’s to make sure they realize “that they’re expected to do a man’s job and not wilt” under extreme duress. In that respect, Conyers will not only have to endure what the other rookies face, but you can be sure he will face a little extra dose — all the more reason to expect him to prove his detractors wrong. If ever a person needed extra motivation, Conyers has it. At the press conference, he said he would use the initial opposition as an incentive to succeed.

One more thing. In his letter, Leary admitted that Conyers “passed his EMT class this spring” but questioned whether “he has been granted his EMT license.” Granted, having a fire fighter who is also an EMT is a bonus, but not all fire fighters are EMTs. Most are not. Moreover, being an EMT is not a job requirement. Nonetheless, Leary said the union “suggested in July,[sic] to Chief Czerwinski that the candidate should be required to have his EMT certification before he is appointed.” That is an unreasonable and discriminatory request, one that the chief is wise to ignore. Leary ignored THE PLANET‘s request for comment, sent on Aug. 6.

Both the mayor and the chief are sticking their necks out for the guy. After the press conference, THE PLANET talked one-on-one with Conyers. We looked deeply and sensed sincerity. We could be right. We could be wrong. The man might prove to be the best hire in department history. Then again, he may prove to be the greatest actor since Olivier and leave on workman’s comp after 16 months with the old “phantom back injury.” The only way to find out, and we agree with the mayor when she said it, that redemption comes not through empty words but bold gestures.

Consequently, we’ll join Tyer and Czerwinski in saying, “Give the man a chance.”

Redemption happens.

ADDENDUM — ADDITIONAL COUNCILORS’ REMARKS

JOHN KROL, WARD 6 (unedited) —  “I support Mr. Conyers 100 percent. I will certainly be voting in favor of this appointment. As you may know, Mr. Conyers’ character today has been strengthened through adversity he faced in the past, and his ability to ultimately overcome his mistakes. Years ago, he chose the wrong path and suffered the consequences for that. However, as he articulated during the press conference, his whole world changed when his first daughter was born. Family can do that. It gave him new purpose and powerful motivation to realize a greater potential.

“Thirteen years have gone by since his incarceration, and by all accounts, he has been a dedicated family man, hard worker and contributing member of the community, in particular, as a coach guiding others along the right path. 
“I think the response you have seen from the community on this topic has been overwhelmingly, and enthusiastically positive. This community believes in redemption, we believe in giving people an opportunity to earn a second chance. This makes me even more proud of this city and our people. I know Mr. Conyers will make us all proud as a member of the Pittsfield Fire Department.”
PETER WHITE, AT-LARGE: “Fred Conyers Jr. Has turned his life around. He waited the time he had to before taking the Civil Service exam and is currently at the top of the list. We can not say that we support people turning their lives around and then not honor the statement in practice. I fully support Mayor Tyer’s decision.”

I agree with the lovely Linda Tyer that everyone who rehabilitates himself or herself deserves a second chance to achieve success in life. Mayor Linda Tyer is both lovely from within and in her outward beautiful looks.
I disagreed with her when she passed a fiscal year 2017 municipal budget with a $6 million operational spending increase + a $12 million capital budget for at total of $18 million in new spending, which did not include the financing of the new Taconic High School project that has a $121 million dollar price tag, excluding any possible future cost overruns.
The lovely Linda Tyer needs to take another look at her municipality’s public finances next fiscal year, which begins on July 1st, 2017 – June 30th, 2018. It is unsustainable to increase municipal spending by $18 million next fiscal year + the financing of the new Taconic High School project!
Moreover, she gave tens of thousands of dollars in tax breaks to a multimillionaire from another community named Richard Stanley, who owns the Beacon Cinema on North Street. The fixed income seniors are going without, while an out of town millionaire gets fatter on taxpayer dollars.
The lovely Linda Tyer called herself a “moderate” Democrat in WAMC’s news story today. She is supporting, but not endorsing, Adam Hinds for State Senator and Tricia Farley-Bouvier for State Representative on Thursday, September 8th.
“I happen to think that his (Adam Hinds) moderate positions align with mine and so that’s why I’m supporting him,” said Linda Tyer.

. Since it is a done deal I say give the man a chance, but I do believe that politics has everything to do with this. And my negative feelings have more to do with the heavy handedness of the politics than the mans history. It does peel the political onion back a bit revealing more of its scope to those who were previously unaware of it.

If I am a Pittsfield citizen with children or grand children I certainly would not pressure them to stay in such a manipulated environment. Rather I would encourage them to look at other options.

I think it’s great the guys getting a chance. He seems sincere and looks to be very fit and has a good attitude. If he stays on the right track he should make a fine fireman. The only thing I don’t get is why all the hoopla? Just hire him like the other guys. Why the front page write up and a hug from the chief? Why weren’t the other guys getting hired given a front page feel good story and a hug? They probably have great life stories too, probably even one that doesn’t include cocaine and guns.

The hoopla was because of the push back from the Union. Mayor Tyer showcased that the applicants requirements were met without question. …. I happen to think she handled it exceptionally well. Front and Center!! Something Dan Bianchi would never have done. He was a back room deal guy. Nepotism all the way!!

The hoopla was caused by Dan Valenti and the Planet. This web site and tv show alone let the public know of the issue.

He could of ignored it like the other press but there was and still is an internal issue festering now in the fire department.

I say give Mr. Conyers his second chance to prove good. Thumbs up to DV, Linda Tyer, the chief and Mr. Conyers. Thumbs down to fire union and to the other press outlets that once again were asleep on the job…

We will never know if any of our public safety people are using drugs because for whatever reason, their unions do not want any of their people tested. You would think the city’s insurance company would insist on it. but once again we are in Pittsfield, Ma. running our own game here.

On the subject of redemption I support this candidate and Pittsfield needs to hire.minorities. On a larger scale we need the redemption of Mayor Tyer so that a rehire of her would be considered.Also need to go back to a 2 year term because our first experience with this Mayor is a nerve racking tax increase at record levels.I simply voted for Tyer because she appeared to be capable of handling a checkbook

The reason.TRISHA performed white flight and supports charter schooling and school choice needs to be explored.She gets elected by the PTOS and this shows she uses public school mom’s for a vote and that is all.TRISHA FARLEY does not support public pittsfield schools….she like Tyer wants it both ways

I am pretty sure Tricia does support public schools and wants taxpayers to drain their bank account to pay for them. She is never going to send HER kids to one in Pittsfield but she does support them as long as other people pay for them.

And I am pretty sure now that her kids have opted out to a safe school she wants to shut the door on any more kids getting a better education in a safe environment at a charter school. Once again a politician taking care of number one.

One more reason I am voting for Andrea Harrington.

I talked to several firefighters. They simply say that when Mr. Conyers chose to commit a felony crime he threw away any possible chance at a firefighter along with it. They do believe in 2nd chances but unfortunately his can’t be as a firefighter. I personally think he should get a chance but the guys make a good point.

Union has No say Rocky,the Mayor has spoken and just like the School, no vote, they don’t get a say, which for all intents and purposes,weaken unions severely. Personally,the lemon isn’t worth the squeeze as a lot of political positions ( jobs) such as jail guards,, fireman, city workers, and court officers are a dime a dozen, it’s who you know I can find you a hundred coaches at the drop of a hat if this was his ticket to rehabilitation. Massimiano opened this rehab door many years ago with the hiring of a former friend who had a questionable past, so this isn’t something new. Very surprised that elite Firefighters Union pushed back as little as it did.

If it’s the gun the union is worried about – what about their brother who beat his girlfriend, drove drunk and had a loaded handgun in the car?

The union protests too much. As Spa points out, they are trying to control an outcome. We should look to see who is number 6 on the list to see who they prefer maybe.

Didn’t someone get hired as an acting something around the same time someone’s girlfriend dropped of the clerk’s race to essentially hand the election to someone? Quid Pro Quo is not something new to these someones so it should come as no surprise to anyone. My question is why would someone use their hire your daughter at jail free card for this someone? If we truly believe in second chances, as I do, this shouldn’t have been necessary.

I don’t think it matters one iota if the councils vote counts or not. They are pretty much owned by the mayor and would be spanked accordingly should they step out of line. A vote against this mayor would be the end of their political careers and they know it.

It is a myth that they operate independently of the mayor while representing the people who elected them. The voters importance ended the day after the election.

First off, Jonathon Melle go be crazy somewhere else. You don’t live in this community so we don’t need your psycho rantings everyday and could careless who or what you support.

Secondly, you can be sure the union would be taking the opposite stance if this was a union “brother” who got in trouble while employed as a firefighter. They would be shouting second chance from the mountaintops.

You should rename this the conspirators blog. This gets as bad as Alex Jones Infowars at times.

I am off for second chances but for the mayor to say that she won’t go along with the council if they vote against it tells you what kind of mayors she is .the council represents the people so in a fact she’s saying she’s is going against what The people want. As far as the sheriff hiring the Chiefs daughter most of those are done as political favors.

I have two concerns
I don’t for a second believe there was no quid pro quo between Bowler and Cherwinski. I know and like Tom but the “acting” (great word for it) chief in any other fire department wouldnt even make bottle washer.
Cherwinski now has a huge problem on his hands. The members had little respect for him before this. Now he has zero respect.
No wonder by three mayors in a row now like this guy dangling by his balls with “acting” status.
Second concern is how the council has been eliminated and how not one of them has any concern about it. Terrible, councilors! Shame on you. On Tuesday night youre going to look like fools.

Mr. Conyers has spent a decade turning his life around. He scored highest on the Civil Service test, and aced all other requirements. There is no one more qualified for the position. This man has earned his place to support his family. The only fools are those who look down on others. Hypocrisy. However, those who think that others should jump the list because they are connected, have Zero Moral Compasses.

Actually, the testing determines qualifications – and this guy scored on top. He has bypassed no one.

There are a lot of ex-recreational drug users out there who seem to have forgotten what they did. I spoke with an old hippie last night and he was so appalled by this hire.

This, from a guy who spent his mid-teens through late twenties high on pot, acid, pills or whatever else he could get his hands on because Daddy was a big wig in Gt Barrington. Now in his early 60’s he would die if folks knew his chemical history.

I bet Conyers spent much more of his life actively rehabilitating himself than this guy ever did – but Conyers got caught. And he spent time in jail, and he has had to spend over a decade explaining himself.

If we don’t believe in redemption, why don’t we just shoot everyone who breaks any law – including traffic laws?

This blog would be awfully thin on commentary if we did that.

I’ve made many mistakes in my life, and I am so glad that my employers and family are not the types of people who see no value in redemption.

There are some states, maybe most,that forbid an application in the private sector if a felony has occurred, don’t know about public sector.

All this hoopla is unbelievable!

This man wants to risk his life to be a firefighter, something not many are willing nor able to do. He wants to spend days a time from away his family and his own home to protect the lives and property of our community. And you want to question his integrity?

Mr.Conyers was convicted possession of cocaine and illegal possession of a firearm. He was not convicted of distributing drugs or firing off a weapon. While all are felonies, there are huge differences.

The readers of this blog and the public at large would be dumbfounded to learn whose drug use actually fuels the drug economy here. The perception is so far from reality, you’d be amazed.

There are alot of otherwise upstanding citizens who enjoy the rock and the coke and the weed. People of all ages, backgrounds and incomes. People with lots of money to spend. The images of the homeless junkie or the toothless crackwhore are mostly imaginary, at least around here. But now, because of the draconian criminalization and social stigmas of “party drugs”, we ended up ushering in the nasty beast known as heroin.

Afterall, alcohol is a drug. No? And it’s perfectly fine to be a fan of it, to imbibe and overindulge and make it a centerpiece of most social gatherings. But it’s just as deadly as heroin, from many aspects. But it’s okay, because the law tells you it is.

The entire culture and attitude toward drug use needs to change.

A point of clarification…

The Mayor is not bypassing the Council. The Council doesn’t have, nor ever has had a say in Civil Service appointments. The whole thing is for pomp and circumstance. It gives the families a chance to celebrate the accomplishments of their loved ones.

Maybe some of the Councilors don’t realize this, as there is no formal training for Councilors. I didn’t realize it until about a year into the job.

Civil Service requires you to take the people at the top of the list unless you have a valid reason not too. If someone is bypassed, they have a right to appeal and even a right to sue.

Imagine what it COULD cost the city if the Council had a say and by-passed someone because they don’t like them.

Again, it ceremonial and always has been for Civil Service positions. Council has NEVER had a say.

Let the families enjoy the night. That is why this is done.

I agree with Dan. And the mayor is showing what leadership looks like whether you agree with her or not. Councilors should think long and hard before abstaining on this vote.

Thank you Barry, It is nice to get the stright poop every now and agine.
I find myself conflicted with this one.
I do believe in second chances because my father used the work release program back in the 60’s and had success with men that had made mistakes in their lifes.
With that being said, what does that say to our kids?
My question is this.
If I just act like an animal for years and then decide to be nice because I end up with A kid do I just get a pass?
I don’t know the answer. I’m going to go with my dad. He had a huge success with second chances. Who am I to be the judge? Maybe this man might save my life or better yet my family.

Non, he paid for the crime he got busted for. Were there other crimes?
Most people with felonies pay the price for life when it comes to employment. Very few get the so called second chance! Needless to say, many sure as hell don’t deserve it. This guy is getting the break of a lifetime. Seems like it is a political game. Pittsfield crap as usual.

Are the police and fire departments the only organizations that fall under civil service rules? Wouldn’t it be great to have the schools, public work, city hall and all other municipal hiring policies based on civil service testing? That would eliminte nepotism, political appointments and deadwood, while insuring we always have the most qualified people filling open positions.

I know more than a few PFF who also dreamed of being firefighters when they were young. They stayed out of trouble never were arrested or spent time in prison. None of them had a lot of money but would never dream of selling poison to the community while armed with an illegal handgun.They also served our country in the military to help them fulfill that dream. I’m all for second chances but this hire seems like a slap in the face to those who did things the right way. I also think it sets a bad precedent for the city a fie dept.

The amount of crimes being committed in Pittsfield should indicate to our Mayor that a plan and a vision of where we will be next year.Here is my vision….pittsfield will have record breaking poverty next summer and breaking into homes will be considered a job by those victimized by poverty. The berkshires are the 21st poorest County in the United States…dont worry we don’t need a plan.
