KAVANAUGH HEARINGS CHARACTER ASSASSINATION AT ITS WORST

ADD 1, SEPT. 28 pm. — In late developments Friday, the Senate Judiciary Committee voted 11-10 along party lines to send Judge Brett Kavanaugh’s nomination to the full Senate. They also agreed to delay the full Senate vote until the FBI could complete a new investigation into Kavanaugh with respect to the specific and narrow allegations made against him by Christine Ford. President Donald Trump ordered the probe, which will be limited to Ford’s charges. This will mark the seventh time Kavanaugh has been investigated by the agency.
The probe should put to rest the investigatory phase of the nomination. The agreement to get the FBI involved was hammered out in bipartisan fashion. Democrats got what they wanted: a close look at Ford’s claims. Republicans, too, “won,” requiring the FBI to complete its work within a week.
The burden of proof is on the accuser, and Kavanaugh must be considered innocent until proven otherwise. “Proven” means irrefutable hard evidence, beyond a reasonable doubt. Without this, the American system of justice collapses, with the new standard for verdicts not being evidentiary proof but an unsupported single-accuser allegation. Yes — police state territory.

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION SEPT. 28-30, 2018) — THE PLANET initially planned to present the “how” of successful sticker or write-in campaigns as a follow up to our previous column. However, the Senate Judiciary Committee (SJC)hijacked that plan with the “Is That All You Got?” hearings, otherwise known to C-SPAN and history as “Allegation Uprise” or the Kavanaugh-Ford showdown. Our editorial board tells us that the column initially scheduled for today will run on Monday.
We could writes tomes on what occurred Thursday on Capitol Hill, but we won’t do that. It’s clear the hearings weren’t so much about finding Pilate’s “truth” as it was about displaying the respective political freak flags — 21 of them, 11 Republicans and 10 Democrats.
They flew high and waved in a gale of hot air, the partisan low fronts colliding with the high-pressure ridge coming from social media.

Democrats disingenuously called for Kavanaugh to ask President Trump to re-open the FBI’s investigation, the piece of coal calling the chalkboard black. First, any senator could do that. Second, the SJC ranking member, Sen. Dianne Feinstein, received Christine Blasey Ford’s accusatory letter from Ford’s congresswoman on July 30 and sat on it for nearly six weeks, a time period when all of this could have been properly handled. Third, Kavanaugh has gone through a half dozen FBI checks. Fourth, the FBI only investigates. It doesn’t reach conclusions. In other words, it does what the SJC is required by law to do — and has already done. Fifth, when SJC Chairman Charles Grassley learned of Ford’s allegations, he immediately ordered staff investigations, with a full invitation for Democrats to participate. They declined. Sixth, the FBI learned of the Ford’s claims in July and found them not credible.
Feinstein’s delay in introducing Ford’s unsupported claims provide the smoking gun. She and the others who had or knew of the letter kept quiet through more than 35 hours of the SJC’s public questioning of Kavanaugh, under oath. They kept quiet during the investigatory phase of the nomination. They kept quiet and continued to withhold evidence during confidential sessions with the judge, never once bringing the allegations to the forefront and to his face. They kept quiet as Kavanaugh responded to more than 1,200 written questions from the committee — more than every other Supreme Court nominee in U.S, history COMBINED. Instead, they withheld the allegation throughout the entire proceeding. Only then, when everyone thought the process closed and the committee set for a vote, they acted.
Who buys that?
Who among us wishes to argue the action was anything other than political, aimed at delaying the confirmation at minimum and gunning down a defenseless Kavanaugh at max? Instead, Ford, her lawyers, Feinstein, and Feinstein’s staff waited until the exhaustive vetting process was complete to drop an 11th-hour, unsupported, 36-year-old allegation into the toilet they created from what should have been a fair and honest vetting process.
Ford proved to be a shaky accuser, not believable on the face of her testimony. Every witness that she identified as having been at the high school kegger, one she can’t place in time or in space, had no recollection of the event taking place. The supposed witnesses deny the event ever occurred. In her testimony, neither Ford nor her attorneys offered any supporting evidence, fantastically claiming it was up to Kavanaugh to prove it didn’t happen. That’s not how our system works. If someone files charges, the burden of proof falls to the accuser. The Democrats were only interested in smearing Kavanaugh, relying on the hysteria generated by social media to act as judge and jury.

What has happened to America, where scurrilous and false claims can destroy the reputation of a jurist who has an unblemished career of public service and who in his private life is attested by scores of men and women to be a man of the highest character? What effect does this have on decent people who will now stay away from politics because they are not perfect and don’t relish the prospect of being dragged through partisan mud?
What happened Thursday before the SJC was a national disgrace.

You should read the MassLive board comments. Hundreds of people (maybe even thousands) on that board hate the far left agenda and will definitely not be voting Democrat in November. People here in Berkshire County are so isolated from what the rest of the country really thinks (and even parts of their own state) about what is happening in the real world. They think their isolated echo chamber of far left ideas is what everyone else wants. It’s amazing that in Springfield, MA so many people cannot stand Elizabeth Warren or anyone on the far left and they are not fooled about the Kavanaugh hearings and what is really happening.
Elizabeth Warren will carry Springfield with 60% of the vote.

Also, Springfield, MA is very conservative compared to the Berkshires. The Eastern part of this state is very different from the rest of Massachusetts. They are wealthier with lots of jobs so they can indulge the far left craziness of Elizabeth Warren compared to the rest of this state that is struggling with REAL issues relating to lack of jobs, poverty, and homelessness that are NOT being addressed by Liz Warren.

My prediction for what may occur with the confirmation. I think naugh should withdraw now. He was under oath. He lied. Even the smallest lie is perjury. Perjury is a felony and if convicted he can not return to his appellate judgeship. By withdrawing he can return to his judgeship. I do not know anything about the FBI but The Wiz does. He worked for ACSI assistant chiefs of staff of intelligence at the pentagon in Washington and MACV military assistance command Viet Nam known as the Pentagon East during the Viet nam war. His group of 7 would eventually be assigned as a special security detachment to the American Division in Chu Laid which was the biggest Division in the world. They provided all intelligence for the entire Americal Division and reported only to the Joint Chiefs of Staff and the President of the united states. All of them hold Top Secret Crypto Level 14 clearances and were all vetted by both the CIA and FBI. The wiz said when he read his clearance which is the highest military or civilian clearance one can attain the government knew more about him than he knew about himself. His friend Woody who was a B52 pilot during the war and flew missions every day over Viet Nam in which the wiz directed the strikes on the equipment he maintained will appear together on the Gman’s show soon to give everybody some understanding as to how the war was run. The FBI will turn up every stitch of information about naugh and if he feels that he told even the smallest lie he better withdraw and if he doesn’t and a lie is detected he will be finished and also could be sentenced to hard time for lying to congress. This is my opinion as to what I think could happen in this situation. We’ll see.

I don’t want public education to be controlled by the far left so that students are indoctrinated with messages like “you have at least 50 genders” and “socialism is good because big government should take care of us”. Congress specifically asked that they and their families not be put on government paid healthcare because they knew how bad it would be and how many things it would NOT pay for.

The only form that has experiential and historical success — not perfect, but at least successful in a functional way — is capitalism. Making the presidents life a living hell is the objective of the media. But Kavanaugh is a skunk, and should be removed by Trump.
Anyone who is nominated by President Trump as a Supreme Court nominee will be treated just like Mr. Kavanaugh because this is a swing vote position on the Supreme Court and the left has stated they will fight tooth and nail to keep a conservative out of that position. I think the Kavanaugh confirmation hearings is another attempt by Democrats to reverse the results of the 2016 election. They are willing to entertain any claim no matter how outrageous. Calling and getting an “investigation” is simply calling for an eternal process. There will be a continual series of claims that need to be “investigated”. It would have happened with anyone the GOP propopsed.
None of this happened with Sotomayor, Kagan or Gorsuch.This is not because of the person but the position. The Democrats want a Supreme Court that legislates a progressive agenda which they cannot get by the ballot. They need the judiciary to do it.
On the specific claims, psychologists routinely find that information acquired after an event alters the memory of the event. In short, all of our memories are wrong, in at least some facts. The book “Invisible Gorilla” is full of examples. An op-ed in the WSJ described how a psychologist got people to remember that they interacted with Bugs Bunny in DisneyWorld, some even recalled “inappropriate touching”. This is impossible. Bugs Bunny is not a Disney character. It is entirely possible that Kavanaugh and Ford are not lying and are reporting what they actually remember but their memories are wrong.
In both civil and criminal trials, uncorroborated eye witness testimony has little weight. There are many people whose DNA shows they have been wrongly convicted by independent eyewitness testimony that was just wrong (see the Invisible Gorilla for some examples). Outside of a court, we all have the presumption of innocence and the right to confront the claims made by accusers. If you claim that for some positions we do not have this right you will open the process to the circus we see with Kavanaugh. We should be ashamed of this circus.
Furthermore, I think their memories are irrelevant. Both Ford and Kavanaugh have led exemplary lives ( maybe Ford should know better about her memories). Both had questionable experiences as teenagers but have learned from them. Kavanaugh has a long record that shows what he will do on the Supreme Court. He will make a good justice.

Yes, CT, and now Kav, Ford, their families, and the country are put on hold for a few more days of a probe that will interview the same people (and some new ones) who will stick to their stories, present a report to the panel, which will then forward its recommendation to the full Senate for a vote. And for what? For the claims of a single accuser whose malleable story does not come with evidence. That is enough now in America to ruin someone. Flake anguished over this, came out Friday morning supporting Kav, then caved to pressure from Dems (or was it “Kaved”?). Was he bought? At what price? What a mess. Prediction: When all is said and done, Kavanaugh takes his place with the Supremes after their Oct. 1 session begins, and the Court if finally fully stocked, like a fridge full of beer.

I believe Kavenaugh never said he wasn’t ever at a gathering with her but rather he didn’t recall being at one and even if they were at one it doesn’t prove Ford correct. It seems like her trauma coincides nicely with her career and education. And really, even if it did happen, in the grand scheme of things, it wasn’t that big of a deal, a couple half lit kids playing grab ass, 36 years ago and she sat on it until now. it’s not like she was actually raped and I question how much her trauma is really caused by this and not something else, or someone else. Yes, she displayed a faulty memory, a.k.a. as a selective memory. She had a Fear of Flying, which was why she withdrew her earlier boast through her lawyer that she would appear before the committee. Funny how she was a frequent flyer for vacations and work, with no problem-o. She waits 36 years to report a drunk lad copping a feel at a high school kegger. She doesn’t know where, whose house (so the owners can’t be asked), when (so it can’t be nailed down), how she got there (too young to drive), how she got home and with whom. But she remembers she had EXACTLY one beer that night. Oh yeah, and none of the witnesses she mentions have a memory of such an event. What a memory! Her story must be dismissed on its face.

Polygraphs are inadmissible as evidence in court, and if this were a trial, this one would be particularly useless. Did it ever occur to you that the lawyers set this up so they could truthfully say, “Well, our client took a polygraph and passed.” They didn’t say the Q and As were meaningless. Also, it isn’t necessarily so that one is lying and one is telling the truth. Logic dictates that. The neutral observer must come down to the fact that she alleges an event for which she had no evidence and therefore cannot prove. We still have the presumption of innocence in America, do we not?

Watching him made me think he had been drinking just before he went to the hearing. He acted like someone who had had a few brewskis. He should have been given an alcohol test and then a lie detector tests asking if he had been drinking. My guess is he would have blown a 2.5.

True. Clarence Thomas refused to listen to the testimony of Anita Hill just like Kavanaugh didn’t listen to his accuser’s testimony. In Kavanaugh’s case he said he was writing what he was going to say. Thomas said he had “heard enough lies” and did not want to listen to Anita Hill.
Clarence Thomas was so angry he said he didn’t even care about the Supreme Court nomination since he was fighting for his family and his reputation at that point.

He tried time after time to dismiss his abuse of alcohol and the accusers and their witnesses will prove beyond any doubt that he was a hard partier. So what will this lying get KAvanaugh. It will get him a felony charge of lying to congress and if found guilty which he certainly will he can not serve on the SC and he will not be able to go back to his judgeship in the appellate court.
