(FORTRESS OF SOLITUDE, THE WEEKEND EDITION OCT. 12-14, 2018) — THE PLANET‘s coverage of the District Attorney’s race in Berkshire County continues today with an interview with acting D.A. Paul Caccaviello. As you most likely know, Caccaviello is mounting a sticker run against Democratic Party primary winner Andrew Harrington. Cacc says that contrary to what some may believe, he’s been campaigning hard while trying at the same time to handle the duties of the D.A.’s office. Cacc didn’t mince words about his plans, about what he thinks of his opponent, Andrea Harrington, or what he expects in November. We should also note that we tried to contact Harrington, but she did not return our calls.

PLANET: How do your react when you hear your opponent calling you out for running a sticker campaign after losing to her in the primary?

CACCAVIELLO: My opponent and her camp have predictably been on record as calling me a “sore loser” for running as a write-in candidate. My opponent said the voters have spoken, but the truth is that not all spoke on Sept. 4, but a lot have spoken up since. I am excited about the democratic process by running as a write-in candidate. This is the beauty of the democratic process. The legal community, law enforcement community, the business community, women, seniors, and families are concerned residents. They are  not sore losers.

PLANET: What are the issues that concern them? What are you hearing as you campaign?

CACCAVIELLO: Just to name some of their concerns and questions, they cite my opponent’s inexperience, lack of any prosecutor work at all, or her lack of a leadership role in any prior organization, her record of brief tenure at any prior employments, and how her claim of 15 years of extensive criminal courtroom experience does not square with her total of 7 district court trials between 2011 and 2016. They also are concerned that that 15-year claim of courtroom experience does not hold water, especially when a court transcript from 2011 reveals her explanation for what she claimed was her own ineffective assistance of counsel [because] it was her first trial —and the last one was in 2016. They also ask if she is not willing to go into court, then who will she hire to do the work? Having not done the work, how can she know who to hire?

PLANET: Have you been campaigning hard or are you keeping your powder dry? We ask because some supporters wish you’d be more visible. Your opponent’s backers say you don’t have your heart in it. How do you respond?

CACCAVIELLO: Since the primary, hundreds of volunteer have joined my team and are working hard to educate the voters about the write-in process and comparing my experience and background with my opponent’s. To say that we have been extremely busy would be an understatement. The public will see those efforts up close in the coming weeks. Doing the work of the DA and while running in an election has been a challenge, but I have embraced challenges throughout my professional and personal life. Just because something presents [itself] as difficult does not mean you don’t take the challenge if it is the right thing to do, and that is what I and my supporters are doing. Check out my Facebook page for information, videos, and a calendar of events. We have also expanded out of our campaign space and moved into additional space for field activities. The support and enthusiasm from my supporters has been tremendous, and I am confident about my choice to give ALL voters a chance to elect the most experienced person for the Office of District Attorney. I am committed to this race and to protecting the most important office in the county.

PLANET: Have you had any discussion with Harrington about staying on in the office if she wins in November?

CACCAVIELLO: Attorney Harrington and I have had no conversations about any circumstances that may happen post Nov. 6.

PLANET: No doubt you’ve been following the discussions regarding allegation of ignored sexual assaults at Williams College. What can you tell voters with respect to that?

CACCAVIELLO: As to the Williams College “issue,” although a certain narrative was pushed in the course of a political campaign, I will be addressing that issue as the District Attorney. Suffice it to say that I have been doing my due diligence on the matter and will respond upon completion.

North Adams is #1 for violent crime in 2016, as cited by the FBI. Pittsfield is #9. Obviously, the Berkshire County District Attorney’s Office is failing to protect their communities from violent crime!
Then there is the framing of Bernard Baran by the Berkshire District Attorney’s Office. The then-D.A., the late-Gerry Downing, hid tape recordings that would have exonerated Bernard Baran while he was incarcerated. It wasn’t until after Downing’s death that then D.A. David Capeless released the exculpatory evidence, which lead to Bernard Baran being released from state prison.
Then there is the case of former Berkshire County Sheriff Carmen Massimiano, who has been the subject of many allegations of sexual deviancy by alleged child molestation when he was a camp counselor at Camp Russell, and also when he was a volunteer at the Boys’ Club where he allegedly fondled a then 7-year-old boy in the early 1970’s. The Berkshire D.A.’s Office framed Bernard Baran, while they enabled Berkshire Sheriff Carmen Massimiano for decades.
I believe a documentary movie could be made about so-called criminal “justice” in Berkshire County! It could be called “Double lives and Double Standards”!
Obviously, the Berkshire County District Attorneys’ Office has failed on many levels!

Sister, the most important thing is to write Paul Caccaviello in and talk to as many friends and neighbors as you can. Harrington won’t say or do anything. She now knows if she opens her mouth she will loose more voters. We will do this we need Cacc.

I’m in Cacc’s corner, believe me, but he’s the underdog at this point. She can stay in her corner but he can’t. He has gotta come out swinging and soon or the liberal loons will be running the DAs office and it will be curtains for Da Berkshire’s as we know em. Hell we’re halfway gone anyway. If Harrington gets in, between her and Tyler, they’ll be shooting up everywhere and sleeping and shittin in the streets like in San Fran.

Regarding the voter thing where Kemp is being accused of t

A spokeswoman from Kemp’s office told The Hill that the applications are being held due to the state’s “exact match” law, which passed last year. The law requires an applicant’s information to match exactly what is listed by the state’s Department of Driver Services or the Social Security Administration.

According to the legislation, if an applicant’s information on a voter registration form results does not match the information in a federal or state database, the applicant’s status is “pending.”

If an application is marked as “pending,” the voter registration database produces a letter, giving the applicant 26 months to provide up-to-date information. Applicants who have been flagged can mail in a copy of “eligible identification” or present it at the polls.

Wow. Dan, the way you put the screws to Cacc regarding the Williams College issue? Your relentless follow-up when he essentially ducked the question? That’s some fierce journalism right there.

But if you ever get another bite at the apple, here are three simple questions you might consider asking.

1. How many Williams College women have filed criminal sexual assault complaints?
2. How many of those cases were investigated?
3. What were the outcomes of those investigations?

That info could be surfaced in 10 minutes.

They aren’t doing due diligence. That are trying to figure out how in the world to spin, spin, spin. That’s the best guess.

Atty Rossi, there is no epidemic of false accusations across this country, rather, without a doubt there is an culture of domestic abuse and violence perpetrated against women. I’ve been a “John Doe” and let me assure you I would be a “John Doe” again if that meant that the vast majority of actual victims were taken seriously.

One whiny little punk at Williams College that was’t mature enough to avoid a situation, whether he was in the right or wrong, is a statistical outlier within the broader discussion of equal treatment.

Stacey – I read some of the filings from your case. The answers to the questions I pose may indeed be relevant, but I do not have those answers myself, nor am I an insider.

I referred to “women” in my above post because the info that I believe needs to be shared regarding the lack of criminal prosecutions almost always concerns female victims.

Your case is different, in that it deals exclusively with the College’s behavior, and does not involve “criminal” matters. That said, the intersection between the College and authorities as pertains to criminal matters might be very telling as to the College’s priorities. Which could be helpful to your case. You should want to see this info as well.

I will be traveling for the next few days and will consider contacting you via email when I return to see if you have any questions about what I have learned. It’s all publicly available info, but I know it well by now.

However, I took a lap on Facebook before coming here and see that one your affiants has made references to you “hunting me down”, along with some lovely thoughts about my “beheading.” This same fool is now openly claiming that I am a Williamstown police officer, which is patently absurd. If you think that kind of behavior makes me inclined to compromise my anonymity and share my insights, you are mistaken.

Stacey – Yeah, you will most definitely not be hearing from me. And you should probably know, when your strongest affiant is a foul, offensive lunatic, your case is probably not going to end well.

I read some more filings from your case. I see the way Brian Marquis’ testimony has changed from “I was on judicial panels” to “I went through somef TRAINING to sit on judicial panels. I was never actually on one”

The problem is, Marquis has posted detailed stories on social media about individual cases HE has adjudicated, and spoken to the corruption in the process.

Let’s just put it this way. Between lying in sworn affidavits and lying all over social media, Marquis has not helped your case one bit. And thanks to his continued behavior, once I get back I’ll be sending links to opposing counsel to make sure they are aware of each and every one of his claims.

I just have one favor to ask. If your case ever sees the inside of a courtroom and Marquis is ever called to the stand, I beg you to let me know in advance. I wouldn’t miss that for the world.

Experienced prosecutors rarely comment on open investigations until they have all the fact to protect the integrity of the case. Politicians who are simply looking to get into any available office inflate their resume while constantly dodging questions for hard numbers on their experience. Remember it’s her own words I ran for office before it was cool!

Good article Dan, civics classes use to be a part of our education in the schools. We were taught there were 3 co- equal branches of government Administrative, Judicial and legislative. That sort of morphed into 5 branches with the addition of the media and the people. The only way to flip the pyramid upside down again and return power to the people is to vote. This is one of the greatest opportunities in our lifetime to in some ways to return the power to the people. I’m strongly urging everyone write in Paul Caccaviello and talk to as many friends and neighbors as you can, to do the same.

You are so correct. I currently teach chemistry in another school district near Springfield, MA. Eating my lunch and reading the planet right now to keep up with local info & issues.

They do have the civics course, the personal finance course, and a culinary/home economics courses. I overheard some of my students prepping for a quiz on the amendments to the constitution. One of the money/finance classes uses my classroom during a period when it is empty.

I think it is a choice of the district(s) what they drop / offer. All I can say is that this school is in a Mass legislative district that is fairly conservative. I will leave it at that.

This liberal will not be voting for Harrington for 1 reason and 1 reason only because I can’t logicly put her in a position to fail.His experience overwhelms he lack of experience.He has invested great energy in his job and she has invested nothing.I believe many people are going to change their vote simply because it was a mistake.Dont worry I believe Mrs Harrington wants to shoot right to the top politically and skip the whole experience thing.If not this then watch…..Congress, state rep,Mayor anything…..advice to her….put in some time at something.

Harrington has mislead voters claiming experience she doesn’t have. That’s a deal breaker pure and simple. She barely has criminal defense experience, let alone basic knowledge of the DA’s function.I don’t know what she can be thinking running around inserting herself into the unions, progressive political groups, etc. currying favor with people that have no relation to what the DA does. The district attorney prosecutes cases before the court. They provide investigative support and advice to police departments and support crime victims. They do training and outreach to the community on child abuse, senior abuse, domestic violence, drug addiction, etc. That’s it! I don’t know what is political and requires the endorsement of Healey, TFB or any other pols. What a waste of self-serving grandstanding on all their parts. And it’s not just a question of learning curve, it’s a matter of ethics and basic integrity. Why would anyone vote for someone who so grossly exaggerates their suitability for the most important here? Also, Dan, you had said from the beginning she needs to articulate a program of change and what do we get? Everything she has promised already exists and she didn’t even know it! We need someone in this office who has shown us they have what it takes. Complete impartiality, service, hard work, integrity and a professional, not a campaigner.

This isn’t a popularity contest – the work of the DA has an impact on the quality of life in BC – we can have a lightweight in the Mayor’s office and as POTUS but here – in this case – I believe experience matters – gotta go with Cacc – but my prediction is he loses by 1,000 votes

Voters have to turn out which is why Harrington campaign is so quiet. They are banking on having the low turnout they had in the dem primary which was largely lefty loosies who don’t value the importance of the DA’s office in law enforcement and safety. They want oblivious voters. But many dems have figured out she has no rationale as a candidate and then there is the Rep block. People must vote!

I’m voting for Caccaviello for 3 simple reasons, with reason #1 being the most important;

1) Experience – Caccaviello wins hands down. Harrington is an inexperienced prosecutor and has never run an office, especially an office with a huge budget like the DA’s.

It is the same entitlement attitude that she probably raised her children with. Remember the generation…everybody gets a trophy, not keeping score at sports events, no grades below a 50 (even if no work is turned in), no one can lose, etc.

Oh, and she went lower! Melissa Mazzeo is now saying Harrington said last week that she did not feel comfortable talking to her without a third party present. This came after Harrington called Mazzeo a liar and said she would be politically shunned. This not a mistake, not misinformation, not a difference of opinion. It’s a flat out threat and a lie. Imagine if she had done this as DA, there would be serious ethics violations.

I am also curious about her previous claims to have vast experience in watching the success of drug courts in other counties and her claims that she will start them here in Berkshire county (we already have drug court). A quick google search shows that Massachusetts first began drug courts in 2014. Now we all know new concepts start east and slowly work there way west across the state. If she had seven appearances in the district court between 2011 – 2016 can we only be left to believe that she out right lied about her experience with the drug courts?

One day after the DA primary the Gman met with cacaviello and near begged him to run as a write in candidate because he felt Harrington in the DA’s office would be comparable to Tyer in the mayors office. Two disasters. He tried to set up some debates on his TV show but after trying to reach Harrington on three separate occasions he gave up .The Gman describes Harrington simply as unqualified. He further states she is no more qualified to be the DA as his dog Bucky is to being a 747 pilot. However he states Bucky might be able to land the plane but Harringtyer would definitely be the total failure that Tyer is. The Gman will hype Paul on his TV show and purchase some choice advertising for Paul. Everyone needs to bring at least 5 people with you to the polls. This is a must win situation.

I just want to get the basis for ” Trump on medicare a lie in every sentence” A brief overview is fine, let’s talk reimbursements, DRG’s, CON’s the process of obtaining a CON, quality care centers, or please let’s start with the basics since its open enrollment time. Whats the difference between Medicaid and Medicare? The donut hole? Part B? which if either pays the majority of long term care costs? How are these programs funded? Taxpayers? Via which vehicle or methodology? How would you rate the efficiency of either of these programs? Based upon what criteria? If I am not eligible for the programs how are my contributions calculated? Based on what formula? Roughly what are the administrative costs for each program? I have seen Art continually rail about facts please give us some regarding these questions I have seen you post on them as if you have a wide range of knowledge about them.
Bonus question what Berkshire native is or was a pioneer in the medical research industry?

JP you can get yourself as up to date as I am on all the questions you asked by visiting the fed bldg. in pittsfield. There are pamphlets available and what you can’t find you can ask the people there and they will tell you where to find it. You can also to the govt web site on benefits and disability. Trump op ed in USA Today you can read for yourself. The USA fact checked and concluded that there was virtually mis tatements in virtually every sentence. Also critiqued by WSJ and WP. WP updates fact checker just about daily. MSNBC quoted the data as well as amanpour and Huffington post. Last question I have to think about. Hope this helps you. OK I will start with this one question. Having read your posts on Corporations and getting the feeling that you really don’t care that much for them I ask. Many in both corporate and governmental policy positions are starting to show concern that the ACA has already started to force many HCO’s into acquisitions or mergers. we are seeing this almost on a daily basis. If the healthcare market is controlled by a handful of corporations how will this be good? is it just an unintended consequence? and over time will this be a good thing for consumers?

What are your thoughts on question 1? what will its impacts be on say centers of Quality? Will higher staffing levels negatively impact a healthcare providers ability to obtain a CON? if so In which ways? If we continue on the current path how many healthcare providing organizations will there be in say 5, 10 and 25 years from now? What drives your thought process to those numbers? With the onset of AI what impacts will that have on staffing levels of all specialties and sub specialties? These are things that we must at least look at and probe before we say repealing the ACA is good or bad. TORT reform?

JP my opinion on medicare. It is solvent until about 2024 but without some dramatic changes the future looks rocky. In trumps talk on medicare he was significantly off base. He stated that unless he changed it now senior citizens would be first to lose services__false. 2 He stated that he will reduce premiums by 3__5 % false. In fact premiums will rise by this amt. 3 preexisting conditions will not be covered. Yes and no will expound at end of post 4costs__ he rightly stated cost over the next ten Yeats will be 32.-6 trillion. What he failed to realize is the fact that 2frillion will be saved by overzigt management and because the work force will be highly educated and salaries are expected to rise dramatically the fund is expected to bring in another 2.5__3 trillion dollars. Getting back to the pre existing conditions. This is tough to answer. We have to talk about the ACA. The problem I zee here is the fact that young healthy people are choosing to opt out by paying a pena!TV rather than paying what they should be paying to make The ACAWork. This is huge problem and must be addressed fast or it could cause the entire govt health system to collapse. My tablet is low power and excuse the spelling mistakes. More tomorrow

Well now I am even more confused based upon this reply. Last night before turning in I read your post and was under the impression that this morning you would be posting more. Then I wake up have some breakfast flakes and see that you now want me to answer the questions that I posed to you.
Art I have my opinions regarding the Healthcare industry et al and was looking forward to hearing yours. You see this was not about healthcare or astrophysics it was about seeing where you come from. I see you continually putting down news sources such as Fox for example. I made no statements on Medicaid or Medicare one way or another but in one of your replies your first answer was to try to establish for yourself that my information came from a pro Trump news outlet. My sources are trade publications dealing with Healthcare, Healthcare economics Healthcare delivery, technology and dare I say the impacts of Governmental policy on the industry in general. I am not certain if these are Pro Trump or not. I do know many of them are required reading for the industry. No I am not an expert an expert by definition is as follows: an ex is a has been and a spurt is nothing more than a drip under pressure.
I did enjoy and hope to enjoy more exchanges in the future I have succeeded in my attempt to demonstrate at least to myself that we can exchange ideas and ideals without the name calling the deflecting and implicating that if one watches this channel vs that channel they are somehow less intelligent or simply a follower. Each of us here have something to contribute and I say each of us here care about the City the State and the country if not we would be reading the Brady blog. If someone does not rush to the CC meeting to bloviate and opine before each meeting it doesn’t mean they are cowards it simply means they chose not to attend they have their own reason and reasoning. I agree with you when you say we must all be respectful of each other on this board and this is always how I have tried to be. I know you are a follower of trump and you know I dislike him and have provided many reasons why I do. However this doesn’t preclude that we can not have a civil connversation as is evidenced by the civil communication we are having now. While medicare and social security are surely artsy fartsy topical subjects can we please discuss what has been happening to toilet paper? In the last ten years they have increased the size of the core and reduced the width of the paper, not to mention quadrupling the price. I would submit to you that this can be a senior budget buster on a par with Purinas price increase on cat food. I have asked my congressman to submit a bill including toilet paper as a medical expense covered by medicare for qualifying members. Please call your congressman today and tell them to support this measure so that it can take effect by Jan 1, 2019.

I am also working on a supplemental bill which will demand that the cores are made thicker so that the rolls do not crush so easily. Like the rest of you I hate the thump, thump,thump as the roll revolves on the dispenser.

I mean we need larger rolls and more absorbency all at a lower price. the TP industry took full advantage of the City Council. see that’s how corporations work. Joe at the TP company talks to the elected officials, Joe then determines that they are going to be screwing us and that they are full of ..it. In an attempt to maximize profits and cover up for the lack of product due to the now increase in demand they make the sheets smaller the core larger and in the end they wipe up the profits

Be sure to check out Mike Daly’s latest on It’s Pittsfield Tonight on FB. Apparently, city councilor Helen Moon has an Andrea Harrington email campaign running that accuses Paul Caccaviello of being racist and anti-women. She’s claiming the police and DA are locking up minorities. I hope people are as appalled as they should be. Hey, let’s start a race riot in Pittsfield so an unqualified DA candidate can win. Moon is an irresponsible wrecking ball who is trying to stir up the gullible. We need to initiate a petition and gather signatures to recall her.

I got a Harrington campaign email, too, mailed to south county dems from someone named Bonnie Burman that claimed in “this just in” fashion that Caccaviello is now a Republican — which is of course false. At least they are consistent in their problems with the truth.

If you are seriously going to run for an elected position – then you’d better take a public speaking class and a debate class. You have trouble debating on this blog – exhibit A, above. You’d better study the issues and be prepared to answer questions with facts. Joe Pinhead won the above debate, hands down, no contest.
If you are a devoted Catholic, then why the expletive-laced rants that were redacted? If you were an honest person, you wouldn’t be talking in the third person or using so many aliases.

A lot of her contributors don’t know her, they come through the ACLU which is trying to get DAs elected across the country. It is where all the BS comes that we are over-incarcerating even though Berkshire County jail is at half capacity. Harrington parrots it all the time. The public ought to be extremely alarmed that this kind of outside money and agenda has been used to influence a local race. Google an outsider and you will often find their connection to “criminal justice reform.” They are raving left lunatics with a national agenda who don’t have to worry about criminals on our streets.
