CRIME AND PUNISHMENT: ‘LAW ENFORCEMENT,’ ‘POLICING’ TWO DIFFERENT THINGS

PLANET VALENTI NEWS AND COMMENTARY

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION NOV. 9-11, 2018) — Law enforcement and policing are two related but different activities. Ideally, they work together in a complementary, apolitical fashion. In practicality, that is often not the case. Where Berkshire County proceeds with respect to this “similar difference” remains to be seen in light of the just-concluded district attorney’s race and how if will affect local policing. We know that right now, the two are twain and haven’t met often as measured by the growing crime and violence, especially in North Adams and Pittsfield. Consider:

The Pittsfield Police Department: Currently, a divided fiefdom ruled by Chief Mike Wynn. There are two main factions within the PPD, with politics often a key part of personnel deployment. Morale is low. That’s how you diminish the effectiveness of a force.

The D.A.’s office: Staff are nervous. Paul Caccaviello won’t be asked to stay, and some of his staffers will be told to pound pavement. Those that remain are understandably antsy. Andrea Harrington’s reset button will be a “start over” loaded with questions … and agita.

The Sheriff’s Department: Tom Bowler backed the wrong horse for D.A. Word from the inside is that Harrington will essentially shut Bowler out of Pittsfield investigations as political fallout of the Ruberto-Bianchi (aka DelGallo-Wojtkowski) Machine Wars, fought by proxy in the D.A. race.

The State Police: A member of one of the local SP Command Staffs Harrington will try to freeze the staties by employing troops on an ad hoc basis. Goodbye 7 North Street. Hello barracks.

The Courthouse: This is probably the county’s most stable element in the criminal justice system. We have good judges, generally, but often the interactions with the other branches, notably the police, come off “chippy” — a product of the area’s notorious love of and penchant for cliques and protection of turf.

These divisions exemplify the distinction with which we began this piece.

“Law enforcement” refers to the actions of people whose job it is to enforce terms spelled out in the legislation that governs the definitions of criminal conduct, because, above all, “crime” is a legal not moral concept. Law enforcement administers consequences decided by the courts to those who violate a community’s safety standards as defined by statute. On the other hand, “policing” involves the strategies employed by civil paramilitary groups (police department, sheriff’s office, state police) to fight crime through prevention when it can and arrest when it must.

Law enforcement relies on compulsory compliance, same as good parenting. If you steal the cookies, you get sent to your room. Likewise, if you break the law and get caught, you pay the price. Policing depends more on the citizen’s voluntary adherence. No one can force you NOT to steal, rob, assault, of kill another. You must decide to obey the laws that prohibit such actions. Too much failed policing and prosecution stems from the misguided notion that laws can legislate the actions that stem from the human heart.

Obviously, the common element that binds these two entities — law enforcement and policing — is the cooperation of citizens. Without that, there’s nothing to be done, as we routinely realize with the proliferation of shootings and gun play, to cite one example. If people obey the law, they won’t have to deal with the criminal justice system. In law-abiding communities, policing is a Norman Rockwell beat cop sitting on a stool at Joe’s Diner, listening to the runaway little boy (and yes, we know in the actual painting the guy is a state trooper). In cities such as North Adams and Pittsfield, unacceptable numbers of people ignore the law and act on their antisocial impulses, freezing authorities in helplessness. Whether criminals do it out of ignorance or intent should make no difference, something THE PLANET hopes the incoming district attorney and her “new approach” understands.

THE PLANET writes of the ideal in these two related areas of criminal justice. As we all know with the rise in crime in Berkshire County but particularly its two cities, the way you draw it up on the flip chart and the way it translates into action have become shockingly separate. North Adams and Pittsfield have earned the filthy distinction of crime’s top rank among the Commonwealth’s 351 cities and towns, and that became perhaps the top issue in the D.A. race.

The spotlight blazed upon this race reflected the area’s concern that crime, particularly violent crime and drug abuse, has risen dramatically and well past the mediation of authorities to deal with it The scariest part of this is that the rise has not peaked. Bottom line, it will be the job of incoming district attorney Andrea Harrington to lead the effort to cap the gusher. It would be unrealistic to expect her to institute Utopia, but no one’s asking for Utopia. For her first term, bringing the ascent to a halt and allowing the gravitas of law enforcement and policing to bring it back the other way. Yo can liken it to throwing a ball in the air. The ball will be in three states. It will rise, it will fall, and exactly half way between the two, it will enter that eerie microsecond where it is doing nothing.

That’s Harrington’s first priority: Not prosecuting all crimes all at once, but adopting that “new approach” she mentioned in the campaign to bring about that apexic microsecond where crime “does nothing.” THE PLANET interpreted her philosophical “selective approach” to law enforcement in this light. In the spirit of giving a newcomer to office a reasonable benefit of the doubt and a honeymoon that will last longer than microseconds, we saw her sifting out categories of crime as an attempt to bring about the apex.

She made campaign promises that were controversial, including her position on dealing with the drug epidemic. More power to her. Will her lenient approach to drug users have any impact on people’s free-will decision to shoot up, cook, snort, inhale, and otherwise consume to nasty stuff? We shall see.

She won’t be able to do it alone.

Going soft on crime will not reduce it. Letting drug dealers off will not reduce drug dealing. Quite the opposite in fact. If the police can hardly prevent crime the DA can hardly prevent it either. Troopers are going nowhere. DA pays astronimical amount of money in rent for their offices and she will need them more than any DA ever. When she plays catch and release, local cops will stand down – sure they’ll do their job, but if she claims they are a bunch of racists, like granny warren said, they’ll stop the aggressive policing real quick. Who will suffer? – the victims she claims she cares so much about. Her philosophy reminds me of the name I saw painted on a go cart of some sort on route 8 in Adams today – “ Recipe 4 Disaster”. Once she starts having cases “Harringtoned”, it’s game over for local law enforcement. When you’re own DA doesn’t even respect the rule of law, why bother? just take a F U K I T O L pill, and rest up for that road job.

Granny Warren is all about calling people a bunch of racists that’s for sure. Rachel Rollins won District Attorney for Suffolk County and she won easily. She is the Progressive who advocates for not prosecuting a list of at least 15 crimes. This is truly frightening and I can’t believe that women in these areas and right here in Berkshire County are supporting this insanity. Women typically care about crime prevention for their children and families. This laid back approach to crime has been tried in Progressive Chicago and we can all see the results there on a daily basis. It’s like the criminals are now voting so they can commit their crimes in peace and not be bothered by law enforcement.

We’re not even talking about telling lies which is a whole other issue with Liz Warren. We are talking about her policies which are not “woman friendly”. Crime is a big issue for women and Warren’s policies of wanting Sanctuary Cities and let in all of the illegal immigrants are NOT policies that will reduce crime. It’s time women began to realize that fact for the protection of their children and families.

If you are so opposed to lying & fraud, then why do you support Warren? She’s been lying about her American Indian heritage most of her life, and continues to – despite evidence to the contrary – in order to check the minority box and secure jobs. She is deceiving the citizens of MA by acting as a US Senator and collecting her salary in order to run for President in 2020.

I’m not saying I heard anything, but with the soon to be shake up at the DA’s office, you have to think there’s still a score to settle with the sheriff.

So, with that being said, how about a “Law and Order, team of DA Harrington and the newly elected, heavily Boston D-backed, Sheriff Farley-Buffet.”

The slogan, “When you were subjected to watch McGriff take a bite out of crime, did that frighten you and/or offend you? Wait until you see the Law and Order team of Harrington and Farley-Buffet. At Harrington and Farley-Buffet, we take a soft, friendly….a Progressive approach to crime. Are you a chalk white female who believes your Native-American, and could care less if you actually offend true Native Americans by your false claims and lies? Then come on down. We are the Progressive Law and Order Team of Harrington and Farley-Buffet.

A lot less driving for Farley-Buffet, much better salary than her current elected position, another female Progressive in a powerful law enforcement position in Berkshire County. And most importantly, if we learned one thing about newly elected DA Harrington, there is still a score to settle with Sheriff Bowler. Now re-read my post. I agree, Spa, Pittsfield is in a miserable state of affairs.

The intro of marijuana facilities, along with the needle exchange depot is bringing more and more undesireables into the city. DUIs will increase, as well as burglaries and shootings. Hate to be so negative, but now we have a toxic mix of progressives in total control of the city & county which is a recipe for disaster. The new DA’s lack of experience & her planned method of operation is disturbing, to say the least.

Combine this with increasing taxes from the new Taconic and new water treatment plants – and voila – families/law-abiding middle-class citizens like me will be looking for a way outta here!

I agree Gigi. More car accidents everywhere too. Will local media print the truth that many of these people are stoned while driving? Make this city a Sanctuary City and our crime problems will spiral out of control even further. Farley-Bouvier is all about Boston style politics and her heroine is Liz Warren and that’s what they want to bring more of to this area.

Truly stunning that this woman won Suffolk District Attorney running on a platform of not prosecuting 15 crimes which include shoplifting and property vandalism. People in these areas better protect themselves since law enforcement will not do it. Shoplifting will only be prosecuted on your 7th try which seems to me that criminals could get a big haul of goods before they are caught. Maybe they will stop on their 6th try and just be happy with the merchandise they stole. Truly, are the criminals now heading to the polls? I know the left wants to make sure that ex-cons can vote and even some prisoners.

I heard someone suggest that Romney would run against Trump in 2020 as an independent, with Elizabeth Warren likely being the democratic candidate. That sounds like a winning race for Romney, were that to be true. I did not see a blue wave, just a trickle.
Re the crime in Pittsfield, I can’t see how this increase won’t hurt the ‘revitalization’ campaign for North street and whatever is the cultural district. Who wants to go out to dinner and a show when they have a reasonable chance of getting shot at?

All the diatribing going on here, from Pat and others, is political BS. We all know I am a “radical leftist” in Pat’s eyes, and she is a radical fascist in my eyes. The fact is, to mitigate and diminish the very real crime wave engulfing us we still have to work together and get things done. Calling people names and dividing us all arbitrarily into teams diminishes us all, as well as our abilities to combat crime, much as Dan pointed out the political divisions WITHIN the police department. When people are fighting and sniping about the dopey stuff that separate them, they are taking their eye off the ball.

Rhdy Giuliani is an absolute kook today, but I was living in the city when he started “taking it back” on the simple premise of the broken window syndrome. He directed the police to enforce small, quality of life crimes, and demanded the commissioner make that happen. What had been a relatively scary place turned around very quickly. The street violence, the drug dealing…all the the big stuff welt away because they began enforcing the small, quality of life laws like loitering and public drinking and stree urination.

I was shocked to read that the cops said, after that fellow was stabbed and beaten to death recently, that the cops said they were well aware of the address and the actors therein, but couldn’t take any action because theh couldn’t get an informant. Do the work!! Be IN the community. Make an arrest for loitering, or parking, or for gods sake…moving violations. I got passed on Dalton avenue yesterday, going 45, by a car doing at least 70. That is not unusual. Enforce traffic violations. Enforce window tint limits. Enforce housing codes and blighted properties. Start small, start doing the work, show people you care as an organization about quality of life in every neighborhood. Eventually, quickly, you will get cooperation and crime will begin to come down from its apex.

I agree with enforcing the law, but I don’t agree that certain crimes (at least 15 of them) should not be prosecuted. ANY laws that are broken need to be addressed not just those randomly chosen by Progressives. You smoothly ignored that issue coming from some Progressives.

The only ones I know who are dividing people are those on the far left calling everyone racists and other names. Everyone else wants common sense in their government.

I agree we need a lot more vocational training. Not everyone needs to go to college. Problem is that people who don’t go to the traditional 4 years or more colleges are made to feel inferior in our society. This is wrong. I see more common sense in people who don’t attend college. Colleges just turn out brainwashed indoctrinated zombies who can’t think for themselves in so many cases.

I think the Planet was getting there, but just to be clearer:

law enforcement is NOT crime prevention.

A crime happens/is alleged, THEN the police get involved to see that the perp is apprehended and given over to the court system.

Crime prevention by the police, in this town, for example, would require 1,000 officers on the force, with each shift walking/riding the beats.

Otherwise, you can arm all adults and/or put pitbulls or snakes in every home. Citizen patrols maybe?

I think I see another economic engine here Ed. What if we buy up the Hess Mess and use it as a satellite store to sell cobras and Pythons for personal protection? Great location! And a real pet store nearby to facilitate supply. And a python might destroy any evidence so less paperwork with that species.

Maybe we could get a mean ass Trump supporter to train these things to be extra vicious and nasty. (or someone from the DAs office)

That is all covered in the business plan Dan. Visitors will be charged $8 to come in and view our reptile pit. The mayor is currently in the process of reinventing Tyler street and this will fit in nicely as a tourist attraction.
I have an opening for a snake charmer Pat if you want to pick up a few extra Trump bucks.

Let us address one by one:

Chief Wynn: Half of the cops haven’t been there long enough to have low moral. The other half consist of a number of slackers and skaters that are upset that the Chief is on to them ad trying to shit can the bad apples.

The D.A.’s Office: You say staff is being told to hit the road, yet many people are screaming that staff is hitting the road on their own not wanting to work for Harrington. Who really knows the truth. Ms. Harrington better be careful and if she wants to claim to be a progressive she better work hard to bring everyone together not divide them.

The Sheriff’s Dept: She should tread carefully here. If she starts effing with the Sheriff then it just shows this whole charade is a one giant vendetta to get back at those who didn’t follow the right friends network. The first 3 months will show whether she truly cares about people or if she’s been used to help the Krols, Tyers, Clairmont, dirty cops get retribution against their enemies. Also beware because the Sheriff’s Office provides lots of free law enforcement to our communities at a time when crime is out of control.

The State Police: Aww they have plenty of OT to reduce

The Courthouse: The judges suck. They are the single biggest reason crime is out of control as they let these violent criminals walk away .

Illegal immigrants are fleeing countries where lawlessness is everywhere. That’s WHY they want to come here. We represent safety to them BECAUSE we follow the law here. President Trump is not closing the door to illegal immigrants. He is saying “here is the door”. Please enter our country this way not as a mob trying to sneak in the country. Enter our country legally like everyone else has in the past and it worked very well. We want to maintain a society with laws that everyone follows so that we continue to be a place that is fair for everyone. Why can’t the far left understand this basic concept?!?

Sheriff and District Attorney elections are both in 2022. Harrington has a lot to prove. She has to show that she’s not the dog who caught the car and was baffled on the next move.

Planet posters. Every one on the planet is a good poster but is a terrible DOER. The Gman is front and center regarding everything Pittsfield. He saved you over 100 million in the 80s and he is poised to save you a fortune soon at the W/S updates. He has given the best idea to date as to how to put boots on the ground in the two major crime areas 24/7, he is the only city resident to push for body cameras and he proposed the police advisory/over site committee over three years ago. He is out there supporting the taxpayer at all times but there is no support from anyone in the city. He appears all by himself at all times. He alone secured the opportunity to give a presentation to the public works committee on Dec 10th. He didn’t need any help in pulling together his team of engineers and scientists as he had to look far and wide to find the team he has assembled. If you people who post day in and day out think that it is enough to change things here in pittsfield you are sadly mistaken. What everyone must do is post like you always do and act in any way you can. Go to city meetings and participate send letters to officials, Be a guest on the Gman’s show and talk to many people as to what you think needs correcting. A citizens group is sorely lacking in the city. The Gman can only do so much but if everyone participated like the Gman does we would solve the many problems in record time. The best I can tell you is to participate. I’m sure that Mr. Valenti would tell you to do the same.Participate_=it is the only way to correct wrongs

As a citizen of Pittsfield, I want the GMan involved in the police department, about as much as I want Chief Wynn solving Pittsfield’s water issue. I don’t. The GMan is not a trained police officer, does not think like one, etc. Putting “boots on the ground 24/7” is an absolute foolish idea for many different reasons. (1) a single officer walking the Westside or Morningside areas late at night or early in the morning, is an officer safety issue. It’s 100% completely unsafe. (2) What good would boots on the ground be, if your Westside foot patrol was on Wahconah Street, by BMC, and the shooting (like last night) took place on Columbus Avenue? Somebody in a cruiser coming from Coltsville would still be the beat officer to the scene. (3) If you were in trouble and were violently getting assaulted, would you want an officer jumping out of his car and assisting you ASAP, or would the GMan guarantee that criminals will give the beat officer, who just jogged 1/2 mile with 25+ lbs of equipment on in July heat, a 5 minute breather? Can you do that GMan?

I like the GMan’s fight for the tax-payer. But sometimes, one must recognize one’s own limitations. The GMan is not a trained police officer, so let’s leave to the professionals to decide how to best fight crime in Pittsfield.

Kate the Gman does not profess to be a police expert. The fact that there is no one suggesting anything to curb the crime problems he decided to put out some ideas. If you study the method of rotating cruiser cops and foot patrols you will see there is some merit. First that puts a fully fresh set of legs every hour in the crime areas. The foot patrolman is in constant contact with cruiser officers at all times. Mr gaetani even suggested that foot patrol officers be accompanied by police dogs at all times. Can we tighten thins up further. Yes but we must do something because what we are doing is accomplishing nothing. We all have to think of ways to make things better because things can not be any worse than what WS have now

TSC You are correct about the crime problem being out of hand but it is evident that you and most on this board are not aware of a great idea Mr Gaetani had for putting boots on the ground 24/7 in the morning side and west side neighbors requiring no new police officers. Here is how it works: An officer starts his day patrolling on foot in the two crime areas. After one hour that foot cop is replaced by a policeman who was driving a cruiser. One hour later a foot patrol officer is replaced by some other officer who is driving the cruiser. This occurs 24/7 putting boots on the ground 24 hours a day. This is simply a swapping of foot officers with cruiser officers 24/7. It is a fantastic idea that can be implemented in one minute. The Gman always looks for common sense ideas and it is why he has been so wildly successful in his life’s work. Mr. G suggested this over four times this past year but nothing happens because not enough support is there from the community. This is why I say that planet posters must become active participants. Posting alone accomplishes nothing.

Somebody was shot multiple times on Columbus Avenue at 1PM this afternoon. Yes, in broad daylight. This is how bold these criminals have become in this area. Pittsfield needs outside help brought in at this point to combat the violence. Curfews? Shut down some bars? Something needs to be done quickly. More drug arrests, not fewer.

Don’t know but according to my research, Harrington stated she is not going to incarcerate people for non violent crime, which by inference means that anyone possessing a handgun illegally gets a “get out of jail free carrd”, unless they actually get caught using it to shoot someone.

Scump in huge huge trouble. When Michael Cohen plead guilty to federal financial crimes there was an 80 page FBI report that showed scump was complicit. Because Cohen plead out the document wasn’t made public. The WJ says they will release the 80 page report. They say that if Scump wasn’t president he would be indicted already. The WSJ says the congress will get the report and look for the house to indict scump. Scump is like a severely wounded junk yard dog. He was running free for two years but he now has a democratic collar around his neck. He is foaming at the mouth and is very dangerous but not really because the dems control him now. Harrington claims she is going to end the schools to prison pipeline for people of color and review convictions with an eye toward discrimination, and that she is going to end “the shameful scourge of racial bias here in Berkshire County.” She is essentially calling the criminal justice system racist, just like granney effin’ warren. What evidence did she ever present, that criminal justice in the Berkshires is biased? None, zero, nada, zippo. Blacks do time more than whites because they commit more crime, plain and simple, you can look it up, as Yogi the Bear would say.

The apparent spike in incidence of gun activity isn’t quite as new or elevated as it’s made out to be. It’s only more noticeable now that SpotShotter instantly picks it up and police respond. Which results in a bunch of boring people sitting home listening to the police scanner immediately posting the call to social media and starting a public frenzy.

People have been shooting guns around here forever. Although it seems like their aim has improved considering the number of victims…But we didn’t get SpotShotter on a whim. It was the result of an already large presence of gun play. Now we just know about every single shot fired.

Both of these recent shooting are drive-bys. Very scary for the general public and also very difficult to solve. We have no idea if these people knew their attackers or if these were random drive-by shootings. The police don’t seem to know either. Police are asking for anyone who may have had dashcam footage anytime during the morning that one man died from gunshot wounds to the neck.

TSC If Scump was innocent he would welcome the Mueller probe. No one knows for certain whether he is innocent or guilty but his actions sure point to being an individual who is doing everything possible to insure that this Mueller probe doesn’t see the light of day There is something called perception and the perception strongly points to him being guilty. To answer chucks question what happens if Scump is found innocent in the Mueller probe? would say that the country would accept Mueller’s results and the country would get behind scump. But because he has done so much damage as president he would not win a second term. Everyone needs to be reasonable at all times and scump hasn’t been reasonable and this is why the American people won’t give him a second term.
