(FORTRESS OF SOLITUDE, THE WEEKEND EDITION JAN. 18-20, 2019) — You’re an online business. You lose $151.7 million in the third quarter 2018. Customers file countless complaints about bad service, cheap products, and “bait and switch” practices. Your customer relations are a mess. You’ve just been hit with a lawsuit accusing you of stock fraud and the illegal pocketing of $87.75 million. More suits are said to be in the works.

You are Wayfair, the online furniture company.

You are the company that Pittsfield mayor Linda Tyer went gaga over when she announced last month that Wayfair intended to open a satellite operation in Pittsfield worth 300 jobs.

Now, it appears to be another of the mirages that have become standard operating procedure in the city (WorkshopLive, the Beacon Cinema, Eversource, Spice, Nuclea, ad infinitum, ad nauseum). Of course, all of this must play out in court.

Tyer insists the bad news will not affect the move into Pittsfield. Dispassionate reason would disagree. Companies usually don’t expand when they’re facing these kinds of problems. Off the record, the wise guys say the Pittsfield office will never open. Prediction: Wayfair in Pittsfield is toast.

Did Pittsfield get taken again? The mayor won’t be smashing a bottle of Dom Perignon against the launching of the S.S. Wayfair from dry harbor into the Clock Tower building anytime soon. You know. Clock Tower. Managed by developer David “St. Mary’s of the Star I Want Millions of Taxpayer Dollars” Carver, whose major tenant there just happens to be The Boring Broadsheet. Gosh, do you think that will affect the newspaper’s coverage of Wayfair?

The class-action lawsuit filed in federal court in Boston alleges:

  • the company made false and inflated claims to investors.
  • The fake news drove the stock up from $107 a share on Aug. 1, 2018 to $150 share by the middle of September.
  • When it hit $150, the insiders sold out and cashed in, making almost $90 million. The dates are interesting. Not long after, Wayfair announced its expansion in the Bay State, including Pittsfield.

Wayfair has been losing money for some time. In the third quarter of 2018, Wayfair lost $151.7 million, $75.3 million more than it lost in a similar period in 2017. Analysts say the fourth quarter will shows losses, possible even worse ones. That is not sustainable, and it bears the signs of a tanking company.

Tyer also made the incredulous statement that “lawsuits of this nature are a part of doing business as a public company.”

Truly? Being accused of probity, fraud, and corruption in federal court is a routine “part of doing business?” The comment reveals a nonchalant — no, shocking — attitude about graft that every citizen should find unsettling in the extreme. After all, Pittsfield is a “public company” owned by citizen shareholders. Maybe what she’s saying is that this is an ordinary “part of doing business” in Pittsfield.

On 12/29/18 I ordered the ****** Dark Greg Area Rug. My order # is ********** and my total came to $95. Today is 1/2/19 and I just received the rug and I’m HIGHLY disappointed. First off, it was folded instead of being rolled. So when I tore the plastic off, I had to unfold it which made the rug have TERRIBLE creases that will be extremely hard to get out (if they’ll even come out). The rug is terribly thin, the colors are faded, and overall, it looks a mess. I should have read the reviews BEFORE I made my purchase because it looks like a lot of people are having the same issue. Now I feel like I’ve wasted $95! I tore the plastic off and everything so it’s impossible to ship back. And probably too much work anyway. I’m just so, so disappointed. Terrible quality product.

I ordered from Wayfair for the first time ever and deeply regret it. My item, a king size bed frame, should have been delivered over two weeks ago and since then I have spoken to many wayfair reps and managers who continue to give me the run around – one minute the package is lost, the next it’s on the way, the next it’s lost again. Calls have not been returned and I am livid. This has been a huge inconvenience as I recently moved into a new home and have been sleeping on the floor. I had family come visit for the holidays and instead of being able to stay in my home they had to spend hundreds of dollars last minute on a hotel room. Wayfair initially refunded me $200 and said I would receive my bed a week later. It’s now been ANOTHER week and no bed and Wayfair has decided that they’ll be sending me another bed frame until my actual bed frame gets here – which could be weeks they said. That means that when my actual bed that I ordered arrives I will have to deal with the hassle …

I made an order on November 29th, 2018 for the amount of CAD$356.15 for a Step One 5 Drawer Dresser. It is now December 29th, 2018 and I have yet to receive such delivery by this company. I have been dealing via phone and email back and forth with multiple representative and even a manager by the name of ******* * with the email address *******@wayfair.com. ***** is the shipper for this order and they have failed to deliver this same order countless times. I have contacted both ***** & Wayfair to make sure the delivery driver to press my apartment buzzer code #*** as I have requested and noted down specifically on my order record. I have explained numerous times that I have been into a recent accident where I ended up injuring myself which caused my foot and my back to be immobile. I have notified both ***** & Wayfair multiple times to please make sure to advise the driver to press my apartment buzzer to notify me to let them in as I am currently physically unable to…

I purchased a gift for my daughter-in-law from WayFair. When it arrived, it was addressed to her, from her. She did not realize it was a Christmas gift from me, so she called the company who did not identify me as placing the order. WayFair, then, sent a UPS driver to pick it up and return it to the company. They have not re-imbursed my credit card for the amount ($78) and are calling it fraud on my part (for asking for a refund). Both, I and my daughter-in-law have excellent credit ratings and are professionals. We do not commit fraud. WayFair needs to re-imburse my credit card.

Ordered tile for my home Dec 16 and I still didn’t receive. Everytime I call customer service they tell me 2 business days your order will be shipped. I want what I ordered. Now I’m being told nobody is available to release my order for shipping. I don’t know what to believe. The tile is for my master bathroom. It’s holding up renovations and I can’t use the bathroom.

Hopefully someone copied the story from the Eagle and the more comprehensive one on I Berkshires because I am not seeing either one right now. The iBerkshires one lasted only hours before being scrubbed.

And who gave the order to kill the story and why? This is not the first time iBerkshires yanked a story shortly after it hit the press. Is the local press being controlled and if so from where?

If anyone has the iBerkshires version perhaps they could paste it here.

Good to know. I wonder why it has become harder to locate though. Was someone in power embarrassed? Was the story inaccurate? Who pulled it and who pushed to have it pulled?

Surely there will be an explanation soon in the papers so that they themselves do not look foolish. I am sure of it.

While there was a recent case of an IBerkshire story being temporarily removed, this is usually never the case. After a certain amount of stories are posted on the home page, the older entries are automatically moved to the archive, which can be accessed by the “News” link on the horizontal menu above. A story usually moves to the archive within 24 to 48 hours. Not defending them, just pointing out what I have found.

When precisely did the dream turn into a nightmare you ask. That is presicesly the question Watson but a straight answer is as elusive as big foot, or a cougar in south county, or Kinda like a bad marriage, it’s a downaward slide and one day ya wake up and realize your dream has become a nightmare, but you’re not quite sure when exactly it happened. In Pittsfield’s case, the downward slide started about 30 years ago, and now it is complete. Shootings have become as common as a bum on North Street lookin for a hand out. Think positive Danny Boy, Wave stock, oops I mean Wayfair Stock was 80 bucks Christmas Day and now it’s 96. Now is the time to buy as a realtor once told me. Speaking of Danny Boy, it’s a great Irish song and perhaps Pittsfield can publish its own album and it can be an economic engine, and we can throw some Kapanski cash at
Marketing it, and then cash out when it takes off, kinda like Wayfair. It can be titled Nightmare on Allen Street, by The Downward Slide band, and feature such hits as PCB Park,
Economic Engine, Urban Renewal For Fools, Beacon Bucks, Triple Homicide, Double Shooting, Slice and Dice, A Hand Out, not a Hand Up, The Stanley Bullspit Incubator, A Free
Lunch, A Free Ride, Workshop Dead, the Doyle Debacle, Fat Pat, The Mirage, The Ruberto Renaissance, Trauma Informed Prosecutions, and Restorative Justice. It would also include Coming Soon, The Stanley Shuffle, It Ain’t Happening, We’ve Been Bypassed, A New School Thanks to Fools, and Two Tokes and a Whiff and it can close with The Devils’ in DA Details, and A Pickle Park Coming Soon.

I’ll add to that list….Walmart mysteriously deciding to change their corporate policy just when they were due to set up a Super Walmart here in Pittsfield. Posters keep coming on here and thanking the City Council and Mazzeo for killing the Super Walmart deal while others insist that Walmart changed their corporate policy and decided not to build a Super here. What is the truth? We may never know because THIS IS Pittsfield. A Super Walmart would have revitalized Tyler Street instead of the street narrowing that they are now proposing.

The recent lawsuit is just the tip of the iceberg.
IF they end up in Pittsfield, and it’s a big IF… it will be an extremely scaled down operation. The biggest hold up, they want money from the city, and it’s a story you aren’t hearing yet because Tyer and Kufflinks Kerwood are trying to figure out the work around.

They are going to try and frame it as potential employees needing training, that the candidate pool is weak and that locals lack the basic skills to act as phone reps. So Pittsfield, via a grant program, will help pay to “retrain” locals so they can get the “jobs”
Understand this “retraining” is really just the standard new employee training Wayfair does but it’s now a form of corporate extortion.
That’s at least the back trim deal being considered right now.

A more fundamental problem, the C3 team at wayfair knows it’s a sinking ship. They’ve spent millions on marketing and are not seeing the growth or return. They have also learned the tricks from the dotcom days and now are looking to take profits via stock manipulation before the ship sinks.
Wayfair is, at this point, a Ponzi scheme. New investors are propping up the companies losses and will be unable to sustain this for much longer. The only saving grace for wayfair, some of their foreign sales are grown but not at the rate they need.

Another huge hit, and people need remember this, Wayfair and their crack legal team, is why you pay taxes for online purchases now. The Wayfair salestax nexus has changed online selling forever and has stripped Wayfair of one of its real competitive advantages and it was of their own doing.

eBay didn’t make products, amazon didn’t make products, both had very limited scale. Neither were frauds. There are thousands of internet companies that don’t make products that aren’t fraudulent. Wayfair was a legitimate company, it’s now strayed into fraudulent based on stock manipulation.

Wayfair has buildings, logistics services and devices, their own fleet of vehicles, websites and proprietary IP, and it’s scaled.

The issue is they hit a wall and now instead of moving boxes for a profit, they are engaging in stock manipulation.

Planet, if you search far and wide. That quote by the Mayor~Price of doing business~was also used by a local business entrepreneur, won’t mention his name, who also said that after being fined a couple of million for illegal practices.

Agent Smith lays it out beaufifully. A couple of things added would be many of these tax and tif grabbers always have a plan a b c and d,whether it be what the Agent laid out or something else.

One other thing the Agent might have released is this company like many companies, they (wayfair) wouldn’t mind being bought by the bigger sharks,like an Amazon or a Wal Mart, that would be option E.

There should be inquiriys concerning the BeaCon forgiveness, the current wayfair situation,pickle ball funding,the way the new school was produced (public discussion,sure but private vetting) the water improvement to the sewer plant, that is a big one, why a slimmed down meeting with only a couple council members and why three consultants and no other viable option.the, Moringstar sewer, One million paid for drawings leave a bad taste. And the metered parking,enough said. Add all this with the crime increase and people like stoogeon spewing bullshit you have a bad cocktail.

Fortunately, progressive Harirngton’s office is not leading the prosecution of Wayfair. Whata walking disaster she is.

Sources tell me left-hand Harrington is still sore at the Eagle over their blistering opinion column, calling her on his choice to release a violent defendant on personal recognizance, bypassing a dangerousness hearing.

So, now left-handed Harrington has turned to Chartock’s WAMC as a primary news release outlet.

And that’s the bottom-line!!

Since Harrington and her cabal were so obsessed or fixated on Capeless and Caccaviello during the campaign, I guess a degree of oversight, from me, might not be “cause for concern.”

Moreover, given yours and others on this blog’s heightened level of obsession with Mayor Tyer and the Pittsfield City Council members, I’m guessing a little oversight of DA Harrington is readily acceptable.

And I’m guessing you haven’t read J. Melle’s postings lately. His comments are twilight-like conspiratorial, at best; while mine merely highlight Harrington’s unfitness to hold office.

I’ve never said there isn’t a cheaper way to accomplish certain goals like phosphorous reduction with the wastewater effluent.

What I have said is that the G-man thinks he doesn’t have to follow the laws like everyone else. This is evident by his criminal charges related to threats, witness impersonation, and breaking and entering an automobile. Additionally, his dismissed libel lawsuit against the Eagle because he allegedly admitted he was drunk in public at a political event.

So why would a contractor like the waterboy want no competition? It locks in work and profit. I offer a significant price reduction to my private practice clients if they agree to sole-source a contract with me. I don’t have to compete with other consultants and incur the expense of submitting proposals. I offer as much as a 40% reduction in my hourly rate. for example, one community I submitted a base fee of $9k with add-ons of up to $4k more. The decided to go out for bid. I told them straight up front, if I submit a bid for a project where you’ve allocated a $20k budget, do not expect me to come in with a $13k proposal to win the work. Not when I have uncertainty and time delay.

This is how it works, don’t let the water boy CON you into believing anything different. If the City were to go back and revise the bid specifications, he and his toadies would likely not be low bidder.

I watched the debate in question on TV. Gaetani was in the audience for the debate that took place before the debate that participated in. Did anyone see him drinking in the audience? No. So what the Eagle was saying that he showed up drunk before the first debate and he remained drunk for 3 hours while 2 debates were taking place. If someone was still drunk after 3 hours of not drinking they likely would not be able to walk let alone drive. It’s obvious that the false allegation was cooked up by Earl Persip, possibly after conferring with John Krol. Drane had no business reporting such a non story. But we all know that the Eagle is not a real newspaper.

There are two levels of police presence at the recreational dispensaries in Berkshire county.

The regular police doing traffic and crowd control and undercover drug task force police scanning every plate of every vehicle that drives into both facilities.

The police are indexing all registrations against outstanding warrants and using MV violations (expired reg) as a pretext to pull people over and do searches.

There has not been a single informed comment on this board regarding the significance of the class action suit filed against Wayfair. Such suits are incredibly common, as are the hyped up allegations. They are, as Mayor Tyer said, a cost of doing business for a public company – especially a youngish company that is priced more on potential than current results, leading to more stock volatility and large price swings.

In the one year period preceding the filing against Wayfair, there were 412 other class action lawsuits filed against public co’s. They are almost always a money grab and nothing more than a nuisance. Which is why Wayfair’s stock price has added 10% since news broke of this DEVASTATING (according to the investment gurus on this board) development.

Dan Your idea is a noble one but would never get off the ground. Look at the posters on this blog. Most are very well aware of the problems that face pittsfield and they know who is responsible for them and yet they do absolutely nothing to even try to solve the problems. With the exception of you and the Gman who are the city’s two watchdogs there isn’t even another person who comes close to matching the civic concerns you both try to address. With just the two of you out there without a good support base you virtually can accomplish nothing. Look at CC meetings. Its the Gman only at every meeting with no support. Can you imagine he brought a proposal to save the city 28 million dollars and only two people showed up to support him. The next day people on your blog criticised him for no good reason other than meanness. This is what a person who tries to help the taxpayer is up against. When the Gman had trumped up charges leveled against him without a stitch of evidence the same chorus on this board continued their attack on him. With people like this out there who would put their neck on the line to represent these types of individuals??? Your heart is in the right place Dan but you need to understand the psyche of people. He wishes Dr. Krofta was alive to give him guidance and could use the Krofta money to move this project forward. This project would bring clean water to over 5 million people. Before the project even starts ships from all over the world will be bringing in construction materials for well over a year and interpreters will have to be on the project 24/7 so the engineering teams from different countries can communicate with each other. The construction time frame is over 3.5 years. The only thing that is holding him back is having to flush the city residents down the toilet with these water and sewer projects here. I told him to go ahead and flush them down the toilet because who the hell does he owe anything to. Look what supporting the taxpayer has cost him here in pittsfield. So you see Dan pretty soon it will be just you banging your head to try to help the taxpayer. The Gman is close to telling everyone to kiss his ass. He will be justified when he does.

Art, go to the senior center and you will find most of the people who know or even care what is going on in the city. And almost every one of them has health and mobility issues that would prevent them from being much help.

As far as the younger folk? Some organization recently did a poll somewhere, maybe New York, and ask a bunch of people under 35 several basic questions about their government. The results were abysmal. Most of the younger folk are ignorant of how their govt. works and could care less.

I do not believe government or how it works is a priority subject in schools today. But politicians and their children and their friends do know how politics work. And that is why you get the same old clicky group who wind up controlling your life. And in cities like Pittsfield they control almost every facet of government and cover for each other when they screw up. They also have a great deal to say about who does well in the job market.

And that is why you can’t get people to do what is in their own best interests.

My distinction is not false and you are flat-out wrong. Private companies CAN NOT be sued under federal securities laws. Period. There is zero ambiguity about that.

As for the 412 figure I cited, that refers to class action federal securities suits filed IN THE LAST YEAR. The year before saw roughly the same amount. As did the year before that. Every year, roughly 10% of publicly traded companies are sued by rapacious lawyers who exploit “class action” statutes and throw as much crap against the wall as they can to see if anything sticks. Anytime a company’s stock falls precipitously – for whatever reason – an army of scumbag lawyers look for ways to construct a “fraud” argument and enter the class action sweepstakes.

These suits are indeed routine. And predictable.

He feels a better method is as follows: Candidates for political office should announce their candidacy one year before the election. I just responded to this above but a few points are worth reiterating. Private companies can NOT be sued under federal securities laws. Period. It is evident that you have no idea about the many distinctions between private and public companies, particularly the legal distinctions.

About 10% of public companies are sued every year. Scumbag lawyers have screeners that identify any and all companies whose stock price falls by a significant amount in a short period of time. Then they construct arguments tying the stock decline to fraudulent behavior by the company and its officers. It is routine and it is predictable. I am an active investor. Over the years I have received dozens of notifications regarding my eligibility to join class action suits against various companies whose stock I owned during the “class period.” Intel, Boeing, Google, …these are the caliber of companies I have been invited to sue. I chuckle every time a I receive such an invitation, though I feel bad for the suckers who get roped in and get their hopes up.

The SEC doesn’t prosecute, it’s actions are civil. As for private companies, registration of their securities only occurs if they have 2,000+ “owners.”

Regardless, even if they cross that ownership threshold, INVESTORS can not sue under federal securities laws, i.e. the type of lawsuit brought against Wayfair could never be brought against any private company. Hence the 420 class action lawsuits in the last year that I cited above can not be measured against the universe of 16 million companies (public and private).

That said, there is indeed a lot of nuance regarding how companies might be held accountable for misbehavior. Here’s a good read if you’re interested.

Beacon is floundering

Good thing that they got the building on the cheap because their revenue is way down.

Old beacon pricing was $1 more on seats and 30% less on concessions (based on size and cost)
They grossed about $12 a patron

New Beacon, $5 seats but increased hours and concessions and they are pulling in about $9 a patron

A staff member noted seat sales are actually down, the running theory is that people liked the reserved seating system and are staying away because of it.
Also the extended hours are pushing costs up, the new Dolby 7.1 system is getting complaints for being too loud and sound from one theater is bleeding over into the next.

The CEO is doing radio spots (should be out soon) begging people to come to the movies.
The management team at Phoenix/insight are shocked at how poorly the theater is doing.

Letter: “Feeling unsafe in a dangerous city”

To the editor:

In the summer of 2011 I made a very foolish decision to go walking on North Street at about 10 at night. As I was walking near the bus station on Columbus Ave. I was jumped by five or six teenagers .I was thrown to the ground as these cowards punched me in the head and kicked me in my rib section. I went to the hospital to find out that two of my ribs had been broken. For close to three weeks I was in tremendous pain and had trouble sleeping because of my injuries.

I am bringing up this story now because it is 7 1/2 years later and the crime problem in the city of Pittsfield has gotten even worse. I live a few streets away from North Street and it is less than a 10-minute walk to Morningside Elementary School. As readers of this newspaper are aware, this a dangerous place to live. There are a large number of drug addicts who live in my neighborhood. I do not really care if someone one wants to throw their life away on heroin or other opioids as long as I am not in peril of being robbed because some random drug abuser decides he needs to rob me of my money to get his next high.

Now, to be safe, I no longer carry cash in with me ever and I carry pepper spray in case someone tries to jump me again. I also avoid walking the streets after dark because I try to avoid making the same mistake twice. In my opinion there are many neighborhoods in this town where it is unsafe to be walking the streets, which is a huge problem for me because I can no longer drive a car due to my many anxiety disorders.

I do not see the poor and dangerous areas of Pittsfield changing anytime soon. Since I am living on Social Security I cannot afford to move a safer area of this city or move to another area in Berkshire County. Obviously no one wants to struggle with money but everyone should have the right to have a real sense of being safe and secure in their neighborhood.

The only thing keeping Mr. Hurvitz from being seperated from the rest of his money is the cops. Without law and order, there would be complete mayhem in our streets. No one is forced to live in Da Pitts and saying he can’t move shows he is still living as a victim instead of a Viking, just like you Johnathan. And ya need to update your street list to include a few more like Spring Street. He is right of course about the crime and he better stay home at night and pull the blinds and lock the doors, or start packing a piece like Charlie Bronson when he is out at night. “One man killed in Pittsfield shooting”

Pittsfield — One man was killed early this morning in a shooting on Edward Avenue.

The man’s name was not released, pending notification of family.

According to a news release from the Pittsfield Police Department, at around 2:13 a.m. authorities received a report of a possible gunshot victim outside a location on Edward Avenue. Police found a man who appeared to have suffered at least one gunshot wound. He was pronounced dead at the scene.

“At this time the Pittsfield Police Department does not believe that there is a threat to the general public,” the release said.

Anyone who has information about the shooting is asked to call the Pittsfield Police Department Detective Bureau at 413-448-9705. Information can also be provided anonymously via the Drug Tips hotline at 413-448-9708, or by texting PITTIP and your message to TIP411 (847411).

G. An. After reviewing the transcript of the alleged drinking the night of the debate at B C C… nowhere during the night did I see you drunk or slurring speech that would say you were drinking, clearly you weren’t it’s on tape.

I have a question,who were the so called drinking experts that said you were drinking? How could they tell or know if they didn’t see any evidence. One other very important item also,and unclear on this,did the reporter who witnessed this actually witness you as being allegedly intoxicated, if so,wasn’t that reporter still in the building? That 4 year investigation was conducted by David Capeless and former MSP Det. Lt. David Brian Foley. Both were corrupt, dishonest disgraces from hell. That likely factored into the “quality” of the case against the perp and the disposition that you find so outrageous.

Maybe your outrage would be better focused on corrupt criminal justice authorities who have unlimited power and zero accountability.

Didn’t you know that drug dealing is a non-violent drug offense? I’m surprised he got any time at all. So what if he got caught red handed with 80 bags and was selling upwards of 1,000 bags a week. It ain’t like he stuck a knife in the junkies. It was their choice to use. Just because other DAs bring manslaughter charges in cases like these, don’t expect Hardly to. Just because he was charged with a 10 year felony for dealing heroin doesn’t mean he has to do any time. On a positive note, the sooner he gets out, the sooner he can deal again, and the next time cops can get him for a subsequent offense which will carry a 3 year mandatory minimum according to my lawyer friend, but that only applies if Hardly Harrington doesn’t dump the charge.

Pctv is always looking for people to produce new shows and these potential candidates could each have a weekly show where they can speak to the public and also take questions by telephone. These potential candidates could get help from the king of Pctv Mr. Gaetani. A mayor or councilor candidate who can’t speak in detail about their plans for the city should not be running for office. If we had this format in the past elections we wouldn’t have tyer as mayor or several on the council today. Mr. Gaetani is the one advocating for this format and might be a candidate himself for some office. I think he has a good idea and I also believe that this format would entice better candidates than we have seen for the last 30 years. We are being governed by buffoons who are the darlings of the Gob network. And they are being elected based on sound bites and the like. This format I believe would entice many new voters who have given up voting because they feel there is nothing they can do to stop the incompetents that are elected time after time. I’m not for this. Too bad common sense isn’t too common. A 20 yr sentence would be too harsh, a nothing sentence says don’t bother worrying if you get caught. I’m sick of the drugs — legal and illegal. I don’t have much confidence in the local police, which doesn’t help. The survelliemce Agent Smith talks about ‘might’ help the dispensary people safe (I hope so) but this system of govt sanctioned and illegal drugs just makes everything a hypocracy. Also, it sounds like some of this suurvelliance action becomes an invasion of privacy. Yuck. Holland has red light districsts. This just in.

The Massachusetts State Police unit embedded in the Berkshire DA’s office was formerly led by a Detective Lieutenant named David Brian Foley. Det. Lt. is a very senior rank in the MSP – there are fewer than 50 in the entire state.

Shortly after David Capeless “retired,” Foley left the MSP (under a $50k buyout). He was promptly hired by Tom Bowler as a Deputy Sheriff in the Berkshire County Jail.

As it turns out, Foley was David Capeless’s MSP butt-boy for his entire career. It was under Capeless’s command that he rose from Trooper to Sergeant to Lieutenant to Detective Lieutenant. Foley led all of the narcotics operations that distributed justice so unevenly over the years.

Here’s the good part. From what I have learned, Foley was a corrupt partner in crime (literally) with David Capeless the entire time. Both belong in jail, although that will never happen due to the abject corruption in our state and immunity laws that protect them (despite such laws having zero constitutional basis).

Fortunately, none of those factors will prevent the story from coming to light and providing Capeless, etal. with the justice they deserve – at least in the court of public opinion. I don’t know the details, but from what I understand something big is in the works. Our little hamlet may be getting some serious attention.

I will post more as I learn more, but here’s something to think about. Just as the Williams College rape issue was hitting the fan in October, Foley made a $250 donation to Caccaviello’s campaign. At the same time ADA Greg Barry, Williamstown PD Sgt. Scott McGowan and ADA Dana Parsons also made $250 donations to Caccaviello’s campaign.

All of these names are connected to a case that came up during the campaign.

Time to stock up on popcorn. I suspect this is going to be a good show.

P.S. The disgusting wife of David Capeless posts on this board under the handles Truthsayer, Sister Golden Hair, Agent Smith and Silent Cal. She gets her “scoops” from people like Kim Blair and Mary Shogry, holdovers from the Capeless regime who will likely be gone soon enough.

P.P.S. Mrs. Capeless should probably take a closer look at her husband’s relationship with Shogry. Gross.

You say Foley was a partner in crime (literally)with David capless the entire time. If you want people to take you seriously you definitely need to state verifiable facts. I always take the side of truth and fact and I dont care if a wrong doer is the president of the united states or the most lowly of the low. If the liar is the president of the united states like the one we have today I call him a liar and would call him a liar to his face because he is a liar. You need to provide some proof of what you are claiming if you expect people to believe you. You very well may be right and I am willing to listen to more but others may not. For the record I am not married to any man, I am not related to Capeless in any way or any office holder in Berkshire County or any public servant, past or present.
My information about the new DA and her inner workings come directly from those that work for her and were part of her campaign and are part of the inner circle.
None of her inner circle is really loyal save for what each thinks they can get out of the other.

Got a city CENSUS form. On the bottom of the front page it says “if you have no changes you can take care of it online”. But I went to cityofpittsfield.org as the form says and found CENSUS but it says you must mail the form in.

Does Barry or anyone from the city know if it CAN be done online or did someone forget to do something?
