NEW D.A. TAKES OFFICE; NOW ITS TIME TO DELIVER … AND SHE BETTER AFTER ALL THE CAMPAIGN PROMISES

PLANET VALENTI NEWS AND COMMENTARY

(FORTRESS OF SOLITUDE, The Weekend Edition Jan. 4-6, 2019) — On Tuesday, Andrea Harrington was sworn in as Berkshire County District Attorney.

Took the solemn oath. Pledged. Pinky promised. Triple-dog-dared.

You know, what politicians secretly call “lying.”

THE PLANET need not remind anyone.

———- ooo ———-

Harrington comes in as the first woman to hold the office. She nominated a woman prosecutor from Hamden County as top deputy, or was it Hampshire? Who cares? Split the difference. Women, in fact, are everywhere in the “new” D.A.’s office. The old rooms at 7 North Street have never seen as much glitter, fluff, puff, pom-poms, makeup, sensible heels, and pink swirls. Ellen DeGeneres and QVC have replaced CNN and The NFL Network.  Sources tell us that there are men in the office, though in these gender-bending times, we aren’t sure. We mention this only because the new D.A. has made gender so important.

It’s simple, really. White men are bad. Hard-working, middle-class folks are bad. Women and everyone else are good. Got it?

AH campaigned on protecting the rights of disadvantaged youth, women of color, “victims,” immigrants, transsexuals, LBTGQOLMNOPs, one-legged marathon runners, ballerinas, drug addicts, thieves, pocket poolers, pickleballers, trespassers, vandals, and other stalwarts. Harrington also made it clear she would not prosecute trespassing, theft, receiving stolen goods, malicious destruction of property, drug possession, intent to distribute, and a list of other crimes too ponderous to list. THE PLANET would remind the district attorney that NOT prosecuting these crimes won’t solve the issues that are now hers to fix.

If you’re white, male, middle class, pay taxes, and keep the law — any or all of these — surrender. In Harrington’s eyes, you have had all the advantages. You got where you are not by hard work but because it was “handed to you.” According to the new way, that makes you a racist, sexist, and whatever “ist” may be in fashion.

———- ooo ———-

Harrington won by promising miracles. The black-and-white campaign picture she sketched presented a caricature of the issues, a simplistic cartoon suggesting a Good Ship Lollipop view of crime. Her main stump theme was “ending the scourge of racial bias here in Berkshire County” and the alleged “school-to-prison pipeline.” That’s like the mayor identifying pickleball as the top municipal concern.

Harrington is more politician than prosecutor. That’s not a knock on her, because D.A. is an elected position. You have to campaign. Hustle. Shame yourself. Beg for votes. Kiss up to the Special Interests. Sell out. She did that, performing the thousand and one humiliations required. Paul Caccaviello either didn’t or couldn’t.

Once upon a time, wiseguy scribes like THE PLANET used to give newcomers to office a honeymoon in the first year, but that has gone the way of typewriters and steering-wheel knobs. The politicians bear the responsibility for the way they have abandoned Mary Jane and Joe Kapanski.

During the campaign, we heard stories illustrating the supposed grudge-bearing nature of the new district attorney. Remember her infamous phone call to Melissa Mazzeo? We got a tiny taste when she stopped communicating with us. She took her football and went home, ignoring two congratulatory (and heartfelt) messages from THE PLANET, wherein we went more than half way trying to mend the rifted press-public figure relationship she so desperately cultivated when she campaigned — when she NEEDED us. Insiders in Harrington’s inner circle told us she did this because she didn’t like our coverage of the D.A.’s race. Elephant’s memory and all that.

MESSAGE TO ANDREA HARRINGTON FROM THE PLANET:  During the campaign, you promised a miraculous transformation of crime-ridden Pittsfield and environs into The Wonderful Land of Oz. Now it’s time to deliver.

You go, girl.

Right you are Dan. So far, I am sick to my stomach, reading her swearing in speech on IBerkshires and knowing she canned all the good prosecutors because they were white males. She sounds sexist and racist so far. If you’re a black male caught with a handgun you get a free pass as long as you didn’t get caught shooting it. Who do you think is doing most of the shootings? But don’t worry she will eliminate the gang problem and eradicate shootings with second chances and restorative justice. PUKE DOUBLE PUKE

It’s show time Andrea.

And Dan, what is a steering wheel knob?

Ms Harrington made promises to look into cases former office swept under the rug, that said my call to Andreas office is still unanswered.

Pittsfield is #5 in violent crime in Massachusetts during the year of 2017; North Adams ranked #1, again, according to the FBI.
Pittsfield is one of the most economically unequal communities in the state and nation. There are scarce living wage jobs for the average worker. Of course, the politically connected or Good Old Boys are well taken care of.
The Boston Federal Reserve Bank recently gave Pittsfield a grant to find solutions to its distressed inner city areas of acute poverty.
Pittsfield and Berkshire County has lost thousands its residents to population loss, as well as many hundreds of living wage jobs over the past generation or 3 decades.
Pittsfield politics’ answer to all of these socioeconomic issues and problems is to raise municipal taxes, fees, and debts to unsustainable levels.
The new Berkshire County D.A., Andrea Harrington, will change nothing for the better in Pittsfield and North Adams! In fact, Pittsfield is still in a downward spiral.

Dan,
What is the source for the claim below?

“Harrington also made it clear she would not prosecute trespassing, theft, receiving stolen goods, malicious destruction of property, drug possession, intent to distribute, and a list of other crimes too ponderous to list.”

I remember AH saying she would not prosecute low-level crimes under certain conditions, but the list of offenses to which she will supposedly turn a blind eye seems to grow with each retelling.

Dan,
An “insider” referring you to somebody else’s list without any explanation or elaboration does not justify the claim that “Harrington also made it clear she would not prosecute…”

Frankly, if AH were to do as you suggest and give cart blanche immunity from prosecution to all perps of these types of crimes regardless of circumstances, she would lose my support. But I think that’s unlikely to happen. The world is filled with nuance and I think AH gets that.

As I have stated many times I am not a Harrington insider so I can not speak definitively about which specific crimes she will approach with an eye toward not prosecuting criminally. But the fact is, there are myriad crimes where criminal prosecution is not the best choice if true justice is sought. Restitution, community service, diversion programs, etc. – frequently these are more effective options in terms rehabilitating offenders, exacting a punishment that (morally) fits the crime and most importantly makes our community safer over all.

Why let the truth get in the way of a good story?

Seems like there out to be a way to investigate the convictions/pleas of the previous Prosecutors against the initial charges. you could then compare them against Harrington’s practices after a statistically significant period of time.

Followed up with verifying or refuting correlations of recidivism and crime rates for the corresponding time periods.

But why do heavy lifting when we can read sexist and racist satire to dog whistle fears in a struggling community?

I admit MAGA and the women\body shaming generates passionate encouraging from many of these blog readers.

It really is just grimy side of the rose-colored, vibrant, and dynamic ilk that entrenches politics at all stages of the game. Its a serious game.

It merits analysis. It merits acknowledgement that females are not paid what their male counterparts are. It merits a discussion of an equal starting line, not a jumbled finishing line for disenfranchised persons of all races, creeds, genders, sexuality, abilities, religions and disability statuses.

By all means, if the new DA does not deliver, metrics should easily expose her failures.

I’m curious to get an attorneys opinion on her statement that she will look at certain crimes involving illegal immigrants and not prosecuting them out of a desire to not cooperate with Washington’s current deportation standards. Does this mean illegal immigrants will get a pass we’re citizens will be prosecuted. If so is this ethical? Isn’t the justice system supposed to be blind?
Can it be blind if prosecutions are handled different depending on immigration status? Not a lawyer but looking to see if someone has the answer to that ethics question.

Also, remember Krol swore up and down he wouldn’t be going to work under Harrington. How long until he’s catching the same back scratching job as her campaign manager just got?

I am hoping to see equal justice for both the blue collar dude and the politically connected friends of the court. Under the past DA office too many free passes to special people. Can anyone name a few? Like a former city councilor who exposed a drug raid? A hit and run? And white collar crimes involving cash. And who knows how many others that were not so high profile.

It won’t take long to see because there will be leaks galore. I really do not care one iota that she is female but I do care if she has a moral compass.

I also agree. To see well connected people get free passes and special treatment, irks me to no end. The double standard needs to go. I hope the DA proves a lot of people wrong, because the well connected are already doing everything with their power to dirty her up. May she overcome this bitterness.

And now the alleged free passes will be distributed to her La-La Land supporters. Harrington simply won’t prosecute the woman who shot her boyfriend in an argument simply because the guy complained about the burger she made him. Why? Because the victim was a male and the perp is a PETA member who is vegan with a vagina and donated $10 to Harrington’s campaign.

Life isn’t about Progressive, liberal, la-la land, “#MeToo” positions that dominate in the rarefied air of Berkshire County. That smell in the air is from the manure pile down at the farm.

White women are also members of the privileged class. Also all women in general never lie. These are things we have all learned in the last year alone thanks to the media.

Ignoring small crimes leads to larger serious crimes. I hope this isn’t a lesson this area has to learn the hard way. Not to mention ignoring small crimes leads to poor quality of life for a city and county.

You do know I am being sarcastic toward the media? I KNOW they are talking absolute nonsense about women. Women should be held to the same standard as everyone else and NOT given special treatment just because they are women no matter whether they are white, African American or any other race.

The media, however, thinks differently and is trying to make people think that women deserve special treatment.

Now, Andrea, raise your left hand and repeat after me . . .

And the fodder just keeps on coming.

Let’s imagine a Berkshire County happy with what they put in as our top law enforcer.

Me, I am embarrassed for myself and Andrea Harrington. She may not be, I am!!

But I guess when one’s collecting a yearly salary of $171,000. who gives a crap what a smuck like me thinks.

Although, I have heard from more than one lawyer amazed at how ridiculous Harrington appeared with the left hand raised, while taking her Oath of Office, with a retired SJC justice standing along side looking perplexed.

Then again, according to her sandwich maker hubby, Harrington “passed the New York bar, Florida bar, and Massachusetts bar” in three consecutive days. Funny thing is, she was admitted to the Florida in 2004 and admitted to the Mass. bar in 2007. And New York State has no such record of an Andrea Harrington ever sitting for their bar exam.

Seriously?

Brian,
You should be embarrassed only for yourself, not AH. As I posted on the previous thread, the pettiness that has surfaced over such a trivial faux pas is silly. AH may deserve some teasing or the like over her break from tradition, but the “My God! How could she! She’s incompetent!” nonsense is just a bit overwrought. The fact is it makes no difference which hand you raise to take an oath. The right hand is traditional and used by almost everyone, but the spoken words are the only things that matter in oath-taking.

It was much funnier when Gov. Rauner of Illinois made the same mistake a few years back because the oath-giver tried to prod him to switch hands three or four times before giving up. The videos that now exist appear to have edited out that part – the prodding to no avail – which preceded the video below.

https://www.youtube.com/watch?v=9Q1KBeE97Ns

As for your NYS bar claims about AH, you are very confused on that front as well. Passing the bar is but the first step in becoming a licensed and registered attorney in New York (and almost every other state). If AH didn’t complete the other required steps, her name would not appear on any NYS lawyer database. And there is no online record of individuals who merely “sat for the bar exam” in NYS or anywhere else. Which would explain why there is “no such record” for AH.

Overall, I have to say I’m really confused by your behavior. You were on here a few months back rightly complaining that you had been used as a patsy by the Cacc campaign and specifically by the wife of a former DA, but now you are back in mindless attack mode with absolutely nothing to gain. Why?

Hmm, guess I proved I’m not an attorney. That line about online records of who sits for the bar exam is clearly in error, although I am unable to find any info going back to 2004.

In any event, that’s what’s called a “mistake.” A lie is when you know the truth but intentionally say something else. Big difference. Ask DFC to explain the difference to you.

It’s not a mistake when you counter someone else and affirm with a post that no other state and specifically NY doesn’t have records for those that sit the bar (not just online or that it’s not available)

That’s not a mistake, that’s a specific refutation of a post, effectively saying they’ve lied because your information or knowledge is “superior”.

All it proves is that you are a very dishonest person.
When you say, “there is no online record in NYS or anywhere else”. It was calling out Brian.
You are clearly a liar that will say anything to support your cause. It’s been duely noted that that is your modus operandi.

Oh please. I looked at the website linked on Brian Marquis’s Facebook page instead of looking into things more closely myself. About another idiotic, trivial issue – whether the incoming DA’s wife passed three or only two bar exams. Since NY and MA have reciprocity, it’s a good guess he misspoke.

Given Marquis’ history of rumor mongering and passing along bad information, I may have prematurely concluded this was more bunk from him. If nothing else, I should have looked beyond his sources.

It’s funny that you pretend that makes me a dishonest person and a liar at the same time that you and Marquis ascribe those same qualities to AH’s husband and imply that he knowingly lied about the number of bar exams his wife took. Assume the number he gave was wrong. Did you ever consider asking yourself why he would lie to inflate that number from 2 to 3? What would he (or she) have to gain? Not a thing.

IF he was wrong, is it more likely that it was a mistake or a deliberate attempt to mislead for no discernible reason?

Now, who’s dishonest and a liar?

Hey, look now. Marquis and others are ridiculing AH on Facebook for supposedly dying her hair pink for the swearing-in. You people just can’t help yourselves, can you.

This is my last statement on the Trump administration. His intent, along with Ryan and McConnell leading the charge, is half carried out. He got the big prize, tax cuts for the wealthy. On that one alone,I said, that if the big corporations do not reinvest and corporations will buy back their stock and make billions more, the worker will be screwed to no end, look at G M. Also, they control the stock market and are currently making billions there, why the big fluctuations, fed interest rates, yes, but if you know how to invest, sell, buy back, and don’t think these investors know when to do it.

Trump and specifically Mick Mulvaney are trying to do something that would trump the tax cut gift, and that is privatizing SSI. Don’t think that is going to fly, thank goodness, the Dems are back in power, doubt they won’t have the chance to propose that folly.

DAAH (suonds like Duh) has made it very clear that she plans to work on an “expungement program” for women and minorities, white males need not apply.
Women, working as prostitutes, expungement and no further prosecution. Only johns will be prosecuted. Prostitutes will be given access to diversion programs.

“Disadvantaged males” (her words for any males not white) will also be eligible for expungement programs. Caught with some weed, that’s ok as long as it was simple dealing, no guns, and the weight isn’t above 4 ounces, expungement.

As always Cicero in the attempt to cheerlead for AH he lies yet once again

You can get the list of names of persons passing the bar, as in NYS, via the Board of Law Examiners, via ALM reprints (digital copies in multiple formats), via any number of websites like Law.co, LexisNexis, and subscription online service that cater to legal employment.
And YES Virginia it lists just those that sat for the bar, it doesn’t include those that also passed character and fitness reviews.
Here is, for example, a list of those that passed the bar in NYS in 2018.
https://www.law.com/newyorklawjournal/2018/10/24/bar-pass-list/?slreturn=20190004170237

If you want a list of all those that took it, their scores, how many times they’ve taken it what year they passed, it requires a subscription. You can also call the state of N.Y.

https://www.nybarexam.org
Oh goodness on this page you can quickly look up any names from 2008 on easily, the prior years are more difficult.
https://www.nybarexam.org/Lookup.html

But this is all of no consequence, DAAH is a lawyer in name only. She has less legal experience then most actors who play lawyers on TV.

Getting back to things that matter, THANK GOD that Capeless the sociopath is gone. And while I don’t know the complete list of people in that office who have been given their walking papers, I hope that AH was keeping track of some of the infantile “well, they say she was a bitch in high school” crap that came from some of the people there.

Did anyone hear Rivers the other night addressing-the water engineering consultant Jason Lis,she said, so you’re looking for a gig? Was the term used. Yet, Rivers (flip flop)herself, actually, got a gig at Berkshire Jobs, didn’t she, huh.

Halo. I think the mistake Gaetani and Li’s made was in not charging the city 100 thousand dollars as the city’s consultants do every time they open their mouths. These idiot councilors and mayor are not capable of making any decisions unless there paying other idiots our hard earned tax dollars

I support the lovely Linda Tyer for re-election as Mayor of Pittsfield in 2019. Gaetani is a fringe candidate and will lose badly to the lovely Linda!
I can’t wait to read about her speech on Monday, 1/7.

Gaetani is far superior to Tyer but he refuses to run a real campaign of spend or raise any money.

Why read about it Johnathon when you can go and get a front seat and take pictures? Be a groupie. Maybe you can buy a Tyer hat.

When I read about an upcoming forum to address poverty in Berkshire County hosted by state politicians, I believe they are all part of the problem that is the region’s severe economic inequality. The Berkshires are a China-like one political party system where only political insiders and hacks run the show. The average local resident has no real voice in their government. In fact, if you speak out, they take away your job and blacklist you.

For the past generation or 3 decades, the Berkshires has experienced large numbers of population loss in the thousands. Also, many hundreds of living wage jobs have been lost, and once those jobs are gone, they aren’t coming back in our lifetime. The region relies on a tourism and cultural economy. The jobs are low-income and seasonal.

In Pittsfield and North Adams, teen pregnancies and welfare caseloads double the statewide average. The average worker has little chance of a living wage job with job security. The Boston Federal Reserve Bank gave Pittsfield a grant concerning its inner city poverty. All local students now receive free school lunches.

I believe that the politicians use an economic concept called “perverse incentives” to run state and local government and keep themselves in power forever. To be clear, the more poverty equals the more federal grants and state administered public money for social services, public education, and the county jail. The working and welfare people suffer daily indignities, while the career politicians count their money!

Maybe the career politicians really don’t care about the poor people! However, they do care about themselves!

It’s laughable that folks who didn’t vote for AH feel she has some beholden responsibility to answer especially to them. The losing electorate fails to understand she kicked her opponents’ asses in 2 elections. She has a mandate. She deserves space and time to see it through.

The Mayor is happy that contracts were awarded for the sewer plant because now she can adjust the rates? Everyone have fun paying the new rate, up 50 percent in 2019. The process was not in the best interest of the rate payer. Remember this in November.

Congrats to Pittsfield on the new sewer plant. A construction business out of Methuen has been given the contract, fifty million plus, the cost. One of the parts it will deal with is Aluminum, mainly from the plants chemical treatment of the sewage.New rates are posted in I Berkshires.Gobsigs won’t mind paying, many work for the City. And get raises. Even the School Committee gets a stipend now.

Basically this mayor was voted in by gobsigs, to advance the new school, museum art sale, beaCon,water contracts,et al, when she campaigned on crime, blight. She actually stated to hipsters to come here first and seek employment later.

Ocasio Cortez wants to tax the rich at 70%. The rich will soon be fleeing the country if that was to take effect. Of course it’s to fund the Green New Deal. Wonder if wealthy Democrats will still want to pay their fair share under those conditions?

All the money would of course go to big government and make politicians extremely wealthy. A growing big government will require government workers who will never vote against big government since they are dependent on it. Do you see where this will lead the country? To very corrupt big government since that’s where all the money will be going especially in a country of this size. Government will be extremely powerful and wealthy with all of this tax money. The people will get handouts as governments sees fit to do so, but all the power will belong to big government. Is this really the road this country wants to travel? Just look at all the problems it is causing in France?
