(FORTRESS OF SOLITUDE, THE WEEKEND EDITION SEPT. 27-9, 2019) — The new business courting Pittsfield, Spacely Space Sprockets, tempted THE PLANET for The Weekend Edition. Alas, space provides too big a topic with not enough information, though the early signs are troubling, especially Mr. Spacely’s threat to the city that if The Kapanskis don’t cough up, he’s leaving. Our initial response to this sort of blackmail is “There’s the escape hatch. How about using it?”

Which leaves us The Curious Case of the Washington Whistleblower.

This mystery has Democrats lathering for impeachment and Republicans circling the wagons. If one takes a step back and looks from higher ground, one sees … what, exactly? Washington politics, for sure. Government  dysfunction, certainly. A partisan ink-blot test, yeah. Only  substance seems to be missing.

The evidence leads back to Democrat-friendly operatives looking to strike a campaign two-fer. In pursuing this non-issue, they hope (a) to sink Joe Biden as party nominee, creating the ascendancy of Elizabeth Warren and (b) impeach President Trump.

THE PLANET predicts that (a) will fail — Biden will emerge as the party’s standard bearer — and (b) will backfire. The strong majority of the country doesn’t want impeachment. Biden will win in the end because of his party bona fides. There are enough cool heads in the room to realize a Warren nomination will doom the Dems’ chances in 2020. The country won’t stomach that kind of radical shift to the looney left.

(B)’s reverse thrust will come adults with enough institutional memory to recall the two previous impeachment efforts: the failed impeachment of Richard Nixon and the “successful” attempted coup of Bill Clinton. Nixon had the guts to resign before the inevitable. Clinton prevailed because of the trivial nature of the charges.

The Whistleblower is still unknown, as is the substance of this person’s second-hand contentions, but that has not prevented Democrats from a Limbaugh to judgment.

The Department of Justice has released an unredacted transcript of a phone call between President Donald Trump and Ukrainian President Volodymyr Zelensky. The text was taken down by note takers. The call took place in July from the White House Situation Room. It shows no effort by President Trump to pressure Zelensky into investigating former Vice President Joe Biden’s son, Hunter, in exchange for military aid. This action was falsely alleged by a whistleblower and pushed Democrats on Capitol Hill into an impeachment inquiry.

“There’s a lot of talk about Biden’s son, that Biden stopped the prosecution and a lot of people want to find out about that so whatever you can do with the Attorney General [Barr] would be great. Biden went around bragging that he stopped the prosecution so if you can look into it…It sounds horrible to me,” Trump said.

“I wanted to tell you about the prosecutor. First of all I understand and I’m knowledgeable about the situation. Since we have won the absolute majority in our Parliament, the next prosecutor general will be 100% my person, my candidate, who will be approved by the parliament and will start as a new prosecutor in September. He or she will look into the situation, specifically to the company that you mentioned in this issue. The issue of investigation of the case is actually the issue of making sure to restore the honesty so we will take care of that and will work on the investigation of the case,” Zelensky replied.

“I’m sure you will figure it out. I heard the prosecutor was treated very badly and he was a very fair prosecutor so good luck with everything. You have a lot of assets. It’s a great country. I have many Ukrainian friends, their [they’re] incredible people,” Trump said.

The New York Times reported earlier this year that Biden bragged about getting the prosecutor in question fired under a threat of withholding $1 billion in loan assets for the country. At the time of the firing, that prosecutor was looking into Hunter Biden.

It was a foreign policy role Joseph R. Biden Jr. enthusiastically embraced during his vice presidency: browbeating Ukraine’s notoriously corrupt government to clean up its act. And one of his most memorable performances came on a trip to Kiev in March 2016, when he threatened to withhold $1 billion in United States loan guarantees if Ukraine’s leaders did not dismiss the country’s top prosecutor, who had been accused of turning a blind eye to corruption in his own office and among the political elite.

The pressure campaign worked. The prosecutor general, long a target of criticism from other Western nations and international lenders, was soon voted out by the Ukrainian Parliament.

Among those who had a stake in the outcome was Hunter Biden, Mr. Biden’s younger son, who at the time was on the board of an energy company owned by a Ukrainian oligarch who had been in the sights of the fired prosecutor general.

Everybody who isn’t a Democrat has hostility toward the 4th Estate: The Press/News Media because they are in bed with one party. The way too cozy and friendly collusion between the Democrats and the media is a MAJOR reason for many of the problems we have in this country. That cozy relationship allows the Democrats to get away with far too much.

I think the far left Democrats should explain why they encourage children to call each other comrade, why they want to shut down free speech in this country that doesn’t agree with their far left agenda, and why they want to set up an authoritarian Russian style government in this country by the passage of the ridiculous Green New Deal touted by Lizzie Warren, Kamala Harris, and many other of the far left Democratic candidates.

Five months ago Justin McKennon wrote a blog post on the EMA website about a satellite that suddenly failed in space when it encountered space debris. The blog says they are “currently in the process of developing a facility” to test effects on spacecraft. (The chamber).

“Current openings” of employment opportunities on their website has an ad for an Associate Consultant to be hired in Pittsfield, MA.

I say Justin McKennon is bluffing when he says they’ll go elsewhere without the incentive package.

That “associate consultant” isn’t actually a job at EMA. It’s a job for contract work as a contractor at another company.
EMA is acting like an employment agent. You are a contract employee, for the duration of the consulting.
The company pays $45k but books you at $60-90k.
EMA also lists a few “employees” that are also “employees” of other companies. It’s a trend in some tech companies, whereby it bolsters their numbers, makes the company look bigger, and also lets people pad their resume.
A good example, having a VP of sales or a Director of sales in Europe who is also simultaneously a VP of Sales or Director of sales for another company. Or where your VP of European sales has jumped company to company and is also a new hire. Not because of any real expertise in the specific industry but because they “sell software”.

But let’s take a closer look at the McKennon and Wilson team.
McKennon is essentially a “new hire” he’s only worked for the company EMA for 5 months. Wilson as well, a very recent hire, 5 months with under a years worth of actual work experience outside of working as a research assistant during his education.

Both come from contracting work NTS – National Technical Systems which is a much larger firm in the space tech industry, one that’s ten times larger than EMA.

So what you have here is, two new hires (under six months) one who was so busy building a space empire he’s been a contractor for 6 years, the other who’s not held a “real job” for even a year who in 11 months has worked for two different companies, and this is the face of the Pittsfield Space Empire? This is who Mayor Linda Tyer is going to give $140k, and 60k+ in tax breaks in the first round of funding.
These are the people who are going to run a new “division” of a company? They can’t even source an independent loan or VC funding. They are going to “create” jobs by hiring “associate consultants” to backfill jobs at GD and add in a low level administrative position or two. This is not a space empire led by competent, seasoned business people. This is a space fantasy led by two contractors with barely six years of experience in the industry they are going to build an empire in.

It takes 10 minutes of research to see the pipe dream that this is.
Neither of these people have led even a handful of people, let alone run a division of a company. If McKennon wants to take his space test chamber and run home, so be it. He lives in Pittsfield. Well he has for the last 5+ years. He can go back to consulting if he wants, or maybe he can’t. In talking with someone who works at GD, this project seems to be happening because a contract is ending and this is actually a way for McKennon stay in Pittsfield. Granted he might take his space test chamber show to Albany, but that’s not a bad commute.

These are both smart guys, well educated, but they don’t know how to run a company nor have they been with the company for more than a year combined. This is the company Mayor Linda Tyer wants to invest in? With these two as the people in charge?

Seeking a Slice of Space

Mayor Linda Tyer’s proposal to incentivize Electro Magnetic Applications with perks should be carefully reviewed.

The space tech firm proposes to invest $600,000 in a vacuum chamber in the city, starting with two company representatives, then adding four more employees.

Tyer is throwing out the welcome mat, seeking $140,000 from the economic development account funded initially by General Electric to show the city’s excitement about EMA.

Pittsfield has a remarkably poor record when it comes to such economic development efforts, personified by Workshop Live, the online guitar instruction firm that resided briefly on South Street but moved elsewhere when the public subsidies eroded.

Then there was EV Worldwide which planned to revolutionize the battery industry from West St. The last flicker of power from that startup also went out once the public subsidies ended.

Now Tyer proposes more modest subsidies for EMA, with even more modest benchmarks, notably the hiring of six employees.

While it would be good to have Pittsfield established as “a hub in the emerging space industry,” (per a mayoral announcement), one must wonder if funding from a now-finite account is the best way to accomplish this goal.

Other than attempt to reprogram the economic development funds for private home upgrades, Tyer has been largely hands-off from the resource.

Now it’s up to city councilors to assess the EMA plan, which also includes a phase-in of taxes on the chamber and other personal property.

Aside from the long term prospects of the market sector, it’s clear the city needs clearer benchmarks and the enforcement for such giveaways.

Having been burned before by salesman pitching high-tech plans, city officials should carefully evaluate market potential and whether diverting scant public money makes sense.

Fine research. Also, saying, “Give me a grant for my hypothetical operation or I ask a different municipality” is rather unconventional. A leveraged threat should state “Provide me a grant or I remove my existing operations to somewhere else.”

Trump cheated in real estate, cheated his contractors out of money, has lost a plethora of court cases related to his businesses, cheated on his wives, cheats at golf. Trump’s July 25 call reads like a scene out of the Godfather with Trump in Brando’s role. Attempting to sanitize and hide the transcript on another server? C’mon, let’s get real. You and all your Trump lovers can say what you want, but Trump got caught. Period. And knowing how you all think about Don the Con, maybe you can figure out a way to blame Hillary for all of this. Notice the far left media shows no interest in who leaked this information which is a major crime.

All the cheating you mentioned sounds like a description of the Clinton marriage and their many questionable business dealings throughout their too long time in politics. Yet these are people beloved by many Democrats. Stop the hypocrisy.

The transcript of the phone call authorized for release by President Trump evidences no such pressure or quid pro quo and shows the request to investigate alleged corruption involving Biden and his family was a small part of the call.

The “whistleblower” concedes that his information is based on secondhand knowledge: “However, I found my colleagues’ accounts of these events to be credible because, in almost all cases, multiple officials recounted fact patterns that were consistent with one another.”

“Hundreds of pages of never-released memos and documents conflict with a story that former Vice President Joe Biden has been telling about him pressuring Ukraine to fire its chief prosecutor because he was corrupt, and not because the prosecutor was investigating a company that hired his son, according to a report.

The Hill‘s John Solomon is reporting that the documents — many from the American legal team that helped the company, Burisma Holdings, try to stave off its legal troubles — raise the “troubling prospect” that U.S. officials may have “painted a false picture in Ukraine that helped “ease Burisma’s legal troubles and stop prosecutors’ plans to interview” Biden’s son Hunter during the 2016 presidential elections.

Solomon reported that, for instance, an official Ukrainian government memo shows that Burisma’s American legal representatives met with Ukrainian officials just days after Biden forced the firing of the chief prosecutor and offered “an apology for dissemination of false information by U.S. representatives and public figures” about Ukrainian prosecutor”

What’s worse still about DA Andrea Harrington’s approach to this is that there are dozens of not hundreds of domestic violence cases languishing while she does her book club.

Who exactly is the target audience for this? Existing victims? Will the have time to show up for the readings?
Instead of being innovative and proactive DA Andrea Harrington just copied yet another program with the “book of the month” spoon fed to her.

A much better book that does a historical deep dive, that revisits victims and abusers, is See What You Made Me Do: Power, Control and Domestic Abuse by Jess Hill.
But it would take an iota of thought to actually do something that’s not just copying another DA’s program. Then again Jess Hill isn’t a US author who tweets about trump 4-5 times a day. Jess Hill wasn’t on the Daily Show, so there’s not that progressive cache.

Gamache died. Johnson is on trial for murder. Those are about the only things we know for sure in this entire story.

Campbell admits to shooting Gamache. Campbell then says he lied, it was Johnson. Campbell still pleads guilty to involuntary manslaughter for Gamache’s death.

Lang says Campbell shot Gamache. He says this in a police interview and then to a grand jury. Then he says he lied, Johnson shot Gamache.

Lang’s girlfriend also says Campbell shot Gamache on two occasions to the police. Then she says she lied and Johnson shot Gamache.

The 4th person, Moretti, originally said JOHNSON admitted to shooting Gamache. Now he is stating he lied, that Johnson never said that.

If you were to look up Reasonable Doubt in the dictionary, THIS would be the example given. It’s like Who’s On First.

At this point there is no way any of those jurors should be able to say I believe without a doubt that the man on trial is the man who killed Gamache.

It could have been a one-armed man, by the train, in the rain, in the dark, in the park-ing lot of the Big Y. Maybe Gamache shot himself. Or the weed sellers, Lang and the girlfriend set him up and shot him themselves…

Oh, all all this over a quarter point of weed. Fast forward to today and the five of them could have walked into a dispensary together and walked out with over a quarter pound collectively.

This is a textbook example of creating reasonable doubt by lying.
I think you’ll see this in another drug case coming up. Younger brother, no rap sheet pleaded out, older brother will put all of it on the younger brother and will walk.

Even the police suggested that the witnesses got the wrong person. That coupled with the fact they pleaded to what they thought was just an assault, makes perfect sense.
If you can pleaded down to a short stretch with time served, and think it’s not going to be a murder wrap, why wouldn’t you?
Saves time, prolly better deal than what you public defender would get you at trial. It’s oddly believable.

Also while DA Andrea Harrington has her book club, what’s going on with those dozens of Williams rape cases? In specific, what’s up with Pucci’s client. She was so aggrieved, why isn’t she in DA Andrea Harrington’s office asking for justice? Pucci said he had other people that were raped and contacted him, why isn’t he pushing forward on all those cases for the victims?

I hope that the House of
Representatives impeaches Trump. Let me tell you what will happen next!
1. The House can pass articles of impeachment over the objections of the Republicans, and refer to the Senate for trial.
2. The Senate will conduct a trial. There will be a vote, and the Republicans will vote unanimously, along with a small number of Democrats, to not convict the President. Legally, it will all be over at that point.
3. However, during the trial, and this is what no one is thinking about right now, the President’s attorneys will have the right to subpoena and question ANYONE THEY WANT.. That is different than the special counsel investigation, which was very one-sided. So, during the impeachment trial, we will be hearing testimony from James Comey, Peter Strzok, Lisa Page, Bruce Ohr, Glenn Simpson, Donna Brazile, Eric Holder, Loretta Lynch, Christopher Steele, Hillary Clinton, John Brennan, James Clapper, and a whole host of other participants in this whole sordid affair and the ensuing cover up activities.
A lot of dirt will be dug up; a lot of truth will be unveiled. Finger pointing will occur. Deals will start being made, and suddenly, a lot of democrats will start being charged and going to prison.
All this, because, remember, the President’s team will now, for the first time, have the RIGHT to question all of these people under oath – and they will turn on each other. That is already starting.
4. Lastly, one more thing will happen, the Senate will not convict the President. Nothing will happen to Trump. Most Americans are clueless about political processes, the law, and the Constitution. Most Americans believe that being impeached results in removal from office. They don’t understand that phase 2 is a trial in and by the Senate, where he has zero chance of conviction. Remember, the Senate is controlled by Republicans; they will determine what testimony is allowed — and **everything** will be allowed, including: DNC collusion with the Clinton campaign to fix the election in favor of Hillary, the creation of the Trump dossier, the cover up and destruction of emails that very likely included incriminating information.
They will incriminate each other for lying to the FISA court, for spying and wiretapping the Trump campaign, and for colluding with foreign political actors, especially George Soros. After the Senate declines to convict the President, we will have an election, and Trump will win. It will be a backlash against democrat petulance, temper tantrums, hypocrisy and dishonesty. Even minorities will vote for Trump, because, for the first time, they will see that democrats have spent 2+ years focused on maintaining their own power, and not doing anything at all about black murders in Chicago, homelessness, opioids, and other important issues that are actually killing people. And, we will spend the following four years listening to politicians and pundits claim that the whole impeachment was rigged.
So let’s move on to impeachment.

I believe that Gerry Doyle and Jimmy Ruberto were both big failures in the sad history of Pittsfield politics. The “Doyle debacle” included the signing of the questionable Consent Decree with GE, the birth of the now 21-year-old PEDA, the scandal where millions of taxpayer dollars went missing and was never accounted for, and Good Old Boys barroom politics. The “Ruberto regime” was like one big horrible series of lies! Jimmy Ruberto said he wouldn’t use the Good Old Boys club that gave Pittsfield politics a bad name. But in a short amount of time, it became clear that he was the King of the Good Old Boys! Ruberto said he had a “rolodex” of business contacts, but then hundreds of living wage jobs were lost and thousands of people moved away from Pittsfield during his 8 years of failed “leadership”. Ruberto spent over $2 million from GE’s settlement fund on the downtown Pittsfield’s arts venues instead of using the money for real economic development. On taxes, Ruberto raised annual budgets by 5% per fiscal year, while borrowing a record amount of money. After Ruberto retired, he led a coalition to sell off the Berkshire Museum’s most valuable pieces of artwork, which was very controversial and wrong.

I disagree with the lovely Linda Tyer standing with Gerry Doyle and Jimmy Ruberto on Thursday, 9/26/2019. She is playing into the hands of the Good Old Boys who have ran Pittsfield into the proverbial ditch. It has been stated that Jimmy Ruberto acts like the Godfather of Pittsfield politics. He wants to run the show behind the scenes of Mayor Linda Tyer’s administration. If true, that shows very poor “leadership” by Linda Tyer. May I suggest everyone read the full transcript of the Trump Ukraine call rather than Dan’s small snippet. It reads like something out of the GodFather with Trump telling the Ukranian President he needs “favor” from him, which is to investigate Biden’s son. It couldn’t be more clear that Trump was soliciting help from a foreign leader to advance his own election prospects. I am upset that we have a president that is either so stupid or brazen, that after encouraging the Russians to interfere with his first election, he actively solicited the Ukranian government to help with this election. If you call that a technicality I would hate to know what you think needs to happen to actually be guilty of something.Your response is a classic Trump tactic. Hopefully the fact that McKennon stated on the BB Facebook that if he did not received money from the City of Pittsfield he would go elsewhere should be enough of heads up to vote this down. Any successful business man would know enough to not respond on a Facebook page, especially without thinking responses through. Why is his corporate headquarters not setting his business up? If he is already threatening to leave, will he take the money and the first time something does not go his way, he will stamp his feet and leave? Once again leaving the taxpayers of Pittsfield hanging This GE money should be utilized to benefit all the taxpayers not one person that has a dream. We also need a Mayor that serves all the people, not just a chosen few.

The two people from EMA pushing this deal have worked for EMA for less than six months each.
One of them hasn’t even been working for a year.
McKennon has been a consultant for 6 years and prior to that didn’t even work in the “space field”. Beyond consulting at GD during his EMA “tenure” he was a software “salesman” repping EMA at trade show booths.
Neither of these individuals are principals of the company, they aren’t owners, co-owners, or on any board. They are new hire employees with a total of 6-7 years experience in the “space industry”.
They’ve never run a company, never been responsible for any facilities they’ve owned, have extremely limited expertise in their field, and want to do something “no one has ever done before”.

“No test facility in the world has all these capabilities, let alone in a single test chamber,” EMA states in documents within the proposal.
Maybe there’s a reason for that? If NASA and SpaceX aren’t doing this, maybe there is a reason this isn’t being done?

Seems like a lot of risk for 4 jobs, two of which are entry level administration positions.

You make an excellent point. This kind of thing doesn’t exist anywhere else. Is this literally the brainchild of Justin McKennon? Why has no one / no company ever thought to comprehensively test spacecraft to space storm elements before? Or does it happen in some other fashion?

We know McKennon/EMA has been in the process of developing this testing facility since at least April 2019. What has transpired between then and now to end up as a proposal to the City of Pittsfield in September 2019…?

I agree, but we have a bunch of non- business type people on the CC who will probably not investigate this matter thoroughly.
I stand firmly against throwing Economic Development Funds at a fledgling private business in order to make it appear that our city leadership is making progress in bringing legit businesses to the city. Too many public money throwaways to private companies in this town.
The hypocrisy is that longtime downtown business people like Ramondetta of Nautilus have to fight tooth & nail for free public parking space to be restored, yet the city rushes to throw $140,000 at a startup business offering 4 jobs in five years total.

Not that I can see. Justin’s wife Jill McKennon works for eversource. They bought a $400k home in Pittsfield in 2016 on Juliana Drive. They have one child and would seem to be vested in the community.
Justin May peddle his space chamber elsewhere but it would seem it’s more a way of staying here.
If he gets his space chamber, as his contract ends with GD, he won’t end up consulting elsewhere.
The motivation is not “what’s good for Pittsfield” or what makes sense in the industry, it’s a way for Justin to stay put, nothing more.

As it is Domestic Violence Awareness Month, two of the most common types of domestic violence are rape of a spouse or domestic partner and sexual abuse against a date aka “date rape”.

Considering there were dozens of outstanding alleged cases of rape at Williams and it was a lynchpin promise of DA Andrea Harrington’s campaign, maybe instead of hosting a book club she should be prosecuting those cases. Maybe she should spend a little time reading and brushing up on current case law and get in there and win those cases for the victims.

It’s interesting that most of the complaints levied are Williams College, except those “dozen” or so cases Pucci says he was told about, haven’t been investigated and moved forward.
If there’s about 50 or so sexual assaults a year at Williams College, why isn’t DA Andrea Harrington pursuing these cases?
These “sexual predators”, if left unchecked and not punished – do they plan on punishing them if the are under 25? Under 21?
will only go on to do it again.

Also as Pucci and DA Andrea Harrington have asserted that it was all a failure of Capeless and Caccaviello, maybe she should talk with Lexie Brackenridge and her parents.

What seems to be theme, as is with many of these cases, that DA Andrea Harrington forgets to mention, many of the students don’t bring criminal charges. That coupled with the schools Title IV requirement of maintaining the victims confidentiality, creates this catch-22 of non-reporting.

One interesting quote, “Her parents consulted an attorney. He advised against pressing charges, warning them that a trial would take two years and take their daughter out of college.”
This sadly seems to be the norm, thankfully some progress is being made but I certainly encourage DA Andrea Harrington to use her vast legal experience and knowledge to work with local colleges to increase reporting.

The Bae case was delayed because the victim in question got the remedy of him being suspended, she being able to complete college, then being emotionally and physically ready to testify.

Bae was indicted in 2017, it took two years for the case to come to trial. By her own words she was not emotionally ready to testify until years after the rape, hence the original offer of the plea deal. As she became a willing witness, due to time, therapy, and a change in attitude, a rape case ends up being easier to present. A rape case with no victim testimony becomes a one sided “he said” case.
It was consensual sex”.

Where’s the Pucci case? Why hasn’t DA Andrea Harrington pursued that one? Brakenridge case, well within the statue of limitations.

You take info in the Beagle and weave it into a facile story that you know neither the victim or anyone else is going to bother refuting. You imply you have inside knowledge, despite the fact that if you DO have inside knowledge and think it’s ok to share it on a message board, you are an ethical disaster.

An Adams man was arrested Saturday in an August shooting that claimed the life of 32-year-old Stephanie Olivieri, according to the Berkshire District Attorney’s Office.

Tyler Sumner, 25, faces a murder charge stemming from the Columbus Avenue homicide, said Andy McKeever, a spokesman for the office. Sumner is scheduled to be arraigned Monday in Berkshire District Court.

McKeever said officers with the Pittsfield Police Department arrested Sumner with assistance from patrol units in Adams and North Adams.

Olivieri, of Yonkers, N.Y., was shot once Aug. 25 while sitting in a car on Columbus Avenue. Investigators did not believe that she was the intended target, officials said in the days after the shooting.

More details were unavailable at the time of this report.

NORTH ADAMS — The Berkshire County Drug Task Force raided a West Main Street apartment Tuesday night, reportedly turning up crack cocaine and heroin.

After watching the property as part of a three-month investigation, police executed a search warrant and located Tyler Sumner, 23, who was allegedly in possession of $314 in cash, 23 bags of heroin and 8 grams of crack cocaine.

If sold on the street, the heroin is estimated by police to be worth $160 to $230, while the crack cocaine would bring in about $800.

Prosecutors argued that Sumner has engaged in “consistent criminal activity for years,” referring to his multiple prior drug convictions.

Sumner’s attorney, Glenn Keiderling, briefly questioned if police had substantiated the reliability of confidential informants referenced in the report and indicated he would explore whether the initial search warrant was valid.Sumner pleaded not guilty Wednesday in Northern Berkshire District Court to single counts of class A drug possession, subsequent offense, and class B drug possession, subsequent offense.

Judge Paul Vrabel set bail at $3,500 cash or $35,000 surety.

He is scheduled to appear in court June 22 for a pretrial hearing.

NORTH ADAMS — A Pittsfield man was sentenced to two-and-a half years in jail on Wednesday for assaulting two state troopers in Adams after a routine traffic stop last year.

According to police, Tyler Sumner, 19, of Hamlin Street, was found in possession of an unlicensed firearm and had to be subdued with pepper spray after attempting to fight off two troopers on Columbia Street on Oct. 23, 2013.

Sumner was found guilty of two counts of assault and battery on a police officer, carrying a loaded firearm without a license, possession of ammunition without a firearm identification card, and possession of a firearm without a firearm identification card.

Judge Michael Ripps’ sentencing was in line with recommendations by the Berkshire District Attorney’s Office and Sumner’s attorney Michelle Mechta.

When Trooper Michael O’Brien began a pat-down search of Sumner outside the pulled-over car, he resisted, knocking down O’Brien into the road. Sumner then punched and pushed Trooper Dave McKearney, according to the police report.

After his arrest, police found a Colt .25 pistol containing one round on Sumner. He told police that he and another passenger were members of the Crips gang.

As you will see, as it is approved for posting, this young man has a storied history of violence and drug dealing. His criminal history goes way back to when he was an actual juvenile, 14 and 15 with assault charges culminating in an arrest for assault with a firearm when he was barely 17.
Of course none of it was his fault, his brain was and is still developing. His gang affiliation is just a byproduct of his need for a family and like other experts have noted, this is just a local crime not a crime associated with a larger enterprise of drug trafficking and gangs. This will be the second innocent woman shot in the head, by mistake mind you, by people with known gang ties and a history of violence and drug dealing.

• Under Massachusetts General Laws Chapter 265 Section 18B, an additional criminal charge can be imposed if a person is charged with a felony and was in possession of any type of firearm at that time. If convicted, a minimum prison sentence of five years will be imposed. In the case of a ‘large capacity’ weapon, the prison sentence will be at least 10 years. Additionally, a sentence will be imposed for the underlying felony.

Much ado has been made about why this call was moved to a code worded system and why many calls like it were not.
As it contains the specific names of people of interest and specific names of alleged bad actors in a forgiven government, by law it should be code worded. Code worded and eye only systems and protocols are designed to keep casual eyes off of documents and conversations that might lead to future criminal prosecutions or intelligence actions.

US and Ukraine Treaty doc 106-6, signed by then President Bill Clinton with then Senator Joe Biden voting to ratify contains the following:

Mutual assistance available under the Treaty includes: taking of testimony or statements of persons; providing documents, records, and articles of evidence; serving documents; locating or identifying persons; transferring persons in custody for testimony or other purposes; executing requests for searches and seizures; assisting in proceedings related to restraint, confiscation, forfeiture of assets, restitution, and collection of fines; and any other form of assistance not prohibited by the laws of the requested state. Susan Rice admitted yesterday that even Obama would put calls in such a system. By that treaty signed by Bill Clinton, President Trump was completely within his rights to discuss potential criminals matters.

More troubling is an action by the State Dept. done secretly to change the Whistle Blower laws just days before the release of this report otherwise the Whistle Blower account would not be legal at all. This raises serious questions about what is going on in that department.

I amend the above. It seems the change in the Whistle Blower Act was made sometime between 2018 and the present and was done in secret. This CIA agent and more than likely other spies were in the White House during that time and have been trying to get something on the president all this time. This change in the Whistle Blower law would cover all their bases. So while the Russian collusion investigation was going on which shifty Schiff assured us he had solid information that the president was guilty, they also had this “insurance policy” investigation going on in the White House.

There is obvious pressure from Trump to do a “favor”. He asks this in the paragraph after Zelensky asks for Javelins which the Ukrainians need to stop the Russians. Trump does not define the favor which means either he doesn’t know what it is or both parties know what it is. The request for a favor coming immediately after the request for assistance is a threat. Trump goes on to elaborate that an investigation should begin against Biden and that Zelensky should coordinate with Guiliani and Barr.

There is a benign explanation and an corrupt one of this exchange. The corrupt one is fully explained by the Democrats -Trump is using US national security to improve his election chances. The benign explanation is that he is trying to reduce corruption in a country where the US has strategic interests. He wants to see investigations proceed of hacking by Ukrainian in the 2016 election (Zelensky’s prosecutor general believes this) and corruption with American citizens one of which happens to be Hunter Biden.

There are many facts in the whistle-blower’s report that the Democrats will either confirm or dis-confirm over the next few weeks. We will see which explanation they support.
