PLANET VALENTI NEWS AND COMMENTARY

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION JUNE 11-13, 2021) — Scraping off the barnacles of items left in port for the overhaul. It’s one of the regular duties of maintaining THE PLANET, with far more stories than there are photons in the type case.

MACD CALLS OUT D.A. — In a scathing June 9 letter to D.A. Andrea Harrington, the Massachusetts Association of Criminal Defense Lawyers blasteded Harrington’s actions to remove Judge Jennifer Tyne from a case. The MACD called Harrington’s action “indefensible and unethical,” condemning “[t]he egregious nature of your conduct.” MACD called on Harrington to “voluntarily report your actions to the Board of Bar Overseers.” The association also “demanded” that she “make public all communications related to this matter …”  Here is the hot link to the full texts of the MACD’s letter. DA Harrington Letter

SPEAK UP, MADAME MAYOR — That’s what Ward 4 councilor Chris Connell wants in light of the silence from Pittsfield officials about the rash of shootings in recent days. Connell will be filing a petition asking Linda Tyer to address the council and the city on her plan to eliminate the gun violence. Plan? She doan need no stinking plan.

BURKE’S LAW — Harrington’s attempt to remove a judge from a case has backfired in her face like an exploding cigar from Ballantine the Great’s Joke Shop. Amanda Burke provided excellent coverage and followup in the Berkshire Eagle. THE PLANET often serves as unpaid ombudsman for when the local daily blows it, and we are likewise bound to acknowledge journalism that makes a difference. Nice work, AB.

D-DARK — Is THE PLANET alone in wondering why we didn’t see one mention of D-Day on Monday? The 77th year of WWII’s seminal event slipped by virtually without notice. As Vegas says, the venue was dark. Sad, that.

MESSAGE FROM THE 5th DIMENSION: Our Monday column brought about a good discussion on America’s crest direction with respect to race and justice. Here’s the best pushback, from our long-time good friend Mr. Kltpzyxm:

“There are few good intentions behind these measures, only a form of “restorative justice” that through blind hatred threatens to corrode the very freedoms that once set the USA apart and ahead of other nations.”

The good intentions are legion, not few. The motivation is not blind hatred, it is the desire to get it right in moving our civilization forward. What sets the USA apart from other nations is not only freedom of speech but also the ethical stance to get it right. As for Boogie, the existence of extreme cases on the left AND right are fringe elements that do not contribute to our advancement as a civilization.

Justice is indeed restorative — but left to its own devices it just doesn’t get the job done. It requires the tweaking of thinking individuals who have the best interests of humanity at heart.

We agree with Mr. K. The good intentions aren’t “few,” but neither are they “legion.” THE PLANET also grants that the motivations include the desire to “move our civilization forward.” Likewise, we endorse the notion that extremity on left and right “does not contribute” to “the ethical stance to get it right.” Mr. K is also correct: “Justice is indeed restorative,” but “doesn’t get the job done.” Precisely the point, which makes THE PLANET‘s argument.

The fault lies not in the stars but WITHIN US. The “tweaking” Mr. K suggests might have good intentions, but it does NOTHING to correct human nature. To pretend the forced and instant social engineering will accomplish the goal once again places all the marbles on the assumption that people will do the right thing. They won’t, no matter how much cultural “reform” the do-gooders do.

What’s the answer? It’s too easy. Jesus told us: “Love one another.”

It’s too difficult.

NICK THE QUICKTHE PLANET received lots agreement with our analysis of Nick “200 Hours” Russo’s singlehanded. destruction of downtown North Street. “200 Hours” got $33K+ for less than two months work after the usual “nationwide search” and a huge dose of nepotism. Do you want “200 Hours” on the city council? Then again, maybe you want a lad who can pull down 200 hours each week. Workaholic, baby.

IT’S NOT HER FAULT — After sending an e-mail confessing her hate for white people, Alexandra Oliver-Davila, chair of the Boston School Committee, resigned after a growing backlash, including from the city’s acting mayor. Of course, this being 2021, the woman played victim defense: “I am being targeted as a Latina gender studies professor who teaches about racism, patriarchy, and oppression,” she wrote. “Because of the harassment and overwhelming stress from School Committee-related work, my mental and physical health has deteriorated, so I need to resign and recuperate.” So there. It’s not her fault.

THE CLAPP — Our spies tell us that the $$$$$$$$$ “renovation of Clapp Park has backed up, literally. The toilets won’t flush. They fill up and overflow. Also, the fancy cement pond/spalshpad doesn’t work. Plubming underneath is screwed up. Another great job, Pittsfield.

Have a great weekend, everybody.

If they didn’t tell Harrington that it was The Rules Of Professional Conduct they were citing in the letter, she would have spent a solid week trying to figure out WTF they were talking about.

Nice job Nipples, ya boob! You screwed up more cases without even being in court. That’s gotta be some incompetence record.

whiners. They don’t want any kind of social justice reform because it cuts into their super bloated paychecks. The fewer low-level offenses that DA’s offices won’t prosecute, the more DA offices across the country work on ways to prevent crime by stabilizing communities, the more these defense lawyers huff and puff. It’s hard when you can’t buy your second home or big boat.

Oh, so you’re concerned about the violence in Pittsfield? Then I would recommend complaining to your state representatives and do nothing Governor about leaving the Berkshires high (literally) and dry as far as resources for drug addiction and poverty. But somehow the DA’s office is supposed to make it all happen with no money or resources. Other areas DEMAND their state give them money. But nope, not here. Instead, we come onto website message boards, spout a bunch of really inaccurate information and whine about things. Cool cool

What’s going to put an end to the violence in Pittsfield, is what Rudy Giuliani did in NYC. The “broken window” theory of policing.

For the next couple of months, PPD should team up with the State Police CAT (community action team), and stop everything that moves and arrest all felony law breakers. Make Pittsfield feel like Nassau NY, does to people. I’m sure many guns, drugs, and felons, will be removed from the streets. I bet it will also be quiet.

Plus, a tough on crime mayor and prosecutor are needed. No more pandering to Shirley Edgerton, and her ilk. The POC (people of color) are doing the shooting, drug dealing, and committing the violent felonies. Systemic racism has nothing to do with this spate of crime. It’s weak leadership, a soft on crime DA, and a police chief who seems way over his head, He’s a nice guy, but I could give two rat’s asses what he did on Obama’s 21st century policing commission. Something I wouldn’t brag about. Considering Obama was the one who started the war on cops (Beer Summit) and politicized the DOJ-Michael Brown case. Brown’s DNA was found inside of the officer’s cruiser, showing he was inside the cruiser attacking the officer, according to Holders DOJ report. Just to remind the TSC’s of the Planet.

Instead of vibrant, dynamic, and inclusive, Pittsfield’s moniker should be, “No More.” But, I’m sure Mayor Tyer, DA Wrong Way/Decision, will some how find money to give to Shirley Edgerton, so she can continue her preaching her racism about white people and how they are the root cause to every POC problem. Not poor parenting/absentee parenting, welfare abuses with multiple children by multiple father’s, and lack of education, to name a few. This has zero to do with it, as far as Tyer/Wrong Way/Edgerton/Farley-Bouiver-Country-Buffet (D)/Hinds, believe. It’s all white people’s fault. Does Shirley ever talk about her families drug dealing past? Curious if her teachings ended it for those family members? Or maybe a stint in state prison did? I’d love to hear the answer to that question.

I’m not kidding. We are severely under-resourced and underfunded in the Berkshires. Why are their 10,000 nonprofits consistently trying to make up for the lack of resources the state won’t provide us, with our tax money?

And yes, well-funded towns have more stable communities and less crime. Kind of like where you live, Dan,

It’s more a matter of criminal behavior.
The two you mention did those things and they were crimes.
In the case of the DA unless she’s planning on changing careers and wants to be a criminal she shouldn’t violate the law.
I mean I’m comfortable with calling her actions criminal. It’s going to be interesting when she is disbarred, that’ll be a first in Berkshire County.
First female DA, first sitting DA to be disbarred, first DA to be prosecuted, first DA to lose her drivers license, first DA to be put in Tax Title. First DA to unit judges, lawyers, former prosecutors, head of the ethics commission, all agreeing she’s an incompetent idiot.
She’s creating quite a legacy.

Dear readers,

Let Planet Valenti be the first place that I announce my run for Ward 2 City Council. I am nearing the end of the first step which is gaining recognition on the ballot, and I welcome the opportunity to introduce myself to you.

Who am I?

I am married with one daughter, two cats, and a dog. (Animals both wild and domestic are a large part of my space.) I returned to North Adams in 1998 ending the exodus of my father’s family that took place in the 1950’s. I moved to Pittsfield in 2010. I began my life in the area as an artist selling crafted paintings on the road circuit. It was hard labor consisting of craft, framing, procurement of materials, and the heavy work of carting one ton of display materials and finished goods across the East Coast. I grew weary of that work and turned to Graphic Design and programming. I also spent several years in hardware retail and joined the core staff of Carr Hardware in Lee. That work taught me much from operating heavy equipment, providing 200 gallons per week of propane to Old Castle Quarries, and retail. Currently, I am the bookkeeper and purchasing agent for Vermont Violins which specializes in violin manufacturing, sales, and rentals.

I am proud of each and every job which I had held from a short tenure at Home Depot, the craft circuit and lastly accounting for a violin business. All work is noble, and no one holds a higher purpose than to provide sustenance and shelter to family and to be able to look after one’s neighbor. Beyond the drive to work, I am driven by concerns about the strange business that flows through City Hall and the problems that threaten to divide our community. Like so many, I have made the trek from a young progressive demanding Social Justice to understanding the need to consider all the tradeoffs and costs of social undertaking.

My campaign is the result of many years of frustration, looking in at processes and decisions that frequently feel wrong and do not resonate with Common Sense and our fundamental principles of what is good for the community. I share amazement at the mind-boggling use of our hard earned money. Since the shooting in 2014 that began the community discussion of youth violence, I maintain that nothing has happened to either reduce it or even understand its source. Further, our streets have become the practice space for outlandish engineering experiments to reward private interests, and the business districts are turning to rubble. There is no evidence that City Hall has concern for downtown residents who live in the growing blight, businesses that struggle with impossible traffic and emptying storefronts, and the fact that zero value is provided for our tax dollars.

I will hear the needs of Ward 2, listen to all the people who live there, and be respectful of the interests of the city at large, and I will not be swayed by private interests. That’s a promise that I do not take lightly. I put my reputation on the line for you.

Sincerely,
Charles Ivar Kronick

MA:

Short answer: not my first act in office.

This question demands careful thinking. Demanding a forensic audit without knowledge or information could be the quickest route to spiking any future investigation should one become necessary. That is, a poorly framed investigation may result in lack of confidence for future ones.

Forensic Audits, as I understand them, are need driven and based on evidence of inappropriate behavior. One should have documented evidence of misappropriations, extortions, embezzlements, or other financial misbehavior. Lacking those, an audit could become or perceived by the public to be a fishing expedition that lacks purpose and is also prone to challenge.

Thanks for the question – not easy and important.

This is why we check to see who got the contracts, any/all and build an airtight case for an audit, red flag it all – we need to put our minds together. I would be surprised if the “200 hors a week” isn’t enough to call for an audit. We don’t need to interpret it, a Judge does – Motion for injunctive relief- in the form of transparency-via mandated audit.. The guy from the Wayfair announcement is Tyer’s family member. An MCAD case was dismissed because of this relationship- someone organize a committee please – time is of the essence, Any of the ARC people casually connected to any other agency like, MRC, a client of SHIP for 12 years & they haven’t provided any service – how much money do they get to have a client? NO SERVICES RENDERED.

My opinion really is independent. A forensic audit is designed to gather evidence for a legal case. At present, there is no legal case, but if such a case actually arises I agree that it does become needed. At this time, the idea is ahead the game. What is needed is a comprehensive independent audit that covers all accounts and the entire budget to be conducted by an external firm not connected to any city employee. JOKE ALERT! Is there one in Texas?

I hope this clarifies my position.

Most of the council was in favor of a forensic audit. At least that is what they said. None of them mentioned anything about a legal case when they answered that question. Except for White who is terrified of reprisal from city hall.

Hello Patrick Fennell,

Did you know that I agree with a lot of what you write about in politics from mostly rural Berkshire County, Massachusetts to under the shiny Golden Dome that sits atop the Beacon Hill Statehouse in Boston, to the Swamp’s Capitol Hill (or K Street Extension) and the Oval Office in the White House? Your writings are inspiring to me, despite the fact that we have different political views.

I listen to all sides when it comes to politics. I do not believe just because a politician is on my side that he or she is doing the right thing(s) for the people they are supposed to be representing. I believe the U.S. economy is heading towards the proverbial iceberg or cliff (Nilan) of inflation, big government, economic inequality, record debts, and so on. If the K-shaped recovery/recession is bad news right now for the bottom 98 percent of the U.S. population in 2021, then just wait until the Stock Market tanks later this year or next year in 2022.

The government and its ruling elites or career politicians are supposed to be investing in the people they are representing to give the working class families an economic and financial incentive to live a middle class lifestyle. Obviously, this is no longer happening from Great Barrington or Pittsfield, Massachusetts, to Boston, to the Swamp, and nearly everywhere else in the U.S.A. We live in the era of class warfare (or structural conflict and violence – poverty, jobless, homeless, pollution, political corruption, etc.) where most of the economic and financial gains go to the very top one to two percent of the U.S. population’s wealthiest people and the corrupt career politicians, while nearly everyone else is falling behind. This is NOT the American Way or American Dream, but rather, it is what happened in Germany prior to Hitler’s rise to power around one hundred years ago.

Wednesday’s, June 9th, 2021, vote by Beacon Hill lawmakers to advance the Millionaires surtax happened without them holding public hearings and relying on public policy studies explaining the net benefit of raising state taxes on Massachusetts nearly 20,000 millionaires? Beacon Hill lawmakers keep saying it will bring in between $1 billion to $2 billion in new state revenue per fiscal year, but they are not accounting for the costs to small businesses, investments, and the like. The net state revenue benefit may end up being zero or even in the negative! Also, when politicians vote to raise taxes on the people they are supposed to be representing, they should lead by example and cut their own public pay and perks by at least 50 percent.

On Donald Trump and most of the Republican Party’s BIG LIE about the stolen 2020 presidential election, why didn’t they prove their case in a court of law by now? If Trump and the Republican Party leadership had a case, then I believe that they would have litigated it by now. I believe that the swing states Trump lost to Biden were due to the minority populated cities in Atlanta Georgia, Philadelphia Pennsylvania, Detroit Michigan, and Milwaukee Wisconsin. Trump spent over 4 years disparaging minorities, and as a result, the minority voters in the aforementioned swing state cities voted for Biden over Trump. That is the real reason why Trump lost the 2020 presidential election to Biden.

I do not believe that career politicians care about anything but staying in elected office for life. When politicians retire from elected office, they collect their taxpayer-funded pensions and perks, and then they become registered lobbyists where they make 6-figure salaries or sometimes even higher selling out the very taxpayers they used to represent. When a little guy like you or me writes to our ruling elites, we either get cookie cutter form letter responses or no responses at all.

The fact is that the only winners in our K-shaped U.S. economy are the corporate and ruling elites. That means that little guys like you and I are all losers in the proverbial game of big government and big business. We are being sold out by big government and big business no matter if Donald Trump or Joe Biden is in the Oval Office, and all we can do about it is pound sand – or nothing at all but us being manipulated by the powerful for us little guys to be divided so they can continue to conquer and control all of us with their hot air.

In closing, I hope you see that you and I are on the same side, despite us being divided by the powerful for their own collective gain and our collective loss. I am a student of history, and it has always been divide and conquer so the powerful can control us, while we pay for their many excesses and means to run the system for their own gain and our loss. The people always fall for it century after century as far back as their have been Oligarchs and the people whom the Oligarchs rule over. Why do so many people always have to lose for the powerful to always win? The answer is that because we are divided instead of being united.

Best wishes,

Jonathan Melle

President Trump’s speech full text 6/6/2019

https://nypost.com/2019/06/06/read-trumps-tribute-to-veterans-on-the-75th-anniversary-of-d-day/

“President Macron, Mrs. Macron, and the people of France; to the first lady of the United States and members of the United States Congress; to distinguished guests, veterans and my fellow Americans:
We are gathered here on Freedom’s Altar. On these shores, on these bluffs, on this day 75 years ago, 10,000 men shed their blood, and thousands sacrificed their lives, for their brothers, for their countries and for the survival of liberty.
Today, we remember those who fell, and we honor all who fought right here in Normandy. They won back this ground for civilization.
To more than 170 veterans of the Second World War who join us today: You are among the very greatest Americans who will ever live. You’re the pride of our nation. You are the glory of our republic. And we thank you from the bottom of our hearts………”

“But I remember the story about a fella who was running for office as a republican. And he was in a rural area that wasn’t known to be a republican area and he stopped by a farm to do some campaigning.

And when the farmer heard he was a republican his jaw dropped and he said wait right here while I go get Ma. She’s never seen a republican before. So he got her. And the candidate looked around for a podium from which to give his speech.

And the only thing he could find was a pile of that stuff that Bess Truman took 35 years trying to get Harry to call fertilizer. So, he got up on the mound and when they came back he gave his speech.

And at the end of it the farmer said that is the first time I’ve ever heard a republican speech.

And the candidate said that’s the first time I’ve ever given a republican speech from a democratic platform.”

They did not create the initial event that required a response.
The fact that a sitting DA violated the rules of procedure and violated laws regarding ex parte communication is what started this.
It’s the DA’s incompetence that made that letter necessary. She has communicated information about pending cases, without getting the OK from the defendants and their counsel.

They asked her to self-report, and are rightfully notifying all parties involved.

Remember back when Mazzeo sent out those cards stating how violence was on the rise in Pittsfield and was lambasted because nothing like that ever happens in Pittsfield?

Luckily that idiot that was firing the gun on 1st couldn’t shoot anything but his own hand. Thank god he didn’t seriously hurt himself as I am sure he was a family man, working on his GED with the ultimate goal of becoming a doctor, registered gun owner, and didn’t do nuffin.

I really do worry about the families and kids that live in those neighborhoods and wish the Mayor would come out of hiding to address those families that helped her win that election.

Even if Mazzeo was rightfully screwing the taxpayers out of tax $$$$$$$$$$$$$ instead of Tyer screwing the taxpayers, Machine gun Jesus Lugo still would have been riding shotgun on the hood of a car speeding down Linden St. with an uncooperative unnamed female at the wheel. Apparently allowing machine gun Lugo to ride atop the hood of her vehicle while he pelts houses with bullets is not a criminal offense. I only say this because the reporting on this wild in the ghetto gunfire event did not indicate that machine gun Lugo’s moll was also arrested. At the very least, for reckless driving.

Well, I appreciate the notoriety. But I do believe that left to our own Adam Smith devices, the market — or in this instance ethical behavior — would too rarely see the light of day. Dan is exactly right — loving one another is too difficult. But that is also my point — we have to be tweaked in the proper direction or civilization goes awry. If we let our fellow citizens fall by the wayside, all boats will not rise, and if all boats do not rise, then where will the other boats be when we need their help? It is a positive, optimistic, message: 人之初性本善 humanity is basically good — we just need a little help, that’s all.

Adam Smith’s economic theories pertain to principles of individual pursuit of happiness which is a universal human right and we all respect it by virtue of common sense, i.e., you don’t have to prove it. District Attorney Andrea Harrington issues the following response to concerns recently raised by some defense attorneys regarding a letter she addressed to Chief Justice Dawley about the treatment of victims and prosecutors in the local courts.

“I understand that being in a public position requires that I accept criticism, and I am listening. I have a responsibility to do what I can to stand up for victims of crime and ensure public safety. I spoke out in this instance out of deep concern for victims of domestic abuse and gender-based violence, whom our larger justice system has often disempowered and disregarded.

While I disagree that this was improper ex parte communication, I understand the concerns raised by the MACDL and CPCS about the separation of power. As a former MACDL member and former state public defender, and I am sympathetic to their frustrations.

I remain committed to working in good faith with those in the legal community.
Additionally, some local defense attorneys have recently publicized their concerns about our prosecution policies.

When I ran for this office, I understood that I was challenging the long-term status quo in Berkshire County and that those who benefit from the existing local power structure would push back. The same thing is happening to my colleagues in jurisdictions across the country who are using the position of the elected district attorney to spearhead justice reform.

I accept that significant change can bring discomfort, tension, and conflict.

I am proud of the changes we have made, particularly around eliminating cash bail to ensure due process does not come with a price tag. Individuals credibly accused of violent crimes are represented by counsel at dangerousness hearings when a judge ultimately determines their pretrial incarceration status. We make these requests in only 3% of our cases.

This is a major innovation and a much fairer process than using high cash bail to detain people pretrial.

Our open discovery and formal Brady policy demonstrate my commitment to fair prosecution. We opt for treatment over jail for those with mental health or substance use needs, and we avoid overly prosecuting low-level cases.
Since I have taken office, the Berkshire County Jail and House of Correction population has decreased by approximately a third and is predominately comprised of people who have committed or are credibly accused of committing violent crimes and firearms offenses.

I am hopeful that the local justice partners most accustomed to a traditionalist approach to prosecution will come to recognize that this approach can reduce crime, ensure the safety of victims, and provide the necessary medical treatment for those with substance use disorder. Collectively, we can create a more humanizing and fair justice system.”

Hahaha she’s so full of crap. The ENTIRE legal community sees through this.
She couldn’t win because she’s incompetent, so incompetent she still doesn’t understand what ex parte communication is.
Although she likes to string together the progressive talking points, none of what she has done has been remotely effective.
Even worse is the stunt she just recently pulled has jeopardized cases and has brought such disrepute to the DA’s office she’s destroying the community’s trust. All the decision makers have told her she’s wrong. She has violated the law.
It’s another Nipples “why me”. She is painfully stupid, was not a great student, has had no meaningful legal experience in all the years after she’s graduated law school.

You are what you have always been, a liar, bereft of any ethical center, and an “ineffective counsel”.

So, with your “open discovery,” policy, may I request that you let the readers know how many personnel hours in state police detectives and district attorneys, were wasted at Simon’s Rock College, in Great Barrington.

To refresh your memory Andy….I mean Pittsfield Pride, that was the case were the black female illegally/criminally filed a false police report, when she reported “white guys,” “kidnapped her,” and wrote “racist graffiti,” throughout the campus. Remember?

The DA said the case is closed. She didn’t file charges on the black female…..but a man who burned hay away from people/structures was held on a dangerousness hold…..interesting in her “bringing changes,” to the justice system.

So, getting back to my question. Will your office release those figures? I’m curious the amount of tax payer money that was wasted on that hoax? I’ll do an FOIA, if that’s what it takes?

From the BE:

A board representing the state’s largest organization of criminal defense lawyers has written a scathing letter to Berkshire District Attorney Andrea Harrington, calling her attempt to have a district court judge removed from the bench “an indefensible and unethical effort to circumvent fair process.”
In the letter, the board of directors of the Massachusetts Association of Criminal Defense Lawyers said it was “deeply concerned” about Harrington’s effort to “undermine the independent decision-making of a sitting judge by engaging in an ex parte communication with the Court about pending cases brought by your office.”

Ex parte communication is when one party communicates to a judge directly about an open criminal case without including the other party. The letter contained information about several criminal cases, including an open murder prosecution.

A local defense attorney whose client was referenced in the letter has said he was upset the district attorney did not alert him about the communication.
In a statement issued late Friday, Harrington said she is “listening” to the criticism, but denied that the letter amounted to “improper ex parte communication.”
In May, Harrington wrote a letter to the chief justice of the district court system, Paul C. Dawley, claiming that Judge Jennifer Tyne posed a “significant threat to public safety,” and asked that she be barred from presiding over criminal cases in the county. Her complaints against the judge ranged from “dangerous rulings” to “hostile treatment of victims and prosecutors” in the Berkshire District Attorney’s Office.

Dawley reviewed audio from cases Harrington cited in her letter and concluded that there was “no factual basis” to support her claims of judicial indiscretion.

This week, the deputy chief counsel for the Public Defender Division of the Committee for Public Counsel Services, which provides legal representation to those who cannot otherwise afford it, said Harrington’s missive was “concerning and dangerous” and “sends a message to other judges that they need to fall in line or else face an attack on their livelihood.”

In her response Friday, Harrington said she “understand[s] the concerns raised by the MACDL and CPCS about the separation of power. As a former MACDL member and former state public defender … I am sympathetic to their frustrations.”
“I understand that being in a public position requires that I accept criticism, and I am listening,” she said in the statement. “I have a responsibility to do what I can to stand up for victims of crime and ensure public safety. I spoke out in this instance out of deep concern for victims of domestic abuse and gender-based violence, whom our larger justice system has often disempowered and disregarded.”

Harrington said this week that she stood by the content of her letter, adding that she is content knowing top district court officials are aware of her concerns.

The letter from the lawyers association, which was dated Wednesday and signed by Victoria Kelleher, the president of the organization, said that Harrington had many other options for voicing objections to Tyne’s actions, including a motion to recuse, an appeal, or a complaint to the Judicial Conduct Committee.
“Your letter to the Court was instead an indefensible and unethical effort to circumvent fair process, barred by the Rule 3.5 of the Rules of Professional Conduct, which prohibits any lawyer from engaging in ex parte communications during the pendency of a case.”
The lawyers association concluded the letter by making several requests: “We ask that you voluntarily report your conduct to the Board of Bar
Overseers, and that your office recuse itself from all matters which were the subject of your ex parte communication.”

“We further demand that you make public all communications related to this matter or any other effort on your part or that of your office to initiate ex parte communications about a judge’s conduct in a pending matter.”
In her statement, Harrington did not address the recusal request from the lawyers association, the request that she report herself to the oversight board, or the demand to make public all ex parte communications about a judge’s conduct.
“I remain committed to working in good faith with those in the legal community,” she said.

Harrington sidesteps what she is being accused of by focusing on what she and other far left District Attorneys were spread across the country to accomplish. Harrington would get rid of the police in this area if she could, but she knows that most locals wouldn’t tolerate such a dangerous move on her part. She does celebrate other so-called justice reforms she has accomplished. Her answer to the charges is more like “Whoops, I won’t do it again”. It’s amazing that she has to be reminded about the separation of powers so it makes it sound like with Biden in office, Democrats think they can do as they please.

Is Joe Biden trying to start World War 3 with Russia by calling Putin a KILLER, and touring Europe telling the people there that he dislikes Putin? Let me explain that the U.S. Government makes billions upon billions of dollars every year for decades on end by selling and exporting U.S. military weapons to the world’s countries. Our main competitor for arms sales during the Cold War post World War 2 was the Soviet Union or Moscow, Russia. When the Soviet Union dissolved in the early 1990s and the Russian economy collapsed and they lost their global market share in arms sales. During that decade, the U.S. Government took Russia’s market share in arms sales, and our economy and Wall Street boomed during the Bill Clinton administration in the 1990s.

Putin took over Russia’s government for about 2 decades now (since May 7th, 2000) and will probably be in charge for around another 15 years in the future where he uses his autocratic power in Moscow, Russia to rebuild Russia’s military and exports of arms to the world. The humanitarian crisis in Yemen and the political conflicts in the Middle East region has not stopped the U.S. Government from selling arms to oil rich countries there. In fact, then President Trump said that if the U.S. Government did not sell arms to Saudi Arabia to stop the proxy war in Yemen, then Saudi Arabia would just turn around and buy the arms from Putin.

The U.S. Government’s number one non-farm export is arms sales to the world. The U.S. Government has built a military industrial complex in all 50 states since the end of World War 2 in 1945, and the U.S. Government has fought military conflicts for decades on end and most likely for decades into the future. The U.S. Government’s military industrial complex’s arms sales exports is being challenged again by Russian President Putin. Joe Biden calls Putin a KILLER and tells the people of Europe that he dislikes Putin before Biden and Putin will meet next week on June 16th, 2021 in Geneva, Switzerland. The U.S. Government’s continuous military conflicts and arms sales have resulted in the deaths of millions upon millions of foreign people since the end of World War 2, as well as contributed to humanitarian crises such as the one in Yemen. Joe Biden should look at himself in the proverbial mirror when he calls Putin a KILLER and tells the people of Europe that he dislikes Putin. I don’t know for sure, but I would guess that the U.S. Government’s military industrial complex or war machine has killed millions of more foreign people since the end of World War 2 than the Soviet Union and now Russia’s military industrial complex or war machine.

In mid-March of 2003, President George W. Bush invaded Iraq against international laws, which Joe Biden voted for in the U.S. Senate. Iraq has the second largest oil reserves second only to Saudi Arabia. Bush came from a Yale University Skulls and Bones wealthy political family with a long history in the Texas oil business. Eleven years later, in March of 2014, Putin invaded Ukraine and took possession of Crimea against international laws. How is the U.S. Government right to illegally take over or control Iraq’s second largest oil reserve fields in the world, while the Russian Government is wrong to illegally take over or annex Crimea from Ukraine? Just because the U.S. Government is a democracy under Joe Biden, while the Russian Government is an authoritarian dictatorship under Putin does not make the U.S. Government right and the Russian Government wrong when it comes to violating international laws.

In closing, both Soviet Union/Russian and the U.S. Governments fought together against Adolf Hitler’s Nazi Germany’s military industrial complex or war machine in Europe – and for good reason, of course. But after Hitler was defeated, the Soviet Union/Russian and U.S. Governments went onto build their own respective war machines with tragic results for millions upon millions of foreign people who were killed by the the Soviet Union/Russian and U.S. Governments’ respective military conflicts – or at various times proxy wars because neither country wanted to see the world nuked if Moscow and Washington, D.C. fought each other in direct military conflict during the decades-long Cold War. Now, in 2021, we have Joe Biden calling Russian President Putin a KILLER and telling the people in Europe that he dislikes Putin. What is Joe Biden’s end game next week on his June 16th, 2021 meeting with Putin?  I ask once again, is Joe Biden trying to start the Third World War with Putin?

Trump kept the peace. But no, you voted for Dementia Joe, whose behavior at the G-7 has been mocked & ridiculed. World leaders know he is Obama’s weak, pathetic puppet.

Have you heard of the Abraham Accords? You know, Trump’s Middle East peacekeeping policy which shut out the Palestinians and kept the Arabs & Jews from killing each other?

Putin behaved himself while Trump was in office. Now that Biden’s in office, he’s on the move again, attempting to overthrow his neighbors. Obama’s “don’t cross this line” threats went largely ignored by Putin and now that sock puppet Biden is in charge – Putin will ignore Biden’s hollow threats as well.

All the education in the world cannot correct a flawed world view such as yours.

Word on the street, Harrington was notified that she is being investigated by the Board of Bar Overseers.
She either found out late last night or this morning, no need to self-report anymore, she lost that option.
This will be a licensure issue and may be a criminal investigation as well.
She made national news today.

Andrea Harrington Berkshire County District Attorney closed a “minor human trafficking” investigation – “based on not being able to meet the criminal statute of limitations”. (The United States as a country doesn’t have a statute of limitations on minor human trafficking).

The letter is void of any useful information and as empty headed as Harrington. Here’s my take.
Harrington was as unqualified for the position as anyone could get. She didn’t know how to manage anyone having never managed anyone. Harrington had no relevant legal experience although she overinflated the minor amount that she did have. Her experience in public office was on the school board. Harrington had in fact a trifecta of inexperience that didn’t have to end this way. She could have listened, learned and collaborated. Perhaps she could have exhibited humility and self awareness with others in law enforcement and the legal community. At the very least she could have put a stop to absurd claims she made during her campaign that people are being jailed unfairly based on race. Berkshire county is over policing over prosecuting and over punishing black and brown people. That lie is what Harrington ran her campaign on and she has been trying to back it up ever since.
Rather than listen, learn and collaborate Harrington didn’t do the first thing to understand what the DA’s job entails. She hired mostly political allies many without relevant experience. She managed even the competent with fear and toxicity and many have left. Then she chose as mentor Road Rage Rollins. Even if she even asked Rollins opinion on this latest stunt Rollins probably advised her to go hard full bore. Surprised anyone?
The truth is, Harrington is a deeply flawed person with no evidence of a value structure. It’s quite clear to anyone around her that the force that drives her is self aggrandizement.
All of this was bound to bring about her own downfall.
If Harrington is “listening” do you you wonder if she will learn anything from this? Don’t get your hopes up. She has no track record of that and she certainly doesn’t have anyone in the DA’s office who could give her sound advice. That, again is no one’s fault but her own.

So how in the world did she get to be the DA? Who would support such an inadequate candidate and more importantly, why? What was the end goal?
And whomever they were, can they ever be trusted again to nominate a candidate for any important office affecting so many people about such important issues?

It’s because you don’t have to have much inside your head to be able to vote, and the spins given by the biased MSM during election years are geared toward the gullible and easily influenced.

Look at the Mudslingers who run the local “news”paper. They are a little left of Chairman Mao. But they will eat their own given a reason, or it fits their purpose/agendas. Case in point here.

Also because certain political parties and politicians are so entrenched that there is little hope for qualified outsiders to get on the ballot.

mASSachusetts is a prime example. When was the last time PITTSfield had a decent Mayor? Or western mASSachusetts a decent US Senator or US Rep?

Silvio Conte was the last of a dying breed.

I have noticed that if there is a major crime incident or incidents that occur in Pittsfield the posting on the Pittsfield Police Blog is not posted that day. She must also edit the negatives out of the Pittsfield Police Log. Maybe this explains why nothing else is getting done in this City by Mayor Sneaky Linda. Maybe she still does the work of an Administrative Assistant yet gets paid a Mayor’s salary.

First, Pittsfield is the only City/Town that raised their budget this year. Raises were given to most City of Pittsfield City Hall workers. Raises were around $5,000 each and in Michael Joseph Taylor’s case it was $7500.00. Not a bad annual raise for staying home for a year and neglecting taxpayers. Among the many behind the scene payouts, look at the payout to Bike Lane Nick, even though he denied he was getting paid and more importantly taxpayers did NOT want these bike lanes. Sneaky Linda added more nicely paid positions to work with equality. With all this handout in monies, wondering why Pittsfield does not have a Clerk of Works. This is a position that is desperately needed by this failing City. There is not one project in Pittsfield that is not totally screwed up in this City. Clapp Park splash pad, not even opened for 24 hours before it breaks. Would it not be a pleasant surprise if our Sneaky Mayor would just communicate and be honest about the issues rather than have social media decide what the cause of the closure is! Our new not needed Taconic High School which had to have air conditioning. Guess what taxpayers, the air conditioning no longer works. Most street signage in the City is missing or lying in the roadway. Since the City decided to own their streetlights instead of letting the electric company own them, the maintenance is non-existent. Grass is not being trimmed on roadways and City owned properties, garbage gathers on these properties. Roads have been dug up for repairs yet the City never comes back to repair the road. In fact the City does not seem to complete any task they try to perform. Potholes are still existing, why? There seems to be absolutely no checks and balances in this City whether it be budget wise or construction wise. Does Sneaky Linda hold a weekly department head meeting and hold her department heads accountable for their department? Does she ever give them a deadline to clear up the messes in their department? This type of meeting is held in the private sector weekly. Or, I believe the best answers to my questions is Sneaky Linda and her puppets just sit back and collect their nice paycheck, almost free health insurance and look forward to their City pension. This also includes the City Clownsil. What a waste of taxpayer money, that is why the City needs to get rid of these positions, get a Town Manager and a Clerk of Works. First order of business for them should be a forensic audit.

City infrastructure crumbling, out of control crime, bums on every corner begging and camping in city parks, gangs and drugs, no chicken in every pot but every road with a pothole, wasted money at Clapp Park, water rates going up, moronic traffic designs………….that don’t matter at all!!! Proposal opens the door to sell deteriorating Mount farmhouse to Lee, Lenox

“The proposal to sell the farmhouse to The Mount will be on the agenda of the annual Town Meeting in Lee on June 24, and the Lenox annual meeting June 29.”

“We have a keen interest in seeing the farmhouse preserved and restored,” Mount Executive Director Susan Wissler wrote in a letter to the Lee and Lenox boards and to Lee-Lenox Chief Administrative Officer Christopher Ketchen.”
“Since the towns are willing to work with us now, I would put everything else on hold so we can close this deal,” she pointed out.

A preliminary appraisal values the 135 Laurel Lake Crossroad property at $335,000. Based on the final negotiated sale price, each town would split the proceeds.”

So if the towns are splitting the proceeds and the Mount is buying and paying for the renovations, the headline makes ZERO sense.

“Wissler has estimated the cost of renovation at close to $1 million. She would conduct two fundraising campaigns, the first over 60 to 90 days to acquire the house and, later, the second for the restoration, potentially with partial support from the taxpayer-supported Community Preservation Act.”
