ADD 1 SEPT 28 p.m. — As THE PLANET predicted down to the last dotted “t” and crossed “i” the Boring Broadsheet pretended it had uncovered news of the Clairmont-Mazzeo lawsuit settlement. We had it almost two days before the local daily. One of the paper’s newbies, Matt Martinez, was saddled with the thankless assignment.

As we also Nostradamus-ed, the BB did not give THE PLANET credit for breaking the story. That’s a professional courtesy they have never given for any of the countless times we’ve scooped the pathetic rag. Call it professional jealousy. Just more embarrassment for the paper, as it continues its death watch over dwindling circulation.

Our newsroom spies also said that John Krol was spotted at the paper today, “conferring” with Kevin Moran, Meg B-M, and Linday Hollenbaugh. Our source said Judge “Free ’em Freddy” Rutberg joined in via phone and hogged the “discussion.” Our source described it as a hostile encounter, with the paper doing the browbeating. Watch for another Eagle hit piece on Krol.

The paper is running interference for someone(s) for some rea$on. Will the truth ever emerge? All we can say for sure is that there’s lots of fear surrounding the whole sordid mess. Think about it. The lone local daily, whose job it is to act as the Fourth Estate, complicit in dirty politics designed to take the focus off of the real issues that face the city — taxes, city spending, failing public schools, lack of private investment, decaying infrastructure, rise in crime and drugs, influx of undesirables, lack of public safety, clogged roadways, and so much more.

It’s part of Team Marchetti’s strategy to keep the focus off of such problems, since their boy Pete, with a citywide post for 16 years including council president, has his name stamped all over the decay.

Marchetti has abetted the horrible lack of attention that has allowed Pickeflield to become the laughingstock of the Commonwealth. That alone makes him a poor choice for the corner office.

(FORTRESS OF SOLITUDE, LONG WEEKEND EDITION, SEPT. 28-OCT. 1, 2023) — It’s been a rough week for mayoral candidate Peter Marchetti. THE PLANET‘s Right Honorable Good Friend, council president, and The Suits’ favorite bagman reached this morning for the Preparation H to soothe his aching muscles from the rigorous stumping the night before, but mistakenly, he took the Ben Gay.

This explains the unusual report of Pete belting out a loud version of Johnny Cash’s “Ring of Fire.”

The good news: At least he knows Johnny Cash is not a pay toilet. That Picklefield’s smart council president, sharp as a bowling ball, to quote Foghorn Leghorn.

Pete’s committee — headed by Sgt. Shultz, which had “nothing, NOTHING” to do with the Eagle‘s hit job on mayoral opponent John Krol — might want to use the song as Marchetti’s official campaign theme.

Now on to less serious matters.

To the Boring Broadsheet, the hit job keeps on giving. They ran another story Wednesday.

Meg Brittany-Mehlisch (BM) wrote: “Krol has not disputed the accuracy of  [t]he Eagle‘s [original] story.” Actually, Meg, Krol has “disputed the accuracy of the story” from here to eternity.

We might add that the Eagle has not disputed the accuracy of THE PLANET‘s stories laying out the truth of the case, namely, that Marchettian fingerprints, though not Pete’s, have been dusted by Hemlock Holmes and been shown to be all over the dirty tactics.

BM’s summation story of Wednesday leaves out important details. Evidently, BB editors did not have enough news hole to present to full story. Fortunately, THE PLANET, which scooped the paper on the settlement of Barry Clairmont’s lawsuit against Melissa Mazzeo, has way more photons than the BB.

When BB executive editor Kevin Moran sent his invitation to both candidates Sept. 20 at 8:11 a.m., he wrote: “The sit-down would be an hour or so. It would be filmed for broadcast on berkshireeagle.com and it would be covered in paper.”

When the Eagle released the forum, however, it was chopped, doctored better than Kildare with title cards paraphrasing questions instead of the actual images and voices of Eagle personnel being shown and heard on the tape. Two questions come to mind:

  • Why hide the faces and voices?
  • Why edit the tape so severely?

To gain any credibility, the paper must issue the complete, raw tape.

Here is the full text of what Krol sent to the newspaper with respect to the [pick one] “banking error” …  “embezzlement” [ED. NOTE: We have not published the attachments, because they list account numbers and other sensitive information]. It has not been published anywhere else:

As I have said, this episode was the result of mistakes all around and not bad intentions.
It’s become clear as to what happened, and the evidence backs the truth that my intention was to have these payments come from One Eighty Media. In fact, the documents show undeniable proof that I most certainly believed the payments were coming from my checking account for One Eighty Media.
Now having time to do the work and gathering appropriate information, we have learned several things.
1. On November 12, 2018, I entered the member number for One Eighty Media into the online portal to pay American Express. The payment was made and it seemed to have cleared. This was done to properly have these business expenses paid for by my business, as I clearly intended. Previously, it was being paid through my personal checking account (0000000 in the [Greylock Federal Credit Union] GFCU series of payments attached file: GFCU series of payments)
See attached file AMEX1 showing the payment that was made and then returned. 
2. Later on November 12, 2018, I received a notification that this payment was not accepted because the number was not valid. American Express requested that I provide the proper banking information. This is also noted in the message from GFCU and in the GFCU series of payments. Attachments: GFCU series of payments, GFCU MESSAGE 9-26-2023
3. This is where the March 2015 email from the GFCU associate becomes 100 percent relevant. As I sought to rectify the invalid account number, I referenced the email which incorrectly provided the Animal Dreams account number instead of the One Eighty Media account number. (**this is the first time that I have been able to confirm that this email, in fact, provided the Animal Dreams account number after being able to compare the account number from the email and the account number used for the AMEX card shown in the GFCU series of payments), Attachment: GFCU associate email providing AD checking # instead of One Eighty Media.
I will forward the actual email to you, and you can request it formally from GFCU as it seems to have originally been sent from their secure service. Further, the conversation includes Stacey incorrectly stating that it’s the wrong number – not the Animal Dreams number. Stacey was incorrect. Based on the information I received today from GFCU, this is exactly the Animal Dreams account number.

In addition, I’ve requested any and all records of conversations between representatives of Greylock and myself during this time period between Nov. 12, 2018 and Nov. 15, 2018 to tie up any other possible loose ends, including any recorded conversations with associates that may be available.
**To be clear, I never had any working knowledge of the Animal Dreams account number, never had access to the checkbook, never had any online banking access to that account, and quite simply, never had any direct financial dealings with this non-profit. My name was simply on the account as a favor to Stacey Carver who requested it. Clearly, the associate made an error in providing an incorrect number associated with my name at GFCU.
**Further proof of the fact that I believed this was a valid number for my One Eighty Media business is that I forwarded that same email from the Greylock associate about a year later to my accountant at the time, Barry Clairmont (barryc@lckcpa.com). Mr. Clairmont was both my personal and business accountant at the time. This email was sent to him on March 3, 2016 to follow-up to his request for the account number information as it was needed for tax filing, the payment for the state’s annual $456 fee for small corporations (S-Corp) and to file an extension.

4. There most certainly was enough in the One Eighty Media checking account to cover the payments that were made at those times. During this time period, I was winding One Eighty Media down from a full-time business and clearing debts, as I had started a new corporate position with Benchmark Senior Living in January 2019.
5. For the first payment of $209 on Nov. 15, 2018, the balance in the OE checking account was $6492.42 – attachment: 2018 NOV – ONEEIGHTY MEDIA BALANCE
6. For the second payment of $500 on 12/24/2018, the balance in the OE checking account was $5847.15 – attachment: 2018 DEC- ONEEIGHTY MEDIA BALANCE
7. For the third payment of $2750 on 2/14/2019, the balance in the OE checking account was $3211.69 (again, please note that I was at this time working full-time for Benchmark Senior Living, and winding the full-time work for OneEighty down) – attachment: 2019 FEB- ONEEIGHTY MEDIA BALANCE
8. For the fourth payment of $3000 on 3/4/2019, the balance in the OE checking account was $5961.70 – attachment: 2019 MAR- ONEEIGHTY MEDIA BALANCE
9. For the fifth payment of $370.58 on 3/8/2019, the balance in the OE checking account was $5507.70 – attachment: 2019 MAR- ONEEIGHTY MEDIA BALANCE
10. For the sixth payment of $39.19 on 3/25/2019 the balance in the OE checking account was $3967.08- attachment: 2019 late MAR- ONEEIGHTY MEDIA BALANCE
11. GFCU did message me today confirming the information regarding the AMEX payment – and the wrong number associated with the One Eighty Media business account – attachment GFCU MESSAGE 9-26-2023

I will reserve judgement and wait for the Eagle to do a thorough review since they have the statements and it looks like Dan isn’t going to take the time, but I will say this:

According to the above, by the time he went to make the $370.58 payment, he had already theoretically made payments totaling $6,459 from the account but he says there was $5,507.70 in the account when it actuality it should have been minus $951.30 if the $6,459 had actually been deducted from his account.

So it begs the question; if it was a mistake, why didn’t he wonder why the balance in his OM never seemed to go down.

Maybe I’m misreading this. We’ll see what the Eagle says.

“Any questions” Krol asks? You betcha. Why did you input your wrong checking account number into the Amex portal to begin with? In fact, why were you paying Amex that way and not paying your Amex bill directly from your Greylock business account using Greylock’s on line bill pay? Why did your Amex payments fluctuate so much each month during this time? What was the actual amount due each month during this time? Were you paying the minimum or another amount? did it require balance to be paid in full monthly? What were your monthly expenses that caused your payments to rise so much? Let’s see all your Amex statements for the time in question and your business and personal Greylock statements for the time in question, so we can see what was really going on. The fact is you inputted the cat fund account number into Amex’s pay portal multiple times to make multiple payment’s totaling over 6,000 dollars for your alleged business expenses and you got away with it because your name was on the cat account, and had Stacy not called you out on it you would have skated on it. You were winding down your business you say yet paid over 6,000 to your Amex business account with charity dollars and yet your own Greylock business account never dropped the 6,000 and you know it and knew it, and you said nothing. You sir are not fit to manage a lemonaid stand let alone a city.. you are either crooked or incompetent or perhaps both. You couldn’t last two rounds in an interrogation room with me buddy.

So a couple questions still are not answered. If he had the money he says he had and wasn’t overdrawn, which it actually looks like he was twice [he only shows ending balance not carried balance at date of transaction]
Why couldn’t he immediately pay back the money? By his own statements he should have be able to easily pay the $750 [not wait weeks] and if he’s being truthful he should have been able to easily pay off the debt of $6,800 immediately.

What this seems more like is the Krol Kash Shell Game.
He had way more debts than cash, he was paying some debts with a credit card, some with personal money, some with business money, but floating the payments and debt.
He needed to other Kat Kash account to help him with the floating of debt. Too much debt coming in at once messed up the shell game and he needed another funding source.
Has he paid Harris back the $6,100?

I am a single person, with one Greylock member number, attached to two business accounts.

Twice I have made a cash deposit at the drive thru, given the teller my member number and the proper business name, and the money was deposited into the other business account.

A simple mistake, “Because that’s the one that came up first” when they went into the computer. (Even though I verbally specified the business name).

I can very easily see how any person looking in the computer to give someone their account number could relay the wrong number, by accident.

Marchettis campaign is portraying him as the second coming of Jesus Christ. It is becoming on a par with a Saturday Night Live skit. The guy does not come close to the picture they are trying to paint of him. It is beyond insulting that they think the people of Pittsfield are that damn gullible.

A year from now he will be giving us that shit eating grin of his on a video telling us he had to raise the taxes another 8 percent due to unforeseen expenses that he no way of knowing were coming down the pike. Guarantee it.

I’m still not buying it. Let’s do some math.

In item #8 in Dan’s article, John says he had $5,961.70 in his account at the time of the $3,000 withdrawal. If you take that balance and subtract the $3,000.00 payment, the $2,750.00 payment from item 7, the $500.00 payment from item 6, and the $209.00 payment from item 5, you have a negative balance of $497.30. So he didn’t really have the money if he used his account for all the payments.

You can conclude that it isn’t his fault because the bank balance is higher, fine, good point. Bit consider this…

Wasn’t Mr. Krol recording these transactions in his accounting software? If he was, his software would have told him he didn’t have enough money. Didn’t he wonder who the previous payments didn’t clear the bank?

He points to Carver’s bad bookkeeping. What about his own poor or non-existent bookkeeping?

He said in one of his video’s that Greylock was famous for making this type of mistake, giving out wrong account numbers. Let’s say that is true. Ask yourself, would you ask an organization that is famous for giving out wrong information to provide you an account number? Where is the logic in that? Wouldn’t you just go look at one of your checks, or even better, log-into your Greylock account and look at the number yourself? Where is the self-accountability?

His explanation only makes sense to the financial illiterate.

Either way, this isn’t a guy I want running the City.

It’s everyone else’s fault but his own.

I think it’s also important to note that Krol states his business had debts. Have they been totally cleared up? Does he have any other outstanding debts business or personal? He refuses to share his financials which Marchetti has already done. Why is he not being transparent, which he claims his administration would be? He has stated he wants to be Pittsfield’s “watchdog.” A pretty tall order for someone who can’t manage their own finances!

It could mean a lot of things and this is why the full account statements are needed.

It could be related to fraud, lack of filing by Krol for the needed paperwork [that doesn’t normally get you a court ordered dissolution], by agreement during a bankruptcy, by agreement during a divorce, by agreement from a civil case/lawsuit.

It’s not rare that it happens but most of the reasons are not good.

Since Krol is listed as the only officer of the corp, things like death of a partner or principal in the corporation isn’t one of the reasons.

I know he pleaded economic hardship to Harris, meaning he didn’t have the $6,100 to pay back AD. So based on that I’d guess some money issue forced the court to intervene.
Did Krol file for bankruptcy.
It’s another question that he should answer.

One of the options, The Renovation, said it would use a lot of the existing structure suggesting the pilings are sound. This is just going to be another big dig for the Berkshires . Its overkill for the amount of use it will get. There is no flood mitigation. The grandstands will be high and dry but the rest of the lot will still flood. And then there is the reputation of taking care and responsibility of public property in Pittsfield, which is terrible. I have wondered since the grandstand first closed and if the pilings were sound if an easier less costly fix would just be replacing the bad girders and i-beams. Thats all thats under the stands. A skeleton of girders and beams.

So after 8 years of Marchetti and Tyer the North street business owners are asking new mayoral candidates for help fixing a long existing problem? Whatever is glaringly wrong with this picture?

First of all is speaks loudly that Tyer and Marchetti failed miserably after 8 years and millions of dollars of doing what? It looks like they spent enormous sums of money and time and made it worse than it was before they came on the scene. That much is quite clear.

And secondly, and weirdly, they are seeking solutions from a mayoral candidate that was city council president for a very long time and had great power to effect change but did not? And if he was unable or unwilling to help before, what has changed that he might be able or willing to help now?

And does all this seeking solutions set the table for the taxpayers to pony up another 5 to ten million dollars to FIX IT? Is this just one more boat sinking iceberg headed the taxpayers way? Is constantly reinventing North street a money laundering operation?

I remember, Trapper! It used to be a beautiful city with lots of great stores and easy parking. What took the downtown merchants so long to speak up? Or have they been complaining the last 4 years? The traffic pattern with the bike lanes and crazy line markings is nothing short of confusing. I was glad when Karen Kalinowsky petitioned to put the bike lane issue on the ballot. Installing the parking meters was the worst thing the Tyer administration could have done to the downtown, which was already struggling to attract customers.

Concerning the mayoral candidate who the local news is all in on promoting to be the next mayor.

This wedding venue has been bought and paid for sometime in advance, they will go forward with the marriage because they don’t want to lose their down payment on it.This is even well before the Krol questionable financial issues came to light ,which should be scrutinized. I’m not giving the Gavel Man a pass on his past and current leadership that needs to still be front and center.

If only there was a mechanism to hold a mayor accountable in Pittsfield. If Mr White gets the gavel, as he has been promised, it will be same shit different day in Pittsfield with the tax man chasing us all up the tree again. There has been zero oversight from Marchetti and there is zero reason to believe White will bring anything of the sort to the dais. He is baked into the special interest agenda and will do what the other Pete did….keep his head low and his mouth shut when it comes to challenging any mayoral spending storm. May already have been in discussions about how the 30 million will get to 55 million for the ball park. Soon we will be hearing about the 30 million that will be needed to put diagonal parking on North street (30 mil for openers) could be more if the price of road paint goes up.

Remember when Harrington got caught commingling funds? Guess who was the treasurer in that debacle? Just take a wild guess.

PITTSFIELD — Two accounts related to District Attorney Andrea Harrington’s inauguration and campaign committees were flagged this month by the Office of Campaign and Political Finance for running afoul of state campaign finance law.

The office’s review looked at the Berkshire DA’s political finances during 2020 and found failure to comply with Massachusetts law governing inauguration funds, which are known as segregated funds, due to the commingling of money between her campaign committee and an inauguration fund.

“Harrington told The Eagle that Berkshire Bank put the money into her inauguration account by mistake, adding that both accounts went by the same name. “It was my intention to put the funds in the campaign account but the bank [sounds familiar] put the funds into the inaugural account,” said Harrington, adding that she was not looking to lay blame.” Who was the bag man making the deposits? Guess.

Yes, these berkshire banks do not use account numbers, but adjectives and the like.

I absolutely will not vote for Marchetti. He has had many years to separate himself from the steady demise in this City and he opted to be part of the fabric that has destroyed every inch. No way will he get my vote. City Hall and City Council need a clean sweep

The Berkshire Eagle website lists their “ethics advisory board”, and a member of that advisory board is John Bissell CEO Greylock Federal Credit Union. The Eagle states that journalists should “take responsibility for the accuracy of their work” and “verify information before releasing it.”
