(FORTRESS OF SOLITUDE, MONDAY MARCH 24, 2025) — Mayor Peter Marchetti’s initiative to ban people from standing in the medians of major roadways, the “Median Safety and Pedestrian Regulation in Public Roadways,” sets up an interesting political situation with respect to the mayor himself and the city council.

Will the mayor stick to his guns, and will the council ignore the protests?

The proposed regulation drew a horde of angry citizens stirred up by the rabble rousing of Berkshire Interfaith Organizing.

As quoted by WAMC‘s Josh Landes, “This ordinance feels like its goal is to make the most marginalized and the most delicate invisible by making it impossible to panhandle, by making protests impossible, by standing in the way of being heard,” said clergyperson Margot Page, the president of event co-organizers Berkshire Interfaith Organizing.

THE PLANET might ask “clergy person” Page what page is she on? She speaks of “the most marginalized and the most delicate invisible,” but who, exactly, are we talking about? Criminal aliens? The mentally ill? Junkies and druggies? Layzees and Gimme guys and gals?

Philologically, use of the word ‘marginalized” prompts a query: Why are they “marginalized” and why not Mary Jane and Joe Kapanski? The answer: “choices.” A person’s choices define their outcomes as people. For the “marginalized” and The Kapanskis, the former made bad choices while the latter made good ones.

Two people go to school. One drops out and the other gets a degree. Two people become adults. One chooses to party and the other chooses moderation. One indulges and one does not. One plays video games and the other gets and holds a job. One relies on government to pay their freight and the other pays their own way.

In Loon Liberal meccas such as “official” Bitchfield, the prevailing philosophy has been to grow government and spend ever-growing fortunes on social services. The “marginalized” greedily gobble those services. The Kapanskis pay for them.

Now Marchetti’s proposal won’t change much, but even as a symbol it’s well worth passing, which sets up the compelling political situation THE PLANET mentioned earlier.

And the measure, if passed, will be symbolic anyway. In his interview with Landes, Marchetti said about enforcement: ” … you get a warning the first time, and then you get on a fine structure. If they don’t pay the fines, they don’t pay the fines. I had a conversation with one councilor, you know, will it be reported to a credit bureau ruin their opportunities later? I don’t see that as something that we would be pursuing.”

Consequently, the deadbeats populating busy intersections will keep on doing what they’ve been doing. A more proper response would be to fine. If the fine is not paid, a call is made to the credit bureau. Consequences.

Tonight (Monday) at 6 p.m. the council’s committee on ordinance and rules (O&R) gives the mayor’s proposal its initial hearing. You can bet that Page and the other organizers will make sure their meal tickets, i.e. the “marginalized,” will show up in force to intimidate the five councillors with sob stories about “class warfare on the poor” and red herrings about “free speech.”

Will councilors act with common sense, or will they buckle? In the O&R heat will be

Something for THE PLANET‘s Right Honorable Good Friends to think about: The measure doesn’t ban panhandling. It addresses a dangerous public safety situation at a limited and specified number of city intersections.

Will the Fab Five approve the measure with a recommendation to the full council to adopt it into law, or will they fold faster than Myron Florian’s accordion?

Will it be “The Honeymoon is Over, Gladys” or “I Don’t Want Her, You Can Have Her, She’s Too Fat for Me?”

Of course the sub committee will cave to the will and pleasure of the Mayor. Agree with the Planet totally, the panhandlers are mentally ill, junkies, druggies, alcoholics. For me I’d rather see the council live up to the oaths they took to preserve, protect and defend the constitution, but don’t hold your breath for that. It boils down to the biblical thing teach a man to fish and you’ll feed him a lifetime, give him a fish and you’ll feed him a day. Government can’t solve all of our problems. But, calling it a public safety issue is cowedly at best

These are all the exact same Pittsfield politicians who voted to give Pittsfield’s marijuana millionaire Nuciforo a FREE CASH city pot permits settlement check for the amount of $341,000, which is akin to around 55 Kapanski’s annual tax and fees payments to City Hall.

This is the same Mayor Peter Marchetti who increased city spending by over 5-percent, residential property taxes by over 7-percent, and city fees by 8-percent in fiscal year 2025.

If I spoke to these hypocrites tonight & tomorrow night, I would tell them that Nuciforo, along with Petricca and other Pittsfield millionaires, are the real panhandlers. I would also remind them that Mayor Peter Marchetti will soon be proposing a record high city operating budget for fiscal year 2026 that will start in over 3 months on July 01st, 2025.

I don’t think any person should be allowed to be in a median for any reason. That’s why we have SIDEWALKS and CROSSWALKS. The council needs to be addressing the high property tax,pickpocket tax and enormous water rates. Back in the day my parents said the panhandlers would be charged with loitering.

The solution is simple. STOP GIVING THE BUMS MONEY!!

If people quit “feeding the wildlife,” they will move on to greener pastures. If you can stand for hours holding a sign begging for money at an intersection, you can sweep a parking lot, clean a $hitter, paint a park bench, or remove rats and other vermin from city property.

As I posted over the weekend, Lumpy Marchetti could end the racist DEI department and use 25-30% of that budget and get these bums working and earn their money. Plus, the city would get cleaned up in more ways than one.

You can want to clean up the city from the undeniable fact that begging, let’s call it what it is, makes intersections unsafe and makes others uncomfortable. It doesn’t mean marxhetti hates the homeless or the less fortunate. Agreed many of the homeless are choosing this path and I do not feel sorry for many of them. Get the people out of the roadways. It is simply not safe for anyone and will lead to someone being badly hurt and possibly open the city up to a lawsuit. Next thing people will lobby for is to compensate the beggars if they lose the right to beg in the streets. Let’s give them cars and healthcare too.

Marchetti and White are literally contributing to the homeless problem in Pittsfield so it is going to get worse by the day. The runaway reckless spending with no effort to cut waste will surely push taxes to the point that some amount of elderly on fixed incomes will not be able to keep up with their taxes and lose the very homes they lived in all their lives.
You cannot defend the practice of cutting taxes for the wealthy and raising them for the lower income folk. It is just mean spirited.

This entire thing is just more weird than normal. The best example of how to handle panhandling / or unsafe use of a median is right out in front of PHS in the form of a black fence.That seemed to solve the “kids playing frogger” problem back 10 or 15 years ago.. Why an ordinance? Why all this attention? The City could just as easily and quickly and quietly put up similar barriers like PHS around town where the panhandlers tend to hang out for a hand out… Why not a fence around the perimeter sidewalk of park square, in the name of “keeping demonstrators safe from getting hit by passing cars”? and similar pieces of fencing on the medians elsewhere. If not fencing how about some of those small round bumps in the median surface- those are uncomfortable to stand on. Anyone ever been to the Las Vegas strip? Ever try to sit on something on the Las Vegas strip? You really cannot because that is how they have designed it- to keep em’ moving along in the name of safety. This whole ordinance thing smacks of a smokescreen to camo something else that might be going on in City Hall or Mercer- or??? It smells like a distraction. Is it just to stop us from talking about the school issues or rising taxes or the potholes…or something worse? This seems like a new bright shiny object to chase. THAT is what should be looked at- the why- Why now? Why this? Who is pushing this-anyone? And, what else might be coming?

Without consequences, as you stated Dan, it is a meaningless exercise to spend time on this issue. Similar to dog ordinances – when dog owners are handed a ticket because their dog is off-leash in a city park, and the fine is ignored by the owner – there’s no “bite” to the leash ordinance. Hopefully they’re smart enough to pass this common sense ordinance. Josh Landes protest argument doesn’t make sense. People will still be able to protest at Park Square. They must stay out of the road and off the sidewalks. Nobody pays any attention to them anyway. No one should give money to the panhandlers. Here’s a typical food pantry and meal week in Pittsfield, Monday-4 pantry’s open,6-8 open daily the rest of the week.2 breakfast, 2 lunch, 1 Dinner sites on Monday, Every day is like this Tuesday-Thursday 3 Breakfast Sites per day, 1 or more lunch sites daily too.Monday- Sunday minimum of one Dinner site open. The panhandlers are trying to feed there addictions, don’t be enabling them.

PITTSFIELD — It’s back to the drawing board for the mayor’s proposed median safety ordinance.

The city’s Ordinance and Rules Committee voted 4-1 on Monday evening to file the proposed Median Safety and Pedestrian Regulations in Public Roadways, meaning it will go back to the City Council for review but with the recommendation to shelve the measure.

The decision came after 21 Berkshire County residents spoke out against the ordinance during public comment, citing concerns about its potential impact on panhandlers, constitutional rights violations and a lack of evidence for safety concerns.

“I feel [the ordinance’s] impact will fall on a homeless and low-income residents who use medians to seek assistance,” said Barbara Mahony, a Pittsfield resident. “Instead of this proposed ban, the City Council needs to explore less restrictive, more constructive solutions to address pedestrian safety.”

The ordinance, proposed by Mayor Peter Marchetti, states that every pedestrian has the right to use public ways in Pittsfield (except where it’s expressly prohibited), but there has been “an increase in public safety issues relating to pedestrian use of and entry into the public roadways identified herein.”

Panhandling has become a growing concern in Pittsfield, with many residents voicing frustration over being approached by people asking for help.

However, a series of court cases at the state and federal level — including a 2020 case that struck down a panhandling ban in Fall River — have determined that penalizing individuals for asking for money violates the First Amendment.

In 2023, Marchetti introduced an ordinance banning people from standing on certain median strips unless crossing the street. The Ordinance and Rules Committee referred it back to the mayor in 2024, and the new ordinance was proposed in January.

The updated ordinance would prohibit pedestrians from walking along an adjacent roadway when there is a public way (sidewalk, median, crosswalk, center traffic island or safety island), using a public way to disrupt traffic flow or endanger themselves/others, getting within 5 feet of a vehicle on the road or standing, sitting, or lying down in public ways “with the intent to obstruct or hinder the free and safe passage of pedestrians or motor vehicles.”

These regulations would apply within 100 yards of the intersection of West and Center streets, East and First streets, South and East Housatonic streets and all intersections at Allendale Shopping Center and Park Square.

Opponents argued the measure was an attempt to criminalize homeless and poverty, rather than address pedestrian safety.

“If you care about safety, focus on infrastructure and lower speed limits,” said Elijah Mertinooke. “This is obviously targeting the homeless.”

Others pointed to the lack of data proving that there is a safety crisis at these intersections.

Meg Bossong referenced the the Berkshire Regional Planning Commission STEPS Comprehensive Safety Action Plan report, noting that “none of the intersections that are identified in [the] ordinance are actually identified in that report as being the most dangerous in Pittsfield or in central Berkshire County.”

“The stated purpose of that grant (that funded the report) was create a toolkit for the city in this field and for cities in the county to make data driven decisions about traffic seeking,” Bossong said. “There is nothing in that entire report about panhandling, and one of the main recommendations is to create more medians and safety islands for people to stand on.”

Councilor Patrick Kavey also noted that passing this ordinance without data showing that these intersections are prone to pedestrian related crashes could put the city in a jeopardizing legal position.

“The number of communities that have lost in court over this issue is pretty astounding, and I’m seriously concerned that if we were to pass this, we would be sued,” Kavey said.

The Rev. Joel Huntington warned that with the 5-foot buffer zone between pedestrians and traffic, the ordinance could effectively ban public demonstrations in areas such as Park Square without a permit.

“Sidewalks are a public forum. This ordinance pushes protests into the park, which then requires a permit,” he said. “How many times have we had protests that needed to be done quickly?”

However, one of the main concerns raised during the meeting was how this ordinance would impact the most vulnerable members of the community.

“[By] criminalizing homelessness and poverty, all you’re going to do is make it harder for the most vulnerable people in our city to access … services,” said Michael Hitchcock, co-director of Roots & Dreams and Mustard Seeds. “What you’re doing is pushing them further to the side, where everything will be dangerous and more frightening for the people who are already feeling in fear.”

Councilor Dina Lampiasi also took issue with the vague wording of the ordinance — specifically the sections prohibiting pedestrians from sitting, standing or laying down in public ways “with the intent to obstruct or hinder the free and safe passage of pedestrians or motor vehicles,” arguing that it may lead to unequal enforcement.

Ultimately, the committee voted to file the ordinance, meaning it will move to the City Council without a recommendation to approve.

Only Council President Peter White opposed the motion to file, citing public safety concerns.

“I don’t want to see anyone prosecuted for hitting a pedestrian who steps into traffic because these strips are so small,” White said, adding that he supports revisiting the issue with a better-crafted ordinance in the future.

Mayor Marchetti defended the intent of the proposal, insisting that it was not crafted to target panhandling.

“There’s a lot of misinformation. This was about safety,” Marchetti said, referencing a past fatality on West Street as an example of the city addressing roadway dangers.

To the editor: I think it’s really sad that Pittsfield Mayor Peter Marchetti is attacking the “have nots” in Pittsfield.

His new ordnance, presented at City Council this week, will prevent people from standing on certain street corners hoping for the odd dollar from passersby. (“A proposed ‘median safety’ ordinance draws backlash from Pittsfield residents who say it unfairly targets panhandlers,” Eagle, March 21.)

I think if and when the Council votes down the Median ordinance a new subcommittee should be formed.. Every Councilor who voted against this ordinance would be on it. They would meet on Friday nights. Their main purpose would be to find the panhandlers employment. Local employers could send job openings to the Committee to be filled.Local cops could send them the daily beggars list. That would be the opposite of Enabling which is truly what’s going on.
