ONE.

Have the Sox Found Their First Baseman?

SHAW NOT RAW: Travis Shaw went 4-for-4 last night and is now batting .371 (23-for-62) with 2 2B, 5 HR, 10 RBI, and 4 BB in 22 career major league games…He has 7 multi-hit games in his 14 starts, and is batting .393 (22-for-56) as a starter, including 12-for-24 (.500) in his last 5 games.

·         Last night marked Shaw’s 2nd career 4-hit game (also 8/1 vs. TB…He is the first Red Sox player in the last 100 years to record multiple 4-hit efforts within his first 22 career major league games…He also became the first Red Sox with as many as 5, 3+ hit efforts within his first 22 ML games since Tom Oliver (6 in 1930).

·         Shaw recorded his 5th career homer on Monday night’s 2-for-4 effort…The only other left-handed Red Sox batters in the last 100 years with at least 5 HR within their first 21 career games are Sam Horn (7 in 1987) and Fred Lynn (5 in 1974-75).

TWO.

Deflate-gate judge hammers NFL’s case against Tom Brady

NEW YORK – Daniel Nash stood behind a courtroom lectern on the 17th floor of a federal court house here and tried to argue the NFL‘s case in suspending [New England Patriots quarterback] Tom Brady for four games in the deflate-gate saga.

Yet as the attorney made his presentation, he kept getting interrupted by Judge Richard M. Berman, who repeatedly engaged in direct counterarguments against Nash, sometimes even warning that legal precedent suggested the NFL could lose its case.

It happened over and over during Nash’s 63 minutes in front of the judge and with each Berman question or counterpoint, none of them positive for the NFL, Nash began taking a small, but telling, step back from the lectern, like a boxer retreating in the face of an incoming haymaker.

“There has to be some basic process of fairness that needs to be followed,” Berman argued to Nash after the NFL explained why it failed to allow Brady to question certain witnesses, notably general counsel Jeff Pash, who also co-wrote the disputed Ted Wells report about deflated footballs.

When Nash tried to argue that Pash wasn’t that involved and was more of an editor, Berman, like this was a cross-examination, pointed to an NFL press release that referred to Pash as “co-lead.” Nash, stepped back from that lectern, again tried to minimize it as just a press release.

“Well,” Berman said, “it’s not my press release. You all wrote it.”This is how it went, over and over. For the NFL … ugly. For the NFLPA, well, its 10-person legal team nearly skipped out of court after making an impassioned multi-point claim against the decision by commissioner Roger Goodell to uphold Brady’s discipline.

Kessler and the NFLPA argued that the league never provided notice to Brady that “general knowledge” of an infraction could lead to a suspension, that it didn’t allow a fair arbitration system, that Goodell knew he was compromised as an arbiter because he had previously praised the findings of Wells’ report, that the commissioner improperly increased the findings against Brady from “generally aware” to a full participant in a “scheme” based on no authority and no additional information, that the science of Wells’ report was junk, that the NFL didn’t provide attorney notes to the NFLPA in violation of federal standards and … so on and so on.

‘One Mississipi … Two Mississippi …’

Kessler, as is his way, was often flamboyant and laced his presentation with comic ridiculousness. He noted, for instance, that the footballs were, on average, just 1-2 percentage points underinflated and yet the NFL deemed it a grand conspiracy despite not being able to accurately measure the inflation levels. He likened it to getting pulled over for being 1 mile per hour above the speed limit and asking the police officer how he measured the speed.

“I counted, ‘One Mississippi, two Mississippi, three Mississippi, and I can tell you were 1 mile over,'” Kessler said, role-playing a cop.

Then there was this one from Kessler: “No one in the NFL knew anything about Ideal Gas Law, which is surprising because I think I studied that in ninth-grade science class.”

Even Berman laughed at that.

Berman didn’t just nod when Kessler argued that it says nowhere in NFL policy that a player can be suspended – or punished at all – for being “generally aware” of the conduct of others. He even added his own points, returning to the critical sentence of Wells’ report: “it is more probable than not that Tom Brady was at least generally aware of the inappropriate activities of [Patriots employees Jim] McNally and [John] Jastremski involving the release of air from Patriots game balls.”

Missing Date a ‘Conspicuous Absence’

Why, Berman kept asking, didn’t Wells include a reference to the AFC championship game or even the date of it, Jan. 18, 2015?

“To me it is a conspicuous absence from Mr. Wells’ finding,” Berman said, noting that game and that game alone is what is in question here, not text messages referring to past games. “Why wouldn’t you – he’s a smart lawyer – say on January 18, 2015?”

Berman also focused on how the NFL came up with the four-game standard, drilling Nash over and over about where this number came from, how much of it was about non-cooperation and how much for the footballs. Kessler argued that the crime was similar to stick ’em on a receiver’s hands or any other act like that, which under NFL policy is subject to a four-figure fine for the first offense, not a suspension.

Nash said Goodell decided to liken it to performance-enhancing drugs, which Berman couldn’t fathom.

“How is it equal to steroid use?” the judge asked with a tone of disbelief. “How did he pick steroid use?”

“I think the judgment goes to the integrity of the game,” Nash defended.

“Everything goes to the integrity of the game,” Berman said.

As for Brady not being allowed to question Pash about his role in Wells’ report, Berman blasted Goodell’s reasoning that it wasn’t allowed because the testimony would be “cumulative.”

“How would you know?” Berman asked if Pash didn’t testify. When Nash downplayed Pash’s contributions, Berman had none of it.

“Who else but Mr. Pash had the opportunity to edit the Wells report before it became public?” Berman asked. “Anybody?”

Judge Goes After NFL Mouthpiece

On every one of Kessler’s points, Berman seemed to take a sympathetic stance and in turn was adversarial to the NFL. What that means in the end isn’t determined, but consider toward the end, after Berman went after Nash for the suggestion that you could infer Brady was cheating because he stated that his preferred inflation level was 12.5 pounds per square inch, the legal limit. How, Berman wondered, could wanting the legal limit be a sign of illegal behavior?

Kessler obviously agreed and since he was pressed for time tried to paraphrase Brady’s testimony on the subject. Berman stopped him, said he was allowed extra minutes and then requested that Kessler read Brady’s exact words into the record. Kessler eagerly complied, reading in open court and for the court reporter a long session of Brady’s testimony that can only be considered pro-NFLPA.

In the NFL offices, the mood was noticeably deflated. Meanwhile, Brady took part in the Patriots’ joint practice with the New Orleans Saints, throwing nothing but perfect spirals. The happy ending has already occurred. The Patriots broke the Colts in the AFC title game, 45-7, then went on to beat the Seattle Seahawks in the Super Bowl. It was the team’s fourth Super Bowl title since 2002. That is more championships than any team has won in that time in any of the major professional sports. Brady was named MVP of the game for the third time.

I’ve called about issues, and never received a return call. Maybe if the dept. had a history of addressing things in a timely manner, we would know that maybe a plate is in place or a surface is left unpaved for good reason. But, unless we ask the contractor we get little info.

But the best way to avoid questions is to finish the jobs in a timely manner. wouldn’t that be refreshing?

Me too Southeast. I called DPW, Collingwood and mayor’s office more than once about issues on Pomeroy. Never got put through. Always left a message with phone number. Never got a return call. That’s Bianchi Administration in a nutshell.

chuck v– it is evident you are a banchi man and this site may not be the place to tout him and his people.. collingwood does not answer anyone back. case in point–three months ago– i requested in writing to circuswood –how much money the hydroelectric turbine i installed at the ashley plant–had saved the taxpayers of the city of pittsfield—when we built the plant the ashely resovior was significantly hiher than the floor level of the plant and i could have either built an energy disapating wall or take advantage of the hydraulic head and install a turbine– to power the plant– which it does.. guess what? no response to my request—–what do any of you out there think the reason is for circuswood not getting me this info? there you go– circuswood does not want the public to know how much more money craig c gaetani has saved the taxpayer–because that hurts banchi and circuswood. does everybody out there got it—got it—got it——-craig

I’ve had a number of issues with city streets. Before the temporary bridge was placed on Lakeway Drive off of Pecks, I had concerns about emergency vehicles being able to come over the existing bridge.
I went down to the office early in the morning and requested to speak with Mr. Collingwood. I was told he was not available. I said I would wait and sat down. Twenty minutes later, Mr. Collingwood came out and answered my questions and concerns.
Go to the office prepared to sit and wait. It has worked for me on a number of occasions.

dusty – i see everything and i do not miss a thing–you stated did barry need to worry about craig any more?—absolutely– even more so now than any time previously–i assume you are talking about barry clairmont? dusty– you and everyone on the planet missed something very important. on dans previous day blog——“-the suits keep telling you needless 120million school– a great thing for pittsfield”———–now go to that days post and read everything that is said by a poster (larrybirdsof a feather) and try to guess who that poster is—does he need to worry about craig any more?–you can bet every penny you have– that he has plenty to worry about. i am very busy now as i was way behind in my work because of kidney stones and a shoulder that need replacing and a hip that also needs replacing but i have to move forward pain and all because the election is only 4 weeks away and i need to speak at churches i was invited to speak to and many other scheduled talks at many different organizations. remember i work by myself and have do do everything by myself but i dont mind– it– as i am use to slaying goliath and once i do– i become a team player to move my agenda forward- if people vote with their brains i will be a landslide victor –the scheduled event at bcc on sept14 is not a debate—it is a sham–debates are when the candidates question each other and this is not a debate. if it were– i believe it would end the way one of the posters on this site—nota– had to say– he stated “craig will make minced meat of the competition”— nota– you are a little off —if it were a real debate– i would vaporize them but in this scheduled event– i guess i can only make minced meat of them and somehow that is what i am going to do i dont know you but i have a hunch you know me and the way you describe me– here on the planet i am sure you probably know me—i am all business and no bs-i will heard the taxpayer into my flock and together we will go chew up all the weeds at city hall– you can bank on it—very sincerely—craig

I am thinking of getting a petition together to send to the pentagon offering Pittsfield as a prime choice. Any among you who would sign it?

chuck we have heard enough from you–we arent looking for tiny cuts as you are proposing–i am looking at cuts of 7% per year— massive cuts– it is the only way to save the city. didnt you read dans post as to how far behind the 8 ball the city is and will be as the # of tax payers disappear and the city goes into a downard spiral. you had your turn and didnt accomplish much–i think very differently than you and i clearly see the city as nearing bankruptcy –if they continue to operate as they are chuck–you are talking about band aid solutions and i am talking about saving the whole person. we couldnt be further apart—– you desperately need to see my tv shows to get yourself up to par. i hope we can agree to disagree and remember you said –i will come in fourth in the mayoral race and i posted to you– if you wanted to wager on this and you have been silent–why are you not ready to bet on a statement you made in public(this site). i am a no bs person –put up or shut up .i cant make it any more plain than that—craig

Craig; Could you please tone down your language and watch the swearing ? There are ladies and young teenagers who read this blog. No I will not meet you and get dismantled. I am 5’3” and non confrontational. My deceased husband probably would accomdate you however if he could. Yes, he was a veteran who quietly won the air medal with two oak leaf clusters and a purple heart.
Did you speak this way around your mother ? Thank ypu.

dee i am sorry–i call a spade a spade and i also call it as i see it. isnt that my right? i only swear when it fits. i may be wrong but i have seen many people swear– even this sites guru- i never swore at my mother . some people need to be sworn at . maybe if we swore a little more this administration would get it. i can tell you one thing that is as factual as the day is long –this administration–your administration– definitely gets me and i will be getting them very soon. a new day for pittsfield is coming and the chaff will be blown to the wind. this site i believe is an adult site and perhaps i should set an example by not swearing again–you are right. this is the only right thing i have heard from you but on this point– you are right and i will set an example and try to do my best and not swear—–craig

cat–jimmy carter has had a long life–i met him at the old hotel before the crown plaza and with him it was just like talking to some one you knew for a million tears. down right very nice person. i think pres.carters main problem stemmed from the fact that he didnt hire the right people in his administration. he was very loyal to his supporters and on many occassions –didn’t place the right persons into the important positions and it back fired on him. i truly believe that if he had the right people in high places he might have been the best pres. in the history of the us. his stand in trying to help the little guy was all i needed to know about him and i am praying he has a peaceful send off– free of pain in his last days and i am going to pray for him and i hope many on this site will do the same–thanks for your support cat—truly—craig

This is the last time I will comment on this: I have a cordial relationship with Mayor Bianchi as I do with all of the people running for public office. They should all be commended for their willingness to serve.
When Mayor Bianchi was elected, four years ago, I offered to help him transition into his new position. If Peter Marchetti had won I would have offered him the same courtesy.
I am not, and never have been, a member of the Bianchi inner circle.
I love the West Side Clock shop especially the other cuckoos in there. Birds of a feather flock together!
Very friendly and honest owners!

chuck–you are lying again you do not have a cordial relationship with all who are running for office–you and i have no cordial relationship what so ever the only things you have said about me are hurtful things on this site –i cAN READ between the lines in your posts– that you are looking for a way out with me– but it is too late– i have you signed sealed and ready to deliver but i just dont know where to deliver you to—i am a forgiving person and i dont hold grudges—if you dont agree with me –fine tell me what you want me to answer and i will answer——have you seen any other mayoral candidate who is ready to answer a tax payer like you? if you want me to answer something– i will—-all you have done to date is throw spears at me and i do– in case your not aware have many supporters on this site. they know that i am an open book because i purposely opened myself up for full review by anyone on this site and on my tv program. in case you do not know it i am tryingi to help you– with something this city has never seen the gaetani way—i have been fabuously successful in my life because i know what i am doing and i hope i am given a chance to lead the city the gaetani way. hey —we have seen what we have at present– dont you think the hard working taxpayers have the right to see some one totally different than those who have created a situation where many in the city are a pay check away from disaster? what do you or anyone else have to lose with this kind of an administration. why dont we all try something different—my way—–what do you have to lose. we are already thoroughly broken– i want to rebuild. does that sound ridiculous to you? it is the only thing we can do to try to save our city——craig

Why don’t you pay the $75 to have the junk vehicle removed from your apartment building instead of the taxpayers or pay the $350 for a barrister to represent you for your legal work ? Craig I guess we can’t be friends but we can still have a cordial relationship. Again I commend you for your willingness to serve. The only thing I said was that I thought you would be the caboose in the election. Nothing you have said recently convinces me that I’m wrong. I’m moving on. The election will settle the matter. The only thing we are doing is going around in circles. Good luck at BCC.

chuck—me also–you are forgiven and i hope your prediction is wrong– as i truly have a good game plan for the city but this bickering gets none of us anywhere–thanks for the good luck call i need it. i hope and pray that this election is not a bought election but if it is i still am glad i entered the race because– i tried and no one can fault me for trying—–i think many are going to be shocked by the results—like i said– no matter what happens in the race– i will be the king maker–ronnie is a riddler –do you have it figured out ronnie boy? i told everyone on the planet– i never lose and i will not lose here either– now all doubters go figure out what i mean when i say i am the king maker in the election!!!!! good night i am hurting and cant do much other than post . it takes the pain away from my mind when i post—i hope i get better because this staying home is murder. now i know that i positively will never retire. if this staying home is retirement— i want no part of it . i hope i get better soon as a day or two more of staying home will definitely get me ready to go thru the procedure to get a new shoulder and hip and be well enough by jan3rd to take over as mayor—good night everybody- maybe i will be called the bionic mayor——craig

generally, the Fire Dept. only tows cars that are either abandoned on public property OR when the owner of the car refuses to get it registered and insured (proving that is not junk).

If YOU don’t want a particular car on your property – then it is presumed that YOU can pay to get it towed. In this case, the car in question belongs to a tenant of yours – so if you had the car towed, you could recover this money from your tenant.

Chuck wants to save an honest 1% from the City Budget – and eliminating unnecessary trespass tows would clearly be put in this category. You could promise to cut 7% a year for 4 years or 40% a year – and in fact it would be just that a promise. We puke 1% in stupid purchases every year. if that works, we ask for 2, 3, or 4%. That might (should) include headcount reductions, which in turn chip away at the $640 million in debt.

One thing I applaud you for though: throwing your brother under the bus. whether he made the calls or not, it’s brilliant to deflect calls you may have made to a brother who the cops see a lot of. I think it’s his car you want towed too. if nothing else, this proves you to be pretty ruthless.

between that and the rants on here about who you will fire, crush, obliterate, etc. – what judge would see you as anything but a kind and gentle soul?

SOUTHEAST–TYPICAL RESPONSE FROM YOU– MY BROTHER WOrKS AT MY HOUSE EVERY DAY and i knew nothing about him making any telephone calls. when he read in the paper that i was charged for calls he made he told me. –i told him i could win in court without involving him at all and he said absolutely not– he did it and he said he did it—you see we dont lie even when it may hurt so go look for more stones you imbicile–i know who you are– a person who never worked a day in your life and you want to throw stones- your one small appointed position you held– you were the weakest link on the chain–one more lie from you and i am going to identify you and i dont care what the ramifications are. you are a laughing stock and the public needs to know who you are. one more lie and you are burnt toast–i am not going to take crap from any more crackpots–i know exactly how to deal with you and i am waiting for one more lie. now you should think about that –it– would be very embarrassing to your spouse who isnt a bad person

thanks nota—-i am a stratagist and i havent even had to use one of my trump cards yet . remember i have fried much bigger fish than tyer or bianchi. tyer– i am not going to be too rough on because believe it or not– i do like her but i will put only enough pressure on her to make sure she is sidelined enough for me to win the election. now bianchi—- i am going to crush him flat and guess what? he may not even be in the election. i am dotting all the i”s and crossing all the t”s. i have been operating in stealth mode the past six weeks. , i have been repositioning the carrier by gps. a few more tweeks – alignments and adjustments and we will be ready to fire a lazer guided missile and only people like me– who holds a top secret crypto clearance– the highest military clearance in the us military complex– know where that missile is aimed. i know you like a little excitement and entertainment nota and this is a war game– that i am expert at–stay tuned my friend– you will definitely enjoy the results of that missile strike—-stealth craig—-going to the control room—

You were a great councilor. Many times you would talk at length but you were always on track and interesting. You were definitely one of better councilors. Another was Peter Arlos, a man who would never win a popularity contest, but again like you he spoke with complete knowledge of the subject matter.
Peter is gone but not forgotten while you are still here. Like Peter, you always spoke the truth. People didn’t always agree with everything you said but they always respected you as a councilor for the people.
This long time resident of Pittsfield not only voted for Bianchi but also helped in his first campaign for mayor. I was impressed with his sincerity to fight and eliminate crime in Pittsfield as his no. 1 goal. His second was to repair and repave Pittsfield’s horrible streets. His third goal was to strive to keep taxes low and manageable realizing that over 40% of Pittsfield’s tax base is comprised of retired seniors on fixed incomes. Lastly, he promised to maintain Pittsfield’s excellent educational levels.

Post Election:

Crime is worse than ever with bullets now flying all over the city.Crime is so affluent that it is not advisable to walk in most neighborhoods for fear of being mugged, stabbed, or shot.

Pittsfield roads. The ever present potholes and ditches prepare the average Pittsfield driver with sufficient entry skills for Lime Rock, a race course built on the design of Pittsfield roads and streets.

Taxes: Screw the taxpayer. New school buses 1/3 to 1/2 full on most routes. ( I was recently informed that the city is still paying for the old buses as well as the new) Nice! And of course but not least the new Taconic Vocational School to replace the Present Taconic Vocational. Spending $36 million to repair and bring the present school up to code. Sounds nice, but wouldn’t you rather spend $121 million for a new school. Of course, when all the % is paid on the new school, that total could read $250 million or higher but as my councilor in Ward 1 stated, “It was a no-braner to vote for the new school.”

No.4 goal: Maintain Pittsfield’s educational system. That was simple, just build a new school when Pittsfield’s population is shrinking yearly.

As I see it Chuck, you would be an excellent mayor. If you would consider running, I would vote for you and help in anyway. You were an honest councilor who wasn’t swayed by another. You have an excellent track record when it comes to city government and frankly Pittsfield needs someone of your caliber to save the city.

Likewise, Ward 1 needs someone of Henry’s caliber. Someone who is intelligent, honest, and straight forward. Someone who states his or her positions prior to election and maintains them after election. Our present councilor and our present mayor are complete duds
.
That being said, the present slate of mayoral candidates consist of one great snake oil salesman, one former useless councilor, a local business lady who has had a few run-ins with the law, and last but not least, Looney Tunes.

Chuck, we really need a reliable and honest candidate for mayor. I wish you would consider.
