THREE SHOOTINGS IN TWO YEARS, ONE A MURDER, BUT DRINKS STILL FLOWING AT LACH’S LOUNGE

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION OCT. 8-10, 2017) — At 1:20 a.m. Sept. 10 in the Fenn Street parking lot adjacent to the building that houses Lach’s Lounge, a 32-year-old Pittsfield man was shot multiple times. Judging by the cold bullet casings littering the ground and earwitness testimony, the gunman got off at least 10 shots. According to police, the victim had earlier been in Lach’s. THE PLANET had one wag caution against ordering a shot and a beer at the bottom-scraping barroom. We would only add if you do, drink the beer first, because the shot will likely leave you full of holes.
We’re not saying we haven’t occasionally enjoyed the atmosphere of the bar or that we have, but it’s generally not a good sign when you enter a gin joint and the first thing you see is the outline of a body chalked on the floor. Likewise, we tend to avoid bar and grilles that list the Heimlich Maneuver as “Today’s Special” and feature Naloxoneas an “entrée” selection.
Lach’s has been connected with three shootings and one murder in two years:
- The Sept. 10 shooting, which we shall dissect in a moment.
- A fatal head-shot delivered to James Dominguez III, 30, a Springfield resident, whose body was found in January 2016 in the parking lot at 129 Fenn St. Dominguez, police said, had earlier left Lach’s. A 911 call had been made at 1:30 a.m. He had taken “two in the hat,” as they say on the street. The medical examiner concurred. Pittsfield police said Lach’s had been “overserving” patrons on the night of the murder. That’s polite talk for when a bar keeps plying patrons with booze after they’ve gone beyond three sheets in a gale-force wind (“I’m not as think as you drunk I am”). Moreover, PPD said the bar provided drinks that night to those who were already spit-faced when they arrived, having previously consumed their oceans of booze elsewhere. Dominguez, incidentally, had been arrested in 2014 on a drug raid in Pittsfield. Drugs? In Pittsfield? No way. He pleaded guilty to possession of cocaine and heroin and released on time served. A month later, Dominguez had a bullet in his head after his repasts at Lach’s.
- In October 2015, a man was shot on Lincoln Street. Police investigators determined that the gunman, Anthony Robertson, had earlier been in Lach’s, a fact the bartender conveniently forgot to mention when questioned by detectives.

In the past eight months, Lach’s Lounge has been before the Pittsfield Licensing Board (PLB) eight times. Let’s see: 8-for-8. That’s almost perfect, and it’s damned sure to win you a batting championship. It’s also damned sure not to close you down. Not in Pittsfield, not if you have what the wise guys call “protection” — not that we’re saying Lach’s does, of course. We wouldn’t NEVER say that. This very day or night, in fact, if you wish to get loaded watching baseball, football, hockey, or girl’s lacrosse, you can head to Lach’s. It’s still open. The joint has been dragged before the PLB three times now in a couple years in wake of violence, gunfire, shootings, and murder. Three taps on the limp wrist, and …
… It’s still open.
Stop us if you’ve heard this one before.
The Sept. 10 shooting is made even more hilarious because, unbelievable as it sounds, the near murder didn’t cause another appearance before the PLB. Police Lt. Mike Grady wrote up the bar not for the shooting but for overcrowding that night. Grady told a befuddled PLB that police counts revealed 81 or 82 patrons in Lach’s the night of the Sept. 10 shooting. That didn’t include blind spots outside the range of video cameras. At the Oct. 3 hearing, Grady told the PLB he would “assume” there were more than 82 people inside, given the blind spots. Lach’s interim GM, Ishmael Lytle, no relation to Herman Melville, disputed Grady’s claim. Lytle said there were only 61 people there that night — 61: Same number of HRs Roger Maris hit in ’61. Keep in mind that Lach’s might be able to comfortably contain the three Apollo 8 astronauts and the human remains populating two phone booths, but more than 82 — even 61 giving the benefit of the doubt? Sounds like SOMETHING hot was occurring there prior to the gunplay. THE PLANET‘s guess: 2-for-1 soda pop.
At the Oct. 3 hearing, it came out that police couldn’t say for certain the shooter was inside Lach’s, although the victim surely was. If it quacks like Daffy, po-goes like Daffy, has a beak like Daffy, lisps juicily like Daffy, and “ho-hhoooos” like Daffy, it’s probably Daffy. Oh, and Grady offered this little tidbit: On that fateful-near-fatal Sept. 10 night, Lach’s had served booze to an underage person. Nonetheless, for some mysterious reason known only to Odin, Zeus, Imhotep, Baal, the Great Juju Who Lives In Silver Lake, and the rest of the gods, that violation wasn’t part of Grady’s complaint.
Why wasn’t the shooting the main thrust of the PPD’s complaint? In the hearing, the PLB struggled to figure that one out, notwithstanding any “nudge-nudge wink-winks” being exchanged. After Sgt. John Soules told the PLB “both the victim and several of the bystanders had been inside the bar prior to the incident,” and although the man was shot multiple times not long after leaving the bar, he couldn’t make a connection between barroom, shooter, and victim. Sherlock Holmes, out city turns its lonely eyes to you.
The PLB then rushed in to play Advocate for the Defense for the besieged bar.
Board member Dick Stockwell said that even if the shooter was in the bar, “having a few drinks [is] not illegal.” Bingo!
“I’m having a hard time connecting Lach’s to the shooter and why it is their responsibility,” said board member Dennis Powell. Double Bingo!! Powell also offered the lame excuse of social media. He absolved Lach’s, because on social media everybody knows where everybody else is. The shooter, Powell said, could have learned his victim was in Lach’s and simply waited outside for his target. “That isn’t the fault of the establishment.”
Stockwell said that since the bar hasn’t had a problem since it installed video cameras, all was well and good. What about the Sept. 10 shooting? Not the responsibility of management, he said.

On the night of Sept. 10, according to Lytle and Lach’s owner Michael Kruger:
- Lytle closed the bar at 1 a.m.
- Kruger went home.
- Patrons left but continued to hang around in the parking lot, where the shooting occurred.
- Lytle locked the doors.
- He and a security guard (formerly called “bouncers”) cleaned up.
- Lytle said he heard more than 10 gunshots and called 911.
PLB member Diane Pero scolded Kruger: “There is a problem with your bar, and it has been happening over the course of years, one after another.” Kruger said there are bad things happening all over the city, and he doesn’t know the good guys from the bad. A great tutorial on that can be found any time of day at the Cumby‘s on First Street.
“I’m a bad judge of people,” Kruger said, stating the obvious but not grasping the back-wrenching contradiction in what he next said: “I think everybody is good.”
And what did the PLB do? It voted to continue the hearing to December. No harm. No foul. No envelopes stuffed with $100 bills. The shooting most likely will disappear in the foggy dew, like so much of the violence and mayhem in The Land of Benigno Numine. The police haven’t issued the victim’s name, haven’t said if they have a suspect, nothing. Zilch. Nada. Neither The Lovely Linda “Trashcan” Tyer nor acting-interim-kinda-sorta police chief Mike “The Spin” Wynn want you to know about this sort of stuff. It goes too much against the narrative fiction.
So drinks on the house for everyone. Call the roller of fat cigars. Let the Big Lady sing, Stevens, because all is “vibrant” and “dynamic.” Call this miraculous non-intervention of the licensing board a form of magic peculiar to The Suits and Insiders of Pittsfield. Mary Jane and Joe Kapanski, don’t ask. You wouldn’t understand, although you definitely get it.
Folks, you can’t make up side-splitters like this. The Lantern‘s Fry-O-Lator isn’t up to code? Shut it down. Lach’s gets implicated in another shooting? No problem.
Vibrant. Dynamic.
The final punchline, given the PPD HQ’s proximity to Lach’s, is that police say they learned of the gunplay through Spot Spotter.

Thank God for the Shot Spotter. At first I was bummed out that the mayor would spend so much money on what looked like a new toy. But now that I know that there are so many guns and gangs and shootings in Pittsfield I think it may have been a good investment.
Although if I were a tourist in town I am not sure knowing the city had and very much needed a Shot Spotter, that it would comfort me much.
Once again, I reiterate- why are the cops only showing up when Spot Shotter alerts them?
Why is the NEVER a visible police presence on that block when the bar lets out?
Pittsfield has the busiest police department in the state.When your mayor buys a shotspotter system she and the city council have admitted we have a war being fought by gangsters and shes hoping this helps.Gangsters provide drugs to Stockbridge,Lee,Lenox,Dalton,Great Barrington,Sheffield,Williamstown,Hancock,Laneboro.Stockbridge citizens need to stop buying drugs from Pittsfield gangsters who have taken up residence here.Country curtains closing with 200 adults to be unemployed.
I agree. We have now have the shot spotter but still have the same old results. One person dead, shooter still at large, police pleading with the public for help solving the crime and a Mayor still basking in the limelight from latest trashcan ribbon cutting.
Doesn’t help when you have free needle and free dope for addiction sites here either.
Somebody (Sara I think) wrote on this site the other day to let the police do their job because they always catch the bad guys. Well, that used to be true, but with these drive-by shootings the track record isn’t good at all. The mass shooting in a parking lot that happened two years ago on the 4th of July with one young man dying and others injured….shooters never caught. Same with the drive by shooting that happened just this past 4th of July and now we have the most recent drive-by shooting with the young woman shot while sitting in her car.
Drive-by shootings are extremely difficult to solve. The police do their best, but the nature of the crime is such that they really do need people to come forward and help with the investigation, but with people living in fear this will usually not happen.

And I say Lach’s is guilty of nothing more than being a watering hole for people who can’t afford a la-de-da wine bar. You know, the Little Guy.
Dan, is that true? Did the cops actually say they learned of it through shot spotter?!? I wondered that when it happened. And Radar, you are ABSOLUTELY right. The pressure points are obvious. Lach’s certainly appears to be one. There are always excuses made for not doing things like this “pressure point policing” and sometimes they are as ridiculous as “it happens near a shift change time so…we couldn’t possibly….” If banks in your town got robbed…once a week at exactly 1:30 AM Tuesday for say, three weeks, wouldn’t it make sense to have eyes of some sort on every bank the next Tuesday at around that time? Some will say “it’s not that simple” but know what…it IS that simple. Have a couple of cops take a walk around the block from HQ a couple of times at closing time each night for a month and I bet there will be less appearances before the board. And they don’t even have to enforce the code violations…just walk around the block.
Or just sit a police car in the public parking lot behind the bar.

I can guarantee not a single person would get shot, stabbed, jumped, assaulted or murdered with a cop car parked right smack dab in that parking lot. It just wouldn’t happen.
You know what, it would also curtail excessive boozing as well. Patron who are driving, who know they have to walk past a cop who will then watch them pull off in a car would be very likely to drink less.
No it’s very apparent, PPD has very little interest in preventing crime in that location.
Is it their job to prevent crime? Sounds like a tall order.
Not sure if you’re serious, but I think their job is to protect and serve. React and be invisible is not that.

That is my whole point Arial. Look at statistics. If one KNOWS that violent crimes are likely ro be committed at a specific place, at a specific time (like closing time at a specific bar) one can put manpower in that place at that time and, yes, prevent crime.

I have a few questions regarding the BMC strike:

2. Why is it (according to numerous non-union workers) running more efficiently? WITH LESS STAFF
3. Why are many of the travelling nurses applying for BMC jobs because they feel the contract is beyond generous and the nurses are crazy for striking?

Someone has to take charge in this City. We have a great area to live. Something has to change, start pulling these thugs off the Streets, start enforcing citatations to maniacal drivers, for instance, it is out of control. Lenox State Rep Smitty Pignatelli doesn’t support a regional government for Berkshire County, but wants municipalities and public school districts to share services. Who will administer the shared services? Each set of municipalities or school districts? The state government?
Smitty Pignatelli goes onto disparage Berkshire County for being “older, sicker, poorer” than the rest of Massachusetts. Well, Smitty Pignatelli has been in public office for decades! He has been a State Rep. since early-January of 2003 through present day. Why hasn’t he done anything but vote himself legislative pay raises for the past +14-years?
Smitty Pignatelli is the poster child for everything that is wrong with government. He is a career politician who votes himself pay raises, while the people who pay his public salary live in the real world!

For the past 4 decades, Pittsfield politics has increased its municipal operating budget by around 5% every fiscal year. For fiscal year 2019, Pittsfield politics will be at its levy ceiling under Prop. 2.5. Things will have to change! But, Pittsfield will never change!

Pittsfield police are good at patrolling but alwful as traffic control.Is it possible to make a rule they must keep their heads up and be in ready position when doing a work detail for safety of the pittsfield drivers.

Like red light runners….this week saw an about 80 year old woman run a light near Allendale…saw a city bucket loader run the light on East and First st., several texters swerving back and forth and the usual hundreds of cars and semis blowing through the Coltsville intersection.

Fire and safety basically work for the insurance companies,as far as what you pay in rates. It would be in the best interest of the rate payer and insurance companies to have a more stringent enforcement. I’m with dusty one hundred percent, the driving and disrespect of others on the roads is out of control and has been for years. On the fire side there have been a couple of conspicuous fires that comes to mind involving apartment complexes,have there been any evidence of why those two burned down?

Berkshire Eagle asks poll question on their website “Do you feel safe in your neighborhood?” As expected, people living in poorer neighborhoods in Pittsfield will of course respond that they don’t feel safe, while anyone associated with the Public School System especially teachers and administrators and of course all City personnel will answer that yes they are all warm and safe and fuzzy in their wealthier neighborhoods thank you very much.
Since the Berkshire Eagle just recently discovered that poor people (lots of them) actually live here in Berkshire County, the polls results will probably also be a shock to them.
What happened on Appleton? Many State and Local cops at a house there.

The Cemetery’s are big time drug havens and the Lakes this year, there have been loiterers on Lillybrook Rd. no neighborhood is safe,and you have different kinds of crime. Some lady was raising her fist to me because I was going the speed limit at Springside and Brown. I slow down when someone does that.
Lillybrook Rd. is dead end with a nice cul de sac with no houses around. The residents there know what’s going on. Just one street away from the mayor.
And the calls came from neighbors saying description of said cul de sac infiltrators, and that they ( infiltrators shouldn’t be there) Cops arrive, they’re gone or moved along. Three times, heard it.
Helicopter circling the jail Sat. afternoon, sheriff Dept. scanner was active, looking for something/somebody.

Maybe! …… Maybe if the Berkshire Eagle buries the story Gunman robs Georges Liquor Store in Pittsfield…. in the bottom right hand corner on page B6 in Sundays paper……people will miss it. Just Maybe!!!
If the Eagle printed that story they may not have gotten any more advertising from that client. Places need to appear safe to shop in or near.

Story I heard was that a prissy young filly accidentally stepped in the the dung dropped from the aging mare in front of her. And then proceeded to go nuts on her getting the whole flock of horseys in a tizzy. The whole thing was caught on tape and apparently the horsey that unwittingly dropped her excrement in the path of the debutante will be heretofore be turned into glue.

How many bars with troubles have closed in the past? The crime just moves on to the next one. Maybe Lach’s could put cameras outside. Have the monitor visible to the customers. Maybe the trouble might move to the next one.
OR the city could install surveillance cameras. City Hall is across the street, put one there. Put some on the light poles in the parking lot.
It’s about come to that. Your second amendment rights might be comprimised.
Pittsfield Mayor Linda Tyer said she’s aware of and shares the same concerns and anxieties that news of high crime rates can cause but assures the public that Pittsfield is a safe city.
“We are not naive to assume that we’re not dealing with crime. We have a certain element of our society that has chosen to conduct themselves in a criminal manner. And, at the same time, we are doing our best to make the proper investments in the Police Department,” Tyer said.
Among those investments is Amanda Steben, the city’s crime analyst, who compiles daily data from the department and is able to develop a more current overview of the state of crime in the city, rather than reacting to the FBI’s annual data, which represent the previous year.
“That alone helps us be better decision-makers,” Tyer said.

At least the mayor of North Adams was more transparent. He said that even though he doesn’t personally feel unsafe, he realizes “the numbers don’t lie.” Yeah, ya think?
The most interesting parts of that article? The Pittsfield mayor admitting that instead of actual law enforcement and crime solving, they are relying on someone to analyze data and a shot spotter to notify police when gunshots go off…waiting to hear about the measurable outcomes that either of those methods result in…
