WITH HARRINGTON’S PRELIMINARY WIN, THE QUESTION FOR CACCAVIELLO IS: HOW MUCH DO YOU REALLY WANT IT?

PLANET VALENTI NEWS AND COMMENTARY

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION SEPT. 7-9, 2018) — Andrea Harrington’s narrow win in the Democratic primary may be enough to see her through the November election to become the next Berkshire County district attorney. The only thing certain at this point is that she won’t face a party challenge. That’s why her Sept. 4 primary win may be enough.

May. Not the month, but in, “the probability is there but it’s not a given.” That will depend on Paul Caccaviello. Will he attempt a write-in or sticker campaign to win the November general election? THE PLANET has heard from insiders and wise guys, and they are split, with slightly more thinking he should do it. We present the arguments.

———- 000 ———-

First, to the question: Should he mount a write-in challenge? No one can answer that but Paul Caccaviello. As we wrote, THE PLANET has heard from a good cross-section of local political types involving all three campaigns in the D.A.’s race, and most think he should launch such a write-in bid. They say he could win because of the following factors:

  • He took Pittsfield, the county’s largest vote field. He could be expected to hold on to those votes.
  • The general election will involve more voters, including Republicans, who they say would be more inclined to favor his “no-nonsense” approach to law and order as opposed to Harrington’s perceived softer, “more coddling” approach. Independents, who equal registered Democrats in number, would also be a factor.
  • A second chance after a close primary would be the thing to energize members of his “base” who thought he had it wrapped up and therefore either did not vote or did not help him campaign.
  • He can learn from his September mistakes: Keeping “the wives” out of the fray; campaigning more aggressively; insisting on more debates, where he and Harrington would be one-on-one.
  • The campaign season for the general election is many times longer than for the run-off. Essentially, primary or preliminary elections do not kick into high gear until after Labor Day. This year, the wise guys point out, the vote was held on that day. The November season has already begun.
  • Caccaviello’s would press (1) his vast edge in experience (2) the endorsements he received from local law enforcement agencies, including sheriff Tom Bowler (3) leveraging more specific issues and avoiding abstract theory when discussing the D.A.’s job (4) touting his successes in office.
  • Judith Knight’s voters have been released. They are up for grabs. The pundits think more of them would want Caccaviello than Harrington.

Those who advise against it all point out how hard it is to win a sticker campaign. Failure, they also say, comes with a heavy taint, that of sore loser. One insider says that a write-in effort would be “a political kiss of death for Caccaviello. Write in campaigns never work even when you have a candidate that is well-loved and has momentum. Caccaviello has neither. Just ask Pete White how effective a sticker write in campaign is. After he narrowly lost in the three-way special state rep primary, he tried to keep his ward seat with Kevin Morandi alone on the ballot. He ran the write in campaign, he distributed the stickers. But, it failed miserably.

———- 000 ———-

Caccaviello needs to decide the write-in issue soon.  The longer he waits, the more wishy-washy he appears. Actually, it’s not a tough decision. Cacc simply has to consult his heart: Does he want the office or doesn’t he? We mean, REALLY want to be D.A. If the answer is “yes,” he needs to pull out all stops and go for it. If no, he should talk to Harrington about keeping his job.

With that, THE PLANET congratulates Harrington for her preliminary (and possibly final) victory. She ran a great campaign and proved the value of tireless effort, particularly the old-fashioned wearing out of shoe leather.

Have a great weekend, everybody.

Jimmy Ruberto’s political network of former WHEN hacks prevailed again in Pittsfield politics. I don’t understand why! Ruberto and WHEN oversaw major numbers of population and job loss. They even spent over $2 million of GE’s settlement fund on the so-called downtown renaissance and the arts that was supposed to be used for real economic development. Their response to Pittsfield’s depressed economy was to raise taxes and increase municipal debts to unsustainable levels. The only reason why Ruberto’s and the former WHEN network is so powerful that they were able to replace Paul Caccaviello with Andrea Harrington for District Attorney is that the Good Old Boys (and Girls) club is very powerful in state and local politics. The GOB has run Pittsfield politics for many generations and they are entrenched in power. The sad reality is that the GOB has run Pittsfield into the proverbial ditch. Pittsfield politics is being ran by Jimmy Ruberto, and that needs to change, but it will never happen in the near future. Instead of democracy, you have Ruberto-cracy!

Jonathan you need to name one city that does not have a political group like Pittsfield and or a low income neighborhood owned by corporation bought rental homes be getting violence.
North street is vibrant and the best looking main street in the Berkshires.Ruberto gave elitist backed Museum and the 500k to Hancock Shaker Village…..a fn joke giveaway as they repurposed the money illegally and should pay it back. They marched all the hacks before the council including some guy from Umass to tell us how important it was to refurbish the administrative offices.
With the 60million raised by the museum I want our 600k back as Pittsfield bought them a climate control system…..Does Tyer live in Florida …please paint white lines on roads before someone is killed…also every storm drain is blocked by grass cut towards the road…that should be a fine of 50 bucks….also again trucks on Williams street are allowed to drive 60 more and cars are pulled over and ticketed……Pittsfield police should spend 3 months only pulling over trucks…..where is the Mayor on this…..Trucks chief Trucks….police the trucks….every ahole with a pickup truck is on every cars bumper to go faster…..Big Truck bullies……Police in Pittsfield are afraid of men in trucks

Pittsfield’s downtown is still a dangerous place with violent crime! Pittsfield is ranked #9 by the FBI in all of Massachusetts for violent crime; North Adams is #1. A few months in and around summer, Pittsfield’s downtown has a tourist economy. Most of the year, Pittsfield’s downtown is empty after hours.
Pittsfield politics’ Good Old Boy network has been around for generations. The interrelated, multigenerational local political families think they are more important the real democracy. If you want a living wage job in Pittsfield, you have to kiss their dirty rear ends. If you speak out against the GOB, they take away your job. If you continue to speak out, the GOB spreads vicious rumors against you.
During the past +4-decades of GOB rule, Pittsfield has lost population and job numbers. Pittsfield is now known as one of the most economically unequal communities in the state and nation. Even the Boston Federal Reserve noted inner-city neighborhoods in Pittsfield with extreme poverty, and they gave Pittsfield a grant to address its economic inequality and poverty numbers.
Since I was a freshman/sophomore at Pittsfield High School in 1990, the GOB blamed GE’s downsizing in Pittsfield for its depressed local economy. Over 28 years have passed now, and the GOB has done absolutely nothing for real economic development and job retention/creation. When I was 26/27 years old in 2002/2003, I once walked the streets of Pittsfield looking for employment without success. I grew up in Pittsfield. I was once a young man and Army Veteran in Pittsfield. I know how it is in Pittsfield. I have come to dislike the GOB, especially Jimmy Ruberto, Luciforo, and Carmen Massimiano!

Also to be taken into consideration is that the Berkshire Eagle endorsed Caccaviello. For many people this is the worst taint you can apply. The old Eagle at least, was considered heavily associated with aiding and abetting dirty politics in Pittsfield.

Caccaviello can’t get on the November ballot as an independent?

I think Lieberman did this in CT when he lost the Dem primary for Senate a while ago.

Perhaps too late for late?

In order to qualify for the November ballot as an independent, he would have had to have filed as such originally. The deadline for that passed well ahead of the primary. And if you run in a primary as a party affiliate, you cannot be named on the ballot if you lose that primary, which is why he would need a sticker campaign or write-in, neither of which will succeed, by the way.

From Wiki:

“The party [Connecticut for Lieberman] was established on July 10, 2006, and began collecting signatures in case Lieberman did not win the Connecticut Democratic primary.[4] On August 8, 2006, Lieberman lost the Democratic primary to Lamont. The next day, over 7,500 signatures were filed with the Secretary of State’s office in support of Lieberman’s candidacy. On August 23, the Secretary of State announced that the party had filed enough valid signatures and would appear on the ballot in November.”

Might be a provision for such a thing in MA if enough signatures are filed by a certain date after the primary?

Paul can’t win a write in. Those who voted for Judy are ultra liberal. Even if Judy tells them to vote for Paul, they won’t. Most of Judy’s vote falls to Andrea. When you add Judy’s vote to Andrea’s vote In Pittsfield, Andrea would have taken Pittsfield by 600 votes.

This is also why Tyer wins next year. Her base is solid and she beat the Bianchi, Bowler crowd again. The Mayor’s endorsement is what put Andrea over the top. Unless she messes up in the next 12 months, she is unbeatable.

Harrington did get beat in Pittsfield by Knight splitting up the liberal vote. If Knight weren’t in the race, Harrington would have won Pittsfield.

Read Grier Horner’s letter to the editor today. He makes the same point.

The liberals took 63% of the vote in Pittsfield. Paul can’t win a write-in as they never work. If he wasn’t organized enough to win the primary as a sitting incumbent, there is not way he can win a write-in. He just makes a fool himself.

Whether you like it or not, Tyer is unstoppable unless she messes up. She doesn’t have any major blunders yet. Bianchi-Bowler are done.

Dan. Surprise. AFTER..See my post below to see how dramatically the sheep will be shorn. Honestly it is there own fault. Gaetanis has done a superb job sticking his neck out for the sheep but they have been out to pasture eating hay and they will only know the fox is around when they are between his teeth heading toward his stomach. The G man told me about this site and you and he said that the two of you are the only advocates for the taxpayers in the city of Pittsfield. It is evident. I admire both of you because if it were me I would have told the sheep to kiss my rear long ago. G feel sorry for the sheep because they have put themselves in this position by allowing the Gobsigs to get control of them. He will not give up trying to save the sheep even if he has to go to court like he did in the past to try to save them at his own expense. Mr.G has been trying to help the sheep for three and a half years and he said you have been at it for 12_15 years. We are lucky to have you both and I hope everyone realizes it. Keep on keeping on.

I agree DF. And to “He can’t win” – to say that Tyer is “unstoppable” is an exaggeration and very premature at this point. We don’t even know who her opponents will be. What exactly has she accomplished other than placing trash cans on Tyler Street? I think she is very vulnerable and very beatable. If Caccaviello won Pittsfield – Tyer won’t have the Williamstown progressives pulling her across the finish line.

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.

OK, now that you’ve read it. Have you have read it, of course, right?

Does any sane person think this would happen, even has a snowball’s chance of happening?

Two-thirds of each house of Congress?

Perhaps it is Lizzy who is unfit for office.

Sort of a ridiculous discussion on NPR last night around 8:30–a prof from BC(?) and a Politico “journalist” and the equally fluffy moderator–they kept saying that there’s a constitutional crisis but did not specify how?

Finally, a guy called in to ask, can you give specifics?

They ignored the question.

Just because you don’t like a guy, doesn’t mean there’s a constitutional crisis.

But they did have a sane scholar on to repeat what he has written and said: your only recourse is impeachment (and conviction) and, wait for it, ELECTIONS.

So win the House and get to 67 votes in the Senate and you can remove Trump . . . and get President Pence, which I don’t believe they really want anyway.

That’s a great point. The DA is a political position. Harrington won because she had a strong political machine backing her (and lots of hoity toity liberals in places like Williamstown and Gt. Barrington where the 1% hide and plan their political agendas.

A vote has nothing to do about who is more qualified, etc. It has to do with who has more sheep spreading their name and how many other sheep they can sucker into voting for them.

Look at the photos of Harrington the Senate Candidate and Harrington the D.A. Get rid of that blight mayor. She won’t last the full term without Krol holding her hand

Dan, you lay the options out very nicely, but here is one more for Cacc – Walk away in January with a pension close to $100,000 per year, instead of running, or asking to go back to first assistant. Of course, if he runs and gets in and does 3 years, his pension will be closer to $140,000 for life, like Capeless’. The DA job pays 171,000 per year, and Capeless is raking in 75-80% of that for life. On the other hand, why would Caccaviello care if it is a kiss of death if he mounts a write in? He is not a politician, and would not be interested in running 6 years from now anyhow.

Here is another thing to consider – any member of the Mass bar can run for DA as a write in. That means another prosecutor, or an ace defense attorney, or any stumble bum of a lawyer, of which there are plenty, who can get out the vote like Harrington, can run, as long as the person lives in the county.

https://malegislature.gov/Laws/GeneralLaws/PartI/TitleII/Chapter12/Section12

None of the votes she got in September count. It all starts over.

There is a huge budget and lots of jobs in that office, and none of them are union. I really doubt Harrington, or any outsider who gets in, is going to play nice and keep all the employees.

http://cthruspending.mass.gov/#!/year/2018/explore/0-/cabinet_secretariat/DISTRICT+ATTORNEY/0-/department/BERKSHIRE+DISTRICT+ATTORNEY+(BER)/0-barChart/appropriation_type/(1CS)+DIRECT+APPROPRIATIONS~SUBSIDIARIZED/0-barChart/appropriation_name/(03401100)+BERKSHIRE+DISTRICT+ATTORNEY'S+OFFICE/0-barChart/object_class

Hats off to Harrington, she campaigned hard, and banged on my door so hard, she could of woke a heroin addict on the nod. She is quoted in I Berkshires this morning stating “I didn’t run to win this election. I ran this race to transform the community,”

God help us if she will be as soft on crime as she campaigned on. The only transformation Pittsfield needs is to go from “bang, bang shootem up gangland” to a nice Berkshire town again. You don’t get there by playing catch and release with drug dealers, and we all know that “non violent drug offender” is really code for “drug dealer we feel sorry for”.

Is there a dark horse candidate out there that is going to come in and save us in November?

SisterGoldenHair

Hey U,

He can retire now and get about $100,000 and not work. Capeless is raking in about $140,000. State has website with all the salaries.

And you’re right, Cacc is not a politician, and didn’t campaign like one, and Harrington is a politician, and campaigned like one.

When someone can retire at 53 and rake in a pension of 100k it underlines what is totally wrong with the pension system.
If you added up what he’s put into his pension I wonder if it would even be enough to pay for 2 years. The rest is on the taxpayer. Sure, let’s pay people not even close to retirement age not to work. That should work out just great.

No one is talking about “figuring a way around it”, but just looking at the possibilities of a write in campaign to beat her. What is wrong with that? She did not win the general election mind you, but just a primary. That means if a single challenger runs against her in November, and gets 1 vote, and no one votes for Harrington, that person wins. Harrington doesn’t have a lot of experience and will be a rookie on the job. She could actually use the help of Cacc, but obviously I doubt they would be able to work together or even want to try.

Time will tell if crime goes up in the next 6 years, God forbid, since Pittsfield and even North Adams are on the front lines of this serious crime problem. Williamstown is generally a low crime area so has little to worry about one way or the other with their mostly wealthy population. Violent crime is rare in Williamstown so either way that town has little to worry about if Harrington’s new approach doesn’t work.

It’s the wealthy Progressives who are really working overtime to get everybody fighting over race. They accuse white people of being racists over just about any issue you can imagine. Then they run off to their mansions giggling over all the chaos they are stirring up. They have contempt for the middle class because really they see themselves as being superior which is why Hillary had no sympathy for the struggling middle class. She just referred to them as deplorables.

Even in Obama’s speech today, he makes no mention of the struggles of the slowly disappearing middle class. The real problem in this country is racism in his opinion. Not lack of jobs or jobs being replaced by technology….no racism is the problem. This is why so many in this country are disgusted by these wealthy Progressive elites.

I checked with experts about a write in candidate procedure. Any one from any party can run as a write in candidate. If they Run an organized campaign they must announce their candidacy to the public in the communities where they will be seeking votes. Cacaviello and Knight can definitely run a write in campaign as can anyone else. That being said. If I were Cacaviello I would definitely run. He beat the gobsigs in Pittsfield by 600 Votes and that in itself is the handwriting on the wall that the erosion of the gobsig network has finally started. He should run win this. Every one should talk to as many people as they can to elect him so that we don’t have another idiot running the DA’s office like we have running the Mayors office. Be sure to vote in Nov. Because every vote is needed to out the gobsig backed candidate Hering Tot.

I spoke to the G man and he thinks that Cacaviello with Knights endorsement definitely can beat Harrington. With the election less than six weeks away Cacaviello needs to announce now and go all out. Because she is so totally unqualified he would be doing everyone a favor and he will definitely have city support. The one and only problem is the unsophisticated voter who would need to be educated to write in a name as they are so used to filling the circle.Other that the G man says Go For It. Another thing the G man asked me to post is his present water and sewer bills and what they will be after the cite spends 150 million dollars for not needed work at the s/w plants At his home on west st. He presently pays260.74 per quarter or 1042.96 per year. In the future after updates he will pay 2085.92 per quarter or8343.68 per year. Yes I know you are shocked but G has been stating this all along talking about a factor of 8 Well here it is in dollar and. cents.Look at it again. I have to go now but I will post more when I return.

Imagine giving out five year contracts without C C approval, and giving a half million to Covanta?

The Berkshire County’s most infamous criminal case was the framing of Bernard Baran, whose life was ruined by two corrupt then prosecutors. The two prosecutors were now Superior Court Judge Daniel Ford and the former Berkshire D.A./late Gerry Downing. They used homophobia to bias the jury against an innocent man. They had audio tape recordings from then children who said Bernard Baran wasn’t the man who sexually abused them. Gerry Downing hid those tape recordings as a prosecutor and then throughout his tenure as Berkshire D.A. It wasn’t until after Gerry Downing died that then Berkshire D.A. David Capeless released the exculpatory evidence showing Bernard Baran was framed.
While I don’t trust Pittsfield politics, after reading about how an innocent man was framed and his life ruined, I really don’t trust the Berkshire County District Attorney’s Office!
I hope that Andrea Harrington is a woman of her word and she will bring back integrity to an office that has many hidden and terrible secrets.

You left out part of the story. After the exculpatory evidence came out and it became clear a travesty of justice had taken place, Capeless still fought for another 5 years to try to keep Baran in Jail, finally dropping the charges for good in 2010.

That is a twisted man. And one who should not be allowed to anoint his successor, which is what motivated many anti-cacc voters.

And for this type of protected travesty of justice there is no penalty, but hopefully there are really bad dreams haunting those involved. And they may think that the community is unaware or does not care or does not know that is was they who was involved. Not so.

Dusty – Well put. Could not agree with you more. I think it’s time to revisit the concept of “complete immunity”, which protects people like Capeless even when it is apparent, and provable, that they behaved unethically. Until that time comes, it is essential that we elect DA’s with character and integrity, above all other qualities.

Obama should go back to retirement and have the respect to not speak out like other former presidents have done. All he is doing is repeating the far left agenda of blaming all of our problems on racism. Obama hid all of his behind the scenes activities in what we now know was an administration that was NOT transparent at all during his time as president and the adoring liberal media never questioned anything.

California will be giving free health care if it has its way. Cynthia Nixon running on single payer health care with no way to pay for it, but she will worry about that later. Open borders are needed according to many on the far left which will pose real DANGER for our country. For these people two and two really doesn’t equal four. There is no logic. They are short on details, but big on crazy ideas.

Unbelievable that Obama taunted Trump with “What magic wand do you have? since Obama’s economy was terrible with low GDP, bad job numbers, and an overall bad economy even toward the end of his term. After 2 years of President Trump we have a booming economy, but the far left wants to impeach him because he is crazy according to them.

The far left needs a bad economy to keep people enslaved to big government. Having lots of people who are not dependent on big government assistance for their very survival poses a threat to the far left agenda.

After reading some of the essays on the “Free Baran” web-site, I thought about the alleged child sex abuser former Berkshire County Sheriff Carmen C. Massimiano, Jr.
What happened during Carmen Massimiano’s youthful days at Camp Russell?
Did Carmen Massimiano really fondle a then 7 year old boy in the early-1970s?
What is the true story concerning Carmen Massimiano’s alleged sexual deviancy with boys?
If it is all true, why did Carmen Massimiano get away with it, while Bernard Baran was framed and his life was ruined because of it?
What does all of this say about criminal justice in Berkshire County?

Progressives like to elect people like Harrington and Tyer because of their lack of experience. They are more easily manipulated by their progressive leaders at the top. How long before we are hearing crazy ideas about sanctuary cities, easing up on prosecuting for what they consider minor crimes like shoplifting and property damage and drug dealing so they can concentrate on violent crimes? Because we all know that if you ignore minor crimes we end up with more violent crimes. Ignore drug dealing and you end up with more drugs and people committing violent crimes in order to afford their drugs.

Rachael Rollins is a big far left supporter of Barack Obama. She is running for district attorney in Suffolk County. She is all about leniency for 15 crimes that she considers minor so she can concentrate on the more violent crimes according to her. Ignoring drug dealing in my opinion encourages more drugs which lead to violent crimes so people can afford their drugs.

This far left agenda led by Barack Obama and his crazy followers needs to be exposed for what it is…..DANGEROUS. All of the other crimes that she wants to ignore are bad too and could turn a community into a war zone if these crimes are ignored. Ignoring property damage? Really!!??!! Ignoring shop lifting?? That will quickly turn a community into one big crime scene. These people are truly INSANE.
