(FORTRESS OF SOLITUDE, WEEKEND EDITION, NOV. 7-9, 2014) — In honor of nothing and everything, THE PLANET features the lines of a poem we recently wrote inspired by Percy Shelley‘s “Ode to Liberty.” As with “transparency,” liberty is a concept that TES finds scary and threatening in the extreme. As to precisely why, we shall leave that to the armchair psychologists. Suffice it to say that what MTV is to teenage girls, liberty and transparency are to the mayor.

With that preamble behind us and the glorious weekend having begun and existing mostly ahead of us, we present our humble work.

THE RECALL: AN ODE TO HOPE or A HEAVEN OF GIDDY STORMS: A PITTSFIELD TALE

I

A bedraggled people endure once again

the bungling of the mayor: to have hope expire and die

from heart to heart, from precinct to precinct, over wards in vain,

scattering wasted votes like buckshot fired into the sky.

Their souls one day, we pray, will spurn the chains of their dismay,

and in the recall vote of TES that won’t take long

find their dignity, Mary Jane and Joe — sublime and strong.

We The People and The Little Guy, serene, shall spring forth

from the mayoral nightmare, who in the political abyss shall be hurled

while recovery shoots to the ceiling of hope, finding its worth

on that island of sanity in the ocean of the city’s mad political world. 

II

This divine municipal universe,

granted, is now a curse

for hope and freedom were not: but power from “worse” producing “worst,”

The Suits and TES, with the spirit of beasts kindled there,

of suckups and of other “watery” forms —

but there is war among them … and despair

within them, for We the People will one day sue without truce or terms

to reclaim the body of the sacred, violated dream.

And The People said, “Let their beasts war on beasts, their worms on worms

their men on men. As for us, our hearts shall be a heaven of giddy storms.”

Secretary of State Galvin’s Office Finds Degnan Negligent Re: Clairmont’s Request for Public Records

Now we share some breaking news.

One of THE PLANET’s Z-Agents uncovered this while mining the state’s website. It’s a letter from Shawn Williams, supervisor of records for the secretary of state’s office. The letter is addressed to city solicitor Kathy Degnan (and, of course, by extension, the mayor). The subject of the letter is an appeal by councilor-at-large Barry Clairmont‘s regarding his initial request for public records on 100gate.

The large finding is that Degnan and the city (read “The Mayor”) failed in its job as custodian of the public records to respond correctly to Clairmont’s request. The letter, dated Nov. 5, 2014, orders Degnan “to provide all remaining responsive records” to Clairmont.

The wording from the secretary of state’s office is bureaucratic polite-speak for: “Hey, you crud — We found you guilty of evasion. Send the info right quick, if you know what’s good for you.”

I have received the petition of Barry Clairmont appealing the response of the City of
Pittsfield (City) to his September 2, 2014 request for public records. G. L. c. 66 § 1 O(b ); see also
950 C.M.R. 32.08(6). Specifically, Mr. Clairmont requested copies of email and written
communications between City departments regarding rental space located at 100 North Street.

In an October 7, 2014 telephone conversation with an attorney on my staff, you stated
that in its initial disclosure of responsive records, the City inadvertently failed to provide Mr. Clairmont with copies of all records responsive to his request. You further stated that the City subsequently provided Mr. Clairmont with copies of responsive records. 

It is important to note that it is the duty of a record custodian to use her superior knowledge of the records to assist a
requester in obtaining the records. 950 C.M.R. 32.05(4).

In his petition to this office, Mr. Clairmont stated that the City provided duplicate copies
of certain records and copies of unresponsive records. In response, you informed this office that the City provided Mr. Clairmont with copies of requested records, and furthermore, the City removed duplicate copies of the responsive records and did not charge Mr. Clairmont for copies of duplicate records.

Right of Access; Fees

In his petition Mr. Clairmont also noted that he is a member of the City Council. Please
note that Mr. Clairmont’s personal status as a member of the City Council does not afford any
greater right of access to the requested information than other persons in the general public. The Public Records Law does not distinguish between requesters. Access to a record requested pursuant to the Public Records Law rests on the content of the record and not the circumstances of the requester. See Bougas v. Chief of Police of Lexington, 371 Mass. 59, 64 (1976).

Mr. Clairmont also queried whether a custodian of records could charge a City Council
member for copies of public records. As the identity of the requester has no bearing upon the public status of records, likewise it has no bearing on whether any fees should be assessed.

Attorney-Client Privilege

In an October 15, 2014 telephone conversation with my staff attorney, you stated that the
City withheld two responsive records pursuant to the common law attorney-client privilege.

The Public Records Law states that “the burden shall be upon the custodian to prove with specificity the exemption which applies.” G. L. c. 66, § 10(c) (emphasis added). See also Globe Newspaper Co. v. Police Comm’r, 419 Mass. 852, 857 (1995); see also District Attorney for the Norfolk Dist. v. Flatley, 419 Mass. 507, 511 (1995).

The response by the City did not contain the specificity required in a denial of access to
public records, as this denial was not provided in writing to Mr. Clairmont. To comply with the specificity requirement a records custodian must cite an exemption, and specifically explain the applicability of the exemption to the requested records. I find your telephone conversation with my staff did not satisfy this burden with respect to the City’s attorney-client privilege claim.
Accordingly, the City is hereby ordered to provide all remaining responsive records in a
manner consistent with this decision and the Public Records Law. If the City intends to withhold any records pursuant to the common law attorney-client privilege, Mr. Clairmont must be provided with a privilege index, as mandated by the Supreme Judicial Court. See Suffolk Constr. Co., Inc., v. Div. of Capital Asset Management, 449 Mass. 44, 460 (2008).

This administrative appeal is now closed.

And so we find The Bianchi Administration, again, red-handed with its hands in the Cookie Jar of Obfuscation and Dishonor, a lack of transparency, and caught in the act of trying to dodge a fair and honest request for public documents.

No surprise there, eh? Who’s for storming the gates of city hall and initiating a coup?

It’s a slap, but not a coup. Simply instructs the Mayor to either supply the disputed docs or inventory them as privileged. End of appeals is for both parties. Don’t hold your breath waiting for them to materialize unless the atty-privilege protection does not apply.

Clairmont’s complaint regarding the fees was dismissed as well.

Does Degnan work for the citizens of Pittsfield or as the empty suits personal lawyer?

Did she get herself and the city in hot water by walking in lock-step with the mayor in support of his “lockdown” of information illegally?

Is she competent? Mayor Ruberto did not think so.

Will the mayor’s muzzeling of the press bring him down as it did Richard M. Nixon?

The more information this mayor tries to hide from the people, the more they want to know and all the more reason to expose his dealings.

He ran on transparency. What a Joke!

Mr. Corrupt Mayor is a sleazebag. Degnan leaves a lot to be desired. There is more wrong…than..right in this administration.

Yes it just shifts the addiction from the street gangs like the bloods and the crips over to the govt.

The methadone clinic is dependant on heroin addiction to get new recruits.

It’s not illegal to be high it’s illegal to be in possession unless you’re driving or operating machinery. But yes they are getting people who are hooked on an illegal drug to be dependent on an approved legal substance. I don’t really see the difference. I say just make all the crap legal and end the war on drugs.

I truly felt bad for Degan early on when she was being belittled. But she does seem to be just another cog in the wheel of injustice. But I guess that is what lawyers do. By the time Bianchi gets out of office no one in city hall will have a respectable name for their children to uphold.

In the letter sent by the Secretary of States office,the lawyer quoted law after law to back up his argument to our city solicitor . The responsibility for good governance ultimately rest at the mayor’s feet.Throughout Bianchi career in politics he was a persistent pusher for openness and transparency in city governance .How can we be taken seriously as a city when are branches of government don’t do the daily checks and balances that our founding fathers purposely put into the system to protect against the abuse of executive over reaching.

The council president job is to run the meeting,not to defend the mayor or stop tough questions from being asked that might put a light on abuses of power.
I find in quite troubling that Mrs Mazzeo can have fundraisers with the mayor and say she is free thinker when her actions from her seat on Pctv and her many editorials call into question where here loyalty truly lies. 3000 well meaning citizens voting for you is not a mandate for running roughshod over process.

I also find it deeply troubling that with a city in crisis with drug abuse,gang violence
working poor, lack of affordable housing ,a declining school population ,declining city population and disenfranchised elderly population. The city youth are already burdened with student debt along with their parents and are working multiple jobs to stay afloat. What angers me the most is that after seeing this taking place in the city Mr Bianchi says he love and wants to serve,He not only lacks empathy but lacks leadership along with his followers by putting his needs along with his followers above a greater good. Example : 100 gate, city health care , and most off all the audacity to reward himself and other officials with pay raises when nothing has been done to deserve them fiscally or morally.

Bianchi, Mazzeo and Degan all seem to be working against the people who elected them.
Veterans day is Tuesday. It breaks my heart to to think of all the men and woman who suffered and died so that America could be free and be governed by people who would do right by them. I think of my friend trudging through the rice patties wondering if a sniper has him in his sights, wondering if he will ever see home again.

And I wonder how people can dishonor them by taking elected office and trashing everything these brave men and woman fought for. Selfish, pathetic and disgusting. They need to look at themselves in the mirror and ask if they like the person they have become.

So why does the Supervisor of Records, Shawn Williams, say the appeal is “closed”? Its not closed until the mayor’s office complies with the request and either supplies the records or shows the basis for attorney-client privilege. I gather nothing has happened. Williams doesn’t give a deadline for compiance or state any penalties for non-compliance. Keep at this Dan, the records need to see the light of day..

The mayor is above the law and does not need to answer to anyone.

He can spend taxpayer’s money, change insurance companies, and do whatever he damn well pleases. Without city council approval or obeying the State Attorney General’s office.

There is little or nothing anyone can or will do about it.

Mr. Valenti, kudos to you. You have lit the proverbial fire under the Eagle. I have followed your coverage enough to know that were it not for this story, the Eagle would never have published its page one lead today. You are the area’s best journalist.

Greatly enjoyed the poem as well. I’ve lived in many parts of the country. I don’t know if the locals truly appreciate what they have in a talent like you.

Degnan has probably consulted with a real attorney to try and figure out how they can claim attorney-client privilege so as to save the mayor’s ass from this dirty deal.

Unless the emails get “doctored” they do apparently expose Mr. Bianchi.

Also all the details of the Monterosso payoff should be publicly known. If they used city taxpayer money to give to him, then the city taxpayers have a right to know how much and why it was given to him.
You cannot simply say its a private matter or claim attorney-client privilege there also.
Using taxpayer money and then hushing it up amounts to taxation without representation.
What would he the difference if the mayor just wrote himself a bonus check for $150,000.00 and when people started asking questions, just say its a personal matter. Hush up. Attorney-client priviledge. Lockdown. ??

Everything is Dan Bianchi’s fault! Homelessness, hunger, disease, poverty, corruption, inequality, injustice, and all other problems past, present, and future, it is all Dan Bianchi’s fault! When Dan Bianchi became Mayor of Pittsfield in January 2012, Pittsfield politics was an utopia. Everything was perfect in Pittsfield politics. Then, Dan Bianchi caused all of Pittsfield’s problems in less than 3 years time. Dan Bianchi is the Antichrist who will try to take over the World through military domination until Dan Valenti comes back to life to fight him and rule Earth for 1,000 years of peace. Dan Valenti will save us from Dan Bianchi.

Every times he spends tax payer money irresponsible, he takes away from the hard working class. All this administration has done is gave away our hard earned dollars to does that all ready have. Bianchi took a city that was in condition “x” after Ruberto left office.

We can dispute what “x” was, great, good, fair, poor. I think it was good. But whatever we agree “x” to be there is no questions wahatsoever that Bianchi too over and basically destroyed the city and good govt.

I agree with DV and many others, Bianchi is the worst mayor in city history.
