(FORTRESS OF SOLITUDE, MONDAY, APRIL 27, 2015) — The Founding Fathers wisely built into the framework of governance a separation of church and state. Having seen what centuries of corrupt Prelate Power did to Europe, they didn’t want religion to have institutional claim over the fledgling nation.

That prescient decision wasn’t meant to be one directional, a weak argument offered by those who wish no such separation. These revisionists claim the constitutional provision exists only to prevent religion from temporal rulers. That much is true, but the provision also works the other way, to keep priests, clerics, pastors and the like out of the affairs of government.

Another false “argument” offered by “churchists” refers to constitutional language. Nowhere, they correctly point out, does the Constitution employ the phrase “separation of church and state.” This line of attack is easily defeated. First, constitutional language is about “legislative intent” and not about parsing words, especially those not there. What do the words mean? That is the question. Second, we can also point out that the phrases “separation of power” and “checks and balances” similarly do not find a place in the Constitution, “but no one would aregue that the concepts are not there, embodied in numerous provisions” (scienceblogs.com, 12-5-2003).

Victory Is Sometimes a Lien Thing

This leads us to the tax position of the Victory Temple Church of God in Pittsfield. The church owes the city $22,433 in back taxes. Tax-exempt status doesn’t arrive automatically to any church. It’s not baby Moses in a reed basket, or Charlton Heston for that matter, washing up on the shores of the Nile, unsought. A prior church on the site did not obtain non-profit status. Before that, a deli at that location rendered unto Caesar.

Victory Temple applied for and received 501(c3) license, given to corporations as a means of legally avoiding taxes. Where, then, do the tax bills originate? The city says they are for unpaid water and sewer fees going back 35 years, accumulating interest. Non-profits may get off from paying property taxes, but they must pay for water, just like you do. You try ducking your water and sewer levies for more than a generation. You will soon join the drunks in a chorus of, “How dry I am.”

The city, seeing a large chuck of money fairly owed, has gone after it. Bravo.

THE PLANET sides with the city on this one, and we give full credit to Mayor Dan Bianchi not just in this case but in his pursuit of unpaid tax bills. This is the Dan Bianchi we knew and loved for his 10-year tenure as councilor in Ward 6, and it’s a welcome sign of life from the corner office. Perhaps there will be more to come?

The city is willing to work with the church on a repayment plan if the Victory can pay 1/4 ($5,608) as a deposit. That is more than fair. The co-pastors of the church, Charles and Missy Pratt, have begun an online appeal for donations. That is to their credit. However, calls for Pittsfield to excuse the church from the bill are naive and fraught with misplaced do-gooding.

THE PLANET gives Bianchi full credit for his handing of a long-ignored source of revenue. Tax deadbeats have for far too long escaped unharmed in Pittsfield, and his actions have at least recouped some of the money.

Delinquent tax “payers” have cost the city about $10 million. Think about that, Mary Jane and Joe Kapanski, as you work hard and even go without to remain current on your levy obligations, being the decent people you are.

Municipal debts in arrears can be pursued directly or sold in auction to collectors, who then can try to collect the full amount plus interest or foreclose on properties, taking legal ownership. To date, according to the mayor’s office, the liens to 290 delinquent properties have been sold, recouping $1,146,807 for taxpayers. The next such auction is slated for May 26. The reason so many properties have been seized by the city and are up for auction is because taxes are already too high. At one time there was no separated water bill. Some day soon there will be a separated trash pickup bill.

If you truly owed your property, there would be no way for the government to seize it.

.70 cents of every single dollar you pay to the city of Pittsfield goes to school system – whether you have children or not. Basic road maintenance and maintenance of city owned property is not being done.

If the answer is to keep raising taxes that are already too high and then seize the property on those who can no longer afford to pay them and sell their property to keep this going, then the people have lost. Communism is where you give all your money to the government, they own everything and give the people a Pittence to live on. Sales taxes are fine. Income and property taxes should be abolished. Government work should be voluntary and free. Parents should educate their own children. City government should only provide necessary basic services.

But I guess those seized properties had to be sold to raise the money to give to Monterosso, Scarafoni and the Meth clinic. The Kominski farm had to be seized and the pristine wet lands had to be filled to expand the airport. The Colonial theatre just had to be restored and a new Taconic just has to be built on toxic land. After all, these are basic services.

When I read about the church (?), I was first astounded and then angry. How and why was this failure to pay water and sewer taxes allowed to go on for so long? Can you just imagine what would happen to the rest of us if we tried that.

And how many other “Pratts” in this city are getting away with the same thing?

I am tired of my taxes subsidizing those who fail to live up to their obligations, for whatever reason.

Like Spider I am also wondering how they could get away with not paying a dime for water and sewer for 35 years. Make em pay up just like any other user.

I am going off topic here. However, I just received a letter from the office of the mayor which stated that “our highway crews are working to address each street’s needs in the best manor possible”.
I would like to thank Chris Connell for persevering and getting East New Lenox Road back in reasonable condition.

Before the church was there it was the biker gang “The Warlocks” club house and before that a mom and pops store called Horelli’s (?) Market. Don’t ever remember a deli there. Mr Horelli would pay some of us neighborhood kids a nickel for every sucker fish we could catch in the springtime out of the nearby Housatonic river. He used them to fertilize his garden.

Good luck to the Pratts. I am sure the neighborhood would not want to see them go.

I hope all these tax delinquent properties are being treated equally. There is a huge one out in West Pittsfield on rte 20 out past Pittsfield Lawn and tractor on the other side. May have started out as a car dealership and then a restaurant 30 years or more ago. Property has been delinquent forever and is an eyesore at the gateway to the city. If a regular person owned this the city would have taken it years ago but some people get a free ride.

I think I’ll create the ‘Church of the Valenti’ so that I can escape taxes too. You can all stop by and worship the statue of Dan I’ll be putting up. Afterwards, I’ll be passing by the collection plate so you can contribute to my cause of keeping your money and not paying any taxes.

My feeling is this. The city is in desperate need of a different kind of leadership. I do not know if Mr Gaetani is the answer or not. Perhaps he is off the wall.

But my guess is that he is not going to get fair and balanced coverage in the local newspaper or on Mr Krols radio show or any other special interest controlled venue. He may have felt this blog was a good place to start as there are some intelligent and objective thinkers here. But the haters landed on him right off the bat as though they felt there was a big basket of awesome mayoral candidates to choose from.

He seems to care about the city. He seems not afraid of the power people. That is a start for me so I am going to give the man a chance. There have a been many eccentric but intelligent men.

And if he is a Viet Nam vet you people trashing him should be ashamed.

Dusty: Big news flash! The people questioning Craig Gaetani are veterans. He has made some some large claims. All we ask is that he answer some basic questions. He certainly would not be the first politician to embellish his military service. Since when is asking a simple question something to be ashamed of? Mr Gaetani has not provided any answers or proof of all the claims he has made.

It is time for a drastic change in local government !
We have tried the ” Good Ole Boy Network”,
Then we had this administration which most of us can agree has failed us
It is time for a drastic change and I for one can’t wait. I just hope that people have follow through and elect a whole new government, and not be afraid of the change.
It’s time to get a clean house in government!
It will be people like the Larrys in Pittsfield that keep us from change and moving forward!

This is one of the areas the city of Pittsfield needs to become transparent. From my understanding you would be surprised at who owes the city back taxes. Also I understand some businesses helped out by paying back taxes before an investment was lost. I think the city should post who didn’t pay their taxes 3 months after the due date. This way people who owe will know and the people who vote will also know the freddie freeloaders of the city.

Baltimore, Maryland mayor is an idiot, but will keep her job since she is a Democrat. She is telling police to retreat and let them riot. I bet Obama is also behind this retreat tatic as well. This sets a bad example as these thugs roam from city to city whenever there is racial or police tension, they steal tons of loot and take off with it not to mention destroying American cities. The police should not allow this to continue. I think there are some bad local people there as well and they are being stirred up by the professional agitators. Where is the leadership in this country?
