OML VIOLATION PUTS FY16 BUDGET IN JEOPARDY; MAYOR-ELECT STEPS UP TO THE PLATE: ‘A MISTAKE WAS MADE BY MY OFFICE’

With that coded reverse-coda dispatched, THE PLANET presents mayor-elect Linda Tyer‘s response to the AG‘s recent finding that the Pittsfield City Council broke the state Open Meeting Law on two occasions. The two complaints were filed this summer by former school committeeman Terry Kinnas regarding improperly conducted FY16 budget meetings.

Tut, Tut … But, But

The AG slapped council president Melissa Mazzeo on the wrist with a “tut tut tap tap.” She and her colleagues typically laugh off such law breaking. What, follow the law? This is Podunk. Why would we do that?

Why do that? Simple. Because these violations occurred during budget deliberations, there’s a chance the FY16 budget itself might be derailed.

This budget is the final one filed by mayor Dan Bianchi. As we have previously seen, he left Tyer the problem of funding the final two years of the new public school teachers’ contract, building in raises of  more than 15%. Now the AG’s office tells THE PLANET that on the basis of the illegal hearings, the state could declare the budget process null and void.

Welcome to Podunk.

Questions and a Refreshing Response

THE PLANET asked Tyer four questions:

1. What do you make of the AGs ruling?

2. Does it surprise you?

3. What is the city clerk’s role in compliance regarding public meeting posting and the OML?

4. As mayor, what do you intend to do about these repeated violations and disregard for lawful procedure.

THE PLANET presents her remarks in full:

“Thank you for giving me the opportunity to comment on the attorney general’s ruling, the role of the city clerk, and my intentions as mayor.

“The attorney general’s ruling is fair.  In this case, a mistake was made by my office and it was not intentional.  In our defense we have literally hundreds of meeting postings every year and this is the first time since 2010, when the Open Meeting law became effective, that a clerical error was made by my office.  In this particular situation, the proper notice was posted on the bulletin board outside of my office.  The mistake occurred when the meeting dates and times, without the specific topics of discussion, were posted to the city’s website and electronic bulletin board.  These two posting locations are meant to comply with the “at all hours” provision of the Open Meeting Law.

“Pursuant to the open meeting law, one of the responsibilities the city and town clerks is ‘to post in a location conspicuously visible to the public at all hours in or on the municipal building where the clerk’s office is located; or if an alternative posting method, such as a website, has been adopted, at the alternative location, with a description of the alternative method posted in a manner conspicuously visible to the public at all hours on or adjacent to the main and handicapped accessible entrances to the building in which the clerk’s office is located. Meeting notices must also be available in or around the clerk’s office so that members of the public may view the notices during normal business hours.’  In Pittsfield, we post notices in three places:  on a bulletin board outside the city clerk’s office, the city’s website, and on an electronic bulletin board that has been placed in a window near the handicapped entrance to city hall.  As you can see from the attorney general’s ruling, the City of Pittsfield has not notified the attorney general that it is has adopted an alternative posting location.  I was unaware that this adoption and notification was required.  I’ve learned something new from this ruling.  At it’s first meeting in January, I am going to recommend that the city council adopt an alternative posting location that will apply to all public bodies.

“Finally, as mayor I am committed to working with the incoming city clerk, Jody Phillips, to ensure that the city is in compliance with the open meeting law.  I would not characterize Pittsfield as intentionally disregarding lawful procedure. There is a human element to the work that we do.  Mistakes may happen from time to time and when they do we will continue to take corrective action.”

THE PLANET applauds Tyer’s willingness to respond, something her predecessor refused for the final three and a half years of his term. We also find Tyer’s willingness to own the problem refreshing. This type of honesty bodes well for her executive tenure. However, Mazzeo as council president bears equal share of blame. She should not have allowed the meeting to be held. She should have conferred with Tyer, reposted, and conducted a proper — that is, a legal — hearing.

But as we say, this is Podunk.

What does LT think of MM taking that $500.00 freebie? Did she tell MM that she couldn’t take it when MM disclosed that she intended to take the tickets?

Linden Tyler–When mazzeo accepted that ticket from the colonial, she did indeed break the law. Do you remember who took the time to file criminal charges, against her? Thats right–Mr. Gaetani. The suit was swept under the table but Mr G, plans to resubmit it in the new year. Yes– This is why like Mr. Gaetani. Always out there trying to protect the taxpayer.

“I did not pay for my ticket,” Mazzeo told THE PLANET. “I was an invited guest. I disclosed that I was attending the event with the city clerk’s office. The letter is on file. … It was a great evening and show.”

So, did the city clerk know this was a violation? Did she advise MM not to accept the freebie?

Hats off to the mayor-elect for stepping up to the plate and owning the problem rather than ducking, bobbing and weaving. Her reply knocked it out of the park. It is as though a professional PR person wrote it, and yet I think that she wrote it, and meant what she wrote. Perhaps she will finally be the mayor in shing armor this city so desperately needs. She campaigned on crime as her number one priority, and promised to address the problem. So did Ruberto and Bianchi, Crime got progressively worse during their tenure but of course neither would admit it during their re-election campaigns. Neither did much more than spend money on the wrong things, as the problem worsened. Ms. Tyer is lucky the city was awarded the huge privately funded grant for youth violence, and so are the taxpayers, because her youth violence reduction plan would have been coming out of taxpayers’ pockets and not worked. She has four years to do what she said she would. Actions speak louder than words. Will she talk to the right people to get the right answers and will she then make a proper plan and execute it properly? Will she run around being a ceromonial mayor or will she get down to the people’s business before it is too late? Will she stop the bleeding, literally and figuratively? Or will the city continue its steep downward slide into Scumville? Spending millions on a high school we can’t afford and don’t need does not demonstrate that crime reduction and prevention is your number one priority. I hope she is woman enough to sdmit her mistake for supporting that project, and demonstrate by her fiscal actions that public safety is her number one priority. I will leave you all with this – How many murders, shootngs, robberies, and house breaks are acceptable in Pittsfield? How many have we had this year? Who is ultimately responsible for reducing or preventing them? Come 4 Jan she is.

It would be so great if the raises were taken away from the teachers due to the illegality of the meeting. This process was shady to begin with and it would be karmic justice if the whole process had to be done over this time with the public having full knowledge of what they were previously trying to sneak by the public.

Hey Pat, as I have posted repeatedly here, those step raises have existed in the contract for decades now. “Taking away the raise” would mean solely taking away the “new money” added to each step which was not very much. Certainly something, but the real increase come from the going up a step every year they live and breathe.

It is refreshing that Linda responded with candor. That is a good start. Especially after 4 years of Mayor Lockdown’s draconian policies. The people were right to vote him out.

As city clerk, her level of expertise was off the charts. I suppose that even if the budget were declared null and void and a do over were scheduled to make it legal, the same city council members would just vote the same way as they did in the illegal sessions.

Linda Tyer may just surprise us all and turn out to be a great mayor. Let’s hope so. Give her a chance. We will see. Pittsfield’s first 4 year mayor. Ruberto and Bianchi gone…..Mazzeo stripped of the presidency…. there are reasons to be optimistic. The lovely Linda has to play the cards she was dealt.

I can’t believe what was just read? So the Mayor elect gets a pass on a critical error? If Terry hadn’t inquired about this mess would she have come forth with a swing at the plate? At best, if we take her on her word it was a mistake, the timing of all this from the contract to the budget to Terry finding his inquiry to be true, leaves doubt and skepticism, not accolades, Tyer didn’t do her job.

It takes character to own up to your mistakes. Linda has openly admitted she has learned from this. This allows her to grow. Do you think Ruberto or Bianchi would ever admit to their mistakes?
Not bloody likely.

The budget should be declared null and void. The meetings should take place again. Legally. That would be the correct course of action.

I would recommend supporting Tyer until she demonstrates she is not worthy of our support. Making mistakes is human. Taking proper corrective action is righteous. Covering up, lockdown of information, dirty backroom deals, kickbacks and wasting taxpayer dollars, are corruption.

Maybe councilor Bianchi not mayor Bianchi can resurface and do one thing right on his way out the door. That is, declare the illegal budget null and void and demand the meetings to be held again legally. Not bloody likely.

City councilor. Lisa Tully, displayed her political persona when the BB asked her where she stood on the election/appointment of council president & vp. Her given reply;” If Tyer was elected, I’d support Marchetti. If Bianchi was elected, I’d support Mazzeo”. Can’t lose, I want her advice in Las Vegas.

Seems to me Ms.Tully had just about the most convincing victory of any ward councilor in November.

Regardless of anyone’s opinion of her ability to make a decision, she had less than a 200 people vote against her in her own ward, where two mayoral candidates in the September election had almost 5,000 city voters mark against them.

If we are going by facts and not conjecture, Ms. Tully is the marketing genius, and her detractors are just madder than wet hens.

I work with Tully on the Springside Park Conservancy. She always has her homework done and presents well thought out and practical solutions to issues in our meetings.

Her chutzpah on Tuesday night was refreshing and she got the job done.

As far as voting for CC Prez, her quotes make sense. Why put Marchetti in if Bianchi had been (shudder) re-elected? The council/mayor relationship has been a nightmare recently.

Looking forward to Tyer and Marchetti working together, building consensus and making the best decisions they can for the city as a whole rather than for their BFFs as Bianchi did.

Try something new, make some cuts to the budget. They don’t have to be mind blowing, but something, significant. When I say tax in spend it means raise taxes, expand budget. That seems to be the norm.

Couple corrections: DV you are incorrect – Kinnas is not 8 for 8 -See his complaint against Jake MC dated December 30, 2014 – finding was there was no OML violation – anyhow OML violations are a waste of time unless the finding is that they are intentional, not just a sloppy mistake – time to move onto the some real issues – LT nice response, but we are still in the honeymoon phase and you get a pass…

Governor Charlie Baker is going to have to cut about one billion dollars out of his state government budget that begins on July 1st, 2016. That may mean big cuts to state aid to cities and towns! That may mean to big cuts to public education funding!

The lovely Linda Tyer will have to rely on the useless political hacks on Beacon Hill for state government dollars that may get cut.

Pittsfield politics is reaching its tax levy ceiling and will be unable to raise local taxes. Maybe the lovely Linda Tyer will befriend Bill Gates or Warren Buffett for a fiscal bailout of Pittsfield politics?

How refreshing it is to get a clear, concise, and professional response from Mayor Elect Tyer. It should also be mentioned that she crafted a compromise proposal that was adapted by the city council for the election of the council vice president. There is such a huge gap of intelligence from Tyer to Mazzeo.
