First in a Two-Part Series

[ED NOTE: THE PLANET has just learned that O’Connell Convenience Plus has sold all of its stores to Global Partners LP. The firm, which employs or employed former mayor Dan Bianchi (it is not clear whether past or present tense is appropriate), has been agressively growing its convenience-store presence in the Northeast. Global last year purchased 147 Xtra Mart stores throughout the region. Still too soon to tell if the O’Connell news is in any way related to the following story].

(FORTRESS OF SOLITUDE, DATE, 2016) — “Puff, puff, puff that cigarette.” — song lyrics, “The Smoking Song,” Les Paul and Mary Ford and a lot of others, including Pittsfield teenagers.

If we follow the logic of making birth control available free for teens because they’re going to have risky sex, Pittsfield should make free cigarettes available for school kids because teens are going to smoke — no matter how much we try to convince them otherwise. That way, after they graduate from Pittsfield schools with their worthless diplomas, they won’t have to learn the disgusting habit that provides the perfect adjunct to drinking, drug taking, lottery ticket purchases, EBT cards, criminal activity, and welfare checks.

But no.

Pittsfield wants to create more social engineering programs certain to fail. City officials want to punish selected small entrepreneurs for selling a legal product, while other competitors sell the same product without challenge. We’re talking cigarettes.

Over-Regulation, Under-Intelligenced

Pittsfield’s Board of Health (BOH) has foolishly taken grant money as part of a “me-too” band-wagoner to the Tri-Town Health Department. Taking grant money enables the state to dictate what should be exclusively a local issue. It may be politically corrupt, but it’s politically correct. That’s likely the appeal to Pittsfield’s chief enabler of the draconian crackdown on cigarette sales, BOH chairwoman Bobbi Orsi, a publicity hog and darling of the Totalitarian Democrat Left who has among her many talents the ability to get her picture in the paper every other day.

So came the news that Orsi and her board have denied licenses to sell tobacco products to two Pittsfield businesses, Zuke’s Soups and Variety, and the owners of a new gas station and convenience store at the site of the former O’Connell Convenience Plus Mobil at Lyman and East streets. They’ve done it in the name of The Children. Fewer cigarette licenses = less teen smoking in the BOH’s Common Core-Big Brother math. It probably has nothing to do with providing and protecting the competitive advantage of already established convenience-store chains that may or may not be among The Suits “favored Sons.”

The law to cap tobacco licenses will do nothing to reduce smoking among people who make the bad (but free) choice. This being Pittsfield, the board implemented to new law in an obtuse, secretive manner. As reported by THE PLANET‘s colleague Jim Therrien of The Boring Broadsheet, Pittsfield BOH director Gina Armstrong admitted her deparmtnet failed to properly inform other city departments or any other interested parties of the new regs. Was this done deliberately or through stupidity? What was it, Gina?

Pittsfield to Entrepreneurs: ‘We Don’t Want Your Business’

The owners of the two businesses, Elizabeth Zucco of Zuke’s on West Street, and Naveed Asif and Zameer Alhaq of the East Street business (not yet open), detailed how the city kept them in the dark. Asif and Alhaq, for example, told to board at a hearing last week that no one from the city informed them of the new restrictions on the number of tobacco licenses before they bought the property and made the investment. The entrepreneurs have invested heavily in remodeling the site. (ED NOTE: The city now las 51 tobacco licenses. It wants to reduce that number to 25. North Adams, a city a fourth the size of Pittsfield, has 26 tobacco licenses).

John Benoit, who brokered the deal for Asif and Alhaq, said he went to the Office of Community Development (OCD) to obtain the permits the new business would require. Benoit said no one at OCD knew that new tobacco licenses had been capped. OCD, therefore, did not inform Benoit that there would be trouble in getting a tobacco license.

At the BOH meeting, John Barry, project architect for the new gas station and convenience store, said he, too, was never made aware of the requirement. All Armstrong could muster for the rightly frustrated businesses was, “In hindsight, more information should have gone out about the regulations.” You got that right, honey. Meanwhile, Orsi preened for her close-up.

 Tomorrow in Part Two: Councilor and State Rep. candidate Chris Connell, leading the charge for small business owners, blasts BOH as “really out of control.”

The Mobil should be given the benefit of the doubt and given a License? Zukes as pointed out by Member, Dominica D’Avella had previously violated her License, but this time was robbed and argued she was robbed and lost track of the renewal, she should also be given another opportunity, she won’t do it again, guaranteed. It’s good that the Board is enforcing rules, but a grey area at minimum here.

The Board of Health has no reason to exist, so of course it will create problems to solve. Another example is how they are hassling Dunkin’ over temporary use of one size of cup, suddenly taking a zero-tolerance policy on something no one cared about until crackpot Del Gallo gave them something to do.

Del Gallo has 5 criminal cases against him in Pittsfield District Court. He is “very good attorney”–he managed to dismiss 3 cases and was fould guilty “only” in 2 criminal cases–
illegal Trespass and beating his own parents–elderly, disabled.

Tobacco has been a controversial issue since Colonial times. Even the sociopathic Nazi Germany regime knew tobacco was dangerous to their health and forbid their troops from smoking cigarettes. The last time I smoked a cigar, I had to breath through a tube at Urgent Care in the VA Hospital. I was told never to smoke again, and I have not smoked since then. We would have lower healthcare costs if we banned tobacco, but it would be called big brother or nanny state government. Poor people smoke more than any other group, and the federal and state governments both heavily tax tobacco, which makes it regressive taxation, similar to the lottery and gambling. Big brother profits off of tobacco instead of banning tobacco.

Historical correction, Jonathan. According to Wikipedia… “Restrictions on smoking were also introduced in the Wehrmacht. Cigarette rations in the military were limited to six per soldier per day. Extra cigarettes were often sold to the soldiers, especially when there was no military advance or retreat in the battleground, however these were restricted to 50 for each person per month.”

There was no ban on cigarettes in the German military, but the Germans were admittedly ahead of the curve on research showing the links between smoking and cancer.

Going from 51 to 25 license’s will leave 26 convenience stores boarded up with no chance of re-opening without a license. Then the BOH can enforce the blight laws. Who would want to do business in Pittsfield?

What does it say about our society if a business cannot survive without selling cigarettes? I remember when restaurants said they could not survive if patrons could not smoke and lo and behold people are still going out to eat after all. Whoda thunk it?

What it says is that if your going for a deck if cigarettes and a jug of milk your going to go to a store that sells both. With the restaurants, the same rules applied to all. No smoking if you sell food..

Jim Wilusz is like a bad case of acne, he won’t go away. Ban single sale cigars, then it was regulate e-cigarettes, now it’s raise the age to 21. A question…if smoking is such a major issue, why does theBOH farm out oversight of the issue. All clerks must now have a card saying they passed old Jimbo’s tobacco certification at $25 a pop in order to sell cigarettes and the like. It is now done online, which would probably be easy to set up cheaply ourselves and Pittsfield could keep the revenue instead of sending it to Tri-Town. If it such a major issue, put in some work and create a new revenue stream, what a concept.

Christine Canning of Lanesboro is running as a Republican candidate for the Senate seat. There is an article about her in the BB today. She is saying a lot about taking on school systems that are abusing taxpayer money. Best of all she has taken on the Pittsfield School system before and won as well as the Holyoke School System. I think she is a candidate worthy of serious consideration by Planet people.

What the hell are Xuke patronsI going to do if they can’t get a cig with coffee, it’s the American Way and part of everyone’s morning. Teens should be checked at the Schools doors for a nicotine breath test, if they fail, they don’t get in. On second thought, scratch that idea.

The legal age to smoke (federally) is 18. You know the tobacco giants are not going to stand for this “growing charge” and will eventually start filing class action lawsuits. Does Pittsfield have the money to defend itself? Or more importantly, aren’t their bigger fish to fry for Pittsfield right now than this? While were at it, why don’t we lower the current weight limit of 300 pounds for a Pittsfield Cadillac (i.e.-North Street motor scooter), to 250 pounds. That way our fine, upstanding, large citizens, can “drive” themselves to the corner store for more jelly filled treats. There problem solved.

Wish the health dept would spend more time in restaurant kitchens. I know youths who have worked in several in the last few years and say almost none of them are sanitary. And you might be shocked at who a few of them are. And no I ain’t saying except to say they are not dives.

So seems like somebody is letting things slide.

I watched the O & R mtg. last night. The election may be over and we have a new mayor, but Mazzeo is not willing to accept the fact that Degnan is gone (finally).

The Bianchi forces are still at work trying to undermine the new mayor’s efforts.

Mazzeo’s actions were embarrassing. I suggest everyone watch the reruns of the mtg.

I watched the meeting as well and I really feel sorry for Mazzeo. Beside the fact that the poor woman cannot complete a sentence, she is still depending on the good old boy Bianchi network of lawyers to make a worthless point about the charter.

His was good to see the city lawyer called her on it.

This is going out to Mrs. Z. J W told everyone on a radio show not to over indulge at the all you can eat restaurants, ( not making this up) the point was being made because J W wanted us to eat healthy and the A Y C E was bad for you, so don’t indulge at these particular venues. Anyway, a little while later I was watching Big Jim. On a television show, believe it was P C T V ,B O H meeting, and low and behold, Little Jim had put on some serious pounds. Ya know it would be an economic engine if city hall sold all the cigarettes in the city. If the state is the only one who can operate gambling then the city should be able to monopolize cigarette sales.

Off topic but I got a kick out of it. Every Tuesday in the BB there is a full page ad “Top jobs from top employers”. Today there were 6 entries, 1 from Eden Hill, 1 from Bcarc(a non-profit I assume) , and 4 from the BB. We keep hearing about all these jobs that are available but can’t be filled due to lack of qualified applicants in the area. Well, that tells you what the companies with good paying jobs available think of our local rag.

Looks like the Boared of Health is taking it’s Power way too seriously. They remind me of a Gotcha Squad, that want to use a small Business owner as a whipping pole, in a neighborhood with youth programs and Riverview as neighbors. If there is a Violation, fine them, that would be better than closing the damn business down.

If someone is buying a business, and the business success is dependant on a permit for purchasing ciagarettes to survive, not withstanding, a couple hundred thousand in renovations underground, then you have to make sure you will be able to get a permit. This Broker for the buyer and seller is full of it.

I don’t smoke so I don’t know what a pack of cigs costs but I do know that the State gets $3.51 a pack. What’s the feds cut? How much does the state bring in in cig tax for the demohackaroma in a year? Can you imagine if people didn’t die from cigs what the long term care cost would be…..if we kill em with cigs we don’t have to pay for years in a nursing home, and we’d lose all that cig tax.
