(FORTRESS OF SOLITUDE, THURSDAY JAN. 19, 2017) — Effin’ this and Effin’ that. The F’s have it. F as in failing grade. F as in “farce.” F as in “fake.” F as in Facebook. FF as in “Four Freedoms.” FF as in “Frank Farkas.”

In THE PLANET‘s exclusive coverage of the insult to the Four Freedoms staged by local Democrats a couple Saturdays ago, we included the official permits organizers signed with the city of Pittsfield. One “Frank Farkas” signed off as head organizer, and in what appeared to be an uber-ironic “back of the bus” moment, he made local NAACP head Dennis Powell sign for liability. Why Powell would agree is a matter for another discussion.

THE PLANET invited Farkas to defend his decision to front (another “F”) the march by appearing with us on PLANET VALENTI TELEVISION. Farkas didn’t refuse. He just didn’t respond, hiding as he was behind Judy Williamson‘s skirts on Facebook. Perhaps Farkas doesn’t exist. He has a Facebook page, but so does Jax-Ur from DC Comics’ The Phantom Zone.  Perhaps Farkas is as fake at that.

Churches Can’t Politick , Period

Aside from the intolerant denial of freedom’s rights to those from differing political persuasions who wanted to participate from the dais, the most egregious wrongdoing of the rally’s organizers and enablers was to flout the law restricting not-profit organizations from engaging in political campaigning. At least two Pittsfield churches donated their facilities to this blatantly pro-Democrat Party bund. This, according to THE PLANET‘s read, jeopardizes their Section 501(c)(3) status.

Acquiring 501(c)(3) status has turned into a con game in Pittsfield, one churches have been playing for far longer than most. While Mary Jane and Joe Kapanski must absorb ruinous tax increases year after bloody year courtesy of Pittsfield corrupt politicians and special interests (particularly the teachers’ union), the churches get off scott free. Should theye be taxed? F—, yeah, to use a more colloquial F word. Again, though, that is a topic for another day.

For the sake of discussion, THE PLANET will grant non-profit status to religion — BUT, and it’s a big one, only if the churches abide by the rules. That’s a lot to ask, especially in Pittsfield, where the men and women of the cloth have exemption from taxes but no exemption from the most humiliating forms of co-opting from The Suits.

Simply put, the churches who lent their resources to the FF rally should be called on this illegal action. All it will take is at least one citizen who will file the official complaints.

IRS Complaint Process For Tax Exempt Organizations

FS-2008-13, February 2008

The Internal Revenue Service gives serious consideration to complaints made alleging the abuse of the tax exempt status granted to certain organizations.

When reviewing filed complaints, the IRS carefully follows special procedures designed to assure the public of the IRS’s objectivity in the treatment of tax-exempt organizations. These procedures ensure that the IRS operates in an unbiased and appropriate manner and that its compliance programs are not improperly influenced by outside intervention.

The responsibility for administering these procedures belongs to the Exempt Organizations (EO) function, which is part of the IRS’s Tax Exempt and Government Entities Operating Division.

Complaints (Referrals)

A complaint (also called a referral) is any communication alleging that a tax-exempt organization is in potential noncompliance with the tax law. EO receives complaints from the general public, members of Congress, federal and state government agencies, as well as from other parts of the IRS.

Filing a Complaint

A referral of an exempt organization may be made by submitting Form 13909, Tax-Exempt Organization Complaint (Referral) Form, downloadable from IRS.gov.

Form 13909 and any supporting documentation may be submitted in a variety of ways. They can be sent via:

— Mail to IRS EO Referrals, Mail Code 4910DAL, 1100 Commerce St., Dallas, TX 75242-1198,

— Fax to 214-413-5415,

— or Email to eoclass@irs.gov.

Submission of Form 13909 is voluntary.

In addition to oversight by the IRS, tax-exempt organizations are subject to oversight by state charity regulators and state tax agencies. You may also want to send a copy of the referral you send to us to your state charity regulator and/or state tax agency. [added 1/10/13]

Acknowledgement and Disclosure Prohibition

All referrals are sent to analysts at the EO Referrals Office in Dallas. After a referral is made, the IRS will send an acknowledgement letter to all non-IRS sources making a referral, unless it was made anonymously. To receive an acknowledgement letter, you must provide a return address. We are unable to send acknowledgement letters through e-mail.

Section 6103 of the Internal Revenue Code prohibits the IRS from disclosing whether it has initiated an examination or the results of any examination. Therefore, the IRS cannot communicate with the original source of a referral beyond the acknowledgement letter.

The Review Process

Upon receipt, research is done to confirm the identity of the organization in question and once this is complete, information is entered into a database to help the IRS keep track of the progress of the review.

An experienced EO revenue agent then performs a thorough technical analysis of the allegation made on the referral. The agent uses a “reasonable belief” standard to evaluate the facts and to determine whether EO should take further action. Before taking action, the revenue agent must determine that the facts create a reasonable belief that the allegations may be true when considered fairly and in light of other reliable information.

The reviewing EO agent will decide one of the following:

  • The information does not warrant further action. In this case, the agent inputs information, including rationale, into the database and closes the referral.
  • The referral relates to activities that should be considered at a future date. The agent documents the database and schedules the appropriate date to re-evaluate the information.
  • The referral contains characteristics that require it to be forwarded to a committee of career EO managers and agents. This committee evaluates referrals monthly — more often in some circumstances — and decides whether to proceed with an examination. The committee also applies the “reasonable belief” standard.
  • The information warrants an examination of the organization. The agent documents his or her decision and the reasons for it in the database. The information item then becomes part of the examination file.

If this process results in a decision to examine an organization, the EO Referrals Office will forward the case to a field group for assignment to a revenue agent. The revenue agent will contact the organization and schedule an appointment to begin the examination. (For details on the EO examination process, see Fact Sheet 2008-14.) Dump Trump! Down with Donald! The 45th U.S. President is being audited by the IRS! Donald Trump won’t release his tax returns! What is he hiding? Donald Trump paid a $25 million fine on Wednesday, 1/18/2017, to settle his fraudulent “Trump U” case. Donald Trump is being sued by a woman from the Apprentice TV show for alleged sexual harassment and sex assault. Donald Trump declared business bankruptcy 4 times over! Donald Trump uses HATE speech and disparages many minority groups. His discriminatory proposals are unconstitutional. I am proud of the 1/7/2017 Pittsfield march against the fascist leadership of Donald Trump. I would have marched, too, if I still lived in Pittsfield. I am part of the RESISTANCE! I hope Elizabeth Warren runs against Trump in 2020!

I for one want to address DV’s issue here and not engage in foolishness.

I attended the march. I too was taken aback at the harshness and mean-spiritedness from many of the officials and other notable participants, much of it out of camera range. I am sometimesin a position to be on the inside at such events. The churches are on thin ice with this one. In my judgement they will have a serious problem if someone files.

Thank you DV for your coverage, I only wish people would address your points more seriously.

Did they actually get inside St. Joe or just gather in front? No one will file so there is no worry to the churches. DV won’t do it and none of his disciples will surface with real names to do it. It would be amusing to watch political Pittsfield telling St. Joe and First Congo they have to pony up their real estate taxes. Despite a page and a half of coverage in the local newspaper most citizens still don’t know that it happened or what it was about and don’t care.
BTW, there’s a protest Saturday at 10 A.M. at the Colonial, another tax exempt enclave. Be there!

The process is anonymous……And it doesn’t matter if it’s inside or out if the purpose is political. In this case if the moon bats were given permission to park in the st Joe lot their tax status is endangered.

The progressives put enormous social pressure on their “members” to all walk in lockstep. It’s a total power play, but it keeps control over their members. They do not tolerate dissenters. They even sent death threats to a singer named Jennifer Holliday who wanted to perform at the Trump inauguration and she is one of their own. She is a member of the LGBT community and she was afraid for her life. The famous opera star Andrea Bocelli was also sent death threats. These people do not play nice.

All of the U.S. reps not attending the inauguration are from very liberal districts. Fortunately our own Rep Richard Neal will be attending the ceremonies. Good for him because I’m sure there was enormous pressure on him not to go. Hollywood keeps everybody in line with the cause by denying jobs and ruining careers if people are not one of them.

There is nothing more most teachers hate than “counselors” who think they are saving the world. She is the absolute worst. If she was laying in the middle of the road, I hope people would speed up.

Now before everybody gets all indignant about the issue the Planet describes, please read (and comprehend) the guidance the IRS provides:

The Restriction of Political Campaign Intervention by Section 501(c)(3) Tax-Exempt Organizations

Under the Internal Revenue Code, all section 501(c)(3) organizations are absolutely prohibited from directly or indirectly participating in, or intervening in, any political campaign on behalf of (or in opposition to) any candidate for elective public office. Contributions to political campaign funds or public statements of position (verbal or written) made on behalf of the organization in favor of or in opposition to any candidate for public office clearly violate the prohibition against political campaign activity. Violating this prohibition may result in denial or revocation of tax-exempt status and the imposition of certain excise taxes.

Certain activities or expenditures may not be prohibited depending on the facts and circumstances. For example, certain voter education activities (including presenting public forums and publishing voter education guides) conducted in a non-partisan manner do not constitute prohibited political campaign activity. In addition, other activities intended to encourage people to participate in the electoral process, such as voter registration and get-out-the-vote drives, would not be prohibited political campaign activity if conducted in a non-partisan manner.

On the other hand, voter education or registration activities with evidence of bias that (a) would favor one candidate over another; (b) oppose a candidate in some manner; or (c) have the effect of favoring a candidate or group of candidates, will constitute prohibited participation or intervention.

Even if a church held an unabashed anti Trump rally, it remains unclear as to if it violated anti-CAMPAIGN regulations, considering he is not filed to run for office again. IRS agents aren’t going to run around to investigate between the lines conjecture, especially when there is no written, verbal, or financial contribution for or against a political campaign.

If you contact the tax professionals, ask them to hurrrrry up and finish Trump’s audit, then he can stop hiding behind that flimsy excuse to hide his tax returns.

Churches are not required to file as a tax exempt organization. They are automatically granted it. Churches have been intimidated into silence by misleading info like Dan printed here. I served on a church board for many years. We were never required to file an annual IRS filing.

If this were not true, how is it that many Democratic candidates speak at church services in the south over the years.

Many pastors are waking up to this falsehood and speaking truth about issues. This scares the people who thought they silenced moral leaders.

This requirement does apply to non profit organizations that are granted tax exemptions as stated.

Wrong again. A recognized church is not a government issued 501c3. The only teeth the IRS has is to revoke deductible contributions, so they have no recourse.
The “rules” you speak of do not apply. Study the history of America. Politics were spoken from pulpits for many years. Both candidates and issues.
I think MLK used his church pulpit for political issues…civil rights? This was both a moral and political issue.

Religious leaders that preach biblical morality are finally waking up to this secular lie.

The IRS, even if reported, will do nothing. We are seeing a cycle of history – the 60’s created the 80’s, the 40’s created the 60’s – the 20 years of unchecked handouts created Trump – the gravy train will not and should not ever stop (b/c we all need help on occasion) but the brakes are being pumped…what distresses me is the fear of a social backslide when Trump is ONLY really about the $$ – all the other stuff existed 5 years ago, 10 years ago etc – it seems the outrage is a matter of convenient conscience – where was the social outrage before 11/5 ????

I disagree. Trump really is going to help ALL Americans by job creation. He may succeed or he may fail, but I have no doubt that he is definitely going to try to do this. Those who voted for Trump do not see him as a God or a Savior, but someone who is practical and will fix the economy for all people. This will help the poor in the inner cities and those struggling across the country regardless of their race or sexual orientation. Most people want the chance to achieve and not rely on government handouts to survive. People who don’t care about this issue are probably already financially successful and don’t understand the struggles that other people are experiencing.

Complaint is one way to go–I agree.
Another way is to file a Federal lawsuit in Springfield Federal Court–Filing fee is about $300. Result is 99.9% guarantee,
since Dem/Progressive/Liberals obviously violated Federal Law
about separation of State and Church.
No attorney required. They even offer help to do so.
