PLANET VALENTI NEWS AND COMMENTARY

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION JULY 20-22, 2018) — When you operate a site such as this one, after a while the news comes to you.

Each happening, civic joy or shame, crime, or subterfuge possesses a cast of characters. No matter how hidden, someone always knows something, and when you’re the only game in town when it comes to authentic enterprise reporting and investigative sleuthing, the characters involved in some way with these narratives often drop dimes.

This leads us to the following comment, posted in the previous edition of THE PLANET in reaction to our story on the upcoming primary election of the next District Attorney. We merely present the story. We haven’t vetted it and make no claims for it, but it has a ring of authenticity plus a healthy dose of relevance to make it newsworthy and worth sharing, especially for those who missed it.

With that, let THE PLANET also state the obvious. There are two or more sides to every story, and should anyone in, of, or formerly of the DA’s office care to respond, we stand more then ready — open for business, as it were. We present it as written, unedited:

——— 000 ———

“Let’s not forget the new DA already has at least 2 high-profile murder cases, locally, to prosecute. The death of a 22-year-old girl who was shot in the head as a bystander to an act of violence between adults. And what appears to be a more calculated murder of a man in a park on the Fourth of July.

“Here’s an interesting story about the former DA. As the family of the slain girl was preparing her body for her private funeral, they were kicked out of the room in the funeral parlor to allow prisoner Christopher Davis to have a private goodbye with his alleged girlfriend. At the time Davis was being held at the BCHC, without the right to bail, pending a dangerousness hearing. Neither the parents nor any of the family of the murdered child was asked for permission for this to happen, or even made aware until the Sheriff showed up at the funeral home with the prisoner and told the family members to leave while he said his goodbye. This egregious violation was sanctioned by the DA and the sheriffs office, with zero respect for the family in an excruciating time of grief.
Here’s the kicker – Davis was granted this special permission by way of an agreement with the DAs office. He agreed to testify at grand jury in the murder case of James Dominguez, who was shot in the head and murdered outside a local bar the year before. Some readers here may remember the grand announcement made in the murder case of JD. Suspect charged! Hooray!

“A few weeks later you may also recall an article regarding the prosecution of Christopher Davis for lying to a grand jury in a capital murder case. What the police and DA didn’t tell the public was that Davis lied to the grand jury, he received an unpermitted and unwelcome special private visit with the murder victim to be the first person to say goodbye to her. Yanna’s funeral was a private service with family only, who wanted to express their grief prior to opening up the parlor to the public. Instead, they spent their last days with her, knowing that their privacy and respect and decent humanity had been violated by the sheriffs office, the district attorney, and the funeral parlor as well for allowing this to happen.

“And the murder of James Dominguez? You never heard anything more about that, right? That’s because they had to release the suspect they had charged with his murder based on the false testimony of Davis. But you didn’t see that in the newspaper.
Just another dead person for that new DA to tend with …”

——— 000 ———

The DA’s office is under considerable pressure from within and without. The latter, forced by an election that will get increasingly nasty as we approach September, speaks for itself. Providing Andrea Harrington and Judith Knight aren’t scared off when the chin music gets in and under particularly close and personal, an explosion of some sort may happen. The former, the within, remains — “curious” is the word we’ll use. There seems to be a growing unrest in those offices, particularly following the comment made by the DA spokesperson following the report of a woman found shot up at the house of a Pittsfield Police Officer. The flack, without giving any substantive details about the troubling event, sought to assure “the public” that they were in no danger.

No danger. A woman is found gunned up in a police officer’s house. The DA won’t give out the particulars. But the public need not be concerned.

Really? Maybe the DA’s office needs to drive to Lincoln Street and Wellington. There, in the utility wires that overhang Lincoln, you’ll see a pair of boots slung over the line. We’re told its a gang-related warning to snitchers, as in “Don’t talk or else you end up like this, strung up.” The boots have been there for a month. Odd, isn’t it, that neither the mayor, the city councilor president, any public official, or the police have ordered the boots taken down.

Why, we wonder.

Have a great weekend, everybody.

But you can be plowed into by someone running a red light or stop sign on any street in Pittsfield. There are no rules on the roads any more, or at least apparently not enforced.

Dump trucks and business trucks go 60mph on Williams street with most coming from Dalton.Police will not pull over business trucks.Construction vehicles have a free pass because of all the money made be police roadjobs…….Speed bumps are the only answer for these trucks.Williams street has a truck problem.Every truck not going 35 needs to be pulled over. The mayor and chief have police on double time working on Sundays….Why would any police chief have officers working on Sundays to stop construction trucks .Trucks mayor, trucks chief, police only pull over cars.

Speed bumps aren’t appropriate for a collector road like Williams Street but a roundabout at Elm & Williams would slow things down and make that area much safer.

I hope they don’t put a stop light there because they pretty much give a false sense of security. How many times a day do you think it is OK to go when you get your green light and then ZZZOOOOOOMMMMM as five cars blow through their red and almost T-bone of ya?

There are no people under 65 in Stockbridge. Saw a woman with a baby on main street and she seemed so out of place.Wondering how Stockbridge will replace the 200 jobs lost by Country Curtains.Thank God the Fitzpatricks saved the Red Lion Inn or main street would not be there .

And in this case it’s a pair of boots rather than sneakers. And I take with a very big boulder of salt anything Auto Phil posted yesterday. Nice story, no evidence.

Sorry NIB. The Sheriff is already on record in the BE article I posted yesterday admitting to granting the special visit to Davis.

The entire thing is true.

So you don’t have to search the article:

“The parents say their relationship with the DA’s office took its first wrong turn under Capeless after they took issue with the fact that Chris Davis, a man with whom officials say Asiyanna was involved, won a release from jail in order to see Asiyanna’s body the morning of her funeral. Davis was arrested last July and charged with cocaine trafficking.

They said officials cleared the funeral home for the visit, forcing out family members who were working on Asiyanna’s hair and makeup.

The one-on-one visit was more than either of them got, they said, calling it “disrespectful.” The funeral was private, they said, and he was not welcome.

“How do we trust the justice system when they do something like this?” Eurquhart said.

He said he suspects that Davis got to see Asiyanna because he had information they needed, and so they struck a deal. Sheriff Tom Bowler disputes that claim.

“(Davis) put in the request, we knew it was an ongoing relationship, based on the number of phone calls and times she came to visit, so we honored the request,” Bowler said.

After questioning the visit, the parents say, they found it difficult to get timely information from the DA’s office about court dates and important updates in the investigation. Shanay said the fact that the office wasn’t communicative under Capeless made it all the more difficult to trust that the criminal justice system was doing its job.”

Obviously, the information quoted above does not prove that the sheriff struck a deal. I understand that. But that is what the back story has alleged. And you have to really question why the sheriff would grant a special visit with out asking the permission of the parents or family of a tragically murdered girl. And especially in the case of a prisoner who was being held without the right to bill pending a dangerousness hearing.

Molly,

Regardless of the reason they are up, they are up, and it should be unacceptable and they should have been removed already. How would you like them on the wires in front of your house? The ciity is a shithole and Tyer campaigned on blight. So what exactly has she done about blight????

Dan,

Last I knew both locations were worse than when she stood in front of the KFC building, had her photo op, and declared under her watch, that blight would not stand. Kind of like when Ruberto said he would travel the country bringing jobs here. Both fed us a bullshit and lies sandwhich with a slice of baloney. The voters ate it both times.

To repeat, the DA’s office did not know of the plan to bring the boyfriend to the funeral home. Also, how is it not responsible for the DA’s office to tell the public they are not in danger when someone shoots themselves? That was in the paper. Let’s be responsible and try to operate within a fact-based reality here.

So if the DA did not know, who struck the deal with the prisoner to bring him to the funeral home? Since when does the Sheriff investigate or prosecute murders? He is a correctional officer, not a prosecutor.

Davis made a deal to testify to the grand jury in the murder of James Dominguez in exchange for a special visit. How would that happen without the DA involved?

Re: Pittsfield politics’ G.O.B.s

In response to Thomas Marini’s letter about Pittsfield politics’ Good Old Boys club, I believe Pittsfield has it in spades compared to other areas or locales. In Pittsfield, you have a group of interrelated families who go back generations who run the show. If you are not part of this insider group, you are disadvantaged in running for political office or finding a public sector position in Pittsfield. If you are part of the G.O.B., you are given the red carpet treatment!

I have been criticized for speaking out against Pittsfield politician’s with Italian-American last names, despite the fact that I am from Pittsfield and I have an Italian-American last name. I, along with my family, have been mistreated by Nuciforo and Carmen Massimiano, Jr. They expect loyalty, obedience and silence no matter what they do or who they hurt. If you speak out against top-down political hacks like Nuciforo and Carmen Massimiano, they will retaliate against you by blacklisting you from employment, intimidating you, and spreading vicious rumors against you. Despite the unfair stereotype against Italian-Americans, it is almost like the Good Old Boys run Pittsfield politics like their own mafia!

The sad reality of the Good Old Boys dominance in Pittsfield politics over the past couple of generations is that Pittsfield is in a downward-spiral of population loss, job loss, and one political party rule where a majority of residents don’t vote in state and local “elections”. I believe that the worse the outcomes for Pittsfield, the more powerful the Good Old Boys club has over the local political system. I also believe that Pittsfield politics will never change!

– Jonathan Melle

Letter: “’Good old boys club’ and the race for DA”
The Berkshire Eagle, July 20, 2018

To the editor:

Those of you who are interested know there is a Democratic primary coming up at the beginning of September. Let’s talk about the race for district attorney. Let us suppose there is a political power machine in this town. Let’s call it the “good old boys’ club.”

We all know there are good old boys’ clubs/political power machines all over the nation. It is the nature of politics. Those people have power to do whatever they want. They want to keep that power. They want more power. The more power they get, the less power we have. What about the democratic process? That’s irrelevant to them. Did the Berkshire good old boys club tell Gov. Baker to appoint its candidate as acting DA way back in March?

Some people of Italian heritage seem to be loyal to the good old boys’ club. Does having an Italian last name qualify a candidate to be a good district attorney? Does voting for the candidate with the Italian last name give more power to the good old boys’ club? Never mind what the people want.

As you can see, the author of this letter has an Italian last name. He has Italian heritage on both sides of his family. The author would never vote for a candidate just because he or she has an Italian last name.

It is up to you. No matter what candidate you vote for, go out and vote Sept. 4. Make sure you are registered to vote now! If you want our democratic process to work, you have to work with the process. you have to participate. By voting, you are using your power. If you don’t vote, you lose your power.

Thomas Marini, Pittsfield
