ATTORNEY SULLIVAN LETTER: IS DA RESIGNATION A FORCE THAT WON’T BE DENIED OR A CALL THAT WILL BE CRUSHED?

PLANET VALENTI NEWS AND COMMENTARY

(FORTRESS OF SOLITUDE, WEDNESDAY JUNE 9, 2021) — THE PLANET received a copy of what appears to be a letter written by Pittsfield attorney Robert D. Sullivan Jr. calling for the resignation of Berkshire County D.A. Andrea Harrington.

THE PLANET contacted Sullilvan’s office for comments on and confirmation of the letter but as of press time had not heard back. Based on what we know and applying a sixth sense, we believe the letter to be genuine. If so, it marks a potentially dramatic shift in the narrative of Harrington’s tenure, one that has been dogged by controversy and wrongdoing almost from the start, from the rash of resignations and firings of employees in her office to her own brushes with the law.

From the website Avvo.com:  Attorney Sullivan is an experienced litigator, with over twelve years of trial experience. A graduate of the University of Miami and New England Law Boston, and with the experience of a former prosecutor, Attorney Sullivan is in the courtroom daily to protect your rights and defend your case.

———- ooo ———-

Here is the text of the letter:

“Wrong Way Harrington is on the scramble. She’s sent out the emails and made some calls. She’s trying to suppress the call for her resignation but it’s spiraling out of her control.
Here was the political game plan in the office today:
Andy is looking for people to submit letters to the editor he is writing.
They are reaching out to Rabbi Cain, Neal Pilson, she’s trying to get interviews on talk radio, and is hoping the Broken Eagle will run a puff piece about her anti-bullying and racism seminars run by con-artist Edgerton.
Expect picture of kids being told lies about critical race theory.
The normal onslaught of letters to the editor will be forthcoming. This while she ponders trying to run for Hind’s old seat. The timing couldn’t be worse for her.”

It seems to confirm what sources within the D.A.’s office are saying.

THE PLANET doesn’t know Judge Tyne, except that the court sources speak highly of her and her experience. Tyne, named a Pittsfield District Court judge in 2017, has worked as a public defender, a solo criminal defense lawyer, a real-estate attorney, and, perhaps more tellingly, as an assistant district attorney in the office of Harrington’s predecessors, David Capeless and with Paul Caccaviello.

Could that be why Harrington has it in for Judge Tyne?

Yes, it may shock you, but such grudges have been known to happen.

oh. so you think that court staff, those being prosecuted, and prosecutors weren’t filing complaints with the DA’s office?

DA just randomly decided to write a letter?

That’s not even logical. I need you to both do better. Some investigation would do you good. Request to see the complaints with the DA’s office, I’m not your assistance.

The DA’s office does not accept complaints about judges. There is a formal way to report a judge and if nobody filed a report using the proper channels, than – there is no report- no such thing could exist in the DA’s offce.

It was not a random thing at all it was a desperate attempt on the part of a completely incompetent DA to try and win cases and still not do her job.

Harrington can’t win cases because she has zero court experience. She actually has less than zero experience because she is so ineffective she’s a detriment to every case she’s ever touched (thank god there are not many).
Her junior ADA’s can’t win because there isn’t an experienced DA to guide them.

So what’s her play? She can’t win before a judge, because the judge knows the procedure and the law, so the short cut for Wrong Way is to try and remove the judge because “she’s not fair”, “she doesn’t like me.” “She’s mean.”

So I look at the other side of this issue, to a one, anyone of consequence and standing in the legal community, came out in favor of the judge and was horrified at the stupidity of Harrington.
So which is superior, the hundreds of years of courtroom experience of all the lawyers and jurists and former prosecutors? Or the experience of Andrea Harrington?
Is everyone else wrong and Andrea Harrington is right? Not on your life.
She doesn’t know what she’s doing, she clearly has no ethics, she’s losing slam dunk easy cases, she’s violating due process of nearly all those that come before her office.

No it’s obvious, Andrea Harrington is a dangerous fool.

Lol. Rarely do DA’s actually litigate trials. She has an office full of staff to do that, just like every other DA’s office in the country. Her job is to manage her staff, review cases, research and implement programs and occasionally try a case. Her office has won cases. This judge is abusive. To victims of crimes, to litigators, and to courtroom staff. She’s a miserable wench who doesn’t like people. It’s good she picked a career literally deciding people’s fate. I’m glad she got called out. I’ve seen her abuse in person many times. But I doubt her behavior will change. Guess someone will just have to get it on video. It seems the only way to prove things.

Also, I get the feeling no one commenting here understands a courtroom, litigation, or what a District Attorney’s Office actually does.

The DAs office does not take complaints regarding judges because DAs have nothing to do with supervision of the courts. It’s a separation of powers thing. Might want to look it up. Either an attorney can file an appeal of a judge’s legal decision or a complaint about a judge’s comportment with the judicial conduct commission.

The DA’s office will take complaints from victims and lawyers. The DA’s office does not get any supervision over judges, hence why the letter was written asking for removal. Just like Capeless did, twice. Where was the Berkshire Eagle then? Nowhere. Because Capeless was one of them. A good ole boy.

You people are so transparent it’s pathetic.
Other shoe dropped today. Everyone is coming out against Harrington. There isn’t a competent legal mind that supports her.
The best part is they keep asking if she listened to the court recordings.

If she did and she still thought it was a good idea to send the letter, it shows she is incompetent.

If she didn’t and she still thought it was a good idea to send the letter, it shows she’s incompetent.

Either way she’s a loser and a liar.

This is pretty much part and parcel with your post Monday, Dan.

What we are witnessing is the way progressives conduct business. Wrong Way doesn’t like the way Judge Tyne, runs her court, wears her robe, so she will go behind her back, legally or illegally (it appears in this case), to rid a person who disagrees with her.

If this really is true, it’s time for Wrong Way to be bounced.

I’d be curious if the state did investigate, what would turn up on her and Andy’s computers? A forensic search will date/time stamp emails, internet searches, amount of time spent of an internet retailer. That would almost as interesting as a forensic audit for Pittsfield.

With the violence out of control in Pittsfield, I would love for Helen Moon to explain why she wanted to defund the police? She’s a progressive, reread my post.

Your ignorance is showing. She wrote that letter to blame Tyne for releasing the guy who was shot (in all likelihood in self-defense) and killed. Tyne didn’t release him, a different judge did. DAAH is trying to cover up that her office dropped the ball and failed to get the witness in to testify at the hearing, so the defendant was released and killed by the person he was tormenting.
It’s all about blaming someone else for her mistakes

Jonathan Melle

I read both blogger Dan Valenti’s blog posting and Berkshire Eagle journalist Amanda Burke’s online news article. Berkshire District Attorney Andrea Harrington did not use proper channels in her unprofessional letter of complaints against Judge Jennifer Tyne. The court found Harrington’s allegations against Tyne to be without merit. Lawyers in the Berkshire legal community are calling for Andrea Harrington’s resignation from the Berkshire DA elected office. Berkshire DA Andrea Harrington stands by her ill advised actions, and she gave no indication of resigning her elected office.

Pittsfield, Massachusetts is plagued by violent crime. I cannot blame the current Mayor, DA, Judges/Courts, Police, Sheriff’s Department, and so, for dangerous downtown or inner city Pittsfield because it is a bad situation that is always getting worse and worse as the years go by. Every year for a long time now, the FBI consistently ranks Pittsfield in the top 10 cities in Massachusetts for violent crime. There was a mass shooting incident in downtown Pittsfield during Mayor Bianchi’s two terms in elected office. Earlier this year of 2021 a man was shot dead in broad daylight on North Street.

Post industrial Pittsfield has become very economically unequal and dystopian. Pittsfield politics is corrupt and ran by a group of one political party dominated insiders who are really a bunch of provincial state and local political hacks who are mostly disconnected from a majority of working class and underclass Pittsfield residents.

I understand Berkshire DA Andrea Harrington’s frustrations with wanting to protect the community, but she shouldn’t have taken it out on Judge Jennifer Tyne in an unprofessional expression of indignation at what Pittsfield has become in terms of violent crime, drugs, mental illness, homelessness, and so many poor people living at the edges of society.

You should read other people posts on this blog JM, and you’d understand why downtown Pittsfield is a mess.

I’ll help you understand. All those “grants,” that come to Mayor Tyer to spruce up Tyler Street, put ceramic sheep on North Street, and all the other vibrant and dynamic things Linda does with the grant money, comes with strings attached.

When Boston, Worcester, Springfield, run out of beds at half-way houses or rehab facilities, guess where do they end up? Here, in Pittsfield.

And guess what comes with them JM? Their problems (drug use, “houseless,” and/or criminal activity).

So, the next time the “Lovely Linda,” does a press release praising the grant money she received from the state, ask yourself, who and what comes with that grant.

I’m sure you know JM, nothing in life comes free.

I understand. The state dumps its underclass into post industrial cities like Pittsfield. The Lovely Linda takes Boston’s grant money, along with the state’s underclass. After all, dangerous downtown Pittsfield isn’t called “Social Services Alley” for nothing!

Also, blog posters criticize Pittsfield’s women politicians – Andrea Harrington, the Lovely Linda, Trippy Country Buffet, Helen Moon, Yuki, Dina Guiel Lampiasi – for Pittsfield’s socioeconomic problems, but I know that Pittsfield’s problems were bad way before these women held elected office in Pittsfield, Massachusetts.

I have a Master of Public Administration degree. I have studied communities and public policy for many years of my life. State and local government politicians are supposed to be investing in the people who live there instead of being disconnected from them in her [Linda Tyer’s] gated community near million dollar home and/or screwing them over with their [Adam Hinds’] stupid schemes to raise state taxes while buying a $690,000 home in Amherst, Massachusetts, to help the ruling elites being career politicians for life with their do nothing political hack so-called “plum jobs”.

The people are the government’s most valuable resource because they live, work, shop, pay taxes/rent, and enjoy their life in their community and state. Whatever happened to the proverbial George Bailey investing in the common people in the proverbial Bedford Falls community in the 1946 Christmas classic movie “It’s a Wonderful Life”?

Not criticizing them just like anyone else that maybe criticized, is discrimination. The fall back of things were really bad prior to them being around doesn’t account for what they are doing now in the present to stop it from going really bad ,to really worse than it was. I am far from a financial expert. In fact, people who know far more about financial matters try to explain big business and big government finances to me without me fully understanding it all. On the macro level, our country’s entire economy depends on the financial sector. On the micro level, financial interests are hurting the bottom 98 percent of the population who are not very wealthy. Any time someone out there points this out, they are called Socialist or Marxist. What is my financial solution? I believe that the government should invest in the people who live in communities and states. I believe that government should ensure that all workers are paid a living wage and equitable perks. I believe that everyone should have affordable access to housing, healthcare insurance, public education, financial literacy, living wage jobs, and realistic pension plans with solvent social insurance, social services, and welfare assistance programs. I believe that poverty and other social and economic injustices are structural conflict and violence – class warfare – by the ruling and corporate elites. I believe that politicians are mostly disconnected from the people they represent in government. I believe that a majority of the ruling elites and corporate elites are only in it for themselves. It is the old “If there is no bread, let them eat cake” unevidenced quote by Marie-Antoinette, who was the Queen of France during the French Revolution prior to her execution by guillotine.

In Pittsfield, I think that the Lovely Linda living in a gated community cut off from the mean streets of inner city Pittsfield is a prime example of how economically unequal Pittsfield really is. I see Matt Kerwood’s multimillion dollar slush funds as a slap in the face of the Pittsfield taxpayers. I see Mayor Linda Tyer and Matt Kerwood receiving $41.7 million in Biden Buck$ direct aid from U.S. Congress to the City of Pittsfield mostly being used for the benefit of the vested and special interests instead of the common people who pay their hard earned tax dollars to Pittsfield City Hall. I see Pittsfield politics record breaking nearly $180 million municipal operating budget as excessive. As I read in the Berkshire Eagle and on blogs, it is always, always, always, always….”Business as usual in Pittsfield politics!”

In Boston today [June 9th, 2021], Beacon Hill lawmakers advanced a state constitutional amendment to add a surtax to millionaires, which will kill small business in Massachusetts in the name of raising between $1 billion to $2 billion per fiscal year in new state government revenues. I wonder what the net financial benefit will be instead of Beacon Hill’s one-sided financial analysis of the Millionaires surtax?

I am NOT wealthy by any means. I still think $100 is a lot of money to me at the end of the month. I am NOT part of the politically connected in crowd. In fact, I despise all of the corrupt politicians and their greedy financial donors.

Accepting financial grants has nothing to do with having people who are in the state system move our ways.

And which rehab facilities are you speaking of? Because all the short-term facilities we have in the area (that don’t offer the support services an addict needs for life) are privately owned. And because these places want to make money, they contract with state agencies to send people to these short-term facilities working with the hospital systems. Somehow the Mayor just isn’t involved at all. But isn’t it fun to constantly punch the same bag?

She doesn’t care about victims, the accused, due process, ethical behavior, hard work, integrity, honesty. She is the antithesis of what a good district attorney is.
She doesn’t even know the basics of the law. She just forever damaged a half-dozen cases that are before judges right now. She has destroyed the credibility of her office because a judge called her staff out for not doing their job.

I commend Attorney Sullivan for telling it like it is. Perhaps this will be the crack that opens the dam. We need somebody with Sullivan’s gumption to take it to Harrington in the next election.

Is there such a person on the city side with the gumption and wherewithal to school Tyer. She’s been mayor long enough now to own the crime problem, which btw is worse than ever, in case you haven’t heard, which she campaigned against Bianchi on, and wasn’t it she who claimed she wasn’t going to tolerate the gun play? Actions speak louder than words Linda. When are you going to figure out that throwing money at the problem isn’t, in and of itself, the solution?

X-Lachs, it was much more than just trespassing. As we all watched on TV, Trump told his supporters to go to the capital to interfere with the certification of the election results. His supporters then marched to the capital and attempted to do just that. That’s why the members of congress stopped the certification, in order to hide in fear from the protesters.

After the protesters left, the members of congress bravely went ahead and reconvened, and certified the election results.

Harrington wants to hold defendants prior to trial, relying only on police reports, no live witnesses. Think about it – deprivation of liberty for an indefinite period of time with no cross-exam or substantive due process. There is nothing more draconien and quite surprising for Ms. Progressive. I guess she just puts her finger in the air to see which way the wind is blowing. But,ok, this is what she wants but she has not trained her troops as to how to prosecute such a dangerousness hearing; therein lies the rub. Judge Tyne or any other respectable impartial judge is not going to do the work for you, Andrea. How pathetic.

Deprivation of liberty, I do think about this everyday. Harrington wouldn’t be able to get away with holding defendants indefinitely without a biased accomplice, e.g. Tyne who should have recused herself. A respectable judge would have. A respectable judge with integrity, a judge with a conscience, a judge with a moral compass would have recused herself. Tyne is not this judge. Caught between an over zealous vindictive DA and the equally over zealous vindictive judge is an unenviable place to find yourself, or for someone you love to find themselves. Lying lips are an abomination to the lord…… And no, I will not post the case NUMBERS on here.

I think you hit the nail on the head, J99. Here is what I think happened. The ADAs suck or at least they are not getting the leadership they need, probably on a regular basis. The judge gave ’em what for and they came back and whined. Harrington never listened to the tapes because she is not very intelligent. A lawyer builds a case. A prosecutor builds an airtight case. She doesn’t go off half cocked without first gathering every bit of the evidence. Because Harrington is both dumb and aggressive she ended up disgracing herself. She used anger and aggression, a rooky mistake in any lawyer but a disastrous one for a leader. She has pretty much shown us this multiple times in the past n blaming others for her mistakes. She’s not even smart enough not to underestimate a judge. I don’t know how much more evidence Berkshire County needs here.

All you need to win an election in this state is a a “D” next to your name on the voter registration and a vagina. You know that’s 100% accurate. Everyone was so up in arms about Trumps mean tweets they instantaneously became oppressed and came out in droves.

Unfortunately, they voted for biological body parts and political affiliation as opposed to actual qualifications.

They were promoted, financed and guided by powerful men into their respective positions. These men are still reaping the benefits while not actually having their own names put to shame for the foolish and immoral acts of governance.

And everyone one of them does look the fool as well as the tool. How embarrassing is that girls?

I don’t know this Sullivan, esq. He looks young and in the wilderness as he is not part of the Cohen/Cain Hibberd or other law firm Cabal of the suits.
I can only expect someone put him up to this or maybe he has aspirations, and he is being used as a wedge for the next election.
The problem with the DA, apart from the fact that she doesn’t know how to practice law, is that she is fundamentally dishonest and underhanded. Anyone who knows her knows this, along with her being hot heated.
I alway think when I see the crazy stuff around Pittsfield that the people involved must be dumb or dishonest, many times both, as in this case.
It’s depressing along with the Berkshire Arc thing that the MA Democrats milk the poor to their advantage some crooked tele-evangelists

Burke wrote a good piece, it’s easier to see the whole picture than from Sullivan’s letter/email. I understand now from her article the points above about bail – if they’d had bail no problem — probably. How shady that Harrington is blaming the judge for the outcome of Harrington’s own policy.

They need trained ADAs in that office with supervisors with real experience, not just political hacks. Some of the ADAs (including Joe Yorlano and Karen Bell) are fine, well-experienced lawyers with excellent trial skills. But two good ADAs do not an office make. I hope the cocktail party swells are happy with the role they played in electing the least experienced and most dishonest attorney they could find. I don’t care how many frickkin’ backpacks and story hours she and her staff put together. It’s first and foremost a law office, at one time the best in the county. I’d like to see Harrington try a case–any case–and win.

The liberal elites blew it when they chose her over Caccaviello. What a bunch of fools the voters are–too much TV and too little real-world experience. The problem is that we all are suffering because of her ineptitude. Harrington MUST resign and take Dohoney with her.

My sister was a victim of a sexual assault. She got a rape kit done, she spoke to the police, she is willing to testify against the men that assaulted her.
The DA’s office has been in contact with her but they have provided zero support and make her question going forward to trial.
The so called victim’s advocate couldn’t even remember her name or case.
They called her to provide a victim’s statement during covid. The ADA started reading off her name, then read her someone else’s ssn, then when they tried to confirm the date of the assault and basic info, it was all wrong.
That’s not some old software or a glitch, that’s just bad data entry.
She asked if there was counseling or support services available from DA’s office. They said they were starting a new program but that was two years ago. Recently she talked to them again, because cases are starting to move in the courts, they “misplaced” her file or a big part of it so she had to go through it all again. This time she asked again for mental health support. Two weeks later she got a little handout about drug diversion programs.
My sister has NEVER done drugs, she was raped by an guy she sort of knew and his friend.

If there is anyone screwing up and jeopardizing cases it’s Harrington and her incompetent staff. When my sister asked to be assigned to someone else, she was told they were short staffed and this was the best she was going to get.

I think reasonable people were sick of the stores from or about the Capeless office, shifty evidence handling etc. There was smoke and fire in those stories and that is why Harrington’s message won. But she is just as bad apparently, maybe worse.
The problem around here is that it’s so corrupt that without the US Justice Dept. putting 10-15 people in prison for racketeering not much is going to improve. There is too much incentive to talk out of two sides of your mouth. There are smart private lawyers who milk the system here and who are pretty base and they swan around talking progressive nonsense. If you want to talk ‘sycophant’ though, surely the sycophants are the voters more angry that someone might collaborate with Baker, than think about the quality of the candidate. So many, many people just milking the Democratic machine trough and getting played at every term. Voters maybe aren’t good learning machines?

The moral of this story is, if you are going to kill the king you better not miss. There is nothing wrong per se with taking issue with a judge’s decision or their treatment of attorneys. But you goddamn better have the evidence and Harrington’s failure is major miss. Judge Tyne was trained as a prosecutor in the DA’s office. She knows what is expected when attorneys come to court. The ADAs are not prepared and are woefully ineffective because they have no leadership. That is because of Harrington and Dahoney. This is clear as a bell to everyone in the legal community not just those quoted in the article. And before Harrington goes further off base on her “the Eagle hates me” campaign she should realize they love her. Her continual mistakes are priceless to them.

Hello Patrick Fennell,

The news this morning [June 10th, 2021] about U.S. inflation is that core inflation had its biggest increase since 1992, and overall inflation had its biggest increase since 2008. Inflation is worse than any tax on American consumers. The average American saver is losing their money to rising inflation unless they are willing to risk it in the roller coaster stock market, which is predicted to tank over the next year or two. We are in a K-shaped recovery/recession where only the corporate and ruling elites are on top, while everyone else is losing ground. If the economy tanks soon, then things will only get worse for the working class.

What did you think about yesterday’s vote on Beacon Hill to advance the Millionaires surtax that will kill small business in Massachusetts? How did the Berkshire delegation – Chrome Dome: Adam Hinds, Trippy Country Buffet: Tricia Farley Bouvier, Paul Marx: Paul Mark, the Mayor: John Barrett III, and Smitty Pignatelli – vote on the Millionaires tax yesterday? I assume they all voted for it, but I don’t know for sure. When Beacon Hill lawmakers vote to raise state government taxes, I believe that they should first vote to cut their own public pay and perks by at least 50 percent to lead by example. What a double standard that Beacon Hill lawmakers vote themselves huge legislative pay raises and accept up to 3 legislative pay raises every two years, while they also vote to increase state taxes on everyone else.

Lastly, I agree with you that there are people telling Joe Biden what to say during his week-long tour of Europe. I wonder how his meeting with Putin will go next Thursday, June 16th, 2021? Also, I always wondered why the U.S. Government criticizes foreign leaders such as Putin, while they are friendly with similar foreign leaders when it is in our national and economic interests? Again, it is always a double standard!

Best wishes,

Jonathan Melle

I think Harrington is correct about Tyne. Do you remember the guy who was drunk, shooting a gun from his car window on the West side, tried to evade police and then ran his truck into the St. Joe fence? They found the gun on his front seat. Tyne ruled he wasn’t dangerous and didn’t hold him. If he isn’t a danger, who is?

There are many examples of Tyne’s reckless “judgement”. She is a danger to this community.

Nice try but a lie. The point was the DA should have asked for high BAIL.

Here are his initial charges, Harrington screwed up. The ADA on the case was unprepared, couldn’t string three sentences together, expected the judge to hold, but the ADA didn’t even make the minimum case for why.
Just because you are charged with a crime, and it can be NUMEROUS bad HEINOUS crimes, doesn’t not mean you are guilty. The burden is still on the prosecution to make the case for being bound over for trial with no bail.
Even looking at the charges in totality, that’s not a dangerousness hold. If so EVERY drunk driver or everyone that discharges or possesses a firearm illegally is immediately dangerous.
Since you don’t know anything about the law, dangerousness hearings are typically reserved for people who are direct and imminent threats against another person. Even then the request can’t come unsigned on a scrap of paper.

The best thing to happen to Harrington is Covid. It has hidden from the at large public the total buffoonery judges have had to endure from her office. Keep slinging the mud at everyone but DA Harrington who couldn’t prove or manage her way out of a bag. She seems to think being DA gives some sort of legitimacy and power. It does not. She has to earn it but she can’t because she is not qualified for the job. Even after all this time she still has no idea how anything works, whether it is how to deal with judges or how to manage people. She has exhibited no humility or willingness to learn. But do look for her to start blaming even more people. I guarantee it will be her only defense.

Harrington has been on the phone today and sending emails.
Andy said that if people clicked on links other than the ones about her, it will push her stories off the page.
Calls were placed to the BE to get the story moved off the front page of the website.
Evidently someone complied, the top story jumped to something about a picture and the second story about the legal community laughing at Harrington is slowly fading.

What would be the mechanism for that, a petition?

A sworn affidavit charging the DA with one or more grounds for removal, filed with the clerk of Superior Court.
