The latest occurred when U.S. Marshals tried to served an arrest warrant on Winston Boogie Smith on federal weapons violations.
Boogie was parked in his car. Marshals say Boogie did not comply with orders, resisted arrest, pulled a gun, and fired multiple times. They returned fire, killing the man.
Smith is black.
After the incident, Boogie’s family said the 32-year-old was trying “to turn over a new leaf.”
Stop us if you’ve heard this one before.
The family said the cops were “using his past to tarnish his character.”

- In journalism, many newsroom stylesheets governing domestic violence say that when a woman assaults a man it is “preventive self-defense,” but if it is the other way around it is reported as an “unprovoked attack.”
- Albion College was put into a racial uproar by graffiti praising the Ku Klux Klan and demanding that “all niggers get off campus.” Turns out that security cameras revealed the culprit to be a 21-year-old black student, who admitted the offense. Authorities will not prosecute what they admit is a hate crime because the lad is black and is excused from his actions because American society is racist.
- In Houston, the beat writer for the Houston Chronicle covering the Texans of the NFL was fired because he floated the possibility that some of the women who have accused star QB Deshaun Watson of sexual misconduct might be in it for the money and that Watson might not be guilty in those cases.

The clue to deciphering why this effort will only leave America in the dust lies in that phrase “restorative justice.” The oxymoron ignores the meaning of justice. By definition, justice IS restorative. “Restorative justice” actually means injustice.

Real racism exists in the local schools and it is off the charts!
They don’t even report the stats anymore at BHRSD, Pittsfield, Richmond, and Lenox.
Schools are turning a blind eye to racism because they don’t want people to know what’s going on and how bad it’s really gotten.
When parents stop caring, this is what you get. When school officials can’t pull their head out of their a$$ this is what you get.
It’s high time we consolidated schools in Pittsfield and sent some of the dead weight packing.
How about a few examples to back up your assertion?
Student at BHRSD hurled racial slurs at a Latinx family while they were on property for a soccer game, no discipline.
Teacher in Richmond used the Nword in class. No warning just dropped it.
Students at Taconic yelling racial slurs in the cafeteria all the damn time.
Lenox millionaires chanting to mostly POC poorer schools that’s alright, that’s ok you end up working for us one day.
There are many many many more. They just hide them so if you know a staff member you find out.
I feel that life is too short for humankind to focus on conflict and violence. But for some reason, we waste much of our lives on negativity, power, money and wanting to be better than everyone else whether it be morally, financially, and/or powerfully. Class and Status is our country’s failing. We are all just people instead of a few of us being rich and powerful living in a gated community far away from the rest of society. Life shouldn’t be so weird! We make it that way because we are all really a bunch of insecure jerks.

I didn’t realize how long this brainwashing has been going on. Do to the pandemic I got a little hooked on watching tv series in whole. Some of them were over 10 years old and talking about systemic racism. These shows were aimed at the teenage and younger crowd for the most part. This leads us to the 20 something in today’s society out there marching for any cause they can find even if they don’t understand it. The only racism I have seen systematically for the past 60+ years has been affirmative action. My understanding at the time was so society could help the black in America get help finding the American dream do to slavery and racism. Is this the American dream they were looking for? The good intentions are legion, not few. The motivation is not blind hatred, it is the desire to get it right in moving our civilization forward. What sets the USA apart from other nations is not only freedom of speech but also the ethical stance to get it right. As for Boogie, the existence of extreme cases on the left AND right are fringe elements that do not contribute to our advancement as a civilization.
Justice is indeed restorative — but left to its own devices it just doesn’t get the job done. It requires the tweaking of thinking individuals who have the best interests of humanity at heart.

It is truly a sad day when I feel ethically obligated to call for the resignation of Berkshire District Attorney Andrea Harrington. However, I feel compelled to do so after listening to members of the bar on both sides of the aisle of the criminal justice system, among countless residents of Berkshire County. DA Harrington has recently done something, which in light of her previous unethical behavior, requires me to speak out. Specifically, The DA has written an ex parte letter to the RAJ (Regional Administrative Judge) calling for the removal of District Court Judge Jennifer Tyne. Not only does this run afoul of the ethical rules regarding ex parte communications, especially on substantive issues, but it is an attack on the system through completely improper channels. For the DA, who ran in part on the rights of women involved in domestic violence, to seek the removal of the single female District Court judge that regularly sits in Berkshire County, is appalling. Judge Tyne is a fair and impartial jurist, who will hold any attorney accountable for not being prepared or not performing to the high standards of the practice of law, regardless of gender and race. No rational human being supports domestic violence, but this attack on Judge Tyne is completely inappropriate substantively and ethically. This comes just a month after DA Harrington decided to send an ex parte email to the current sitting Superior Court Justice, again afoul of the ethical rules of professional conduct. She even had the audacity to request a personal meeting with said judge. In light of the troubling news during her short tenure as District Attorney, including driving unlicensed and driving the wrong way down a one-way street, her firing of her public records officer because the public records officer wanted to follow the law and not hide public information that the DA did not wish to become public, and her attempt to bribe a member of the office with a severance package in exchange for the signing of a non-disclosure agreement, I cannot sit by idly any further. Does the law not apply to the District Attorney? My colleagues on the defense bar and even within the prosecutors office do not feel comfortable issuing a statement on these issues because their careers and family require them to remain quiet. I don’t have that fear. I will not remain quiet any longer, and on behalf of many attorneys and residents of Berkshire County I believe DA Harrington has violated the ethical rules of the practice of law, and has violated her oath of office. As a longtime practitioner in Berkshire County, as both a prosecutor and a defense lawyer, I am compelled to call for her resignation. The Office of the District Attorney is political in that it is an elected position, however the work of a District Attorney should never be political. The time has come for the residents of Berkshire County to be represented by an ethical and dedicated prosecutor, not someone who runs afoul of the rules to gain political advantage. I remind my fellow friends and colleagues that the only case ever tried by DA Harrington was lost, and she prayed for relief from the court that the Defendant, whom she represented, was the victim of ineffective assistance of counsel, an attack on her own ability to effectively litigate. The time has come for new leadership in the DA’s office, and whomever that may be will have my support.
Has an ethics complaint been filed about this? Has Moon actually gone to the office of campaign and political finance? Has anyone sent the publicity around it? Unless these complaints are made it’s another nothing burger. I don’t doubt it’s real but confront or shut up.

Formerly an exemplary public defender, whom was advanced to judgeship, due to her refusal to comprise her integrity and horse trade clients. Which former lead counsel Nathaniel Green did routinely, with nearly 50% of cases he handled being overturned on appeal due to ineffective assistance of counsel.
NAT the RAT helped put 100s of innocent victims of local law enforcement in jail.
Tyne would have been next lead counsel, leveling the field. The new lead counsel is no better than the previous, much like the present District attorneys no better than last.
Prove it, Betit. Which of Green’s cases were overturned on appeal due to ineffective assistance of counsel? How many cases did he try? OK, now that you’ve done the research and tallied the raw data, let us know how you arrived at the 50% number. You may include in your research those cases overturned with multiple appellate issues as long as the court (Appeals Court and SJC included) found reversible error under Strickland.

I’m no fan of attorney Sullivan, but his courage in writing this letter may sway my opinion. He barely scratches the surface, I’m doubtful he fails to understand the District attorneys office routinely perjures themselves and suburbs perjury and extorts pleas via fraudulently obtained dangerous holds and fraudulent use of mental health examinations.( he commonwealth can hold defendants 60 days for observation at misery mountain-bridgwater – which does not go against dangerous hold- then after defendants been detained 60+120 days just prior to hearing move case to superior court and easily get another 180 day dangerous hold.
The helpless jailed defendants routinely submit to thier public pretenders and District attorneys extortion and take a 6 month sentence with credit for time served.

Word is out that you are talking all things Restorative Justice so I thought I would add my perspective as a Victim of the War on Drugs. You see, I chose to sell marijuana or Cannabis as we are now calling it. I keep forgetting! Where was I? I just got out of prison so I am a true warrior. I “distributed” marijuana and to help me, I engaged some teenagers from the neighborhood. The worst happened and even though I committed these so called crimes many, many times I got caught just once. Then I got a long sentence that was only because I am brown. This hurt my community because what do you think happened to my kids when I got sent to jail? This has decimated my family unit and caused my son to start shooting up the streets at night. His baby momma doesn’t want to turn him in because guess what, he’s taken care of business while I’m away and she is dependent on the income. Think of what all the money you spend on arresting people for selling drugs could do for us. But never mind, I’m out now and guess what? Currently, the Pittsfield Police Department’s “Crime Statistics” page on its website at pittsfieldpd.org is blank, and its short-lived CityStat Report program hasn’t been updated since October 2015 [- which was when Dan Bianchi was the Mayor of Pittsfield, Massachusetts].
“Since May 9th, we’ve had 12 shooting incidents or shots fired incidents,” said said Pittsfield Police Department Captain Mark Trepani.

Great Barrington — Berkshire District Attorney Andrea Harrington announced this afternoon that state police assigned to her office are no longer investigating an attack that allegedly occurred on the Simon’s Rock campus in September.
The student reporting the assault recently informed detectives that they would no longer cooperate with the investigation. The student similarly refused to cooperate with a private investigator hired by the college, Harrington said in a news release.
The Campus Safety department at Simon’s Rock received a call shortly before 2 p.m. on Friday, Sept. 27, with a report that a student of color had been assaulted and dragged into a wooded area on campus. The student, whose name and age were never released, was transported by ambulance to Berkshire Medical Center in Pittsfield, treated for minor injuries and discharged.
The incident alarmed students, faculty and staff on the campus, in part because it was preceded by the appearance of anti-Semitic graffiti and racial slurs written on the walls of campus buildings.
An extensive investigation by Great Barrington Police and State Police Detectives assigned to the Berkshire District Attorney’s Office uncovered inconsistencies between the student’s allegations and the evidence collected during the course of the investigation.
Still, authorities said last month that the investigation into the “alleged incident” would remain open, “given the unease that the complaint has caused for the community, particularly for Simon’s Rock students and faculty.”
“While these inconsistencies call into doubt that an attack occurred as alleged, police and prosecutors have determined there is insufficient evidence to charge the student with making a false report to law enforcement,” the new release said.
Investigators conducted numerous interviews, reviewed medical records, searched the grounds, and searched electronics. There was no surveillance video of the area available.
Multiple law enforcement agencies including Simon’s Rock Campus Safety, Great Barrington Police Department, State Police Detective Unit assigned to the Berkshire District Attorney’s Office, State Police Crime Scene Services Section, and forensic scientists assigned to the State Police Crime Lab “devoted significant resources to investigating this matter given the disturbing nature of the report and the concerns over potential racial motivations for the attack,” Harrington said.

On 06/07/2021 at approximately 8:35 PM, Pittsfield Police Officer Brennon Stockton observed a black sedan driving west on Linden St with a male on top of the hood, shooting a firearm in the direction of a Linden St address. Officer Stockton observed the individual on the hood shoot his weapon five times.
Officer Stockton immediately initiated a motor vehicle stop and the male on the hood fled on foot through the backyards in the area. Multiple units converged in the area and began an area search. Officer Bryan Betters observed the suspect run into a Robbins Ave address. A short time later, the suspect exited the property with a gunshot wound to one of his hands. Subsequent investigation identified him as the same person that was shooting from the hood of the black sedan. He was identified as 37 year old Jesus Lugo of Pittsfield. Mr. Lugo was transported to BMC for treatment of non-life threatening injuries. He is in the custody of the Pittsfield Police Department on firearms related charges. The female operator of the vehicle is not cooperating with the investigation at this time. This is not believed to be a random act as the female operator and Mr. Lugo are acquaintances. The vehicle involved was subsequently towed to the Pittsfield Police Dept for processing.
Ballistic evidence was found in the area where Mr. Lugo was observed shooting. The firearm believed to have been used during the commission of this crime has also been recovered. This is an active investigation and additional charges may be forthcoming.
While this incident was still being investigated, officers were alerted to another shots-fired incident which occurred on Daniels Avenue at 1253am (6/8). There were no injuries related to that incident which is also under investigation.
