Part Two of Two
(FORTRESS OF SOLITUDE, WEDNESDAY JUNE 16, 2021) — The legally contentious matter of District Attorney Andrea Harrington’s letter to Judge Paul Dalwey, Chief Justice of the District Court System, asking that Judge Jennifer Tyne be removed from the case, continues to reverberate within the local legal community and criminal justice system. The letter has defense attorneys in an uproar, as evidence by the letter their state association sent to the D.A.
Two questions emerge:
(1) Was Harrington justified in sending the letter?
(2) Should Judge Dawley have accepted it?
A local defense attorney sent us this:
“From the state Board of Bar Overseers: ‘All attorneys admitted to practice in Massachusetts are governed by the Rules of Professional Conduct adopted by the Massachusetts Supreme Judicial Court. The purpose of the Rules is to set forth minimum ethical standards for the practice of law. It is the responsibility of the Board of Bar Overseers and the Office of the Bar Counsel to see that the Rules of Professional Conduct are followed.’
“The real issue here is due process. Both sides of a case [at trial] have to be equally informed. That’s the law. It’s a safeguard that the accused has a shot at a fair trial. I’m hearing that a complaint has been filed with the board [of Overseers]. And no. In my view, Judge Dawley should not have accepted the letter. He should have noted it, refused it, and made his refusal the story.”
The source seems to be confirming what a PLANET commentator posted over the weekend:
“Word on the street, Harrington was notified that she is being investigated by the Board of Bar Overseers. She either found out late last night or this morning, no need to self-report anymore, she lost that option. This will be a licensure issue and may be a criminal investigation as well.
She made national news today.”

Finally, if you missed it, here’s a qualified reaction from one of our criminal justice sources, posted over the weekend on THE PLANET. The comment refers to Harriington’s letter in response the the Massachusetts Association of Defense Attorneys objections:

The letter is void of any useful information and as empty headed as Harrington. Here’s my take.
Harrington was as unqualified for the position as anyone could get. She didn’t know how to manage anyone having never managed anyone. Harrington had no relevant legal experience although she overinflated the minor amount that she did have. Her experience in public office was on the school board. Harrington had in fact a trifecta of inexperience that didn’t have to end this way. She could have listened, learned and collaborated.
Perhaps she could have exhibited humility and self awareness with others in law enforcement and the legal community. At the very least she could have put a stop to absurd claims she made during her campaign that people are being jailed unfairly based on race. Berkshire county is over policing over prosecuting and over punishing black and brown people. That lie is what Harrington ran her campaign on and she has been trying to back it up ever since.
Rather than listen, learn and collaborate Harrington didn’t do the first thing to understand what the DA’s job entails. She hired mostly political allies many without relevant experience. She managed even the competent with fear and toxicity and many have left. Then she chose as mentor Road Rage Rollins. Even if she even asked Rollins opinion on this latest stunt Rollins probably advised her to go hard full bore. Surprised anyone?
The truth is, Harrington is a deeply flawed person with no evidence of a value structure. It’s quite clear to anyone around her that the force that drives her is self aggrandizement.
All of this was bound to bring about her own downfall.
If Harrington is “listening” do you you wonder if she will learn anything from this? Don’t get your hopes up. She has no track record of that and she certainly doesn’t have anyone in the DA’s office who could give her sound advice. That, again is no one’s fault but her own.

Like I wrote previously, prior to the lovely ladies who now run Pittsfield politics, Pittsfield and Berkshire County still had violent crimes, drugs, gangs, poverty, and so on. I understand that Berkshire District Attorney Andrea Harrington lashed out at Judge Jennifer Tyne because she is frustrated at the lack of progress in restoring law and order in the beautiful Berkshires. She (Andrea Harrington) made a mistake. She should admit that she made a mistake, but that her heart was in the right place. We all make mistakes in our lives, and that is what makes us human instead of mindless machines. If anyone tells you that they are perfect and never make mistakes in their lives, then they are self-deluded liars, insecure, and have agendas. I actually believe that Andrea Harrington’s flawed actions show her passion for her elected position as Berkshire District Attorney.
On another subject, I watched and listened to the news yesterday (15-June-2021) about President Joe Biden’s meeting with Russian President Putin today in Geneva, Switzerland today. As I understand it, every U.S. President from George W. Bush, to Barack Obama, to Donald Trump, and now Joe Biden believed that they could negotiate with Putin only to fall for Putin’s KGB political games. If Putin is truly playing U.S. Presidents over the past 21 years, then why does Biden believe he will be any different than his predecessors? Also, the U.S. Government invaded Iraq for its second largest oil reserves in the world (next to Saudi Arabia) in 2003, but the U.S. Government is being the pot calling the kettle black because the Russian Government invaded Crimea in 2014. The U.S. Government’s main or number one non-farm export are military weapons, and the U.S. Government knows that if they don’t sell arms to foreign countries’ governments, then Putin will. Nonetheless, I wish Joe Biden all the luck in the world today.

Russian President spoke with reporters after his less than four-hour summit with Joe Biden.
The meeting with Biden was supposed to last 5 hours, it lasted less than four.
During his press conference following the bilateral meeting, ABC hack Rachel Scott asked Putin about how his political opponents turned up dead.
This was after Vladimir Putin ripped the Black Lives Matter movement for its massive path of destruction across the US following George Floyd’s death – something the liberal media lies about to this day. The Russian leader said he does not want that to happen in Russia!
Putin pointed out to Rachel Scott that hundreds of Americans today are sitting in jail without a fair trial – political opponents of the current regime.
Putin also mentioned the shooting of veteran Ashli Babbitt in the US Capitol, although he did not mention her name.
Of course, Putin is right. And he appears to be more honest than the Pravda media we have here at home in the US.

The nerve of the reporter to question Russian treatment of their political opponents when Biden is holding his political opponents without a fair trial, an enemy of Hillary and Bill just turned up dead (another one), and the far left destroys the lives of anyone who disagrees with them. I think that both the Judge and our District Attorney are at fault. He shouldn’t have accepted it and she shouldn’t have presented it to the judge. Harrington has the greater portion of the blame for even attempting to remove a judge in the first place. That is overstepping her authority and not following legal protocol.

And while we’re talking about Pittsfield stupid decisions, anyone notice the drive-up mailbox, which USED to be in the USPS parking lot – has now been relocated directly on Fenn St. Since it is on the passenger side of Fenn just past the Post Office – customers now need to park their car,& get out of their vehicle to deposit outgoing mail, unless you have a passenger with you. Today a car was parked on Fenn alongside the dropbox, so it wasn’t accessible except by customers on foot.
If the genius who came up with this idea thought it would relieve congestion in the lot……..wrong! If you have to get out of your car anyway, you might as well park in the lot & take the mail directly into the P.O. More congestion!

Here’s how it works:
There is a process to file a complaint about a judge, Harrington failed to follow it. That process exists SPECIFICALLY to head off the disastrous chain of events Harrington set off. In doing what she did she set off a chain of events that was no fault of anyone but herself.
The use of the term “imminent threat” has legal weight and meaning. It requires immediate action. If the police thought there was an imminent threat to someone’s life, they could take actions that would normally violate the 4th Amendment.
Likewise, in this case, once the chief judge received the letter and was made aware of the cases (none of which have pendency in front of him), he’s required to examine the issues at hand to head off further potential error. He is also required to notify all involved including counsel for the defendants because of the egregious ex parte communication by a sitting DA.
The immediate as well as proximate causes for all of this was the hubris, arrogance, and incompetence of Andrea Harrington.
He and his court is able to move cases outside his/their jurisdiction, which will probably be what happens. It does however create a number of challenges for appeals, should any case be appealed.
Since this issue was so beyond the pale, I can’t find something this stupid having happened in modern case law, it’s hard to tell the outcome. Harrington has forever tainted and poisoned these cases.

I was wondering if the ex -judge was trying to muddy the waters – as well as wondering about the ‘defense attorney’ comment that the story should have been that the judge refused to review AH’a accusational letter and make THAT the story. I can’t see how ignoring her letter would have helped as the public would think the judge/system was ignoring a dangerous situation. And that would have opened an appeal path too, no?
Maybe all the judges should be furious with Harrington as it entangles them in a mess.

PITTSFIELD — Elevator repairs at City Hall have delayed the City Council’s return to in-person meetings, the council president said Thursday.
Because of the repairs, the Pittsfield City Council will meet virtually one more time before getting back to in-person meetings, according to Councilor Peter Marchetti.
On Wednesday, Gov. Charlie Baker signed legislation to extend until April 2022 a portion of the state’s Open Meeting Law that gave public bodies the option to participate in remote meetings. The provision had been set to expire this week.
The City Council’s next meeting is Tuesday, and will take place via Zoom.
