(FORTRESS OF SOLITUDE, MONDAY JUNE 14, 2021) — For news hawks, Berkshire County D.A. Andrea Harrington is the gift that keeps giving. Daily she makes another headline to a story that erodes faith in her competency to serve.

In Part 1 of this two-parter, THE PLANET presents highlights of our conversation-cum-coffee with a retired county judge. We call him Judge Crater.

JUDGE CRATER

With respect to the ex parte letter Harrington recently sent to Paul Dawley, chief judge, district courts, asking for Judge Jennifer Tyne to be bounced from a case, Judge Crater referred us to the American Bar Association website, Rule 2.9. THE PLANET has updated our earlier version to clarify Crater’s remarks and to correct our presentation of the point he was trying to make.

ABA Rule 2.9 says this:

(A) A judge shall not initiate, permit, or consider ex parte communications, or consider other communications made to the judge outside the presence of the parties or their lawyers, concerning a pending* or impending matter,* except as follows:

(1) When circumstances require it, ex parte communication for scheduling, administrative, or emergency purposes, which does not address substantive matters, is permitted, provided:

(a) the judge reasonably believes that no party will gain a procedural, substantive, or tactical advantage as a result of the ex parte communication; and

(b) the judge makes provision promptly to notify all other parties of the substance of the ex parte communication, and gives the parties an opportunity to respond.

(2) A judge may obtain the written advice of a disinterested expert on the law applicable to a proceeding before the judge, if the judge gives advance notice to the parties of the person to be consulted and the subject matter of the advice to be solicited, and affords the parties a reasonable opportunity to object and respond to the notice and to the advice received.

(3) A judge may consult with court staff and court officials whose functions are to aid the judge in carrying out the judge’s adjudicative responsibilities, or with other judges, provided the judge makes reasonable efforts to avoid receiving factual information that is not part of the record, and does not abrogate the responsibility personally to decide the matter.

(4) A judge may, with the consent of the parties, confer separately with the parties and their lawyers in an effort to settle matters pending before the judge.

(5) A judge may initiate, permit, or consider any ex parte communication when expressly authorized by law* to do so.

(B) If a judge inadvertently receives an unauthorized ex parte communication bearing upon the substance of a matter, the judge shall make provision promptly to notify the parties of the substance of the communication and provide the parties with an opportunity to respond.

(C) A judge shall not investigate facts in a matter independently, and shall consider only the evidence presented and any facts that may properly be judicially noticed.

(D) A judge shall make reasonable efforts, including providing appropriate supervision, to ensure that this Rule is not violated by court staff, court officials, and others subject to the judge’s direction and control.

Judge Crater then gave THE PLANET a tutorial.

“[Rule 2.9 (A)] covers Harrington’s letter [to Dawley]. If you look at the exceptions, none apply to her letter,” Judge Crater said. “For a prosecutor to do what the district attorney has done clearly violates the law, and she should have known that. I mean, that’s basic, Law School 101.”

Judge Crater highlighted (A): A judge shall not …  permit or consider ex parte communications, or consider other communications made … outside the presence of the parties or their lawyers concerning a pending or impending matter.

“That’s pretty clear. ‘Shall not’ leaves no wiggle room.”

The ABA provision cited by Crater pertains to judges. Was he suggesting that Judge Dawley should not have received the letter? That appears to be the case, though he never came out with it in so many words. Better legal minds than THE PLANET‘s, and that’s a large universe, pointed out the distinction. Judge Crater was linking Harrington’s letter to Judge Dawley’s acceptance of it.

“I don’t know where [the D.A.] got that idea [to write the letter] or who advised her to do it, but she doesn’t seem to realize the seriousness. That’s the most concerning part for me. [Harrington] doesn’t appear to grasp the significance of an illegal, ex parte communication and how it jeopardizes the fair administration of justice. … It seems far too political to me. I’m glad I’m out of it.”

Hello blogger Dan Valenti, fellow blog posters, and all of the blog readers out there,

Berkshire District Attorney Andrea Harrington has made mistakes since she was elected to her post in the Fall of 2018. She is seen as both political and controversial to her critics. She is seen as progressive and with the in crowd to her supporters. The legal community has called on her to at least admit her mistake(s), and at most, for her to resign or face the consequences of her alleged and known actions. To be clear, she – similar to all politicians – has her enemies and they are smelling blood. I feel sorry for anyone who is put in difficult situations in politics, but I also feel that she has put herself in said difficult situations in politics.

I wish to add that prior to Mayor Linda Tyer, and prior to Berkshire D.A. Andrea Harrington, respectively, Pittsfield, Massachusetts had the same distressed socioeconomic, violent crime, drugs, poverty, and so on, problems that it has today in 2021. I never understood why critics of the current Mayor of Pittsfield, and critics of the current Berkshire D.A. write or say that their progressive and in crowd politics is hurting the community and county when it has been this way in Pittsfield for decades on end.

Inner city Pittsfield has long scared the living daylights out of me since I was a young man since 1993 when I graduated from Pittsfield High School 28 years ago. On of my biggest fears in my then young adult life was that I would end up being stuck in inner city Pittsfield due to me being part of the distressed socioeconomic underclass and working poor class that makes up a majority of Pittsfield’s disadvantaged residents. To make matters worse for me, my dad was a Pittsfield area politician and he also worked at the Pittsfield courthouse for over 31 years until early-2002. Not only did I fear facing a life of being dependent on low to moderate wage work and social services, but I also had to deal with corrupt Berkshire County and Pittsfield politicians who were mean to me and my family back then. Inner city Pittsfield and Pittsfield politics both threatened my survival for many years of my then young adult life.

Mayor Linda Tyer and Berkshire D.A. Andrea Harrington are around my age range, and they, unlike me and my family, stayed in Pittsfield to try to rebuild the city and county from it post industrial GE past into a better area for the next generations of families and young adults who live in Pittsfield. I couldn’t do it, but they could, and now they are facing everything I saw firsthand and feared being captive to decades ago, except that the Lovely Linda lives in a wealthy gated community, while the Lovely Andrea lives in upper class Richmond like former Governor Deval Patrick, while I would have ended up in the zone or the ring of poverty around North Street. Lucky for me, my family and I have lived in southern New Hampshire for 17 years now, but inner city Pittsfield and Pittsfield politics still causes me unpleasant feelings of anxiety after all of this time.

It does not make a difference if it was “this way” 20 years ago. If Tyer campaigned saying she was going to be on top of all the bad stuff and then totally failed she deserves all the criticism she gets. With her though, it seems to be a wholesale lack of effort as she seems to be focusing on handouts to her friends from the taxpayer coffers.

Yes,Pittsfield had some of the same violent crimes,drugs, poverty, problems back then as today.
The citizens want to know what they are going to do about the problems they have today which is on steroids. You can’t change the outcomes of the past, but you can alter the future with actions starting today.

Perhaps an investigation into the who?how much?and lack of prosecution of fiduciary embezzlement petrated upon Dalton taxpayers through Dalton Fire department?
Next commissioners meeting is 6/29@6:30 ms Harrington is quiet on the subject. MSP attached to her office did the investigation, as Dalton police department is known corrupt.
Why are the taxpayers who are suffering ever increasing taxes being left in the dark?

No one knows about what the real Pittsfield is like more than I do. My dad was a Pittsfield area politician, and I saw a lot back then when I was a young man. I studied and have a Master of Public Administration degree, which means I understand how Pittsfield politics operates for its own gain at the expense of the people and taxpayers. I understand that inner city Pittsfield mostly consists of the city’s underclass and working poor residents, while the ruling and wealthy elites live in the outer edges of Pittsfield – (or in Naples, Florida) – including the sitting Mayor who lives in a wealthy gated community close to the Hancock border. I understand that one has to either kiss the dirty behinds of the Good Old Boys (& Girls) club of insider, incestuous, corrupt provincial political hacks, and/or be related to the “All in the Family” clan to have a living wage job in Pittsfield, Massachusetts. I understand that if one speaks out about Pittsfield politics’ disservices and insider baseball, he or she will lose their job in a New York minute, and be on the blacklist until they sacrifice all of their integrity, self-worth and pride at the alter of the Pittsfield politics’ mystery man from Naples, Florida whose rolodex is at the bottom of Silver Lake. Lastly, I understand that the outcomes of Pittsfield’s past cannot be changed, and the Pittsfield’s dark present and future can be with actions starting today, but I am not holding my breath!

You sound very in tune with the political atmosphere here in Pittsfield and beyond.It is good that you learned at a younger age because many younger people aren’t or don’t get involved. Unfortunately some of what you learned was at the expense of a family member.

None of what the judge said has any real bearing on the DA. Those are rules for judges, not DAs. The entire article is nonsensical.

She is bound by rule 3.5 as spelled out in the letter.

Rule 3.5: Impartiality & Decorum of the Tribunal

Advocate

A lawyer shall not:

(a) seek to influence a judge, juror, prospective juror or other official by means prohibited by law;

(b) communicate ex parte with such a person during the proceeding unless authorized to do so by law or court order;

She communicated ex parte with judges in an attempt to influence an official (a judge) in hopes of removing another judge while her office had cases pending.

Citing 2.9 is ludicrous as it pertains SOLELY to the judges conduct.

Her actions are the violation, so the only issues at hand are actions pertaining to a lawyer.

If the judge is saying that Dawley somehow violated the rules of professional conduct by reading her letter and reviewing the cases, it’s a good thing your judge friend is retired.

Harrington is planning to argue that the communication is not ex parte as the pendency of the cases is tenuous.
Since she is Bart arguing the cases, she is not unduly trying to exert influence.
She doesn’t understand the word “proximate”. As the DA she is ultimately responsible for ALL cases, not just the ones she litigates personally.
Withdrawing the letter will do no good whatsoever as you can not unring that bell.
Her only course of action was to self report but it’s too late.
I’ll bet she gets a censure from the MA Bar overseers and the the DA Association (NDAA).

Maybe a legal eagle can explain more to me but I understood the ABA rules were professional guidelines for ethics. They are not laws like .. ahem I don’t know … say driving without a license.

There is usually no criminal penalty but professional censure for transgressing the attorney rules. Usually, the Board of Bar overseers gets involved only to professionally censure the attorney; e.g. there isnt a criminal element to the censure. Am I correct about that? There is usually only a slap on the wrist unless it’s fraud with client funds?

Also, the rule cited refers to the rules for Judges – so is there a suggestion that the judge who reviewed AH’s allegations acted improperly? I don’t think anyone is suggesting that they did, but not sure why Crater quoted the judge rules since Harrington isn’t a judge. Did she cause the judge to commit an ethical transgression? Is that why Crater is referencing those rules instead of Attorney ABA rules?

Sadly, the Board of Bar Overseers in MA is about as diligent as the compliance guy in the movie Boiler Room. I wouldn’t expect much comeuppance there, even if they wrote a strongly worded letter – what else would they do? As far as I know they don’t censure judges, that is another agency, but again, I could be wrong.

It looks terrible for AH but not likely to be the smoking gun her detractors wish for.

The bar association is on a campaign to remove judge Tyne, as she and vrabel are honest. Hard for the connected to fix cases with an honest jurist. Although friday Tyne questionably allowed the coaching of commonwealth only witness in a bench trial the defendant has waited 7 months for. Perhaps Harringtons efforts and Dawleys threat bore fruit.

If that is true then you are suggesting that Berkshire County lawyers want to get rid of judges who are not ‘’persuadable’? And they will try and get judges fired that they don’t like? On some ways that is what happened, already.

The ABA rules are actually duplicated in MA law. They are slightly different but are materially the same when it comes to these issues.

Where is the rule or how does it apply to a district attorney?

I’m not defending her actions. Clearly she tried to circumvent legal channels to have a judge removed. But please explain how the rule above applies to the DA.

It doesn’t pertain to her save how it works in concert with with 3.5.

Under (a) she has tried to influence a judge or other official(s) be means prohibited by law. That prohibition exists in concert with the law 2.9 (a) that says a “judge shall not….”

She is not covered by 2.9 (a). This whole article and this judge is suspect because they clearly paid no attention to the actual facts at hand. Also it’s not the ABA rules that are of concern. It’s the rules of professional conduct as per the Massachusetts Supreme Judicial Court Rules. In many cases they are identical but the enforcement authority and some of the rules are different.
For example, the ABA may sanction but the Board of Bar Overseers for MA might as well but under 4.01.(3)

During a proceeding a lawyer may not communicate ex parte with persons serving in an official capacity in the proceeding, such as judges, masters or jurors, unless authorized to do so by law or court order.

I did vote for her. I was/am still upset about the Baran case. Also the hounding of the teenager who was eventually sent to jail for two years for selling pot. Not cool.

Sawin was a drug dealer, period. He was not hounded or entrapped. He was dealing while his case was pending! At the time he was convicted, the policy of the office was to prosecute cases factually supportive of a school zone violation with no discretion, period, and without regard to who the defendant was or where they grew up. That doesn’t always lead to great outcomes, but at least the white rich kid from Great Barrington was treated in the same manner as the black poor kid from Pittsfield. And remember, pot was still illegal then.

The war on drugs has been a trillion-dollar failure, but failing to enforce drug laws in one jurisdiction is not a solution. The reason why decriminalization of drugs in Portugal works is that it applies to the whole country. If law enforcement in Berkshire County decided against enforcing the drug laws, it would not cure the problem. There would still be a demand for drugs and dealers from all over would set up shop here without consequence.

The DA is a failure because there is no depth of experience upon which to draw in order to create policy. All she knows is what others have done, said, or studied.
Expertise is important. Politics is a curse when dealing with people’s lives. That’s why the over-simplification of a no cash bail policy is foolish, political pandering. If she had a lick of sense, AH would know that bail is a tool that can be used properly if based upon a sensible policy.

Understand that the decriminalization of drugs in Portugal was not about drugs but about HIV/AIDS.

Portugal has socialized medicine, free healthcare for most. Since the cost of HIV/AIDS treatment was very expensive and most of the new cases were illegal drug users, they found it cheaper to treat addicts than to treat HIV/AIDS patients.
So poor Wrong Way is doing what she does best, approaching the problem from the wrong way and applying the wrong solutions to the problem.
By trying to decriminalize opioids, she is creating a market for drug dealers.

“In 1999, Portugal had the highest rate of HIV amongst injecting drug users in the European Union. There were 2,000 new cases a year, in a country of 10 million people. In 1997, 45% of HIV reported AIDS cases recorded originated among IV drug users,[3] so targeting drug use was seen as an effective avenue of HIV prevention. The number of heroin users was estimated to be between 50,000 and 100,000 at the end of the 1990s.[4] This led to the adoption of The National Strategy for the Fight Against Drugs in 1999. A vast expansion of harm reduction efforts, doubling the investment of public funds in drug treatment and drug prevention services, and changing the legal framework dealing with minor drug offences were the main elements of the policy thrust.”

“The drug policy of Portugal, informally called the “drug strategy”, was put in place in 2000, and came into effect in July 2001. Its purpose was to reduce the number of new HIV/AIDS cases in the country, as it was estimated around half of new cases came from injecting drug use.

In addition, the existing practice of giving drug addicts a waiver for drug possession was codified in a new law. The law (Drug Law 30/2000) maintained the status of illegality for using or possessing any drug for personal use without authorization. However, for persons addicted to said drug, their case was now deemed an administrative offence.[1] The authority to impose penalties or sanctions in these cases was transferred from the police and justice system to so-called dissuasion commissions if the amount possessed was no more than a ten-day supply of that substance.[2][1]”

What about the influence a retired judge has with the judicial branch, colleagues – jurisdiction – judges have top respect from EVERY sector – jurisdiction, meaning the place where he held session – what about the influence on lawyers and it speaks of a need for research. Birdland owns legal offices, there’s NO WAY this doesn’t lead to bias, I have experienced it re: a wrongful eviction. Probate/Housing/District Courts are at risk – you’ll see. There’s NO WAY anyone can think a retired judge is neutral regarding local news – WE ALL SEE IT Dan.

The Eagle actually did a deep dive on that Art Sale story. I remember reading that initially there was to be strong oversight on what was going to happen to all that money. Then, I also remember reading that, oh no, there was NOT going to be any such public oversight. Somebody changed their minds after the fact. And the coverage has been slim since then. If Berkshire County wants to address the heroin problem, they should start by making sure that the correct person is summoned to court & check if that person is also a care provider for elderly/disabled/children. Unfortunately they called the wrong person & that drug dependent person, the rightful owner of the charge – was let go? And is now dead. Someone else’s docket number was sent to me & I was forced to appear! WTF is going on around here?

If I were in Putin’s shoes this Wednesday in Geneva Switzerland, I would respond to Biden’s criticisms of Russia’s annexation of Crimea from Ukraine in 2014 with the fact that then U.S. Senator Biden voted for Bush #2’s 2003 invasion of Iraq whereby the U.S. Government still controls around 85 percent of Iraq’s oil reserves, which are the second largest oil reserves in the world next to Saudi Arabia. If I were in Putin’s shoes, I would ask Biden how he was right to vote for the 2003 invasion of Iraq and the U.S. Government’s ongoing control of Iraq’s vast oil reserves, while Biden believes that Putin is wrong for Putin’s 2014 invasion and annexation of Crimea from Ukraine. If I were in Putin’s shoes, I would also remind Biden that the U.S.A.’s economy centers around exporting military arms to the world’s governments, and that when Russia’s economy collapsed in the early 1990s after the end of the Soviet Union, the U.S. Government took over Russia’s market share in arms exports to the world’s governments. In closing, if Biden really believes that Russia should follow the rules of international relations, I believe that Putin should hold up a proverbial mirror to Biden’s face!

I was interested to read the detailed statement from District Attorney Andrea Harrington relating to issues in support of victims of crime, particularly domestic abuse, and gender-based violence, as well as working for medical treatment for mental health and substance use needs while avoiding overly prosecuting low-level cases. She notes changes such as replacing cash bail with hearings designed to focus jail time for those credibly accused of committing violent crimes and firearm offenses.

These are issues of justice reform that are providing change in other communities. Working for change is complicated and often resisted. District Attorney Harrington states a commitment to listening and working in good faith with the broad legal community. I encourage reading her entire statement and hope her commitment to efforts to promote fair prosecution and a more humanizing justice system, will be widely shared.
