(FORTRESS OF SOLITUDE, MONDAY AUG. 9, 2021) — Now that the Pittsfield Conservation Commission has correctly decided to review the proposed cement/asphalt monstrosity called a mountain bike pump track, it’s time to examine other aspects of this impending project.

You may wonder why THE PLANET has expended so many photons on this issue, which may seem peripheral to you.

Answer: Because the pump track goes far beyond a money grab by a private company aided by accomplices among your traitorous political “representatives.” The serpentine secrecy with which proponents sprung this on the city illuminates a moral and philosophical dimension that directly bears on Pittsfield’s future. At immediate issue: the fate of Springside Park. The larger issue: Do citizens have a chance to regain control of the government they once owned?

This is a battle for Pittsfield’s soul. Will a greedy oligarchy reach the point of invulnerability, or do Mary Jane and Jo Kapanski fight to reclaim their rightful place?

As you know from reading THE PLANET, backers want to place the large development in the middle of Springside Park. If it goes through, the pump-track emporium will enrich a private developer (and who knows how many if any public officials via kickbacks?) while exploiting free use of a taxpayer-owned natural resource.

THE PLANET knows that if citizens were polled, the majority would oppose destroying the woodland refuge so a bunch of thrill-crazed yahoos can get their kicks on $2000 bikes at a $3 million monstrosity that will forever change the character of the park.

Joe Kapanski, The Little Guy. Where he inevitably ends up–Screwed, unless he fights back.

Here’s where the wise guys and wags usually point out how badly the city has let Springside fall into neglect over the decades, turning a brilliant gem into a neglected heirloom. They’ll mention the “houseless,” gangs, youths running amok, tent villages,  drug use, and night critters. They are right to do so, but they leave out one crucial point that cements the case for rejecting this development.

Precisely because the city has been negligent, the Best Friends of Springside Park — the small volunteer group fighting for environmental integrity — need your support. Join them. Contribute. Let your alleged “representatives” know how you feel.

This is an election year, although you wouldn’t know it by the walking dead on the campaign trail (always an ominous sign that The Suits are planning another robbery). All candidates need to be put on the hot seat regarding the mountain bike pump track: For or against. No middle-ground. No fence-sitting answer. If they duck, bore right in and come back with it: For or against. Now.

The Bike Mafia has already destroyed Nothing on North with ridiculous bike lanes that give pedalers as much room as motorists, making parking and traverse exceedingly difficult. It’s killing the street. If you don’t think so, as Rick Stohr of R.J. Stohr Jewelers. Ask Steven Valenti of Steven Valenti Clothing for Men. Ask Tom Rich of Paul Rich Furniture. Ask the owners of Dotties and other downtown merchants. Don’t let them destroy Springside Park.

This issue is not really about a tone-deaf development in Springside Park. It’s about a tipping point that will indicate if We the People still have hope in the Town Without Pity.

How anyone seeking office stands on this issue will tell you much about the location of their loyalties. Will they be bum kissers to The Suits? Then they’ll tell you what a great thing the destruction of Springside Park will be — yes, another “economic engine.” Will they actually stand for Mary Jane and Joe Kapanski? Then they’ll oppose this continued abuse of the park.

The ConCom decision buys time on an issue that bears eerie resemblance to the Civic Authority debacle twenty years ago. They two are not identical, of course. The Civic Authority used a baseball stadium as a Trojan horse to enact citywide legislation that would have given mayor Gerry Doyle autocratic powers through a panel he would appoint.

Both issues, however, pit a large, money-backed push by The Suits to ram a project few people want down the throats of Mary Jane and Joe Kapanski. David and Goliath. Big Brother vs. The Little Guy. Both projects feature alleged public servants shilling for wealthy private interests. Both projects rely on proponents’ lies, misinformation, and intimidation.

Here they are trying to silence a small band of citizen activists, the Best Friends of Springside Park.

The Best Friends don’t have the big money on the other side, but they something more formidable.

They have the truth.

Make this a rallying cry during this year’s campaign: “Remember Springside Park!”

I agree with Mad Trapper, blogger Dan Valenti. Pittsfield politics is no different than an old fashioned Mafia casino operation where the Suits and their wealthy backers get to pay to play, while the proverbial Kapanski family always lose on more levels than the Empire State Building without an elevator. Pittsfield politics is ran by wealthy Ward 4, who always decides who the Mayor will be, as well as the At Large City Councilors and the “Level 5” School Committee who actually defends the status quo, meaning failure. The rest of Pittsfield’s other 6 Wards don’t count in Pittsfield politics. That is the OPPOSITE of Democracy!

I wish to share my thoughts about Pittsfield, Massachusetts:

My native hometown of Pittsfield, Massachusetts is Exhibit A in post industrial decay. GE used to employee over ten thousands working class local residents post World War 2, but today, GE employs zero local residents, and GE made Pittsfield into its dump. Gregory Crewdson shows his large artistic photos of post industrial Pittsfield to privileged museum and art gallery viewers in London, England, New York City, and L.A. His art exhibits of Pittsfield are literally called “A City in Decay”. Pittsfield is one of the most economically unequal areas in the state and nation because there are no living wage jobs there for the average working class family. The Mayor, Linda Tyer, and her millionaire Accountant husband Barry Clairmont live in a millionaires-only gated community in west Pittsfield within a few feet of the Pittsfield/Hancock border. Inner city Pittsfield has daily shootings and a man earlier this year of 2021 shot dead in broad daylight on North Street, is always in the top 10 in violent crime in Massachusetts as annually ranked by the FBI, has drugs, gangs, prostitution, poverty, homelessness, and so on. On a personal level, I don’t blame Mayor Linda Tyer for living in a wealthy gated community in west Pittsfield because she values her personal safety, but I still think it sends an elitist message to the rest of Pittsfield.

If this project was one that was desirable and wanted then the right way to propose it would have to engage the citizens and groups that have worked on And used all these years. Things have been proposed and used on the property but it went through the proper process. If they really want it at Springside I say put it right next to the water tower on Benedict Road. Keep everything on the outside of the park. I still think the best place would be on the PEDA land. It’s been 30 years and not much has happened maybe this could be a win/win project to get people to look at PEDA

The problem with the 2 sites you suggested are they don’t have trails to hold races on. Existing trails and the availability to create new trails are the main reason Springside Park was selected as the ideal site. If you want to see what it will look like on a daily basis if this project is built, take a trip in there tomorrow…or next Tuesday evening when the races will be going on. BTW…The softball complex wasn’t on the list of sites considered by the proposers. The bottom line is the Parks Commissioners haven’t done their due diligence. They’ve let Jim McGrath lead them.

I have no problem with a recreational track being built at springsides 300 acres by a interested privat group.Getting people into the park would be fantastic for the park.With that said not 1 dollar should be used of taxpayers money…..Why,because we cant afford anymore responsibility because the mayor and my city councilor have not proven they can sweep our streets and paint our street lines…..We need to ask all who run for council if they can balance a budget at home and do they believe in cutting the current budget by .50%….Simple Stuff first. Never Forget 1/6/2021

  1. Being that the property is in fact public property was this advertised as an RFP?
  2. Were there any other organizations who responded?
  3. If it was advertised where can one view the RFP and any other non winning proposals?
  4. Being the park is a public property what are each of the parties responsibilities regarding maintenance, access, liability etc.
  5. Where can one view this document.
  6. Has a revenue stream been identified for the City in exchange for said property?
  7. has access, rights of way, and other issues been resolved and reduced to writing?
  8. Where can they be viewed.
  9. Currently the entire park is open to the entire world, will part be closed off? if so what is the compensation?
  10. will the acres be removed from the open space considerations/count?
  11. Will there be ADA access?

Just some questions is all. Asking the public to give up a resource is a huge ask. without a demonstrable and documented public benefit and a methodology of measurement it has to be a hard no

Many excellent questions and I assume they are rhetorical because this mayor does not answer many questions. She may very well be riding in the cab of a Drott as we speak on her way to tear up some forest land.
I hope some BCC Environmental students makes filming the progressive destruction a documentary class project. Will the Dean please loan this person some nice camera equipment or better yet a drone? And please make it suitable for PBS or sixty Minutes.
You would think that right now with all the concern for the plane,t such self serving projects might be put on hold. But greed and money are the reasons the country is in such bad shape to begin with so not likely that will change any minds. But it sure looks bad for those promoting it and they will be remembered for it like Doyle is remembered for Hill 78.

Where possible, I’ll speak in specifics, but for stuff I’ll have to resort to generalities.

Answers:
Being that the property is in fact public property was this advertised as an RFP?
Being determined, but likely no. This a project funded and paid for a non-profit (NEMBA) and they are coming to the city with the project in hand. (Note, I’m working on a nonprofit project on public land right now and depending the location, etc. there can be some hoops to go through when a nonprofit entity comes to a public land manager with a proposal.)
Were there any other organizations who responded?
Yes, positive to the proposal. Springside Conservancy, etc.
If it was advertised where can one view the RFP and any other non winning proposals?
No RFP generated (see above), so no RFBs.
Being the park is a public property what are each of the parties responsibilities regarding maintenance, access, liability etc.
All covered by a standard Memorandum of Understanding and Services Contract. Note: opponents of have falsely claimed this bike skills area would be for profit enterprise and its not. So the nonprofit (NEMBA, the mothership, not the local chapter) would be the only party besides the City involved. In most states a MOU is toothless without a services contract, so a services contract for maintenance is usually drawn up, usually for $1 a year. These (skills parks) aren’t rare and liabilities are well known, with less incidents per a user than football/soccer fields. So they fit well with existing city liability requirements.

All documents are part of the public record since December.

Again, this is public infrastructure being initiated, paid for and maintained by a nonprofit, so there is no revenue. That isn’t unusual for bike skills areas. Most are connected in some method to a nonprofit. While Mr. Valenti claims this is for profit enterprise, it is not. The only for profit company involved is the contractor who was hired by a nonprofit for services rendered.
Has access, rights of way, and other issues been resolved and reduced to writing?
This is a public land, so there are no true rights of ways, etc. at least in the way you mean them. Easements may cross the property and those would have to be researched prior to construction, but that is typically a pre-construction activity, not a pre-submittal activity. Access is per the land manager’s requirements usually. There will have to the SWPPP (Stormwater Pollution Prevention Plan) and construction plans, obviously, and all that will have to be hammered out with the land manager (parks).
Currently the entire park is open to the entire world, will part be closed off?
No. Contrary to what the opponents keep saying, the area containing the skills area is about the same as standard baseball diamond (under 4 acres) and it will replace an existing underutilized ballfield. Again, there are hundreds of these bike skills areas in the United States and we know exactly how big they are and how they integrate with parks. Its just like any other active use.
Will the acres be removed from the open space considerations/count?
Not sure what you mean. Well over a third of Springside Park is active use now. This is an active use going into a current active use area. No change in active vs. passive use is occurring.
Will there be ADA access?
This is a bike skills area. Not sure how you have ADA access in those circumstances.

Joshua the liar and racist full well knows that the MOU will allow for NEMBA to manage as they see “fit and necessary” which due to their lack of management expertise and staff in this area, they will subcontract out to a company like Milltown.

The local NEMBA chapter will get a percentage of the fees, but a for profit company will get the majority of maintenance and service fees.

This is a for profit venture gift wrapped in a NFP wrapper.

Joshua full well knows this, just like he knew that if they went with the full scope of the project they would have been buried in DEP and ConCom review.

Just like Joshua knows it’s not active use, that in MA a use is considered abandoned and loses all grandfathering after two years on non-use.
When it reverts it reverts to the lowest form of use. So where they plan to have this, it’s really passive recreational use. Not withstanding the lack of enforcement by the City to stop the current destructive use.

Understanding that the proponents of this park are a non profit have you provided any kind of financial and or tax filings showing the community where your monies go. Example Salaries xx% operating costs xx% program costs xx%? Guide star or other ratings? I am just curious as to the past record of expenses vs receipts.

What were the factors used by you or your organization in determining that Pittsfield and in particular Springside park was your best fit? You stated that you were coming to the City with a project in hand that is great I ask who identified the need and was that need developed to fit the plan? The vehicle or instrument that this or any city uses to develop in concert with its citizens is a Master plan. The master plan is developed over a time period with great community input to be the guide and measuring stick for development for the future it is meant to be forward looking in an attempt to meet the needs wants and desires of the community. What need, want or desire in the plan does the track fill? I am certain it fills a need for some but to do that others have to give so to speak I am searching for that balance. As I understand it the land however used now was deeded for a specific reason and accepted on behalf of the Citizens for that use. Changing that use as time goes by should not be taken lightly. and not without a broad community discussion, that discussion has to be open honest and amongst mature adults.

Because the group proposing this is in fact a nonprofit does not mean monies will not be generated. The catholic Church is a non profit correct? The status of the group proposing the development is irrelevant to the merits and or the community benefit of the proposal in my eyes.

When I ask about rights of ways I am asking about the following will the park be open to the public at all times? no dues no fees? Some still have a bad taste from being essentially locked out of baseball fields that many of us enjoyed in our youth. will anyone at any time have unfettered access?

How many if any square footage or acreage will be cleared, paved and or utilized for parking, Concessions( if any) maintenance buildings etc?
Is there a plan in place to aid an injured rider? ambulance etc? Sanitary facilities?

ADA Access If a rider has a family member or other party interested in supporting them could they get there?

Joshua, I truly do appreciate your answers and I hope you take this as offered None of this is really to do with a bike park, you could have proposed an aquarium the questions would remain. We are a community that cares deeply about our resources and the stewardship entrusted and granted to us by those who deeded the park. We have an absolute duty to ensure what ever resource that we are entrusted with using is used wisely and to the benefit of the entire community. We must also protect ourselves and future generations from the liabilities of hastily made decisions without the proper vetting. We are citizens and taxpayers it is our guard this time.

I am not a representative of NEMBA. I started posting here when I saw the level of misinformation put forward by some. I do all my advocacy work for urban trail access pro-bono. Always have, always will.

The New England Mountain Bike Association (NEMBA) is a 501(c)3 non-profit and as such, has to post quarterly financials, as well as a year end financial statement. You can easily get whatever copies of that you would like. Their bylaws and chapter requirements also spell out that no board member can have financial interest in a project.

The public record I reviewed before the May meeting showed the City made the determination for Springside Park,. There were news articles about it at the time.

I’ll speak in generalities here, not for NEMBA. The need for these types of skills areas is two fold: 1) teaching skills to kids and adults as part of a broader skills based classroom instruction. Locally, our skills park is used for NICA, Little Bellas, the local schools’ PE classes/adjunct and a state program (I Can!). There is also a need 2) to channel energy of kids that go out in public lands and build stuff, obviously not know what impacts they can have. Focus the experiences they want in place and way where those impacts can be controlled.

When I was doing research on the Park, I found it was home to petting zoos, agricultural uses, ballfields, mowed meadows, etc. So its hard to argue it was supposed to be for exclusively passive recreation, especially when so much of it is active use recreation now. (Note: many people misunderstand active vs. passive use. Just mowing a meadow once a year makes it active use as you are altering the ecology of the area.) Historical aerials show it basically treeless in the late 1950s. The point of all this listing is simple: if one argues that a skills park violates some long held understanding about the property, why didn’t it for previous (or current) active uses? Others have made the same point (Berkshire Eagle, July 28th) The location of the skills park has been shifted southward to an underutilized ballfield, which really makes the impact curve quite low.

The proposer (NEMBA) have repeatedly said this will be free to the public and they (NEMBA) will handle a large portion of the upkeep themselves free of charge to taxpayers, not some outside group. (NEMBA has never had an outside group come in on any lands they have MOUs on. Ever.) That is inline with most of the skills parks in the country. These infrastructures are not revenue generating devices in themselves. There are skills parks in resorts, but the resort, not the skills park is the revenue generator. Obviously, that isn’t the case here (or with the vast majority of skills areas nationally). As to people being removed from or limited in accessing the park, no. There is typically a control of when the infrastructure can be used based on weather. For trails this is called Positive Trail Control. I suppose for a skills area it could be called Positive Skills Control… 🙂

All the sizes of the actual infrastructure has been asked and answered multiple times. 3.5 acres for the entire thing. (A standard baseball field is close to 4 acres.) No concessions, etc. The claims of that are in the opponents fever dreams. Parking – at the May meeting I suggested utilizing Reid Middle School parking, its what we do here at our local skills parks. Can’t speak for the City of Pittsfield or NEMBA on if that suggestion was taken seriously. But looking at historical usage in other cities, its usage is more like a skate park as far how people come and go.

EMS access is the same for any other sport or activity in the park. Sanitation isn’t different than any other sport or activity in the park either. Again, we know from existing skills areas what the injury rates are. Lots of skinned knees and elbows, not many 911 calls. And to my knowledge, there has never been a link between biking and dysentery.

ADA access doesn’t mean what you think it means. (I do civil engineering as my 9-to-5.) So no, there won’t be ADA access as that is very specific set of rules that would need to be followed. If you mean could a person be pushed or wheel themselves up with a wheelchair, in the design, there are crushed gravel pathways. However, knowing what I know about wheelchairs from work and family members, the biggest issue isn’t going to be the skills area, its going to be getting to the skills area in the “normal” sections of the park.

To me the issue isn’t people that care deeply or have honest and sincere questions. People who want to learn based on factual, provable knowledge & history are something we need more of. What is frustrating is when the answers are easily found and people decide to ignore them for crazy pants statements, like this is a for profit idea being trojan horsed through the local chapter of NEMBA. Most of your sincere questions are easily answered (and have been answered before). To answer a question below – “I ask: who walks into any place — a City, a Business — cold calling with a plan, and that plan is for the “good of the community” and not self serving?”  The only self serving part of this is getting to put infrastructure on public lands. This ain’t the first skills park with this type of financial setup and no, regardless of what others say, its not a scam to bring in outside groups. Almost all legal trail access in the United States is run exactly like this – 501(c)3 trades their efforts for access.

So here’s the deal.
The purposefully did not bid it out because it’s being paid for by a not for profit (NEMBA) but it’s not really. It will be funded by donations, but those donations will come, in large part, from a few donors with a vested interest in securing the property and rights without bidding.

It’s a scam. Let’s say a fictitious company, Pill Town Capital, wants that property but can’t secure it due to bidding requirements etc. They also know the city will eventually have to have a public/private partnership to make sure it’s run efficiently.

So what they do is find a willing not for profit, like NEMBA or NAMBLA or whatever they are called.
The NFP acts as their proxy, since cities and towns in MA can directly sell or lease property to NFPs without going through normal bidding.
Remember Pill Town showed a specific interest in this property a while back, they realized the recreational potential of the land, but knew they couldn’t secure the property outright. So this is the fruition of their long game approach.

NEMBA gets exclusive access to the property, Pilltown finances the construction, a place like Berkshire Money Mismanagement acts as the bagman.
So once it’s all built, and since being built by a not for profit it’s not subject to bidding nor is it subject to prevailing wage, the city realizes it lacks expertise in the area of running mountain biking facilities. They then look for a company/NFP to contract with to run it. They may contract with NEMBA who in turn may subcontract to PillTown, a large company that has expertise in outdoor recreation. NEMBA might get a 10% skim, Pilltown gets a entertainment/management contract and a fat maintenance contract which well exceeds the initial cost of their investment.

Also know that Pilltown will write off any donations to NEMBA. It also will look good for pilltowns books because their capital outlay is minimized and they are secured against future revenue. Also NEMBA being a NFP can secure grant funding not open to for profits, so that partnership give Pilltown an extra revenue stream. This is just a form of money laundering.

This is the same move that they pulled with the movie theater and the seats.
They loaned them the money, allowed Stanley to take the profits, and then forgave the outstanding loan. Stanley walked away with more than he put into it with little or no risk to himself.

It’s the museum scam as well. Cry poverty full well knowing you planned to sell those paintings 7 years prior to the public knowing. Knowing that you planned to sell the museum still asked for public handouts and money from the city all along the way.

If MA law made some changes, none of this would happen. If projects on city or town land, irrespective of who may be paying for it, we’re subject to MA procurement laws, these kid of structure/deferred payment scams would dry up.

Where did it come from? Donations I am assuming. Who made those donations and to what are they connected to if anything?

at the most recent conservation meeting after short open comment period the chairman said” i am confused” ”he should be ” and he further stated when i am confused we will continue this to another meeting,, well we are all confused how this shady city operates,, lets put community development in charge of everything,, ruffer controls park department and open space and looks like we can throw the park commission in there as well, the conservation agent position also falls under community development , the historic commission is under community development vetted by mr Hoss, community preservation fund is also under CD etc, and the list goes on,, its time to get the Ruffer fox out of the hen house or do we have to apply for a special parking waiver from her office before we can park at city hall ?? the community development department needs to be gutted and restructured for the best interests of the public at large who in my opinion has lost all trust with the current administration ,

The fact that there is confusion amongst the public as well as the commissioners tells me that this was not an open process. Unless the commissioners are totally disenfranchised ( which they could be) one could logically assume that they have been following this process from the start and had at least a review if not a contribution to the documents before they were let out. It is much easier to get what you desire if you ask openly and clearly in a document. Having them review “the Plan” shows that the project is working backwards. The City other entity should be validating the developers plan against the RFP or other instrument. We should not be attempting to fit the plan into our current documents.

I still don’t recommend sugarless gum for those that chew gum. And now with all the chemicals and awareness to food chemicals and additives. That 5th Dentist looks to be correct.

My husband is a nurse at BMC and he’s said there’s a lot more Covid cases but they keep saying that it’s the Delta variant.

He does a lot of the testing and there no actual Delta variant test. That in order to find out what variant you have BMC would have to send it out to another lab.
The PCR can’t tell. They have to send samples out for genomic sequencing.
He says they’ve only sent out 15 samples in the last two months and only one has come back as Delta.
He thinks it’s probably virus breakthrough and that the vaccines is more ineffective.
There’s only a few labs that can do the needed genomic sequencing and there’s no way the can handle the hundreds of thousands of tests required to state with certainty it’s Delta.

Saw a post on another site and the poster mentioned as to why Springside Park could not be developed to mirror Look Park or Forest Hill Park. Thought to myself how true and how beautiful it could be without screwing up the environment. Even if they added some tennis courts, pickleball courts, picnic areas, re-open the zoo, stock the pond for fishing, move the beautiful carousal there, etc.. During the holiday and winter months they could have a Holiday Light Show, charge a small fee and make some monies for up keep, open the rope tow again where many of us Pittsfielders learned to ski. But, then again, look at the up keep of our current parks, there is none unless parents do it. Look what the City did to the Softball Complex. Also, Pittsfield always moves and fails at projects because no citizen involvement is ever asked for and everything is always done on the sly with very little thought, only to appease a certain person in the “clique”. Prime example is the Mayor asking for $100,000 this week for the buyer of the Tyler Street Fire Station. Would she have done the same for the couple that wanted to open a first responder’s pub? Of course not! Still finding it real strange that there has been no comments by our Vibrant & Dynamic Mayor and the City Councilors. Evidently they have all checked out of their roles of serving the taxpayers. Just hope voters remember this when voting this fall. Not one of the elected Councilor at Large seats have spoken a peep about the bike paths, crime, traffic conditions, or now Springside Park. Why?? Evidently they are terrified of the Beastie Girls Linda and Deanna. How Pathetic!

I was concerned originally by the proposed pickleball court which would have been added to our communal expenses. This latest project would be expected to completely wreck the concept of an urban park which provides integration of natural spaces into an a developed city. Such parks have a long and important contribution in the history of US cities, and Pittsfield is fortunate to have the Springside Park at its current size.

Regardless of my personal opinions, which includes taking great care of the gifts of property provided by Chance, I hope the outcome follows the Springside Parks Conservancy request for help in stewardship, not changing the master plan.

I found it funny that the reconstruction which is to start in 2026 goes from Merrill St bridge to Lyman street, why not to Teddy’s? Long ago the GE settlement said a bike path along the Housy would be built, was this their idea?
