PROGRESSIVE D.A.’s HAVE TURNED CRIMINAL JUSTICE ON ITS HEAD; POLICE FEEL BETRAYED

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION JAN. 14-6, 2022) — The actions of ultraliberal district attorneys across the country prove a concept THE PLANET has long asserted, that “crime” is a legal concept and nothing more. If legislators pass a law against a certain activity, doing that action becomes a “crime.”

Without a law, there’s no “crime.” For example, getting caught with a J years ago might send you to the stripey hole. Today, peddling cannabis has become big business, especially in Pittsfield, one of the city’s literal “growth” industries.

Now a few years into the pink revolution in criminal justice, we’ve seen the results. The progressives tout lower crime rates, but it’s nothing about which to brag. Of course the rate goes down. When you decriminalize or refuse to prosecute so-called “low-level” crimes — offenses like drug possession, shoplifting, vandalism, looting, prostitution, drunk and disorderly conduct, and others, — there can’t be a “crime.” The actions won’t show up on the books. The crime rate goes down.

However, there’s a reason police departments and citizens loathe the new “soft and gentle” approach to criminality. Public safety. People don’t feel safe, and officials standby, frozen into place. Is a counterrevolution in the works?

In Los Angeles, for example, D.A. George Gascon faces a recall effort. In San Francisco, the police union has castigated D.A. Chesa Boudin. Officers say Boudin has given thugs a “green light” to attack cops. In the Big Apple, Manhattan D.A. Alan Bragg may soon be eating his pussyhat.

From The Daily Beast‘s Kali Holloway:

Detectives’ Endowment Association President Paul DiGiacomo suggested Bragg may as well have given “drug dealers business cards telling everyone they’re open for business,” and Police Benevolent Association head Pay Lynch—in an uncharacteristically measured message, at least for him—expressed “serious concerns.” GOP Assembly Minority Leader Will Barclay claimed “Bragg should not be allowed to hold his office,” as does Republican governor long shot and attention-thirsty Andrew Giuliani, who held a press conference to demand Bragg be removed.

But the most headline-grabbing critique came from newly appointed Police Commissioner Keechant Sewell, who sent a letter that opened by asserting concerns about Bragg’s policies in relation to some 36,000 NYPD members’ “safety as police officers, the safety of the public and justice for the victims.”

“I believe in reform (sic) that make sense when applied collaboratively,” wrote the first Black woman to serve as police commissioner. “In that same vein, I am concerned about sweeping edicts that seem to remove discretion, not just from police officers, but also from Assistant District Attorneys regarding what crimes to prosecute and how to charge them.” She cited worries over escalating subway violence due to fare evasions, fears of “more open-air drug markets and drug use in Manhattan” because of fewer marijuana prosecutions, and a prediction that the policy change for resisting arrest would leave cops open to harm and “have deleterious effects on our relationship with the communities we protect.”

Here in Berkshire County, police officers THE PLANET has heard from cops who feel the same way about D.A. Andrea Harrington. The only difference is that won’t go on the record, at least not at this point. That’s how the guano rolls in “vibrant, dynamic, inclusive, and diverse” Pittsfield.

“Why bother with arrests, if we know ‘The People’s Lawyer’ won’t prosecute?” asks one local officer.

Good question.

Those who have their cuppa Joe at this address also don’t seem too pleased with Harrington.

Wrong Way is a “minister of justice.” Let’s take a look at her track record:

  • Lonnie Durfee, white male, burns two bails of hay. No people/property were in jeopardy of being harmed. Sentence: 2 years in jail.
  • Reymon Delacruz-Batista, Hispanic male (POC), murdered in Pittsfield State Forest 12/5/21. No updates/No suspects in custody.
  • LaQuan Johnson, black male (POC), involved in multiple weapons violations/shootings in Pittsfield. Arrested after being involved in drive-by shooting on Glenwood Avenue on 4/30/2000. Johnson was pled out to 3 years probation.
  • Parth “Peter” Chaudhari, Asian decent (POC), involved in a scam, which included seven states and scammed people out of $300,000. Only 8 months pre-trial confinement. Allowed to voluntarily deport himself after paying back money.
  • Jesus Lugo, Hispanic male, (POC), drive-by shooting from the hood of his GF’s vehicle. Caught after he shot himself in the hand, after running from the police.
  • Edward Jennings, black male, (POC), arrested for murdering Lemond Grady, on North Street, on 4/20/21.
  • Myron Crapps, black male (POC), arrested for shooting a woman on Kent Avenue, 7/14/2020.
  • Tyler Sumner, black male (POC), arrested for shooting/killing Stephanie Olivieri, on 8/25/2019.

So, based on a quick 10 minute search of recent Berkshire County violent crimes, it brings up quite a few.

Of my observation, one man was sent to jail for a nonviolent crime, Lonnie Durfee, and one man. Peter Chaudhari, was allowed to pay restitution with no jail time for another nonviolent crime.

One person of color, Delacruz-Batista, was murdered with no suspect information, no updates from Wrong Way’s Office. Should the public be scared? Alarmed? On the look out for a suspect/suspects? An update Wrong Way would be nice.

That leaves the other five, all people of color, charged with violent crimes/shootings.

So, from Wrong Way’s statement and my quick research, it would suggest that Wrong Way is truly is a “minister of justice.” That is if you’re a white male, you get punished to the fullest extent of the law. If you’re a person of color, you can commit violent crimes and Wrong Way will begin the defendants mitigation process immediately, to lessen any sentence that person of color might have to serve.

This is actually the role of a defense attorney, but hey, Berkshire County voted for this imbecile. She can’t even drive down a one way street legally with a valid driver’s license, but yet we expected her to know the job of DA?

If you enjoy the notoriety of Pittsfield becoming the Springfield of the North, with the shootings and violent crimes, then re-elect the “minister of justice.”

I’d rather have the late, great, “Minister of Defense,” Reggie White, as our DA, rather than Wrong Way.

Yes, she’s the Minister of Justice of “minimizing harm.” Let’s go with that. Was “harm minimized” when Andrea Harrington:

  • Allowed the attempted murder of a baby to go unpunished due to Harrington’s failure to provide witnesses?
  • Violated rules of professional conduct by calling for the removal of our Chief Justice of District Court based on hearsay, without reviewing available evidence?
  • Repeatedly blocked the release of public records resulting in the whistleblower resignation of a public records officer?
  • Failed to deliver an iota of justice after a racially motivated violent crime hoax at Simon’s Rock? It was the DA’s weeks of foot dragging, lack of leadership and ultimate failure to deliver justice that caused damage to our community’s efforts to combat racism.
  • Allowed multiple murders, rapists and assailants to be acquitted or have charges dropped due to her office’s incompetence?

We could go on, but the arrogance has made us sick.

Hello blogger Dan Valenti and fellow blog readers and/or posters,

If what is being said about Berkshire County District Attorney Andrea Harrington is true, then she should be referred to the state and federal Departments of Justice. If D.A. Andrea Harrington is failing to protect victims of violent crimes in Berkshire County Massachusetts, then she should be legally removed from her elected office. The only question I have for you all is what has actually been done about it? If people and law enforcement officials are saying that D.A. Andrea Harrington has failed in her official duties, then they should be writing to Boston and Washington, D.C. with specific examples of her alleged actions.

Blogger Dan Valenti said no law enforcement official in Berkshire County will go on the public record, but then he blames the region’s political corruption for that. Sometimes a whistleblower has to risk it all for the sake of the integrity of the governmental system. I don’t know if I could be a whistleblower who would risk it all to stop a government official(s) who is/are failing to do his or her job(s), but I admire those who do speak out for the public good. I hope that blogger Dan Valenti has not crossed the line by writing a possible baseless political and legal attack against Berkshire County District Attorney Andrea Harrington. I want blogger Dan Valenti to provide real evidence of victims of violent crimes in Berkshire County not being protected by the law due to Andrea Harrington’s alleged failure(s) as the Berkshire County District Attorney.

There is the historical case of the railroading of Bernard Baran, since deceased, in the mid-1980s by District Attorney Tony Ruberto, since deceased, and Prosecutors (the late Berkshire County District Attorney) Gerry Downing and (Massachusetts State Superior Court Judge) Dan Ford. There has been a lot of actual evidence of the past Berkshire County District Attorney’s Office failing to act in good faith for over two decades, including the release of audio tape recordings of children in the mid-1980s that was illegally long withheld exculpatory evidence by the previous Berkshire County District Attorney’s Office that then Berkshire County District Attorney David Capeless gave to Bernard Baran’s Defense Attorneys after a state appellate court order, which finally set Bernie Baran free from state prison after over two decades of incarceration where he was repeatedly beaten and raped behind bars for sexually violent crimes against young children that he most likely did not commit.

There were allegations against former Berkshire County Sheriff Carmen C. Massimiano Junior, since deceased, sexually abusing and exploiting young boys from the late 1950s to the early 1970s when he was a Camp Counselor for Jim Mooney, since deceased, at the Boys Club’s Camp Russell and at the Boys Club on Melville Street, which the politically connected Berkshire County Court personnel, such as Cliff Nilan, allegedly covered up for decades. Cliff Nilan got into trouble with the state Court system for his failure to enforce Angelo Stracuzzi’s terms of probation after Angelo Stracuzzi was arrested in Maine in 2004 for sexually abusing underage teenage boys there. These historical stories have been documented and evidenced, while blogger Dan Valenti’s political and legal attack on Berkshire County District Attorney Andrea Harrington have not been documented and evidenced.

Like everybody else, Andrea Harrington is presumed INNOCENT until proven guilty, and blogger Dan Valenti has upset me tonight with such a serious political and legal attack against the sitting Berkshire County District Attorney, who I support from my perch in Southern New Hampshire. In closing, I do NOT believe blogger Dan Valenti on this issue!

Reread the article. As Dan posted, Legal Eagle and myself did exactly what you asked for. Are those not facts? I certainly didn’t dream up Lonnie Durfee, Reymon Delacruz-Batista, or LaQuan Johnson. I’ve never met any of them and have no plans to.

You think she’s great Jon, amuse us with your reasoning as to why?

Do you enjoy spending more of your government handout money on food and other merchandise? If not, by Wrong Way not enforcing shoplifting laws, guess who WalMart, Home Depot, Target, etc, pass that loss on to? You guessed it Jon, your SSDI doesn’t stretch quite as far as it used to. That is fine by me. My dad loved Pittsfield back in the old days. But it is no longer the same Pittsfield that my mom and dad grew up in the 1950s and 1960s. I wasn’t born until 1975, and the Pittsfield I know is a dystopian community with violent crime, poverty, failing public schools, corrupt state and local politicians, and so on. Could it get any worse for Pittsfield in the 2020s? Don’t you know that large photos of Pittsfield Massachusetts have been displayed in upscale art galleries and museums in London, NYC, and L.A. as “A City in Decay”? I understand that in my father’s youth, Pittsfield was a working-class city with small businesses, restaurants, nice homes, and the like. My dad will turn 78-years-old this Summer of 2022, which means his 21st birthday was back in 1965, which is a very long time ago now. I really don’t give a shit if blog posters pick on me for being a disabled Veteran, but I wonder what it would like for me if I earned New Hampshire’s absurd $7.25 per hour minimum wage at a thankless service job. I guess I would then move back to my native hometown of Pittsfield Massachusetts and shit on North Street’s Social Services Alley like the other homeless residents there. I could waive to Mayor Linda Tyer when she drives by me in her Lexus. As for blogger Dan Valenti’s attack against D.A. Andrea Harrington, until he produces more than a few negative opinions of her, then he and the rest of you are full of HOT AIR in the cold of mid-January of 2022.

I find it interesting that people in NYC are not afraid to say something about the political class and use their names while here in the beautiful Berkshires people are wise enough to know not to do that unless they are planning to move out. Wouldn’t it be nice if Pittsfield could lead in the area of public discourse, modeling one of Norman Rockwell’s Four Freedoms. Maybe we could model for the current administration in Washington instead of creating a department to search out citizens who oppose them and charge them with a crime (hello Germany 1930) we could show them how to open their ears and minds to have open discussions to learn about one another and try to understand why they think the way they do. Isn’t this what America has always been about?

Thank you, Dan for helping shine a light on what is arguably the most important local story in Berkshire County. The public needs to hear and understand the depth and impact of Andrea Harrington’s deceit and incompetence and not allow her to hide behind the cloak of the democratic progressives any longer.
This is not about a philosophical difference between visions about criminal justice ie “a different kind of prosecutor.” It’s also not about the public just needing to know all the good work Andrea Harrington is doing. It is about the sham she has created out of the Berkshire DA’s office.
Andrea Harrington’s lack of prosecutorial competence masquerades as policy. She has surrounded herself with a staff that is woefully inexperienced and so lacking in any leadership or supervision that they are afraid to try cases. This has resulted in the defense bar knowing that they can push prosecutors around and get what they want. The threat of trial is no longer a tool that belongs to our prosecutors who protect the people. Under Harington, the DA’s offfice has been transformed from an institution that was once respected and feared for its competence into one that is ridiculed and preyed upon for its complete ineptitude. It is a horrible development that has every indication of getting worse for Berkshire residents if she is re-elected.

Pittsfield and North Adams were still in the top 10 cities for VIOLENT CRIME in Massachusetts, according to the FBI’s yearly reports, prior to Andrea Harrington’s tenure as Berkshire County District Attorney. Please, please, please, please….provide us with evidence to back up your BullSHIT claims against Pittsfield politics’ newest scapegoat for generations of failed state and local leadership!

Look at crime statistics in Pittsfield 2012- 2018 sorry but it was on a upward trajectory that is fact if that matters.

It is correct to say the DA is not responsible for the crime rate. It’s also valid to point out that case by case this DA is a total fail. Those facts were pointed out in the blog and are going to be hard to argue with.

Crime is out of control in New York City where I saw the boldness of criminals doing car jackings in broad daylight with a policeman right there. The police can’t shoot out his tires and don’t the criminals know it. New York even has the nerve to distribute a brochure to residents telling them how to survive a car jacking since the criminals are running wild thanks to the policies of the same people putting out the brochure. New York, the financial center of our country, is being intentionally destroyed.

Not sure I agree with that statement. I don’t think the fact that Andrea is a woman has anything to do with her ineffectiveness as a DA. She is simply under qualified and doesn’t have the wits about her to admit she is way over her head. Shame on the voters of Berkshire county who elected her. Everyone should be afraid of women. Women commit some of the most violent crimes and atrocities.

Massachusetts woman accused of raping toddler released without bail – a 29-year-old Pittsfield woman was indicted on charges of aggravated rape with force, posing a child in a sexual act, and aggravated indecent assault and battery. The accused woman is the mother of the 18-month-old rape victim. Pittsfield woman pleads guilty to molesting child… did this monster even go to jail for this. I think I read that this monster gave birth to another baby.

In another Pittsfield headline, October 12, 2021 – Accused of trying to burn down a Pittsfield home, woman held pending dangerous hearing – a 45-year-old Pittsfield woman was arrested on Oct. 10, 2021, for attempting to set fire to 32 Third St. Arson of a dwelling house. Is this dangerous woman still being held?

A 43-year-old Pittsfield woman was arrested on Oct. 21, 2021 on arson of a dwelling house after she allegedly set fire to 17 Adams St. Six people were displaced by that fire. Is this woman locked up where she can’t hurt or kill someone?

Jan. 13, 2022 – A 23-year-old Crowley woman was booked on Aggravated Arson, accused of setting fire to a home with her mother and daughter inside. Three people were inside the home at the time of the fire, including a 13-year-old. Be afraid of women!

The problem in Pittsfield is not so much how many Kapinskis get out to vote, but whether they have decent people running to vote for. Let’s face it, Pittsfield politics is largely garbage in and garbage out with a few but very few exceptons. Most of the candidates have been programmed, positioned and promoted by the cabal way ahead of the election. Ruberto could probably tell you who the mayoral candidates will be ten years from now. that is how out in front of this thing these guys are.

Our “social justice warrior” Wrong Way Harrington didn’t disappoint today on social media.

She’s pledging her full support to recently, federally indicted, Baltimore City Prosecutor, Marilyn Mosby, on Twitter.

What did “social justice warrior” Mosby do to earn a federal indictment you ask? She fraudulently withdrew $80,000 out of her pension, claiming financial hardship brought on by COVID. What was her hardship? She needed the money to put on two houses in the state progressives love to bash, but seem to be drawn to, Florida. She also lied on the loan application about owing back taxes.

Mosby and her husband owe the IRS $45,000 in back taxes. The IRS placed a lien on their property in 2020.

She’s been indicted on federal fraud and perjury charges. Of course Mosby blamed it on “politics.” But Merriick Garland’s DOJ, is as blue as blue gets. Once she realizes that, then I’ll put $100 bet the race card will get tossed out.

My first thought is, why do these “social justice warriors” prosecutors feel that paying taxes is discretionary? Wrong Way Harrington didn’t pay her property taxes and apparently Mosby feels the same way about paying taxes.

It still amazes me Lonnie Durfee got two years for burning hay. A black female at Simon Rock College staged a hate crime hoax, which caused panic and undue scorn on all white male students during that time. Not to mention a waste of tax payer money and state police resources. She was never charged. Colleen Janz, a white female defrauded her company of over $30,000. If not for Honorable Judge Paul Vrabel, Janz would have received a Continued Without a Finding (CWOF) for 30 days, and a $50 fine. These are penalties usually reserved for low level misdemeanor crimes (shoplifting, disorderly conduct, etc), not major fraud cases. Now, Harrington kicks in her full support for Mosby.

Notice a pattern here? She is a politician, not a prosecutor. I hope whoever runs against her in the next election reads the Planet.

My dad was a politician in the beautiful Berkshires from the Spring of 1996 to mid-2000. During that time, “the pot king” (Nuciforo) had it out for my father, and he hurt me in the process of dishing out retribution against my dad. After my dad retired, the aforementioned “pot king” continued to persecute me for many years even after I relocated to Southern New Hampshire in the early-Spring of 2004. I am NOT delusional about it.

I am a disabled Veteran for a reason: I suffered abuse in the military, and it impacted my mental health. I am NOT delusional about it.

Thank you for your weekly political email about Beacon Hill politics. It turns my stomach to think that during a pandemic, Beacon Hill lawmakers have extended their 7-week-long taxpayer-funded vacation to over 9-weeks-long. It is very sad that Massachusetts has a large homeless population. Beacon Hill MIA lawmakers are literally sitting on billions of dollars in state cash. Why don’t they stop their lengthy vacation and go back to so-called “work” to spend some of their billions of dollars to help all of the homeless people during the very cold Winter months of January and February of 2022? It is interesting to read that Beacon Hill lawmakers and the Governor, Charlie Baker, have contempt for each other. One would think that they would put it aside and work together to meet the needs of the people during the pandemic. It is all about money and power for the ruling elite. Lastly, I feel bad for the plight of the State House staff who are overworked and underpaid, but it somehow fits with the theme of your political emails about Beacon Hill politics. Please keep up the good work!

There are now 293 comments on DA Harrington’s twitter post supporting the indicted DA of Baltimore. One tweet says she should resign, the people of Massachusetts should be very afraid, another calls her despicable and pathetic. Most go like this:

(5) Conviction of a crime involving moral turpitude;
(6) Conduct prejudicial to the administration of justice which brings the office
into disrepute; or
(7) Knowingly authorizing or permitting an assistant district attorney to commit
any act constituting grounds for removal, as defined in subdivisions (1)
through (6) hereof.
A proceeding to suspend or remove a district attorney is commenced by filing with the
clerk of superior court of the county where the district attorney resides a sworn affidavit
charging the district attorney with one or more grounds for removal. The clerk shall
immediately bring the matter to the attention of the senior regular resident superior court judge
for the district or set of districts as defined in G.S. 7A-41.1(a) in which the county is located
who shall within 30 days either review and act on the charges or refer them for review and
action within 30 days to another superior court judge residing in or regularly holding the courts
of that district or set of districts. If the superior court judge upon review finds that the charges if
true constitute grounds for suspension, and finds probable cause for believing that the charges
are true, he may enter an order suspending the district attorney from performing the duties of
his office until a final determination of the charges on the merits. During the suspension the
salary of the district attorney continues. If the superior court judge finds that the charges if true
do not constitute grounds for suspension or finds that no probable cause exists for believing
that the charges are true, he shall dismiss the proceeding.
If a hearing, with or without suspension, is ordered, the district attorney should receive
immediate written notice of the proceedings and a true copy of the charges, and the matter shall
be set for hearing not less than 10 days nor more than 30 days thereafter. The matter shall be set
for hearing before the judge who originally examined the charges or before another regular
superior court judge resident in or regularly holding the courts of that district or set of districts.
The hearing shall be open to the public. All testimony shall be recorded. At the hearing the
superior court judge shall hear evidence and make findings of fact and conclusions of law and
if he finds that grounds for removal exist, he shall enter an order permanently removing the
district attorney from office, and terminating his salary. If he finds that no grounds exist, he
shall terminate the suspension, if any.
The district attorney may appeal from an order of removal to the Court of Appeals on the
basis of error of law by the superior court judge. Pending decision of the case on appeal, the
district attorney shall not perform any of the duties of his office. If, upon final determination,
he is ordered reinstated either by the appellate division or by the superior court upon remand
his salary shall be restored from the date of the original order of removal. (1967, c. 1049, s. 1;

No one has ever been able to convince me that arresting,charging and convicting a person who has committed a crime is systematic racism. Society needs to have rules/laws to follow in order to keep peace. At times there are laws that Congress created that weren’t acceptable and they need to be changed. That is why America is set up with checks and balances. Yes there are laws that I feel aren’t legitimate but I don’t break them, I write and call the people who can make the change. That is why they are elected.

Crime continues to explode across the country especially in the big cities. Eric Adams saying yesterday that gun violence is out of control while ignoring the lawless atmosphere the Progressive have created in New York City. Prostitution, shooting up in public, carjackings in broad daylight, drug dealing openly, stealing and looting. Are opium dens next? Just don’t commit any violence. Yeah right, the whole atmosphere is ripe for violence which is why violence is escalating. No way they are this stupid. The Progressives are intentionally doing this so that people are begging them to enforce the law including taking guns. A 13 year old died from a massive amount of Fentanyl. He collapsed in school. Connecticut officials say they will get to the bottom of this and they will find that Biden is allowing Fentanyl to flood the country, but they aren’t allowed to tell the public that truth. Read the hate rag again today and just can’t believe they write the things they do. No wonder our children don’t know how to think and write, they are following the example of the hate rag. In the letters to the editor section one person is arguing about women’s right to choose what’s in their bodies while another on was writing the government has the right to dictate what goes into your body…what are our kids supposed to think!! I won’t even go into the editorial on how to fix elections and make it sound like you want free and fair elections, we are definitely in strange times!

Just finished reading the Pittsfield Police Blog. In less than 24 hours they listed a 37 year old Pittsfield resident that was involved and charged in 3 separate operating under the influence motor vehicle accidents. Guess the legal system is waiting for this guy to kill some innocent person so Harrington can say he didn’t mean to! How about locking him up to dry out. Wonder if he hit some hay bales if he would be locked up? System is completely broken! Watch your backs out there folks!

FBI said the hostage takers were not targeting the Jewish people and yet they took the hostages from a synagogue. They could have taken hostages from anywhere, but they specifically chose Jewish people.
