ADD 2, March 26, evening: The Berkshire Edge has reported new details from the fatal incident wherein a Pittsfield police officer shot and killed a 22-year-old man on Onota Street.

  • The incident took place outside 279 Onota Street.
  • Miguel Estrella died from two gunshot wounds fired by one of two officers responding to the second call for help.
  • After receiving “multiple calls” from 911, police and County Ambulance arrived at the scene. Estrella reportedly declined transport by ambulance to Berkshire Medical Center. Police had determined he had cut himself in the face.
  • On the second call, just four minutes after police left, more calls came in, this time with two police officers responded ahead of Count Ambulance.
  • After firing TASERs at Estrella, “successfully,” police said, Estrella advanced toward them with a knife.
  • One of the two officers responded by shooting two bullets into the young man.
  • The Chief Medical Examiner’s office has scheduled an autopsy for Sunday.

ADD 1, March 26, morning: This news from the Pittsfield Police Department:

On Friday, March 25, 2022 at approximately 9:46 PM, Pittsfield Police Department Patrol Units were dispatched to the 200 block of Onota Street for an initial report that an adult male party had injured himself with a cutting injury and was outside of his residence. Initial responding patrol units located a 22 year old male with an apparently self-inflicted laceration to his face. Officers requested emergency medical services to treat the injury. At approximately 10:06 PM, the subject refused medical attention. The subject was left in the care of his girlfriend, who agreed to remain with him for the night.

Shortly thereafter, at approximately 10:10 PM, Patrol Units were dispatched back to the original location for the male party causing a disturbance again. Upon arrival, units immediately observed that same male party, armed with a knife. The initial responding units requested additional units and equipment. When the armed subject advanced on the officers, they attempted 2 TASER deployments on the armed subject. When neither TASER deployment was successful in incapacitating the armed subject, 1 officer fired their duty sidearm, striking the subject and stopping the subject’s advance.

The initial responding officers immediately attempted to render lifesaving aid and called for emergency medical services. Additional Pittsfield Police Department Patrol Units and Investigative Units, as well as Massachusetts State Police Units responded to contain the scene.

The subject was transported to Berkshire Medical Center. While taking control of the scene, the Pittsfield Police Department requested assistance from the Berkshire State Police Detective Unit assigned to the Berkshire District Attorney’s Office. At approximately 11:20 PM, the Pittsfield Police Department was notified by Berkshire Medical Center that the subject had succumbed to his injuries and was deceased.

The subject’s identity is currently being withheld pending notification of the next of kin. The involved officers’ names are being withheld pending completion of the preliminary investigation.

The Berkshire District Attorney’s Office was notified and took jurisdiction over the case. The case is currently under investigation by the Berkshire District Attorney’s Office, the Berkshire State Police Detective Unit, the Pittsfield Police Department, Massachusetts State Police Crime Lab, and Massachusetts State Police Ballistics Section, with assistance by the Berkshire Law Enforcement Task Force.

At 11 a.m. Monday, at the fountain in Park Square, attorney Robert D. Sullivan, Jr., a political independent, will formally announce his candidacy for Berkshire County District Attorney.

From the campaign press release: “The event will take place at the Fountain at Park Square, in the heart of Pittsfield’s downtown and near the court complex where he has been a fixture, both defending and prosecuting cases. Sullivan has practiced law in the Berkshires for nearly a decade and a half, as a criminal defense attorney and an assistant district attorney.”

“Berkshire County needs a chief prosecutor that doesn’t follow the trends of politics that reach far beyond our county, but rather focuses on the needs of our residents,” Sullivan said in the release. “It needs a chief law enforcement officer who puts community safety and accountability over the false rhetoric of a certain political caucus or movement. The county needs a District Attorney who isn’t a politician.”

THE PLANET recently had a sit-down with Sullivan, who, in the on-record portion, amplified on a key part of his campaign.

Sullivan promised that he would be in the race “to win, not just show.”

“This will be a campaign with a tight organization,” he said, “with the money to compete, and mainly with a message that will resonate with everyone tired of what they’re seeing out of the D.A.’s office under its present holder,” Andrea Harrington. Sullivan called Harrington’s tenure as D.A. “an embarrassment” to the public, the courts, and to law enforcement. “This race will be about competence.”

During Harrington’s term, Sullivan said, “we have seen the high cost to pubic safety exacted by someone who puts politics over justice.” Sullivan noted the exit of high-profile employees, especially Jeanne Kempthorne, who resigned in January 2020. Kempthorne, a highly respected Salem-based lawyer with four decades of experience, quit over her “serious concerns” that Harrington was in over her head and wasn’t following the law.

Sullivan said that too much of Harrington’s energies were going into politics and PR.

“She’s not running a D.A.’s office. She’s running a re-election campaign at the expense of public safety, paid for with public money.”

He noted that with gang activity on the rise, so is the drug trade, and with that, “all that goes with it — guns, battles over territory, violence — with ordinary citizens too often caught up in the mayhem.” He said that every citizen who’s afraid to go downtown, and every homeowner in a neighborhood who has to stay inside out of fear, is also a “crime statistic, just one that will never be counted.”

Sullivan said Harrington’s “criminal coddling” has left Berkshire County less safe that it was when she took office. He spoke of Harrington’s violations of the law, her lack of experience, the “revolving door” with staff, and how the “district attorney’s office has lost the respect of the courts.” He blasted Harrington for running an office that was “scared” of losing cases and for that reason has refused to bring charges.

He said Harrington was a phony and accused her of hypocrisy, looking for a headline, for speaking out against the death sentence when Massachusetts doesn’t have a death sentence, all the while ignoring the “growing number of shootings” in Pittsfield and county and the sheer number of illegal firearms on the streets.

On Sullivan’s Facebook page, he excoriated Harrington for:

  • “Refusing to try murder cases.”
  • “Using public funds to buy a non-disclosure agreement from an employee” (a reference to the firing of Helen Moon from the D.A.’s office).
  • “Offering  a 30-day CWOF for embezzling $30,000”
  • “Dismissing cases without consulting victims.”

He called these cases “all abuses of public trust.”

Sullivan will face the winner of the Democratic primary in September, pitting Harrington against Pittsfield attorney, former D.A. candidate Tim Shugrue.

Robert Sullivan is full of SHIT! It has been decades of failed politicians promising to reduce violent crime in Pittsfield/Berkshires to win state/local office and then produce dismal results. Jimmy Ruberto campaigned on reducing violent crime against Mayor Sara Hathaway nearly 20 years ago in 2003. How did that turn out for Pittsfield? The definition of insanity is saying/doing the same thing over and over again and expecting different results. It is also the definition of a career politicians and a “wanna-be” career politician such as Robert Sullivan.

I – Jon Melle – could say the same things as all of these bullshit artist state and local career politicians and “wanna-be’s” in Pittsfield/Berkshires by promising to reduce violent crime, upgrade Pittsfield’s Level 5 public schools to Level 1 status, bring back the thousands of lost living wage jobs and lost population numbers since the 1970s, recruit one dozen Fortune 500 companies to the PEDA debacle, reduce taxes and tell the corrupt do nothing Salons on Beacon Hill to finally equitably administer state aid to Pittsfield/Berkshires (and beyond), and put wings on Pig(natelli)s so that would they fly around Unicorns on Park Square.

When will the Robert Sullivans of the world please stop with their hot air? Lastly, it is easy to sit there and criticize your opponent in politics, but it is a lot more difficult to produce real results for Pittsfield/Berkshires, Attorney Robert Sullivan!

Wrong Way Harrington’s soft approach on crime has turned Pittsfield into a shooting gallery and Wrong Way is worried about legalized dope injecting places and treating 18-20 year-old’s as innocent 4-5 year-olds. She’s got a few of those currently on trial for shooting and maiming another young guy.

As of today Harrington is facked beyond all recognition. It was Harrington’s lack of leadership that allowed yesterday’s disaster in court. Her lack of management has caused a mistrial due to a tainted witness. Her incompetence left the DA’s office with victim witness advocates that can’t manage family members and attornies who can’t run a trial properly. It’s all over now.

Nick Carnevale‘s parents are going to ruin the trial and Andrea Harrington is so incompetent she’s going to let it happen.
We know the Carnevale’s, they are good people, but their son has no memories of what happened, he has substantial cognitive problems, suffers from seizures, headaches, pain, motor function loss. He can barely remember both short and long term things, it’s all a jumble. It’s well known among friends and family.
His injuries happened during the event he allegedly “remembers”, he has no real memories of the event, only what he’s been coached to say by his well meaning parents. Any brain injury or head trauma or neurologist would destroy this poor kids credibility.
I’m embarrassed that Andrea would allow this, I’m sad that the parents would try and find justice this way. When you make your kid purger himself on the stand, it’s not justice.

Brain injury is complex. It is possible that he remembers. It takes time and triggers [pun] can initiate a memory. That’s why we can’t live easy. You open a soda / we duck & cover. A chopper flies overhead we flip the fuck out. But, we know truth from fiction.

This is going to be a disaster. Before I even read the article in the Eagle today, I was thinking what the defense attorney was thinking: his parents helped connect the dots to “restore Nick’s memory.” I then read the article and saw the defense attorney (Dale Bass) mention the exact same thing I thought of.

I’m not a defense attorney, but if I was, I wouldn’t mind putting Nick on the stand. I would just question him softly and slowly about everything he did for the past month or two. Unfortunately, it will overload his memory and he’ll come across as unsure to a jury. Then just paint the picture for the jury. It will show he’s been coached and it’s not his memory. No need to further traumatize the poor kid. And honestly, I don’t blame the poor parents. I would want the maximum for the animals, who did this to my kid.

Harrington won’t go for the max for a 19 year old anyway, it contradicts her campaign for youth offenders which she has been concentrating on all week.
These parents just want what is best for their son. Sad to say I told you so but they are not going to get it from Andrea Harrington. I don’t blame them for taking matters into their own hands. It’s better than leaving it to Harrington.

Everything a witness says and by extension is asked by prosecution allows the defense to cross examine. The risk is that he is too unstable to sustain an aggressive defense. It goes into the “don’t give your opponent/defense control of the witness/evidence” logic of trials.

Not going into all the details but F Lee Bailey took my client apart back in 1970 when I was stupit enuff to put my deer poaching defendant on the stand. Bottom line is that if your client is caught dragging a ruminant, shot and gutted out of season, back and forth in front of a trail camera, and that video has been on public TV for six months, AND, and your client is a known liar and philanderer, don’t put the son of a bitch on the fucking stand. Don’t do it.

Lesson learned.

Yes, one can pick either or neither. It’s up to prosecutors and defense to choose witnesses. In the Carnevale case, the judge allowed the victim/witness to remain silent due to significant brain injury.

My concern is that prosecution opened the door to a heavy abuse of this particular witness. I don’t suggest you are confused, but you are confusing strategy with options. You claim, “they can be credible witnesses.” The challenge in this case is to what degree will the victim be able to remain credible under exacting questions. He will not be simply establishing that he got shot and was at Washington Mtn, right?

It’s practically impossible to measure the amount of credibility a witness provides regardless of a brain injury.

Why not a conviction based solely upon circumstantial evidence.

In my case ya called a witness police chief who wasn’t a party to the situation and also wasn’t on the witness list. The cop had been fired. Violated my due process. 5 jurors knew him. You got yourselves a gazebo.

So the local paper has a story about the horrifying numbers of opioid deaths in “Berkshire County.” They seem to have bent over backwards, as usual, NOT to give Pittsfield numbers separately. And this seems to be the normal approach to blur the fact that when bad things happen in “Berkshire County” 90-95 percent of it is in PITTSFIELD. But if Joe Blow scans the paper he will get the impression that Pittsfield is just like everywhere else. NOT TRUE. Pittsfield is the HUB of danger in Berkshire County. You are nine times as likely to get shot in Pittsfield as North Adams, probably more. Same for getting mugged or assaulted.

Must be depressing for a young reporter to do a story and then have it red lined to the point you hardly recognize it.

If Harrington’s office screws up the Carnevale trial again and it looks like they probably will, Nipples had better not even show her face in public. Wish the Carnevale family had demanded to move the trial to another County after the previous DA’s office screw-up. Feel that is the only way they will get a fair trial and justice.

Off-topic. Seems like Morales’s latest brilliant idea has arrived. Why are they street sweeping the streets? Watched them on Crane Avenue and they were only enlarging the pot holes and craters. Plus they were tossing broken payment at cars and all over tax payers lawns. Administration intelligence at it’s best!

I think that, due to wholesale neglect of the roads over the last six years, no one knows what to do. Many of the city roads need to be done over from the roadbed. The mayor does not want to use her special interest money for a public problem, which is why we are where we are now. Problem is that the roads are now falling apart so fast that by the end of spring we will be down to chunks of asphalt mixed with mud on a large swath of the city.
Normally a mayor would just leave a situation like this for the next mayor to figure out but even some of the special interest folk are getting bummed out. Patching is not going to work except for a few not so bad areas. But many of the roads are literally dissolving before our eyes.

I am not sure Morales is the problem here. He may just be one more higher level pawn in the administration with his hands tied.

State police are being tasked to investigate the police homicide today. Heads are going to roll. At a minimum there will be homicide charges against two officers, with criminal negligence charges against a dispatcher and two other officers.

They had this person under their control and let him go, knowing he was suicidal. They then returned and fulfilled his wishes of suicide by cop. This is going to end with a paycheck for his family along with a few cops in jail and a couple off the force.

Harrington will screw this up, mark my words.

Here’s hoping PPD heads roll, starting with Chief Michael Wynn. I won’t hold my breath waiting for any of them to go to jail. You’re right, the trained PPD cops had Miguel, who had a history of mental illness, safely, and still alive, under their control for their first response to the scene. It wouldn’t surprise me if the cops didn’t use those few minutes between 911 calls to flip a coin to see which cop was going to blow allegedly suicidal Miguel away when they returned to the scene of the crime.

That financial figure dwarfs the amount of money – estimated to be around $2 billion per year – that the proposed state surtax on earnings of over $1 million per year in Massachusetts would bring into state government coffers. The voters in Massachusetts will vote on the state constitutional amendment to put a surtax on earnings of over $1 million per year on election day in November 2022, which is also when voters will elect a new Governor of Massachusetts.

It is called the career politicians’ financial shell games with our tax dollars! They all get rich at the public trough, while we pay for their lies and false promises to fully fund public education and other worthy public projects and services. After they retire with their public pensions and perks, they go right back to the government as 6-figure greedy registered lobbyists, or millionaire marijuana businessmen. My best friend told me at our lunch together a couple of weekends ago to never trust a career politician, but they lie and make such false promises that I want to believe that they are not all about the Almighty Dollar and power. I also want to believe in the Afterlife, that I will win the Powerball lottery jackpot, and that my beloved nearly 14-year-old dog will live at least 6 more years with me.

Studies show that the more money a school system has the smarter the kids get. And Pittsfield is a case study. If you totally disregard the absentee rate, the drop out rate, the abysmal scholastic rate, the revolving door teacher and superintendent rate and the bullying, your kid might come out a genius. The point blog writer/posters are making is that the career politicians increase taxes by lying to us and making false promises to fund public education and other worthy projects, programs and public services, but at the end of the proverbial business day, they are never fully funded because the politicians ALWAYS use the tax dollars for their own self-interests to enrich themselves and their campaign donors at the public trough. No one said/wrote/posted that spending money on public education automatically produces better results. To illustrate, career politician Smitty Pignatelli writes the loftiest op-eds in Western Massachusetts newspapers saying that he is fighting for state funding and so on, but I have followed his nearly 20-year public record on Beacon Hill and he mostly votes in favor of the top-down State House leadership’s legislative agenda, which does DISSERVICES against the people and taxpayers who live in Western Massachusetts and points east. Smitty Pignatelli voted for and accepted countless state legislative pay raises and public perks, and he makes 6-figures doing nothing in state government. NEVER trust career politicians! And keep them as far away from public education as possible.

After responding to “multiple 911 calls” Trained Pittsfield cops left the self-harming, a danger to himself, “crazy acting again” knife wielding subject, with a history of mental illness, in the care of his girlfriend, at an apartment complex full of potential victims. Just four short minutes later, certainly enough time for Pittsfield cops to retreat to the Crossroads parking lot, get locked and loaded, and return to the scene of the murder by cops. So, we’re to believe that within 4 minutes, more than enough time for the cops to get locked and loaded, the same knife wielding crazy acting mentally ill subject, obviously deemed NOT a deadly threat/danger to himself, or anyone else at the apartment complex full of potential victims, where the cops left him, just a short 4 minutes before, NOW, needed to be shot to death in the street like a rabid dog.

And in other news, at an event where trigger-happy Pittsfield cops were not invited, a 40-year-old man wielding a crossbow held cops off in a 9-hour standoff, and EVERYONE lived through it.

The Brien Center and Law Enforcement

Since 2016, a Brien clinician has accompanied Pittsfield Police as a co-responder on calls that have a mental health or substance misuse component, successfully diffusing situations that have the potential to escalate very quickly. Most of these calls involve people who are suffering from psychosis, who are suicidal or whose behavior is frightening or threatening to family members.

Also curious is that Brien center crisis liaison must have had the night off, again.

“Tyer confirmed Tuesday that she will accept the council’s recommendation to reallocate $85,000 from the nearly $4.3 million patrol line item. She said the process to find two more crisis intervention counselors will begin immediately after funding is officially in place.

Wynn said that a Brien Center representative reached out to clear up a misunderstanding that the council’s vote indicated the department was moving to withdraw its partnership with the center.
On the contrary, Wynn told the advisory board, “We need them, but we don’t know that they’re going to be able to provide more people.”

The police department works in partnership with the Brien Center through social worker Richard Collins, who is on hand 40 hours a week to respond to calls for people in crisis with officers.

Three specific cases which lead to a death. The third recently. A mentally unstable man was left in the custody of his girlfriend? And this didn’t seem serious enough at the intitial police call but escalates into the victims death minutes later? Let alone having a plan other than a kill shot. This is what the latest protests like defunding police and b l m is all about.

The other was the little girl on Plunkett St and the decision to let a nefarious at best individual as overseer of that child’s welfare with no welfare and well being checks? Ending in death.

And the little baby dying at the custody of so called professional caregivers who gave no care and D C F was negligent in my opinion with the whole matter. Life maintenance 101 madame D A.

Two hours Wynn and his completely incompetent PPD let this guy wander about with a knife and put him in the care of his girlfriend who originally called the police.
