Incumbent Andrea Harrington will meet attorney and challenger Tim Shugrue. As we did for the sheriff’s race, we shall have the twin hot seats set equally on “HIGH.” The hour will be broadcast on our new YouTube channel, PLANET VALENTI VIDEO, and other social media (Facebook, Instagram, etc.) later that same evening].

(FORTRESS OF SOLITUDE, MONDAY AUG. 15, 2022) — Games.

That’s what political campaigns are.

Serious games, for the way politics affect the daily lives of individuals and the quality of life for communities. For example, why to you think Mary Jane and Joe Kapanski have seen their private lives assaulted by unsustainable tax hikes? Why is the city of Pittsfield closer to third-world status than a beautiful small city?

One reason. Politics.

Campaigns are games, and those games matter.

Presently, Berkshire County has two such games under way: the races for sheriff and district attorney. Some ways they are the same; some ways they are different.

SAME

  • Both races will be decided Sept. 6. The four candidates — challenger Alf Barbalunga and incumbent Tom Bowler for sheriff; challenger Tim Shugrue and incumbent Andrea Harrington — are Democrats.
  • There are no Republicans on either ballot.
  • November , thus, will be coronation month.
  • Both races feature strong, well-funded, determined challengers against connected, stand-pat incumbents.

DIFFERENT

  • Tom Bowler hasn’t been seriously tested in 12 years. Harrington narrowly survived a tough race four years ago.
  • Sheriff contenders have been duking it out heavyweight style, and it’s been generous to the electorate. Meanwhile, Harrington has been absent, hidden by her handlers while Shugrue has been nonstop on afterburners. In that way she has cheated the voters.
  • Barbalunga and Bowler each had the stones to sit in THE PLANET‘s double hot-seats and go at it in one of the most exciting and informative debates in you’ll ever see. They’re legit. They showed up. Question: Will Harrington answer the call 3 p.m. Wednesday when we tape “live” the D.A. forum? Shugrue will be there. Harrington has not declined. Sources are saying she will show, because if she doesn’t, she will lose. We’re taking that as a “yes.”

SHERIFF NOTES

If the sheriff’s contest was a football game, first quarter was June 2 (Bowler announces) through June 15 (Barbalunga’s launch). Bowler had a 28-7 lead. July, second quarter,  Alf get hot. Bowler 31, Barbalunga 17. In early August, Alf began hitting downfield against Bowler’s Pree-vent defense, culminating with THE PLANET debate. End of third quarter. Bowler 33, Barbalunga 25 (Alf made a two-point conversion; Bowler caught Alf in the end zone for a safety).

It’s now the 4th quarter in a one-score game. Pudge, from his own 16, got off a booming punt with an eternity of hang time. Afl called for a fair catch on his own 18. That’s where we stand. Talking with both coaches, Alf’s going all-in, Tom-Brady-attack-mode. Pudge is calling on Bill Belichick’s stifling “D” from the “wide right” Super Bowl win, Giants over Bills.

Who’s going to come up big in crunch time?

First time up, Bowler faced ex-state rep. Dan Bosley. His law-enforcement experience plus temblors from the Carmen earthquake paved the way. Second time, no opposition. A breeze. This time, he’s facing a campaign spending $110,000 led by a well-known chap with deep political connections and a taste for the jugular who isn’t afraid to use slash-and-burn tactics worthy of Sherman’s March to the Sea.

None of this, of course, reflects on the ability of either man to be sheriff. Bowler has 12 years and counting on the job. The record is there to examine. Supporters back him without qualification. Barbalunga has never done the job, though he has many years of experience in the criminal justice system. His supporters, using the same track record of the sheriff, say it’s time for a change.

That’s why we conduct elections.

One last comment, and this applies to both sheriff and DA. Turnout will be a large factor. Pundits expect low turnout, maybe 10-12%. THE PLANET predicts 15%. This will favor the incumbents and make the challengers’ task all that more difficult. Both races will boil down to three factors:

  • How energetic are the bases of Bowler and Harrington? Bowler enjoys strong support. Harrington doesn’t. His base is out there. Hers is reticent, almost embarrassed, to go public. Lots of “basement stumping” for her. Loud support for him.
  • How successful will Barbalunga and Shugrue be in getting voters to the polls? The higher the turnout, the better their chances. Both have proven to be dynamic campaigners, and they are doing their best to ignite the casual non-voter.
  • Bowler and Shugrue are allies. Same with Barbalunga and Harrington. If Shugrue gets it on for Bowler, he energizes Harrington’s people. If Barbalunga pushes for Harrington, he’s helping Shugrue. Alf has tried his best to distance himself from Andrea. In THE PLANET‘s debate for sheriff, Alf refused to explicitly say he would endorse Harrington. That said it all. Bowler took the opposite stance. He came out cloud and clear for Shugrue.

D.A. NOTES

Tim Shugrue  just won a key endorsement, the most important of the campaign. The Massachusetts State Police Association said there’s only one choice for D.A., and that ‘s Tim Shugrue. The challenger’s packed schedule of events, the relentlessness of his stumping, plus his rich background as both a defense lawyer and prosecutor stands in stark contrast to Harrington. She’s barely seen, her supporters seem subdued, and she has almost no courtroom experience, which could explain her reluctance to actively campaign.

Here are the keys to this race:

  • Shugrue needs a big win in Pittsfield. He’ll get it.
  • Harrington needs an even bigger showing showing in north and south county, even bigger than four years ago.
  • If Shugrue keeps it close in Willamstown and Lenox-GB, he wins.
  • If Harrington takes the woke vote in the north and south county enclaves again (the way she did four years ago against Paul Caccaviello) she takes it.

If I am running Shugrue’s campaign, I put a lot of resources between now and Sept. 6 in north and south county. If I’m running Harrington’s campaign, there’s no way I let her skip THE PLANET‘s Wednesday debate.

She skips, she loses. Simple as that.

People will come through for the right ones – Bowler and Shugrue. Anything else gives Tyer et al a vote. Please people, vote for the good guys for once! Not the good ol boys ( or girls!). Vote for Berkshire county, it’s to time to take our county back!! Vote Bowler, vote Shugrue.

The Harrington camp is crazy not to attend the Planet forum. I see that Bowler vs Barbalunga has well over 2000 views and with smart TVs where a family can watch YouTube who knows how many have viewed? The other forum won’t reach very many views.

You may write in Boss Hogg for Sheriff. I am rooting for the A-Team: Alf & Andrea. Whether it is Boss Hogg, Alf & Andrea, or Tom & Tim, these two elected positions pay a whole lot of money and benefits that most people could only dream of receiving from the public trough. When Dan Bosley ran for Sheriff in 2010, people sarcastically wrote that he was like Boss Hogg trying to double his state pension. Dan Bosley still cashed in with his public pension(s) plus perks on top of his 6-figure lobbyist salary on Beacon Hill and beyond. Boss Hogg, Dan Bosley, and the four candidates for running for the two Berkshire County plum positions all like to roll in the taxpayers’ dough! Meanwhile, “Rome is still burning” in Pittsfield, but let’s blame Linda for it all because we need a scapegoat to make ourselves feel better.

Use a teakettle. Preferably one that whistles randomly. David Lynch has one of his characters speaking from a tea kettle so the art reference is nice touch. Lynch movies pro-police too. Kind of a version of genie lamp.

Kettle makes more sense in ways more than one.

In addition to the plant, I think a life-size cardboard cutout of John Krol should be added to the empty seat if Wrong Way is a no-show.

You could use the pic of him in the recliners at Stanley’s Steamer with Flat.

Bowler wins but it’s not a strike or even a spare. Barbalunga hits below the belt a few more times, and Bowler has a rude awakening, and spends the next 6 years grooming his replacement to knock Barbalunga out next time. Does the replacement have a B in his name too?

Alf is out of gas.Carm himself knew it would be better to just vannish by stepping away to let a good person run the prison.I can’t imagine one person in all of berkshire county thinking it would be a good idea to let the no show Barbalunga intimidate and poison a jail the way Carm did.

In looking at Facebook and the pictures of people coming out to support Bowler, he’s universally popular.

I’m a lifelong Democrat, 28 years registered as a Democrat and a caucus member. I fully support Bowler and know what a sniveling scumbag Alf is. Why? I’ve worked with him. There isn’t a person less qualified for the job than Alf.

What is safe to say, most of the people supporting Alf either owe his dad a favor, want him not to work in probation, or are of the criminal element type.

Definitely not a fair conjecture. Nearly 3/4 of voters in Berkshire county are democrats. Even so, given that Bowler won by nearly 80% (in 2010) in one of the county’s bluest towns (Pittsfield), I’d say he represents the average Berkshire County voter. In looking at these comments I think there is a clear delineation between Dan’s typical reader (who lean more conservative) and Bowler supporters who have been brought to the site on account of the race. I’m not sure how much of an overlap there is between the two. I imagine there’s a lot of new readers to this site that have been due to the fact that Dan is providing one of few channels of discourse and investigative work. Perhaps Dan can shed some light on how readership analytics have changed since this race took off. He’s mentioned an increase in clicks/video views, but perhaps he can share insights on new, unique visitors as well. Either way, I think your assumption is pretty off JStoutman.

Four years ago, I joined the effort to elect Andrea Harrington as Berkshire district attorney. My interest in doing so was rooted in dismay at the office’s prior administration.

I have watched closely the work of the DA’s Office under Harrington. Whatever one makes of the endorsements she is now announcing from politicians who live outside Berkshire County, her office’s performance on the nuts and bolts of its prosecutions has been woeful.

I have been a trial lawyer for 42 years. I spent 10 of those years as a federal prosecutor. In that period, I ran the U.S. Attorney’s office in Springfield. Among other cases I successfully prosecuted during those years was the biggest armed robbery case in the history of Berkshire County. I know what it is to be a quality prosecutor.

The failures of the DA’s Office under Andrea Harrington to effectively prosecute its major criminal cases have been frequent and noteworthy. Two of the most recent of those failures are telling.

In 2021, Harrington charged Cassandra Barlow-Tucker and Matthew Tucker, of Adams, with involuntary manslaughter alleging that they had, acting as foster parents, recklessly failed to provide basic medical care to a foster child in their care and so were criminally responsible for his death.

The Tuckers faced 20 years in prison if convicted, and suffered the devastating loss of reputation that attaches to those charged with killing a child.

Almost a year later, after conducting hearings and reviewing written submissions from Harrington’s office and the Tuckers’ attorneys, Berkshire Superior Court Judge John Agostini made detailed findings of prosecutorial misconduct by Harrington’s office and dismissed the case against the Tuckers. Judge Agostini is a highly esteemed Superior Court judge. In dismissing Harrington’s case, he wrote a thoughtful 17-page decision which concluded with the stinging comment that District Attorney Harrington’s presentation was “not the standard of conduct the court expects from the Commonwealth in grand jury proceedings.”

The Eagle wrote an editorial addressing the DA’s misconduct in this case and, in less circumspect terms, wrote that “Overreaching to obtain indictments is a dangerous abuse of discretion, but doing so in a case that tries to hold a foster parent criminally responsible for a child’s death is truly reprehensible.” Harrington has now appealed this ruling but has refused to respond to The Eagle’s request on behalf of the public for even the scant details of her appeal.

More recently, Harrington’s office lost a first-degree murder case where the evidence included the video confession of the defendant admitting to the murder. During the trial, the defendant testified that his confession was false and that he had given it only under pressure by police officers. But Harrington’s office chose not to call those police officers to testify and rebut that claim. After the trial, the police involved in that investigation publicly rebuked her office for not calling them as witnesses who could have thoroughly undermined the credibility of the defendant’s claim that his confession was coerced.

If Harrington did not believe the police who investigated the case and therefore would not call them to testify, she should either not have introduced the confession into evidence or not have prosecuted the case at all. If she believed the police, she should have called them as witnesses. At best, her office’s decision-making in this matter is inexplicable. At worst, it is prosecutorial malpractice.

These two cases exemplify the Harrington administration’s poor judgments in major prosecutions. It is fine for Harrington to lean on her progressive values and political endorsements to seek reelection. It is another thing to do the hard work of effectively and fairly prosecuting the real and dangerous criminals in Berkshire County, which is her office’s primary mission. That Harrington has failed to do.

Harrington’s public pronouncements criticizing others who serve in the criminal justice system also deserve some attention.

In May 2021, Harrington wrote a letter to Massachusetts District Court Chief Justice Paul Dawley, stating that District Judge Jennifer Tyne, who regularly presides over Harrington’s District Court cases, was a “significant threat to public safety.” Harrington described some of Judge Tyne’s rulings as “dangerous” and alleged that she engaged in “hostile treatment of victims and prosecutors.” She demanded that Judge Tyne be removed from the bench.

After carefully reviewing the tapes of the proceedings in question, Justice Dawley determined that there was “no factual basis” for Harrington’s allegations; rather, the recordings reflected Tyne’s “careful and thoughtful analysis,” and her rulings were “properly within the bounds of lawful judicial discretion.” Despite these findings and widespread support in the bar for Judge Tyne, including from many former prosecutors, Harrington has repeatedly and publicly stated that she “stands by” her criticisms.

And in January of this year, Harrington publicly proclaimed a strong but very dubious opinion involving the federal indictment of State’s Attorney for Baltimore Marilyn Mosby. Like Harrington, Mosby was part of a self-styled group of “progressive” chief prosecutors whose mission is to reform the criminal justice system. One day after Mosby’s federal indictment for perjury and other significant felonies, Harrington rose to her defense. Harrington wrote in a since-deleted tweet: “Seeing the justice system used against @MarilynMosbyEsq is scary for those of us taking on the status quo. I have tremendous respect for Marilyn’s leadership and her courage but she shouldn’t have to bear so much. This MLK day, I will be celebrating her.”

In essence, Harrington implied that the federal charges against Mosby were trumped up by the scary “status quo,” which apparently included the United States Department of Justice, which brought the charges, and the federal grand jury that indicted her.

Harrington’s unsubstantiated criticisms of others acting in good faith in the criminal justice system, like Judge Tyne and the U.S. Department of Justice, undermine the public’s trust in our criminal justice system to no good end.

All in all, the people of Berkshire County deserve better from their district attorney — a lot better.

Eagle had more details today on Bowlers underling getting an extra 70 on top of 6 figure pension to run the meal program for certain people, out of the old jail , and of course the end justifies the means, it’s a worth program, blah, blah, blah. The bottom line is this is a totally inappropirate use of our tax dollars, and all these agencies and organization are sucking off the taxpayer tit, and the old jail should have been sold to the highest bidder years ago. It’s a classic example of democrats and their policies rapiing us Kapanskis, and I am sick and tired of it. As a minimum, sell the old jail. Bowler is basically running a massive social services agency!

Who benefits from Pittsfield school system meals programs.??..First it was legitimately hungry kids. Then it was any kid whose mommy did not feel like making him breakfast or lunch, and NOWWWW, it is EVERY kid who makes it to school on any given day. Dan, I agree with your percipient analysis of these two races. Doesn’t matter if Bowler is the second coming of Jesus, or Babalunga is the devil in disguise, or vice versa, it’s about campaigning, messaging, getting out the vote, etc, as you say. Poltics is a blood sport and it really isn’t about who is best for the job, but rather who has the best sales job, and who punches better. Barbalunga is going to go for the juggler. That is why I have written that Bowler needs to get on offense. Being a well liked nice guy may not be enough, even if he has done a great job running the jail. Even if all the Barby Bashers on here are correct, most people don’t know about Barby’s Baggage and Barbalunga isn’t spilling his dirty laundry in public. It’s Bowlers job to do it.

Alf complains about the budget constantly, bringing the same services from Chicopee to Berkshire will add to that immensely. That’s the point! Female inmates are getting the services they should get in Chicopee. Tom bowler doesn’t do what is right for himself, he does what is best for his jail and his community. You must be delusional. She got hammered even with the softballs and the clear slant in her favor.

That high pitched “I’m a manager I don’t have to try trials” doesn’t play because she’s managed our office into a complete mess. If anyone needs advice they ignore what she says and asks Bell. Well they try to but she’s so locked in her office with a closed door policy, Bell often doesn’t help anyone. It’s like trying to get an angry bear to help, Bell is constantly angry.

For those in the public that don’t understand, that press conference for “Miggy”. She did absolutely none of the work, she spent the whole time campaigning from her office, she tried to intervene and wanted to say more bad things about the police with zero facts, Bell shut her down. It took half a dozen people a weeks worth of man hours to prep her for that conference. It was painful to sit there and watch all the effort put into trying prop her up in front of the camera. She still screwed it up and just read the report straight out.
Please god let this end soon send her back to her super successful private practice.

Also since none of the democrats in office don’t want to go against the party, they aren’t going to endorse Shugrue but you can bet their lack of endorsement of Harrington is really an endorsement of him. It’s unprecedented how many local politicians aren’t endorsing her for the office she’s an incumbent in. The name Harrington is political poison.

She’s the actual DA managing the office and making sure some things are functioning. The problem is if she doesn’t like you, she’ll undermine you if it suits her mood. Bell is more conniving and backstabbing then even Andrea because at least Bell can help you, when she denies you that help it ruins cases and she’s not adverse to screwing up a cases because of her pettiness.

In the last week it’s been Andrea campaign culture x 1000! The no endorsements from Tyer and Smitty is driving her nuts. She was apoplectic when she called Pucci and found out he was not only going to not endorse her, he was going to campaign against her.
Andy is doing double duty as spox for the office and helping prep things for the campaign. They act like it’s not happening but a good 2/3 of the office is in panic campaign mode.

Andrea spends an inordinate amount of time obsessing about who’s talking about her, what the “buzz” is on the internet.
She has sort of an ebonite’s list, so when something is negative, she assigns who she thought said it. Melissa is a judge target for her. Andrea is also obsessed with who is leaking stuff from the office, she thinks is one or two of the Detectives assigned to the office. She tries to butter them up. I don’t know if they are leaking things but I sure know Moon would constantly leak stuff. What moon didn’t fully understand is that Andrea and Josh Landes have a “special relationship” so when Moon went to Josh, Josh outed Moon to Andrea pillow talk style.

It’s amazing to watch the frenzy that this election has put her through. Flop sweat Harrington is her newest nickname.

This blog if often rife with racist and downright dehumanizing opinions. I would be embarassed to admit to many in my circle that I thoroughly enjoy this blog and read almost everyday.

Dan, you do an excellent job revealing proprietary information and reporting the facts, but your audience often ruins the content.

Whether it’s a 50-post long idiotic bash between two posters or someone rambling on for 1000 words, to the constant obession with Donald Trump – this blog often has a hard time staying on course and relevant. This is no offense to you, just a downfall of the internet and being a public forum. Your security changes as of late have made it better.

But Andrea is 100% right for declining. Would you go to a gathering where 98% of the people there hated you? Would you go anyway so that once you left, all your haters would have more fodder to bash you with? This blog is full of bully and Andrea haters. Any person running for office needs to be seen and heard by all especially the voters who may not agree with them, so I think it shows a weakness in the DA’s makeup that is a serious one. A DA has to be tough and tough skinned to get the job done. As for the racist, dehumanizing and TDS on this blog, most writers have been trying to educate TSC, Fizzlehead and JM on being more open and understanding to all people of all makes and colors but it has been very difficult for them to open their minds and learn. Don’t worry I am sure the writers on here will continue to offer our help and support in their continued education of being open minded and turning off the brainwashing TV channels they watch

Certain members of the NAACP who were part of the debate asking questions of the candidates for da are all about not the crimes being committed, but what will happen to the criminals after the crimes are committed regardless of the nature of the crimes.Harrington pretty much uses race in every question and response she gives to anyone no matter the questions. Put the F’N blindfold back on lady justice!

I agree OP. I also think there’s more to keeping DA Wrong Way.

A big reason, no oversight on certain groups who might be misappropriating funds. ARPA funds come to mind.

I’m not an expert in the use of ARPA funds, but something tells me a trip to another country to explore your roots, was not an intended use of taxpayer money no matter how much glitter you put on it. DA Wrong Way has been very soft on crime with this group too,

Just thinking outside the box.

Letter: Pittsfield has a panhandling problem

To the editor: When is Pittsfield going to crack down on panhandling?
You can stop at about a dozen intersections throughout Pittsfield and Lenox with these people looking for handouts. What disturbs me and others is that some drivers keep giving money — wise up, people.
I saw the person by Hubbard Avenue a couple times frequenting Starbucks and then having the audacity to sit with a sign and large Starbucks cup telling us he needs help.
Guess what — most people stopping at these intersections cannot afford Starbucks. If they are that hard up, there are agencies in the area to help. I noticed most weekends they are nowhere around — must be vacation. Why don’t the do-gooders around town help them off the streets?

No it’s worse than her trips to Portugal or Ala. or Calif. being funded by taxpayers. They were paid for by this group which is funded by the Soros money machine. Letter: Harassment of actors at Pittsfield Common was shameful

To the editor: It was disturbing to read about the harassment of the Shakespeare actors and staff at the Pittsfield Common. I am part of the volunteer group, Pittsfield Beautiful, that was at the Common at 8:30 a.m. Aug. 12. We were there to weed and mulch around the plantings. We do our best despite dealing with cigarette butts, drug paraphernalia and other debris around the gardens.
If these kids have the time to harass people, wouldn’t it be nice if the courts told them to get out of bed and show up at 8:30 a.m. to work alongside Pittsfield Beautiful and do something good for the city?

Just a thought.

Which is comparable to Alf’s issue of bringing female inmates back to Berkshire. This is his Williamstown. Just like AH said we will start investigating sexual assault cases on day 1, Alf says we will begin the process of bringing female inmates back on day 1. PEOPLE!!!! It will not happen, it’s the issue he is using to try to get elected. Don’t fall for it and don’t believe his hires will make any less money than those do now either. Alf lies!!!

The bad thing was the shooting was going on as people were going to the common and kids were playing in the splash pad

The police didn’t even bother to say anything because they didn’t want to upset anyone. They were going with “the public is not in danger except we have a drive by shooter on the lose where kids are playing and people are going to a concert.

Adam Foss, an advocate for criminal justice reform who Andrea Harrington brought to the Berkshire District Attorneys office to “discuss what the future of the criminal justice system can look like” has been arrested for RAPE.

Foss was indicted Tuesday in Manhattan Supreme Court on charges of first-degree rape and sexual abuse. He is charged with raping a woman, 25, while she slept in Midtown Manhattan hotel room in 2017.

He was previously cleared of another rape by Harrington pal former DA Rollins who he endorsed for Suffolk DA.

Harrington brought Foss to the Berkshires to help her “prioritize domestic and sexual violence” and “provide ADAs with the tools they need” according to iberkshires.

Tuesday afternoon along Route 7 (First Street) in Pittsfield:

4pm: Brazen daytime shooting at a convenience store with at least one victim injured.

A few hundred feet away…

5pm: A lovely crowd gathers in the adjacent park for an evening delight of “Shakespeare in the Park”.

Literally hundreds of people set up with lawn chairs and evening snacks a thousand feet from violent, daytime shooting.

Only in Pittsfield. Everyone is still safe as the night Barry walked the strip at 3am. Hallelujah!
