BATORY STANDS HER GROUND AGAINST MAYOR: ‘IT’S NOT PETER’S RULES; IT’S ROBERTS’ RULES

Consider it an early bonus.

Here is the polished version:

School committee (SC) newbie Ciara Batory campaigned on transparency, openness, and sticking up for Mary Jane and Joe Kapanski, even if it meant sticking it to the man, particularly with respect to releasing the “independent,” $155,000 report on school department scandals. Well guess what? She’s actually fulfilling those promises.

This man loves transparency … except when he doesn’t.

That’s something unique to Bitchfield. Let’s see. Official, “representative Bitchfield has one mayor, 11 city councilors, and seven SC members. That’s 18 “reps.” Thus far, We The People have evidence of one true Rep. That’s Batory. One-for-18 produces a batting average of .055. In the Dreaded 18, we have one repeat member, Mayor Lumpy.

THE PLANET asks why the mayor is even on the committee, let alone chairman. It’s a decided conflict of interest, but wise and procedurally. But this is Chinatown, Jake, where corruption and abuse of power is the norm. We saw that on full and raw display Wednesday, when the SC met.

The mayor and Batory got into it when Lumpy introduced an item that wasn’t on the agenda, let alone put there by Batory. You’ll recall that on Jan. 28, the SC voted to RELEASE THE REDACTED SCANDAL REPORT by Feb. 18. Done deal, right? Not so. Feb. 18 came and went with no report. On Wednesday, Marchetti introduced the matter again, essentially saying it needed to be approved again.

In a blatant disregard for the law, the mayor pretended through a convoluted “explanation” designed to confuse the matter that in its Jan. 28 vote, the SC did not actually approve but voted to send it back a second time for review based on fuzzy, phantom legal threats from one parent and the teachers union. Of note, Batory did not receive one syllable of support from her five colleagues, who enabled the petulance of the mayor.

Batory, in a Facebook post wrote:

For the record I did not place this item on the agenda. The Chair placed this item on the agenda without my request or consent, and that is not how this process works. Under Robert’s Rules of Order, a member has the right to control their own motions and how they are presented. Assigning an item to a member without their authorization is improper and misrepresents my position. This is an abuse of process, and I want the record to clearly reflect that I did not submit this agenda item. WE ALREADY VOTED ON THIS! We cannot claim to follow procedure while denying members the floor and assigning them agenda items they did not file.

Here’s the exchange. It highlights Lumpy’s problem in dealing with strong, independent women. It also shows The Suits’ puzzling attempts to keep the report hidden, which makes no sense. On the one hand, they say the report found nothing of concern. On the other, they claim that releasing the report will spur a lawsuit. That’s contradiction is easily resolved — (a) release the report and (b) let them sue (unlikely). Call their bluff.

Here’s the exchange from Wednesday night:

BATORY: Can you clarity if there is active litigation or a specific legal claim?

MARCHETTI: There are threats

B: OK so then that’s just a threat and not an actual legal claim. I fell like we already did this (1/18 vote) 

M: I think we did and its on here because I know some of you actually went to the administration building to read the report. So it’s there just … I’m sure there’s probably not much we will be discussing in executive session

B: So I just have a point of clarification. The school committee already voted to release a redacted version of the report and that vote has already taken place.

M: A correction to that,that, because I specifically asked you before you made your motion [to release the report] to have it come back to the school committee for review before it was given to the public. And that’s the motion you made [it wasn’t] and that’s the motion you made …

B: The motion that I made was for release of the redacted version of the report. You came to me because you said that if I did not say that if I did not say that that I would be handed a blank piece of paper.

M: No. I said that …

B: That we should review it. In my motion, it was not a motion to make another motion. It was a motion that 

M: You made at that that the mo— the chair’s making the ruling that the motion you made that day [1/28] was for the report to be …

B: My motion — point of order — 

M: In that, I may … we can go back and play the tape [voice rising].

B: Please do. Please do,  go back and play the tape because you guys voted to …

M: You can vote ‘no’ and the rest of us will go into executive session. Roll call, madame clerk. 

B: Sir, I did not yield the floor. 

M: I —

B: I did not yield the floor. 

M: I am telling you you are out of order and to stop.

B: I am not out of order, because I did not yield the floor.

M: [strident] Roll call madame clerk.  

B: Point of order for clarification and you …

M: I gave it to you. I gave you the clarification. 

B: I’m telling you that is not what my motion said.

M: And I’m telling you differently.

B: Are you telling me it is what I said? My motion was to release a redacted version of the report. 

M: Roll call, madame clerk. 

CLERK: Miss Batory.

B: I’m not Im not done talking. I didn’t yield the floor. 

M: [snippy] What’s your vote? 

B: What’s my vote?

M: Ye’m ma’am.

B: I wan’t done talking and I didn’t yield the floor. 

M: I told you that … I, I provided you the answer to your point of order that you’re done. What’s your vote. 

B: I’m not done. I I didn’t yield the floor, Mayor.  I …

M: You don’t have to yield the floor. You asked. {C tried speaking] Scuse me. 

B: I know what my motion  said …

M: Mmm you asked for a point of order 

B: Roberts rules, if you want … if we did want to go back and vote somebody, I know there was talk about that — they would have had to then done a motion to redact my motion   for another vote. I never said that we would vote again. I said we would release a redacted report.

M: I’m telling you [that] you had a point of order. The chair ruled.

B: It’s not Peter’s rules. It’s Roberts rules. 

M: The chair ruled and we’re moving forward. Roll call. 

CLERK: Miss Batory. 

B: No, because we’ve already done that. Like I said, this is also not … this is a threat. This is not somebody suing us, which is what we’re being told numerous times. This is a threat.

M: [PAUSE]  Next.  

CLERK: Miss Batory.

B: [votes] No.

THE PLANET thanks Batory for standing up to a bully. She’s fulfilling her campaign promises and, unlike Mayor Lumpy, at least can leave the room with a clear conscience.

Hello blogger Dan Valenti,

Peter Marchetti is a DISGRACED politician. He should RESIGN the Mayor’s Office. His inappropriate unprofessional behavior towards School Committee Member Ciara Batory is inexcusable.

The hidden Pittsfield school legal report is obviously a cover-up. They are doing everything to keep it hidden from the public. There is NO trust between the common people and the corrupt government in Pittsfield politics. (So much for Peter Marchetti’s “One Pittsfield” tagline).

Earl and the 2-Pete’s Pittsfield politics have to release their fiscal year 2027 municipal and public school operating budget proposal soon. Pittsfield has the 2nd highest in Massachusetts Commercial tax rate in Massachusetts only behind Holyoke. Residential taxes and fees in Pittsfield are a lot higher than peer small cities to the tune of tens of millions of dollars per fiscal year.

In fiscal year 2026, Pittsfield is currently spending over $62 million dollars more than Westfield. They are 2 similarly sized small cities in Western Massachusetts. (What is WRONG with this picture?).

There needs to be a FORENSIC Audit to explain why Pittsfield is always over-taxing and over-spending taxpayer dollars.

I do NOT know what is WORSE here. Is it Mayor Peter Marchetti’s history of inappropriate unprofessional behavior towards women, especially with the hidden legal report whereby he acted abusively against School Committee Member Ciara Batory, as well as the fact that he is named in a federal sex discrimination/harassment lawsuit by Victoria May, OR is it Pittsfield’s decades of financial mismanagement that is costing the Kapanski’s an excessive amount of tax dollars?

Ciara Batory is a real leader who is standing up for what is good and right in Pittsfield.

When you speak up, instead of being heard, you are argued with. When you bring facts, instead of engagement, you get dismissal. When you stand your ground, instead of respect, you get talked down to. That is not a one time interaction. That is a repeated experience that people are starting to recognize.

There is a difference between leadership and control, and what we are seeing does not feel like leadership. It feels like someone who takes disagreement personally instead of understanding that it comes with the job. Public service requires listening. It requires humility. It requires the ability to sit across from someone who disagrees with you and not turn it into a power struggle.

Instead, the conversation gets redirected, the concern gets minimized, and the person raising it becomes the problem. That is not communication. That is deflection. And when this happens over and over again, it stops feeling like a misunderstanding and starts to feel like a leadership style.

Are we okay with a city where speaking up means preparing to be dismissed? Where asking questions turn into being challenged personally instead of answered professionally? Where accountability is treated like disrespect?

Because strong leadership is not threatened by being questioned. It does not need to argue its way out of every uncomfortable moment, and it certainly does not need to belittle the people it serves to maintain control. Strong leadership listens, engages, and responds.
Petty Peter doesn’t like being challenged.

What would you expect? Do you think the Machine would even blink at a recall? It would be their moment of victory because no one here (the odd few who actually live in Bitchfield) will even show up to vote and the rest will ignore it too. Count on 30% interest with half owned by the Mayor. They’ll probably put some other business on that ballot too.

Ciara Batory is doing exactly what she was elected to do…expose the corruption. In response to Mayor Marchetti saying, “There have been threats if we release the report”, Ciara responded, “At some point, we have to separate legitimate risk from fear-based decision-making — because the public deserves transparency, not speculation.” Perfect answer.

Ciara has blown all credibility she had to actually make a difference.

She outsources all her thinking and research to Chat GPT, doesn’t understand anything about her position and how the rules around it work, and contradicts herself when ranting about funding levels while shes about to blow taxdollars getting the city sued releasing the report.

As a PARENT I understand releasing the report for our kids but the report will be redacted and by the sounds of the committee it won’t have any new information. The report will have confidential information in it though that is protected by law. The cost of this would be the city getting sued by the unions. The unions have sent formal lawyer demand letters to the city saying they will sue if the report is released. You would think people that work with classified information at their work would understand this? As a TAXPAYER watching the city cut our schools and have shit roads I dont see the value in releasing the report. I wish Batory and Moody cared more about MY TAXDOLLARS

The unions exist to protect school system employees, not students. And certainly not taxpayers. If the unions are opposed to releasing a report about dirty employees then you know it’s a good idea to release the report. Whose side are you on?

The secrecy in releasing this PHS report makes me take pause and wonder who are they really protecting?

IMO, it’s our former failed Mayor Linda “Flat” Tyer-Clairmont.

It’s alleged this disturbing child predatory behavior by adult female administrators has been known (and ignored) long before Mayor Lumpy took over Bitchfield.

Flat and GOBSIG’s don’t want her to have to answer questions and possibly face civil deposition(s), about what she knew and blew off. Lying is a criminal offense, known as perjury.

“Vibrant and dynamic” statements only go so far in legal proceedings. A paper trail and what’s known and ignored (precedent set) is what they care about.

Just my belief.

I have a hard time drawing line s between the Mayor, School Committee power, and the School Admins who do the hiring. Example. SC says, we need a subcommittee (usually just the one proposing it) to study how to get DEI positions. That goes into a black box, but I guess the fin team cooks a job description and a budget request. And presto you have $400000 of open funds that can be aggregated for years until they decide to hire. Which then results in expanding that newly grown tentacle with surveys, trainings consultants, financial incentives for promoting DEI talking points. Just one position yield a wonderful harvest, but tying it to the Mayor? She had enough milking asphalt, trucks, Ford SUVs, sewage sludge. Road salt, and weird union deals mysteriously funded months after they’ve been approved, and grants, airport gambits, homeless schemes, and seizing control and quickly digesting the ARPA monies, not more than a few pennies that were seen by any person there.

Not impossible, but for the Mayor to accomplish all that plus milking the School budget stretches belief, and surely someone would wind up in Silver Lake.

Flat might not have had her hand in the Bitchfield Pubic Scohol hiring/firing deishons, but to think she knew nada about “Sheppard’s Pie,” being passed around the PHS students of color, would be naive.

Scohol Comite or not, the buck stopped with Flat. She could have put an end to all of it and saved taxpayers $155,000.

In MA, under MGL Chapter 93A, an entity that suing a government must serve a notice of intent to sue that government agency. It’s mandatory, not “Peter’s Law.”

  • Government/Tort Claims: Under the Massachusetts Tort Claims Act, you must send a presentment letter to the executive officer of the government entity before filing suit.

I used to threaten my kids when they were growing up and acting up, that I’d let Santa know, so they wouldn’t get any Christmas presents. It worked, but it was just a threat. Nothing more, nothing less.

Same exact thing Mayor Lumpy is doing here. Using an idle threat to try and stop the release of the report.

Maybe it’s time Ciara and other PHS parents file suit to get the report released.

Show us the lawsuit paperwork Lumpy or release the report.

We paid for it, not the Bitchfield gubermint.

I believe Mayor Lumpy doesn’t want the report released because it was a $155,000 fleece job by a locally connected DEI law firm.

The two “investigators” were both retired female judges who did all their “interviews” by phone or zoom. Zero investigative experience, other than assigning a law clerk a research project for them to cite as their work.

Ask a seasoned detective if that’s how they conduct an investigation.

Not go to people’s houses, their job, or have them meet at Mercer (neutral site) to conduct interviews?

Nope, just phone calls.

No. Absolutely not. People are generally a mentally fucked up species,which is how G-d made us. There are advantages though: the ability to obtain infinite jest, plan ahead, think wonderful thoughts about yourself, pleasure, art, neat hobbies, and stuff the rest of the species don’t care to think much about.
