(FORTRESS OF SOLITUDE, WEDNESDAY, APRIL 13, 2016) — You may recall from THE PLANET‘s previous coverage that the mayoral-appointed panel to look into the strange operations at the Pittsfield Municipal Airport (PMA) uncovered deeds that pushed the limits of credulity, even by the city’s low standards. Problems included leases of valuable commercial property going for $40 for 40 years, odd accountability and cut-off management, the Bermuda Triangle surrounding the ops of Lyon Aviation, and more.

The panel appears to be close to closing its books, as indicated by this e-mail from commission chair Tom Sakshaug to panel members:

Hi All,
Please see the attached draft agenda for our April 27 meeting. Council Chambers and 203 are not available, and some members have not seen the airport, so we will meet there.
Please note the item on alternate ownership or management. I really need to have those interested in changing these things to have examples or models that we can discuss. It is time for concrete ideas.
We are winding down and I want to get everything in soon. If you have additional items or would like to narrow or expand any item, please let me know ASAP. I must send in the agenda by April 22 at 3pm. Suggestions after the fact only serve to cause another meeting.
I have been working on a document along with Jonathan. I will send it along as soon as we refine it more. It is only a draft and subject to changes. Of course, it does not include things we have not yet covered.

Ward 4 councilor and state rep candidate Chris Connell, however, doesn’t think the work is over. Connell, a member of the airport group and one of the cosponsors of its formation (along with at-large councilor Melissa Mazzeo), sent this response to chairman Sakshaug, a few hours later:

Tom, with all due respect,  I still feel there are many unanswered questions that should be discussed before we finish.

1.  A PERC  representative   should be at a meeting to discuss their involvement with the Westwood properties since they are currently receiving 85% of the land leases. Also, I have been told that PERC does some grounds maintenance there such as mowing etc.
2. The solicitor should attend a meeting to discuss the discrepancies with the land and hanger leases.  Many leases cannot be found and some that have been are not signed according to the airport manager.

3. There does not seem to be much accountability between Lyons aviation and the airport manager regarding takeoffs and landings.

4. Who is overseeing the acquiring of equipment and vehicles from the GSA?  Although the equipment is free, it is obviously repaired and maintained by city paid employees.

In conclusion,   I feel we have an obligation to get the answers on these questions as well as others so that then we may be able to suggest ways to improve revenues and/or reduce expenses. Thats the most  important part of conducting a cost benefit analysis. I also feel that the report should be generated by the commission (not one member) based on voted  items. I don’t want the public to feel that we are rushing things and thereby giving them the perception that we not disclosing pertinent information.  Thanks Chris Connell ward 4 councilor

OK, this is exactly why I ask for agenda items. Thanks for giving me some.
1. We did have PERC reps in about the leases. Do you have a suggestion on someone else from PERC?  I’m not sure we will get anything different since the leases are so old, but we can try. We can ask about any Westwood maintenance by PERC.
2. We can certainly have the solicitor at a meeting. I would like to give him questions in advance so he can prepare. We can come up with questions for him at this meeting.
3. Perhaps we can discuss this and come up with some ideas about landings and takeoffs, keeping in mind this is a non-tower airport with no one present after hours..As long as Mike and Bob are present, we can come to a conclusion.
4. This will be a good question for Bob Snuck and Brian Spencer.

I’ll put relevant items on the agenda for the 27th.

Regarding the document: Jonathan and I have started it, as a draft. Mostly it is introductory and describes what we know. We will certainly vote on recommendations and minority opinions may be written.

Our Right Honorable Good Friend wasn’t done:

Connell followed up yesterday morning with this:

Tom, in regards to PERC, we only had two employees from community development at the meeting.  We need someone from the board to explain how the funds received benefit the airport , otherwise I will vote to have 100% of the land lease revenue turned over to the city to offset losses at the airport.  Also,  possibly a board member(long term) of PERC would have more information about the land leases.
On another note if the legal leases (ones that have been signed) cannot be located,  the city should immediately renegotiate those leases thereby generating more income.
In considering the city’s portion of the fuel that is dispensed,  my feelings are that 2 to 3 cents per gallon is too low. Since it was stated at the first meeting that going up 10 cents would not put Lyon aviation at a competitive disadvantage,  the city should be able to recoup more per gallon.
Considering the countywide airport concept which apparently we function as, I suggest since asking other neighboring communities to contribute probably would not be successful that we raise landing and take off fees.
As far as management,  my options would be
1. Consider Lyon aviation as assuming the management and possibly leasing the property from us.
2.  If number 1 is not an option,  then we send out an  RFQ( request for qualifications) to see if there is a private firm that would be willing to assume management.

Connell is right to press the chair about these matters. The PMA is one of only a long, depressing line of systemic, institutional, municipal malfunctions, but at least the matter is self-contained by definition of its function (easy to determine what’s an “airport” matter and what is not). The Ward 4 councilor has pragmatic suggestions for straightening out the PMA mess while bringing added revenue into city coffers. He continues to show, by action, why he is light years more qualified to be Pittsfield’s state rep than the current office holder, whose name does not escape us.

Well this gives me great respect for Mr Connell. Less so for others who may have been hoping to close the door on this.

Lost contracts, lost video tapes. I think Pittsfield has lost its credibility and why would any legitimate business want to get involved here?

I’d be curious to have a list of all of the rental properties the kind good councilor Connell owns or is involved with cross referenced with police logs, building permit information and rental inspection forms, welfare vouchers, medical calls for drugs, child abuse cases, and food stamps. That would be an investigation worthy of showcasing the right Good Councilor Connell’s community leadership, or profiteering, depending on what turned up.

So you look through the peep-hole and you see two cops (a man and a woman) standing at the door.
So next you make sure that you’re holding a knife in your hands when you open the door and that it’s pointed at the cops.

The story is Not the 88 year old….. it’s the dumb ass cops, their Assinine judgement, and the coverup that followed across the board in this Department….Up and down. The PPD has issues.Like it or Not.

Once again, this story is just the tip of the iceberg. Those tapes disappeared to keep what happened around that incident quiet. The dvr was destroyed on purpose to hide something else and the 88 year old was coincidence. Someone’s kid is on those tapes. He may be a cadet now.

At the time there was the July 4th murderous shootout for which no one has even been charged case unsolved. There was embezzeling by the PPD union rep allegedly. There were some other things as well.

The leases (or at least notices of lease) SHOULD BE recorded at the Berkshire Middle Registry of Deeds. Lease longer than 10 years are supposed to be recorded. I was at the Registry looking something up for work last week and to satisfy my curiosity, I looked up two leases. Notices were recorded for Pittsfield News and another building I am not sure of the current occupant.

The two I saw had Charlie Smith (mayor) and Mike McCarthy’s signatures.

It’s not that leases can’t be located – the question is, does the will to find them exist? I have reviewed files on special permits from the 1960’s and 1970’s in the Community Development Office – so I am sure those records exist. Or, we ask the lessees for their copies. Maybe we just bill them a new rent, and I bet you will get THEIR copies immediately.

Contracts (leases) do not have to be recorded to be valid. I sincerely doubt many landlords record leases at all.

maybe not, but leases in excess of 10 years are supposed to be recorded. It seems as if the City recorded at least two of them.

But, if we want copies, I suspect a letter raising the rent to $2000 a month would produce copies in a heartbeat.

A ”notice of lease”, as used in this section, shall mean an instrument in writing executed by all persons who are parties to the lease of which notice is given and shall contain the following information with reference to such lease:—the date of execution thereof and a description, in the form contained in such lease, of the premises demised, and the term of such lease, with the date of commencement of such term and all rights of extension or renewal. A ”notice of assignment of rents or profits”, as used in this section, shall mean an instrument in writing executed by the assignor and containing the following information:— a description of the premises, the rent or profits of which have been assigned, adequate to identify the premises, the name of assignee, and the rents and profits which have been assigned. A provision in a recorded mortgage assigning or conditionally assigning rents or profits or obligating the mortgagor to assign or conditionally assign existing or future rents or profits shall constitute a ”notice of assignment of rents or profits”.

Also, note they are notices of leases, not necessarily the full lease contracts.

Citing state law to explain what airport leases need to be recorded is exactly what today’s blog is about and not trolling anything. If you don’t care to take it seriously, then don’t. You can continue to call people names, bully, and threaten, but if you want to have legit discussions and enhance our community, then act grown.

I take him seriously…and usually like & agree with Shakes’ posts. Cogent, well-considered and spelled correctly. Pat on the other hand almost never posts anything with which I agree. However, Pat too is cogent, thoughtful, well-presented and spelled correctly so I completely respect her (I believe Pat is a her, if not I apologize.) Plus she gives me another side to think about…which is what “discussion” is all about.

not sure if you are legally bound to record the notices – but I have been in extended (10+ years) leases and the notices were all recorded.

And my point originally is that it seems as if the City has recorded the notices – so the information really is out there.

And finally, if the issue is that we want to see the real leases, we can just presume they are all expired and send notices of a new rent. I would bet $100 that the folks getting the sweetheart deals would produce those quicker than MM can say “we should follow the charter”.

Shakes started off fine and every now and then has a good one but lately he comes off as angry and frustrated. For example his first post on Mr Connell.

Remember how they sold the $$millions for airport improvement, it was going to keep companies here (goodbye GE, goodbye Sabic) and bring in new ones (no one). It wasto be an economic engine. Wha’ hoppin’?

The Bianchi supporters on the CC (led by Mazzeo) were In rare form last night. It appears that their only interest is throwing a monkey wrench into anything the mayor wants to do.

What is going on? Mazzeo verbally attacking Marchetti! Amuso pointing out the conversation going on between Mazzeo and Connell while DT Rivers was speaking!

BARRY I AGREEMORONS- AND YOU KNOW WHO YOU ARE AND SO DOES THE wIZ–you seem to know a lot of what went on at the water plants- when they were built by the Wiz- but your comments are very selective and meant to disparage the wizard. A FIRM WORKING IN THE PLANTS tried to cut corners and put in non osha approved ladders. The wiz was working there one day, as he usually was and some one had walked over a polymer spill and went down the ladder to the pipe pit making the rungs super slipery. The Wiz used that ladder as he always did, to get at the air dissolving tubes in the pipe pit to make adjustments The minute he put his foot on the first rung of the ladder- it slipped off the rung and he fell into the pipe pit- coming to rest draped over a very large pump with an eye hook on it which went into the Wiz’s spine snaping his vertebrae. He was opperated on and was in the hospital when the plants went on line. The ceremony for the opening of the plants were held in the Wiz’s hospital room. He walked with crutches and canes for the next 20 years and still has to take medication to this day to relieve the pain. AND NO MORONs– HE DIDN’T SUE KROFTA ENGINEERING LIKE YOU SAID. Every thing you MORONS SAY ARE OUTRIGHT LIES. No ONE HAS BEEN ABLE TO SUPPLY A STITCH OF EVIDENCE WHICH IS CONNTRADICTORY TO WHAT THE WIZ HAS BEEN SAYING. THE WIZ HAS EXTENDED AN INVITATION AGAIN TO YOU AND ALL OTHER NAY SAYERS TO COME ONTO HIS TV SHOW WHERE HE WILL QUICKLY DISMANTLE YOU. I am very sorry to hear of that awful injury. It sounds horrible and I am sad that anyone would have such a long and painful recovery.

That said, today’s comments have nothing to do with the Whistler and I’m sorry that he is disappointed not everybody is as obsessed with him as he is.

RED THE DUNCE ARMSTRONG.— Mr. G baited you. He let it be known weeks ago on his show that the hair piece he likes to have fun with is indeed his own hair. When he was about 30 years old he was losing his hair like all gaetani’s do — he grew out his hair that he had left and had it weaved into an engineered tissue. The g-man just wanted everyone to see what he use to look like when he was young. You have to be very secure with yourself to wair a hair piece and the Wiz is very secure with himself. He may even dye it at times to fool the council and the school committee. He is having a lot of fun with it fooling idiots like you. In fact i think he should have his gray hair streaked with some black and wear it all the time. I think you should Wiz– as it makes you look much younger. Hey- some on the council have had some work done on themselves and they look pretty good. If we can look better–What is wrong with that? I’d like to know more about the law suit that Gaetani is bringing against the city regarding THS. I hope the project can be stopped. Many of us talk a lot about doing something about it but I’m glad that someone actually has taken some action. Maybe more of us should show up at council meetings and be more vocal. So often the only voices we hear are the GOBs and there belief in a Pollyanna version of Pittsfield. It’s good to see someone talking brass tacks realty. Too bad that he was cut off before he completed his thoughts of privatization and operation of the water and sewer plants.

L T and the chief owe it to those police officers to come clean with the public as to just what happen so the officers can be cleared of wrong doing. Plus I don’t think that there names should have been realest to the public unless it was proven that they were doing something wrong.

SPA GIRL–I agree whole heartedly. You have to understand that on this site and in any other large group, you will find all kinds of people. Some who are very very smart and down the line until you reach reach individuals at the bottom of the spectrum- where you find individuals such as shakes -red- romen- sonny- dowgerass and several others . They lend nothing to the conversation and get to feel self important on sites where by– they can remain annonyomous. Standing on there own– where we could identify them–they would quickly be dismissed as the crackpots that they are. Look what they do to Gaetani day in and day out. All Gaetani is trying to do is help the taxpayer. If there is something wrong with that–I would like someone to explain it to me. While Iam at it–Where were you brave posters at last nights CC Meeting? Mr. Gaetani was there and he should be given the academy award for his presentation and speech content. He stunned the council and mayor –you should have seen their faces. If you didn’t see the Wiz in action you can stream the meeting or watch his Friday show. He may indeed be able to stop the THS Project- GIRL–The Wiz will be at the SC Meeting tonight. Will you and the other brave posters be at his side? Has a real, tangible, law suit (cause) been truly filed in a court of competent jurisdiction? Where are the pleadings available ? Is this a actual legal action like Gaetani v Krofta Engineering, 10, Mass Workers’Comp,Req.127,128 (1996) or is this just more hollow, empty, speech and bravado where reasonable people are expected to believe it, simply “because I say so” ?

24 more pages for the BB!!! Big Whoop. Front page today (I won’t do a Melle and cut and paste the whole article) “Seminar to explore how to recruit, retain millennials”. 1Berkshire hosting at $25 a pop at the Colonial Theatre.
Problem #1. Starts at 8:30 AM on the day the BB runs the article, which means the limited people who now read this rag probably read it too late to attend if they wanted to.
Problem #2. Everyone knows that the reason that we can’t retain the millennials is because there is nothing for the 25-35 crowd to do in this city and they are going to Boston, NYC, and the only people paying $25 to go to Colonial Theatre already know this and are going for a free breakfast because their fee is being paid by the banks or businesses that are connected to 1Berkshire.

For those of you who missed the School Committee meeting you missed a lot. McCandless once again assumed his secret identity of McCandmore as he begged for a budget increase upwards of 2 million dollars.

He assured us that he has made cuts everywhere. What I’d like to know is how do I get a job at a place where there are these huge budget cuts but no one gets laid off and everybody get a double digit raise? Let’s not forget that McCandmoreandmore said that there are fewer students but we need more money to give them an education. It’s obvious that McCandmore’s understanding of economics did not come from Milton Friedman but from Milton Berle.

After McCandmore finished his presentation finally we got to the public comment session. After hearing all the big talk from planet posters, I thought the room would be packed with planet posters but the lone voice of reality came from our friend Mr. Gaetani. His remarks were very good. He spoke about his background in education and the need for the school committee to consider the Pittsfield taxpayer. He suggested any additional money needed be obtained by greatly reducing the considerable bloat in the Mercer building. Half the room was filled with teachers and other school department employees who looked approvingly at each other when Gaetani called for reducing the Mercer payroll. McCandmore just sat statue like when Gaetani compared the superintendents salary to the average salary in town. We all could take a lesson from this. We can’t leave the talking to one man. We must all speak up. If you can’t come to meetings call or email the school committee members, city council and mayor. If you are sick of what’s going on in Pittsfield do something, and do it often.

After having done this apply for a job in the school district or town where you would like to work. You will be hired if you can convince the people in charge that you are well qualified. Once employed immediately enroll in a masters program that will make you even more valuable. I hope this helps you in your quest.
One thing that won’t help is sitting typing away on your keyboard complaining and making fun of someone’s name.

A degree in education is a joke and a bad one at that.

All these teachers with advanced degrees and most of their products are unprepared for college or the work force.

Maybe we should give them four million.

Now the mayor is saying Pittsfield Public School principals and teachers care deeply about their school communities. If they were given a 20% pay cut who thinks we’d see their true colors? How dedicated to their school’s and community would they be?
