JUDGE’S RULING IN TAYLOR GRAND JURY PROCEEDINGS SETS DANGEROUS PRECEDENT

(FORTRESS OF SOLITUDE, MONDAY OCT. 5, 2020) — One of most serious setbacks for U.S. citizens came after the Sept. 11, 2001 attacks, when the Patriot Act suspended habeas corpus, a constitutional guarantee of a person’s protection from false arrests. Nearly 20 years later, We the People suffered another constitutional loss when Jefferson County (KY) circuit court judge Ann Smith ordered Kentucky attorney general Dan Cameron to release 20 hours of secret grand jury testimony in connection with the police shooting of Breanna Taylor.
Smith ignored a sacred legal right going back to the Magna Carta, signed recently in June 1215 by King John at Runeymede. Of the document’s 63 provisions, the longest is section 61, which provided protections against bogus charges. The Founding Fathers of the nascent United States of America a few years later included in the Constitution Article 5, guaranteeing the same protections.
The judge’s ruling to release the Taylor grand jury deliberations sets a dangerous precedent and should alarm every citizen who cares about freedom from Big State. By rule, grad jury testimony is held and remains secret. There’s only one plausible reason Smith ordered this unusual move: the overreaction to race. Racial issues have gone from legitimate discussion to the hysteria of witch hunts. If you’re “of color” and you face justice today, society’s default position is now to blame the police.
THE PLANET agrees with the Founders and with centuries of legal foundation that grand juries should be able to proceed behind closed doors. The reasons are many:
- Protection of the innocent. If the grand jury fails to indict, the accused’s reputation remains intact, especially in malicious or arbitrary prosecutions.
- Witness protection. Because grand juries hear cases that are notorious, witnesses who would otherwise not testify will do so with the promise of anonymity.
- Secrecy provides law enforcement with a valuable investigative tool. Investigators can probe a case without tipping off the targets.
- Grand jury testimony cannot be used in a trial. The jury hears evidence and decides if the prosecution has enough to bring criminal charges. In the Taylor case, the jury said no.
Breonna Taylor found herself involved as collateral in a drug operation. Her previous boyfriend was heavily involved in the Louisville drug scene and, investigators say, the woman allowed her apartment to used as a mail drop and storage area for drugs, weapons, and cash. Taylor learned the hardest way possible that actions have consequences.
The released grand jury testimony shows that despite having a no-knock warrant, police knocked on the door and loudly announced themselves. The only response they received was gunfire from Taylor’s current boyfriend, Kenneth Walker, who fired through the door and wounded one of the officers. It’s the M.O. of the street: Shoot first and don’t ask questions. The cops entered a darkened apartment with light flashes coming from a movie playing on TV. One of the officers said it looked like more shots being fired. Officers returned fire, Taylor dying in the crossfire.
Think about it.
- Officers had enough evidence to ask for a judge to grant a no-knock warrant.
- The judge examines the evidence and agrees.
- Police show up at the correct address.
- In an abundance of caution, the knock and announce themselves.
- They get no response from inside.
- Taylor’s boyfriend fires first.
- THE PLANET asks: What are the cops supposed to do?
AG Cameron received a week’s stay so officials could go through 20 hours of tape and redact the names of jurors and witnesses. If they hadn’t done this, how much do you think their lives would be worth?
It’s unfortunate Taylor got involved with the drug scene, however peripherally. She was yet another who was “getting her life in order.” Yes, and she paid a fearsome price. Taylor family attorneys won a $12 million settlement from the city. That wasn’t enough. The family took the money and wanted revenge.
The grand jury heard the evidence and concluded the police were justified in their actions. Judge Smith’s decision essentially says what “protestors” and BLM agitators claim: “We can’t trust the criminal justice system.”
A court order can release grand jury testimony. The problem here, though, is the unanswered question: Was this extreme measure forced by an activist judge from a political agenda centered around race.
If that’s correct, it’s over for America.

Last week, a 22-year-old woman named Cassandra Brouthers was murdered by gun shots in inner-city Pittsfield. It is the first homicide in the city since August 2019, when Stephanie Olivieri was killed, also while inside a car. Inner-city Pittsfield has violent crime, drugs, prostitution, poverty, and homelessness. It is place most people avoid going to. North Street is called “Social Services Alley” by day, and “The Shooting Gallery” by night. The Mayor, Linda Tyer, lives in a gated community with her millionaire husband, Barry Clairmont. Former Mayor Jimmy Ruberto is a full-time resident of Naples, Florida, and a part-time resident of upper class Lenox. The ruling elites who run Pittsfield politics don’t live anywhere near inner-city Pittsfield. They must know full well about the acute socioeconomic issues facing inner-city Pittsfield, but they don’t do anything helpful to change things for the better.
This latest murder is a real turning point for Pittsfield. The last two female victims were casualties of circumstance…wrong place, wrong time. Word on the street is that this was a deliberate hit on this girl. Someone wanted her dead and shot her up multiple times in a blatant murder.
Pittsfield is disgusting.

We here in Berkshire county have already had to bare witness to what happens when politics are allowed to take over the criminal justice system – is there a bigger point than Andrea Harrington. Think about it, she talked and talked and talked about Williams college investigations being a sham under Capeless, yet has she brought one case that wasn’t originally charged under Capeless? We heard over and over again about how transparent her office was going to be during high profile cases – any word on the latest homicide in Pittsfield and how long did it take her to comment on that tragedy in Sheffield. Not that I think those investigations shouldn’t remain sealed until complete but she stood on her soapbox and offered immediate answers, yet here we are and she’s always declining to comment. Do you think with her political ways she would’ve used the domestic related homicide rate of her first year in office against an opponent – you bet ya.
Have we in the history of ever had a district attorney making 170K a year be so far behind on property taxes that it ends up in the classified section of the paper? Any attorney with half of a brain would know that’d eventually end up in the paper. Are we to believe our top prosecutor is that dumb or is she that absent minded. Or is this another one of her claims that it’s a smear tactic by the Berkshire Eagle, which mind you is one of the most liberal papers in the world.
And we were promised over and over again how the integrity of this office was going to change, yet we have a DA who was stopped driving the wrong way on a one way street, with a suspended license. Instead of owning the mistake, going to court and getting a continuation without a finding like everyone else, it was the Eagles fault for publishing it, New York DMV’s fault for suspending her when she didn’t pay the fine and she’s too ignorant as a lawyer to realize Massachusetts is a reciprocating state to New York. Now mind you the Eagle wrote way too many disorganized articles for one instance but she blasted them for just writing about the stop never owned her mistake.
And, have we ever had a DA that would bring a jug of milk to a homeless camp for a photo op with a political campaign. Can you imagine how self centered someone would have to be to use people down on their luck for political gain. Has she done anything for them since now that Joe’s out? The date of her mid day wrong way stop also begs the question, what was she doing out of the office on primary day? Was she campaigning on state time? Was she driving a state leased vehicle for campaigning? Didn’t her campaign finance get sited over and over again for misappropriations.
Have we ever seen a DA spend nearly as much time traveling out of the area for speeches, meetings and conferences (remember her reason for the speeding ticket in New York). Did students need to hear a junior DA speak or did a small county need another prosecutor in the office with a limited staff. Was she then, in all her experience able to finally tell the difference between a shell casing and a projectile.
We could go on and on about her fumbles but the point being, we are seeing politics infiltrating the scales of justice nationally but Andrea Harrington has been hard at work utilizing image over integrity since the day she rose the wrong hand! I would love to hear the truth of what Helen Moon has to say!

Which in judges well reasoned and routinely followed starry decisis – that any facts falsely given to media and grand jury be equally distributed in the continued interest of justice

The settlement was peanuts as the loss of consortium alone should of reached 40-70 million

Judge Ann Smith did not err in her ruling, Cameron attempting to reverse engineer a narrative is obvious.

It’s all an attack on our justice system. All of the far left district attorneys spread across the country who now refuse to prosecute so many crimes and it was critical to have them in place when the rioting started. Yes Pat, if you can get whisked away to a hospital with all the best doctors, multiple treatments, and no expense spared, your chances of surviving are greatly improved, even if you are 74 and obese. Suggestion for a new fundraiser for City of Pits. How about placing the following three couples in each of the Prive Pods. Mrs. & Mr. Mayor, Andrea Harrington and hubby, and Mikie Wynn and his honey, they can have a dinner hosted by HON and dessert by Dotties, both establishments that the City has paid a lot of bucks to keep open. Meanwhile, us hard working tax payers can purchase a dozen eggs for a minimal donation and pitch them at these three couples while they enjoy their dinner. Bet a lot of monies would be raised. Probably could build a new homeless shelter and police station.
You are not just Merry and Bright but BRILLIANT and don’t forget the 20 year tax break to Spice the former HON and Link to Life owned by Joyce Bernstein and Larry Rosenthal who just happen to live in a Tony town in South County. Monies well spent for the “everyday citizen of the CITY”.

There are still no arrests in the shooting/murder of a 22-year-old woman named Cassandra Brouthers in Pittsfield last week. There are other unsolved shooting murder cases in inner-city Pittsfield. Dangerous downtown Pittsfield is a scary place. The FBI states that Pittsfield is always in the top 10 for the most violent crimes in Massachusetts. I feel bad for the poor people who live in inner-city Pittsfield. They are unable to afford to move out of the distressed neighborhoods in Pittsfield. I am happy I did not end up in inner-city Pittsfield. It was one of my biggest anxieties/fears when I was a young man over 2 decades ago. When I lived in Berkshire County, North Street was derisively referred to as “Social Services Alley”. Thousands of young adults moved out of Pittsfield and the Western Massachusetts region because there are scarce living wage jobs there. If you weren’t related to one of the incestuous Good Old Boys Pittsfield politics families, then you either had to kiss their corrupt and dirty behinds or pound sand. If you spoke out about Pittsfield politics running the city into the proverbial ditch, you were blacklisted and bullied. Pittsfield is exhibited in huge Gregory Crewdson photo’s as a city in decay in elitist museums and art galleries in London, NYC, and L.A. Pittsfield is polluted with industrial chemicals called PCBs that cause cancer and other deleterious health impacts in local residents, while state and local politicians give into GE’s snake oil negotiations with the corrupt EPA bureaucrats. Pittsfield has high municipal taxes, fees, and public debts, while Matt Kerwood sits on a +$10 million slush fund. The Berkshire legislative delegation to Beacon Hill are 5 do nothing political hacks who only do disservices to their hard hit Western Massachusetts legislative districts. 4 out of 5 of the state Reps and Senator voted themselves a 40% pay raise over 3.5 years ago. Now, they haven’t even proposed a fiscal year 2021 state budget after over 3 months and counting.
