PLANET VALENTI NEWS AND COMMENTARY

ADD 1 May 6, Early Afternoon — This just in from the Pittsfield Police Department.

On Thursday May 5th 2022 at approximately 7:03pm members of the Pittsfield Police Department (PPD) Anti-Crime Unit (ACU) observed a suspicious party on Francis Avenue.  The party was wearing a black ski-mask and was seen entering a convenience store.  Officers observed that the party appeared to be carrying a handgun in the front of his pants.  ACU members and patrol officers detained the individual and removed a loaded .40 caliber handgun from the front of his waistband where they had previously observed the weapon.  The weapon was loaded with fifteen rounds of hollow-point ammunition.

The suspect, a 16 year old male resident of Pittsfield, was arrested and charged with Carrying a Loaded Firearm, Possession of a Large Capacity Feeding Device (magazine), and other firearm related charges.  He is expected to be arraigned in the Berkshire Juvenile Court.  The juvenile was also in possession of over $3500.00 in cash at the time of his arrest.  [ED NOTE: The release included a photo of the weapon]

Just another day-and-night in “beautiful, vibrant, dynamic, DIE” Pittsfield.

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION MAY 6-8, 2022) — The latest chapter of Ricky’s Rumpass, the public-works clown show that eats up Kapanski Kash to destroy the quality of life for honest Pittsfieldians, has sunk to new lows with the addition of the dangerous suicide boards knows as Bird Scooters.

It wasn’t enough to wreck North Street, much to the chagrin of the struggling merchants managing to stay on life support in spite of mayor Linda “Flat” Tyer’s determination to stick it to the Little Guy, erstwhile shoppers, and others who might have honest business downtown. Nope. She and her DPW commissioner, Ricky’s Rumpus, continue to pour freebie-honey all over the Special Interest Insiders and the Gimme Groups. Or do you think the maze they made of North Street with krazy-kwilt bike lanes was for you?

Not a chance. It was for the two or three wokes who serve on city boards and ride their $4,000 tricycles once in a while (anyone for Alison McGee?). At least that’s what the city propaganda minister, Josef Goebbels, declared last year. Now, since NO BIKES have been spotted using the bike lands since Lance Armstrong got his feel-good juice from “Dr. Robert” (“Well, well, well you’re feeling fine. Well, well, well he’ll make you, Dr. Robert” — The Beatles), turns out the krazy lanes weren’t for bikers at all. The few who do pedal on North Street do so on sidewalks, mostly. Going the wrong way.

So then what did commish Ricky’s Rumpus and Mayor Flat intend?

———- ooo ———-

C’mon down, Bird Scooters.

Too many things suspicious here.

  • The huge safety issues.
  • Like the bike lanes, citizens were never consulted in any meaningful way, nor were merchants, about these precarious devices. Simple reason for that. It would have been rejected out of hand. Citizens see far greater priorities, including road repair, public safety, and crushing taxes.
  • The story claimed by Ricky’s Rumpus and Flat Tyer is that Bird came to the city. If that’s true, it is so only in a technical, legal sense. It appears that a “silent partner” acted as a go-between and planted the “hint” that Bird should contact the city. Why not? It was, is, and, with the current cast in charge, always will be ripe for the picking.
  • We have heard from multiple sources that the principal of the company acting as city agent has ties to city hall. We haven’t confirmed that. At the same time, no one from the city has told THE PLANET has issued a denial. As an independent contractor, its books are not subject to examination.
    •  The condo is part of the renovation of the St. Mary’s Church complex on Tyler and Dartmouth streets.
    • The company, Pocket Trucking LLC, operates out of 81 Dartmouth St. Apt 305. It’s a 2 BR 1 bath condo, 810 sq. ft., sold six months ago for $174,900. Some “corporate HQ.” It appears to be some guy’s apartment. What guy? Timothy Lanfair.
    •  Hmmmm.
      • One of the contractors for the Bird’s is.

  • Timothy Lanfair describes himself on Facebook as a “Bad ass tech guy … to make it all look dope.” His words, not ours. Sounds exactly like the type of entrepreneur that Pittsfield attracts and is attracted to Pittsfield. Of course, THE PLANET could be wrong.
  • 21 or the 24 scooters (more are on the way) had dead batteries.
  • We had reports that two Birds were trashed and several used and scattered throughout the city. One of THE PLANET‘s Z-Agents had a picture of a city truck with four of the corralled scooters in the bed. Readers wanted to know why city resources are being used, when it was claimed that Pocket Trucking, would be handling all such issues?
  • Sources say the city has purchased $2,500 worth of gift cards. That’s with Kapanski Kash. One city hall source says they city did it to make it look like the program got off “flying start.” Fakery, smoke and mirrors, sleight of hand. That might explain why the vast majority of users seem to be kids under 18. So much for the promises that no one under 18 would be able to access these rides.
  • In real life, the rollout of the scooters was so disorganized and chaotic that Flat had to call a press conference — not on gun play that’s out of control, not on another screwing of taxpayers via the FY23 budget, not on roads that NASA will be using for moon training — to blather a bunch of B.S. about these “vibrant, dynamic, DIE” machines. Truly, can this at last be Flat and the city finally hitting bottom? THE PLANET doesn’t think so. There’s more to come.
  • THE PLANET has received multiple reports from drivers and pedestrians of kids on these scooters weaving in and out of traffic, dangerous in the extreme. A fatality is in the process of being prepped.

———- ooo ———-

Finally, for those who missed out the first time, we repeat again out initial report on these devices:

We began it this way in our April 4 column:

Just when you think that the out-of-touch, corrupt insanity that’s torturing the Kapanskis has hit a new low in Pittsfield, we have this.

We have e-scooters, the latest reeking wrinkle of “Ricky’s Rumpus.”

The hits just keep coming from the Tyer Administration.

You’ve heard of Abbot and Costello Meet Frankenstein? THE PLANET presents Danger City Meets Ricky’s Rumpus.

Let’s hear it for “RICKY’S RUMPUS,” the gift that keeps on giving! What better way to take advantage of pot-holed, drug-infested, confusing, dimly-lit Pittsfield byways than to put people on incredibly dangerous e-scooters that, guaranteed, will generate more broken bones, lawsuits, and even fatalities than a trip down Dewey Avenue at 3 a.m.?

With the help of our good friends at Shouse Law Group, we present verse and chapter why e-scooters will be disastrous for Pittsfield, and not just for the ridiculousness cost. To make it even better, rumor has it that somehow, the city is doing business with developer Rickard Stanley of Beacon Cinema fame. The city will be using scooters supplied by Bird.

Here’s the skinny. The e-scooters:

  • will cost $23.40/hour plus $1
  • small, solid wheels with no shock absorbing and poor traction
  • have weak headlights
  • high center-of-gravity with wheels not far enough apart to prevent frequent tipping and loss of control
  • come with no training
  • anyone with a smart phone and a real or fake I.D. can use one
  • prone to vandalism (a favorite is cutting the brake lines
  • are not maintained or routinley examined for safety.

For those who want for full story, THE PLANET and Shouse Law Group are here to give it to you.

POOR DESIGN FEATURES MAKE SHARED E-SCOOTERS DANGEROUS

Some of the problems with shared E-scooters have stemmed from poor vehicle designs. These problems have led to E-scooter lawsuits being filed against Bird and Lime for defective designs.1

1. THE HIDDEN FENDER BRAKE ON THE BACK TIRE

Some, but not all, shared E-scooters come equipped with an emergency brake. It is located on the back wheel. However, to the untrained eye, it looks like a plastic covering for the back tire. Few people know that you can step back onto the plastic covering to push it into the wheel.

When going down a hill, this hidden fender brake can be the only way to slow down.2

People who do not know about this hidden brake will not be able to use it when they need to. They can also accidentally trigger it, potentially causing an accident.

2. ONLY CONSUMER QUALITY PARTS ARE USED

Many of the E-scooters on the road are consumer models. These consumer models are not made of materials that are designed to withstand constant use. Instead, they were made for single owners who only rode it a few times a day, at most. Consumer parts, especially those that are made of cheap plastic, deteriorate under the stress of constant use.

3. WEAK HEADLIGHTS

E-scooters are not supposed to be on the roads at night. However, they are still often being ridden as the sun sets. The weak headlights that adorn many E-scooter models are not enough for anything but the bright daylight. Riders are left to squint at the road ahead. Other drivers can miss oncoming E-scooters because of the weak headlights.

4. E-SCOOTERS HAVE A HIGH CENTER OF GRAVITY

E-scooters are meant to be stood on, during the ride. As a result, the center of gravity for E-scooter riders is very far from the ground. The spacing of the wheels is not wide enough to provide stability for a center of gravity that far away. Tipping over or losing control becomes very easy to do.

5. THE SMALL AND SOLID WHEELS

The wheels on shared E-scooters are small – 9 inches or less on most models. They are also solid, rather than filled with air. This design was to reduce maintenance costs. However, the solid wheels do not absorb shock very well. They also do not have as much traction as an air-filled tire. They are also much less able to roll up small steps in the road, like the cracks between sidewalk blocks or up the bump between the sidewalk and the street. This can cause you to lose control and get in an accident.

THINGS THAT MAKE RIDING A SHARED E-SCOOTER SURPRISINGLY DIFFICULT

E-scooters are also dangerous because they are not easy to ride safely. E-scooter sharing companies could have made them easier to ride. However, they failed to do this, putting riders and other innocent people in danger.

6. THERE IS NO RIDER TRAINING PERIOD

Anyone with a smartphone can download an app and unlock and ride an E-scooter. There is no training session or even an instructional video. Riders have to pay for their first ride, too, so they do not want to waste their money getting accustomed to the way it rides.

It should come as no surprise that one study found that one-third of riders who got hurt were in the middle of their very first ride.3

7. MOST RIDERS DO NOT KNOW TRAFFIC LAWS FOR E-SCOOTERS

Different states and even different cities have their own rules for where you can ride an E-scooter. Some require you to ride on the sidewalk. Others forbid it.

Few riders know the rules of the road for where they are. E-scooter sharing companies could provide a database of E-scooter rules and regulations, but they do not.

8. AT A GLANCE, E-SCOOTER RIDERS LOOK LIKE THEY ARE WALKING

E-scooter riders are in a standing posture. At a glance, drivers and pedestrians rarely realize that they are riding an E-scooter. They then make decisions on the assumption that the E-scooter rider is going far slower than they really are. This can cause confusion and an accident.

SAFETY PRECAUTIONS E-SCOOTER SHARING COMPANIES COULD HAVE TAKEN, BUT DID NOT

Finally, there are 4 safety precautions that E-scooter sharing companies could have taken to protect riders, but did not.

9. WARNINGS BEFORE TRIGGERING AN AUTOMATED SPEED REDUCTION

In some cities, E-scooter companies have created “geo fences” where their scooters can go faster.4Once the E-scooter crosses one of these fences, a computer program automatically slows the vehicle down.

Riders, however, are given no warning, and cannot see geo fences, which rely on GPS tracking. The sudden decrease in speed can cause a crash.4

10. VIGILANCE AGAINST KNOWN VANDALISM

Some people do not like E-scooters on the streets. A few have resorted to vandalism to make their anger heard. A couple of them have resorted to cutting the brake lines on E-scooters.5

Despite knowing about the danger, though, Lime and Bird do not regularly check their vehicles for damage. This puts riders and innocent bystanders in danger.

11. NOTIFYING RIDERS OF DAMAGE ON AN E-SCOOTER

Bird and Lime have developed E-scooters that self-report damage.6 Those reports, however, only go to the sharing company. They do not notify users of any damage or defects on the E-scooter they are about to ride.

In fact, both Bird and Lime expressly disclaim liability for damaged or defective E-scooters in their user agreement.7 They also force users to agree to conduct an extensive pre-ride safety check.8

12. STANDARD MAINTENANCE POLICIES

Both Bird and Lime rely on independent contractors to collect, recharge, and report damage to their E-scooters. These independent contractors do not have a strict policy to follow. They frequently miss clear signs of abuse or damage that endangers later riders.

———- ooo ———-

An electric scooter (Bird or Lime) accident lawsuit is a legal claim by a person injured from the use of a scooter. They are most often the result of someone’s negligence. However, they can also be the result of someone’s intentional conduct. Victims can suffer serious injuries that entitle them to compensation for:

Scooter accidents have also become far more common with the advent and proliferation of E-scooter sharing companies like Lime and Bird.

The California personal injury lawyers at the Shouse Law Office strive to represent people who have been hurt in a scooter accident. In this article, they discuss:

electric scooters

1. WHAT ARE SCOOTERS AND E-SCOOTERS?

Scooters are two-wheeled devices with a flat platform between the wheels. People stand on this board and can propel themselves by kicking on the ground.

E-scooters, however, are scooters that are propelled by an electric motor. Not only do they move without the rider kicking it forward, E-scooters can also go much faster than normal scooters – some of them can go up to 15 miles per hour.

1.1 THE RISE OF E-SCOOTER SHARING

E-scooters have become incredibly popular in the last few years as a form of shared transportation that can be used for “last mile rides” – those that are too far to walk but not far enough to drive.

Riders can rent an E-scooter, often for as little as a dollar plus mileage, through a smartphone app. Once at their destination, riders can end their rental period and leave the scooter at their destination. Because the wheels of the E-scooter lock when the scooter has not been rented, E-scooters do not have to be docked in special locations like shared bikes do.

1.2 E-SCOOTER SHARING COMPANIES

Several E-scooter sharing companies have instigated and capitalized on this demand for rentable electric scooters. Some of the bigger companies providing smartphone apps and rentable E-scooters are:

  • Bird,
  • Lime,
  • Skip,
  • Lyft, and
  • Spin.

These companies have stirred controversy by dropping off hundreds of E-scooters in a city with little warning to local officials. In many cases, cities have no traffic rules or regulations in place for E-scooters, which frequently fall outside the definition of bikes, cars, and motorcycles. As a result, locals rent and ride E-scooters with no rules to dictate where they can and cannot go, putting themselves and others in danger.1

Some cities, including Los Angeles, have even temporarily banned E-scooters while lawmakers work to lay down regulations.2 Other cities have sent cease-and-desist letters to E-scooter sharing companies who have dropped the devices within city limits without talking to local officials, first.3

1.3 LACK OF REGULATIONS FOR E-SCOOTERS

One of the most controversial aspects of E-scooters has to do with the lack of regulations that govern how riders can use them.

Traffic laws governing non-traditional forms of transportation – like E-scooters – are frequently left to local governments. This means one city can require E-scooter riders to stay on the sidewalk, while another city can require them to stay on the street. The confusion can cause serious accidents that leave innocent people hurt.

2. E-SCOOTER ACCIDENTS

As E-scooters have become popular, the number of accidents involving an E-scooter has skyrocketed as well. In each city that has been inundated with E-scooters, hospitals noted a sharp rise in the number of patients visiting their emergency rooms.4

These E-scooter accidents can happen in a wide variety of ways. However, they can all be put into four categories:

  1. A single-party accident that leaves the E-scooter rider hurt and no one else affected,
  2. A collision between an E-scooter and a pedestrian,
  3. A collision between an E-scooter and a car, and
  4. A pedestrian tripping and falling over an E-scooter.

In each case, determining who was liable can be difficult. This is especially true because of the terms of use that E-scooter sharing companies force riders to agree to, in order to rent an E-scooter.

2.1 ACCIDENTS INVOLVING ONLY AN E-SCOOTER RIDER

Many E-scooter accidents are single-vehicle crashes that happen when the rider loses control of the vehicle.

In many of these cases, the rider’s inexperience contributes to the crash. One study commissioned by the Centers for Disease Control (CDC) to cover E-scooter crashes in Austin, Texas, found that 33% of riders were hurt on their very first E-scooter ride.5

However, not all of these accidents are the rider’s fault. In some cases, single-vehicle E-scooter crashes can happen when a rider is driving safely, but hits a bump in the road or a sudden rough patch of sidewalk that makes them lose control and fall.

Example: Clara is riding an E-scooter slowly on the sidewalk, where she is supposed to ride. Ahead, there is a sharp drop between the blocks of the sidewalk. She does not see the drop, and the sudden fall makes her lose her balance and veer into the side of a building. Because she was hurt by a poorly-maintained sidewalk, the municipality could be held liable for her injuries.

In other cases, the E-scooter itself may have caused the crash. In early 2019, a rash of seemingly unforced accidents was connected to defective E-scooters provided by the E-scooter sharing company Lime. In those incidents, the brakes on E-scooters traveling at full speed were being applied without the rider’s touch, causing some serious injuries.6

2.2 ACCIDENTS BETWEEN E-SCOOTERS AND PEDESTRIANS

Accidents between E-scooters and pedestrians have gotten the most attention because of the distaste that walkers have for E-scooters being driven on the sidewalk.

Crashes between an E-scooter and a pedestrian can be severe because of how vulnerable pedestrians are, especially when they are hit from behind. However, not all of these accidents are the E-scooter rider’s fault.

Example: Paul is riding an E-scooter on the sidewalk, where he is supposed to be. However, he is riding at 15 miles per hour, which is too fast for the lightly crowded sidewalk. Mary is leaving a coffee shop and as she opens the door and steps into the sidewalk, she gets hit by Paul because he has no time to stop or change direction. Paul will likely be held liable for the accident.

Example: George is crossing the street. He looks both ways for cars, but does not notice Tom approaching on an E-scooter in the bike lane, where he is supposed to be. When George steps out into the street, Tom crashes into him. George may be held liable because he did not see Tom.

2.3 ACCIDENTS BETWEEN E-SCOOTERS AND CARS

While relatively rare, accidents between E-scooters and cars are often the most severe. The weight of the cars and the vulnerability of an E-scooter rider often mean that the rider will suffer serious injuries.

One particularly common scenario is when a car “doors” an oncoming E-scooter. Many cities require E-scooters to be driven in bike lanes or on the far right side of a street. Car drivers who have parked on the side of the street often fail to check their side mirror before opening their car door. If they open their car door suddenly and an E-scooter rider is just about to pass, the driver could be held liable for the accident.

2.4 E-SCOOTERS TRIPPING PEDESTRIANS

One of the reasons why shared E-scooters have become so popular is that they are “dockless” and can be left anywhere. As E-scooter riders reach their destination and discard their ride, they frequently leave the E-scooter in a place that can inconvenience others or trip them as they pass by.

Pedestrians who get hurt after tripping and falling could be entitled to compensation from one of a variety of different people, depending on the details of what happened:

  • The E-scooter driver who left the vehicle for the victim to trip on,
  • The E-scooter company, if the vehicle had been left there for an overly-long time,
  • The owner of the premises, if the vehicle was left on private property, or
  • The city, if they have assumed the responsibility of removing discarded E-scooters.

3. THE ROLE OF USER AGREEMENTS IN E-SCOOTER ACCIDENTS

A key component in determining who was liable for an E-scooter accident – and therefore who should pay compensation for the injuries it caused – are the user agreements that E-scooter sharing companies require riders to sign before they can rent an E-scooter. These user agreements are binding contracts between the rider and the E-scooter sharing company, and go to great lengths to waive the company’s liability for a crash.

E-scooter sharing companies use these agreements to disclaim responsibility for accidents and pin liability onto the rider to the fullest extent possible. For example, Lime’s user agreement7:

  • Requires riders to abide by all traffic laws, but does not specify what they are or how to do so,8
  • Makes riders claim that they are “familiar” and “reasonably competent and physically fit” to drive an E-scooter before they are allowed to take their first ride,9 and
  • Requires riders to perform an extensive safety inspection before riding, and disclaims liability if the E-scooter was defective.10

E-scooter sharing companies also write their user agreements in ways that ensure no rider will read them before renting an E-scooter. For example, Lime’s user agreement is 53 pages long.11

Breaking any of the provisions in these agreements, though, can be used by the E-scooter company as an argument that they should not be held liable for injuries sustained in an E-scooter accident.

4. E-SCOOTER ACCIDENT INJURIES

The injuries that frequently occur in an E-scooter accident are shockingly severe, especially when the E-scooter rider was hurt and was not wearing a helmet.

According to one medical study, which examined 249 patients who went to an emergency room for an accident while riding an E-scooter over a one-year period, head injuries where the most common12:

Head Injuries 40.2%
Fractures and Broken Bones 31.7%
Soft Tissue Injuries 27.7%

That study found that only 4.4% of riders were documented as wearing a helmet at the time of the crash.

The study by the CDC also tracked injuries sustained by E-scooter riders. Out of the 190 injured E-scooter riders in their study, nearly half had a severe injury, including:

  • 48% had fractures, lacerations, or abrasions to the head,
  • 35% broke a bone other than then nose, fingers, or toes,
  • 19% had multiple fractures, and
  • 3% had skull fractures.

5. COMPENSATION FOR E-SCOOTER ACCIDENT INJURIES

Victims who have suffered one of these injuries in an E-scooter accident deserve compensatory damages for their:

  • Medical expenses, both in the past and anticipated in the future,
  • Lost wages or income during the recovery process,
  • Reduced earning capacity or ability to earn a living in the future,
  • Pain and suffering, and
  • Loss of companionship suffered by the victim’s family.

I turned on the Boston radio yesterday (Thursday, 5/5) afternoon, and the Massachusetts State Senate overwhelmingly voted to give undocumented/illegal immigrants Massachusetts Driver’s Licenses with a loud applaud from the gallery. The Boston radio newsman said that both the State House & State Senate chambers have enough votes to override a possible veto by Governor Charlie Baker. When thousands of undocumented/illegal immigrants have Massachusetts Driver’s Licenses, will there be more serious and/or deadly auto accidents? If there are more costs than benefits, will the corrupt career politicians in Boston vote to overturn the law that rewards undocumented immigrants who live in Massachusetts, USA illegally? What about the billions of dollars in state government surplus cash and ARPA “Biden Bucks” that Beacon Hill lawmakers are still sitting on? When will they get around to spending the huge amount of surplus state money and ARPA “Biden Bucks”? Most state governments either spent most of their surplus state funds and/or put in place a 5-year ARPA “Biden Bucks” spending plan, but on Massachusetts. Lastly, Mayor Linda Tyer has an electric scooter to sell you, the fictional/proverbial Mary Jane and Joe Kapanski, along with Pittsfield’s Level 5 public schools, violent crime and vibrant, dynamic and dangerous downtown. Just don’t bring any of it to her Gated Community neighborhood, please.

The gentleman from Dartmouth street who is maintaining the scooters info suggests that he opened that business in Nov 2020. So he was apparently on board a year and a half before the public even knew this was coming? Also, curious if he lives in an apartment where is he storing and maintaining the scooters and is it zoned for a business? And if it is not on Dartmouth street where is it and did they get a tax break from the mayor or a generous deal one way or the other as is typical back door Pittsfield operations?
And somehow I just don’t believe Morales is really the key driver behind this scooter rollout. But why in the hell is he doing anything like this in the first place. I used to know something about the DPW and knew a lot of people who worked there. And there is no way the guy in charge had any time for bullshit projects like scooter if he was doing his job right.

Today just before 5 pm. I witness three scooters with a total of five idiots coming from the direction of the courthouse, on the courthouse side of the road, heading towards West Street in the middle of the road. I was able to watch this because I was at the red light at corner of West and North traveling East. Traffic coming from the South had the green light to proceed North on NOTHING, but these idiots scooted right across the path of oncoming traffic. The first of the three scooters was solo. The other two scooters had passengers. The two scooters with passengers almost collided when they reached the corner of the bridal shop. Maybe next time. But what I’m really waiting to see are photos in Smugmug of drive-bys by Pistoleros with Ghost Guns on Ricky’s Scooters. Because its going to happen.

Speaking of wormy things coming out of linda tyer, I read a glowing endorsement for these scooters and for the disadvantaged spawn in foster homes due to neglect by their absentee fathers and drug addled mothers. The glowing endorsement of tyer and all things wormy came from a career foster parent and 2-time recipient of tyer’s pick pocket at-home tax program. Apparently, she wouldn’t be able to stay in her home without her subsidized foster kids and she couldn’t afford the new roof and new back porch she got if it wasn’t for tyer’s pick pocket tax program. “If you’re a one-person household, making $72,600, all the way up to $116,000, you might be eligible for FREE relief from tyer’s pick pocket tax program.

Sorry to change subject. WTF is Pittsfield Library applying for ARPA funds. It’s a Library not a social service hub. Read the article on IBerk. Curious about other peoples opinion on this.

ARPA CARES
ARPA CARES
Reply to  joetaxpayer

This is a kufflinks Kerwood shell game. ARPA funds can only be used for certain things. If the library can apply for them, and it’s an allowed use, Kufflinks can then divert money from the budget that would have gone to the library to free cash.

Also these are CARES and ARPA funds going specifically to museums and libraries via the MBLC. If you look at c) you’ll understand what they are doing. They are going to pay for staff and technology out of ARPA funds. Then the money the city would use for the library will go to bike projects and platinum staplers.

To achieve the American Rescue Plan Act’s purposes with respect to Grants to States, this funding is to be used by September 30, 2022, in helping communities respond directly and immediately to the pandemic, as well as to related economic and community needs through equitable approaches. Spending priorities are as follows:

a) First, to enable libraries to reach residents with internet hotspots, accessible Wi-Fi, and other digital inclusion efforts, particularly in support of education, health, and workforce development needs. The following types of data, among others, can inform efforts to reach underserved populations:

• Poverty/Supplemental Nutrition Assistance Program (SNAP)

• Unemployment

• Broadband availability;

b) Second, to provide rapid emergency relief to libraries across the country, allowing them to safely respond to the pandemic and implement public health protocols;

c) Third, to support library services that meet the needs of communities throughout the U.S., including costs such as personnel, technology, training, materials, supplies, equipment, and associated indirect costs; and

d) With respect to (a), (b), or (c), reach tribal and museum partners best positioned to assist with pandemic response efforts, in addition to traditionally eligible library entities, where appropriate.

Here’s the catch, they aren’t even a business to boot. Even better, the first “black owned” business started with this taxpayer gift, is being started by the beneficiary of this gift: Warren Dews.

He and multiple felon, Harmony Persip, are starting a “black owned resort” to cater to POC who imbibe in marijuana. The only problem, the area Warren proposed for this “resort,” is in an area not zoned for business. Go figure, huh?

But now they find themselves in a bit of a pickle because republicans themselves are overwhelmingly in favor of a woman’s right to choose and they are speaking out now. So these same politicians may get themselves voted out of office this fall if they speak out loud in favor of it.

Dan for starters, I want to wish you and everyone the best of luck and the best of times tonight. I’m sure it will be successful.

To switch subjects just a bit, I wanted to show the taxpayers of Pittsfield/Berkshire County how much blood, sweat, and tears, our state rep Tricia Farley-Country Buffet (D), is putting in to help the hardworking taxpayers. She has spent a boatload of time helping illegal aliens and helping them get the right to vote…..I mean drive.

Remember when Tricia Farley-Country Buffet (D), said getting illegal’s DL’s would promote “public safety?” The reason she gave, illegals didn’t have to “fear the police” when traveling? She even had PPD Chief Mike Wynn vouching for her and this horsesh!t reason. Well it turns out that “public safety” was really masked under the guise of giving illegals the ability to vote, not “public safety.”

Remember this and thank Tricia Farley-Country Buffet (D), when (1) **most importantly** YOU vote, (2) your vehicle gets hit by an illegal driving with a DL, but no vehicle insurance, (3) YOU have to PAY to get a federal “Real ID” to be able to fly, etc.

Hello I live in Pittsfield and have lived here for over 30 years. Never had Pittsfield been worse, it’s a horrible place now. The taxes, water, and sewer bills have gone through the roof! The roads are horrible, there’s trash everywhere, in the winter they don’t plow my street except when we call and complain. There’s a pothole at the entrance to my street that could swallow a car. The icing on the cake, a child on a scooter hit my car while it was parked McKay street. I was coming out of the movies and I saw him do it. He hit the side of my car with such force it left a dent and broke my side view mirror off. When I called the police they didn’t even want to come over to take the report. They finally came over and wrote a report, the officer said it only looked like a couple hundred dollars in damage so he argued with me about even writing the report. Thankfully he did because it’s over $2,600 in damage. The mirror alone is $700 and the side camera is $300, a parking sensor is $430, dent repair and paint correction and blending.
I called my insurance company and was told it would go against my insurance plus I’m out my deductible of $500. How can the city be so thoughtless! The bird company said they don’t track user information and that it’s confidential, how do they bill if they don’t?

INBOX FROM THE BERKSHIRE NAACP:

“The NAACP, Berkshire County Branch believes that change cannot wait. Our Communities of Color continue to experience trauma as a result of law-enforcement officers’ (LEO) actions and the inaction of our elected leaders.

Pittsfield lacks adequate, appropriate, racially and culturally responsive mental health services. And elected officials and providers have stated they recognize these gaps in care. Currently, access to crisis counseling and response is limited to an unknown crisis 1-800 number or the over-utilized emergency room at Berkshire Medical Center.

It is irresponsible and dangerous to allow these circumstances to persist.

The City of Pittsfield, its city council, state delegation, and Mayor have relied solely on the Pittsfield Police Department as the only answer to crisis response and public safety.

But they don’t need to be. There are many alternative-to-LEO organizations responding to non-violent emergency calls every day in this country.

One of the best examples is in Eugene, Oregon with the CAHOOTS, standing for Crisis Assistance Helping Out On The Streets. They are a mobile crisis intervention program staffed by White Bird Clinic personnel using City of Eugene vehicles. CAHOOTS provides support for EPD personnel by taking on many of the social service type calls for service, including crisis counseling. CAHOOTS personnel often provide initial contact and transport for people who are intoxicated, mentally ill, or disoriented, as well as transport for necessary non-emergency medical care. The CAHOOTS have been providing service for over thirty years.

Even closer to home municipalities like Boston and Lynn and our neighbors in Northampton and Amherst are heeding the call for equity by recently establishing independent, and alternative-to-LEO, response units, and new city departments.

Mobile crisis response teams serve our neighbors. Our current co-responder program in Pittsfield does not.

The NAACP, Berkshire County Branch asks that the elected officials of Pittsfield, including the City Council, State delegation, and Mayor;
1) support the ACES Bill (H. 2519)
2) ensure any state funding earmarked for crisis-response in Pittsfield is devoted to an independent (from the Pittsfield Police Department), peer and practitioner-led, mobile crisis unit
3) commit to a process of assessing current PPD functions, undertaken by those with lived experience that are representative of the diversity of Pittsfield; that said advisory commission will be tasked with researching non-violent crisis response best practices and models; and, authorized to recommend for adoption a new city department appropriate to the circumstances of Pittsfield.
-President Dennis Powell”

You can believe if this is body cameras idea adopted a city councilor-ors it will be to fit the officer either way. HERES what you Do. You announce to the future victims like Miguel and Daniel that he/she is being recorded. That’s it. Police never enter an enclosed area with deadly weapons drawn unless they’re coming out alive but they can announce that also inside if law requires. But the main problem has been outside shootings. On the flip side it is very expensive to have cameras. I will be looking at these woke city councilors down the road to see how it is implemented, period. You know they’re going to mess it up. The city council should be the sign off on all of this.

Where is your apology Dennis? Miggy advanced 120 feet (40 yards) towards the officers. They weren’t hunting Miggy because he was “large and the officers were scared.”

Until you apologize, your opinion’s are as valuable to me, as TSC and Chesty’s are.

The way I read the PPD’s Media Release, even the information from the PPD’s own media release, under Mapping Pittsfield Police report’s breakdown of the shooting of Miquel Estrella, doesn’t indicate that Miggy advanced 120 feet TOWARDS the PPD Killers. The map actually shows a 120 feet radius which includes the entire 279 Onota Street Apartment Building, a portion of Onota St., Woodbine Avenue and an area behind 279 Onota St. The source of this information is the Pittsfield Police Department and it indicated that the PPD’s own 120 FOOT RADIUS IS APPROXIMATE AND THE PRECISE LOCATIONS OF EVENTS DESCRIBED IN THE REPORT ARE NOT AVAILABLE. Whereas the Miggy candlelight memorial site would suggest that Miggy was shot somewhere in the vicinity of Woodbine Avenue. Anyway, that’s the way I read it.

And the $hitshow has started. 4 kids on scooters going down the middle of Elm St. smh

This was just posted on facebook. And guess what? It was IMMEDIATELY bombed with comments from the mayors lackeys saying stupid things suggesting that kids will be kids, leave the kids alone and let them have some fun, You did this as a kid yourself, and the dumbest one of all, “Drivers just need to be more careful and watch out for them.”
So it looks like if anyone of these scoot out in front of you and you hit them, it is going to be YOUR fault, and it does not look like the mayor is going to except any police report that does not reflect that. So good luck out there people.

There’s 5 kids three on the sidewalk and two in the road. The fat kid in red shorts is riding double.
There’s a lady walking who almost got hit, she’s in front of the scooter with the fat kid. You can barely see the scooter way in front, the kid jumped a curb.

SNAP and EBT users were told how to sign up for free rides, and given free bird gift cards.
Taxpayers money at work. EBT and SNAP users get 5 30 minute rides a day for free. The money is not billed to the EBT card holder but billed to a transportation fund run by the State.

“ In addition to Community Pricing, in several cities we also offer Bird Access, an option for low-income riders only that offers five 30-minute rides per day for only $5 a month who are enrolled or eligible for a government assistance program.”
The “five free rides” are free to the end user but is charged to the Transit Fair system in MA. Both Bird and the City of Pittsfield get their cut paid for via the state.

https://help.bird.co/hc/en-us/requests/new?ticket_form_id=4525412340628

Basically any kid you see on these is an EBT kid. It’s a new babysitting thing. A lot of adults are saying, “let kids be kids” yeah that’s fine until they get run over or do property damage and the poor driver involved is blamed. The city doesn’t need to facilitate this kind of thing.
The ink of the medical bills these EBT kids are gonna rack up, without helmets. Oh but Darby just bought a bunch of “free” bike helmets for kids.

Contrary to how these things are being portrayed, they are not for tourists, they are to entertain the poor.

one of the mayors lackeys posted that it is a way to encourage kids to be “active”. Can’t make this shit up. It is almost as much exercise as watching TV.

Back in the day my own parents would always encourage exercise and would say, “Bobby, why don’t you and your little sister get on your bikes and go play in traffic? And I will have a nice supper for you when you get home, if you are not killed having fun playing amongst all the moving cars and trucks.”
And then they would say “I love you”, just in case I did get killed and they would never get to see me grow up.

West Stockbridge had to shut down its community page on Facebook due to toxic drama, which emmanated from the actions of the usual suspect. Why is it when something happnens it is always the same toxic Hurricane?
Let’s hope this fine restauranteur gets the support she deserves.

To the editor: I hope West Stockbridge will grow ever more prosperous, vibrant and welcoming to everyone. But growth shouldn’t happen at others’ expense.
My business, my family and West Stockbridge as a whole have been ill-served by the current Select Board chair.
Our business, the Truc Orient Express and residence, has been here for more than 43 years. Many businesses in town had to pivot due to COVID, but one was directly detrimental to our business and home. It’s unfathomable that a nonpermitted business was allowed to have outdoor concerts that harmed my business and family — all last summer — as excessive noise levels were allowed 30 yards from both. As taxpayers, don’t we have the right to operate our business and enjoy our home in peace, without interference or disruption?
We didn’t move into a neighborhood containing an existing venue featuring loud music with amplified bass. Despite the conditions of a special permit which limits excess noise levels, this disruptiveness continues with no enforcement. Regardless of one’s entertainment preferences, intrusive noise pumping through our residence and business will never be acceptable. It would not be acceptable to anyone, nor should we be expected to tolerate it. We didn’t settle next to an airport; the airport moved to us. Parameters on a business’ operations are there to ensure everyone’s rights are protected and there is peaceful coexistence within a community.
Nonenforcement shows extreme bias, revealing an inability to understand why proper requirements are needed for legitimate businesses to thrive and coexist without conflict. Continuing to show preference for one business over another is inexcusable and speaks to poor leadership and conflicts of interest. To enforce or not enforce zoning laws or other licensing laws differentially in favor of certain business over others, without a legal rationale, not only exposes deep ethical issues but is clear discrimination. This current chair’s preference is not the law.
We welcome change and growth, but we never imagined it would have such an adverse impact on our quality of life and our civil liberties due to such abysmal leadership and governance. West Stockbridge desperately needs fairness, transparency and equity reestablished in our government. The toxicity and blatant disregard must stop.
Therefore, on May 9, I will vote for Andy Potter for Select Board. Andy will serve all with respect and transparency.
Truc Nguyen, West Stockbridge

Dennis Powell’s letter actually makes a lot of sense given that Pittsfield has been and still is in the top ten cities by population in Massachusetts for violent crime. The PPD’s law enforcement operations are obviously NOT working! The city’s only official response thus far is a disputed PPD Use of Force preliminary report whereby only PPD personnel were interviewed without any other evidence, such as the calls to 911. Like I have written before, the PPD is conducting a CYA operation to protect the city from insurance claims/liabilities and lawsuits after the deadly shooting of a young man with a known history of mental illness who was in need of medical and psychiatric care on the night he was shot twice in the chest by the PPD. Pittsfield is a dangerous city, and things need to change, or else violent crime will only get worse and worse there. That is more bad news for the fictional/proverbial Mary Jane and Joe Kapanski!

Far from isolated, unless you consider it to be isolated when you consider these incidences of youths in possession of large capacity loaded firearms, when, not one, BUT TWO, daughters of PPD cops, one a minor child, who allegedly SHOT HERSELF with her cop father’s unsecured loaded service weapon, after the cop tormented his daughter, the other an 18-year-old shoplifter in possession of a loaded handgun when she shoplifted several bottles of booze and then led cops on a high-speed chase from one end of the city to the other, were easily able to get their hands on loaded handguns. Neither one of them would be considered the disadvantaged products of the ghetto, rather they’re the spawn of ghetto minded cops. But, still, even if you reject the gun possession incidences of the kids of cops, there’s also this; Noise Complaint Leads to Discovery of Juvenile with Loaded Firearm / Daily Voice – July 1, 2021

a quaint little Pittsfield tale of three juveniles in the McKay Street parking deck, one of the juveniles caught with a loaded handgun stuffed in his pants, the other two juveniles, suspected of disposing of several bags of heroin as they fled from the Pittsfield cops.

Or this Pittsfield tale of two young juvenile cannibals from the ghetto; Two juveniles in Pittsfield charged with possession of firearms and drugs – wwlp.com – May 27, 2021

The two juveniles were arrested and charged with the following:

Possession to Distribute Class B Drug
Receiving Stolen Property
Possession of Ammunition without FID card
Possession of Large Capacity Feeding Device
Carrying Firearm without License

And there’s this;
3 Juveniles among 6 arrested during Pittsfield Drug Raids

Drugs raids in Pittsfield which netted about 4,000 bags of heroin, two loaded handguns and THOUSANDS of Dollars in CASH
Odd that the Pittsfield Cops couldn’t say exactly how many THOUSANDS OF DOLLARS IN UNTRACABLE DRUG CASH THE COPS FOUND and took possession of.

Two juveniles were found in the first home. One had 80 bags of heroin in his pocket. Police say a backpack belonging to another juvenile contained 400 bags of heroin and a loaded 9 mm handgun

And this; Crime Series: Shootings Spur Community Response in Pittsfield / WAMC – July 21, 2015

A 15-year-old boy shot a 17-year-old boy near the busy intersection of Tyler and First Street in broad daylight. Which inspired this statement from Chief Michael Wynn;

“We’re not interested in responding after the call anymore, we’re interested in developing a strategy of intervention,” Wynn said. That was in August 2014.

That was a year before 18-year-old Keenan Pellot was shot and murdered by 18-year-old Thomas Lee Newman. A 17-year-old was also shot in this gun violence incident, but survived.

You think 16 is young but it is going lower. You can thank the criminal justice reform brigade for juveniles as young as 11 now seen violently attacking citizens in downtown Boston. It was the 2018 criminal justice reform law that prohibited the arrest or prosecution of children under the age of 12 and limits the ability of law enforcement agencies to hold children under the age of 14. Police can’t do anything about them. You’re own your own people.

Harrington’s ultra progressive Soros funded prosecutor cult is now on a promotional tour to get juvenile murderers released across the country. In Milwaukee they are reviewing 50 cases to “safely return them to their communities.” This combined with some of Harrington’s other policies should horrify you. For example you will remember that Harrington spoke at the legislative briefing to raise the age of adult prosecution to 21. Under her plan, Wayne Lo of the Simon’s Rock murders would most likely never even have been charged. These are the people Harrington stands with, not the Kapanskis. She is an unmitigated disaster.

Blogger Dan Valenti wrote and posted: Thanks for posting, JM. 3 years, 4 months, and nearly one week of a near-zero dud coming from the current D.A.’s office, but who’s counting? Shugrue is. That’s for sure.

My reply: I respect it when you use facts to support your ongoing criticisms of Berkshire County District Attorney Andrea Harrington. In fact, I agree with many of the factual points you write about her track record since 2019. I also wish to point out the fact that Pittsfield – along with North Adams – has had the same violent crime and related problems long prior to 2019. Please put that fact into your list of facts. I believe that you are unfavorable to Andrea Harrington due to her progressive politics and restorative justice approach to prosecuting criminal cases in Berkshire County. I understand that you have other factual reasons, too, but the bottom line is that she is too liberal for your liking. We live in a free country. Andrea Harrington has every right to be a progressive politician, and she is part of a growing number of Attorneys who believe in restorative justice. You have every reason to criticize her, as well as to write and blog unfavorable views of her tenure as D.A. Lastly, please ask Attorney Timothy Shugrue to back up his claims of greatness in practicing the law by requesting that he list his successes and failures as an Attorney in Berkshire County.

Best wishes,

You can find theatrical glimpses into the horrors of botched/backroom abortions, and the importance of providing safer therapeutic abortions in films like The Cider House Rules, For Colored Girls and even on Call the Midwife. You don’t even have to look to the movies for examples of why women should be allowed safe access to terminate an unwanted pregnancy. I say this because the horrors of Baby Farming Profiters is never going to go away. It will just keep changing its name, CPS, DSS, DCF, Berkshire Children and Families/18 Degrees. All of them are in the business of Baby Farming. But irresponsible women aren’t responsible enough to prevent unwanted pregnancies and won’t be satisfied with a first trimester abortions. Even though that gives them a whole 14 weeks to decide to end the potential life of the contents of their irresponsible wombs. Civilized and uncivilized societies have always looked for ways to abolish the inconvenient contents of the womb. Sadly, society has chosen on decidedly uncivilized methods when it comes to the fate of the unborn, the just born, and the newborn. May I suggest you read on Ensoulment.

I agree with most of what you say. These irresponsible women now want abortion on demand so anytime during the 9 months and even once the baby is born, these women want the right to control the fate of the baby. They want to say it’s about their body, but most Americans agree that 3 months is enough time to decide. Irresponsible women have turned abortion at any stage of pregnancy into a minor medical procedure. Unless it’s done for health reasons to protect the mother, most Americans do not agree with abortions past 3 months.

Pittsfield drivers take caution when backing out of your residential driveways. As I started to back out this morning, out of no where comes two Birdy’s scooting by my driveway in the middle of the street. Proceeded to follow them down my street as they felt they evidently had the right of way and were totally unaware of traffic, much like Morales every morning on Elm and East Street, they were just focused on getting to the pot shop on Merrill Road. So now since Flat Tyer has been in office my once quiet street has now become a street saturated with pot stench from Berkshire Roots, addicts begging for money from Spectrum after getting their methadone fix, constant New York cars breaking the speed limit to get their pot and now the Birdy Scooters. Meanwhile my taxes keep increasing and I no longer feel safe in my home. People say move, but that is much easier said then done! Also, why should I have to leave my home that I take pride in because of a bunch of highly paid nitwits like Linda Tyer feel they can do what ever they want without consulting the very people that pay their salaries. Congrats Linda/Barry for ruining Pittsfield. Wonder how many Birdy’s pass their driveway? Not everyone lives in a gated community. Us taxpayers have NO choice! Sickening!!!

True. As long as their high class neighborhoods don’t suffer and stay quiet and stench free, and safe from crime, they are fine with how their far left agenda is going. Wait until they get control over everyone with their climate change agenda and see all of the sacrifices they will demand of us like no vehicles if you can’t afford electric, public transportation for most people, and you won’t own anything, but will be happy. Big government will be watching us constantly.

The clock is ticking on the first scooter fatality and city hall will be wholly complicit in this child’s demise. Hopefully when it happens the mayor will hold one more scooter presser and say more than, “Aww shucks! …did not see that coming.”

Like the sands of time a life gets shorter with each passing day. So sad that some feel the need to hasten the drop of the sands because of blind stupidity.

That’s funny but not funny. I’ve seen at least three ridiculous scoooter moves. On channel 1. The scooter driver on sidewalk on North Street going towards fountain north just went right through it was on tv while reporting on north st Covid. About an hour ago I get out of my car and six of them are rolling down the pothole street and unswept by the way, they were traveling by the way pretty well and I smiled at them as they went by but they didn’t care I guess and I’m looking down as they go by and the girl in the back of the pack it’s a little pothole she almost got killed I don’t know how she stayed up because she was really rolling. I hate to say it but somebody’s already said it before this isn’t gonna end well we need to know who the hell is paying for these damn things though I sure shouldn’t be I pay enough taxes and some are needless taxes like pickpocket decks that Terry coin years ago.

Back in the day, Rolodex Rubeto and his band of gobsig’s did everything they could to keep Terry off the city council.

And keep him off they did. It really speaks of Terry’s character and his fight for the little guy.

I believe this was one of the times Tricia Farley-Country Buffet (D) even flexed her “political clout,” to keep Terry away.

They didn’t want Terry to see how “book keeping” is done in Pittsfield terms.

Something that’s come up in the Miggy shooting investigation.
The police violated procedure as Sondrini, the trigger happy cop is a K9 handler, procedure dictates that the continuum of force would require the k9 to be released before shots were fired.
Sondrini should have had has dog at the ready, or remote released the dog. If he had time to walk back 40 yards, he had time to release the dog.
The dogs are outfitted with vests.

Sondrini screwed up and it’s not surprising Wynn covered for him.

The number of time animal control has been called on sondrini for leaving his dog out in the run without water and appropriate shelter is pretty high, just ask any of his neighbors. The PPD, as always, covers for their own.

Is it really a surprise that PPD killer cop Sondrini allegedly neglects his dog by leaving him without water and shelter. Just thank your lucky stars wynn selected Nicholas Cabral to become one of the PPD’s finest instead of Decorated Police Officer Terry Yetman. Also when Nicholas Cabral became one of the PPD’s finest the Pittsfield PD was also blessed with Nicholas’ wife Lucia Cabral. The PPD’ s celebrated first-ever Latina police officer. PPD Lucia, like her PPD husband Nicholas were how ever short lived.

The police were told not to do any enforcement action against scooters. I guess the cops will show up when someone gets hurt, or maybe they won’t.

People don’t understand the basics of the issue.
They all say stuff like;
“kids are having fun?”
“What’s wrong with having fun?”
“It doesn’t cost the taxpayers anything”

It’s fine that kids are having fun BUT fun doesn’t have to come at the expense of safety.
The program is supposed to be for those 18 or older, but it’s clearly targeting poor kids (the poor part is important).
The kids aren’t wearing helmets, they are not following any type of rules, they ride multiple riders, they ride in and out of traffic, weave around, ride on the sidewalk, they are a hazard to drivers (the primary users of the road).

This program is costing taxpayers money, that $5 a month fee for low income, the full rate is still billed, but it’s billed to a state transportation fund. The city and kufflinks helped via contact to get that done in Pittsfield. Those transportation dollars are finite, they are also used for senior, veterans, and low income transportation dollars that go towards BRTA, that help low income employees get to work,
MassMobility, subsidized bussing, YouthPass, CharlieCard etc. The city has also invested in money to prepare for the program, city employees are repainting lines, are helping pick up scooters, the police are being (or were being) diverted for calls. That’s your tax money being spent.

We make these huge pushes in schools and with the police about bike safety, wear helmets, obey the road rules, they even made special lanes for bikes and limited traffic access to downtown. None of that matters, none of the basic safety matters.

A majority of these kids are under-privileged, low income, and instead of promoting healthy and safer activities, the city is putting the most at risk at higher risk to death and injury.
And what happens when these kids end up in the hospital, who’s going to pay those bills? Certainly not the single parent or grandparent with kids on mass health.
I’ve heard there’s a plan to start doing enforcement of the helmet rule, but the police will be handing out “free helmets”, paid for by a “grant” using taxpayer funds.

If the plan was to make downtown undriveable, Tyer is doing a great job. If the plan was to place at risk youth at greater risk for serious injury, she’s accomplished her mission.
Let them have cake!

Late this afternoon a small group of kids dumped their Birdy’s on one of my neighbor’s front yard and left. This neighbor works constantly to keep their property meticulous and they were very upset. So evidently us taxpayers are no longer allowed to think our property is private. Evidently Flat Tyer and Ricky Rumpus feel that they have jurisdiction over our yards since they state that the object of renting the Birdy is to leave it wherever when through with it. Since they feel this way, why should we pay our taxes if basically our property is no longer ours and it is allowable to be littered by a City sponsored program? Suggesting that a remedy to anyone that has a Birdy dumped in their yard to pick it up and drive it over to Ricky Rumpus’s address at 16 Adelaide Street and put it in his yard, I would suggest dumping it at Flat Tyer’s but we can’t get through her guarded gate. This program could have worked, but, as usual under this Administration there was absolutely no thought process and no rules or regulations put in place. Shouldn’t there be a published phone number to call and have these scooters removed immediately from your property? Be careful out there!

You have to wonder why the mayor has stressed that this “scooter for kids in traffic” program is Rickys passion, not hers. Is that because the city solicitor has told her it is very dangerous and so she if covering her ass?
Does Ricky realize the position he has been put in? Used for? Does he have deep pockets for when, not if, the first child goes down?

More Proof. Either it’s a zombie apocalypse, or this is the work of the Joker:

“The confrontation began after an officer observed a man lighting vehicles on fire in a parking lot near a district station at around 1:20 p.m., Police Chief Estella Patterson said at a news conference.
The officer called for assistance, and three other officers came to help, she said, and the officers ordered the man to stop. Patterson said the man continued to throw Molotov cocktails, ultimately tossing one near an officer close to him.”

From Atty Sullivan’s FB page. TRUTH.

DA Harrington: Stop referring to your cases as evidenced-based prosecution. All prosecutions, whether successful or not, are based on the ability to introduce admissible evidence, pursuant to the rules of evidence that apply at trial. Stop making what has always been the standard something earth-shattering. No successful prosecution is non-evidence based. In fairness to you, you have no experience or concept of how to successfully try a case. In fact in a recent matter you couldn’t even successfully produce an indictment without it being dismissed for over-embellishing in front of the grand jury. That baby’s death is now on your hands. Lack of knowledge of the process equals a failure of leadership and the virus has spread to a large part of your office due to lack of training. Lack of knowledge leads to a lack of strategy and the community ends up suffering. My suggestion, go back to law school and do some mock trial work. Although your performance in the Jamel Nicholson trial suggests you probably wouldn’t make the mock trial team. Completely free advice, I won’t send you a bill. You’ve wasted enough taxpayer money on political trips across the globe, hiring PR firms, paying Hootsuite to manage your social media, the list goes on. As one of my favorite bands (Rage Against the Machine) once said: STEP DOWN.

Sullivan doesn’t care about the Tucker case except the judge took Nipples to task for lying to the grand jury. Dismissing a case without trial is rare. It shows the procedural nightmare that nipples has created.
“ you couldn’t even successfully produce an indictment without it being dismissed for over-embellishing in front of the grand jury.”
That’s what’s at issue, the “baby’s death” isn’t on her hands, she didn’t kill the kid.

Sullivan knows the Tucker case is a no win case.

Hello Erin Leahy at Act on Mass,

Thank you for your weekly political email from Act on Mass. I always look forward to reading your thoughts about Beacon Hill politics. I hope that all of your reform efforts will work, but I am not holding my breath.

My responses to your political email today (Saturday, 7-May-2022) are:

The U.S. Supreme Court doesn’t represent the American People, including on abortion law. I asked my 75-year-old mother about the U.S. military industrial complex that has killed millions upon millions of foreign Peoples since the end of WW2, consumes trillions upon trillions of federal tax dollars, emits more greenhouse gases than 140 countries combined, and so on, but the Pentagon gets away with it all as being legal, but if an American woman has an abortion, the Swamp pretends to go nuts about it. She replied that her generation fought for women’s rights in the 1960s and 1970s, protested the U.S. war machine killing over 5 million Vietnamese People back then, and supported the founding of the EPA back then.

The U.S. Government is the number one exporter of arms in the world, which has led to humanitarian crises around the world. Since Putin invaded and started his unprovoked war in Ukraine, the Swamp and Wall Street has made a financial killing. The U.S. Supreme Court, like the rest of the Swamp and the Billionaire Elites on Wall Street, are all about war, money and power. When the U.S. Supreme Court overturns nearly 50 years of limited abortion legal rights and the right to personal privacy laws, let us all remind them about the Pentagon, the Swamp’s obsession with the Almighty Dollar and Wall Street, and that the U.S.A. is the number 2 polluters of greenhouse gases in the world second only to China, which the two countries combined pollute nearly 50 percent of the world’s greenhouse gases that contributes to global warming and sea level rise.

Beacon Hill’s corrupt career politicians passing a law to reward undocumented immigrants with Massachusetts Driver’s Licenses is contradictory to state and federal laws concerning legal immigration. I understand that it is a complex issue similar to limited abortion legal rights, but undocumented immigrants with legal driver’s licenses could lead to more serious traffic accidents and/or fatal auto accidents. If there are negative consequences, should Beacon Hill lawmakers vote to overturn the law?

Beacon Hill’s corrupt career politicians passed the bill to legalize sports betting in Massachusetts by a voice vote, which means that nobody knows how each State Senator voted. Like I wrote before, all gambling schemes are nothing more than regressive taxation schemes. Beacon Hill lawmakers use all of their regressive taxation schemes to play financial shell games to give tens of billions of dollars in state tax breaks (every fiscal year) to their wealthy big business campaign donors. Regions such as mostly rural Western Massachusetts do NOT have the big businesses that the Boston area has. Municipalities and public-school districts are always systemically underfunded by Boston. I grew up and lived in Western Massachusetts for most of my life, and I have long spoke out about how the corrupt Boston politicians were always screwing us over with their financial shell games and institutional political corruption, but to no avail.

I wish to thank you for your non-binding transparency question on ballots across the Commonwealth! I hope you succeed in bringing Sunshine Laws to Beacon Hill’s corrupt Statehouse, but I won’t be holding my breath.

Best wishes,

Jonathan Melle

The sneaky Berkshire Eagle had no mention of the very cool spring that we have had, but they are getting all excited about temperatures in the 80’s by the end of the week. These temps will be higher than normal for this time of year drools the Berkshire Eagle. So we get a few days of warmer than usual weather for May, but no mention of the overall pattern we have seen up to now. Anything to justify their climate change agenda takeover of the country by the far left.

The Berkshire Eagle runs a supposed fact check of Twitter claims that Blackrock owns the majority of single family homes in the country and that Bill Gates owns the majority of farmland. Blackrock refutes the claim, but declines to say how many single family homes they do own and claiming that they own mostly rental units. No mention of the extreme buying of private property by Blackrock since Biden was elected which has made it difficult for Americans to buy homes when they were outbid by Blackrock. Supposedly Bill Gates does own lots of American farmland, but not all. Again, we just rely on his world with little evidence and this is called Fact-checking?

I do not believe that it is physically possible to own the majority of single family or rentals in the USA. Must be referring to largest number of homes. If so, that isn’t really hard to do. Othewise, maybe it’s the ownership of liens and mortgages. If so, that IS interesting and much more disturbing than primary ownership.

Hello Patrick Fennell,

I respect you. I respect that you are a Veteran – like myself. I respect that you are a Republican who supports Donald Trump in U.S. politics. I respect that you are pro-life. I respect that you speak out about local issues in Great Barrington, you tell it like it is about the corrupt career politicians on Beacon Hill, and that you write about the Swamp’s systemic failures in American leadership. While I will never support Donald Trump in U.S. politics, I respect you, and I agree with a lot of your political views.

My reply to your political email to Erin Leahy and myself is that people, including women’s issue, should stop being politicized. We are all human beings, not numbers on a bureaucrat’s spreadsheet. We should all practice the Golden Rule, which means that we all treat each other with respect, fairness and safety in our lives, which is a lot easier said than done, of course.

In the case of Berkshire County District Attorney Andrea Harrington, who is a progressive politician, she receives more personal attacks than any other Berkshire-based politician, which has become redundant, banal and mean-spirited. I doubt that Andrea Harrington, who I wish a Happy Mother’s Day, is fighting for abortions to kill innocent babies. That is ridiculous! I doubt that Andrea Harrington is fighting to let violent criminals walk the streets of Pittsfield. That is also ridiculous!

Beacon Hill lawmakers’ recent votes to give undocumented immigrants Massachusetts Driver’s Licenses contradicts state and federal laws on legal immigration. Moreover, the consequences could result in increased serious and/or fatal auto accidents. In time, the would-be law should be overturned if it leads to serious consequences.

As I respect you, Patrick Fennell, I ask that you please respect me and the written response I have sent to you and the community.

Best wishes,

Jonathan A. Melle

I’m not sure of your employment career, but after 3+ years on the job you would be expected to understand what is required to be performed in the position or be removed. JM’s Pittsfield politics story equals “Luciforo” persecuting my political dad, Bob, and having his provincial network trying to bully me to death, but I survived all of these years/decades later. JM’s U.S. Army story equals me receiving military medals and commendations from my U.S. Army Officers, an Honorable Discharge, the White House sending me a letter saying the U.S. President (GWB) sends me his regards, who ordered me a VA hearing in/around mid-2004 nearly one city block from the White House, and me being a 100% service-connected disabled American Veteran. When JM goes to the hospital, my statement reads that a grateful country is happy to serve me. Pick on JM all you want, but JM is a proud American Citizen and Veteran who is honored by our grateful country. Lastly, I am proud to support Andrea Harrington for reelection as Berkshire County District Attorney. She is my fellow Pittsfield sister high school graduate back in 1993. I am proud of her for all that she accomplished in her life. Andrea Harrington is a good person!

Why is my cat scooting? Scooting indicates that something is bothering your cat, such as: Something stuck on their bottom – such as litter or poo. Worms – a common cause of an itchy bottom. Anal gland problems – two little scent sacs in the bottom that can cause irritation if they become blocked or infected.
