Fuss Over Foss — Maybe Mrs. Harrington can bring Adam Foss (hmmmm, another “Adam,” like Mr. Webster) back to the Berkshires at $20 grand a pop to give a talk about on proper gender relations. That is, when he posts bail after being charged on Manhattan rape and sexual assault. Perhaps Mrs. Harrington can ask Foss to give her instruction on how to prosecute all them “rape cases” she campaigned on four years ago — you know, the ones that apparently don’t exist.  Choosing Foss and 40% attrition rate. Wow, what a judge of character!

Fuzzy Logic — Candidate for sheriff Alf Barbalunga has raked incumbent sheriff Tom Bowler for more fuzzy math and the Berkshire Eagle for failed reporting. In his latest press release, Alf took issue with the reporting on $70,000+ in grant money paid to the “special sheriff” Jack Quinn from February 2021 to June 2022. Barbalunga says the numbers the Eagle published “don’t … add up.” Bottom line, Barbalunga charges that Quinn pulled down $75 and hour, not the $36 figure that Bowler and the Eagle have stated. As of press time, the Bowler campaign has not responded.

There’s a website for lawyers that ranks DAs across the USA. It ranks them by cases, case load, win/loss, charges and pleaded, and a few other things.

Andrea Harrington came in dead last….DEAD LAST of the thousands of DAs in the USA the Berkshires has the distinction of having the worst DA.

She was beaten by a couple DAs that died in office, a dozen or so that were charged criminally, some that were forced to resign. There are prosecutors and DAs that have been disbarred that rank as more effective that Andrea Harrington.

She has a new Nickname, Dead Last Andrea!

Excellent interview with Tim Shugrue. He’ll make a fine DA. A great balance of experience, insight, and community-focused commitment. He will return the DA’s office to the best law firm in the county with well-trained and properly supervised ADAs. The choice could not be more clear between an excellent criminal justice practitioner and a corrupt, incompetent politician. Thank you, Dan!

I think he’ll be just as crap as every other DA running back 50 years. I think AH very well may be worse, but this guy has special interests written all over him. Nothing will improve but a different set of takers will get what they want. Western NE is a shitty law school too. Berkshire co is politics, so i Al services graft, mob money, pot money and union money. Mob and union money going hand in hand historically. There will be no justice. And the public will keep paying billions of dollars and have roads that look like Mozambique, shit schools, and daily shootings on the street. If you count the Great Barrington Water fiasco we are worse than Flint Michigan.

The Biden regime is waging war on the American people, and those like you and me who demand adherence to the U.S. Constitution in particular.

If it wasn’t clear enough already, the events of this week have made it crystal clear.

We see it with the ongoing politicized persecution of the January 6 defendants, while violent, organized left-wing political terrorism throughout 2020 and beyond has been ignored or excused.

We see it with the censorship and persecution of journalists exposing serious scandals like the contents of the Hunter Biden laptop and Ashley Biden diary, while nobody was (or will be) held accountable for the FISA warrants obtained under false pretenses to spy on the Trump campaign, based on a “Russia collusion” hoax concocted by Hillary Clinton’s operatives.

We saw it with the targeting of pro-freedom political organizations like Campaign for Liberty throughout the Obama administration.

And now, Joe Biden and Senate Majority Leader Chuck Schumer are providing funding to the IRS for 87,000 new armed agents in their “Build Back Broke” bill which passed the House last week. The IRS job posting says agents should be prepared to use “deadly force,” and I fully anticipate the full-on scaring and harassment of Americans by the IRS will resume shortly.

Even the mainstream media is talking about Biden and the big government statists waging war on the American people, after the FBI raid on Donald Trump’s home.

Happy Weekend everyone!! I hope everyone is staying healthy and happy during this great summer! Just saw an article about this inflation reduction (ha,ha George Orwell is smiling) bill where people who buy electric vehicles will get a rebate up to $7500. Lo and behold right on cue the car companies all raised their prices…by how much do you say??? take a guess, the figure is in my paragraph. I just ordered some movie time microwave popcorn from amazon so I can watch CNN this week while the government raids Obama’s several mansions to find the millions of classified papers he took from office…this should be a doozie. I wonder if they will indict him on spearheading the Antifa/BLM summer riots that may have been a smoke screen for the illegitimate election of that year. This should be a great weekend for CNN:)

We heard “insurance policy” during the Trump/Russia hoax. Peter Strzok now touring talk shows slamming Trump when he should be doing prison time for going after Trump while he was an FBI agent. The raid could also be to take any documents regarding “Crossfire Hurricane” since the same FBI agents who raided his home were involved in that fiasco.

When I think of higher power I think of high tension lines and how I use to tight rope walk across them over the Yantze river in China. The first time I did it it was on a dare and when I got all the way across the peasants were waiting for me with fortune cookies. What makes the Constitution and the USA generally the best government? The most successful model both historically and globally? Millions are headed here as I write to get away from third world failed nation states, narco-democracies, industrial-party syndicates of South America. One proof is over two hundred years of political stability, even during the Civil War. Not one president got beheaded, not one revolution, not one change of power structure or major Constitutional revision since the Constitutional Convention.

Do you support the American Experiment and particularly peaceful transfer of office? If so, don’t support third world power tactics where winners only win if the loser goes to jail or executed. Save treason and corruption for investigations of illegal acts like Watergate, spying, planting false evidence, theft of State Department documents by State Department heads, influence peddling, illegal wiretapping where there is concrete, clear and demonstrable criminal acts.

I’m surprised we have to talk about this in this country. This conversation is a direct result of the Loons taking power.

Why didn’t the FBI go after the leftist loons threatening the SCOTUS justices? One was on the way to assassinate Justice Kavanaugh. Intimidation of judges is a federal felony.

Seems they were AWOL the whole summer of 2020 while the Burn Loot and Murder events, er peaceful protests, were going on. And when a whole section of the city of Portland OR, was held as an illegal fiefdom by the Antifa, complete with attacks on courthouses, police stations and federal buildings.

Left Wing Right Wing was originally a 19’th century French thing. Someone just noticed a predictable seating order in the room and called those guys on the left the left wing and those on the right the right wing.

Come political ‘science’ and ‘social science’ aka – anythinggoes ‘science’, right and left labels were invented to make a false distinction. For example, Hitler is ‘right wing.’ Stalin is ‘left wing.’ That works since they live in different countries. But what happens when they all share the same roof? They outcompete each other because they all want the same thing and have the same mindset and strategy.

What is interesting is that we now have a death spiral of anarchy,* lost heritage, murder, and persecution rising on these terms, just like the French had when they came up with the original idea.

*Anarchy: No law which means ‘Justice is the will of the strongest’. Liberty is what you can scratch out for yourself – it’s relative in the anarchic state.

I just watched the riveting hour and fifteen minutes with Shugrue. Looked more like a love fest to me. If Dan were a woman I think he would have proposed on the spot. Not ONE hard ball question that Dan is known for, not ONE. It was such a disappointment.

Im no fan of Harrington, but I don’t think I can vote for this extremely rich (look at his suits, pocket squares and cuff links he wears to each debate) privileged white man. He seems like such doofus.

Kids Place back in the 90’s was used as a tool for the prosecution, not a place to help kids (it’s different now). That is why Berkshire County had the highest conviction rate for child molestation, many of which have been proven to have been false convictions. Tim Shugrue started the joint with Dective Collias, who when retired admitted that he was molested as a child, a fact he never revealed while brain washing children into giving false testimony.

I think I’ll pass on voting in this race.

You could argue he has been in practice for 36 years, but the average person has never seen him in court. I hear he has quite the temper in the courtroom. I can vouch for the fact that Shugrue can handle himself in the courtroom. Superior court is major leagues, and it is there that I have had Shugrue question me, as a prosecutor and as a defense attorney. He questioned me professionally both times, and he handled himself very well. As to his run against Capeless, Capeless was running scared that Shugrue would beat him. Shugrue ran a good, tough, and fair campaign. Hell, I would not be surprised to see Capeless and Caccaviello come out and endorse Shugrue. Harrington is that incompetent.

On criminal family members, don’t look too closely, because you’ll find that cops have criminals in their own families. We don’t need Harrington educating the community, and training youths. What’s Harrington going to train them to do, drive without a valid driver’s license, drive down one-way streets the wrong way, fail to pay fines, maybe she’ll train them to be liars. She uses all the current talking points about inequalities, but leaves out the data that breaks down the types of crimes being committed and what communities they are being committed in. Most importantly the data also shows it’s the same ones over and over committing the most serious crimes. I’m glad some make good on their diversion program diplomas and move on. You shouldn’t need any DA to keep anyone out of the “clutches of the justice system “as she states ,when in fact it should start at the family level in the home about consequences for any criminal activity.

The legislature decided that “Shoplifting” would NOT be a jailable offense for the first 3 times it has been charged. So Harrington can’t lock them up even if she wanted to. Are negroes really only 33% of the prison population? I would think it would be much higher considering the negro’s natural born predilection for all things criminal. Of just the last 10 shootings in Pittsfield, whether they resulted in murder or not, how many involved negroes/POC, both as the perpetrator and the alleged victim? The reason negroes are allegedly only 33% of the prison population is because negroes are the perpetrators of their own self manufactured genocide against their own tribes. It’s really funny how Shirley Sharpton Edgerton neglected to educate the community in her Black LIES manifesto on how these fine young 13,14,15,16-year-old cannibals so easily get their youthful hands of illegal firearms, and why it’s so easy for them to put the trigger. The Andrea Harrington and Shirley Sharpton Edgerton types are not the solution to the natural born criminal problem. Just the opposite is true. I propose that every juvenile caught with illegal firearms in his possession be sentenced to his age at the time of his offense/arrest. It probably won’t make him civilized, but it’ll keep the community, including their own, a little bit safer for each one they lock up. That prison recommendation is for only those fine young cannibals in possession of illegal firearms, if they’ve used the firearm in a crime, the sentence should be doubled or tripled. For habitual offenders, just lock them up and throw away the key. If a 13-year-old pistol packing criminal didn’t learn his lesson after being locked up until he turned 26, he’s never going learn his lesson.

Yes. Most POC people had no idea that their lives were so bad until someone told them. They were told that responsible POC needed to be upset even if they did not know why. So they did get upset and it created a huge problem where a much smaller one was before. If POC think all the rioting, YES RIOTING, made their world better, I sure hope they can quantify it. Lots of feel good stuff out there though.

Noticed that there is no posting of the PPD Log today. Wonder if yesterday’s Planet Valenti blogger Police Report’s very informative explanation about Tyer and Wynn’s new “cheat sheet” in how to reword the constant crime to make Pittsfield look Vibrant and Dynamic hit a NERVE. Many other bloggers including myself added to this post. Bottom line Tyer and Wynn were caught in just another huge lie to the taxpayers of Pittsfield, the same taxpayers that pay their hefty salaries. Wonder if they have a dinner date this weekend so they can discuss what is their next maneuvering lie to hide the crime. Probably close down the blog, noticed also that the PPD Traffic Division Twitter has not had a post since way back in 2020. Evidently there have been no traffic accidents since then in Pittsfield. How Vibrant and Dynamic can it get? Wow!

Saw a picture of the Birdy accident the other night in front of the Mission Bar, which we will never hear about as Ricky Rumpus says it didn’t happen. Ironically it shows the Birdy broken on the bike lane right near crumbled pot holed pavement, and the Lenox Ambulance EMT’s were working on the victim. Way to go Pittsfield!

Across the USA wayfair will cut 800-1000 jobs.

Wayfair plans to cut at least 45 (more like 70) jobs in Pittsfield at their call center. They also plan to consolidate their space and ask to be let out of part of their lease. This is true in a number of places. They want to move most operations South for cheaper rent and utilities.

There was talk about shutting the whole thing down but they have tax incentives they have to realize so they want to do the 10 week severance buy down to the newest employees.

Vibrant and dynamic bye bye. So much for 300 jobs. Pittsfield will be luck to even remember Wayfair in two years.

• Timothy J. Shugrue, who is challenging Harrington in the Sept. 6 Democratic primary for Berkshire District Attorney, will attend a Saturday event at the Dalton Fire Department and a chicken dinner fundraiser at the Dalton United Methodist Church.
 Both candidates are expected to attend a forum Wednesday sponsored by the North Adams Democratic City Committee and Massachusetts Democrats.

‘BROKEN WINDOWS’ DEBATE: The Harrington campaign restated its belief late this week that Shugrue misrepresented his position on an issue related to racial justice during a debate Monday at the Berkshire Athenaeum. Shugrue had disavowed supporting the concept of “broken windows” policing.
In a social media post following the debate, Shugrue conceded that he had expressed support for that approach in a media interview.
The Harrington campaign also said Shugrue should have answered a debate question about the state’s 2020 Police Reform Act. He had declined to answer at the time. 
“District Attorney Harrington is calling on Mr. Shugrue to end his shocking pattern of dishonesty regarding racial justice,” the campaign said. In that statement, Harrington added: “Racial justice is the most pressing issue facing the criminal justice system. Mr. Shugrue owes us candor and honesty when it comes to his positions on racial justice.”

A PLEDGE TO ACT ON GUN VIOLENCE: In a campaign statement this week, Shugrue questioned whether Harrington has done enough to curtail gun violence involving minors in Berkshire County. He said he has tallied 16 incidents this year.

“Four years ago, the district attorney eliminated school-based youth educational programs in Berkshire County schools and dismissed every one of the loyal and talented employees in that department. These programs were effective at educating students around making good choices, providing important mentoring opportunities, and identifying resources to help teenagers and their parents,” he said in a statement.
“One of my first acts as District Attorney will be to launch data driven social and emotional learning programs back into the schools,” he said. “It is critical that we support our schools by giving students the knowledge and understanding around critical topics like substance abuse, bullying, healthy relationships, cultural awareness and diversity.”

As an educator these programs were vital to us. And then they were taken away!! These women should not have been let go, Harrington was intimidated by their experience and knowledge. She is not a leader, a true leader surrounds themselves with knowledge and experience. She runs from it because doesn’t have it. She needs to be in the limelight and take all the credit. Tim Shugrue will not do this – he is a leader, a teacher, a mentor. And what a perk, he knows how to try a case! Vote Shugrue!!!

They’re expressing their frustration with Michael Wynn and his refusal to allow them to review Wynn’s official cover-up of the murder of Miquel Estrella. Chair Ellen Maxon said she was highly disappointed and SHOCKED by the revelation that Wynn has denied the POLICE ADVISORY BOARD access to Wynn’s investigation. The fake Police Advisory Board was reconstituted after the PPD gunned down a despondent Daniel Gillis. The fake Police Advisory Board was wrongly under the impression that the board’s existence would somehow prevent another senseless death at the hands of the trigger-happy killer cops of the PPD. I actually agree with Jimmy Ruberto’s endorsement letter in favor of Alf Barbalunga for Sheriff. The people of Berkshire County, including the women inmates sent to Chicopee, should all be treated with care and respect. Alf gave a lot of his time to the community over the years.
I am rooting for the A-Team: Alf & Andrea in the September 6th, 2022, primary election. Berkshire County District Attorney Andrea Harrington is the common peoples best hope for change in the beautiful Berkshires.
I tried to post a parody letter of Mayors Linda Tyer and Jennifer Macksey’s misguided endorsement letter in favor Paul Mark (Marxism), but it must have been too long to be posted on this blog. I believe that the Berkshire state legislative delegation to Boston have failed the people they represent in Western Massachusetts. Beacon Hill lawmakers are sitting on billions upon billions of surplus state dollars, but they didn’t pass any economic stimulus and development legislation with tax relief for low to moderate income residents, including Senior Citizens and Veterans, and they won’t meet again in formal session until after the New Year in 2023.
Please don’t get me started about K Street’s PAC Man Richie Neal (D-Insurance Companies), Maryland Markey (D-More Hot Air), Elizabeth Warren (D-NOT of Main Street), and Joe Biden (D-Record Deficit Spender), who is deficit spending tens of trillions of federal dollars in return for 40-year high U.S. inflation that is sinking millions of commoners into deeper debt with higher interest rates to boot.

Jeanne Kempthorne: I worked with Berkshire District Attorney Andrea Harrington. Here are the 7 biggest reasons I’m not voting for her
In 2018, I supported Andrea Harrington for Berkshire district attorney. In January 2019, she hired me as her chief of appeals. One year later, I quit in protest. I’m supporting Tim Shugrue for district attorney, and I want Berkshire County voters to know why.
I’m a progressive Democrat. I have worked with Progressive Democrats of Massachusetts, the Massachusetts Alliance and the Justice for MA Coalition. I have worked as a prosecutor and a defense lawyer in state and federal court. I accepted Andrea Harrington’s invitation to work for her because I believed she would pursue the progressive values she espoused and that I share. I was wrong.
Before Harrington took office, many experienced prosecutors, deemed insufficiently loyal, were told to leave. Others quit. Among leadership, only the first assistant district attorney and I had experience in government service as prosecutors. Harrington herself had minimal trial experience, no prosecutorial experience and no experience managing a government office.
Instead of hiring experienced, competent people to fill those gaps, Harrington appointed unqualified, inexperienced campaign supporters and friends to fill key positions and relied on “special” assistants from other counties to carry the workload.
On inauguration day in January 2019, Harrington’s immediate tasks were clear: Triage the emergencies and glue herself to the chair to learn the job; right the foundering ship; provide leadership and improve morale; hire and train assistant prosecutors; build a team committed to a new vision of criminal justice; implement the no-cash-bail policy; begin work on juvenile and adult diversion policies and programs.
That is not what happened. Rather than immerse herself in the nitty-gritty of her new job, she went on vacation and then on a boondoggle to tour Portugal’s drug-treatment program. Leadership meetings focused as much on enemies and the press as on the difficult challenges the office faced in accomplishing its mission. Huge amounts of energy were spent figuring out how to keep her patronage hires out of trouble.

Berkshire district attorney tried to unseat a judge she called a public safety ‘threat.’ Her bid failed.
Several of Harrington’s more appalling acts of unprofessionalism and lack of judgment have been reported, such as her indictment of two foster parents for manslaughter and her preposterous attempt to have Judge Jennifer Tyne removed from hearing criminal cases in Berkshire County. Less well known are her failures to implement the kinds of criminal justice reforms she touts and her mistreatment of staff:
• In July 2019, the American Civil Liberties Union urged her to support a moratorium on the use of facial recognition software while more research was done to determine its impact on racial profiling. (By 2018, reported data had shown that the software misidentifies Black female faces 35 percent of the time.) After consulting with the State Police, Harrington refused.
• When Harrington unveiled to great fanfare a juvenile diversion program on the steps of the Boys & Girls Club of the Berkshires in 2019, the program was far from ready. For months, Harrington had delegated the program design to her former campaign manager who had no skills, training or experience in juvenile justice. (A draft provision calling for restitution from juveniles was laughable.) Months were spent reworking it. Harrington herself provided little guidance. From the outset, the program was seriously understaffed: one part-time employee, still in school and with minimal professional experience. Urgent complaints from community program providers and the juvenile court probation office were frequent. Within months, overwhelmed, the staffer left.
• Harrington delegated the development and leadership of the domestic violence fatality task force to her former campaign manager, who had no legal qualifications for such a post.
• After Judge Tyne struck the testimony of a “drug recognition expert” in an operating-under-the-influence case, Harrington did not issue a clear policy against the use of DRE evidence, despite its lack of scientific foundation.
• While Harrington did indeed adopt and implement a no-cash-bail policy, the use of dangerousness hearings to hold defendants pretrial has gone up dramatically.
• Harrington has not only favored political associates and personal friends over experienced professionals, she has treated many employees, particularly women over the age of 50, very badly, firing or demoting people without warning or performance improvement plans.
• In 2020, WGBH in Boston awarded Harrington one of its sarcastic “Muzzle Awards” for her ignoble actions undermining free speech by instructing the office’s records officer — me — not to produce required public records to The Berkshire Eagle. In protest, I resigned. Within days, I was approached by the Suffolk DA’s Office, headed by the progressive Rachael Rollins, and eventually served in that office’s new integrity review bureau, reviewing past murder convictions for miscarriages of justice.
Unlike larger counties, the Berkshire District Attorney’s Office is too small to support a neophyte DA who cannot competently try a felony criminal case and is unwilling to roll up her sleeves to implement major policy changes effectively. The citizens of Berkshire County cannot afford to indulge the extravagant delusions of a careerist. Harrington simply does not have the necessary skills and experience for the job and she has demonstrated little, if any, interest in acquiring them.
Experience, competence and integrity matter. Tim Shugrue understands how the criminal justice system works — and how it fails. He is someone the staff can turn to for advice and leadership without fear of retribution. He has the confidence of his colleagues in the legal community and the courts. He has the best interests of the people of Berkshire County at heart — not his own. He deserves your vote.

Short response (always the better one): Taking a job that is a poor fit, as in you are not up to the responsibility or the office is not up to yours, is unprofessional, extraordinarily so for someone practicing law..

Furthermore, her accusations (eg “[X] was a campaign manager not qualified”) do not make logical argument. Proof? Why not qualified? Any fact beyond the subjective and emotional pertaining here? This letter does not do her any professional benefit. I’m not certain I’d hire her as my lawyer.

Sometimes you take the job because it has promise, Nipples talked a good game because no one challenged her, she got a pass and the Democrats were all with her.

I don’t fault Jeanne for taking the job, she saw how bad it was and left. That takes courage and integrity.

The campaign manager was Hellen Moon, I completely agree she was unqualified for every position she was given, just as Andrea is unqualified the position she was gifted by the Democrats.

No. You absolutely do not take a job if you see lack of professionalism in the leadership and administration. There is zero potential for ‘promise’ in those situations. You don’t even do that if you are breaking into a field completely green. If you do, you will end up fired, in ethical trouble, or at the very least having learnt the worst practices which a future employer will have to resolve.

I find the letter to be objectively unbecoming and inappropriate for an ex employee to write of her past employer. I would have written a completely different letter were I somehow in her shoes. If I had specific complaints that were substantiated beyond the confines of my head, I may have said, “The DA has ethical complaints. For example there is a case [XYZ] pending against her in State Court” Not: the DA hired a person wholly unfit fo the job.” That is manipulative language.

I agree with everything said about AH. I also believe that Alf’s campaign should make clear that he will be the same kind of leader. They are teaming up, they are a pair, a duo, cut from the same cloth. Just look at the multicultural Bridge forum this coming Monday – they made sure the dates were clear for these 2 candidates and also made sure Shugrue and Bowler couldn’t make it. Now Alf is jumping on the bandwagon. One would think that teaming up with AH would kill him. Oh that’s right, he’s not committing! I guess a few thousand dollars in donations to her campaign is non-commital. Alf is part of her same regime, led by cousins Ruberto & Massimiano and good friend Cliffy Nilan. Mark my words you will regret voting for him sooner than you did for AH!

I agree with the message and content. We don’t dispute this. My dispute is that I think there is something very wrong about how this letter is written. I think it is unprofessional and unethical. In this case, for me it’s shoot the messenger and the sender both (two political animals who parted ways in conflict).

Jeanne is uniquely qualified to know who is qualified for these jobs, she’s worked in government, overseen dozens of employees, and is adult enough to recognize incompetence when she sees it. How you would write something doesn’t matter because you aren’t a lawyer, never been the head of the ma ethics board, and haven’t worked as an ADA or DA.
She has, as to the ethics of her letter, her judgement supersedes yours any day of the week and twice on Sunday.

Of course, we agree on the substance. DA Harrington is a catastrophe and thoroughly rotten DA. I knew that without having to work with her and promote her malevolence for a year. Why did she resign? Did she hear a Voice one night like Howard Beal? “Why now? Because you are working for the wrong DA, dummy!” Did she get a warning from a prospective employer? What is not said is also important. I say people working for employers under the pretense that ‘the fault of the director is not the fault of mine’ were and are part of the problem.

I knew Harrington was a horrible prospect well before Guernsey, Moon, and the rest of the progressives determined that it is now safe to ditch her. Harrington is not the point. The author reveals a lot about herself that deserves a closer.

In 2018, I supported Andrea Harrington for Berkshire district attorney. In January 2019, she hired me as her chief of appeals. One year later, I quit in protest. I’m supporting Tim Shugrue for district attorney, and I want Berkshire County voters to know why.
I’m a progressive Democrat. I have worked with Progressive Democrats of Massachusetts, the Massachusetts Alliance and the Justice for MA Coalition. I have worked as a prosecutor and a defense lawyer in state and federal court. I accepted Andrea Harrington’s invitation to work for her because I believed she would pursue the progressive values she espoused and that I share. I was wrong.

Before Harrington took office, many experienced prosecutors, deemed insufficiently loyal, were told to leave. Others quit. Among leadership, only the first assistant district attorney and I had experience in government service as prosecutors. Harrington herself had minimal trial experience, no prosecutorial experience and no experience managing a government office.
Instead of hiring experienced, competent people to fill those gaps, Harrington appointed unqualified, inexperienced campaign supporters and friends to fill key positions and relied on “special” assistants from other counties to carry the workload.
On inauguration day in January 2019, Harrington’s immediate tasks were clear: Triage the emergencies and glue herself to the chair to learn the job; right the foundering ship; provide leadership and improve morale; hire and train assistant prosecutors; build a team committed to a new vision of criminal justice; implement the no-cash-bail policy; begin work on juvenile and adult diversion policies and programs.
That is not what happened. Rather than immerse herself in the nitty-gritty of her new job, she went on vacation and then on a boondoggle to tour Portugal’s drug-treatment program. Leadership meetings focused as much on enemies and the press as on the difficult challenges the office faced in accomplishing its mission. Huge amounts of energy were spent figuring out how to keep her patronage hires out of trouble.

LOCAL NEWS
Berkshire district attorney tried to unseat a judge she called a public safety ‘threat.’ Her bid failed.Several of Harrington’s more appalling acts of unprofessionalism and lack of judgment have been reported, such as her indictment of two foster parents for manslaughter and her preposterous attempt to have Judge Jennifer Tyne removed from hearing criminal cases in Berkshire County. Less well known are her failures to implement the kinds of criminal justice reforms she touts and her mistreatment of staff:

• In July 2019, the American Civil Liberties Union urged her to support a moratorium on the use of facial recognition software while more research was done to determine its impact on racial profiling. (By 2018, reported data had shown that the software misidentifies Black female faces 35 percent of the time.) After consulting with the State Police, Harrington refused.
• When Harrington unveiled to great fanfare a juvenile diversion program on the steps of the Boys & Girls Club of the Berkshires in 2019, the program was far from ready. For months, Harrington had delegated the program design to her former campaign manager who had no skills, training or experience in juvenile justice. (A draft provision calling for restitution from juveniles was laughable.) Months were spent reworking it. Harrington herself provided little guidance. From the outset, the program was seriously understaffed: one part-time employee, still in school and with minimal professional experience. Urgent complaints from community program providers and the juvenile court probation office were frequent. Within months, overwhelmed, the staffer left.
• Harrington delegated the development and leadership of the domestic violence fatality task force to her former campaign manager, who had no legal qualifications for such a post.
• After Judge Tyne struck the testimony of a “drug recognition expert” in an operating-under-the-influence case, Harrington did not issue a clear policy against the use of DRE evidence, despite its lack of scientific foundation.
• While Harrington did indeed adopt and implement a no-cash-bail policy, the use of dangerousness hearings to hold defendants pretrial has gone up dramatically.

• Harrington has not only favored political associates and personal friends over experienced professionals, she has treated many employees, particularly women over the age of 50, very badly, firing or demoting people without warning or performance improvement plans.
• In 2020, WGBH in Boston awarded Harrington one of its sarcastic “Muzzle Awards” for her ignoble actions undermining free speech by instructing the office’s records officer — me — not to produce required public records to The Berkshire Eagle. In protest, I resigned. Within days, I was approached by the Suffolk DA’s Office, headed by the progressive Rachael Rollins, and eventually served in that office’s new integrity review bureau, reviewing past murder convictions for miscarriages of justice.
Unlike larger counties, the Berkshire District Attorney’s Office is too small to support a neophyte DA who cannot competently try a felony criminal case and is unwilling to roll up her sleeves to implement major policy changes effectively. The citizens of Berkshire County cannot afford to indulge the extravagant delusions of a careerist. Harrington simply does not have the necessary skills and experience for the job and she has demonstrated little, if any, interest in acquiring them.
Experience, competence and integrity matter. Tim Shugrue understands how the criminal justice system works — and how it fails. He is someone the staff can turn to for advice and leadership without fear of retribution. He has the confidence of his colleagues in the legal community and the courts. He has the best interests of the people of Berkshire County at heart — not his own. He deserves your vote.

Also included in this office full of political favors was Conflict Dina Guiel Lampiasi. She was hired as an administrative assistant who realized how much work she had to do. AH then created a new HR job for her. What it really became was a spy who walked around the office looking for those who didn’t like AH. She and Moon reported any troublemakers back to their inept leader, who was in her office polishing her pleather skirt and cowboy boots.

Public records violations are so common that they often don’t get the attention they deserve. Yet the principle that government should be transparent is an important one. If we don’t know what our representatives are up to, then the idea that we live in a self-governing democracy is meaningless. Unfortunately, the Massachusetts public records law is so weak that officials violate it with impunity — even though the law was strengthened slightly several years ago.

Some incidents, though, are so egregious that they warrant special mention — which is how Berkshire County District Attorney Andrea Harrington earned herself a Muzzle.

Last December, The Berkshire Eagle filed a public records request about a student at Bard College at Simon’s Rock who said she’d been racially attacked. Following an investigation, her claim was found to have been a hoax. Harrington’s office declined to provide the records.

What happened next was truly startling. Harrington’s public records officer, Jeanne Kempthorne, resigned and blew the whistle on the DA, telling the Eagle, “It was the straw that broke the camel’s back. My concern is that what she [Harrington] did was not in the public’s interest; it was in her interest. This isn’t a private company, and it’s not her campaign. There are bigger considerations — are we actually going to fulfill our public duties?” For good measure, Kempthrone gave the Eagle redacted copies of the records it had sought.

Harrington’s office denied that anything untoward had taken place. But the law requires law enforcement agencies to release records once an investigation has concluded, as was the case with the Bard incident.

“When officials abuse the investigatory exemption of the public records law, they prevent us from learning if justice is being served in our communities,” said Justin Silverman, executive director of the New England First Amendment Coalition, in an interview with the Eagle.

So Ellen Maxon of the Police Advisory Committee is irate about not being able to view the report on Miggy. What was her useless committee going to do if they disagreed with the outcome? Meanwhile, I would suggest the Police Advisory Committee make themselves useful for once and investigate why the Mayor and the Chief of Police are altering and covering up the facts of crime in Pittsfield. This maneuver by Tyer and Wynn is almost as bad as DA Nipples not prosecuting crime. It is like the 3 Stooges working to make Pittsfield as unsafe as possible.

Wish Karen would toss a comment about it. Or Pete White who usually likes to chat about stuff going on in the city.
But if the mayor feels like she has to hide rather mundane things like traffic accidents, then what else might she be afraid might become public if someone starts poking around? She sure seems nervous about what gets in the news doesn’t she?

At the 711 next to NYU workers say they get robbed at least 4 times a day even assaulted at times. They had to lock their refrigerators due to the theft. They used to call police but thanks to progressive prosecutors cops are unable to help so they stopped calling.

No wonder the mayor is shutting down the news outlets. Holy shit man. Those statistics kinda refute Barrys claim that he feels safe walking around bare ass in the early hours of the morning.

You would think the business community would get on the mayors butt about this instead of encouraging her to hide it because that will not make it go away. Perhaps if you are an outside inverter you don’t give a shit but…. Is she trying to bury it as best she can till she finishes her term and hightails it to the bottom of a different mountain in a different place? Maybe one that is a mile high?
