———- ooo ———-

(FORTRESS OF SOLITUDE, THE WEEKEND EDITION SEPT. 2, 2022) — On July 11, approximately three days into her sentence,  a 46-year-old Pittsfield woman died in custody at Chicopee’s regional lockup for women. There’s where Berkshire County sends its female population, which presently numbers between 12 and 14.

Shortly after, candidate for sheriff Alf Barbalunga blasted Berkshire County sheriff Tom Bowler, saying the woman’s death “is part of a pattern of what happens to Berkshire County residents who find themselves in state or county jails.” Barbalunga said that “on average, every 10 months there has been either a death or an escape” under Bowler’s supervision.

Bowler excoriated Barbalunga for using “a family tragedy as fodder for his political purposes.” Bowler said Barbalunga failed to mention that  “[t]his woman died from natural causes.” Bowler said “The medical examiner ruled that her death was the result of natural causes due to a pre-existing condition.” Hamden County Sheriff Nick Cocchi concurred. “Natural causes.”

But did she die from natural causes? This question has haunted the campaign since it first emerged in July and exploded during the August debate THE PLANET hosted between Barbalunga and Bowler.

———- ooo ———-

THE PLANET obtained a copy of the death certificate, signed by Boston Dr. Irini A. Scordi-Bello. It lists the immediate cause cause of death as “PENDING.” The form also has this: “Manner of Death: PENDING INVESTIGATION.”

Our questions:

  • Has such an investigation been conducted?
  • If so, by whom and has it been released? (If it has, we missed it)
  • If not why not?

Death to “natural causes?” If so, why does the death certificate say that the manner of death is under investigation.

—————————————————————–

SIDEBAR (FROM WBUR)

Hampden County Jail

Current sheriff: Nicholas Cocchi

Total deaths 2008-2018: 22

22

Average inmate population (2018): 1,165

——————————————————————

A WBUR investigation by Christine Willmsen and Beth Healy found that from 2008 to 2018, 195 people died in custody of Massachusetts’ sheriffs. WBUR said gathering that information (including cause of death) proved extraordinarily difficult.

“Jails are perhaps the least accountable part of government in the United States,” said David Fathi, director of the ACLU National Prison Project. “When you combine that lack of transparency, that lack of oversight, with a marginalized, unpopular captive population, it’s a recipe for neglect and mistreatment.”

The WBUR probe mentioned the case of an inmate in Worcester County who died “in agony” of a treatable type of meningitis after jail staff ignored his complaints. The sheriff’s report said the death came from “natural causes.”

Sound familiar?

So what, if anything, is being covered up in the Pittsfield woman’s death?

——————————————————————-

——————————————————————–

The investigation found that “when people suffered from dire medical conditions in Massachusetts county jails, they were often ignored or mistrusted, with fatal consequences. The sheriffs … responsible for inmate health care face little oversight, and often have withheld the circumstances of these deaths from the public — even from inmates’ families.”

Is that what is happening in the Pittsfield case?

———- ooo ———-

Where’s the report?

From the WBUR investigation:

“The federal Death in Custody Reporting Act requires the government to collect data on the more than 1,000 inmates who die every year in American jails. Sheriffs have been required to file a form called a CJ-9, which provides the inmate’s name, age, race, cause of death and other information.

So where’s the report on the death of the Pittsfield woman?

According to WBUR, “compliance by the roughly 3,000 U.S. jails has been voluntary. The DOJ’s Bureau of Justice Statistics … has no enforcement teeth. The result is that an unknown number of deaths go uncounted, and since 2014, reports have been years late.”

Voluntary reports.

Delivered late, if at all.

Written up, according to one lawyer quoted in the report, to be “all self-congratulatory.”

Did negligence occur in the Pittsfield woman’s death? The public in Berkshire and Hampden counties, to say nothing of the woman’s family, deserve a full report.

Have a great weekend, everybody.

Name one M-E’s report that came back within months, it doesn’t happen! Even her own family has said this is a witch hunt disgraced into scandal by Barbalunga. An easier report to find is the Barbalunga north Adam’s invest he said during the NAACP debate he said he’d let more light on as the summer goes but has not said a word as of yet.

It is disgusting that this unfortunate death is still getting press! Goes to prove that there is no respect for people anymore. Hasn’t her family suffered enough. Her family is not going to the press and blogs to have her death debated. Miggy’s family does go to the press and that is their choice. Once again It is not the choice of her family. Barbalunga and all OTHERS that continued to turn her death into a disrespectful trash talking conversation are doing nothing but inflating their gross egos to the point of being evil. Shameful to all that continue to trash her death over and over. Hope nothing like her death ever happens in their family, but then again people that own this type of disrespectful mind could care less who they harm.

There are so MANY other issues that should be written about and discussed!! Time to end this crap!

Why is asking about the death disrespectful? The number of deaths in custody seems very, very high. It’s a question of public service and apologies to the family but there are more important things at stake.

Pending cause and manner of death
After our examination of the deceased, the cause of death may not be immediately apparent.

The medical examiner may require more testing, such as toxicology. The medical examiner may also request additional information, such as medical records or police reports.

The additional testing will not delay the deceased’s release from our office.

A death certificate will still be filed, but the cause of death will be listed as pending.

Questions are always good, but why are they so concerned now? Where was the concern from Alf and friends prior to announcing a run for sheriff about the deaths of the incarcerated happening? That’s the problem, do people really care or do they only care now? These people could have been bringing more attention to the issue long ago. I don’t believe for one minute this just came into view for Alf.

Understanding your point on the dates. What I’m also saying is ,that even prior to the death and campaign began where was Alf’s and others concern about all incarceration deaths? He is in contact with people in the know about these things since he mentions it himself as head of probation in south county.

I think the issue here is the secrecy in general. Is this any different than what happens in hospitals or assisted living? Natural causes or negligence often kinda look the same, just like an election recount will give you the same number even if someone voted twice using another identity. They look at the result, not the cause. Wonder who does the investigation now???

Alf is here to unseat Bower. He has the cajones to throw around the allegations. Alf may be a thug, but Bower is thug for certain. Maybe we do a AH and get rid of Bower and then get rid of Alf? It might take a couple of flushes to get rid of big turds.

Pittsfield city clerk affirms integrity of elections after a candidate flags risk of fraud

PITTSFIELD — The city clerk issued a statement Thursday refuting a sheriff candidate’s claims about elections.
A post was published Wednesday on the official campaign Facebook page of Alfred E. “Alf” Barbalunga, a candidate for Berkshire County sheriff. It contained allegations about the integrity of the elections process in Pittsfield.
City Clerk Michele Benjamin said Thursday that she viewed statements in the post as “irresponsible” and “false.”

Barbalunga’s post has since been deleted.
Benjamin did not identify by name the politician who made the post she was responding to in her statement.

In a since-deleted Facebook post, candidate for sheriff, Alfred E. “Alf” Barbalunga, claimed the state was “watching” the sheriff and DA races following “multiple complaints of voter fraud. The Pittsfield city clerk categorically denied the claim.
According to a screenshot, Barbalunga’s post opened with a statement in capital letters proclaiming the message a “notice.”
It then made claims about voting that Benjamin, in her statement, said were false, including that the Elections Division of the Secretary of the Commonwealth is “watching” the DA and sheriff races “due to a lawsuit and multiple complaints of voter fraud …”
“There’s no truth to the post whatsoever, and the state Elections Division confirmed that,” Benjamin told The Eagle in an interview Thursday.
Barbalunga, when asked for comment, said in a text message from a campaign event, that he’s “not familiar with the post.” He said his team is going to send additional information soon.
Benjamin, the longtime city clerk whose office oversees elections in the city, said she confirmed with the state there “have been no confirmed reports of violations of election laws by election officials in Pittsfield.”

She said the state division is “not party to or privy to any lawsuit regarding any elections in Pittsfield and they did not receive ‘multiple complaints of voter fraud’ in Pittsfield in 2019,” as Barbalunga claimed.

She added that state elections officials are “not ‘watching’ the contests in the Berkshires because of issues in Pittsfield in 2019 and they are not ‘watching’ the elections in the Berkshires any differently than” those in other parts of the state.
In 2020, the husband of Pittsfield Mayor Linda M. Tyer sued her challenger in the 2019 election after the challenger suggested he tampered with ballots.
That allegation by Melissa Mazzeo, Tyer’s challenger in the Nov. 5, 2019, election, was investigated by the state Elections Division, which found it to be baseless.

Mazzeo had claimed that a recount was needed because of “significant concerns my campaign has about the integrity of the election here in Pittsfield.”
The recount affirmed the original result.
Benjamin said that process showed the city’s ability to conduct a fair and accurate election.
“I feel that we proved ourselves by the recount in 2019 that these are fair elections for all candidates,” she told The Eagle.
The city complies with all state and federal election laws and “every person involved in the election has taken to heart the oath they have sworn to uphold the laws of the Commonwealth of Massachusetts,” she said.
“Elections in Pittsfield are honestly and fairly held for all candidates,” Benjamin said in her statement. “The City of Pittsfield and the Secretary of the Commonwealth take violations of election law very seriously and encourage anyone with concerns to bring it to our attention.”

Benjamin said elections officials “confirmed to me that the post was not accurate, and they communicated that to the person who posted the statement.”
“It’s disheartening that people can make [a] false accusation,” the city clerk said.
The primary is Sept. 6 and early voting has begun. There are county elections and state
elections on the ballot.

You can’t fault Barry “vigilante” Tyer, for getting lost in Pittsfield City Hall. He probably worked a few late night Cumby’s parking lot patrol shifts. He was probably tired.

Barry thought he found an exit door to leave city hall for the night. Instead, the door he thought was an exit, actually led him to where they were counting ballots during the last mayoral election.

It’s an honest mistake. How could one honestly expect Barry, being a former city councilor and wife to the current mayor, not know his way around city hall?

I don’t get it, the State investigated Mazzeos complaints, and they now claim they aren’t aware of multiple complaints in 2019? What? Didn’t they investigate them?? I don’t think the State actually pays attention to any election.

Dan, pending usually means awaiting further testing, such as toxicology screens, or perhaps the ME has send out tissues for a more expert analysis, or is consulting certain experts. The death certificate is amended in all these cases, down the road. So, there will be, or should be, another one. And the ME officer won’t even release a death certificate to the police. Only the DA gets them. Hope this helps.

And that is if they even do one. They often just run toxicology reports based on blood draws, and look at the body and the police reports. In other words they do tnot even dissect the bodies much of the time.

They take about a year to get unless homicide and sometimes the DA does not even give them to the police. I have seen that happen, even in a homicide. It’s like pulling teeth. If it’s a murder you might get it in like several weeks, maybe months. And just because an ME says it’s a suicide doesn’t mean it was. Plenty of people get away with murder and one of the sure fire ways is to have a homicide written off as an accident, suicide, or “natural causes”. It all happens.

Here’s another similarity she tends to forget…

Both men were belligerent, violent, heavily under the influence of alcohol and ran at police officers with knives.

Many people are confronted by police during mental health meltdowns, they aren’t all killed. You know why? They don’t try to attack gun wielding police officers with knives

I know everyone says, ” just take the knife away” or “it’s only a knife” but anyone with self defense training will tell you RUN AWAY FROM A KNIFE, even a small 1″ blade can cut a person up horribly and possibly kill them. They are nothing to sniff at.

Odds of death are greater if you charge. Run away, and you make it harder to be hit, and you decrease odds the other will shoot. and if hit, odds of dying are halved.

The Pittsfield Police Advisory Board had a mass resignation because Mayor Linda Tyer’s administration’s legal counsel ruled that the board would not be able to review the PPD’s internal investigation in its deadly use of force against the intoxicated and self-harming young man with a knife whose name was Miguel Estrella who had a well-known history of mental illness. While I do not disagree with the city and Berkshire County D.A. Andrea Harrington’s affirming reports that the deadly use of force was justified, I strongly disagree with the PPD’s finding that on the night of the incident that took the young man’s life, that Miguel Estrella was not a person in distress under the law. To me, that is like saying the 2 + 2 = 5 or that Pigs have Wings and Fly around Unicorns in Fields full of Toys made by Santa’s Elves before Christmas. How on Earth could Mayor Linda Tyer and D.A. Andrea Harrington rationally affirm the PPD’s report that Miguel Estrella was not a person in distress under the law on the night of his death at the hands of the Pittsfield Police Department? I am disappointed in both of the women politicians: Mayor Linda Tyer & D.A. Andrea Harrington.

The plum post of Berkshire County Sheriff is nothing more than a no-show position for a politically connected Democratic insider hack. That is why Carmen Massimiano sat on his fat ass for 30 years. That is why Dan Bosley wanted to sit on his fat ass as a would-be Sheriff in order for him to have doubled his state pension. That is why Tom Bowler is sitting on his fat ass. That is why Alf Barbalunga wants to sit on his fat ass, too. Nobody wants to end up in the county jail no matter who you are. The no-show Sheriffs’ lack of oversight of inmates’ deaths is due to the fact that they all sit on their fat asses and collect their huge public pay plus perks for doing nothing for many years until they get to collect their huge public pension plus perks.

JM I’m going to try to explain to you Miggy situation, so you will understand.

Miggy was armed with a large knife (deadly weapon). For a police officer, this now has become a potential deadly force encounter. A deadly force encounter will supersede (take precedence) over any mental health issues a person might be suffering at the time. He advanced on the officers for over 30 yards, ignored verbal commands, and paid the price. Miggy forced the action. End of story.

If you had paid attention during combat training for the couple of weeks you were in the Army, you probably would have learned this. Or were you in sick call during that time?

Also, what is your fascination with Carmen, the former sheriff? He’s been dead for a few years now, yet you bring him up like he still runs BCHC. You seem to have another unhealthy obsession with him too. Did he not fondle you at camp like the other boys and you feel left out?

Then again even the city clerk has called Alf irresponsible.

I don’t doubt for one second that the Planeteer who announced his/her intention to vote multiple times was joking. It was a joke! But there are genuine concerns of the alleged abuse of unverified mail-in ballots from more than just a handful of conspiratorial voter fraud fruitcakes. It’s easier to believe that Barbulunga was ordered to back away from the subject of voter fraud, not because it isn’t a very real threat to the integrity of voting, but because it actually is a very real threat to the integrity of voting. I’m not fruitcake, and I don’t have any trust in the integrity of allegedly fair and free elections. I could easily believe that the very last thing Elections Division would want is if voters really knew the truth about the integrity of elections. I know there are incidents where citizens have gone to vote in an election, only to be informed that they’ve already voted, when, in fact, they had not.

Mark Atlas, of Worchester, Massachusetts, was charged in 2013 with voter fraud for voting under someone else’s name. Although Atlas’ attorney claimed it was just a prank, he admitted to sufficient facts for a guilty finding. The charge was continued without a finding for one year, and Atlas was ordered to pay $1000 in court costs, as well as serve 200 hours of community service.

I was always fascinated about the stories of Kevin Sherman’s uncles ability to get “a thousand votes for candidates with his endorsement” Now he is buddies with Alfie so I am wondering if the same story holds true. These stories of getting the backing of certain families in Pittsfield is the only way to win makes me think that the state should come in and clean out our election board and system, seems corrupt unless you think Pittsfield voters are a bunch of sheep that do as they are told with no intelligent thought in their heads. If this is what you believe then there is no need for a school system at all. Very puzzling

Big news Dan. Barbalubga campaign copied my post from this blog a few days ago where in I pointed out how I could vote mutilple times (because there is no ID required), and that a vote for bowler and Shugrue was a vote against Harrington and Barby, and therefore 4 votes, and so his campaign issued a NOTICE TO THE PUBLIC on Facebook, about voter fraud effuckingcetera. Seriously?????

He also called and reported my blogpost to the secretary of commonwealth. Wow! For the record Alffie Boy, I did vote 4 times – for bowler, against you, for Shugrue, and against Harrington. As I wrote in the original post, 2+2=4, and I wrote that even Harrington knew that. I assumed you already did. Well, now you know too. I mailed my vote in a few days back and I will not be voting any more times than that. Even if I wanted to, (and someone could do it, since ID is ludicrously not required) i will not go to the polls. Pittsfield is too unsafe. I could get robbed. But don’t worry Alffie. You will not have the election stolen out from under you, you will loose fair and square, despite your dirty pool.

City clerk knocked him into next month. He deleted it and proclaimed he never knew it was posted. What integrity.

I don’t t know where it originated but back in the day, when I hung out with a guy named Bud Weiser, we was in The Crossroads and I was shooting pool. Can’t recall if I was playing or someone else was her opponent, but a woman ran the table. She was pretty hot looking too but I was more impressed with the way she was banging balls in the corner pocket (not to be confused with banging in the corner office, which I also have know of). A guy turned to me and said “you show me a women who can shoot pool, and I’ll show you a dirty house”. It’s funny what we remember. It always stuck with me, and that was decades ago.

Everyone knew exactly what you meant. No ID means you can walk into any polling precinct and say a name and address and vote. You can ask for provisional ballots without any ID.
You can’t check a library book out without ID but you can vote for the leader of the country without ID.

It shows exactly how slimy Alf is to
1) Raise that to an official complaint (and he did absolutely call that in)
2) Concoct a notice to the public on his Facebook page (he helped write it). There was an entire strategy session on it.

Worse still is that this family of the dead inmate refuted this bogus story, run again by Dan (for what reason is unknown but it does seem like interference for Alf’s campaign)

“ Pratt’s father told The Eagle his daughter’s death was the fault of no one, and said he did not like that it became a political issue.”

Jaime Lynn Pratt’s death last week came to light after a challenger for Berkshire County sheriff, Alfred E. “Alf” Barbalunga, announced Monday that a woman died while in custody at the Western Massachusetts Regional Women’s Correctional Center in Chicopee.

Jail officials and Pratt’s father attributed her death to natural causes. But Barbalunga alleged her death was part of “a pattern of what happens to Berkshire residents who find themselves in state or county jails,” a claim that prompted swift rebuttal from incumbent Sheriff Thomas Bowler and his counterpart in Hampden County.

Alf you are a disgusting little man with zero integrity and not enough brains to know when you need to just be grateful for the jobs your father bought for you.

I make you this promise Alf, after you lose the election for Sheriff, and after Shugrue gets elected DA. I will make it part of my life’s mission to legally bring forward to the DA the details of your behavior as a court employee in North Adams and bring forward sworn affidavits from probationers and their family members (including three women that will have have plenty to say).
When done you won’t just be out of a job, you will hopefully be in jail and under the supervision of the person you are running against. Your dad will not be able to make this go away by buying or bullying your way to freedom.

I have never seen Dan run interference for a candidate like he has for Alf.

A pending report only means that all the toxicology hasn’t come back and the report will be amended as such. A common example would be death by myocardial infarction, that would be a normal diagnosis but they’d wait for toxicology to make sure the contributing cause wasn’t the presence of cocaine. Which would change the entire diagnosis.

This blog runs the gamut of truth and honesty and lies and innuendo in the name of “free speech” but I’ve noticed recently that people have complained about edited posts or missing posts and most are related to Alf somehow. I’ve read posts by Dan with a large slant towards Alf, saying Alf was winning in debates, when clearly he wasn’t.
Dan you can endorse a candidate, it won’t matter to us but at least be honest about it.
Don’t edit posts to favor your candidate, don’t slat your “reporting”, just come outright and endorse Alf. We will probably and collectively think a little less of you but only for a couple days. You are doing damage to your lifetime credibility by this underhanded version of bias in editing and articles.

Yes it seems that if the narrative fits the slant of the board and Dan, it runs full tilt.
Where is the employee report promised? The story should have highlighted that Alf has refused to release his employee discipline findings.

The story should have been how Alf just got “bitch slapped” and called irresponsible by the Pittsfield City.
We all know what happened, Alf was making his own news.
He read a stupid comment on here that was clearly a joke, escalated it to a complaint and called Galvin’s office.
He coordinated the posting of the Facebook post because he wanted one more fabricated event and to be out in front of the news, and got caught with his pants down, again.
Dan you get press release, why not run that story? The press release from the city clerk? Any mid day breaking updates about the press release?

“There’s no truth to the post whatsoever, and the state Elections Division confirmed that,” Benjamin told The Eagle in an interview Thursday.

Alf is responsible for his campaign, there isn’t a chance in hell some low level volunteer posted that post without approval. It wasn’t an “overheard” conversation, it was a fabricated post by Alf, I know this because I know two of the people working on his campaign. Jonalee is working those releases directly with Alf.

Alf you’ve lied and cheated your whole life, man up and take responsibility for the things you do.

And shame on Dan for dragging this dead woman through the mud again. Making her family have to see this BS again. So disgusting, all to support the man child Alf.

You say you are supporting a candidate but the bias for Alf is so strong, it’s pathetic and transparent as to what you are doing.

This would apply to the Turnip’s speech yesterday……

In 1943 the following directive was issued to all party members from communist headquarters in the US, when certain obstructionists become to irritating, label them after a suitable buildup as fascists or Nazis or anti-Semitics, and use the prestige of anti-fascist tolerant organizations to discredit them, in the public mind associate those who oppose us those names who already have a bad smell, the association will after enough repetitions, become fact in the public mind

The Turnip’s handler’s are big Alinsky fans. Read any of Rules for Radicals?

The organizers first job is to create the issues or problems, and organizations must be based on many issues. The organizer must first rub raw the resentments of the people of the community; fan the latent hostilities of many of the people to the point of overt expression. He must search out controversy and issues, rather than avoid them, for unless there is controversy people are not concerned enough to act. . . . An organizer must stir up dissatisfaction and discontent.

True revolutionaries do not flaunt their radicalism. They cut their hair, put on suits and infiltrate the system from within.

The despair is there; now it’s up to us to go in and rub raw the sores of discontent, galvanize them for radical social change.

Ridicule is man’s most potent weapon. It is almost impossible to counterattack ridicule. Also it infuriates the opposition, who then react to your advantage.

He constantly screams about racism with Bowler, and he constantly brought up Jason Cuyler. What people don’t know is that after the library debate Jason not only was showing his support for Bowler in the audience, but he hugged him afterwards.

the only POC’s that are whining about racism are former drug dealers like Kelvin something on FB who is clearly just bitter that he wasn’t promoted. I understand your points. But our paper of record is a complete propaganda machine. The Eagle almost never correct the record, and they have a few good reporters. The water conservancy guy who is trying to get his actual quotes/facts out about the Housatonic cleanup has said this too (forgot his name). The Beagle knowingly manipulates regular people by printing things that aren’t fact checked or have intentional bias for the ‘business’ community they are tight with. It’s been at least ten 10 years of brown, shitty water in Housatonic – how many investigative articles on this? Not many. Martin was/is the lawyer for the water company. A reporter could walk to his office from their office at little expense to get on the record, The Eagle never ask the right questions. The byproduct of Dan’s blog is that occasionally you see a glimmer of truth seen nowhere else.
For me, can’t stand either sheriff. I believe this is the resting place of bad law enforcement and think jM was on the money of them all sitting on their asses. Luckily, I have little involvement with any of them.

What isn’t normal is how Biden and the far left are destroying our country while trying to put the blame on Trump and his supporters. What is not reported. A 15′ satan was on route to be installed at the back, a dark menacing reminder that Satan now runs the show. In fact,
the statute was just a magnified version of a dungeon dragon piece. APMRF engineering corps located the satanic idol hours before it was to be deployed. Ten tons of bronzed epoxy and blew up the container with two well placed rounds. A horn embedded in a UPS truck. It burned 7 hours! There is a section on PA Ave now taped off as slip hazard. APMRF, as you know, will not let satanic ‘art’ stand. Bad art is satanic art – a desecration of form and nature.

I am surprised the ‘marines’ (more likely actors on loan as all actors are satanic too) weren’t outfitted with glowing eyes.

I agree with about those actors. Being an old oater fan I used to write scripts for western movies and True Grit was one of them. I was going over some word changes with John Wayne one afternoon when he insisted I change my phrasing of “put down that gun cowboy”, to “drop it honcho”. Long story short he got so mad he grabbed a nearby baby out of a stroller and ate it right in front of me. AND, yes his eyes did seem to be glowing like you say. No salsa, no mayo nothing.

Actors are deficient people. They have no self, no human integrity. They are all satanic. At death’s door, the ‘man with a thousand voices’ will beg the almighty for just one. What prayer will save the man that is not a man? Plato explains the vice associated with actors – his concerns would be magnified ten fold if he saw what they do today. Nothing is off limits, yet it’s fiction they perform that they believe to be real.

Example Alex Baldwin brandishes loaded handgun, and to emulate authentic scene points it at person and pulls a trigger and a real bullet is fired at a person. Fiction was disproved by reality, but the actor does not recognize his incurable idiocy which by metamorphosis, transformed him from man to humonculus shape shifter.

Lie of the day from the Fake DA. The ultra progressive Atty Knight has been calling out Harrington’s deceit for years. This time Harrington lied to the NAACP. If she will lie about this case she will lie about yours. Will anyone listen?

To the editor: In 2018, I ran as a progressive candidate for district attorney.
Now, I’m supporting Tim Shugrue. The depth and breadth of Tim’s legal experience will enable him to actually bring substantive criminal justice reform to Berkshire County.
The current DA has not done this, nor will she. This story is one example of how I know this is true.
In 2017, I was hired to represent an 18-year-old Latinx man who was working two jobs and had no criminal record. He had been beaten and hit with a stun gun by three white police officers inside his home while in his stocking feet. He was charged with three counts of assault and battery on a police officer, resisting arrest and disorderly conduct.
Police unapologetically reported that they had struck my client with batons, punched him in the face and shocked him with a stun gun numerous times. Months before the August 2019 trial, I repeatedly asked Harrington’s office to dismiss this case due to the officers’ obvious use of excessive force and the lack of criminal conduct by my client. Each time, Harrington refused.
On the morning of trial, I confronted Ms. Harrington in the hallway and asked her again to dismiss the charges, reminding her of her promise to bring a more enlightened approach to the criminal justice system. She refused. Instead, Ms. Harrington deferred to the officers who brutally beat my young Hispanic client — exactly the kind of conduct she purportedly stands against.
Thankfully, the jury did the right thing and acquitted him on all charges. (“Jury: No assault of Pittsfield officers during in-home arrest in 2017,” Eagle, Aug. 6, 2019.)
Worse, Harrington later told the NAACP that by the time she learned about the case, it was too late for her to dismiss it. This is not true.
We’ve had four years of progressive rhetoric without action. The verdict is in. With Ms. Harrington, it’s just rhetoric, not deeds. A progressive DA would never have prosecuted my client.
In contrast, Tim Shugrue is a stand-up guy. He ran against David Capeless in 2004 for many of the same reasons that I ran against Capeless in 2006. We shared a disdain for the thuggish use of mandatory minimums by that office to incarcerate nonviolent individuals. Now, we both believe that there remains a deep need for criminal justice reform in Berkshire County and that this can be accomplished hand in hand with effective law enforcement, not in spite of it.
Judith C. Knight, Lee
The writer is an attorney with a practice in Great Barrington and also was a candidate for Berkshire district attorney in 2018.

When PPD thugs brutalize citizens/violate their civil rights, you can bet their victim[s] will be charged with the usual lies, assault and battery on a police officer, resisting arrest and disorderly conduct. Never underestimate the depravity of depraved cops, and Andrea Harrington and David Capeless and Gerald Downing and Daniel Ford and Anthony Ruberto.

A 56-year-old Dalton woman was assaulted and injured by PPD cops when she went to the Pittsfield police department to file a complaint against the Pittsfield Police. After Pittsfield police assaulted the woman, and injured her, Pittsfield police arrested her and charged her with assaulting a police officer and disorderly conduct. Because that’s what depraved cops do.

Dalton woman is not guilty of assaulting officer – June 22, 2014

This is far from an isolated case.

This type of police corruption is not the exception; this is the rule for PPD corruption.

Guess what Andrea? The crime rate isn’t the problem. You are. You can’t put together a case and get witnesses to court. You dismiss domestic violence cases left and right because your prosecutors aren’t trained yet you have the nerve to claim you are women’s champion. What about the lady with three kids who got choked half to death and pushed almost out the window by a repeat offender? You dropped the case because she refused to testify. There are so many examples like this yet you stand on a soap box a week before election and claim crime is down? Shame, shame, shame shame on you!

Andrea Harrington does not give a shit about REAL victims of REAL domestic violence and REAL RAPE. Case in point http://www.wwlp.com – August 29, 2018

Second person arrested in connection with Pittsfield Child Rape case –

‘A Pittsfield woman was arraigned Monday afternoon after being charged with raping an 18-mouth-old boy. Following her arraignment, she was released on condition of not having any contact with the alleged victim. Erica Emerling has been charged with aggravated rape of a child with force, posing a child in a sexual act, and aggravated indecent assault and battery on a child under 14.’

This 29-year-old monster, aka mother, is facing serious charges.

And I’ve read, that while free, this monster gave birth to another victim. And she’s still not locked up.

January 17, 2020 – GUILTY PLEA – Woman Blackmailed into Assaulting Toddler Pleads Guilty

A depraved tale about a monster who took explicit photos of herself and shared them with another monster who then threatened to distribute the explicit photos if the mommy monster didn’t RAPE her own baby. So, the mommy MONSTER RAPED HER OWN BABY, and didn’t go to prison for this monstrous depravity. This Baby Raping MONSTER is another one of Andrea Harrington’s depraved victims.

This is exactly the point other posters and letter writers have made about AH saying one thing and doing another. Well-trained prosecutors know how to investigate, prepare, and present a domestic violence case without a victim. There are a myriad of reasons to do it this way, not the least of which is victim safety. AH professes to prioritize gender violence, yet did not train her ADAs on the fundamentals of evidence based (victimless) prosecution. DAs Downing, Capeless, and Caccaviello all pursued domestic violence cases in this manner with success, which under these circumstances mean holding the offender accountable and making victims safer. Shame is right.

If you look at online reviews for correctional facilities our local jail gets a 4 star review, while the facility in Chicopee gets a 3 star review. In speaking with someone who did a brief stay in Chicopee her chief complaints were the food and it takes too long to see a counselor. The question becomes how to address this situation. Do you bring part of the population back here or fix the problem out there?

Option three is, “don’t get your ass put in jail”, cuz it was not meant to be pretty and cater to your every need. Parents need to tell their kids this cuz they do not seem to be aware of it.

https://www.wwlp.com/news/local-news/hampden-county/womens-jail-in-chicopee-earns-perfect-score-in-audit/

To the editor: As a formerly incarcerated person, I have a question for the public.

Have you been incarcerated yourself? Has your family? If you’ve answered no to either of those questions, you don’t have enough facts or experiences to be writing about this subject. My family and I have been through this twice. Simply being incarcerated and away from your loved ones is a traumatic experience.

I was sentenced to the Berkshire County Jail and House of Corrections in 2012. My daughter was 15 at the time — not an easy time to be separated from your mom. We made it work somehow. My family wanted me to be able to receive education on what I needed to fix. My husband and daughter came every visiting day. Location shouldn’t be the issue; it’s getting better that should be the main focus.

Jail isn’t really designed to be convenient for anyone. You can’t have the men and women come in contact with each other, therefore the women were able to go to a classroom for a few programs that were offered 10 feet outside the “pod” and at night a few that were classified went and cleaned the cafeteria. That’s it. Do you think this creates a healthy and healing environment? I can tell you it does not.

Sheriff Thomas Bowler realized the women of his county would be getting more: more movement within the facility to earn good time and more programs in the community to help acclimate them into society by moving the female inmates to Chicopee. I was in the minimum security section of the Western Massachusetts Regional Women’s Correctional Center where I was able to go out Monday through Friday working on crews outside and go to NA or AA meetings at night. I never felt disconnected from my county.

The sheriff didn’t just ship the women off; he is closely involved in every decision that is made concerning their safety and well-being, even going as far as hiring a women’s reentry and aftercare case worker to meet with them every week. In Chicopee, we had programs for education and for areas of need such as addiction, abuse, human trafficking, trauma and more. Women are in jail because they need help; let them get the help they need and make the distance work somehow. It’s worth it for everyone in the long run.

Im going to tell you a secret the Lee police department is pretty inept. Their former Chief was running a shakedown scheme for years. There were always allegations of him shaking down prostitutes for favors and cash and local dealers for money.

The MSP out here is a catch all for probies, who if they do well get moved closer to Boston. Troopers who plan to retire, or screwups. If you screw up off to the Lee or Cheshire barracks.
A few years ago a trooper who was married to an MSP command officer’s daughter, cheated on said daughter. He ended up in Lee.
A former State Trooper’s son got caught with steroids, he will never leave the Berkshires.
We are not looking at the best and brightest out here. Just think of Pittsfield and how they fought so hard for an affirmative action hire chief.

The felony convicted former Lee Police Chief wasn’t just shaking down a businesswoman he was also stealing LOTS of $$$$$$$$$$$$$$$ from a toy fund he ran for decades to allegedly make Christmas a little happier for disadvantaged kids, and he was also stealing Bingo $$$$$$$$$$$$$ from his church Bingo instead of depositing the money for the church. But he was a 30 plus year trusted police officer/police chief. And the daughter of the convicted career police thief is a state trooper, and his state trooper daughter’s wedding couldn’t have been cheap. And the taxpayers still had to pay the attorney fees for this criminal. The police chief thief was supposed to sell his Pittsfield home and repay the taxpayers who paid for his defense. But I don’t believe that he ever complied with that. But I digress, decades ago a high-ranking state trooper was accused of leaving SOMETHING in the mailbox of a woman after she broke off their illicit relationship. The state trooper’s behavior resulted in the high-ranking state trooper having to sign his gun business over to a family member. And THESE are the best and the brightest, rising through the ranks. And don’t even get me started that affirmative action hire chief.

There’s no heat on a dead body. She was missing for days, her body would have been at room temp or ambient temp.

The dogs would have detected a scent of a dead body that close to her vehicle. Maybe she wasn’t dead just unconscious until the cold nights did kill her, but nobody even knew she was missing until days after her car was found abandoned in the park. Until we know cause of death, if they can determine it, we can only speculate on what happened to her.

While there may be some truth to what you are reporting, (back when Kennedy rolled the Olds off the bridge with the poor damsel it, a trooper was threatened to be exiled to the Berkshires )
a dead body can be very hard to find in the woods, especially after decomp. And the Lee Chief is a top shelf leader and cop.

Bullshit I know the some Troopers in question. A good man got transferred to a shit detail for being a hero.

2013
In July, Murphy, 48, was suspended with pay for one day for the leak. A month later, he was transferred from his job as a tactical photographer at state police headquarters to a rural patrol job working the overnight shift.

Sgt. Sean Murphy a good friend, was transferred to a shit detail in Athol.
So don’t talk about things you don’t know boy.

The Lee chief is a rube and part of the Lee police department problem.
He was a Sgt when Buffis was chief. He knew exactly what was going on, did he do anything all those years? No. He took his promotions and kept his mouth shut. And if you say he didn’t know what kind of cop does that make him? I get your a badge bunny/jock sniffer but you don’t know what you are talking about.

Todays Eagle, “Board resigns en masse”. Many interpret this as good news. Really? Why are you there in the first place? Are you there to review, to criticize, to change decisions made by elected officials. In this case the chief of police made a decision that is very good, within his authority to make, a decision we citizens expect a chief executive to make, and a handful of citizens are critical of this decision. Thank you chief, for a decision that is gutsy, accurate and authorized to make. And how about the mayor? We have to give her a maximum of credit for guts and brains. Not easy to go against an independent citizen committee, but she did it.It is not easy to go against a citizen group in Pittsfield. Nice job Mayor Tyer and Chief Wynn.

The International Brotherhood of Police Officers, Locals 447 and 447S, said they back Bowler’s reelection as sheriff. The locals, which represent Pittsfield patrol officers and superior officers, said Bowler earned their support because of his experience, service, collaborative leadership, accessibility and embrace of education, treatment and work programs.

“Over 12 years ago, when then-Detective Bowler left the Pittsfield Police Department, he left a lasting impression on the members of the department,” the unions said in a joint statement. “If asked to describe him: honest, professional, inquisitive, and attentive to detail, are words you would frequently hear. He took those traits to the Berkshire County Sheriff’s office and the men and women who serve in that agency reflect that.”

In North Adams, the union that represents patrol officers and sergeants with the North Adams Police Department threw its support to Bowler. In a statement, MCOP Local 382 said it backs Bowler because it sees him as “an integral part of the community [who] has forged many partnerships that have created a great number of resources for Berkshire County … We believe integrity and experience matter.”

Bowler also picked up an endorsement from the State Police Association of Massachusetts, which called him a “collaborative leader who has been an integral partner to” its members.

“He has a long history of supporting law enforcement, but our support stems from so much more than that,” the association said in a statement. “Sheriff Bowler has integrity, experience, compassion and commitment to his community. We are proud to endorse his candidacy and urge voters across Berkshire County to vote for him this Tuesday.”

Please remove the picture of Hitler that is posted on your blog. The Holocaust and Hitler’s evil legacy is less than 100 years old. Posters on your blog can make their unfavorable criticisms of Joe Biden without comparing him to Hitler by putting Hitler’s picture above Biden’s picture. Lastly, I had brunch with my mom and her friend on her friend’s birthday today, and I said to them that I believe that MAGA equals NAZI under Donald Trump’s racist White Nationalist political movement in the USA (and Europe). Donald Trump is a lot more similar to Hitler than Joe Biden!

No President Of United States, past or present, should be compared to Hitler. Even Donald Trump. Trump and Biden may be many things but neither deserves to be compared to Hitler. You keep using the Hitler comparison for Trump like some people use the word “rascist” when they have nothing else to say. It’s ok to disagree with a President, its one of our rights. Seen a post by that Josh Landes guy saying that overall crime in Pittsfield has dropped 40% in the last five years. This is absolute unadulterated bulllshit and he should be ashamed for lying so blatantly to his community. He and his handlers can manufacture all the statics they want and keep what we are seeing with our own eyes out of the newspaers, but people see, hear and talk and we know he is lying through his teeth. News quickly spread so we have out of town liquor store thefts with no bail. Did I miss WAMC’s coverage of that? I guess I wasn’t listening when they covered Fair and Just prosecution and Harrington’s association with that radical group and its ideas about “reform?” I must have missed that overdose deaths have skyrocketed here while they are down elsewhere in the state because out of town drug traffickers like the guy Harrington let go live with his sister in Springfield. Dan this was a disgusting and needless article that does nothing but continue the pain for a family so you can support that scumbag Alf.
It’s so very clear you support him, it’s a bias that everyone can see.
I guess I though you were better than this but aren’t.

You want to look into a death of inmates, look into the ones that were released during Covid at Harrington’s insistence as part of the national “Difference a DA Makes” and Fair and Just campaign to reduce incarceration. At least two had no safe place to go and died of overdoses. So much for Harrington’s protection of vulnerable addicts.

Here is the letter signed by Harrington demanding accelerated release. Overdose deaths among recently incarcerated are widely known to be many times higher. The Brien Center and others in the treatment and recovery community were against firmly against it.

It was part of a major campaign to use covid to to release inmates.

You would think a story like that would get media attention locally. It would have made such a nice one for Overdose Awareness Day.
