(FORTRESS OF SOLITUDE, MONDAY NOV. 30, 2020) — Even when Berkshire County district attorney Andrea Harrington advocates for a much-needed adjustment of courtroom policy, she manages to taint the corrective with self-serving politics. As she herself unwittingly reveals, she’s “acting.”

Case in point, Harrington’s Nov. 18 letter sent to Justice Paula Carey, chief justice of the Trial Court; Jonathan Williams, court administrator; and the Trial Court in Boston. In the letter, Harringon points to a serious backlog of jury trials due to the COVID-19 virus and a lack of secure locations for trials to be held. Here’s the full text:

THE PLANET applauds the intent of the letter and commends Harrington for taking action. As she states, the local D.A. does not have the power to unilaterally impose local conditions that meet the protocols of the Trial Court. Berkshire County needs help from Boston.

The problem with the letter can be found in the “cc”s. No less than 20 people are copied in. Some can be justified, such as judges Agostini, Vrabel, Smyth, and McMenemy, as well as the two state associations for trial lawyers. But the governor? Why on earth would he be copied in, except to serve as political promotion? This was a point made to THE PLANET by our sources among the local legal community. Also, since we need help in Boston, why wouldn’t she copy in the Berkshire County reps to the General Court?

One source put it this way: “It’s an admission of what I think we all know. Andrea’s basically saying these guys [Sen. Ben Downing and reps John Barrett, Tricia Farley-Bouvier, Paul Mark, and Smitty Pignatelli] have no sway on the [Beacon] Hill. It’s funny. You’ve got people who have been there for years but they might as well be back-benchers.”

This is from one of our Perry Masons, whom we asked for help in understanding the letter:

The need to get in person jury sessions up and running is great and AH is right to demand some action. There are too many people held indefinitely as “dangerous” under 58A who want a speedy jury trial. As a defense lawyer, I would be demanding a non-virtual jury trial and if not provided within statutory “speedy trial” times, would be moving to dismiss. I have heard from my sources that the DA’s office is freaking out about Carnevale case that got started just prior to COVID shutdown with jury and all and then had to end in a mistrial due to mandated shutdown. Apparently, witnesses for the prosecution are “forgetting” facts, since the mistrial and the DA’s office may very well lose this case. Not good. So, yes, she is right to go on record with this, although cc’ing the Governor is ridiculous and possibly a political attention grab. On a side note, had to pull out air sickness bag upon reading the words “justice actors.” She is ridiculous.

Words sometimes reveal more than the writer intends.

Harrington [or her flack, Andy McKeever] could have used many other words — officials, officers, personnel, professionals, or even more direct appellations such as judges, lawyers, and the like. To refer to legal work as “acting” seems to reveal Harrington’s true feelings about the D.A. position. She’s acting.

Another lawyer sent us this note:

Thank you for Planet Valenti.  I think your work provides invaluable feedback to those in power.  And I do think the average Joe is forgotten.  You hit the nail on the head re: “justice actor.” Freudian slip.  Too bad a true professional did not succeed in getting that job.  All the white ladies who lunch think AH is darling.  As we know, there are some very dangerous folks out there … .  and the clown car cavalry is outmatched.

The [constitutional] Right to a Speedy Trial is complicated because there are “excluded” times from calculation including closures due to COVID. See Commonwealth v. Lougee. General rule: delay helps defense, civilian prosecution witnesses forget or lose interest or change their minds about testifying.
AND, one other Harrington special: her claim of convictions on domestic abuse cases where victim did not testify. On at least one of those cases, it was a plea, not a trial (therefore the victim would not have to speak) and judge went with defense sentence recommendation and not prosecution. Hardly a “win.” But the Eagle does not fact check McKeever’s releases.

The Trial Courts have been exploring a number of different alternative methods and locations for jury trials. This has been going on for months. They send out routine information emails about this information, so it’s an outright lie that they have not updated anyone about plans.
In fact just prior to this letter, PR flack piece, the Trial Court had notified her office that they were close to a solution. Her release of this letter was timed to make it seem like her letter actual had an impact on action that had been taking place.
This is a preemptive action to place blame on the Trial Court for her offices failure to secure future convictions.
Actor is a term of art for the legal profession. It is not incorrect to use it but it shows a lack of contextual understanding of actor and the inferred “bad actor”.
Another thing not to overlook, her use of the word “investment”. When she goes over budget expect the those “expenses” to be the reason.
The cc’ing of Lawyers Weekly is much more telling, it’s a way to get her name “out there”.

Does she really sign her title Berkshire District Attorney and leaves out the county.

Yes your right about that. A diversity coach makes good coin. Imagine what the ones who own and run these programs are making. We have so many fields they work in now.

My experience with Covid and the way BMC failed us.

I got covid, I don’t know how, I don’t suspect I will ever know. I work a regular job, in an office I’ve got a husband and two children, they got it too.
One day I started coughing, it was a small but persistent cough. I didn’t think much of it until 5 days later when it hurt to even breathe. I immediately isolated and I called my primary care, they said get tested. I tried. It took four calls to the “hotline” and a note from my primary care to get tested.
Getting tested took two days of effort. I drove myself and got tested, one nurse told me I’d be notified if I tested positive, another told me I’d be notified either way and gave me instructions and a pamphlet on how to check electronically.
I got my results three days later, no one called, there was no follow-up, I got my results by myself online, I can provide those results for verification.
After testing positive I wanted my family to get tested, it was like pulling teeth. My family had spent a hundred or more hours in close contact with me, 5 days of coughing before I isolated and probably 3 days before that I was actually sick.
More calls to their pediatrician and my primary care got them tests. Same thing, no one called. We got our test results online. Thankfully everyone’s symptoms were mild or non-existent. No major issues for us, mild fever, cough, I had it the worst my chest just hurt constantly, and still does. It took 5 more calls and almost a month to get scheduled follow up tests to check if we were negative. No one ever called with results or tracing, no work history or anything, where I’d been, names of people I work with.
No one ever asked what school my kids went to, they ride a bus every day to school, the public health nurse didn’t call, the school nurse didn’t call. When I called the school to let them know, the school nurse seemed like she couldn’t be bothered. She said she gets her results directly and she would wait and see.
I’m writing this because I finally did get a call.
BMC called to confirm my insurance because they had a problem with submitting the bills, I think they had the wrong prefix or an older plan number for my children.
I live in a small town, I’ve looked at the numbers everyday on the states website. My town never went up. If you read the formula and based on the population in my town 1400 people, our 4 cases would have pushed us up out of grey.
My town still says 13 cases, it has before we got tested, and still says 13 cases. They know da toy where I live. I don’t live on Rt 41 or parts of town that have a Pittsfield mailing address.
I don’t have much faith in this process. I have zero faith in the public health and school nurse, zero faith in the tracing program, it was very difficult to get testing and we all tested positive.
We had to lie about how bad our symptoms were and then had to get doctors notes to get a test. They were more concerned with billing than our actual health. We were lucky.

Thank you for your post. One wonders how many more there are out there like you. It seems like no one is in charge sometimes. Is there a particular office or person in Berkshire County who is the head authority on such things?
And now that people are dying locally it is hard to figure the numbers. They keep saying “new deaths”, or “new cases” without really giving a timeline. What the hell does “new” mean? New since yesterday? New since 1918? Stop with the word games because it makes it look like someone is afraid the truth might come out.

The role of district attorney should never ever be political. But, Berkshire county elected THE most politically ambitious person in the area, who could honestly care less about what title she had as long as it was a title. She pointed over and over again (some might argue this tipped the scales for her) about a lack of criminal prosecutions at Williams college, she gets elected and then aligns herself with this cultural organization. I again ask, if this had been a male teacher, would she have been this forgiving? Had there since been any charges brought forward that weren’t brought by the previous administration? It’s really too bad the Berkshires doesn’t have any real reporters, who can truly dig into something, and then right a clear, concise article sticking to facts. Further, if there were, depending on who they are, freedom Freddie would shut em down anyway!

Holy Smokes. That’s Gwendolyn Hampton Vansant and I never knew. Having sex with a student when you have been his/her teacher and 5 or mores years have not passed since that time is just plain wrong. Having two children with said former student, wrong also. You are so right to call out the hypocrisy of Harrington’s alignment with Vansant while condemning the lack of prosecutions at Williams College. Is this fact about Vansant well-known?

Are you serious. The student’s life is forever uprooted, meaning family tree etc. A man doesn’t just have babies and give them away – not even knowing ? That is Fuxed up to do to a young man, esp. your student for God sake – supposed to take care of him – that blows my mind. Seems we have no problem parenting everyone else’s kids though. This story is too much, seriously – I will double up on therapy. She knew it was short lived – babies……. I’m sure they are loved, that’s all the Peace I can conjure. I trusted her. I busted my Dad out of Fairview Commons – took his ass right on out of that place. In a wheelchair. Cops, Firefighters, Ambulance on me for hours, surrounding my home – NOT MY DAD ! Take care of your disabled family – what a f* shame. My Dad! Was a rough road getting him to the appointments after that, I did it. My baby in his stroller, carrying his car seat around, with my Dad in a cabulance, wheelchair bound I pushed my Dad and my Baby through the Dr. Office – carrying also a baby bag – learning how to do his meds & testing with the nurse – Dad’s home today. This is real. Nothing to DO WITH CORONA. NOTHING TO DO WITH CORONA !

My writing style is insane, I see it too. – I meant I had to escape my parent out of the nursing home & it was tough then trying to manage his needs on my own. But I saved his life. & this is not due to covid. The conditions there were unacceptable. Point being they operate in secrecy & its unsafe there.

Yah dude, I am afraid the words pandemic, virus and highly contagious go right over your head. So I can’t help ya. It just makes me so sad when I see the nurses and doctors on TV trying to handle the overflowing intensive care units. They are being put through hell because a lot of people just don’t want to be inconvienced. Nobody said life was fair. Nobody said life woud always be a bowl of cherries. Shit happens and people suffer but no one should be dragging others down with them.

So you are saying the restaurants that violated health protocols that worked for 9 months shouldn’t risk their patrons lives.
That the few who fucked up shouldn’t drag down the rest who did everything right.
That out of 351 cities and towns in the entire state, many with much more dire Covid outlooks we were the ONLY one that closed restaurants for dine in. I totally get it, you’re right. They shouldn’t. Where your wrong is none of what was done had any impact on public health, was not founded in the numbers.
Portsmits closed on its own and all they had to do was shut down yukis and the sold autos for a couple weeks.

The argument from restaurant owners is that they followed all of the safety protocols and played by the rules yet now are being asked to shut down during the only time that will carry them through winter.

This isn’t a federal or state order, it is coming from the dictator in the corner office that doesn’t have a clue on how to run a business. Rather then single out her buddy on the counsel who was responsible for a large amount of this mess, she is shutting down everyone who spent their own money to be able to safely operate.

Now you have people spending money in other areas of the county and guess what? When Pittsfield is allowed indoor dining some day again, many of those customers still will not return because they found other options. This is why you see restaurants rarely take long extended breaks, because the second you close, your regulars go somewhere else and discover something different and go to your place less.

We have lost a large amount of our small local restaurants and this is going to be the nail in the coffin for a bunch of others. Something tells me Hotel on North, Dottie’s, and Methuselah will probably be OK though.

Why should restaurants have to pay a penalty for a city councilor running a speak easy after hour drunken bar party.Also the city councilor should come out and say that restaurants should not be penalized for her breaking the law.This was apparently a well known illegal alcohol bar…..She also needs to resign as a councilor.Im sure all her colleagues agree she is not a good decision maker.Why should the Highland pay for the city councilors illegal behavior.

Also said he did not fall and hit his head.

17 hours ago they changed it to injured his foot and may need a walking boot for a couple weeks

10 hours ago they said he had a hairline fracture in his foot and will required a walking boot for several weeks.

When asked why, if he did not fall on his head or hit his head, why did he have a CT scan on his head, they did not answer. Later they mentioned he complained of dizziness, and that was scrubbed from CNN about 30 minutes after it was posted.

They said it wasn’t a fracture, then it was. He got a CT scan for his head and foot.

They scrubbed the head part. It’s not a couple weeks, it several. As in 5 or more.
He went from one clinic to a neurologist and get the CT scans.

Channel 10 Albany news just stated that they have reached out to the Mayor’s office pertaining to why she is still not communicating to restaurant owners or even updating them on when they can open for in side dining and guess what, she has not responded to the news station!? Why no response once again, she has two assistants that we pay for, they can’t respond? CC Vice President Peter White lies on public TV and states the Mayor updates the taxpayers every Friday. Wake up and stop butt kissing Peter, you have been caught lying to the taxpayers big time. Mayor Sheehan of Albany and Mayor Sarno of Springfield update their taxpayers every day sometimes more than that on Covid 19. Goes to show that the Mayor of Tyerville is way out of her element. Also, where is Governor Baker? The last time he visited Tyerville was last March and he basically kicked the Mayor back in shape. Time for another visit Governor or maybe taxpayers should group together and campaign for a vote of no confidence against the Mayor and all but two of the City Council. Our City we all use to call Pittsfield is one step from death.

Local restaurant owners Craig Benoit (The Hot Dog Ranch), Tony Mazzeo (Mazzeo’s Ristorante), Pasquale Arace (The Highland Restaurant), Mickey Saldato (The Roasted Garlic & Zucchinis), Paul Capitanio (East Side Cafe) and a few others went to City Hall today to ask for the mayor to come out from her office and speak with them for just a few minutes. They were hoping to present her with a petition signed by over 20 local restaurant owners asking for her to lift the ban on indoor dining. Mayor Tyer declined to speak with them today, but agreed to a Zoom conference meeting tomorrow at 11:30am to discuss the issue further. Please call your city councilors and support your local restaurant owners.

The staff, most of whom had few if any symptoms, spread it to some very ill and elderly patients. All the large gatherings in the community prior to the outbreak, spread this virus to the staff. These elderly were not protected from the virus.

Consider that these staff, possibly asymptomatic, would be eating out at resturants if they were open. I know it seems draconian to close indoor dining but it seems prudent for the time being. These cases exploded quickly and are expected to get worse.

PITTSFIELD — The owner of a local brewery got a pass from the city Monday on an apparent violation of COVID-19 regulations.

After a brief show cause hearing Monday, the city Licensing Board unanimously agreed to take no action against Wandering Star Craft Brewery for inviting customers who buy their beer to enjoy it in a space outside the brewery Nov. 14 and Nov. 15.

A complaint was filed with the Pittsfield Police Department after the brewery posted a promotion on social media about the outdoor consumption of Wandering Star brews that weekend.

Under the current state regulations during the coronavirus pandemic, prepared food from a commercial kitchen must be served with alcoholic beverages. Outdoor beer sales must come from a tap, not bottles. The food must come from a legitimate menu; just peanuts, pretzels or cheese and crackers won’t suffice.

Wandering Star’s liquor license doesn’t allow for indoor, on-site consumption. With a separate license, the brewery could serve beer from a tap. But, owner Christopher Post thought his promotion wasn’t a problem, since the property behind the brewery belongs to another business from which he leases the buildings.

“I’ve always been told the place is off premise,” Post told the board.

Board member Kathy Amuso reminded Post that he should have been aware of the state restrictions on selling/serving alcohol during the pandemic.

“Going forward, I want you to know what you can and cannot do on premise and behind your premise,” she said.

Between Liz Warren’s comments yesterday about let’s reimagine freedom to be dependence on big government, this is going to get really bad quickly in this country. Pittsfield’s COVID overall positivity test rate has upped to 4.5% as of November 28th, according to data sent home to PPS families. On October 15, the rate was 0.1%.

Yet 173 of 421 active cases are attributed to long term care. At Hillcrest Commons, 137 out of 299 residents tested positive. That’s a positivity rate of 45%.

You absolutely cannot lump outbreaks at a nursing home and the jail with the positivity rates of the general public.

On November 22 and 23, Pittsfield did pop-up testing for 760 students, parents and staff of the PPS community. They yielded 4 positive tests, a rate of 0.5%.

Let’s be rationale here, which numbers more accurately reflect the threat to the general
public?

The schools should be open. They did not contribute to an outbreak at a nursing home.

Keeping the schools closed sends one (false) message – you will never be safe, anywhere. All of these precautions are for shit because nothing you do helps. As soon as people leave their homes, we’re doomed. (All false narrative, but propagated at every turn).

Open the schools. Stop the fear mongering.

And fire the Mayor. She has no idea what she is doing. There will be no climbing back from this black hole. Pittsfield is doomed under her administration.

There are too many patients in Hillcrest Commons. So easy for the virus to spread to many patients. Berkshire Health Systems should have sent patients to other smaller local nursing homes so there were not so many in one place. Patients should have had their own room and not had to share with another patient. Sharing a bathroom with a room mate will quickly spread the virus.

OR, if you have an infected nursing assistant going around passing our medications or helping people get dressed then one infected person could infect alot more and it would not matter how many patients were in each room?

Unfortunately there aren’t enough beds to do one patient to a room.Most likely patients are getting infected by staff.

I reported earlier what she said about putting packets of 50 ballots through the machine 8 to 10 times.

To wit: Ballot jams. Error. Must discard the vote count for the whole batch. Then rescan. But they just counted the ballots again, adding to the previous count, scanning them through, without discarding the count. So you get 450 to 500 votes for every 50-ballot packet.

She called the FBI. Spoke with a woman for 40 minutes. Disconnected. Called back and left a message. No call back from FBI.

I really hope this chick has hired body guards.
