MATT TUCKER AND WIFE: DEATH IN THE CRIB IS NOT A MERE TECHNICAL GLITCH

“They waddled into Berkshire County Superior Court, all 600 pounds of them, an estimate of their combined weight. If they were billboarding for the 7 Capital Sins, which would it be, sloth or gluttony?”

Body-shaming or factual account?

Point 1: THE PLANET would not begin an account that way.

Point 2: We do, however, understand the level of outrage brought by this case that might tempt people for preferring that kind of opening. We’veheard a bunch of it. Remember, though, that by law the Matthew and Cassandra-Barlow Tucker must be considered innocent until a court of law declares otherwise.

Here’s the straight way to report this, courtesy of The Berkshire Eagle:

PITTSFIELD — An Adams couple has been indicted on charges including involuntary manslaughter in connection with the death of their 10-month-old foster child last year. A defense attorney, however, calls the case as an “appalling scapegoating” of two experienced foster parents.

Matthew Tucker and Cassandra Barlow-Tucker, both 37, were arraigned Thursday afternoon in Berkshire Superior Court on charges of involuntary manslaughter involving neglect of legal duty and reckless endangerment in the death of infant Kristoff Zenopolous on Feb. 18, 2020.

The Tuckers face up to 20 years in prison if convicted.

The Eagle continues:

The Tuckers … pleaded not guilty. Prosecutors did not seek bail. Judge Mark Mason released the Tuckers on personal recognizance with orders they comply with any requirements stipulated by the Department of Children and Families.

DCF placed the child in the Tuckers’ care Dec. 5, 2019. District attorney Andrea Harrington said the baby had shown “visible signs of illness” two weeks before Feb. 18 when the Tuckers found the child dead in his crib. Harrington said the child died of strep A pneumonia and pus in his lungs. The baby also had a collapsed lung.

Try to imagine the unimaginable: the baby, drowning in his own pus, helpless. Then imagine the parents not getting a doctor.

What, they didn’t realize the child was suffering? Though Harrington said there was “some evidence … about steps that were being taken to care for the infant,” she added that antibiotics would have saved the baby’s life, slam dunk, back-and-white, case closed. Medical testimony in the upcoming trial should clarify that point beyond reasonable dispute.

From the Eagle, quoting the D.A.: “The Tuckers failed to bring Zenopolous to the doctor, despite him displaying visible symptoms including a fever and cough. Antibiotics routinely are used to treat these underlying illnesses and … the Tuckers’ failure to obtain medical care caused Kristoff to develop widespread infection.”

The words have a certain gravitas.

Jill Sheldon, the Matt Tucker’s defense attorney, said the death wasn’t the fault of her client. Perhaps she is correct. Sheldon partly blamed an unnamed “organization” for the death owing to “paperwork [that] was not received” by Tucker regarding the baby’s medical history. What “organization?” Why not name it? What “paperwork” did the Tuckers need beyond the evidence presented by the suffering child? Moreover, Sheldon said it was not the Tuckers’ responsibility to bring the baby to the doctors. THE PLANET finds that hard to believe. Who else but the Tuckers should have been responsible, or did they and Sheldon expect the baby to get out of the crib, steal a smart phone, and call a doctor or DCF on his own? Were, and are, the Tuckers hiding something? It’s a reasonable question.
Tucker’s wife has a separate defense attorney, Katherine Grubbs from the public defenders’ office. It strikes THE PLANET as odd that the husband would have private representation and the wife a lawyer from the pool reserved for indigent clients. Is one planning to throw the other under a bus? That’s how local legal eagles see it.

The full facts of the case have yet to be introduced, which should preclude hasty judgments and certainly do by THE PLANET.

But consider:

(a) When a parent or parents take a foster child into their home, THEY ARE RESPONSIBLE FOR THE CARE AND WELL BEING OF THAT CHILD. Look up the definition of “foster.”

(b) There’s a sick infant, helpless in his crib, displaying clear signs of medical distress. What paperwork does a parent need to seek professional intervention for a child in the throes of deathly illness?

(c) For two weeks, the baby suffering grows progressively worse.

(d) For two weeks, according to the indictment, neither Tucker gets professional medical care, treatment the D.A. says would have saved the child’s life.

(e) The baby dies.

With respect to (a), this is what the Department of Children and Families has on the state’s website:

“What do I need to know about my foster child’s medical needs?

“The child’s ongoing worker should be available to help you with any questions about medical needs, appointments and forms. If you need additional help, you can ask to speak to the Medical Social Worker in the office.

  • Medical Social Workers – Each DCF office has a medical social worker to help schedule appointments, collect important health information such as immunizations and past medical history, provide care coordination, work with MassHealth and other insurers, and ensure that youth receive their prescribed medications. They are available to consult with foster parents regarding medical questions.
  • 7 and 30 Day Medical Policy – When a child enters foster care they are required to have a medical screening within 7 days and a comprehensive medical exam within 30 days. You will need to provide all documentation forms from the physician’s office to the child’s ongoing social worker.
  • Authorization for Treatment & Medication – Foster parents can authorize routine medical and dental care. Foster parent are required to inform the child’s ongoing social worker/supervisor of all medical and dental care.”

Harrington took this to a grand jury, indicating the level of concern she had in seeking justice in the name of We The People.

The grand jury brought back enough evidence for an indictment. Now you can dismiss that action with the tired bromide that one could get a grand jury to indict a ham sandwich, but THE PLANET has more respect for due process than to be that flippant, especially given the sad and tragic loss of an utterly innocent life.

Question: Did the Tuckers avail themselves of the help offered by their DCF medical social worker?

Question: Did the child receive medical screening within his first seven days in his new home?

Question: Did the child receive a comprehensive medical exam within the first 30 days? That exam should have taken place by Jan. 5, 2020.

Question: What specific actions did the Tuckers take on their own to help the poor baby?

Question: The defense made much of both the number of children the Tuckers had fostered, but why so many in such a short period of time? Something sounds amiss there.

Question: How could good parents with so much experience not known at some point leading up to the baby’s death that, paperwork be damned, they had better do something more than just pray?

Question: What communications did the Tuckers make with the state regarding the infant’s condition between Jan. 6 and the day the boy died?

Question: What does the paper trail reveal?

From the Eagle: Asked whether the Tuckers sought medical treatment for the boy over the approximately two months they fostered him, Sheldon responded, “that will come out, as to how medical treatment was sought. She said she had not yet received all of the documentation related to the grand jury investigation from prosecutors. Both she and Harrington indicated more information about the case is forthcoming.

THE PLANET and everyone else should hope so.

Full disclosure.

When THE PLANET had our TV Show at PCTV, Matt Tucker served as technical adviser. We had plenty of interaction with him, and as a technician he was competent and mostly responsive, in a pull-your-teeth kind of way. Our impressions of the man, and they are simply that: A strange and distant dude addicted to comic-type superheroes and video games, the toys-in-the-office, “Pete White Thing.” He gave the vibes that every problem, including life issues, was simply a technical glitch that somewhere had a “patch.” We had the feeling that he was masquerading, play acting, as an “adult.”

One final question for today: Is Tucker still employed at PCTV? The station is, in effect, a public utility. In THE PLANET’s view, he needs to be suspended without pay until the matter is adjudicated. We have inquiries into Tucker and to PCTV exec Shaun Serre.

We await their response.

Emotions run high in cases such as this. They require every bit of strength the presumption of innocence contains.

The presumption of innocence … unless and until.

Is he still chairman of making sure nothing gets in the way of the mayors agenda? Is he the chairman who forgot what his job is? If the child wasn’t getting any better and there were definite symptoms, then the foster family should have taken the child to an actual doctor for actual medical care.

The problem lies with DCF. In order for the foster parents to take this particular child to the hospital, they needed paperwork from a DCF case worker. That worker ignored repeated requests. The husband has a voice mail from DCF telling him NOT to take the baby for medical care until he receives authorization. The baby died before he could get that.

Harrington is in WAY WAY WAY over her head, like somebody else said let the adults do the thinking and talking.

What branch of dcf was involved.if the child was sick for days and both knew about it then they’re both responsible in penalty. The voice on the other end of the phone wasn’t an aberration.

One thing is for sure, whether it’s their foster parent vetting process or their case supervision protocols, DCF shares culpability in this tragedy, both legally and morally.

I can only imagine the real story behind this baby. If I were the child’s family, I would be furious. We don’t know if this was a temporary situation or not, but if it was, there should be a lawsuit pending. And why was this child allowed to be tortured as long as he was? Two weeks of pneumonia and a collapsed lung? All signs were pointing to this child was fighting for his life. And if it wasn’t the foster parents responsibility to bring him to the doctor, then what are all other foster parents doing when their children are sick? Just letting them suffer? Find their own ride to the ER? I was a foster parent for a period of time, and I could not imagine allowing my little one, who relied on me for so much, to wither and die if she was sick. I spent many a day in the doctors office with her because that was my job, to provide care and safety. I became a foster mom to help make the world a better place, one little life at a time. This wasn’t a business deal. I wasn’t simply a babysitter. You are called “foster parent” because you act as parent, and provide what a parent provides. Love, comfort, safety and medical care, even if for a small period of time. That is your job. Now who’s responsibility was it to bring this baby to get medical help? The Tuckers. There is no getting around that. What an obscene statement for their lawyer to make. Absolutely obscene.

The only explanation I can come up with is that they may have religious reasons for not seeking medical attention, relying on prayer and miracles instead. In that case, DCF should have screened better because people like this do not belong in charge of human lives, much less an INFANT, who can not communicate when there’s a problem. However, the sounds this baby had to have made should have been enough to alert them that there was something so wrong that no amount of prayer would be helpful.

Almost everyone weighs 300 pounds. Keep eating processed foods, sugar, salt, trans fats, french fries and other carbs, large portions…., and then sit on your couch for over 8 hours everyday of your adult life.
Why do so many people out there have children when they don’t want to take care of them and/or cannot afford to care for them? You do NOT have to have children! The World is over-populated as it is. If you have children, then be responsible parents and care for them so they won’t end up neglected, hungry and in the bureaucratic hands of social services. It costs a lot of money and takes a lot of time to have a family.
Our culture has become trashy with sex, violence, drugs and alcohol, gambling, credit cards and subprime loans, a dumbed down public who doesn’t participate in public affairs, politicians who only take care of themselves and their supporters, many thousands of greedy lobbyists who vastly outnumber the aforementioned self-serving politicians, and a polarized political system that doesn’t try to reach the common good.
In closing, I wished we were all not so insecure and self-centered as a society that we actually cared about each other, our respective community, our political system, and our country and world.

DCF takes children from families for ridiculous reasons. Victoria Rose Smith who was murdered in South Carolina was put into foster care for two reasons. First, her mother had used pot and that was the first incident that alerted DCF and then the mother fell asleep during the day while taking care of the kids. The young boys could have easily woke her up, but they were sensitized by DCF to report any minor incident so they ran to neighbors and neighbors called police. At that point, all 3 children, 2 boys and a girl in this family, ended up in foster care since the mother couldn’t get them back. The girl, Victoria Rose, was murdered by the foster care family. Every effort should be made by DCF to keep children with their biological parents, but that’s not what they are doing.

You don’t have to go to South Carolina for DCF horror stories, Massachusetts DCF MONSTERS are responsible for plenty of their own DCF horrors. The death of 11-year-old Hannah Nazareth is still an unsolved Pittsfield mystery. The downtown Pittsfield/North Street prostitution ring run by certified foster father, Randy Lambach, who allegedly pimped out some of his foster kids. One can only guess as to what DCF allowed DCF approved foster father Randy Lambach to get away before he was arrested for running a prostitution ring in downtown Pittsfield, MA.. And in Auburn, MA it only took 5 years to indict DCF certified foster Monster Kimberly Malpass in the death of 2-year-old Avalena Conway-Coxon and the tragedy of baby Samara. DCF social workers and their supervisors should have been indicted along with the DCF certified 600 pound Tuckers.

This topic could make up a college course, from role of birth parents to the government to the foster parents. The only one that we know suffered however is the bay that passed away. I hope that it is not in vain, even though as the me society has turned to civil unrest over anything, I see this case being a quick news story that people will forget about quickly. Society as a whole needs to look at itself to see what changes can be made so people understand the ramifications of all the choices they make on a daily basis. Know if you have sex the outcome could be a child that you and your partner are responsible for, not the state. If you do have a baby or child it is your responsibility to take care of them in everything until they are able to take care of themselves. I could continue but it is getting to long. I hope people read this blog and add to it, especially on this very important topic.

If I had seen this sick baby from across the got dayum street I’d have called an ambulance. A child in this condition would be sent to Baystate Hospital for in-patient IV antibiotics. If somebody is morbidly obese it shows the person can’t take care of him or her self and therefore cannot be trusted to care for a child. Plain and simple. I’m got damn sick and tired of hearing about all the people suffering from food insecurity when we have a huge (pun intended) obesity problem in America. If the government stopped giving the layabouts money for groceries maybe they’d eat less. There were no obese people in the death camps!

It happens Dan, cops make mistakes, sometimes fatal ones. Happened a few years on subway platform in NYC. Most cops have taser and gun on same side where their strong arm is, and have them where they can reach em. As you wrote, and have in the past, the key word is COMPLY. Resisting arrest brings it to another level. One less criminal, and free tv’s and sneakers for the rioters.

You know, there are times when the Officers instructions are unclear and you know Officers play games. They laugh in your face type of shit as your life swirls counter-clockwise down the drain. I’d always comply- until my Will to survive kicks in and a compelling need to escape is beyond my control. Fight/Flight is with the autonomic system. It’s auto pilot. It’s out of the individuals control at that point. People who have been safe in their life, will joke but it’s a real thing. Your life is in jeopardy- you flee, you fight – you think about who is at fault later. Natural instinct, let me see you rise above your Will to survive. So a black man with warrants, driving a car without insurance. When he resisted arrest, assaulted a police officer, and jumped back into his car and sped off he was shot. Whole city riots.

When a second lieutenant gets stopped for no display of plates (he had a temp tag in the car behind illegally tinted windows) drives for miles, ignores commands from police officers, then gets maced that’s the cop’s fault?

Don’t run from the cops, don’t do illegal stuff, you’ll be much better off.

Mayor opened everything up wide and now Covid cases are spiking big time in Pittsfield. Younger people getting it more and more. Is she hiding under a table somewhere or what??? Shouldn’t we be doing something different? She has brass balls when it comes to taking peoples hard earned money and handing it out to friendly types but now she is petrified that if she took appropriate action (like closing shit down) her buddies might get maaaadddd at her. I once had a person tell me their BMI problem was related to a glandular problem which is a medical one. I’m not sure if this person was using it as an excuse for themselves or is it the real cause of the issue. I’ve never heard about that before.

What if parents of all kids mentioned to them that it was a bad idea to give cops shit all the time. Especially when they catch you doing something illegal. Tell them about all the kids that gave cops shit that got shot. If it is too much work for the parents perhaps it could be mentioned a couple of times in school. Or it could be a question on your drivers license test, “What kind of bad things can happen if you give a police officer shit while he is trying to do his job?” Maybe it could even become a rap song or Miley Cirus could sing about it while swinging from a wrecking ball.
It seems simple enough. If you can’t stop breaking the law at least stop giving cops shit when they question you about it.

DCF is rewarded for their deadly failures. When police/paramedics arrived at the familiar address (as police had responded to more than 80 incidents involving fraud, domestic violence, neglect, among other suspicious and/or criminal activity) at the DCF approved section 8 foster Hell hole of DCF certified disabled foster Monster Kimberly Malpass they found baby Avalena dead, baby Samara was in a coma, and a third baby, who had to be rushed to hospital. And for those miserable DCF failures an additional 100 million $$$$$ was added to the obscene DCF MONSTER’S budget. The same thing happened when 5-year-old Jeremiah Oliver went missing. DCF socials worker’s falsified records indicated that Jeremiah was thriving, even though the truth was Jeremiah’s little corpse had been stuffed in a suitcase and dumped along the roadside to rot away, weeks before. But again DCF’s budget was increased. And DCF MONSTERS will no doubt be rewarded, AGAIN, for baby Kristoff’s untimely painful torturous death. I guess we can at least thank Allah that the 600 pound DCF certified gluttons didn’t devour the evidence.

The audit said the agency did not consider sexual abuse as something that rose to the level of “critical incident,” and that’s why the agency did not report at least 118 case of sexual abuse of minors in foster care. The agency also failed to reports more than 260 foster care incidents which apparently did not rise the level of “critical incidents.” Incidents which included, but was not limited too: Gunshots Wounds, Burns, Head Contusions and other Serious Bodily Injury to Children, in foster care, under DCF’s protection.

Anytime there are co-defendants in a case, married or not, each defendant is assigned his/her own attorney. Attorney Sheldon is a private attorney who is also a bar advocate and was assigned in this case. There is nothing nefarious with this arrangement. What is disgraceful, imho, is Harrington holding a presser outside the court following the arraignment. This is another example of her incompetent political hack self milking a tragedy to promote herself. Most District Attorneys have pressers when there is a public safety concern. Not the case here. Perhaps she got word that Attorney Kempthorne would be featured in the Eagle for receiving an award for blowing the whistle on Harrington’s failure to disclose on the Simon’s Rock case?

Attorney Sheldon is representing him as a bar advocate which means she is getting paid by the state, not by the client. A bar advocate has to be used as the wife is represented by the public defenders office and two attorneys from the same office cannot represent two co-defendants – to do so would be a conflict and a violation of ethical duty. We disagree as to the presser.

Yes. But only because they qualify for state appointed attorneys. There is an inquiry into income. Private representation on a case such as this would require a substantial up-front payment.
