Zealots, for all their inability to comprehend, reason, do possess a certain piquant innocence. After telling THE PLANET every little thing we’re doing wrong, she tried to justify “Andrea’s track record.
Trying to keep it a fair fight, let it be said THE PLANET didn’t bring the “track record” up. She did when we asked, specifically, why she thinks Andrea will win “going away” (and we wish she would!).
“Her track record.”
Then, stepping on the claymore she buried herself, the True Believer asked me not why I think Andrea would lose but why did I think she won’t win (a subtle difference our good friends the lawyers, barristers, and esquires will appreciate).
With a Buster Keaton face, we replied: “Her track record.”

It would have been entertaining to get a transcript of the woman’s bumblingly stirring defense of the county’s chief prosecutor. The word-toss reminded me of the North Korea’s announcement yesterday of COVID in Pyonyang:
“A most serious emergency case of the state occurred,” the Korean Central News Agency (KCNA) said. “The state emergency epidemic prevention command and relevant units made deliberation of the result of strict gene arrangement analysis on the specimen from persons with fever of an organization in the capital city on May 8, and concluded that it coincided with Omicron BA.2 variant which is recently spreading worldwide rapidly.”
To which we say, “exactly.”
The woman also said Andrea “would love to meet with THE PLANET” — provided we were handcuffed in a chair and forced to listen to a “re-education speech,” which she would personally deliver as part of THE PLANET‘s rehabilitation into “right thinking.” Included in the curriculum: The finer points of “restorative justice.”
We’ll hear about how The Kapanskis need to “invest” in our young punks, gang members, bums, layabouts, junkies, pushers, pimp, illegals, and prostitutes. Invest? How about a swift kick in the butt for all those who won’t pull their fair share and who would rather live free, cradle to grave, on all the levels of government — city, state, and federal — that have royally screwed the Bay State.
Royally. And we thought the Founders didn’t want an unaccountable monarchy.
Actually, we remain open to meeting with the district attorney. All she has to do is dial “V” for “VALENTI.” THE PLANET has already had long, private meetings with Bob Sullivan and Tim Shugrue, who began this cycle as Harrington opponents. Sullivan has since dropped out of the race and thrown his support behind Shugrue. When the phone doesn’t ring, we’ll know it’s Andrea not getting back to us.
Since there is no Republican or independent candidate (Sullivan was the latter), the Sept. 6 preliminary election will decide the winner. November will be a mere formality, the rehearsal for a January coronation. As we approach that date, THE PLANET shall be increasing our coverage, for the simple reason that there is no more important local election this year. The stakes: the future of public safety in Berkshire County, particularly Pittsfield, the county seat.

Tim Shugrue, veteran prosecutor and defense attorney whose has been in the court room thousands of times, has been quietly but effectively building a campaign organization that will draw upon a vast network of resources, time, talent, and treasure. Shugrue has hit the ground doing a fair version of a campaign’s Usain Bolt. O Salutaris, Hostia.
Meanwhile, Andrea has yet to formally announce. She’s laying low, so low that Chubby Checker has put her on speed dial for his next Limbo. THE PLANET wonders why? Could it be her terrible track record? Is she playing rope-a-dope? If that’s the case, she’s going to lasso herself. Is she trying to lull Shugrue into a false sense of security? If so, she might have already flown past the fail-safe point.

Yet another subjective personal attack against Berkshire County District Attorney Andrea Harrington by blogger Dan Valenti. This time it her track record of 3 years, 4 months, and 12 days of prosecuting crimes. Just like Santa Claus, the Easter Bunny, Unicorns, and a Fortune 500 company moving to Pittsfield, prior to 2019, Pittsfield was a utopia of living wage jobs, Level One public schools, political integrity by honest public servants, safe streets, and a downtown arts district that rivaled Paris, London, NYC, and L.A. But then “the big bad” Andrea Harrington became the D.A. in 2019, and she caused Pittsfield to become a dystopian disaster. Add to that Trippy Country Buffet and the lovely Linda Tyer, and Pittsfield has three evil witches destroying the Berkshires with their evil spells. Now the man, the myth and the legend named Tim Shugrue is promising to bring Pittsfield safe streets, but we have heard those failed promises to restore Pittsfield’s glory days of the post-WW2 1950s & 1960s era for about 50 years now. Should we be holding our collective breath for Tim Shugrue to be Pittsfield’s one true Savior and Messiah? Tim Shugrue touts his decades of legal experience, but he hasn’t listed his successes and failures as a Berkshire-based Attorney. I wonder why? Not really, of course. In closing, Tim Shugrue’s promises are about as worthless as Jimmy Ruberto’s Rolodex, which I heard can be found at the bottom of Silver Lake.

(1) No, I will not criminally charge Andrea Nuciforo. The “actions” you listed do not rise to the level of criminal activity. I believe the last three District Attorney’s over the past 20 years or so, (Downing, Capeless, and Cacciviello) have already told you such. Have you considered using some of Mr. Nuciforo’s medicinal medication to “chill out?”
(2) No, I will not use the Office of the District Attorney to “decriminalize outdoor masturbation activity.” There is nothing wrong with “self love” Mr. Melle, however; you must do that in the privacy of your home. Masturbating in public is a criminal offense and this office will prosecute to the fullest extent of the law, if you are a white male. May we suggest you grab some balls, the recreation type Mr Melle, and go outside and burn off excess energy?

I am proud of Andrea Harrington, who graduated in my sister (THS) High School in Pittsfield along with me in 1993. Her professional accomplishments are praiseworthy. I have written that her tenure as Berkshire County District Attorney has been problematic at times. I have also written that prior to 2019 when she became the D.A., Pittsfield’s violent crime rate was still in the top ten cities by population in Massachusetts, according to the FBI’s annual reports. To be clear, Pittsfield has NOT changed its violent crime pandemic since 2019. As for Nuciforo, he viciously persecuted, bullied and threatened me, as well as my dad, Bob Melle, who was an elected Berkshire County Commissioner (1997 – mid-2000), he (Nuciforo) was in bed with the Boston Financial District when he was a Pittsfield State Senator, which led to him having to step down from the post in 2006, and about a decade later, he (Nuciforo) used his political connections in Pittsfield and Boston to cofound his multimillion-dollar marijuana business called Berkshire Roots for a little over 5 years since March of 2017. Nuciforo got away with being a corrupt politician for over 25 years now. D.A. Andrea Harrington probably knows all of these matters. Nonetheless, I am proud to support D.A. Andrea Harrington for reelection in 2022.

One from you claiming harassment etc. . and the other side you don’t mention where you harassed him where he had no choice, but to seek help in stopping you. He took your harassment seriously as others have through the years ,that had contact with you while you ran your mouth and scared them as well. The disposition means Smith did not have to admit to any wrongdoing in order to resolve the matter in Central Berkshire District Court.
Three arrested for firing gel pellets at bystanders in Pittsfield
Pittsfield Police said in court documents that in early March, occupants of a silver SUV fired what appeared to be pellets at a woman as she walked near the Madison Cafe.
Not long after, a man reported that he too had been shot with an apparent pellet while he stood at Park Square, and provided police with a similar description of the suspects and their vehicle.
A third report was then lodged by two people who said they were struck with gel pellets outside of Crossroads Cafe on Onota Street. Police said Smith was in the passenger’s seat of the suspected vehicle when officers stopped it at West Union and John streets.
Additionally, Maddalena said police had received three additional reports of bystanders being struck by pellets fired from a moving SUV one day earlier, on March 5.
On that day, a food delivery driver was reportedly struck in the back of the neck while making a delivery; a person was struck while standing at the intersection of West and Center streets; and a male and his son were shot at while walking to see a movie downtown, according to a police report.
Great for tourism, innocent family and working people getting shot by 19 year old thugs.
According to the lawyer for the driver of the vehicle, 19-year-old Jah’Rell Mayes, they were firing Orbeez, a popular brand of gel beads that expand in water, from a water gun.
Police initially charged Smith with several counts of assault and battery with a dangerous weapon and a single count of disorderly conduct, according to court documents. Mayes’ case has been continued to Wednesday.

Lawyer Elizabeth Quigley is absolutely horrible. She runs up clients bills as far as she possibly can and causes greater conflict between people in order to reap the benefits financially. The victims overwhelmingly supported a resolution that would quickly get the most money back. This is an excellent outcome that makes the victims financially whole again.

None of this happens under DA Wrong Way. Instead she uses the DA’s Office to advocate for legal heroin injection sites, not thinking of the dangers and scourge that will linger around a place like that. She uses the office in identity politics: David Moody (LOC, 3.5 yrs prison for firearm charge, 3-striker) vs Lonnie Durfee (w/m, 2 yrs prison, burning hay bales only).
Facts like this should scare a wing nut like you JM. After a few of your “Dear Andrea” letters go unanswered, you’ll come unglued. Then the insulting letters and JM rant letters follow. Soon after, she will have the NH State Police pick you up and you and Lonnie Durfee will be “cellies” together.

Timothy Shugrue, who currently is running for District Attorney of Berkshire County, got all charges dismissed for Meredith D. Nilan, the daughter of Berkshire Superior Court Probation Chief Clifford J. Nilan, who got really drunk at a Berkshire Young Professionals event at Mission bar in downtown Pittsfield.
She then drove her daddy’s car and hit and broke the neck and caused brain damage to Peter Moore, 45. Then drove away. Days later she said she hit “something like a deer.”
She got to move on with her life, including living it up in NYC for years, and now has a cushy job at General Dynamics and married a millionaire Allegrone. Berkshire County’s very own Paris Hilton. Never faced a single charge. I’m sure she cried all the white women tears she could and daddy had everyone in his pocket, including a possible future DA.
Do we really want someone who bends the justice system to the elite to be in the most powerful elected position in our local justice system? Peter Moore will always have brain damage and severe physical, emotional, and mental pain from Nilan’s complete disregard for others’ lives.
That’s not my DA. The Berkshire can find a better candidate if they want someone to run against DA Harrington.

Do you actually know the function of a defense attorney, which Tim was at the time? It’s to DEFEND his client under that client’s constitutional privileges and those of the judicial system. Mr. Shugrue did that job and did it well. He was a DEFENSE lawyer at that time, as he is now. You conveniently dismiss, ignore, or aren’t aware of his years as a prosecutor. This was prior to going on the other side. As a prosecutor, he had a sterling reputation as fair but tough, not the guy you wanted to face if you were a criminal. JS, consider the implications of this in terms of the functional nature not just of the courts but of the entire judicial system. That system is made up of imperfect human beings, who are functioning of within a theoretical framework that assumes an impossibility, which is that humans can match the ethical and moral perfection to which idealism strives. In plain English, you have an imperfect system, but it’s the best we’ve yet devised, all of which makes it a kind of game. In any game, you want the best players, the ones who know it inside and out … the ones who have dedicated their lives to it … the ones that have a passion and love for what they do … the ones who can lift themselves above and beyond their narrow self-interests and see it as a game (with the courts, a serious game to be sure) … the ones who can employ their passion dispassionately. That’s what Tim Shugrue did as a prosecutor when he had a great track record of putting criminals away, and that’s what Tim Shugrue did with his defense of countless clients. That’s the person I want as MY lawyer, who as D.A. will assume that title and responsibility and not just for me but for every decent person in Berkshire County. I want a lawyer who has been in court countless thousands of time, not one whose appearances beyond the rail can be counted in single digits (with most of those being failures). In short, both THE PLANET and Dan Valenti can’t think of a better candidate for D.A.
I don’t care about Shugrue’s other cases. I care about this one. This isn’t an imperfect system, this is a travesty of the legal system. I care that he’s a sleaze who made sure a privileged princess got to walk away from breaking a man’s neck and causing brain damage. All because of who her father was. And from what I remember you were all over this case. So much so, that a harassment order was placed against you, Dan. I think you’re so confused over the fact DA Harrington ignores you, you’ll take any pos to run against her. Pittsfield can do better.

You’re the one who is confused. The harassment suit brought against me by Ms. Nilan was done on her own, without and then against legal council. The suit was filed ex parte (I didn’t even know about it) and granted by a veddy politically correct female hispanic judge who didn’t like the press, particularly white, middle-aged, male muckrakers. It was a temporary stay. One week to the day later, before a new judge, I answered the charges and for six hours took apart why the harassment order was frivolous. My defense was the first amendment. It’s interesting to note that Meredith wasn’t represented in that case (which was separate from the Peter Moore incident) not by Tim Shugrue — something of which you seem unaware — but by our good friend Mark Brennan.
I won the case the moment I asked if anyone could point to one factual claim I had written that was not true. Case over.
The case became a nationwide precedent that clarify constitutional rights for writers in the blogosphere and drew nationwide coverage. I was later told that Meredith went against legal counsel in filing the suit. Her legal team knew she had no case. Again, you seem to be unaware that Meredith did face charges, paid her restitution, and went on, as far as I can tell, to a good, productive life, and I’m pleased with that. You should be, too. If met her today, I would wish her well and every success.
By the way, the DA doesn’t ignore just me. She ignores any legitimate member of the free press who dares to ask uncomfortable questions. She’ll only deal with sycophants and toadies. Glad to educate you on the case. No charge, BTW.

Shugrue is just another pawn in the system, making sure the guilty aren’t punished. The only people that want him, are defense lawyers… he’ll make sure their pockets stay fat. It’s up to prosecutors to win cases for We The People, something that isn’t done now because so many cases don’t go to trial or are dismissed … something, by the way, that Tim Shugrue has done in his many years as a successful prosecutor. Believe me, if you were a criminal, and you saw Tim on the other side standing in for the Kapanskis, you were going to do time. Guilty as done, guilty as charged. It will be that way again should he become Berkshire County’s next D.A.
