PLANET OBTAINS PAPERWORK OF CITY’S INVOLVEMENT WITH e-SCOOTERS; LIES, LIES, AND MORE LIES

(FORTRESS OF SOLITUDE, WEDNESDAY MAY 11, 2022) — Despite Pittsfield’s attempts to hide the paperwork associated with its disastrous rollout of the e-scooter program, THE PLANET‘s Z-Agents managed to get a key piece of the paper trail.

We obtained the “Memorandum of Understanding” (MOA) between the city and Bird Rides Inc. of Santa Monica, CA.

THE PLANET can accurately sum up the city’s claims about this boondoggle in four words: Lies, lies, and more lies.

The document is labeled “MOA.” It’s not a contract. What’s the difference? We went to a well-known local barrister, “Perry Mason.” (S)he explained that, unlike an actual contract, a MOU is not legally binding. Only contracts legally bind parties to an agreement.

This is a big deal.  All those safeguards that Flat Tyer and Ricky’s Rumpus indemnifying the city have no legal standing. After reading the MOU, Mason said the city is exposed to lawsuits connected with the scooters: “This [MOU] leaves the city wide open to actions that might occur with the use of these machines.”

“Does that include financial liability?” we asked.

“Yes,” Mason answered. “Legally, [the MOU] is worthless.”

Join THE PLANET now as we lead you through some of the specifics. The fine print is that none of it is legally binding. In legalese, Bird Rides Inc. has flipped the Bird on the rubes in the corner office and roundabout.

The preamble states: “This agreement shall remain in effect until November 1, 2024 (not more than 36 months from agreement’s effective date) unless terminated as set forth below.” You’ll recall that when the city introduced this program, it said one year, not three years. Flat Lie #1.

Clause 1 states: “No person shall deploy a Stand-up electric scooter sharing system in the City in violation of this Agreement.” Actually, violations are all we’ve seen since the Birds began flying.” Flat Lie #2.

In clause 2, after stating the rules of use, we find this whopper: “Users of Stand-up electric scooters shall be 18 or older.” Reality: probably 95% of the use has come from children. Flat Lie #3.

Clause four states the scooters’ hours of operation as 5 a.m. to midnight. When the city announced the program, it said 5 a.m. to 9 p.m. Flat Lie #4.

Clause five states that Bird “shall provide a minimum of 50-75 vehicles at launch.” THE PLANET doesn’t know the exact number, but the number of scooters was between 20 and 30. Flat Lie #5. Included in clause seven isn’t a lie but a beaut of another sort. It states that Bird Rides will provide materials that “educate riders on rider responsibilities and encourage safe and courteous riding and parking.” Apparently, the 12- and 14-year olds who have been using the Birds to play chicken haven’t read these materials. Of course, if they are PPS students, they don’t know how to read.

Clause 10 is THE PLANET‘s favorite, the indemnification clause. You’ll recall Flat and Rumpus made a big deal about how the city would not be on the hook for any legal issues. Clause 10 speaks otherwise. Cluase 10 states: “The City expressly acknowledges that in no event shall Bird Rides Inc. be liable for any special, indirect, consequential[,] or punitive damages.” Translation: If lawsuits ensue, Mary Jane and Joe Kapanski will be footing the bill. Flat Lie #6.

Clause 14: “In carrying out their responsibilities, the parties remain independent contractors, and nothing herein shall be interpreted or intended to create a partnership, joint venture, employment, agency, franchise[,] or other form of agreement or relationship.” Mason laughed when (s)he read this. It lets Bird walk away from everything and anything if problems arise. So much for the strongly implied joint venture that Flat and Rumpus triumphed. Flat Lie #7.

Clause 15 says Bird may use “independent business logistics providers to facilitate local operations.” Bingo! Here’s where the parties made provision for sneaking in the services of “Pocket Trucking LLC.” Pocket operates out of an 800-sq.-ft. apartment (305) at 81 Dartmouth Ave. CEO is Timothy Lanfair, self-described “Bad ass tech guy … to make it all look dope.” No one has yet to come forward to explain Lanfair’s arrangement with the city or to reveal the rumored connection he has “someone” in city hall. Flat Lie #8. THE PLANET wonder if there’s any paperwork connecting Bird, the city, Pocket Trucking LLC, and/or Timothy Lanfair.

Finally and most curiously,  nowhere on the MOU do we see an effective date. As you recall, the MOA’s preamble refers to the arrangement not to last more than 36 months (Flat Lie #1) from “the effective date.” Well, if there is no “effective date,” then we are dealing with infinities. It’s SO Pittsfield.

The MOA is signed by Linda M. Tyer and Austin Marshburn, Head of City and University Partnerships. Hmmmm. What about Clause 14 (Flat Lie #7), which states there shall be no “partnerships?” Another Flat Lie?

Other than these small discrepancies, the Bird-Pittsfield e-scooter program has been delivered in truthful, honest, and transparent fashion.

And that’s the biggest lie of all.

As for the MOU, THE PLANET recalls the wisdom of MGM’s Louis B. Mayer: “An oral contract isn’t worth the paper it’s printed on.”

Was on north street tonight.
Watched kids ride against traffic heading north in the southbound lane by Berkshire bank. Drove right towards a PPD SUV, made it stop in the middle of north street, kids turned down Depot street. Cop went on his merry way onto Fenn St.
Cop didn’t do a damn thing.

That really does seem to be the case. Not a good look for a macho police chief but probably too late for him to change lanes. She seems to have gotten a hold on most of the city leadership and it shows. The city has become an embarrassment and no spin from local media is going to fix that. The main guy who was suppose to provide oversight (Peter Marchetti) sold out every city resident by aiding and abetting the negative forces. So he holds a ton of thhe blame for what has happened in Pittsfield. He could have given the city hope, but for whatever reason chose not to.

If you are on the fence about leaving today is a good day to start the process.

It makes you wonder if Marchetti is getting even with the taxpayers now for not voting him the mayor a few years ago? He really seems to have it in for them. And not in a good way either.

As far as Mike Wynn goes, as I’ve stated before on the Planet. When it comes to policing, Mike talks the talk, but he never walked the walk. Tony Riello took care of Mike back in the day. Ask any officer with over 25 years on or recently retired officers. They’ll tell you.

Back in the day, when the summer months hit and patrol was very short, Mike was off attending training in Boston. When the majority of PPD were getting tasked with the 4th of July parade, Mike was off in training in Springfield. When PPD had to hold officers over shift (basically forced OT, but union approved) because of sick call-outs, Mike was teaching at (fill in the blank) police academy. Get the idea?

Mike is what’s known as a “paper dragon.” A resume to dazzle, but when you probe a bit about the actual job, the stories are always of someone else’s arrest or incident. Or about a scenario in training he covered, but not actual handling dangerous offenders.

Plus, Mike was a big advocate to get rid of civil service protection for the police chief’s position. Civil service protection for the chief kept a meddling mayor, NAACP Denny Powell, Shirley Edgerton, and others at arms length from the chief. Not anymore. This is the result.

Pittsfield has a murder’s row of do-nothings: Flat Tyer, “chief” Wynn, Ricky’s Rumpus, Jumpin’ Joe Curtis, DA Wrong Way, Pete Marchetti, food critic Pete White, and the creme de la creme of do-nothings: Tricia Farley-Country Buffet (D)

And the sad thing about that if you remember, Bianchi hooked up his buddies by having departments from city hall moved to his buddies office space on North Street.

If memory serves me correctly, this abomination only cost the city $500,000.

At least Dan somewhat cared about the city. Flat Tyer doesn’t give a damn. Potholes, garbage decorates the streets, bums and junkies on every corner.

You would be correct. Warren Dews, Shirley Edgerton, and company just got $700,000, to help start up black owned businesses.

Seems good in theory, until you realize that Warren’s wife works in the mayor’s office, Shirley is a paid (charlatan) city employee, and they aren’t even a current business to help show and lay the groundwork for new start-up businesses.

Oh, and the beneficiary of the gift, Warren, is opening up the first “black owned” business with Harmony Persip (sister of city councilor), in an area not zoned for commercial use.

The city just screwed the taxpayers again!
The board of health is now locked in a lawsuit in Federal Court, being sued by Verizon.
The Telecommunications Act is pretty damn clear, local and state governments can’t restrict sighting based on RF output, only the Feds can and ONLY if it’s violating RF output levels.

That’s gonna be a million dollar plus lawsuit, Verizon will get all its legal fees back, prolly get punitive damages all because a bunch of idiot BOH members couldn’t stay in their lane.

Also the eagle doesn’t seem to have any editors, it’s a 5G tower, not 4G tower. That’s the whole point, 5G kooks complaining about nothing.

What prompted Mr. Worldwide’s response on May 9 to my posting of a problem our so-called downtown business district has? North Street, our former business district is dead, and to give parking tickets to customers visiting the few businesses we have makes no sense. Take a look at what we have done to ourselves. At one time downtown had 6 movie houses. Football games were held at Wahconah Park. A marvelous train station was located at the bottom of West Street hill. Advertising posters were not allowed on the grass at Park Square. I know time marches on and changes are inevitable; however, many of these downtown changes that destroyed Pittsfield were made with approval from elected officials, and before GE and all mills left us. Is it any wonder why corporate officials washed their hands of us? Now we’re fortunate to have someone come here to make a few hot dogs for us.No one should be afraid of facing and honestly discussing our problems.

I don’t think I misread anything. If downtown is as dead as he says it is, why did he have to illegally park? There should have been many open spaces within a few 100 feet of his destination. Is he that lazy that he can’t walk 100 feet?

Maybe Chuck is wrong and downtown isn’t as dead as he would leave you to believe. All the spaces were taken and he had to park illegally, and therefore was entitled to do it without consequences. That or walk a long way from a parking garage (oh the agony of it all).

His parking was an attitude of entitlement and arrogance, period. If you still think it wasn’t I ask you this…was he entitled to park in a handicapped spot? If not, why not?

What is the difference between parking in a handicapped spot illegally and a no parking zone illegally? Both are illegal, right?

Mr W, parking on North St is ridiculous. The foolish meter system that doesn’t except cash forcing people to use credit cards. Then some nameless company collects your personal information and turns around and sells it.
Only place I would go is Carr Hardware.

My question to you would be how much over the line makes a vehicle illegally parked? If he was half in the spot was the car behind him double parked and did they also get a ticket? Many questions about this high crime on NON! I want photographs and fingerprints, where is Arlo? I think I see a song in the making!

Downtown UPSTREET, along with the rest of this shitty city, is a dangerous SHITHOLE of unenforced rules and crime! This shitty city bends over backwards to accommodate the houseless unwashed vagabonds. The unwashed houseless, with the blessing of shitty city officials have turned public parks into tent city encampments. Shitty city officials have made traveling on NOTHING ON NORTH dangerous with all sorts of obstacles littering the ROADWAY. Drivers are confronted with subsidized kids on scooters riding in the middle of traffic, scooter riders are riding these free rides on both sides of the ROADWAY, on the wrong side of the ROADWAY, and directly at oncoming traffic. Two days ago, a young male on a skateboard, in the middle of the roadway, came directly at my vehicle, forcing me stop. I don’t know how he managed to do it, but to his credit, he flipped his skateboard not two feet from the front of my vehicle and caught it in air. Running into the bank for a few minutes seems the lesser of offenses. I’ve actually reported bums outside that bank begging for money as I left that bank. Apparently, the bank can’t do anything to stop city welcomed houseless bums from panhandling on shitty city property outside the bank.

Chuck, I too remember when North Street was “vibrant and dynamic”.

Free parking, no asinine curbs to impede snow removal , four lane traffic without unused bike paths. The street lined with open rather than vacant stores/buildings, England Brothers, Thursday nights when ALL the stores were open late………as a tyke I saw some of the future 67 Sox play at Wahconah…….the roads were well maintained and not similar to the current moonscape…….

Parking tickets are one of Flat Tyer’s “economic engines”, just like the meters (where is Cool Hand Luke when you need him) that are a PITA and another “economic engine” that drives shoppers to the malls. Does that loot cover the “meter maids” and their cars?

Carr Hardware is fortunate to still have it’s own free private parking.

Maybe they could put up some new signs, at the city limits: “Entering vibrant and dynamic Pittsfield, please donate to the bums at each traffic light”

And Mr Worldwide’s are part of the problem too.

What about Flat Tyer and deadbeat Lanfair’s scooter squadrons? Seems roads, sidewalks, bike paths, parking lots, they been inside buildings yet?………..are all scooter right of ways with no restrictions on direction, or rules.

Is there a pan handling law in Pittsfield? If so can it be enforced and if not can we make one up to stop the constant begging?

Just for there own safety they should not be allowed to loiter on the islands. Signs should be placed in the island directing people not to give any money to them, but donate to local food pantry’s or other social services.

Thanks Dan for the very informative article today. Totally unbelievable that Liar Tyer has put the City in this position. In reading your article, one thought came to mind. Did Liar Tyer even check with our illustrious City Attorney Pagnotta before signing on the dotted line? Although in all the times I have watched Pagnotta at CC meetings he seems to be uninformed and lacks answers on every issue. Definitely he is not the sharpest tool in the tool shed. Probably why his law office sent him to Pittsfield, he seems like an embarrassment. I am sure the City pays him well. Not only has Liar Tyer opened the door to lawsuits, City is now being sued by Verizon Wireless. Was Pagnotta involved in this upcoming potential mess. Also, did Liar Tyer consult Pagnotta before her signing of the Coventa contract? At this pace, City of Pittsfield will be broke by the time Liar Tyer’s term is up. Can anyone name one positive thing this woman has done for Pittsfield?

As I was typing this was listening to a “low” speed police chase of someone on a scooter from the Allendale area to the Elm Street area. Scooter was in and out of traffic, chase was called off because scooter rider did not have a helmet on, the City was fearful the rider would fall. Wynn is probably afraid of a lawsuit if they fell. Great, so I guess another issue that the honest law abiding taxpayers have to deal with. It is down right scary driving in Pittsfield with the lack of traffic enforcement. Thanks Liar Tyer.

And for those who don’t know, insurance companies will spare no expense investigating any incident that has potential liability attached. The ultimate goal of insurance companies, pay as little as possible.

Clause #14 allows The Bird Company to just pull up their stakes and leave town. This just happens to be the “catch-all clause.” This clause kicks in when either Bird is losing money in Pittsfield or a civil lawsuit is pending and much like GE, Bird will put the vibrant, dynamic, and inclusive city, in its rearview mirror.

This is just a partial but quite accurate list of Pittsfield problems, almost all of which have come about as the result of corrupt government. If a real mayor was to take over tomorrow, one that intended to try to make a serious course correction, it would take him or her ten years to undo the damage. And that would start with immediate hacking away at wasteful spending and chopping taxes.

But the reality is that, that scenario is unlikely in a burg with stage four cronyism and a very short life expectancy. And if you, as a middle income taxpayer in Pittsfield, Ma. think that you can survive this spiral, or outlast it in hopes of better times, you will find out the hard way. That new deck, that new car or that child’s college education will either be out of your reach or bury you in credit debt. I keep repeating this because it is true and I hope to save at least one family from the Pittsfield smother. And that is what Pittsfield does, it smothers you slowly and you do not even know it is happening until you find yourself unable to pay your bills without running up more credit debt.

He had predicted the water rates would sore and sure enough they have started to go through the stratosphere. You do realize the US sets prices for the world based on our demand.

We use 4x the amount of gas that china does in one day. So if prices are going up for us, they go up for everyone (except the oil/OPEC states). They are tracking lower both on percentage increase and their prices are dropping while ours are rising.

Europe has always been more expensive because they don’t have massive oil fields.

Not certain what that means I can only assume its going to be rolling by on the scooter grabbing a bag or purse then scooting away. $10.00 to your charity if it isn’t a scooter mess that night.

PITTSFIELD, Mass. — The mayor is proposing a nearly $189 million budget for fiscal 2023 that is about $10 million higher than the this year’s $179 million budget.
Mayor Linda Tyer’s request to raise and appropriate $188,589,144 for the FY23 operating budget was referred to the Committee of the Whole on Tuesday.

Departmental deliberations will begin next week on Tuesday, May 17, with a public hearing on the budget and five-year Capital Improvement Plan, which was made available to the public on Tuesday.

The budget proposal includes $242,784 for the mayor’s office, $109,262 for the City Council, $9,138,800 for the Fire Department, $11,927,437 for the Police Department, and $56,686,954 for unclassified spending.

The proposed school department budget is $72,398,262, which is a 7.56 percent, or $5,086,562, increase from this year. Most of the increase is in contractual obligations, which increased by about $4.7 million.

Within the school budget is $1,895,347 for administration, $55,822,847 for instructional, $4,526,341 for other school services, $6,372,746 for operations and maintenance, $472,358 for fixed costs, $68,074 for adult learning, $234,047 for acquisition of fixed assets, and $3,626,502 for tuition payments.

With $570,000 in school choice revenues and $50,000 in Richmond tuition revenues, the total budget amounts to $73,018,262.

Three orders related to the Community Preservation Fund were also referred to the Committee of the Whole: to Amend Order 45 of the 2021 Series, appropriating $974,480.93 for the FY22 Community Preservation Fund budget; to appropriate $670,317.00 from the FY22 Community Preservation Fund budget; and to appropriate $818,435.44 for the FY23 Community Preservation Fund budget.

Last summer, the council adopted an overall budget of $743,451.75 for the fiscal 2022 administration of the CPA. Eleven of the 13 applications received were deemed eligible and funded for a total request of $716,782, with a further reduction after two projects were further refined the costs of their projects.

Governor Charlie should finally take responsibility and apologize to the Veterans and their families for his administration’s mismanagement of the Holyoke and Chelsea Soldiers Homes during the Covid-19 outbreak that claimed dozens upon dozens of lives there. Massachusetts state taxpayers will be paying for the state’s proposed $56 million settlement. When my dad, Bob Melle, was a Berkshire County Commissioner (1997 – mid-2000), I went along with him to Beacon Hill whereby he testified that Boston’s “Big Dig” was costing state taxpayers well over $10 billion back then. Guess who managed Boston’s “Big Dig’s” public financing back then? The answer is then bureaucrat Charlie Baker. How much state taxpayer dollars have Charlie Baker cost state taxpayers due to his failures in public management and leadership? Moreover, the corrupt career politicians on Beacon Hill are still sitting on billions of dollars in surplus state cash and “Biden Bucks”, while they recently rejected all state legislative proposals to provide tax relief, including for Veterans, Senior Citizens and working-class commuters. Beacon Hill lawmakers are proposing a $50 billion fiscal year 2023 state budget that will cause even more economic and financial pain for state taxpayers while our country will soon be dealing with an upcoming brutal economic recession by the end of the year of 2022. I believe that the Solons in Boston don’t care about the people and taxpayers who they are taxing and spending to death. Massachusetts is among the top property tax states in the nation, while Boston area big businesses receive nearly $18 billion per fiscal year in state tax breaks from the corrupt state lawmakers in Boston. To put the proverbial cherry on top of the proverbial cupcake, Beacon Hill lawmakers will soon go on their 5-month long taxpayer-funded vacation from August 1, 2022, to December 31, 2022. Charlie Baker should resign in disgrace, along with the entire Massachusetts State Legislature!

Charlie Baker is sure a Republican when one looks at the tens of billions of supply side economics state tax breaks that he has given away over the years to his politically connected big business buddies in the Boston area. I am still impressed by Mayor Linda Tyer for calling him out for shortchanging municipalities and public-school districts with state-administered federal/state aid dollars for municipalities and public-school districts. What really impressed me is that Linda Tyer understands public management and financial policies, which means she is nobody’s fool, unlike so many past Pittsfield politics’ failed Mayors. The next Governor of Massachusetts would be wise to hire Linda Tyer to manage their state government administration and finance office. If I were a would-be Governor, I would ask Linda Tyer to work for my administration.
